On Saturday, September 22, 2018, the Department of Homeland Security (DHS) announced a proposed rule that will define a law according to which people who enter and remain in the United States temporarily or permanently will have to provide for themselves and will not be able to ask the Government for any public benefits. Please click here to see the proposed rule. Based on the new rule all U.S. immigrants will have to show that they are not burdens on American taxpayers. The Government will make an evaluation on how likely a Green Card candidate will become a public charge at any time in the future. According to the proposed regulation, a public charge definitions a person who receives certain public benefits. E.g. federal, state, local, or tribal cash assistance for income maintenance, Temporary Assistance for Needy Families (TANF), Supplemental Security Income (SSI), Medicaid (with limited exceptions for Medicaid benefits paid for an “emergency medical condition,” and for certain disability services related to education), Medicare Part D Low Income Subsidy, the Supplemental Nutrition Assistance Program (SNAP, or food stamps), institutionalization for long-term care at government expense, Section 8 Housing Choice Voucher Program, Section 8 Project-Based Rental Assistance, and Public Housing. However, there will be some exemptions, such as asylees, refugees, and other categories of vulnerable individuals are not subject to the public charge ground of inadmissibility, along with aliens serving in active duty or in the Ready Reserve component of the U.S. Armed Forces, or the spouse or child of the service member. Also, DHS would not consider disaster relief, emergency medical assistance, benefits received by an alien’s U.S. citizen children, and Medicaid benefits received by children of U.S. citizens and potential adoptive children of U.S. citizens. Please go to the Department of Homeland Security (DHS) website to learn more.

Does it worth to take a chance to ask the Government for a free insurance and lose a chance to become a U.S. resident?

Before filling immigration papers consider purchasing visitors health insurance. India Network Visitors Health Insurance offers great plans for new immigrants who just moved to the United States, for Green Card holders, and for U.S. Citizens.

Which plan would be better for a new immigrant who is currently in a process of getting a green card?

It all comes to a person’s age, health and budget.

If a person is young, healthy, doesn’t have any pre-existing conditions and prefers to spend less money on premiums, he or she should go with CHUBB Standard plan or AXIS BasicCare plan. Both of these plans are fixed benefits plans and they offer low premiums from a US-based company.

If a person is in 50+ age group, has some pre-existing conditions (blood pressure, diabetes, heart issues, etc.) or who wants to have less out-of-pocket expenses, he or she should go with CHUBB Network plan or CHUBB Premier plan. These plans offer the best pre-existing coverage on the U.S. market. They consider pre-existing conditions the same as new problems and extend coverage to inpatient, outpatient care, etc.

Visitors insurance provided by India Network Visitors Health Insurance will give new immigrants a piece of mind during a stressful time of immigration to the United States.
Call 408-540-3600 to talk to the experienced insurance agents who can give advice on the best coverage for your visitors.

The redesign of these eight certificates is one of the many ways USCIS is working to combat fraud and safeguard the legal immigration system.

We piloted the new certificate design at the Norfolk, Tampa, Minneapolis-St. Paul, and Sacramento Field Offices, as well as at the Nebraska Service Center.

The certificates of naturalization are:

N-550, issued to an individual who obtains U.S. citizenship through the naturalization process;

N-578, issued to a naturalized U.S. citizen to obtain recognition as a United States citizen by a foreign state; and

N-570, issued when the original Certificate of Naturalization is lost, mutilated, or contains errors.

A Certificate of Citizenship is issued to an individual who obtains U.S. citizenship other than through birth in the United States or through naturalization. The various types of Certificates of Citizenship are:

N-560A, issued to an applicant who derived citizenship after birth;

N-560AB, issued to an applicant who acquired citizenship at birth;

N-645 and N-645A, issued to the family of an individual who served honorably in the U.S. armed forces during a designated period of hostility and died as a result of injury or disease incurred in or aggravated by that service. Form N-645 is issued if the decedent was a male, and the N-645A if the decedent was a female.

Form N-561, issued to replace a Certificate of Citizenship when the original certificate is lost, mutilated, or contains errors.

The redesigned certificates of citizenship and naturalization feature a large, central image against a complex patterned background, which helps deter the alteration of personal data. Each certificate possesses a unique image only visible under ultraviolet light and attempts to alter it will be evident. Posthumous Certificates of Naturalization and the Special Certificate of Citizenship each bear a different image, yet feature the same fraud-deterrent security features.

Periodically changing the design and printing methods for these certificates helps USCIS stay a step ahead of counterfeiters.

Although the look and feel of the documents is new, the process of applying for and receiving them has not changed. Individuals do not need to renew their Certificates of Naturalization or Citizenship, regardless of when they were issued. The certificates we issued before the redesign will continue to be accepted as proof of citizenship.

For more information on USCIS and its programs, please visit uscis.gov or follow us on Twitter (@uscis), YouTube (/uscis), Facebook (/uscis), and Instagram (@USCIS).

Would you like to have stress-free trip? We are here to help you!
USA is one of the most popular travel destination around the world. Every summer millions of people come here to spend their vacation or visit family. If it’s your first trip to USA, here is what you need to know about this country:

1. Public transportation is often very limited or not available at all in a lot of cities around USA. Roads can be very busy and difficult to navigate, especially if you don’t know English very well. That’s why you need to decide in advance how you’re going to travel in USA and maybe rent a car with good navigation system.
2. Make sure to have a valid credit/debit card. It’s the most popular way of making purchases and payments in USA.
3. Don’t use your cell phone. If you want to save money, you can buy local prepaid cellphone plan or use public Wi-Fi.
4. USA is a country with one of the most expensive prices for medical services and if you get sick here, it might cost you thousands of dollars. Please buy visitor insurance before you leave your home country. Here you can quote and apply for visitor health insurance plans provided by India Network Services.
5. Don’t be surprised to pay more than you see on a store tag because of sales tax. It varies depending on what you’re going to buy.
6. Be ready to give tips in restaurants, hotels, SPA, etc. If you’re going to pay with a credit card, you’ll need to write the amount of tip you would like to give on the credit card receipt and add it to the total number on the receipt.
7. USA uses a different measure system – distance in miles, temperature in Fahrenheit, weight in pounds, and height in feet.

Enjoy your trip and if you want to have stress-free time you should buy visitor health insurance. Go to this page to quote and apple for visitor insurance plans provided by India Network Services.

USA is very popular among foreign students and exchange visitors and for them it’s very important to know new USCIS rules if they fail to maintain their status in the United States. Also they need to remember to purchase Visitor Health Insurance. Please go to this website to learn your options.

U.S.Citizenship and Immigration Services (USCIS) today posted a policy memorandum (PDF, 179 KB)changing how the agency will calculate unlawful presence for students and exchange visitors in F, J, and M nonimmigrant status, including F-2, J-2, or M-2 dependents, who fail to maintain their status in the United States.

This policy aligns with President Trump’s Executive Order: Enhancing Public Safety in the Interior of the United States to enforce the immigration laws of the country and will go into effect on Aug. 9, 2018.

“USCIS is dedicated to our mission of ensuring the integrity of the immigration system. F, J, and M nonimmigrants are admitted to the United States for a specific purpose, and when that purpose has ended, we expect them to depart, or to obtain another, lawful immigration status,” said USCIS Director L. Francis Cissna. “The message is clear: These nonimmigrants cannot overstay their periods of admission or violate the terms of admission and stay illegally in the U.S. anymore.”

Individuals in F, J, and M status who failed to maintain their status before Aug. 9, 2018, will start accruing unlawful presence on that date based on that failure, unless they had already started accruing unlawful presence, on the earliest of any of the following:

The day after DHS denied the request for an immigration benefit, if DHS made a formal finding that the individual violated his or her nonimmigrant status while adjudicating a request for another immigration benefit;

The day after their I-94 expired; or

The day after an immigration judge or in certain cases, the Board of Immigration Appeals (BIA), ordered them excluded, deported, or removed (whether or not the decision is appealed).

Individuals in F, J, or M status who fail to maintain their status on or after Aug. 9, 2018, will start accruing unlawful presence on the earliest of any of the following:

The day after they no longer pursue the course of study or the authorized activity, or the day after they engage in an unauthorized activity;

The day after completing the course of study or program, including any authorized practical training plus any authorized grace period;

The day after the I-94 expires; or

The day after an immigration judge, or in certain cases, the BIA, orders them excluded, deported, or removed (whether or not the decision is appealed).

Individuals who have accrued more than 180 days of unlawful presence during a single stay, and then depart, may be subject to three-year or 10-year bars to admission, depending on how much unlawful presence they accrued before they departed the United States. Individuals who have accrued a total period of more than one year of unlawful presence, whether in a single stay or during multiple stays in the United States, and who then reenter or attempt to reenter the United States without being admitted or paroled are permanently inadmissible.

Those subject to the three-year, 10-year, or permanent unlawful presence bars to admission are generally not eligible to apply for a visa, admission, or adjustment of status to permanent residence unless they are eligible for a waiver of inadmissibility or another form of relief.

This policy memorandum is updating Chapter 40.9.2 of the USCIS Adjudicator’s Field Manual.

However whether you are going to see family and friends, starting a new job, going to school, or on a trip, having a good visitor health insurance is the most important thing you can do for yourself and your loved ones. Some people may argue that they are healthy or their medical conditions are under control, but the reality is, anything can happen. While having fun, you could get into accidents or catch cold by simply sitting next to a sick person. Diabetes and high blood pressure are universal problems that most elderly visitors from India and other countries are facing, and they are all pre-existing conditions that could lead to other health complications.

It is not unusual for a foreign national to be sponsored for an employment-based, third preference (EB3) position, and to later “upgrade” to an employment-based, second preference (EB2) position in a subsequent case, based on a higher level degree and/or additional work experience. For many, this raises the question about the prospect of upgrading to the coveted employment-based, first preference (EB1) category. While it certainly is possible for a person with an EB2 or EB3 position to then be sponsored for an EB1 position, it is important to understand that the criteria to qualify for EB1 is not simply a matter of additional schooling or experience as seen in the transition from EB3 to EB2.

Qualifying for EB1

There are three different subcategories of EB1, each with its own distinct criteria:

EB1(a) – Persons of Extraordinary Ability

This subcategory of EB1 is reserved for those with extraordinary ability in the sciences, arts, education, business, or athletics. To qualify, the foreign national must be able to show sustained national or international acclaim. The individual’s achievements in the field generally must be evidenced by extensive documentation.

A candidate for this category can self-petition; no offer of employment is necessary, but the applicant must intend to work in his or her field of expertise. More details on the EB1(a) category are available in the MurthyDotCom NewsBrief, Self-Petitioned, Employment-Based Options (24.Nov.2015).

EB1(b) – Outstanding Professors and Researchers

The EB1(b) subcategory is designated for outstanding researchers and professors. Although the bar to qualify for EB1(b) tends not to be quite as high as that of EB1(a), it still requires that the candidate demonstrate international recognition for achievements in a particular academic field. As a 2010 policy memo from the U.S. Citizenship and Immigration Services (USCIS) put it, the candidate “… should stand apart in the academic community through eminence and distinction based on international recognition.”

In addition to having a minimum of three years’ experience as a teacher or researcher, the foreign national must be sponsored by either a university or institute of higher education, or by a private employer with at least three full-time researchers, and that employer should have achieved documented accomplishments in the field.

As with the EB1(a) category, a strong petition generally is one accompanied by extensive, objective evidence of one’s accomplishments. See the MurthyDotCom InfoArticle, EB1: Outstanding Professor or Researcher for more details.

EB1(c) – Multinational Managers and Executives

The EB1(c) subcategory is reserved for multinational managers and executives, and is very similar to the requirements set out for the L1A classification. To qualify, one must have been employed outside the U.S. for at least one year within the past three years as a manger or executive by an organization related to the U.S. company sponsoring the foreign national. Further, the person must be coming to work for the related U.S. entity in a managerial or executive capacity. More information on the EB1(c) category can be found in the MurthyDotCom InfoArticle, Multinational Executives & Managers.

Conclusion

There is a natural progression that exists, allowing many who qualify for an EB3 position eventually to qualify for an EB2 job after completion of education and/or additional years of work experience. On the other hand, moving from EB3 or EB2 to EB1 is less straightforward. Still, given the possible benefits of filing under the EB1 category, especially for foreign nationals from oversubscribed countries, like India or China, exploring the possibility and understanding the eligibility criteria for filing an EB1 petition may be worthwhile.

There are a lot of different plans available for new immigrants, temporary workers and green card holders. Go here to see them.

U.S. Citizenship and Immigration Services (USCIS) announced on 04/27/2018 that the agency will begin phasing in use of the U.S. Postal Service’s (USPS) Signature Confirmation Restricted Delivery service to mail Green Cards and other secure documents beginning April 30, 2018.

The first phase will affect documents that need to be re-mailed because they have been returned as non-deliverable. These documents include Permanent Resident Cards (also called Green Cards), Employment Authorization Cards, and Travel Booklets. Applicants who have changed mailing addresses during the course of the application process are more likely to have their secure documents sent with the new delivery method, which USCIS will expand to all secure documents in the future.

As part of the new delivery method, applicants must present identification to sign for their documents upon delivery. They also have the option to designate an agent to sign on their behalf by completing the Postal Service’s PS Form 3801, Standing Delivery Order (PDF) or PS Form 3801-A, Agreement by a Hotel, Apartment House, or the Like (PDF). Applicants can sign up for USPS Informed Delivery to receive delivery status notifications. Applicants will also have the option to arrange for pickup at a post office at a convenient date and time by going to the USPS website and selecting “hold for pickup.”

Signature Confirmation Restricted Delivery increases the security, integrity, and efficiency of document delivery. The Signature Confirmation Restricted Delivery process provides better tracking and accuracy of delivery information, improving service to applicants.

Information on how to track delivery of secure documents is available on the USCIS website.

On occasion, we transfer cases between our five service centers in order to balance our workload and promote timely processing. This page provides up to date information on any workload transfers that we make. You can also subscribe to the Alerts GovDelivery distribution list to receive an email each time cases are transferred. Unless we note otherwise, below is the general information for a workload transfer.

How You Will Be Affected If We Transfer Your Case

If we transfer your case, we will send you a transfer notice. Your receipt number will not change, and the transfer will not delay the processing of your case.

You should continue to file your forms according to the existing form instructions. You can find the correct filing address listed under the “Where to File” section in the form instructions and on the form Web page.

If your pending petition is eligible for premium processing and you want to request premium processing after your petition or application was transferred, you must:

File your Form I-907 with the service center where your petition or application is currently pending, and

Submit a copy of the Form I-797, Receipt Notice, for your pending petition or application.

If you do not do both, we may reject your Form I-907.

How to Track the Status of Your Case

Check your case status online with your receipt number. You can also sign up to receive automatic case status updates by email.

If you do not receive a decision on your case within the published processing time for the new service center, you may submit an inquiry online or call the USCIS Contact Center at 800-375-5283. For people who are deaf, hard of hearing or have a speech disability: TTY 800-767-1833. When asking about your case status, please provide us with your receipt number and specify that your case was transferred to a new location.

If we send you any notice (such as a Request for Evidence), please read the notice carefully and follow the instructions provided.

If you move while your case is pending, you must inform USCIS of your address change. You may file a change of address on our website or by calling the USCIS Contact Center. It is important that you notify us of any address change as soon as possible, so that you continue to receive notifications from USCIS.
