From time to time, I take the opportunity to post things I read that are thought provoking not only to &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/wordpress/category/jobs-for-felons/"&gt;ex-offenders and felons&lt;/a&gt;, but also those who need to be educated about their plight.  Recently I read an editorial in the &lt;span style="font-style: italic;"&gt;Detroit Free Press&lt;/span&gt; that focuses on a  movement in Michigan that would make it illegal to ask about criminal records on initial employment applications.  The thought is, that if more employers were able to meet applicants instead of simply excluding them on the basis of having a criminal record.  Feel free to leave comments.&lt;/p&gt;&lt;p style="font-weight: bold;"&gt;-Eric&lt;/p&gt;&lt;h3 style="color: rgb(204, 204, 204);"&gt;&lt;a href="http://www.freep.com/article/20120120/OPINION01/201200347/Editorial-A-tiny-box-can-unfairly-slam-doors-on-ex-offenders?odyssey=mod%7Cnewswell%7Ctext%7CFRONTPAGE%7Cp"&gt;Editorial: A tiny box can unfairly slam doors on ex-offenders&lt;/a&gt;&lt;/h3&gt;&lt;p&gt;Nearly 1.3 million people in Michigan -- one in six adults -- have  felony convictions that leave them at a lifelong disadvantage when it  comes to finding jobs and housing or getting an education.&lt;/p&gt;&lt;p&gt;This  week in Lansing, one of dozens of groups around the country fighting  discrimination against people with criminal records -- the Fair Chance  Coalition to Ban the Box -- will launch new efforts to remove criminal  record disclosures on application forms in the state.&lt;/p&gt;&lt;p&gt;Fair Chance  wants Michigan to remove the felony conviction box from state  application forms. The group also plans to push legislation that would  require private employers to remove it. "We're not asking anyone to hire  (ex-&lt;a style="color: rgb(204, 204, 204);" href="http://howfelonscangetjobs.blogspot.com/2011/12/new-bill-in-wisconsin-will-hurt-felons.html"&gt;felons&lt;/a&gt;)," said campaign director Monica Jahner. "It's about giving  them the opportunity to interview with the employer, sell themselves and  tell their own story." New rules would not apply to jobs for which  those with felony convictions are ineligible by state or federal law.&lt;/p&gt;&lt;p&gt;That makes sense.&lt;/p&gt;&lt;p&gt;Blanket  prohibitions imposed on &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/wordpress/2011/07/24/exoffenders-felons-jobs/"&gt;ex-offenders&lt;/a&gt; run counter to Michigan's official  policy of helping ex-prisoners return to the workforce. Whether or not  they include prison or jail time, criminal convictions restrict where  people can live or go to school, what professions they can enter and,  most pointedly, whether an employer will hire them. These barriers  actually encourage criminal activity by preventing ex-offenders from  re-entering the economic mainstream.&lt;/p&gt;&lt;p&gt;An estimated 65 million  Americans have criminal records. Over the last two decades, the  percentage of employers screening for such records has grown from an  estimated 20% to more than 90%. In the information age, those records  are increasingly easy for anyone with a computer to access.&lt;/p&gt;&lt;p&gt;Only  about one in five people with a felony conviction go to prison, with  others serving probationary sentences or short stints in county jails.  Still, many employers refuse to interview otherwise qualified applicants  with even a misdemeanor conviction in their past.&lt;/p&gt;&lt;p&gt;The limitations  placed on employers under ban-the-box initiatives are minimal.  Employers can legally reject applicants based on a criminal record.  Moreover, criminal records are easy enough to find today without  requiring applicants to check a box.&lt;/p&gt;&lt;p&gt;Still, ban-the-box  initiatives have enormous educational value and send a powerful message  to employers, many of whom currently won't consider hiring an applicant  with a criminal conviction. That places an unfair burden on many  citizens who have completed their punishments, and the rest of us pay a  cost when ex-cons can't support themselves through legitimate means.&lt;/p&gt;&lt;p&gt;California,  Minnesota and New Mexico have already removed the question from state  job applications; dozens of large cities have banned the box for city  jobs. Massachusetts allows background checks only after an applicant is  deemed qualified for the job.&lt;/p&gt;&lt;p&gt;In Michigan, Battle Creek has been a  leader, enacting an ordinance in 2008 that generally prohibits city  contractors from having a blanket ban on hiring people with felony  records. In 2010, the Detroit City Council removed questions about  felonies from applications for city jobs.&lt;/p&gt;&lt;p&gt;Encouraging employers  and local governments to give people with criminal records a second  chance is good public policy. I have begun to  facilitate an employment/transition preparation class at the facility.  The class meets for an hour and twenty minutes once a week for about  five weeks. To take full advantage of the time we have together, I want  to make sure that we are covering the most useful information and tips.  In your experience, what have been the most helpful and useful  topics/exercises? If I had to single one  or two things, I would say that the &lt;a style="color: rgb(204, 204, 204);" href="http://www.youtube.com/watch?v=vSbuOpTkyVU"&gt;ex-offenders and felons looking for jobs&lt;/a&gt; would have to present a  totally professional presentation.  That is resume, dress and grooming.   No one gets a second chance to make a first impression.  Secondly, they  must develop a plan of action that would help them get an extensive  list of employers to apply to.  Finding a job is indeed a numbers game.   The more applications, the more interviews. The actual crime occurred 8 years prior in 2003, at the age of 20.   Characteristically, I don't even vaguely resemble the young person that I  was then. I feel like I'm stuck working in a job that has no benefits,  opportunities, or room for enhancement. I was scheduled to begin classes  this year for respiratory therapy, but the board does not allow felon  participants because I will not be able to obtain state certification  here in CA. Furthermore, as a convicted felon, I don't meet criteria to  receive federally funded financial aid to attend any  2 year college.&lt;br /&gt;&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;I make $11 an hour and  can't afford to pay for classes with my limited income.. I feel like  giving up because I just don't know how to turn this around. The DA is  willing to reduce it to a misdemeanor in 2 years and can be expunged  after the $30,000 fine has been satisfied, but realistically, that may  never happen.&lt;br /&gt;&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;In the meantime, I don't  know what to do. I have an 8 yo son and I want to provide him with life  beyond the necessities. This is a really underutilized   resource.  Each state has a network  of  centers that provide an   assortment of free services that can help you in getting a job. In   addition, these centers provide  a long list  of services that can help   people get jobs and even train  them for new  careers. He has an interest in  psychology and broadcasting but not sure if he could have a job once a  degree is obtained. Your friend is looking at a career in Psychology.  The only problem I see is that there are some jobs in the psychology field that require licensing or certification.&lt;br /&gt;&lt;br /&gt;Before he invests time in money in pursuing a degree in that field he should find out if he can be licensed in your state.&lt;br /&gt;&lt;br /&gt;As far as a career in broadcasting, I see no reason that he cannot get hired.  In that field he will be subjected to the the same factors that &lt;a style="color: rgb(204, 204, 204);" href="http://howfelonscangetjobs.blogspot.com/2011/08/felons-can-get-help-finding-jobs-and.html"&gt;ex-offenders and felons&lt;/a&gt; in other fields have to deal with.  He will have to find an employer who will be willing to overlook his convictions.  How can he do that? From time to time I take the opportunity to post note worthy things I find on the web or that people send me.  The following is about a proposed bill in the State of Wisconsin.&lt;br /&gt;&lt;br /&gt;When individuals are convicted of crimes, the arrests can stay on their records for years. In some cases, this could prevent them from being interviewed or hired for positions in which they are interested and qualified.&lt;br /&gt;&lt;br /&gt;A new bill in Wisconsin might inhibit convicted felons even more. If the bill passes, it will "prohibit employers from being sued for either firing or refusing to hire convicted felons, even if the circumstances of the conviction have nothing to do with the job."&lt;br /&gt;&lt;br /&gt;Supporters of the bill say it promotes a "pro-business" environment. Many persons, feel differently. Detractors claim the bill will make it harder for felons to get hired and maintain employment which is a major factor in the rehabilitation process&lt;br /&gt;&lt;br /&gt;The law presently affords employers the ability to restrict convicted felons from doing certain jobs, especially jobs  that may be directly related related to their convictions. Employers are also permitted to dismiss employees who lie about having a felony conviction when they applied.&lt;br /&gt;&lt;br /&gt;The new bill takes things a step further, giving employers reasons to not even take chances on people who have made mistakes in the past. One state representative was especially concerned about the impact the bill would have on the African-American community, where the unemployment level is already at "crisis levels."&lt;br /&gt;&lt;br /&gt;If the bill passes, it could make it even more difficult for individuals to find work in Wisconsin. However, times are really  hard for us right now, as my fiance is 31-years old and has been out of  work for 2 years. In 2007, he please guilty to Conspiracy to commit  robbery OR carjacking (which is how it is listed on his record). This  actual even happened in 2003. Since then, he secured one job in 2007,  and lost it in 2009 when the store went out of business. In addition, he  went to Lincoln Tech Institute and obtained a certificate for Diesel  Technology and Technician. Next, he went and got his forklift license.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;He has submitted over 200 hundred applications in the past year and he  has still not gotten a job. He even walks into companies wearing a suit  and tie just to fill out applications, hoping that this will help  increase his chances at securing a job. Every time it seems his chances  are looking good in the interviews, he either tells about his  conviction, or the companies conduct a background check, and he does not  get a call back after that. We have been to the One Stop Career Center  seeking help, and the most they gave him was a list of employers who  have hired ex-felons in the PAST. We have been to church organizations  and have contacted Trenton, and still he has not received any help.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;He  would like to drive trucks, fix on them, or get a forklift job, but we  just don't know what to do anymore. I'm trying not to give up on this  man, but it's becoming so overwhelming. If he attended Lincoln Tech, there are placement services there that assist graduates.  If that doesn't work, I suggest grabbing the yellow pages and making a list of all the garages in your area that service diesel engines.  He can call each one to inquire about open positions.  Because he has training but not much experience, he may have to start as a mechanic's helper.  A third option would me to contact trucking companies in your area to see if they service their own trucks.  He could apply as a mechanic's helper at those places. He was released from prison more than ten  years ago and my fiance divorced him but has too much compassion to turn  him out on the street. He had found work in construction driving  tractors and heavy equipment but all that disappeared when the recession  hit. After a long stretch of unemployment he got another construction  job that required heavy manual labor. His bosses knew of his crime and  worked him extra hard because of that.&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;Despite  what I have read about parole officers, the reality is that many of them  don't really like their work so they play games, mostly trying to  violate these men again. If the parolee is living in a good neighborhood  (despite the hatred of the neighbors) the parole officer may be very  jealous, which is the case with my fiance's ex. She is not there to  help him in any way. That is the reality.&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;Meanwhile,  he makes a meager income of about $800 a month, and he lives in my  fiance's home taking care of their teenage son. My fiance takes contract  work and travels to stay away from him. Prior to her ex husband's  incarceration, he worked in the office of a major defense contracting  firm and earned a very good living. But now, he is mostly a broken  middle-aged man working manual labor at minimum wage.&lt;/div&gt;&lt;div&gt;&lt;br /&gt;&lt;/div&gt;&lt;div&gt;My  fiance and I would like to help him find meaningful and lucrative work.  He had worked in positions that would earn upwards to $40 an hour, but  no one would hire him because of his status. The guy has an impressive  resume, and he's constantly worried about being violated again, or that  his parole officer will go after him. We're considering to set up a LLC  and make him an 1099 employee. There are in all probability quite a few contractors in your area looking for skilled day laborers as a way to keep their own costs down. He could get a list of contractors that have recently been issued building permits at your local municipal building. My convictions unfortunately were aimed mainly at my parents when I was younger do to an emotionally unstable home life. I have corrected my problems and own emotional bouts. I am a successful father of two beautiful little girls and engaged to the most wonderful woman on this planet. We are buying a house soon on her income....I feel less of a person not being able to provide for my family. I was told last week by Kelly services after an interview that I had the job. It was the best news I heard since my lady said yes to that important question after we laid our baby girl down for the night. I went to work today, I loved it. I liked it so much I started to talking to the hr person about retirement and shares in the biz. I received a phone call on the way home tonight which is what has sparked my efforts for finding an answer online. Kelly services was relaying a message that a background check had come back and they found a felony. The conviction that was in question was a misdemeanor. I'm not even sure that will save me from what's ahead but I plan on taking immediate action in the morning. My hopes lie within the kind heart of the hr woman from the place I was employed. The conviction in '07 was not a felony, if there is any possible way to get that taken care of on a very bare income please let me know. First, if the conviction was on the application, It wouldn't be a question. It would make no sense to leave convictions off when applying, get hired and than lose the job when background checks are done.&lt;br /&gt;&lt;br /&gt;If your only situation is that your misdemeanor is listed as a felony, one option is to have the prosecutor associated with your case to correct the situation.  If you have no success there, I suggest contacting your local legal aid office. I was watching Mo’Nique's documentary entitled, “Women Behind Bars,” and saw myself. I don’t believe I’ve cried with such intensity in years and absolutely hate to see women placed in such testing predicaments. Having experienced adversity and can understand how simple it is to be caught within certain circumstances. But now I have a question I’d like to ask the world, a felon serving time, paying back debts to society or whatever discipline is necessary, I concur, but what else is expected of a felon when seen as a title and society won’t assist these human beings (felons) back into what is called a “forgiving world.” Living in Colorado, I have come to experience racism from many aspects, African American, female (educated), epileptic (disability), and a felon. With these characteristics defining me as a person, employment, or to suggest a second chance in the state of Colorado is almost non- existent. Employers in Colorado do not assist &lt;a style="color: rgb(204, 204, 204);" href="http://www.youtube.com/watch?v=PKRBF54oqWo"&gt;felons with employment&lt;/a&gt; necessary to pay back debts, live efficiently and evade recidivism, where most felons eventually return to a life of crime for a means of survival.&lt;br /&gt;&lt;br /&gt;I for example, unemployed and being a convicted felon am ineligible for assistance. I’m curious to know what services, options, choices and the alike are available for cultured felons? To give a brief synopsis of my conviction; I plead guilty to and was convicted of a misprision of a felony in 2006 a crime committed by a young man in 2002.  Misprison of a felony was an offense under the common law of England and was classified as a misdemeanor.  It consisted of failing to report knowledge of a felony to the appropriate authorities.  After the 9/11 tragedy, the United States, reinstated the Patriot Act, adopted and revised England's law of a misdemeanor "misprison of a felony" making it a felony and terrorist act to protect the country against further terrorists or terrorist acts (basically ourselves).  Having knowledge of a crime or criminal, placed me in the category of being a terrorist threat to my country. Though it is documented a witness came forward in 2003 stating money was offered in exchange for my life, instead of providing protection for a US citizen, the government chose to convict and sentence a U.S. citizen for essentially not “snitching” and protecting the lives of her and her family. When we have no one in the country we can trust, who do we turn to? When families are afraid and fear for their lives added with the lives of their children (i.e. domestic violence homicides) and the government deems the victim(s) as a terrorist or their actions a terrorist act, where do we go and what do we do to protect our own?&lt;br /&gt;&lt;br /&gt;Having no prior criminal history, I was sentenced to one year in a woman’s federal facility in Fort Worth, Texas (released October 2007) and one year probation (completed 2008).   Since my release in 2007, I completed and received a B.S., in Criminal Justice with an emphasis in Domestic Violence and Juvenile Delinquency.  Wanting to increase my awareness and familiarity of family, I directed my career objective to counsel women and children; and enrolled in Argosy University where (passing the necessary exams) I will receive an MBA, LPC in Clinical Mental Health Counseling in September of 2012.  While attending school full-time, I volunteered with Bridges of Silence; an after school tutoring program for children and youth; ages 6-18.   But ineligible for hire due to a felony back ground.  At the same time, I completed training to obtain certification for CPR, Standard First Aid, and Blood Pathogens.&lt;br /&gt;&lt;br /&gt;Now having a criminal history, I will use my story as an example for others to follow when making what could be life changing choices.  I was what most considered “The All American Girl” born in the United States, first job at the Mall, age sixteen, honor roll, track star, peer counselor, comedian, prom queen, and later registered to vote, age eighteen. I like to think I was a model citizen until my choices lead me to a path of devastation.   I made a mistake in my choice of friends, relationships, life in general and feel I owe it to society, in particular, the younger generation to emphasize the importance of where our choices, positive and or negative, could eventually lead us.  Working with and empowering children is a difficult task, and is not encouraged when one has a felony record.  I do discourage convictions involving children, but rather, use a conviction such as my own, to dissuade children from following the same path.  I am often discouraged from many job openings with children for discrimination purposes as all of the applications clearly specify, “a felony conviction does not automatically disqualify employment,” however, having that title automatically places a negative stigma amongst employers, volunteers, and society as a whole.&lt;br /&gt;&lt;br /&gt;Seeing the displacement of children and adolescents due to their wrong or bad choices isn’t the example I want to lead by.  Rather, be that example to demonstrate that “yes” I made a bad choice, but a bad choice does not make me a bad person. If I had put some thought into my decisions, then I would not have made those mistakes. But, it’s too late, “I am unable to take it back,” however, I can grow from it. My purpose in life now is to give back, and help deter others from making the same mistakes I did.&lt;br /&gt;&lt;br /&gt;The state of Colorado seems to be the least forgiving state of felons; the entire realm of felonies should be classified separately, but are grouped and stigmatized as all being a nuisance to society.  These stigmas may be the foundation to many felons either falsifying the fact of having a conviction or falsifying their credentials, where even “I” have been informed of being, “over qualified.”  Whom do felons go to for help or work? No one wants to hear our side; they look at the title and automatically make assumptions as to who you are as a person!&lt;br /&gt;&lt;br /&gt;President Barack Obama signed into law on April 9, 2008, the Second Chance Act (P.L. 110-199) which was designed to improve outcomes for people returning to communities from prisons and jails.  We as citizens were lead to believe it was intended to authorize federal grants to government agencies and nonprofit organizations to provide employment assistance, substance abuse treatment, housing, family programming, mentoring, victims support, and other services that can help reduce recidivism. However, this Second Chance Act is nonexistent in the state of Colorado, evident on every application as emphasis is placed on “a felony conviction does not automatically disqualify an applicant,” but, very well guarantees the likelihood of your application not being viewed.&lt;br /&gt;&lt;br /&gt;I’ve accepted responsibility for the crime I committed, and owe it to future generations to help deter them from possibly making the same mistake in their lives.  I want to be of assistance to my country, not be on assistance. I have been told being a convicted felon makes me ineligible for assistance in the state of Colorado. Does it help or hinder the situation, single, without children, and refusing to claim epilepsy as a disability? I’m asking for assistance in finding employment in the state of Colorado, and for a second chance that will allow me to go forward and give the necessary message to our children. Though my crime had nothing to do with children, I was recently informed that my felony conviction will not allow me to be eligible to counsel children.&lt;br /&gt;&lt;br /&gt;Confused, as a felon I am an excellent candidate for a volunteer and or mentor for children, but the title felon suggests I also pose a threat to children and society as a whole.  Once again, felon is a title, it is not who I am. Thank you for taking the time to read and absorb my story. The moral of the story is felons are people to, and we should be treated as such. The only difference between me and others without the title of “felon” is I was wedged between a rock and a hard place. A movie I recommend for all Americans is “Loose Change.” Then when it comes to you having to make that choice for your family, what choice will you make? When someone attacked me, I would attack back in which I  earned myself 1 night in jail &amp;amp; 3-4, misdemeanors (not at the same  time).&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="color: rgb(204, 204, 204); font-family:georgia;" &gt;After having my children, I grew up &amp;amp; gained control of  myself. I have stayed out of trouble for 10 yrs now but I am having an  awful time gaining employment. I have a security clearance approved by  the government but still most companies will not hire me. I have been  recently laid off in security due to the economy. I spend everyday  applying for jobs, sending out my resume &amp;amp; going on interviews.  During the interviews employers love my credentials, my skills &amp;amp;  want to hire me right away, but once I mention my past or the background  comes back, they shut the door in my face. I have applied to big &amp;amp;  small companies, temp work &amp;amp; even fast food. I get the same with  all. I have NO felonies &amp;amp; the misdemeanors I have were never  committed again. I have proven that I have learned from my past.  I've put in  the education, so what else can I do to get past my past? One-stop Career Centers are very underutilized resources that  ex-offenders and felons can use not only to get jobs, but to get career  counseling and training.   In   addition, these  centers provide a long list of valuable services. &lt;/span&gt;&lt;span style="font-family: georgia;font-family:georgia;" &gt;There are 24 Regional Workforce Boards in Florida which are responsible  for implementing the employment programs in their regions.  Services  available include referrals to employment, career counseling, assistance  with job search and placement, access to computers/internet, resume  preparation, phone/fax machines, copy machines, interest, aptitude and  basic skills testing and other special programs tailored to meet  employment needs of those facing barriers to employment.  &lt;/span&gt;&lt;p  style="font-family: georgia;font-family:georgia;"&gt;&lt;span style="font-size:100%;"&gt;Each center has trained counselors that provide one-on-one assistance. Not a bad idea if she threw it in the  river; however, stupidly she hocked it using her friends ID. the felony  charge is not for taking the gun but using false id to hock it. She  graduates the end of the month and cannot find work.  This is kickoff time  for AZ but the big hotels that doing the hiring are doing thorough background  checks. She had a great job lined up with Wigwam. In fact, the HR director told  her--this is a great company and a ache to work any where in the world.  That Friday she was supposed to go to orientation. Unfortunately, the HR  Dir. called her and said because of her felony change they cannot hire  her.&lt;/span&gt;&lt;/div&gt; &lt;div style="color: rgb(204, 204, 204);"&gt; &lt;/div&gt; &lt;div style="color: rgb(204, 204, 204);"&gt;&lt;span style="font-size:130%;"&gt;She did a stupid thing--no question there; I told the judge that regardless  that we are from New Jersey the closest she had come to seeing a gun was by a  policeman and not Tony Soprano.  She is really in the dumps. As I often suggest to ex-offenders and felons who seek jobs in the culinary arts, large corporate outlets may not be the best choice.  They often have hiring practices that are determined at the corporate level.  She may be better off looking for jobs at independent restaurants and catering companies.  Check your local telephone directory and start calling.&lt;br /&gt;&lt;br /&gt;Also she may seek assistance from independent temporary employment agencies.  Often temporary assignments turn into full time jobs.  There are temporary agencies that primarily work with the service industry. I was convicted but no jail time, I was placed on probation which I have completed. In 2006, I was given another Felony for Unemployment Fraud again no jail time and amount paid back before court hearing. These two Felonies were huge mistakes in my life and very humiliating for me everyday of my life. I went from a $70,000 a year job in Dayton, Ohio with great benefits to a $40,000 a year job with little to no benefits and currently unemployed.&lt;br /&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Through these past seven years I have lost my family of two wonderful children and a great wife who has been by my side through all of this humiliation. I lost my home and my dignity We all live from my mistakes and I keep trying to get back into the career I am very good at but can not get past the background checks that many companies require before they hire a person. Twice, I made it all the way to actually going to the new work place and working over 5 hours before the HR department came down with a delayed background report and the bad news that I can not work for this company due to background convictions.&lt;br /&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I am so tired of having to live each day in humiliation, not being able to provide for my family and have a place to call my own home. I have learned many things these past seven years and have seen how less forfeit people survive on little to no income. I have an education and so many technical skills and can get hundreds of jobs at or around $80,000 a year and could provide for myself and my family and their futures for college and retirement. but I get shutdown with one question, “have you ever been convicted of a felony”.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I am asking you to please help me in any way you can to be able to get these two mistakes off my background. Independent agencies don't have to deal with restrictions larger agencies may have placed on them by their parent companies as they relate to hiring ex-offenders and felons. They are free to hire anyone they choose. I was told I would have to register as a sex offender which at  the time I was o.k. with doing...because my probation officer told me  before that I never received a tier hearing because the judge believed I  had no risk of re-offending(and I'm proud to say I have not since I was  17...I'm 26 now)so although I had to register only law enforcement,  courts, and anything fed related could actually see it... I believe there are other &lt;a href="http://www.youtube.com/watch?v=vSbuOpTkyVU"&gt;ex-offenders and felons looking for jobs&lt;/a&gt; that are in similar situations, I will offer a suggestion.&lt;br /&gt;&lt;/p&gt;&lt;p&gt;My understanding of deferred adjudication is, there is an initial plea of guilty. It is my understanding, once the  conditions of the deferment are met (typically a fine and probation,)  the charges are formally dropped.  Since there is no conviction, you may  legally answer “no” when the questions asked “Have you been  convicted….”  The charges although formally dropped, they will still remain as a charge and will appear on background checks as a charge and not a conviction.&lt;/p&gt;&lt;p&gt;If your charge is appearing on &lt;a style="color: rgb(204, 204, 204);" href="http://howfelonscangetjobs.blogspot.com/2010/04/sex-offender-needs-job.html"&gt;sex-offender&lt;/a&gt; registries, there may be a reason that you don't know.&lt;/p&gt;&lt;p&gt;Because this seriously impacts your ability to get a job, I suggest you get legal assistance in first establishing the terms of your deferred adjudication and then what your rights are. I am a recovering  alcoholic/drug addict, and I have been sober for over 4 years. All of  arrests in the past were alcohol and drug related. I have had  unfortunately 4 DUI's. The last one being June 28th 2007. That was the  night that my life changed for the better. I was arrested and charged  with 3 felonies as well as 4 misdemeanors. Assault with a deadly  weapon, evading, and possession of a controlled substance. This was the most terrifying moment in my life and  I made a commitment to change my life right then and there. I had bouts  with sobriety in the past but this was my bottom.  I knew I had to  change and that is what  I did. From that point on I have lived a clean  and sober life, I attended a rehab voluntarily, I actively attend AA  meetings as well. I also volunteer in my community. I strive to better  myself in any way I can.&lt;br /&gt;&lt;br /&gt;&lt;div&gt; &lt;/div&gt;&lt;div&gt;Now I am at a crossroads in my life. I am going to be  39 years old in October and I want to go back to school. I have a dream  of becoming a paramedic and serving my community. This is a  dream that I  had when I was younger but I allowed addiction to steal it away from  me. I don't want to live in fear of my past anymore. My wife and I are  separating and I need to make a decision for myself. So my question is  this: have you ever heard of anyone with a similar past like mine  becoming a paramedic or even a firefighter. I am in California and I  have looked into it. I know of ex-offenders becoming firefighters.  Paramedics and firefighters in many communities are separate entities.  My understanding is that in California, some firefighters are paramedics and have to be licensed by the California&lt;span style="font-size:100%;"&gt; Emergency Medical Services Authority. It's a fancy way of  saying secretary.   I am graduating at the end of the month and just  don't feel like that will be enough for me and my life. I want to  continue in business but didn't really have a kind of business in mind. I  have always been interested in helping people and was looking into a  mortuary science degree.. It will be a few years before I can complete  the prerequisites and then the program, but after that will any doors  actually be open for me? I was doing some reading and it's going to be a  very difficult road. I don't know what to do. I am from California and  was wondering if you knew anyone out this way I could talk to.  I also  read that from my discharge date I had to wait 7 years to file for a  certificate of rehabilitation and then from there I can see about  getting my record expunged.. 7 year!? I have to wait that long to start  my life and there is no guarantee. I can't afford to do that and am  desperately seeking help in this matter.. Your life might as well be over, unless of course you have loads of money at your disposal so that you can have them expunged, but that doesn't always work. It is so unfair. Their should be limitations on how far back employers can go on background checks. Also I think that if the felon was placed on parole or in a half way house for more than a year after their incarceration they should be evaluated and certified as to whether or not they are reformed. I think that it should be a program that the court system and the lawmakers work together on. There has to be some way to keep these people from having to resort back to crime. It is a burden that is placed on the family as well as the ex-offender. &lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Q:&lt;/span&gt; My name is Dennis and I am getting so frustrated and  depressed on what I have been going thru for years. I have 2 felony convictions  nearly 18 years ago and every time a background check is done it comes up. What  they are seeing on paper is not the person I am today. I have a credit score  over 726, I own my own home, and I have been living a law abiding life since  getting out of prison where I did 2 years- that was back in 1997 when I got  out.

&lt;br /&gt;&lt;/div&gt; &lt;div style="font-family: georgia;"&gt;I am 48 years old and it is getting very difficult  getting past these background checks- no one wants to take a chance with someone  with a record and every time I go on an interview I have the embarrassment of  explaining what I did and the kind of person I am today- but it just doesn't  matter.

&lt;br /&gt;&lt;/div&gt; &lt;div style="font-family: georgia;"&gt; My felonies came when I got involved in crack, the  demon itself. My first felony came when I was in a cab and lottery scratch off  tickets were taken and I got charged with robbery, I received 5 years probation.  The second one came because I was still addicted to this evil drug when I took  47.00 out of a back room in a bar, it was my crack head girlfriends parents bar  and her mother prosecuted. I received a sentence of 2 to 4 years. This actually  saved my life and the transformation began in getting my reputation and life  back in order. That crack tore thru my life like a tornado and it was a blessing  that I was incarcerated for those 2 years. But try explaining this to a  potential employer and the door closes.

&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;I'm sorry you have not had much success in your job search.  Don't give up hope just yet.  The fact is, &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/jumptags_my_bookmarks.xml"&gt;ex-offenders&lt;/a&gt; and &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/delicious-20110831.htm"&gt;felons&lt;/a&gt; get jobs everyday.  Your challenge is to find out which employers will give you an opportunity.  Unfortunately this is easier said than done.  My first suggestion is to employ the single greatest method of finding job leads... &lt;/span&gt;&lt;span style="font-weight: bold;"&gt;&lt;span style="font-family:georgia;"&gt;Networking.&lt;/span&gt;
&lt;br /&gt;
&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;Many people got their job leads from people they know. This is called networking. Networking&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;is the most effective method of finding employment leads. Most jobs are never advertised because &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;they are usually filled by personal contacts. In fact, employers would rather hire someone referred &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;to them by people they know rather than to painfully sort through resumes and applications.  &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;How many people do you know? Each one of them is a potential lead for a job.
&lt;br /&gt;
&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;• Friends&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Relatives&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Neighbors&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Parole/probation officers&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Members of your religious group (especially ministers, priests, imams, etc.)&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Former teachers&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Former co- workers&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Former employers&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Classmates&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• Casual acquaintances&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;• People you do business with (Hairstylists, barbers, doctors)
&lt;br /&gt;
&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;Look at the list above. In each group, list five people that you can contact. That is at least 55&lt;/span&gt;
&lt;br /&gt;&lt;span style="font-family:georgia;"&gt;people that could help you in your job search. Let each person know that you are looking for a job &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;and that any information they have for you would be helpful. Have copies of your resume handy &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;for your contacts to give to other people.  Often when ex-offenders and felons  are referred for jobs, the question about criminal records doesn't come up.
&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;&lt;/span&gt;&lt;span style="font-family:georgia;"&gt;
&lt;br /&gt;You just never know where your next opportunity will come from.  &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;Never ask for a job. Only ask for information about job leads or for advice.  The more people you  &lt;/span&gt;&lt;span style="font-family:georgia;"&gt;are able to contact, the more leads you will get. Remember, this is a numbers game.

&lt;br /&gt;Frequent readers of this blog are familiar with my next suggestion.  I encourage every &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/GoogleBookmarks%281%29.html"&gt;ex-offender&lt;/a&gt; and &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/GoogleBookmarks.html"&gt;felon&lt;/a&gt; looking for a job to visit their local One-stop Career Center.  One-stop Career Centers are very underutilized resources that ex-offenders and felons can use not only to get jobs, but to get career counseling and training.  &lt;/span&gt;&lt;/span&gt; In   addition, these  centers provide a long list of valuable services. Some services   available are: &lt;p&gt;Career planning and counseling&lt;/p&gt; &lt;p&gt;Workshops (Resume Writing, Interviewing Skills, and related topics.)&lt;/p&gt; &lt;p&gt;Computers with internet access and word processing&lt;/p&gt; &lt;p&gt;Daily access to thousands of job listings&lt;/p&gt; &lt;p&gt;Job-related magazines and local newspapers&lt;/p&gt; &lt;p&gt;Job postings and referrals&lt;/p&gt; &lt;p&gt;Printers, fax machines, phones, and copiers for job search use&lt;/p&gt; &lt;p&gt;Each center has trained counselors that provide one-on-one assistance. Although I am not supposed to be a convicted  felon this charge is still showing on my record.  I am a college student  and am interested in entering the medical field as an administrator.  I  have been denied by the Florida nursing board to become a nurse. There will be terms set by the court, usually a fine and a period of probation. Once the terms are met, the charges are usually dismissed. There will be no conviction associated with that offense. If the person does not complete the terms of probation and or the fine is not paid, a finding of guilty may be entered and the person may be sentenced according to the penalties specified for the offense.
&lt;br /&gt;
&lt;br /&gt;So when completing an application that asks if you "Have you ever been convicted of a crime, you can answer "no" and rightly so because you haven't. Bear in mind that the charge will appear on a background check as a charge and not a conviction. You should have no problem with this. To absolutely certain of the status, you should check with the prosecutor or your probation officer associated with your case.  The exception to this is, what I believe happened to you.  Even though the charges may have been formally dismissed, they will always be visible to law enforcement agencies, the court system and government agencies.  The medical board is a government agency therefore will have access to the charges.  I don't know what your charges were but it may be possible that the medical board took them into account.

I am a 28 year old felon in Alabama. My crime was credit card&lt;br /&gt;fraud and ID theft. Since it was my first conviction, I was granted 1 year&lt;br /&gt;parole with court costs. Even though the punishment is light, I am unable to&lt;br /&gt;find a job to help pay off the dues and support my family.&lt;br /&gt;&lt;br /&gt;I have learned of the Federal Bonding Program, but it doesn't seem to be getting&lt;br /&gt;me anywhere. I have been on many interviews where I have put the crimes on the&lt;br /&gt;application, but they insist on running a background check, which of course&lt;br /&gt;comes up with the convictions. Finding a job unfortunately is not an exact science.  Finding a job with a criminal record is even tougher.&lt;br /&gt;&lt;br /&gt;I suggest to all &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/wordpress/2011/07/24/exoffenders-felons-jobs/"&gt;ex-offenders and felons looking for jobs&lt;/a&gt; to tell everyone they know that are looking for employment.  Many people got their job leads from people they know. This is called networking. Networking is the most effective method of finding employment leads. Most jobs are never advertised because they are usually filled by personal contacts. In fact, employers would rather hire someone referred to them by people they know rather than to painfully sort through resumes and applications.  How many people do you know? Each one of them is a potential lead for a job.&lt;br /&gt;&lt;br /&gt;• Friends&lt;br /&gt;• Relatives&lt;br /&gt;• Neighbors&lt;br /&gt;• Parole/probation officers&lt;br /&gt;• Members of your religious group (especially ministers, priests, imams, etc.)&lt;br /&gt;• Former teachers&lt;br /&gt;• Former co- workers&lt;br /&gt;• Former employers&lt;br /&gt;• Classmates&lt;br /&gt;• Casual acquaintances&lt;br /&gt;• People you do business with (Hairstylists, barbers, doctors)&lt;br /&gt;&lt;br /&gt;Look at the list above. In each group, list five people that you can contact. That is at least 55&lt;br /&gt;people that could help you in your job search. Let each person know that you are looking for a job&lt;br /&gt;and that any information they have for you would be helpful. Have copies of your resume handy&lt;br /&gt;for your contacts to give to other people.&lt;br /&gt;&lt;br /&gt;Another suggestion is to locate your local Goodwill. The United Way supports a number of organizations that have contacts to open positions. Perhaps a more polished professional like yourself may be better served by contacting your local S.C.O.R.E (Service Corp of Retire Executives) office. As the name implies, there are retired executives who serve communities in many ways. Perhaps you may find valuable contacts that could help you locate your next opportunity.&lt;br /&gt;&lt;br /&gt;Another suggestion I often make to ex-offenders and &lt;a style="color: rgb(204, 204, 204);" href="http://jailtojob.com/wordpress/2011/07/24/exoffenders-felons-jobs/"&gt;felons&lt;/a&gt; looking for employment is to apply with cover letters and resumes. Often when applicants apply directly to employers this way, the question of a criminal record never comes up.
