New Study Shows Minimal Benefit from Aggressive Diabetes Treatment*

Statistics show that heart disease is responsible for the death of two-thirds of diabetics. In response to these disconcerting reports, some experts have proposed aggressive diabetes treatments to prevent the future incidence of heart problems. However, a recent study released by Australian researchers concludes that this new method of “aggressive” treatment does not forestall cardiovascular pathologies any better than standard methods for lowering blood sugar levels.

The Australian study, which compared the two treatments on thousands of participants, detected no cardiovascular benefit that would warrant the aggressive treatment of Type-2 Diabetes, that is, the number of strokes and heart attacks remained the same between the two study groups. Nevertheless, the study did report that aggressively treating diabetes resulted in a one-fifth reduction of kidney problems, a frequent complication for diabetics.

Each year, millions of people who are disabled from an accident or disease turn to the federal government for Social Security Disability payments - a benefit that every worker who is declared disabled is eligible to receive. It's a 51-year-old government insurance program - a lifeline of sorts - that every worker pays for through that line-item on their pay stub, known as FICA.

But a two-month CBS News investigation reveals that safety net may not be there when you need it most.

"I always figured that I'd die in a fiery car wreck or something, never that I'd be disabled," 33-year-old Scott Watson told CBS News chief investigative correspondent Armen Keteyian.

Two years ago, a failed surgery left Watson with a fracture in his spinal cord. It turned his life upside down, leaving him unable to work in his job as a broadcast engineer.

"Everybody says, 'You gotta have a positive attitude,'" Watson said. "You know, and I say, 'Well, I am positive. I'm positive this is the end,' you know. I mean it's not going to get better."

Declared disabled by the state of Maryland, Watson was told he was "shoo-in" when he applied for federal disability last year, only to be turned down three months later on the grounds, according to federal guidelines, he wasn't disabled enough. Watson appealed, and was denied again.

He's one of 27,000 Maryland residents - 68 percent of all those who applied - to suffer such a fate.

Overall, two out of every three people who apply for federal disability benefits are rejected by a government agency that critics say is out of date, underfunded, and incapable of serving the exploding number of disabled Americans. Waiting times for a hearing in some cities are more than three years.

Linda Fullerton, an advocate for the disabled, told Keteyian: "I have people all the time writing to me, saying they are suicidal."

Fullerton's online support site is home to one horror story after another.

Reading from emails, she said: "Had to file bankruptcy to keep home. Losing home with four children."

A two-month CBS News investigation has found that over the last two years, at least 16,000 people fighting for disability benefits died while awaiting a decision.

Overall, the backlog of cases now stands at 750,000 - up 150 percent since 2000.

People wait an average of 520 days for a hearing on their claims.

"So. Jerry, this is how it ends up for you?" Keteyian asked.

"This is how it is," Rice replied. "I hope it's not how it ends up."

But he believes he deserves the disability?

"I'm not asking them to give me welfare," Rice said. "I'm just asking them to give me what they promised. Yeah, I deserve it."

"It's a mess from the time you apply - till the time you get a hearing," said attorney John Hogan, who has represented thousands of folks in Atlanta, the backlog capital of the nation.

"We're the furthest behind of any area of the country, it could take 2.5 years to get your hearing," Hogan said.

Make notes as to the time of day, weather conditions, road conditions, street lights, and the presence or length of skid marks. Try to make a diagram noting the location of the vehicles, crosswalks, stop signs, and traffic signals.

When you exchange information with the other driver and give the facts to the police, do not feel obligated to admit responsibility for the accident. The things that you say immediately following an accident may be used against you during the course of litigation. You may think that you were responsible for the accident and later learn that the other driver caused it or the other driver was equally at fault.

C. Towing Your Car

What to do after a car accident!

Your heart is beating hard, you're breathing fast and you can't believe you just got into an accident. Look around. You're alive? Good. Everyone else? Even better. Now here's what you need to do once the dust settles.

Call An Attorney and Get Help Now

You should: (1)Keep your auto insurance information in the glove compartment, including a pre-printed form allowing you to provide the particulars of any accident, including a sketch of the scene. (Even better, use that disposable camera you keep in the car. You don't? You should. (2)Stay at the scene of the accident until police have come and gone, making sure you have the name of the officer(s) and that they have your version of what happened. Do not assume a police report will "take you off the hook" or even that one will be generated in the event of a minor accident ("minor" may mean no one is injured even though your car suffers a direct hit).(3)Exchange names, addresses, driver's license and insurance information with the driver of the other car.(4)Review your policy to make sure of your coverage. Make a list of questions and related information you want to know.(5)Report the accident promptly to your insurance company. This may not seem wise or necessary to you. The accident may be minor, you may not want to risk seeing your rates rise or you may live in a no-fault state and think that the other driver's insurance company will pay for everything. But state laws generally protect you from higher rates unless an accident was your fault. And even though you may think no-fault lets you off the hook for the other driver's medical expenses, it does not. It simply says his insurance will pay for his expenses (up to the limits of his coverage), regardless of who is at fault. But rest assured his insurance company will come knocking on your insurer's door seeking repayment if it believes you were at fault in the accident. The point is, your insurer should be informed.

Think that's the end of it? Read on.

You've never read your auto insurance policy, you don't want to read it and even if you're in an accident, you're still not sure if it would force you into those endless lines of fine print and insurance-speak. Assuming you can even find the policy. If you can, look in the back for what are called the conditions of your policy -- what you are supposed to do in the event of an accident. These requirements are pretty straightforward, although compliance may seem like a hassle when you're already upset by the accident itself. But you may forfeit some of your rights if you don't follow these instructions. Next, look at the cover sheet of the policy, which is called the declarations page and which lists the types and dollar limits of your coverage, including short-hand references to any discounts or special provisions you have elected to purchase. Last, there's the actual insuring agreement itself, which explains what your insurer is protecting you against, including definitions of terms used in the agreement and explanations of what's not covered (called the exclusions). If you don't understand your policy, keep calling your agent and/or state insurance department until you get clear answers to your questions. Most people have heard that ignorance is no defense under the law, but they don't think they'll ever have to find out. Hopefully, your accident involves only damages to things and not to people. And, hopefully, it wasn't your fault. Even if it's just your car that's banged up, repairs can be a major headache. This is where the reality sets in that replacement cost is not the same thing as market value. Your car can easily be declared a total loss even though the money you'd receive is nowhere near what it would cost you to replace the vehicle. The best advice about getting your car fixed is to remember that the money may be coming from the insurance company but you should control the repair process. This means refusing to settle for a repair job you don't like. And it may also mean refusing to accept the use of generic replacement parts instead of the original manufacturer's parts (your policy may give your insurer the right to use generic parts, so it's important to check the fine print to know your rights). Even if your favorite shop doesn't do the repairs, you can still have your mechanic look at the car (although this may be at your personal expense) and provide an assessment of what should be fixed. In almost every case, no matter what the disease is, the answer is the same - "Maybe, it just depends upon how badly you are affected by the disease." One example might be cancer. The word "cancer" is scary to anyone, but there are many cancers which can be treated and cured very quickly, with little or no lasting effect. On the other hand, of course, there are cancers which cause great suffering and ultimately death. The question in each individual case is "How sick is this particular individual with cancer and how long is this person going to remain sick?" Skin diseases are another example. The vast majority of skin diseases, while annoying, would not be considered to be disabling. On the other hand, there are some uncommon, very severe skin problems which are clearly disabling. In extreme cases, psoriasis, which is not rare, may be disabling. Thus, almost without exception, the mere fact that an individual has a disease with a certain name does not guarantee that the individual either will or will not be found disabled. It all depends upon how sick the person is.

Unless your disability is catastrophic (such as terminal cancer, a heart condition so bad that you are on a heart transplant waiting list, total paralysis of both legs, etc.), there is no easy way for you to tell whether you will be found disabled by Social Security. In the end, the decision of whether or not to apply for Social Security disability benefits should not be based upon whether or not the person feels that Social Security will find them disabled. Attorneys familiar with Social Security disability can make predictions about who will win and who will lose, but even they can seldom be sure. An individual should make the decision about whether or not to file for Social Security disability based upon their own belief about their condition. If the individual feels that he or she is disabled and is not going to be able to return to work in the near future, the individual should file for Social Security disability benefits. If denied, the individual should consult with an attorney familiar with Social Security disability to get an opinion as to the chances of success on appeal.

Yes. There is an offset, which reduces Social Security Disability benefits because of worker's Compensation benefits paid, but in virtually all cases, there is still some Social Security Disability benefits to be paid. In a few states the offset works the other way - - Worker's Compensation benefits are reduced because of Social Security disability benefits.

You do not have to wait until the worker's compensation ends and you should not wait that long. An individual can file a claim for Social Security disability benefits while receiving worker's compensation benefits. It is best to file the Social Security disability claim as soon as possible because otherwise there may be a gap between the time the worker's compensation ends and the Social Security disability benefits begin.

No, you do not have to wait until the sick leave is exhausted. You should file for Social Security disability benefits now, if you believe that you will be out of work for a year or more.

Not even one day. You can file for Social Security disability benefits on the very same day that you become disabled. Many individuals make the mistake of waiting months and even years after becoming disabled before filing a Social Security disability claim. There is no reason to file a Social Security disability claim if one has only a minor illness or one which is unlikely to last a year or more. However, an individual who suffers serious illness or injury and expects to be out of work for a year or more should not delay in filing a claim for Social Security disability benefits.

Possibly. If you have worked five out of the 10 years under Social Security before becoming disabled, you will have enough earnings in to potentially qualify for Social Security disability benefits. For individuals 31 or less, the requirements are a little different, since such individuals have not had such a long time to work. Unless a person has been staying home and taking care of their children for quite a long time, however, it is very possible that they will qualify for Social Security disability benefits based upon their own earnings. Also a homemaker, if poor enough, can qualify for Supplemental Security Income (SSI) whether he or she has worked in the past or not.

No. If you have worked in recent years or if you are applying for Disabled Widow's or Widower's benefits or Disabled Adult Child benefits, it does not matter how much money you have in the bank. There is no reason to wait to file the claim.

The best, surest way to file a Social Security disability claim is to go to the nearest Social Security office in person and wait (often for a few hours) to see someone to file the claim in person. In the alternative, a person may contact Social Security by telephone and arrange for a telephone interview to file the claim.
