The DNA profiles of every newborn should be done and results should be collected and systematically archived. Every citizen who turns 18 should get his/her fingerprint, iris, face and other such biometric data recorded. This data should be added to their respective DNA profile. This data should be added to the election identity cards, passports etc. equipped with electronic chips, which are to be issued in smart card form. A school teacher was dismissed from service for physically assaulting the school Principal. He challenged the order in Central Administrative Tribunal which held that the punishment was disproportionate and reinstated him. This was upheld by the High Court in appeal. The management took the matter to the Supreme Court of India by preferring  a Special Leave Petition. The Supreme Court held that a teacher is expected to be a role model in the society.  He is a &#39;guru&#39; who sets himself as an example for the students. It was a relief when her co-worker Swetha readily offered her friendship. The bold, ever-smiling and amiable nature of Swetha soon made her Shalini’s soul mate.&lt;br /&gt;&lt;br /&gt;One day, Swetha brought her an application and agreement…  “Hai, Shalu… would you please help me sweetiee” She continued… “Please sign these applications… I am getting a loan from XYZ Bank... They need someone to attest these. Where else can I go for this dear? Shalini was more than willing to offer any help… and she was indeed a “&lt;span style=&quot;font-style: italic;&quot;&gt;friend in deed&lt;/span&gt;”. Without thinking twice, she signed all the papers Swetha brought to her, without even reading them… she could not afford to distrust her dearest friend. It was a loan application for ten lakhs, which she needed for buying her new car and latest laptop…&lt;br /&gt;&lt;br /&gt;Swetha was a great friend but a terrific spender… She was already in deep debts. She never believed in economizing and budgeting. The inevitable event was soon to follow... Swetha was caught red-handed embezzling money and soon secured her red card out of that office. Civil and criminal prosecutions were lodged against her for recovery and forgery and misappropriation of funds. It was a hard news for Shalini... it was too much for her. Soon she started hearing not-so-pleasant stories about Swetha.. about her vagabond, uncaring and luxurious lifestyle and more of her debt traps. She was in fact nicknamed as “Loan&lt;span style=&quot;font-style: italic;&quot;&gt;a&lt;/span&gt;holic” and she was the last person to know it!! Shalini could not believe what she learned, first until she got a call from XYZ Bank reminding her about the liability. It took her some time to understand the implications. Swetha lost her job and she had no assets. For recovery, the bank had no option but to proceed against her guarantor, Shalini. She tried contacting Swetha… her phone was dead and she had moved from her earlier address. Soon she got a legal notice claiming a hefty sum… It was more than 15 lakhs, and Shalini had to pay if off. The price of friendship? or that of thoughtless action?&lt;br /&gt;&lt;br /&gt;When you stand as guarantor, know that you are endorsing the credit of a person. Do it responsibly. By signing a guarantee agreement, you are guaranteeing repayment of the loan. By doing so, you are agreeing to take up the responsibility for the credit given… If the person who takes the loan fails to repay the loan installments, the guarantor too will be held equally liable for the whole loan amount and interest due. So, be cautious next time… Give guarantee only to those persons who are really worth it. Law aides only the vigilant... and not those who sleep over their rights - &quot;Vigilantibus non dormientibus jura subveniunt&quot;. Various legal systems have prescribed their own periods during which actions, either civil or criminal can be brought in before Courts of Law. This period is called &quot;Law of Limitation&quot; or &quot;Law of Prescription&quot;. Normally, law prohibits all actions beyond the relevant prescribed period.&lt;br /&gt;&lt;br /&gt;In India, the law of limitation is mainly embodied in &quot;The Limitation Act, 1963&quot; (Act 36 of 1963). As per the definition given in the said Act, &quot;period of limitation&quot; means the period of limitation prescribed for any suit, appeal or application by the Schedule, and &quot;prescribed period&quot; means the  period of limitation computed in accordance with the provisions of the Act.&lt;br /&gt;&lt;br /&gt;Section 3 of the Act imposes the bar of limitation. The periods of limitation for various kinds of actions are listed in The Schedule of the Act. The various kinds of actions are listed as Articles and the respective periods of actions and from what event, the mentioned periods will start to run, are given against each of item.&lt;br /&gt;&lt;br /&gt;To illustrate, Article 19 of the Schedule provides:&lt;br /&gt;&lt;br /&gt;Art. 19:   For money payable for money lent  -  Period of limitation: 3 years   -   Time from which period begins to run: When the loan is made.&lt;br /&gt;&lt;br /&gt;This means, when the money is lent as loan, a suit for recovery of that amount has to be filed within three years from the day on which the money was lent. If X lent Rs.1,00,000/- to Y on 01.01.2000, if X want to file a suit against Y for the recovery of the same, he/she need to file the suit within three years, i.e., 31.12.2002. If the suit is filed after 31.12.2002, the Court will dismiss the same on the ground that the claim is barred by limitation.&lt;br /&gt;&lt;br /&gt;Sometimes this period is prescribed by other statutes as well. Satan and His Staff, 54 F.R.D. 282 (1971)&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Gerald Mayo filed a claim before the United States district court for the Western District of Pennsylvania in which he alleged that &quot;&lt;span style=&quot;font-style: italic;&quot;&gt;Satan has on numerous occasions caused plaintiff misery and unwarranted threats, against the will of plaintiff, that Satan has placed deliberate obstacles in his path and has caused plaintiff&#39;s downfall&lt;/span&gt; &quot; and had therefore &quot;&lt;span style=&quot;font-style: italic;&quot;&gt;deprived him of his constitutional rights&lt;/span&gt;&quot;. While the official re-ports disclose no case where this defendant has appeared as defendant there is an unofficial account of a trial in New Hampshire where this defendant filed an action of mortgage foreclosure as plaintiff. The defendant in that action was represented by the preeminent advocate of that day, and raised the defense that the plaintiff was a foreign prince with no standing to sue in an American Court. This defense was overcome by overwhelming evidence to the contrary.  Whether or not this would raise an estoppel in the present case we are unable to determine at this time.  If such action were to be allowed we would also face the question of whether it may be maintained as a class action.  It appears to meet the requirements of Fed.R. of Civ.P. 23 that the class is so numerous that joinder of all members is impracticable, there are questions of law and fact common to the class, and the claims of the representative party is typical of the claims of the class. We cannot now determine if the representative party will fairly protect the interests of the class.&lt;br /&gt;We note that the plaintiff has failed to include with his com-plaint the required form of instructions for the United States Marshal for directions as to service of process. These days, we see a lot of clamour against the torturous methods resorted to by the police personnel in India. Have you ever wondered what is the root cause for this disturbing social menace?&lt;br /&gt;&lt;br /&gt;To a great extent, the main culprit is Section 27 of the Indian Evidence Act, in my opinion... Why?&lt;br /&gt;&lt;br /&gt;The duty of the police is to investigate into the crime, apprehend the suspected offender and to bring him/her before the Courts of Law. Whenever a crime is reported to the police, it should register a crime and thereafter investigate into the same in order to find out who perpetuated it.&lt;br /&gt;&lt;br /&gt;Whenever a crime is reported, the police is expected to investigate into the matter and identify its perpetrators. In these days, any delay in identifying and apprehending the offenders would be fatal to the credibility of any investigating agency. The public outcry, the media pressure and the constant demand from the higher authorities can exert enormous pressure on the investigating officers to apprehend the offenders at the earliest. In the given circumstances, the easiest course open will be to resort to violent methods for extraction of information... nick named as &quot;Third-Degree Tortures&quot;. Our Courts have repeatedly denounced the use of torture by the police.. but when the root cause persists in the statute book, we cannot expect this barbaric practice to end.&lt;br /&gt;&lt;br /&gt;Section 25 of the Indian Evidence Act, 1872 maintains that: &quot; &lt;span style=&quot;font-style: italic;&quot;&gt;No confession made to a police officer, shall be proved as against a person accused of any offense.&lt;/span&gt;&quot; This means, what ever that is stated to the police by the suspect cannot be used against him, during the trial against him. This restriction is imposed with an intention to make sure that the police would not employ force of any kind on the suspected offender, in order to extract a confession from him/her.&lt;br /&gt;&lt;br /&gt;Section 26 of the Indian Evidence Act maintains that: &quot;&lt;span style=&quot;font-style: italic;&quot;&gt;No confession made by any person whilst he is in the custody of a police officer, unless it is made in the immediate presence of a Magistrate, shall be proved as against such person.&lt;/span&gt;&quot; Section 26 proceeds in the same spirit of Section 25. Unless made in the immediate  presence of a magistrate, no confession made by a suspected offender to a police officer, can be used against him/her, during the trial.&lt;br /&gt;&lt;br /&gt;The general mistrust of the Legislature towards the integrity of the investigating police is reflected in both Section 25 and 26. These sections act as a safeguard against torture, by discouraging the police from resorting to torturous questioning of suspects,  during investigative process, with a view to extract confessions. The undertone of these sections is that, an offense is to be investigated by obtaining confessions but through intelligent investigation into the offense.&lt;br /&gt;&lt;br /&gt;But, the civility ensured by the two provisions is greatly whittled down due to the operation of Section 27 of the Act. Section 27 of Indian Evidence Act maintains that:&lt;br /&gt;&lt;br /&gt;&quot;&lt;span style=&quot;font-style: italic;&quot;&gt;Provided that when any fact is deposed to as discovered in consequence of information received from a person accused of any offense, in custody of a police officer, so much of such information, whether it amounts to a confession or not, as relates distinctly to the fact thereby discovered, may be proved.&lt;/span&gt;&quot;&lt;br /&gt;&lt;br /&gt;As per Section 27, anything that is spoken to by the suspected offender to the police officer, which directly led to the discovery of a fact, that portion of what is spoken to by the suspected offender, which directly led into the discovery of the said fact, would be admissible as an evidence during the trial. To illustrate the point, imagine X is accused of murdering Y and is in the custody of the police officer. &lt;span style=&quot;font-style: italic;&quot;&gt;X says to the police officer.. &quot;come with me, I will show you the knife with which I stabbed Y.&lt;/span&gt;&quot; The police officer follows X to a place from where the police personnel takes out the knife from its hiding. The sentence &quot;&lt;span style=&quot;font-style: italic;&quot;&gt;come with me, I will show you the knife with which I stabbed Y.&lt;/span&gt;&lt;span style=&quot;font-style: italic;&quot;&gt;&quot; &lt;/span&gt;&lt;span&gt;and the fact that the discovery of the knife was made will be admissible in evidence against X, during his trial. &lt;/span&gt;The knife would be marked as a material object.&lt;br /&gt;&lt;br /&gt;A confessional statement otherwise inadmissible becomes admissible by virtue of Section 27 as follows: (read as a single sentence):&lt;br /&gt;&lt;br /&gt;(a) A person who is &lt;span&gt;accused of an offense&lt;/span&gt;&lt;br /&gt;(b) &lt;span&gt;gives some information&lt;/span&gt; to the &lt;span&gt;police&lt;/span&gt;&lt;br /&gt;(c) &lt;span&gt;while he/she is in the custody&lt;/span&gt; of the police&lt;br /&gt;(d) which has l&lt;span&gt;ed to the discovery&lt;/span&gt; of a fact/thing&lt;br /&gt;&lt;br /&gt;Then,&lt;br /&gt;&lt;br /&gt;(e) &lt;span&gt;that part&lt;/span&gt; of the information so tendered&lt;br /&gt;(f) which &lt;span&gt;distinctly&lt;/span&gt; relates to the fact/thing discovered&lt;br /&gt;(g) will be admissible in evidence &lt;span&gt;against the said accused&lt;/span&gt;&lt;br /&gt;(h) &lt;span&gt;if deposed&lt;/span&gt; to before the Court by the police, during the trial.&lt;br /&gt;&lt;br /&gt;According to Hon&#39;ble Supreme Court &quot;&lt;span style=&quot;font-style: italic;&quot;&gt;The basic idea embedded in Section 27 of the Evidence Act is he doctrine of confirmation by subsequent events. The information might be confessional or non-inculpatory in nature but if it results in discovery of a fact, it becomes a reliable information.&lt;/span&gt;&quot; Bodh Raj v. That ban (imposed by the two preceding sections [i.e., Sections 25 and 26] ) was presumably inspired by the fear of the Legislature that a person under police influence might be induced to confess by the exercise of undue pressure. &lt;span style=&quot;font-weight: bold;&quot;&gt;But if all that is required to lift the ban be the inclusion in the confession of information relating to an object subsequently produced, it seems reasonable to suppose that the persuasive powers of the police will prove equal to the occasion, and that in practice the ban will lose its effect.&lt;/span&gt;&lt;/span&gt;&quot;&lt;span style=&quot;font-weight: bold;&quot;&gt;&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;There are numerous circumstances which can pressurise an investigating officer to complete the investigative process at the earliest. Since the career prospects of police personnel are linked to the fast and successful culmination of the investigations they undertake, it would not be surprising if they become overzealous and resort to violence, in the process. It may be true that by employing torture, some truth can be revealed.. but it is also true that, innocent numerous are being subjected to barbaric tortures.. on the excuse that it is for common good.&lt;br /&gt;&lt;br /&gt;We are driven by the basic legal principle that &quot;&lt;span style=&quot;font-weight: bold; font-style: italic;&quot;&gt;everyone is deemed innocent until proved otherwise..&lt;/span&gt;&quot; and still it is a harsh reality that numerous languish in &quot;torture chambers&quot; indefinitely, even before reaching a Court of Law. Our laws postulated principles against &quot;self-incrimination&quot; and still we allow Section 27 -  &quot;&lt;span style=&quot;font-weight: bold;&quot;&gt;the Barbaric Shortcut&lt;/span&gt;&quot; to remain in our statute book. K. Balakrishnan Nair. J of High Court of Kerala, in the case Chandramohan Nair v. State of Kerala, I suddenly came across the usage &quot;&lt;span style=&quot;font-weight: bold;&quot;&gt;Wednesbury Unreasonableness&lt;/span&gt;&quot; which aroused my curiosity. The principle is well elucidated in the judgment itself. This principle belong to the domain of Administrative Law and indicate the threshold at which the Courts may consider reversing a administrative decision for want of reasonableness. The usage took its origin from the principle enunciated in the erstwhile case decided by the three judges of the Appeal Court of United Kingdom, Lord Greene M.R., Somervell L.J. and Singleton J.  in the case Associated Provincial Picture Houses Ltd. V. Wednesbury Corporation.&lt;br /&gt;&lt;br /&gt;The above mentioned judgment of Kerala High Court in WP(C) 13058/2007 was rendered in favour of the petitioner who challenged the appointment by the State Government of another person to the post of Member of the Kerala Consumer Disputes Redressal Commission overlooking him. (BTW, seems the word &quot;Redressal&quot; seems to be an invention of the Indian Legislature.. not seen in any of the online dictionaries at least!). The Government of Kerala invited applications from eligible persons to the aforementioned post by way of notification, to which the petitioner preferred an application. The selection was made by a committee consisting of the President of the State Commission, the Law Secretary of the Government of Kerala and the Secretary to Government, Department of Food, Civil Supplies and Consumer Affairs. He was called for the interview in which he, according to him performed well. The selection committee forwarded the names of the petitioner, 5th respondent and another to the Government. The Government in turn avoided the petitioner and selected the other two persons disregarding the fact that the petitioner was recommended  by all the members of the committee as against the 5th respondent who was not recommended by all the members of the committee. The petitioner filed the writ petition challenging the said appointment as vitiated by &lt;span style=&quot;font-style: italic;&quot;&gt;mala fides&lt;/span&gt;. The respondents contended that the persons appointed were fully qualified and the President of the Interview Board was biased towards the petitioner since he was a practicing lawyer and was prejudiced towards the 5th respondent since he was not a law graduate. The respondents argued that as per the provisions of the Consumer Protection Act, 1986, the Government is the appointing authority and is entitled to select from the panel of persons who got recommended by the committee.&lt;br /&gt;&lt;br /&gt;The Court while appreciating the right of Government as an appointing authority to make appointments, pointed out that the selection committee being there, the power to deviate from the recommendation of the selection committee should be exercised sparingly and only on valid grounds. In other words, the said power of the Government can be exercised only fairly and reasonably. The Court took note of the fact that, the relevant files of the Government did not disclose why the Government did not prefer the petitioner (especially when he got recommended by all the members of the selection committee, unlike the 5ht respondent). The Court observed that if the Government found 5th respondent as a better candidate and preferable to the petitioner notwithstanding the recommendation of the selection committee, it can definitely appoint the 5th respondent overlooking the petitioner, had the files of the Government was not silent on such an aspect. The Government &lt;span style=&quot;font-weight: bold;&quot;&gt;failed to consider&lt;/span&gt; and give reasons as to why the petitioner who recommended by all the members of the selection committee was ignored and that fact vitiated the process. Therefore, the Court observed that the order passed by the Government appointing the 5th respondent is vitiated for &lt;span style=&quot;font-weight: bold;&quot;&gt;failing to advert (consider) to relevant matters&lt;/span&gt;. The Hon. Justice proceeded to observe that the said would amount to Wednesbury Unreasonableness and elucidated the principle by quoting the original passages from the above mentioned British case : &lt;span style=&quot;font-weight: bold;&quot;&gt;ASSOCIATED PROVINCIAL PICTURE HOUSES, LIMITED v. WEDNESBURY CORPORATION. &lt;/span&gt;The relevant portion reads as follows:&lt;br /&gt;&lt;br /&gt;&quot;It is true the discretion must be exercised reasonably. Now what does that mean? Lawyers familiar with the phraseology commonly used in relation to exercise of statutory discretions often use the word &quot;unreasonable&quot; in a rather comprehensive sense. It has frequently been used and is frequently used as a general description of the things that must not be done. For instance, a person entrusted with a discretion must, so to speak, direct himself properly in law. He must call his own attention to the matters which he is bound to consider. He must exclude from his consideration matters which are irrelevant to what he has to consider. If he does not obey those rules, he may truly be said, and often is said, to be acting &quot;unreasonably.&quot; Similarly, there may be something so absurd that no sensible person could ever dream that it lay within the powers of the authority. Warrington L.J. in &lt;i&gt;Short v. Poole Corporation&lt;/i&gt; &lt;a href=&quot;http://www.justis.com/J-Net/J-Web.dll?Link?0&amp;%5B1926%5D%20Ch.%2066&quot; onclick=&quot;return confirm(&#39;This link requires a subscription to The Law Reports on Justis.com.\n\nClick \&#39;OK\&#39; if you are a subscriber.\n\nClick \&#39;Cancel\&#39; if you are not.&#39;)&quot;&gt;[1926] Ch. 66&lt;/a&gt;, 90, 91 gave &lt;span style=&quot;font-weight: bold;&quot;&gt;the example of the red-haired teacher, dismissed because she had red hair. That is unreasonable in one sense. &lt;/span&gt;&lt;span style=&quot;font-style: italic;&quot;&gt;In another sense it is taking into consideration extraneous matters. &lt;/span&gt;It is so unreasonable that it might almost be described as being done in bad faith; and, in fact, all these things run into one another.&quot;&lt;br /&gt;&lt;br /&gt;The judgment concluded by stating that, while exercising the discretion in making selection from the panel of names recommended by the selection committee, the claim of the petitioner was not at all considered. The Court observed that the same amounted to &quot;Wednesbury Unreasonableness&quot; and vitiated the order of the Government.
