Brazil is first government to sue Twitter

The government of Brazil is the first national government to sue the social networking site Twitter (where your account can be managed by Tweet Adder ) because it says that the site was used to help criminals evade capture, and avoid people from being caught be speed traps.

The announcement by Brazil comes on the heels of Twitter announcing that it will delete content on a country by country basis if it breaks local laws. Brazil believes that by alerting people to speed traps and road blocks, people’s lives are being endangered and criminals are avoiding arrest because of people tweeting information.

According to the Brazilian government, road blocks are set up to catch people related to weapons and drug trafficking as well as car thefts. In addition, they believe that by information of the place and time of speed traps and road blocks, Twitter users are endangering people’s lives on the roads by defying measure designed to reduce traffic accidents. 55,000 people die on Brazil’s roads each year, costing the country billions, and Brazil is now suing for $290,000 for each day that Twitter and its users don’t obey with the request.

Dotcom refused bail for the second time as he’s deemed a “flight risk”

MegaUpload co-founder Kim Dotcom, or to use his real name Kim Schmitz has been refused jail for the second time. Unlike Bluehost, MegaUpload hosted files rather than websites, and has been closed down pending charges of online piracy by the US Federal Government. Dotcom was arrested in New Zealand, and has been prevented from being bailed because he is deemed a “flight risk” before being extradited to America. Arguing against this, Dotcom made his first public utterances since being arrested. He disputed the reasons for him being refused bail:

“I’m aware that if I go to Germany I would be unable to unfreeze my assets. What I want to do is stay here to fight and get my money back. What would I do in Germany with five kids and a wife with no money? It is not an option for me.”

Dotcom is a German citizen and as Germany has no extradition policy with the United States, he would escape trial in the US. Dotcom states that he hasn’t got the money to support himself and his 5 children, and wants to face the charges in the US so he can unfreeze his assets which are approximately $40million currently. US prosecutors feared that Dotcom may have more money and this played a part in the New Zealand court refusing bail for the second time. Justice Asher said:

“He may or may not have the means to bring about such a scenario, however it was open to the judge and constituted a significant risk which could not be mitigated by [bail] conditions.”

The fact that he could use a helicopter or another “unorthodox route,” the fact he was a wealthy man and possibility of returning to Germany, all played a part in bail being rejected. Dotcom is expected to appeal for a third time against being rejected for bail. The assets that have currently been seized are $6million of cars, $23million in Hong Kong as well as $10m worth of New Zealand government bonds. The dispute over online piracy will go on, and despite the SOPA and PIPA acts in the US being put on hold, websites and web hosts such as Bluehost are still uncertain about the future.

Data of 50m MegaUpload Users Could Be Deleted By Thursday

Hosting Service MegaUpload may have its data deleted as early as Thursday, according to reports. MegaUpload possesses data for over 50million users and as well as being accused of hosting illegal movies and music, the site also contains a lot of personal data files and photos which users would like to get back. Unlike web hosts such as Bluehost who keep data in their own database centers, MegaUpload used outside companies to host their users’ data.

Two of those companies, Carpathia Hosting Inc. and Cogent Communications Group Inc have been cited in a letter filed as part of the case from the Eastern District of Virginia US Attorney’s Office that the files will start to be deleted as soon as Thursday. Lawyer for MegaUpload Ira Rothken said he is confident that the data will not be erased:

“We’re cautiously optimistic at this point that because the United States, as well as Megaupload, should have a common desire to protect consumers, that this type of agreement will get done.”

According to Rothken, the data could be critical to MegaUpload’s case in court, and in any case, the hosting companies are in charge of the servers that hold the data so it will be up to those companies whether the data is removed or not.

Despite the fact that MegaUpload was based in Hong Kong, the US Federal Government was allowed to act as the company had hosting companies in the US (similar to Bluehost), who they were leasing servers from.

Currently then, there is great uncertainty as to when or if the data will be deleted but there will be many out there who will want to get their data back before the servers are wiped clean. We will have to wait and see about more developments.

Symantec advises users to stop using their software

Internet Security firm Symantec, who own the brand Norton Antivirus, have advised users to stop using one of its products after it was discovered that the code for the software was leaked online and that anyone using it could be exposed to hackers. The product in question is specifically the 2006 Norton Internet Security, Norton Antivirus Corporate Edition and Norton System Works. Alternatives, which can be bought with an ESET promo code, should be used for the time being. Symantec said in a statement:

“Symantec recommends disabling the product until Symantec releases a final set of software updates that resolve currently known vulnerability risks.”
