<p>We convinced the Bronx District Attorney&#8217;s Office to <a href="http://robertlgreenberg.com/2012/08/defense-of-the-bronx-da-policy-to-decline-to-prosecute/" target="_blank">decline to prosecute</a> in a case involving possession of a controlled substance&#8211;our client&#8217;s own prescriptions, in his own home.</p>

<p>Later in the week the Brooklyn DA&#8217;s Office dismissed all the charges in another case.  In that case, our client was arrested for Felony Burglary as a Domestic Violence charge, and now is a free man.</p>

				<content:encoded><![CDATA[<p>Four years ago, a Kansas man donated sperm, but now the courts want him to pay <a title="Court case query: Is Topeka man a sperm donor or father?" href="http://cjonline.com/news/2012-12-28/court-case-query-topeka-man-sperm-donor-or-father" target="_blank">child support</a>.</p>
<p>Another example of how technology is several steps ahead of law, because these questions have yet to be fully answered.  If he is &#8220;just&#8221; a sperm donor, he is not on the hook—or so we thought.</p>
<p style="padding-left: 30px;"><em>Nearly four years ago, Marotta donated sperm in a plastic cup to a lesbian couple after responding to an ad they had placed on Craigslist.</em></p>
<p style="padding-left: 30px;"><em>Marotta and the women, Topekans Angela Bauer and Jennifer Schreiner, signed an agreement holding him harmless for support of the child, a daughter Schreiner bore after being artificially inseminated.</em></p>
<p style="padding-left: 30px;"><em>But the Kansas Department for Children and Families is now trying to have Marotta declared the 3-year-old girl’s father and forced to pay child support. The case is scheduled for a Jan. 8 hearing in Shawnee County District Court.</em></p>
<p>If Marotta were declared the father, would that eliminate Bauer&#8217;s obligations to the child?  This will be an interesting case to follow, but is also an important lesson for future donors.  If it is held that the donors are liable for the child&#8217;s costs, then donations will necessarily plummet.  Another example of basic economic incentives at work: If the costs of donations increase, then donations will decrease.</p>

				<content:encoded><![CDATA[<p>Brooklyn assistant district attorney Imran Ansari was arrested for <a href="http://www.nypost.com/p/news/local/brooklyn/drunk_with_power_UhcTDoNobI7W4VHgibcgfL" target="_blank">refusing to pay his taxi fare</a>.  Ansari insisted that, as an ADA, he outranks the police.  Instead he was charged with the crime of theft of services.</p>
<p>Unfortunately this is the attitude of many in the District Attorney offices.  That is: I&#8217;m an ADA, and so above the law.  Cops, prosecutors, <em>etc.</em> are public servants.  The public is their boss, public servants are not the bosses over the citizenry.</p>
<p>This kind of attitude is endemic through the criminal justice system.  New York ADA&#8217;s represent the People of the State of New York—all the people.  In a system filled with people like this, anyone facing the criminal justice system needs a zealous advocate in his or her corner.  We can be reached 24/7 at (800) 3-RLG-LAW.</p>
<p>Full disclosure: I worked as an ADA in Brooklyn and elsewhere in NYC, but I never met the subject.  Also, no NYPD cop would ever take kindly to this line of argumentation.</p>

				<content:encoded><![CDATA[<p>The U.S. Marine Corps will now be <a href="http://www.washingtontimes.com/news/2012/dec/14/marines-to-test-for-drunkenness-duty/" target="_blank">conducting regular, random breath alcohol tests</a>.  Marines will be required to submit to a breathalyzer test and those who register a blood alcohol content (BAC) level of .01 or greater will receive counseling.  Greater than .04 and a medical exam will be ordered.</p>
<p>In most states, the (BAC) to be considered &#8220;drunk&#8221; for DWI or DUI is .08.</p>
<p>The military has been conducting regular, random urine drug testing for years.  These measures help to ensure the safety of those in the combat zone.  A soldier, sailor, airman, marine, or coast guardsman who is under the influence of drugs or alcohol is a danger to those around him or her.</p>
