Woolworths’insurers may be paying out onmesothelioma claims

Insurers of the now defunct
Woolworths retailer may be facing a compensation claim worth millions of British pounds, now that the husband of an ex-cashier is
holding the company accountable
for his wife’s death. Betty
Westhead worked Woolworths’
Durham Market Place store
between 1947 to 1982 in Durham,
England. In the fall of 2009, she
began to develop breathing
problems and was diagnosed with
mesothelioma, a rare cancer of the
protective lining of the lungs, heart,
chest and abdomen that is caused
almost exclusively by prolonged
asbestos exposure.

Westhead passed away at the age
of 78 on June 23, 2010. Her
husband, Ivor, filed the claim
against Woolworths in the hopes of
doing justice for his wife and to
helping others who may have been
affected. Westhead’s attorney
says asbestos is known to have
been in the store ceiling and that
dozens of people may have been
exposed to the carcinogen during a
major refurbishment of the store
that took place in the 1960’s.
Because asbestos cancer takes an
average of 40 years to develop
and become symptomatic, the
timing of the exposure and the
diagnosis of Westhead’s illness
correlates well with her claim.

Over 100 people worked at the
Woolworths when the renovation
was taking place, and all of them
could be entitled to up to £100,000
each, and staff from other
Woolworths stores could also be
eligible if similar works were carried
out at their locations. However,
there is one obstacle that
Westhead and his legal
representation face: a lack of
witnesses. Because the renovation
took place in the 60’s, it is proving
difficult to find people who can
speak about the conditions in the
store during the renovation.

German Research Points to Use of Exam for Earlier Diagnosis of Mesothelioma

Mesothelioma is a fatal form of cancer caused by exposure to asbestos. With up to fifty years between exposure and development of mesothelioma symptoms, finding a better way to diagnose the deadly disease sooner is key to improving treatment options, quality of life, and possibly longevity for sufferers.

A new study conducted by a team of
German scientists found that by
examining samples of lung tissue for asbestos fibers that it might be possible to determine whether or not the patient will likely develop
mesothelioma (or other cancers
caused by asbestos) and possibly
when.

Mesothelioma is diagnosed in roughly 3,000 new patients a year in the United States. Worldwide the cancer kills an estimated 20 to 30 thousand people yearly. The disease is, so far, incurable and only the few patients diagnosed in the earliest stages of the disease respond well to various treatments.

Diagnosing mesothelioma before it progresses is essential yet challenging. Only 10 to 15 percent of mesothelioma patients are in stage 1 or stage 2 of the disease, meaning that most diagnoses come only after the disease has passed into stage 3.

Published in Recent Results in Cancer Research, the German team examined samples from several patients already diagnosed with the disease and found that “lung dust analyses are a relevant method for the determination of causation in mesothelioma.” Asbestos fibers can be viewed in the lung tissue
samples under examination with light and electron microscopes.

Comparing the overall amount and
type of asbestos fibers in the lung
tissue could very well predict whether or not a patient will develop cancer, how long it may take for symptoms to arise, and could possibly be used to determine which type of treatment
would best suit the patients.

Interestingly, the research also found that the median time between asbestos exposure and development of mesothelioma or other cancers had risen in Germany to 42.5 years. In addition, at least within the German population, people are being diagnosed later in life, making treatment all the more difficult.

While the study produced no definitive link between asbestos fiber counts and diagnosis of mesothelioma, it has
opened up a new realm of research in the fight against this deadly disease, helping scientists understand how the disease is caused and how it progresses.

Perhaps one day this discover could lead to a test that detects mesothelioma before
symptoms arise which could be
administered after suspected asbestos exposure.

Mesothelioma Diagnosis
Mesothelioma is almost always caused by exposure to asbestos. As with most cancers, early diagnosis greatly increases the efficacy of treatment. Unfortunately, due to the way it forms, mesothelioma may not manifest until anywhere between 30 and 40 years after the initial exposure.

Mesothelioma symptoms are generally non-specific and resemble the signs of more common illness, such as flu, bronchitis, viral pneumonia and heart disease. New Treatments Offer Hope for Mesothelioma

A new published review of standard and investigational treatments for malignant pleural mesothelioma (MPM) offers some hopeful news for mesothelioma patients.

The article, published in Current Oncology Reports, analyzes an array of mesothelioma treatments, from new and existing chemotherapy drugs and new radiotherapy techniques to advances in immunotherapy and gene therapy.

Chemotherapy

The authors note that, although the chemotherapy combination of cisplatin and pemetrexed continues to be the preferred first-line treatment for mesothelioma, the newer combination of gemcitabine and cisplatin has also proven effective, especially in combination with the surgical procedure called extrapleural pneumonectomy and thoracic radiation. Other studies have also confirmed the value of the gemcitabine/cisplatin combination in Phase 2 clinical trials for inoperable mesothelioma.

Radiation

On the radiotherapy front, two new techniques have been introduced for use as part of a multi-modality approach for mesothelioma. Intensity Modulated Radiation Therapy (IMRT) and proton bean radiotherapy are methods for delivering radiation that effectively targets mesothelioma tumor cells while minimizing damage to surrounding tissue. When fewer healthy cells are damaged, side effects are minimized. Mesothelioma patients who are not substantially weakened by treatment side effects tend to have better outcomes.

Other Therapies

New ways of targeting mesothelioma tumor cells with destructive drugs are also showing promise. Hyperthermic intraoperative chemotherapy is a method for delivering powerful anti-tumor agents directly to the surface of the mesothelium, where mesothelioma starts. A heated drug cocktail is washed through the abdominal cavity during surgery, before the surgical incision is closed. Administering chemotherapy in this way helps to minimize the side effects of chemo for mesothelioma patients.

Immunotherapy and gene therapy work on a cellular level to harness the body’s own immune system to kill mesothelioma cells. By targeting particular protein receptors inside cancer cells, these new drugs have been shown to accelerate natural cell death and slow down or prevent cellular replication.

While all of these therapies hold promise for patients, many are still being tested and mesothelioma remains a diagnostically challenging cancer with a poor prognosis. The authors of the article conclude, “Thus, although there are numerous hopeful treatments for MPM, the benefits of these regimens remain to be proven in a randomized clinical setting.”

The Russians found the biggest,
meanest Doberman and Rottweiler
------- in the world and bred them with the biggest meanest Siberian wolves. They selected only the biggest and strongest puppy from each litter, killed his siblings, and gave him all the milk.
They used steroids and trainers and
after five years came up with the
biggest meanest dog the world had
ever seen. Its cage needed steel bars that were three inches thick and nobody could get near it.

When the day came for the fight, the
Americans showed up with a strange animal. It was a nine-foot long Dachshund. Everyone felt sorry for the Americans because they knew there was no way that this dog could possibly last ten seconds with the Russian dog.

When the cages were opened up, the Dachshund came out and wrapped itself around the outside of the ring. It had the Russian dog almost completely surrounded. When the Russian dog leaned over to bite the Dachshund's neck, the Dachshund reached out and consumed the Russian dog in one bite. There was nothing left at all of the Russian dog.

Bill said to Jim and Scott, let's break the monotony of this unpleasant task by concentrating on something interesting.

I'll tell jokes for 25
flights, and Jim can sing songs for
25 flights, and Scott can tell sad stories the rest of the way.

At the 26th floor Bill stopped telling jokes and Jim began
to sing. At the 51st floor
Jim stopped singing and Scott began to tell sad stories.

Workers' Memorial Day for people who suffered from mesothelioma

Prominent New York mesothelioma
attorney Joseph Belluck said that the
recently celebrated Workers ’ Memorial Day served as a time to remember
those who have died from
preventable workplace diseases as
well as to renew efforts to make
workplaces free from cancer-causing
materials such as asbestos. Asbestos is a human carcinogen and is known
to cause mesothelioma and lung cancer.

Workers ’ Memorial Day took place April 28, marking the anniversary of
the founding of the Occupational
Safety and Health Administration, the
federal agency whose mission is to
protect workers from job-related
injuries and diseases.

“On April 28, we joined in mourning with the thousands of families who
have lost loved ones to cancers that
could have been prevented through
safer workplaces, ” said Belluck, a partner in Belluck & Fox LLP, a New
York City law firm that represents
victims of mesothelioma throughout
the country.

“The best way to honor those who have fallen is to step up our efforts to
rid our country’s workplaces of harmful materials, such as asbestos,
which has been linked to a variety of
deadly diseases, including
mesothelioma,” he said.

Pleural mesothelioma is a rare form of cancer that is caused by microscopic
asbestos fibers becoming lodged in
the thin lining that encases the lungs.
Close to 3,000 Americans are
diagnosed with the cancer yearly.
Although there is no cure for mesothelioma, it can be treated with
varying degrees of success through
the use of surgical procedures,
chemotherapy and radiation.

Thousands of workers in a variety of
industries have been affected by the
dangerous nature of asbestos fibers.
Certain industries, such as the
construction and the maritime
industries, have a greater occurrence of asbestos-related disease than
others do. Some of the construction trades most at risk from asbestos include (but are not limited to):
insulators, plumbers and pipefitters,
electricians, sheet metal workers, or
construction workers involved in the
remodeling, or demolition of an old
(pre-1970′s) building.

“It’s time that we place a permanent, global ban on this harmful, deadly
material and make a concerted effort
to remove and destroy it,” Belluck said. “Unfortunately, wherever asbestos remains in the workplace without
being safely removed, and wherever it
appears in newly manufactured
products, people will continue to die.”

Study Finds 20%-25% of Mesothelioma Cases Go Undiagnosed

An international group of researchers
has just released the results of a 15-
year study of global mesothelioma rates. The findings suggest that this rare form of cancer (caused specifically
by exposure to asbestos ) strikes many more people than anyone had
previously anticipated. In fact,
research has shown that between 1 in
4 and 1 in 5 cases go unreported.

The study was sponsored by The National Institute of Health, a division of the U.S. Department of Health and
Human Services. The results were
released in an article written in 2010
that was accepted for publication in
Environmental Health Perspectives and
posted in its entirety online in January of 2011. Researchers Eun-Kee Park et
al. surveyed 89 countries worldwide,
collecting data from a fifteen year
period between 1994 and 2008.

World Health Organization data from the 56 countries in which
mesothelioma rates were recorded
showed that the disease killed
174,300 people. Researchers then
dug deeper for corroborating data.
Because mesothelioma has an incubation period of up to forty years,
they went back prior to 1970 and
found the total amount of asbestos
use in those 56 countries during that
time frame. Official data, taking into
account for political destabilization and storage of mass quantities of the
carcinogen, shows that over 65 million
tons of asbestos were used up until
1970.

Comparing those two numbers the
researchers found a mathematical
equation that defined the linear
relation of asbestos use to cases of
mesothelioma. They used that formula
to calculate disease rates in the 33 countries in which no mesothelioma
data exists. The result was shocking.
It was estimated that 38,900
previously unknown cases of mesothelioma (roughly ¼ of the reported cases) went undocumented.
The total sample size of this study
accounts for 82% of the world’s population.

Heavily industrialized nations lead the
pack for use of asbestos and
mesothelioma deaths. During the time
frame in question, the five countries
that consumed more asbestos than
any other were (in order of tonnage) the United States, UK, Italy, Germany,
and France. Those five countries
suffered almost 112,000 cases of
mesothelioma in total—over 64% of the world’s documented cases.

Researchers warn that after 1970, the
date when they stopped collecting
data, asbestos use almost doubled to
124 million tons. That means that
countries which used asbestos after
1970 or are still actively using it are expected to see their mesothelioma
rates climb even higher as the latency
period for new cases reaches its end
period.

Jeremy Renner to Play Mesothelioma Cancer Victim Steve McQueen in Film

Three decades have done little to
diminish our fascination with
legendary actor Steve McQueen, who died tragically at age 50 of the
asbestos cancer mesothelioma. Today he remains a fixture in pop culture
and garners more attention than the
majority of deceased celebrities.

Now one of the most exciting actors of
our generation – Jeremy Renner is tapped to play McQueen in a new bio-
pic. The as of yet unnamed movie will
be produced by The Combine, a
production house Renner set up
specifically to make the McQueen
picture.

Writer and director James Gray is said to be basing his screenplay on
Marshall Terrill's books Portrait of an American Rebel and The Life and Legend of a Hollywood Icon.

After shooting what would be his last
film, The Hunter in 1979, McQueen was diagnosed with mesothelioma, a rare but aggressive form of cancer whose
only known cause is exposure to
asbestos. According to his wife
Barbara Minty McQueen, the actor
rarely talked about his mesothelioma, but did say in an interview that is was
caused by asbestos.

McQueen reportedly told doctors he
had regularly used asbestos-lined
suits when he would ride his
motorcycles, and had stripped
asbestos from pipes as a punishment
when he served as a Marine earlier in his life.

After seeking out an experimental
surgery in Juarez, Mexico after
American doctors declared he was too
weak for any surgical procedures,
McQueen passed away on November
7, 1980.

It is unclear if the new film will cover
his later years and struggle with mesothelioma.

Supreme Court denies Exxon Mobile appeal of mesothelioma lawsuit

The New Jersey Supreme Court in Trenton recently declined oil giant ExxonMobil ’s request for appeal after losing a lawsuit that awarded mesothelioma sufferer Bonnie Anderson $7 million. Anderson was exposed to asbestos while handling her husband’s contaminated work clothes while he was employed at Exxon ’s Linden Bayway Refinery. John Anderson ’s job involved removing insulation, which for decades was manufactured with asbestos, to fix pumps and filters. Malignant mesothelioma, a rare cancer that affects the protective lining of the lungs, heart, chest and abdomen, is caused almost exclusively by prolonged asbestos exposure.

Improved Peritoneal Mesothelioma Prognosis After Chemotherapy and Surgery

Chemotherapy is one of three commonly used treatments for mesothelioma. Typically used in conjunction with debulking surgery and/or radiation therapy, chemotherapy can increase the likelihood that all cancerous cells have been destroyed. This approach has been found to maximize a patient’s prognosis.

Chemotherapeutic agents can be delivered via a pill, injection, catheter or topical application. Malignant mesothelioma patients whose chemotherapy routine includes both cisplatin and pemetrexed typically have a better survival rate than patients taking one single medication.

A recent Australian study reviewed a multi-institutional registry and found 405 peritoneal mesothelioma patients who underwent cytoreductive surgery and hyperthermic chemotherapy. The study population was comprised of patients from eight separate institutions. The researchers then contacted the individuals and conducted follow-up interviews with 401 surviving patients.

Of the interviewees, the overall median survival rate was 53 months. This rate was far higher than the average malignant mesothelioma prognosis, which is approximately a year after diagnosis.

In addition to extended average survival rates, the chemotherapy and surgery combination was also found to increase the number of patients who reached three and five-year survival rates. Within the study, 60 and 47 percent of participants were alive three and five years after treatment, respectively.

Approximately 92 percent of the interviewees had received hyperthermic intraperitoneal chemotherapy. Cisplatin, doxorubicin and paclitaxel were the three most commonly administered chemotherapeutic agents. The mean length of hospital stay after treatment was 22 days.

After considering the cases of the participants, researchers determined that four prognostic factors affected a peritoneal mesothelioma patient’s response to chemotherapy. Epithelial subtype, lack of cancerous lymph nodes, full cytoreductive surgery and completion of a hyperthermic intraperitoneal chemotherapy regimen were found to independently increase survival rates in the analysis.

today is dealing with the past. People

problem is how to deal with the asbestos that is still out there in older
buildings, concrete and insulation. For
more than half of the 20th century
asbestos was used just about
anywhere that required insulation. It
was just about everywhere out there - and still is.

removal of all asbestos anywhere
people were exposed to the hazard.
However, this is often easier said than
done. In all too many cases the biggest expense involved in
renovating an older building is dealing
with asbestos. Often the expense of
totally removing asbestos has
prevented renovation of older
buildings. Demolishing or renovating old buildings used to be easy but not
anymore.

For many years asbestos removal was
at a stand still. Those companies that
could afford to remove asbestos
insulation in their buildings had
already done so; often at great
expense. Those companies with smaller financial resources usually just
left their old buildings alone and
delayed dealing with the asbestos.
Finally in the 1990s governments
started to approve alternate ways of
dealing with asbestos in buildings.

Currently there are 3 approved ways
of dealing with asbestos in older
buildings. Removal is still the preferred
way, but is very expensive and not
entirely without dangers. Simply
getting the asbestos out exposes it to people. The trick and expense in
asbestos removal is keeping it out of
the air and away from people. An
additional problem with asbestos
removal is you have to install new
insulation and fireproofing, usually fiberglass, to replace the asbestos you
are removing.

A second way of dealing with
asbestos is called encapsulation. This
involves actually building a structure
around the asbestos so that it is totally
contained. In some cases this is a
viable option but usually it is almost as expensive as removal. Many buildings
cannot handle the extra weight of the
encapsulation structure.

The third way of dealing with asbestos
is called encasement. With this
procedure a special 2-part coating is
sprayed over the asbestos totally
preventing exposure to the fibers. The
first coat is a primer that binds with the asbestos fibers, holds them in place
and also prepares the surface for the
second coat. The second coat is the
sealer that does just that, totally
sealing off the asbestos.

Independent testing of encasement
has shown that the final surface is
completely safe. There are no airborne
fibers or other volatile substances
coming off the surface. It is totally
harmless. In the field, encasement has proven to be more than 50 percent
less expensive compared to removal
and can be done in half the time and
with much less labor expense. The big
drawback with encasement is the
asbestos is still there but as long as the building isn't changed or demolished
the encasement coating renders the
asbestos totally harmless.
