<p>Moodle HQ have launched their highly anticipated 3.2 major version release. This latest version of world&#8217;s most popular LMS platform includes several new features and major improvements:</p>
<h3>Boost</h3>
<p>A brand new core theme which boast better navigation within and between courses, and more space on screen for course content, giving you a clear, consistent way to configure key pages such as courses and activities; and a unified experience with the Moodle mobile app.</p>

<h3>Messaging and notifications</h3>
<p>Moodle 3.2 has new messaging and notifications functions that are user-friendly and easy to use. Now you have the ability to easily configure how you want Moodle to notify you about important events on the web site &#8211; via email or direct mobile notifications. Moodle’s new messaging functionality also means you can find and contact other users easily on any device.</p>

<p>You can now welcome your users to your Moodle site with your own custom tours of the interface; allowing you to Create and share walkthroughs with teachers and students with the user tours feature in Moodle 3.2 and highlight key aspects of your Moodle site.</p>

<h3>New media player plugins</h3>
<p>Moodle 3.2 brings a range of new media options with its new default player Video.js &#8211; which now provides industry-leading accessibility and usability for video and audio in your content. There is also full support for captions and subtitles for any video in any part of the site, and with pluggable support you can now also add new video players easily to anywhere in your site.</p>

<h3>New responsive/accessible graphs on all reports</h3>
<p>Users can now generate interactive and responsive charts with a brand new graph library in Moodle 3.2, allowing them to understand what’s happening in their course by viewing graph information in a summarised list format. For developers: Chart.js has been chosen for the next generation graph API backend because of its clean-cut aesthetics and responsive scaling to screen size.</p>

<h3>LTI 2 compliance</h3>
<p>Moodle 3.2 is now compliant with LTI 2, so It&#8217;s now easier than ever to seamlessly access shared content. Cartridges have also been implemented so that people interested in accessing your LTI tools will now know more about the content you’ve shared and also get handy information such as a title, icon and description. There is also the exciting new addition of Content Item &#8211; a powerful tool that allows users to configure and customise LTI tools to their specific needs so they can get the most out of the tools they’re accessing.</p>

<p>You asked and they’ve listened &#8211; welcome to improved rubric marking improvements in Moodle 3.2. Arbitrary scoring is now possible with the rubric marking function in Moodle 3.2, and competency frameworks can now be easily shared between Moodle sites and also the repository on moodle.net.</p>

<p>BigBlueButton is an extremely popular open source web conferencing system for online learning that complements Moodle perfectly, providing an easy to use tool for HowToMoodle clients to add real time video, talk, presentations and chat to their courses.</p>
<p>HowToMoodle will include web conferencing with all of its hosting plans from November 2016. HowToMoodle clients will be able to conduct virtual classrooms with webcam sharing, chat, polling and presentation sharing for up to 6 participants at no extra charge. Additional options such as session recording, desktop sharing and additional users can be added, if required, with the “Conference Plus” package.</p>
<p>Speaking on the partnership, HowToMoodle’s Director Ray Lawrence comments; “<em>An increasing number of our clients have identified the benefits of a web conferencing solution to work with their Moodle site. Our clients will now have the facility to conduct real time training sessions, meetings tutorials and more at no extra cost. Adding a web conferencing session is just like adding any other activity to Moodle.</em>”</p>
<p>Frederick Dixon from Blindside Networks comments; &#8220;<em>We are delighted to be working with HowToMoodle to provide their customers with real-time interaction with students. As customers are looking for ways to increase student engagement and retention, this partnership enables HowToMoodle to offer an integrated hosting solution with BigBlueButton that gives instructors the ability to share their audio, video, slides, chat and desktop and to engage students with polling and emojis. Instructors may record the sessions as well for easy viewing later on from within Moodle.</em>&#8220;</p>

<p>As we discussed in the previous <a href="/blog/complying-with-data-protection-law-for-your-elearning-site-guest-blog/" target="_blank">guest blog on Data Protection Law</a>, operators of e-learning sites are likely to obtain and hold all kinds of data about users including names and e-mails addresses at the very least and so it is important to understand the rights that those users have in relation to their data. David Miller, Partner at <a href="https://www.flintbishop.co.uk/" target="_blank">Flint Bishop Solicitors</a>, expands on this area, bringing clarity to the rights of a site user to access their personal data.</p>
<h1>(Part 2)</h1>
<p>Section 7 of the Data Protection Act 1998 (<strong>Act</strong>) gives all individuals the right to make a “subject access request”. In this blog we will discuss what a subject access request is and, how you (a data controller) must respond to such requests from your users (or, indeed, others).</p>
<p>Any individual who makes a written subject access request and pays a fee (if applicable) is entitled to be:</p>
<ul>
<li>told whether any personal data about them is being processed;</li>
<li>given a description of the personal data, the reasons it is being processed, and whether it will be given to any other organisations or people; and</li>
<li>given a copy of the information comprising the data.</li>
</ul>
<p>In most cases you must respond to a subject access request promptly and, in any event, <strong>within 40 calendar days of receiving it</strong>.</p>
<h3><strong>What is a valid subject access request? </strong></h3>
<p>For a subject access request to be valid it should be made in writing (this means it could be made via email, fax or hard copy).</p>
<p>There is no requirement for you to respond to a request made verbally but, in some circumstances, it might be reasonable to do so (as long as you are confident about the identity of the person you are talking to).</p>
<p>Where it is clear that the individual is asking for their own personal data, such request should be treated as a subject access request. A request does not need to mention the Act specifically or even say that it is a subject access request.</p>
<p>A request is valid even if the individual has not sent it directly to the person who normally deals with such requests (it is therefore important that you and your employees are able to recognise what a subject access request looks like and ensure that it is treated appropriately).</p>
<h3><strong>Specific forms</strong></h3>
<p>You cannot require individuals to use a specifically designed form on your site when making a subject access request. Although your organisation may have a standard form that it would like individuals to use, you may only <strong>invite </strong>individuals to use this form. Any request made for subject access (in writing) must be considered as a valid request, <strong>whatever the format</strong>.</p>
<h3><strong>Contents of the information </strong></h3>
<p>The Act requires that any information you provide to an individual is in “intelligible form”.  This means that the information you provide should be capable of being understood by the average person. This does not mean that the information you provide must be in a form that it is intelligible to the particular individual making the request.</p>
<p>For example, if you receive a request from someone whose English comprehension skills are quite poor and, they ask you to translate the information that you have sent to them &#8211; there is no requirement for you to do this under the Act. However, it would be good practice for you to help them understand the information that you hold about them.</p>
<h3><strong>Fee </strong></h3>
<p>Any organisation receiving a request may (except in certain circumstances relating to health records) charge a fee for dealing with it. If your organisation chooses to charge a fee, you do not need to comply with the request until such time as you have received the fee. The usual maximum fee that you can charge is £10 (however there are different fee arrangements for organisations that hold credit, health or educational records and these should be checked before you levy a fee).</p>
<p>Although you need not comply with a request until you have received a fee, you cannot ignore a request simply because the individual has not sent a fee. If a fee is payable but has not been sent with the request, you should contact the individual promptly and inform them that they need to pay.</p>
<h3><strong>Further information </strong></h3>
<p>The Act allows you to confirm two things before you are obliged to respond to a subject access request:</p>
<ul>
<li>you may ask for information to judge whether the person making the request is the individual to whom the personal data relates (this is important as releasing the information to the wrong person would be a breach of the Act); and</li>
</ul>
<ul>
<li>you must be reasonable about what you ask for. Therefore, you should not request lots of information if the identity of the person making the request is obvious to you.</li>
</ul>
<h3><strong>Information regarding children </strong></h3>
<p>Many user of e-learning sites will be young but, for the purpose of the Act, there is not a sharp distinction between those who are over 18 and those who are not. Even if a child is too young to understand the implications of subject access rights, data about them is still their personal data and does not belong to others (e.g. a parent or guardian). Therefore it is the child who has a right of access to the information held about them (even though in the case of young children these rights are likely to be exercised by those with parental responsibility for them).</p>
<p>Before responding to a subject access request for information held about a child, you should consider whether the child is mature enough to understand their rights. If you are confident that the child can understand their rights then you should respond to the child rather than a parent. You should take into account the following:</p>
<ul>
<li>the child’s level of maturity and their ability to make decisions like this;</li>
<li>the nature of the personal data;</li>
<li>any court orders relating to parental access or responsibility that may apply;</li>
<li>any duty of confidence owed to the child or young person;</li>
<li>any consequence of allowing those with parental responsibility access to the child’s information (e.g. where there have been allegations of abuse of ill treatment);</li>
<li>any detriment to the child if individuals with parental responsibility cannot access this information; and</li>
<li>any views a child or young person has on whether their parent should have access to information about them.</li>
</ul>
<h3><strong>What to do if the data includes information about other people </strong></h3>
<p>The Act says you do not have to comply with a request if to do so would mean disclosing information about another individual who can be identified from that information, except where:</p>
<ul>
<li>the other individual has consented to the disclosure; or</li>
<li>it is reasonable in all the circumstances to comply with the request without the individual’s consent.</li>
</ul>
<p>You will need to balance the data subject’s right of access against the other individual’s rights in respect of their own personal data. If necessary you may be able to redact information referring to others but you should only do this after receiving specialist advice on the issue.</p>
<h3><strong>Repeated requests </strong></h3>
<p>The Act does not limit the number of subject access requests an individual can make to any organisation. However, it does allow some discretion when dealing with requests that are made at unreasonable intervals. Under the Act you are not obliged to comply with an identical or similar request to one you have already dealt with, unless a reasonable interval has elapsed between the first request and any subsequent ones. You should therefore consider the following:</p>
<ul>
<li>the nature of the data;</li>
<li>the purposes of the processing; and</li>
<li>how often the data is altered.</li>
</ul>

				<content:encoded><![CDATA[<h3>Introducing Auto enrolment</h3>
<p>The Auto enrolment is a great plugin which allows you to enrol users based on actions that they make within Moodle, such as logging in, viewing a course or viewing an activity/resource.</p>
<h3>Is there documentation for Auto enrolment?</h3>
<p>Unfortunately, there is no documentation for this plugin, however it is fairly straightforward to configure and get working.</p>
<h3>How to set up Auto enrolment</h3>
<p>The plugin is available to download in zip format from <a href="https://moodle.org/plugins/enrol_auto" target="_blank">https://moodle.org/plugins/enrol_auto</a>. Simply select your version of Moodle and then click on &#8216;download&#8217;. The zip file should be unzipped and its contents should be moved into ‘Moodle’/enrol folder.</p>
<p>Once the files are moved into the correct directory you can login to the Moodle site as an admin and complete the installation by going to ‘<em>Site administration ► Notifications</em>’.</p>
<p>For me this process took only a few minutes and completed without any errors.</p>
<p>As always, you should take a backup of your Moodle site before installing this plugin.</p>

<h3>Configuration options</h3>
<p>As an administrator there are a few configuration options to change the way that the plugin behaves.</p>
<p>First off you will need to enable the plugin in the ‘Enrolment’ plugins area, <em>Site administration ► Plugins ► Enrolments ► Manage enrol plugins</em>. Click the ‘Eye’ icon next to ‘Auto enrolment’ to make it active.</p>

<p>You can edit the default settings for the Auto enrolment plugin within a course by going to <em>Site administration ► Plugins ► Enrolments ► Auto enrolment.</em></p>
<p>You can also edit the specific enrolment settings within each course when you add the ‘Auto enrolment’ as a new enrolment method.</p>

<p><strong>Allow auto enrolments</strong> – This setting determines whether the enrolment method is enabled within the course. By default, this is set to &#8216;Yes&#8217;.</p>

<p><strong>Enrol on</strong> – This setting changes the type of action required by the user to enrol them in the course. This can be set to ‘Course view’, ‘User login’ or ‘Course activity/resource view’.</p>
<ul>
<li>The &#8216;Course view&#8217; option will enrol them in the course when the first click into the course.</li>
<li>The &#8216;User login&#8217; option will enrol them into the course when they first login to the site.</li>
<li>The &#8216;Course activity/resource view&#8217; will enrol them into the course when they access the selected activity/resource.</li>
</ul>

<p><strong>Activities/resources</strong> – If you have selected to enrol based on ‘Course activity/resource view’ then this is where you choose what type or types of activity or resource the user needs to view to be enrolled.</p>

<p><strong>Default assigned role</strong> – Here you can decide which role users will be enrolled as. By default, roles available are:</p>

<li>Non-editing teacher</li>
</ul>
<p>If you have any custom roles that can be assigned in a course, then these will be available here also.</p>

<ul>
<li>No documentation available for installation/setup</li>
<li>Cannot delete the enrolment method from a course once added (you can deactivate it).</li>
</ul>
<p>Overall this is a great plugin which allows you to enrol users in courses easily and is especially great if you have a mandatory course that all users need access to as they can be instantly enrolled on login without any input being required from the user or the administrator, and works very well if you’re using self-registration.</p>

<p><strong>What were the reasons you decided to have a theme created for your Moodle site?</strong></p>
<p><strong>Annie:</strong> &#8220;We are a social housing provider, and we use our Moodle primarily to engage with our residents through online service improvement activities, as opposed to it purely being an LMS system. With this in mind we needed our site to be as visually engaging as possible, as we are asking residents to come onto the site out of choice and give up their personal time to engage with us on there. Also online engagement in our sector is not particularly common-place, with many residents preferring more traditional, face to face activities, so again we wanted the site to visually draw people in as much as possible and to be enjoyable to use.&#8221;</p>
<p><strong>What was your design brief for the new design?</strong></p>
<p><strong>Annie:</strong> &#8220;We wanted our site to loosely reflect the look of our website and to be in line with our branding guidelines in terms of the colour palette and fonts etc. However we did want it to be a bit brighter and &#8211; as it is distinct from the Hyde Official website &#8211; separated slightly design-wise. We wanted the theme to incorporate clear, simple buttons to lead residents easily to the most important areas of the site as residents had previously told us that navigation could be an issue. Communication and discussion/debate are also important outcomes of our site, so we wanted the visually appealing image slider in the new theme to be able to show nice big images and promote new stories, consultation opportunities or discussion topics.&#8221;</p>

<p><strong>Since the theme launch, what has been the response by your learners and colleagues to the Moodle site?</strong></p>
<p><strong>Annie:</strong> &#8220;Response has been great, our users seem to really like it and the feedback about the improved navigation has been very positive – with users telling us it’s much easier for them to find the category and activities they need. We’re really happy &#8211; we think it looks really clean and vibrant and it’s much easier for us to get our messages across. We’re about to open the site up more to other colleagues around the business and improve the links externally from our website to encourage more residents to enrol, so we’re really hoping that they all like it too!</p>
<p>We have also been very proud that the site has been shortlisted for 3 awards relating to innovation in digital engagement in the last year, including TPAS, the Chartered Institute of Housing and the UK Housing Awards. We won our Southern stage of the TPAS awards so <span style="color: #0069b1;"><strong>can justifiably say that our Moodle site is award winning!</strong></span>&#8220;</p>

<p>David Miller, Partner at <a href="https://www.flintbishop.co.uk/" target="_blank">Flint Bishop Solicitors</a>, gives a practical and straightforward guide into aspects you should consider with your eLearning site when it comes to complying with Data Protection Law.</p>
<h1><strong>The Basics (Part 1)</strong></h1>
<p>The law around data protection can seem very complex and confusing and many organisations struggle to understand it.  Whilst this is a sometimes difficult area of law there are some basic principles which, if kept in mind, will help you appreciate your obligations.</p>
<p>If you hold or store data (whether gathered through your eLearning site or otherwise) which is personal data (broadly speaking, information relating to living individuals), you are probably a “data controller” for the purposes of the Data Protection Act 1998 (<strong>Act</strong>). It is on data controllers that the obligations under the Act fall.  A data controller must comply with eight data protection principles in relation to the personal data they hold and what follows is a short, non-exhaustive, guide to those principles and complying with them:</p>
<h3>1. <strong>Fair and lawful processing</strong></h3>
<p><strong> </strong>The Act requires you to process personal data fairly and lawfully.  In practice, this means that you must have legitimate grounds for collecting and using personal data and you must be clear and transparent on how you intend to use the data.</p>
<p>A practical step to take to comply with this principle would be to provide individuals with appropriate privacy notices when collecting their personal data detailing what information you collect and store and what you use it for. These notices should be placed on the front page of your eLearning site and brought to the attention of users whenever you capture data about them personally.</p>
<h3><strong> 2. </strong><strong>Specified purpose</strong></h3>
<p><strong> </strong>Personal data must be:</p>
<ul>
<li>obtained for one or more specified and lawful purpose and;</li>
<li>it must not be processed in any manner incompatible with that purpose or those purposes.</li>
</ul>
<p>Organisations should be open about their reasons for obtaining personal data and what they do with the information must be in line with the reasonable expectations of the individuals concerned.</p>
<p>The Act specifies two ways in which you can specify the relevant purpose of obtaining personal data:</p>
<p>a) in a privacy notice given to individuals at the time their personal data is collected; or</p>
<p>b) in a notification given to the information commissioner.</p>
<h3><strong>3. Adequate, relevant and not excessive</strong></h3>
<p>The personal data you hold must be adequate, relevant and not excessive in relation to the purpose or purposes for which it is processed. You should therefore ensure that where you hold personal data about an individual:</p>
<ul>
<li>that data is sufficient for the purpose you are holding it for in relation to that individual and;</li>
<li>you do not hold more information than you need for that purpose.  Any excess information should be securely disposed of.</li>
</ul>
<h3><strong>4. Accurate</strong></h3>
<p>Personal data must be kept accurate and up to date. To comply with this provision, you should:</p>
<ul>
<li>take reasonable steps to ensure the accuracy of any personal data you obtain;</li>
<li>ensure that the source of any personal data is clear;</li>
<li>carefully consider any challenges to the accuracy of information; and</li>
<li>consider whether it is necessary to update the information and, if it is, update it promptly.</li>
</ul>
<h3><strong>5. </strong><strong>Not be kept for longer than necessary</strong></h3>
<p>Personal data processed for any purpose must not be kept for longer than is necessary for that purpose. The Act does not set out any specific minimum or maximum periods for retaining personal data. In practice, it therefore means that you will need to:</p>
<ul>
<li>review the length of time that you keep personal data;</li>
<li>check whether you are under any obligation to keep the data for any particular length of time (whilst the Act may not spell out a timetable other laws or codes of practice may do);</li>
<li>consider the purpose for which you hold the information in deciding whether (and for how long) to retain it;</li>
<li>securely delete information that is no longer needed for this purpose; and</li>
<li>update, archive or securely delete information when you have held it for the maximum period.</li>
</ul>
<h3><strong>6. </strong><strong>Data subjects</strong></h3>
<p>The people whose information you hold (called in the Act “data subjects”) have certain rights under the Act. These are as follows:</p>
<ul>
<li>a right to access a copy of the information comprised in their personal data;</li>
<li>a right to object to processing that is likely to cause or is causing damage or distress;</li>
<li>a right to prevent processing for direct marketing;</li>
<li>a right to object to decisions being taken by automated means;</li>
<li>a right in certain circumstances to have inaccurate personal data rectified, blocked, erased or destroyed; and</li>
<li>a right to claim compensation for damages caused by a breach of the Act.</li>
</ul>
<p>Where a data subject seeks to exercise a right in relation to data you hold about them you must comply with the Act.  This can be a difficult and sensitive area however and we will be posting some further guidance on this soon. We always recommend that you get professional advice before responding to any enquiry by a data subject.</p>
<h3><strong>7. Secure</strong></h3>
<p>Under the Act, appropriate technical and organisational measures must be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data. You, therefore, need to ensure that you have appropriate security measures (both physical and technical) in place to prevent the accidental or deliberate compromise of personal data that you hold.  This could include locked rooms and filing cabinets (for physical records) and password protection and encryption (for digital information).</p>
<h3><strong>8. Transfer outside of EEA</strong></h3>
<p>Personal data must not be transferred to a country or territory outside the EEA unless that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data. A transfer of personal data for the purposes of this principle occurs when information moves from an EEA country or territory outside the EEA.</p>
<p>If your eLearning site can be accessed from outside of the EEA you should include a provision in your terms of use/privacy notice to address this and obtain the data subject’s consent to this transfer of data.</p>
