woman named Kirsten decided to look into the legality of Pinterest. After all, she's a lawyer with a passion for photography.
What she found scared her so much, she shut down her Pinterest boards entirely.
Kirsten's investigation began after she saw photographers complaining about copyright violations on Facebook. She wondered why Facebook could get in trouble for copyright violation and Pinterest couldn't.
She browsed Pinterest's Terms of Use section. In it she found Pinterest's members are solely responsible for what they pin and repin. They must have explicit permission from the owner to post everything.
"I immediately thought of the ridiculously gorgeous images I had recently pinned from an outside website, and, while I gave the other photographer credit, I most certainly could not think of any way that I either owned those photos or had a license, consent or release from the photographer who owned them," Kirsten writes.

Pinterest encourages repinning community photos though, so Kirsten found it hard to believe the act was unlawful. She continued to dig.
Kirsten turned to federal copyright laws and found a section on fair use. Copyrighted work can only be used without permission when someone is criticizing it, commenting on it, reporting on it, teaching about it, or conducting research. Repinning doesn't fall under any of those categories.
The one glimmer of hope for Pinterest, Kirsten writes, is the outcome of Kelly v. Arriba Soft Corporation. In that case, a photographer sued a search engine. The search engine won because it used thumbnail images in its results, not the entire work.
Thumbnails aren't always fair use, however. They're only fair use if the necessary portion of the work is copied and nothing more. Pinterest, however, lifts the entire image from the original source which is not ok.
If that didn't scare Kirsten enough, the all caps section of Pinterest's Terms of Use did.
Pinterest writes:
“YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND SITE CONTENT REMAINS WITH YOU.”
What's more, Pinterest places all blame and potential legal fees on its users. It writes:
"You agree to defend, indemnify, and hold Cold Brew Labs, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Site, Application, Services or Site Content, (ii) your Member Content, or (iii) your violation of these Terms.”
Basically, if a photographer sues you for pinning an image illegally on Pinterest, the user must not only pay for his or her lawyer, they must also pay for Pinterest's lawyer. In addition, the defendant must pay all charges against him or herself, along with all of Pinterest's charges.

Kirsten likens Pinterest to Napster as an enabler of illegal activity. It wasn't just Napster that went down -- 12 year old girls who downloaded music were sued too.
She concludes:
"My initial response is probably the same as most of yours: 'Why [can't I pin their work]? I’m giving them credit and it’s only creating more exposure for them and I LOVE when people pin my stuff!' But then I realized, I was unilaterally making the decision FOR that other photographer...Bottom line is that it is not my decision to make. Not legally and not ethically."
UPDATE: After he caught wind of Kirsten's article, Pinterest co-founder Ben Silbermann called her to discuss the copyright issues.
Silbermann told her he was "basically a guy with a computer who had a vision" who "knows there are issues with Pinterest and the fear of claims of copyright infringement."

Abercrombie-and-fitchoutlet.com is a Hong-Kong based bootleg supplier of faux A&F wares, including these lovely cargo pants in a deep “Nigger Brown” shade. I know. Gawker reported that a bad Chinese translation software is to blame for this situation. Apparently, it translates “dark brown” into “nigger brown.” (Someone needs to have a chat with the software writers!) I went to the website to livechat with one of the service reps about this issue. When I inquired about the pants, he apologized profusely, saying, “We have changed the name of the product, please check it. Sorry about that.” When I pressed him further, asking him questions like, “do you know any brown people the same color as those pants?” he replied with the same comment. Student Loan Forgiveness Act 2012

On March 8, Congressman Hansen Clarke (D-Mich.) introduced H.R. 4170, the Student Loan Forgiveness Act of 2012.

Normally we don't go into the findings of particular pieces of legislation, but the Student Loan Ranger thinks findings like this are refreshing and show Rep. Clarke is living in the reality most of us inhabit, including:

Total outstanding student loan debt officially surpassed total credit card debt in the United States in 2010, and is on track to exceed $1,000,000,000,000 during 2012;

Excessive student loan debt is impeding economic growth in the United States. Faced with excessive repayment burdens, many individuals are unable to start businesses, invest, or buy homes;

Because of soaring tuition costs, students often have no choice but to amass significant debt to obtain an education that is widely considered a prerequisite for earning a living wage."

If you want to hear more from Rep. Clarke, you can watch him introduce the bill in the House. But right now we're going to do what the Student Loan Ranger does best: explore the details.

The act would create a new 10/10 Loan Repayment Plan (with new forgiveness provisions), cap interest rates for all federal loans, greatly improve Public Service Loan Forgiveness, and convert some borrowers' private loans to federal loans. That's a lot! Here's more information on four key parts:

1. 10/10 Loan Repayment Plan: Cleverly called 10/10, the plan caps payment amounts at 10 percent of a borrower's discretionary income (the same 10 percent cap as President Obama's Pay As You Earn proposal in terms of payments) and can provide forgiveness in 10 years.

The forgiveness provision kicks in after a borrower makes 120 payments, which must be either payments under the 10/10 plan; payments that were not less than they would have been under the 10/10 plan; or "payments" of $0 during a month the borrower was in deferment due to an economic hardship.

For borrowers on or after the date of enactment, forgiveness is limited to $45,520 in principal and fees plus the interest accrued on the principal and fees. That's a huge amount!

There is no forgiveness cap for borrowers who predate enactment. And because prior payments can count, many borrowers who have been repaying their loans for 10 years or more could be eligible for complete forgiveness right away.

One of the Student Loan Ranger's reservations about the plan is that it currently requires borrowers to agree to have their payments electronically debited from a bank account, which could penalize low-income borrowers who may not have bank accounts. We're also concerned that requiring borrowers who leave the plan to repay on a standard plan could put some into a catch-22 where they can't afford payments in 10/10 but also can't afford to leave.

Finally, we're hoping that the plan will be open to help all borrowers with federal loans, without having to meet a threshold like the "partial financial hardship" required for Income-Based Repayment.

2. Capping interest rates for all federal loans: The act would cap the interest rate on federal loans at 3.4 percent. This is great news for borrowers, since the interest rate is set to be 6.8 percent for all federal Stafford loans as of July 1, 2012.

3. Improving Public Service Loan Forgiveness: The act would also provide for Public Service Loan Forgiveness after 60 monthly payments instead of 120. It is impossible for us to overstate how much this would help borrowers who have committed to careers at relatively low-paying public interest jobs, who could actually start saving for their kids' education and perhaps owning their own home half a decade earlier than they anticipated.

4. Refinancing private education loans: Certain eligible borrowers would be able to obtain a Federal Consolidation Loan to discharge private loans (which lack the protections of federal loans). While we have a few questions about the details, such as whether this would be open to borrowers who had to borrow private loans in addition to federal loans, overall, this would be an incredible help to borrowers struggling with private loans.

This is an act that really needs public support if it is going to move out of the House Education and the Workforce, House Armed Services, and House Foreign Affairs committees it has been referred to. I was at a work conference yesterday and was reading the eBook ‘Acne Free in 3 Days’ while I was hiding in the audience. While I was reading through the book, I had one of those ‘ah-ha!’ moments that makes you want to slap yourself and wonder why you didn’t think of it before.
You see, I’ve read so much in forums and even received emails from readers about the relationship between candida and acne, but I’ve never considered just how strong the relationship between the two actually is. In fact, your acne may be caused by candida alone. Which means, if you clear up your candida you clear up your acne.

What is Candida and why does it cause acne?

Candida albicans is a fungus that is normally found on the skin and mucous membranes in the mouth, rectum, or vagina. It may also travel through the blood stream and affect various parts of the body. If the fungus is not controlled, problems may occur. Basically, the Candida Albicans is a negative yeast infection that begins in the digestive system and as time goes by it spreads to the other parts of the body. It acts as an invading parasite that attaches to the intestinal wall and makes home of your internal organs, which makes the body react and create the many symptoms.

Not everyone who has a Candida problem will suffer from acne, acne is just one of many possible side effects. I had a problem with Candida once in my lifetime which was caused by a reaction to the contraceptive pill. My main symptom was chronic thrush which lasted for about a year, I had a couple of spots but generally my skin was fine.

The author of the book suffered from severe acne when he was a teenager (I’m guessing from hormones). He then treated his severe acne through a lot of antibiotics and a course of accutane. One of the possible side effects of antibiotics is Candida Albicans. So when the author had grown out of his hormonal acne, he then got chronic acne again from the Candida. Once he cured his Candida through mainly a heavy detox and diet (all in his book), his acne so quickly and easily just went away.
The more I read the more I’ve come to have the opinion that acne from Candida Albicans is perhaps not the easiest to get rid of, but certainly the fastest. As soon as you kill the excess fungus in your system, the acne simply just goes away, fast.
If you do have Candida Albicans, the condition can be controlled by diet, probiotic supplements and if you’re game like the author of acne free in 3 days – a detox.
To fix my Candida problem I visited a doctor (who was also a natural therapist). They told me to stop taking the pill, recommended supplements, wrote a prescription and put me on a strict no sugar, yeast and alcohol diet for one month. This cleared up my condition, and to my surprise gave me flawless skin. I was very disciplined with my sugar intake though. I didn’t even eat sugar substitutes and I wasn’t a big fruit eater then so I pretty much stayed away from the ‘sweet’ flavors for that month.

Viola Davis stepped on to the Oscar's red carpet in a beautiful, strapless emerald green Vera Wang gown and said she purposefully skipped the wig she wears on red carpets and for film roles. It is the first time the actress has rocked her natural short locks on a worldwide stage, and she says her husband, Julius Tennon, saw it as a potential opportunity for empowerment. "My husband wanted me to take the wig off," she told InStyle at a pre-Oscar dinner in Los Angeles. "He said, 'If you want to wear it for your career, that's fine, but in your life wear your hair. Step into who you are!'"

And while Viola has said she's not giving up the wigs for good, wearing her own hair was an excellent choice for a big event like the Oscars.
