Tony Bower, Director of Mullaways Medical Cannabis Pty Ltd will challenge the validity of the Search Warrant obtained by police to enter his property and the seizure of over 200 medical cannabis plants and business records notwithstanding that police unlawfully entered the premises before obtaining the Search Warrant.

Mr Bower said "I am not walking away from this or from the hundreds of patients who use Mullaways Medical Cannabis Tincture. I have inspected the police application for the Search Warrant held at Kempsey Local Court House and found that the reasons given by the police to obtain the Search Warrant were false and misleading.

Tony Bower said "I intend to defend the charges and have served a subpoena on the Registrar of Kempsey Local Court for full access to the warrant application and supporting documents. A subpoena hearing is listed for 16 April in the Local Court at Kempsey on the same day police commence court proceedings against Mr Bower.

We have ascertained from the warrant documents that police failed to state in the application that the premises belonged to my company, Mullaways Medical Cannabis Pty Ltd and that I showed them documentation that the medical cannabis was cultivated for patients suffering and dying from serious conditions such as cancer. "

Tony Bower said he held up the Mullaways Medical Cannabis Pty Ltd company sign when the police helicopter was hovering over the medical cannabis plants. Tony Bower said "I walked across the road and spoke to police when they landed on an adjoining property. I fully informed police that the medical cannabis grown at the premises was for seriously ill and dying patients and to call the health department.

The police ignored everything I said and entered my premises without a warrant. They made no enquiries before applying for the search warrant even though I showed police business documentation. Police remained on the property while waiting for a search warrant. Once the search warrant was obtained I was taken into custody and was not present throughout the search of my premises.

There were no complaints made about the medical cannabis plants or tincture to the health authorities however police conducted this raid as part of their annual cannabis eradication program. It was clear that this was not a drug trafficking operation What drug trafficker has a website and a company registered under Commonwealth law. What drug trafficker has letters from their client's doctors recommending that their patients use medical cannabis to treat their medical conditions.

I am deeply offended that my business premises were raided in this manner and that I have been charged by the NSW police as a criminal under the Drugs Misuse and Trafficking Act." Regarding the Single Convention on Narcotic Drugs 1961 to which Australia is a signatory

It is really important to understand that one of the fundamentals of the preamble of the Single Convention on Narcotic Drugs 1961, states:

...recognising that the medical use of narcotic drugs continues to be indispensable for the relief of pain and suffering and that adequate provision must be made to ensure the availability of narcotic drugs for such purposes ...

This has recently been reaffirmed by the
United Nations Commission on Narcotic Drugs

Striking the right balance to achieve the optimal public health outcome

At the 53rd session of the Commission on Narcotic Drugs (CND) held in March 2010, the Commission adopted Resolution 53/4 “Promoting adequate availability of internationally controlled licit drugs for medical and scientific purposes while preventing their diversion and abuse”.

The Commission recalled the recognition of parties to the Single Convention on Narcotic Drugs 1961 as amended by the 1972 Protocol:

“that the medical use of narcotic drugs continued to be indispensable for the relief of pain and suffering and that adequate provision must be made to ensure their availability for such purposes.”

Convention control measures to ensure safety and availability (Page 7)

The objective of the international drug Conventions—balance between ensuring availability and preventing diversion and abuse—is promoted by an international regulatory system that provides the framework for national drug regulation. Pursuant to the international regulatory system, States agree to adopt certain regulatory requirements.

The control provisions of the Conventions are designed to (a) ensure that controlled medications are prescribed for legitimate medical purposes and safely reach patients through a controlled distribution chain and (b) combat illicit manufacture, trade and distribution.

They are designed to serve what the INCB has described as the overall goal of a “well functioning national and international system for managing the availability of narcotic drugs and psychotropic substances” namely “to provide relief from pain and suffering by ensuring the safe delivery of the best affordable drugs to those patients who need them and, at the same time, to prevent the diversion of drugs for the purpose of abuse”.

All people surveyed provided a letter from their Doctor stating their illness/condition and that the Doctor was monitoring them. Most Doctors recommending cannabis for their patients recommended a non smokeable form of cannabis be used.

An overall drop in the use of medications was expected but the continued reporting by participants that they had greatly reduced or given up alcohol, tobacco and other drugs after using the Tincture for a time was not expected but could not be ignored.

Of particular note was the stabilising affect the tincture had in one Diabetes case.

The NSW Police have hit a new low by descending in an expensive tax-payer-funded operation with a police chopper and confiscated the medical cannabis crop needed to make Mullaways Medical Cannabis Tincture. The medical cannabis crop was a strain of cannabis specifically bred by Mullaways Medical Cannabis Pty Ltd to be extracted into a medical tincture. Each medical cannabis plant was labelled for specific patients. Through the confiscation of this medical cannabis crop, the NSW Police have deprived many Australians their medicine. It is a form of discrimination against sufferers of chronic illness and pain whom need this medicine – Medical Cannabis.

On the 23 of August we will be going to NSW Parliament House to hand over our terms for a treaty on cannabis.

A treaty will be drawn up and presented to the Secretary of Health as it is the Health Department that control the Growing and Possession of cannabis in NSW for medical purposes. We will be asking that person to discuss a treaty.

With the help and support of the Hemp Embassy we will be asking everyone to come down and support this.

Bring a joint or we will be dispensing cannabis tincture free of charge to all who bring a letter from their doctor stating they have an illness cannabis is known to treat.

We will also be asking the NSW Health Minister to issue a Card protecting patients from harassment. This should have been done a long time ago in accordance with the TGA Special Access Scheme. If they are unwilling to provide this medicine they cannot stop you from providing your own. This is in Law.

If the Secretary of Health will not talk, or if for some reason they do not exist, as has been implied in some correspondence, then we will be going straight to the NSW High Court.

A letter of Notice has been sent to the NSW Health Department advising action will be taken on that day.

It is time to stand up and show we have the courage. Not only to help ourselves but to help others less fortunate. Lets help them have a quality of life they deserve.

Lets sit down and have a smoke or a cookie or even a home made tincture - whatever you like.

Lets sit down and actually talk about the end of the 100 year war.

I have written to you, asking for a meeting to discuss this very serious matter that confronts us... but it seems it has fallen on deaf ears again.

I am not prepared to stand back any longer and watch our young go to jail because they tried to help their aunty or uncle or even worse their parents: Imagine watching your son or daughter go to jail when you are dying and in extreme pain knowing that all they were doing was try to help, imagine your last thoughts not being able to see your son or daughter and tell them you’re sorry...

Imagine the contempt the people in these situations must feel for you. If there really is a heaven and a hell, then these people are there waiting.

The people that I talk to want legalisation and I understand some of their argument, but it has not been what I was trying to achieve. I hope you fully understand that over the years I have gathered all the information I need to achieve just that. I also know that over 57% of this state would vote for it... so to all the doubters that thought I could not get this far, think again.

I was given this task by country. I was judged by our government to be a ‘fit and proper person’ to do the job at hand; if you are now unwilling to talk then I will talk to the people and unlike you I will give them what they want.

So please understand the consequences of the indignant attitudes that you have taken as I know the outcome, I win. It would be best to be at least talking at the finish.

I hope that you have looked at all my letters and paperwork, it will tell you I’m not doing this to make friends ~ but if I have made new ones along the way, that will be a bonus.

I Support Medical Cannabis in Australia

I created this page to support the medical cannabis industry here in Australia and to help the first and only federally approved medical cannabis manufacturing and research company in attracting state government accountability for the approval of their application to commence business in this state.

-The application has been received by NSW Health (Gov.) yet after numerous requests; they simply don’t reply to queries or send any kind of ‘receipt of acknowledgment’ (18 months...).
-The application has NOT been sent back unsuccessful. (18 months...)
-NSW Health have been sitting on the application for 18months..., very skilfully and backhandedly dodging responsibility to process its approval.

*{I}* ...I postulate the reason they are stalling is because; for the first time, they've got an application in their hands from a legitimate, registered, expertly knowledgeable and industry supported company who has jumped through the necessary hoops and ticked ALL the right boxes...

... furthermore, as there also would be legal ramifications for destroying or trashing an application, it probably just got accidentally, mysteriously and inexplicably misplaced in their storeroom with the rags and dirty sponges hoping it'll deteriorate into forgotten-ness...

...all they've got left to stop medical cannabis in Australia is to try to kick it under the rug - well I don't think so... :)

They are gripping the rail with fear of the implications because it IS HAPPENING, they know they can't stop it and they don't know enough about it to be able to control it. What they think they know about cannabis is that it's a 'drug'; and that there's a 'war on drugs'; and that makes it bad; and so on; ...

...and that makes them look stupid.

Q/. How many people can hold a discussion with you and tell you how 'bad' medical cannabis is and be able to support their anti-cannabis claims based on fact not fear or propaganda?

A/. Not one. Not many of us even know much about the plant and its medicinal properties at all, let alone how to tell you it's bad for you when it's not. (To be just as ridiculous and ludicrous: I could tell you how drinking water is bad for you and passionately associate it to a high risk of fatality because I heard -thought I learnt - that someone choked and drowned on half a glass of water! :)>

With very few cannabis experts throughout the world and the hush-hush stigma associated to it strangling the career path, not many people know much about the plant at all. That’s one great reason why we need to embrace it; to research it and develop it into positive and progressive uses such as medicine, building materials, land regeneration, paper, clothing...

We need to stop the harmful use and abuse of the generally low quality, ill prepared and undeveloped cannabis represented in the ‘black market’ culture. There is no war on this so-called 'drug', just an excuse for government expenditure and State accountability (keeping international face) which requires more expenditure in policing and detaining the chronically ill who are forced into the black market seeking the plant’s medicinal qualities to heal or cope with extreme chronic conditions.

Police are also dangerously, and in some cases fatally policing and detaining our children (the ever curious teen/adolescent, who of course, is invincible, will live forever and just has to try everything! - even if it is just once). Just a small stint in detainment, or even a negative experience with the law can have enough effect to traumatise the positive growth and development of our children. And to add hammer to nail, salt and liquor to open wound - Magistrates are giving sentences out like they were Father Christmas! It's quite sickening to watch our youth imprisoned one after the other for petty, non-criminal, offences.

Anyway, in any case or any event:

The chronically ill are suffering unnecessarily with modern health regimes and their harmful, never fully tested, synthetic medicines which furthermore require additional modern pharmaceutical synthetics to treat side effects etc, etc and so on....

Help bring back a natural herbal medicine that relieves sufferers of their chronic conditions without aggravating and/or complicating their condition (in a lot of cases it is the only truly effective healing treatment available).

It is of great offense to my nature and against my culture to refuse help to someone in need where I have the capacity to help.

Thing is people know where to get the medicine - the disgusting injustice to humanity is how this government system is proactively taking the most extreme measures to ensure that if you have an illness that medical cannabis can effectively treat and take any steps to educate or medicate yourself then you're at war with the government... just politically criminalising our youth, sick, dying and suffering... which, to understate, is so much more than just wrong and on so many levels!
