Legal prohibition on cow-slaughter in Nepal infringes indigenous peoples’ rights, UN experts told

Two Nepali non-governmental organizations have submitted an urgent communication to UN rights experts informing that legal prohibition on cow-slaughter in Nepal infringes indigenous peoples’ right to freedom of religion and cultural rights and threatens the secularity of the Nepali state.

Lawyers' Association for Human Rights of Nepalese Indigenous Peoples and National Coalition Against Racial Discrimination sent in the joint communication on Friday to four UN Special Rapporteurs on the Rights of Indigenous Peoples, the Promotion and Protection of the Right to Freedom of Opinion and Expression the Field of Cultural Rights, and the Freedom of Religion or Belief.

“The communication is submitted to raise the issue of the continued prosecution of indigenous peoples under Nepal’s law against cow-slaughter—a law deeply rooted and wholly justified by Hindu (and therefore non-secular principles) and one which historically has been used to carry out the State’s forced cultural assimilation of indigenous peoples and to forge a homogenous identity for Nepali citizens,” the NGOs write.

“The first Royal Order officially prohibiting cow-slaughter stated that the punishments for the crime were death and the confiscation of all of the offender’s property. The codification of Hindu ideals, and most especially the ban on cow slaughter, was therefore “used as a means of promoting national integration and sovereignty over various ethnic groups and remote areas” the communication reads. “Importantly, the prohibition on cow-slaughter was always monitored from the center in Nepal and was therefore often used as a tool for showing the strength of centralization in the nation”

The communication further states, “The first Civil Code of Nepal, the Muluki Ain of 1854 stated: “This kingdom is the only kingdom in the world where cows, women, and Brahmans may not be killed”—trumpeting Nepal as the purest Hindu Kingdom and simultaneously signaling to Nepalese citizens that Hindu religious creeds were to be the law of the land.”

“Even as the punishments for cow-slaughter have become less extreme over time, a 1990 amendment to the Civil Code still made cow-slaughter punishable by 12 years in prison and this law—like its predecessors—has been consistently and discriminately used against the indigenous peoples of Nepal,” the NGOs allege.

With information on a large number of cases of cow-slaughter, mainly from eastern Nepal, the NGOs show that in over 90 percent of the cases, the defendant is a member of an indigenous community and pleaders, police personnel and judges responsible for the cases are Hindus, and for the most part high-caste Hindus (Brahmin or Chhetri). Thus, they claim, “Such a distinct pattern in the identity of defendants charged under a single law suggests that the prohibition on cow slaughter is without question enforced in a discriminatory manner.”

In many of the cases, the defendants have been sentenced to six to twelve years in prison. Often, the arrests were reportedly made based on complaints from local Hindu fundamentalists groups and accompanied by abuse and torture. In almost all the cases, the defendants or those sentenced are primary breadwinners of their families. As a result, the families, which are mostly already in poor economic conditions, have been left in worse situation after the cow slaughter incidents, including being in debt for bail amounts that had to be paid. At the same time, the arrests, accompanied by physical and verbal abuse, as well as following the legal consequences suffered by indigenous persons have instilled fear among broader indigenous communities to freely practice their religious and cultural customs and traditions.

The communication further reads, “This appeal to the international community is made namely because attempts to challenge the validity of the current cow slaughter prohibition in domestic courts have failed…A law such as the prohibition on cow slaughter represents a clear violation of this domestic commitment to secularity, however when the prohibition was challenged on such grounds in front of the Supreme Court of Nepal, the Court upheld the prohibition.”

“As domestic attempts to challenge the prohibition on cow slaughter have been unsuccessful, it is necessary that international experts unite in condemning this law as a hangover from the time when Nepal was a Hindu kingdom,” the NGOs conclude. They recommend that the Special Rapporteurs communicate with the Government of Nepal—particularly with the Legislature-Parliament—to repeal the provisions that criminalize cow slaughter so as to guarantee religious freedom and cultural rights to Nepal’s indigenous peoples.

UN rights experts apprised of violation of rights of indigenous Pradhan Newars for construction of a mega business complex

Two non-governmental organizations have submitted an urgent communication to UN rights experts alleging that a Nepali private company has unlawfully acquired the communal trust lands of indigenous Pradhan Newar community of Kathmandu to construct a mega business complex. As a result, the religious and cultural customs and traditions of Pradhan Newars based on the pond and its embankment lands have been devastated and thus their cultural rights and rights to cultural rights and rights to lands and resources violated, the communication reads.

Lawyers' Association for Human Rights of Nepalese Indigenous Peoples and National Coalition Against Racial Discrimination jointly submitted the communication to the UN Special Rapporteurs on the Rights of Indigenous Peoples and in the field of cultural rights on Monday. They have urged the Special Rapporteurs to correspond with the Government of Nepal about the need to take immediate action to defend, protect and promote the rights of the indigenous Pradhan Newars to their land, resources, sacred places and culture.

The planned business complex Chhaya Center is currently under construction in the tourist district of Thamel in Kathmandu metropolis. Its developer Chhaya Devi Complex Pvt. Ltd. has promoted it as “the biggest business complex in Nepal’s history” being built in a total area of 76,000 sq. ft. As per the communication, the land on which the complex is being built is communal trust land of local Pradhan community. The company has reportedly acquired the land, which historically held a holy pond and its embankments, through a long series of abuse of authority and corruption.

Local Pradhans had traditionally used the pond for their daily rituals in the nearby Newar monastery, death rites, festivals as well as other religious and cultural purposes. During the dictatorial Rana oligarchy, then Prime Minister Keshar Shumsher Rana forcefully annexed the pond in the compound of his palace – Keshar Mahal – built in 1895 while the Pradhan Newars were given limited access to the pond. A small royalty was paid to the monastery for the acquisition of the pond and embankment land. Idols and structures of various gods and deities in the embankment of the pond were moved. The tradition of using water and lotus flower from the pond for daily worship at the monastery was discontinued and a stone nearby was used as the site for death rites.

Following the death of Keshar Shumsher in 1964, his son Keyur Shumsher unlawfully got the land of the pond and its embankments registered as trust lands under his tenancy ownership through abuse of authority conniving with few locals and government officials by 1977. Following number of fragmentation and transfers of ownership of the land, the land was brought under private ownership of the company in 2009 and approval for construction of the business complex was acquired in 2013.

Whereas construction of the complex is ongoing at a rapid pace within high concrete walls and tin fences, many customs and traditions of local Pradhans have been entirely discontinued or dishonorably altered and the idols and structures moved from the embankments of the pond have been in the state of utter despair in lack of adequate preservation in an open space that has more or less turned into parking area and/or spot for street vendors in the side of a busy street. Further, the construction of the complex even presents further challenges to existing practices and customs of the community, including observance of communal rituals and festivals in the remaining space.

Many locals have been fearful to speak against the construction of the complex due to strong influence of the investors in political circles, as well as their connections to land mafia. Nonetheless, some locals filed a case at Kathmandu District Court demanding repeal of all transactions of the communal trust land in 2014. However, the court process has been sluggish with hearings postponed repeatedly. Complaints submitted to the National Human Rights Commission and Commission for the Investigation of Abuse of Authority on the issue also did not produce any result for the community.

A representative of the Pradhan community along with rights advocates filed a public interest litigation writ petition in Nepal’s Supreme Court in July 2014 against the company, local officials and concerned government authorities and ministries. The writ petition claims that right to religion and cultural rights of the Pradhans have been violated, along with infringement of other constitutional rights and different national laws. It calls for an Interim Order to immediately halt the construction of the complex and freeze any transaction of the land as well as a mandamus order to retain the pond and its embankment as public property and to undertake initiatives for protection of such public properties.

While the Supreme Court did not issue an interim order to halt construction of the complex, it has issued a show cause order to the defendants. Nonetheless, the proceedings at the Supreme Court have also been very slow.

The organizations, in the communication, have informed that the situation involves violations of rights of Pradhan Newars as guaranteed by international human rights instruments, including the UN Declaration on the Rights of Indigenous Peoples. In lack of effective national remedies, they have urged the rights experts to come together to condemn such continued violations of rights and consider ways to intervene to ensure that the Government of Nepal protects and promotes human rights as it is obligated to do.

UN rights expert informed of violation of rights of Nepal's indigenous Newar people due to road expansion drive in Kathmandu valley, with the case in point of Ugrachandi temple in Lalitpur

This communication was submitted to the UN Special Rapporteur on the Rights of Indigenous Peoples, Prof. James Anaya, on 6 August 2012 to provide information regarding violations of human rights of indigenous Newar people of Nepal, and/or continued threat thereof, by the road expansion drive in Kathmandu valley – mainly in Kathmandu metropolis and Lalitpur sub-metropolis, with the case in point of Ugrachandi temple of Lalitpur.

Below is the detailed account regarding current immediate risk of demolition of Ugrachandi (Tamka:dya:) temple, a historical holy shrine of Newars in Jawalakhel, Lalitpur, without any consultation with and consent of local Newar communities for expansion of road in the area.[1] This violates their right “to maintain, control, protect and develop their cultural heritage” as provided by UNDRIP article 31 along with their right to Free, Prior and Informed Consent.

When and Where:

July 2012, Jawalakhel, Lalitpur Sub-Metropolitan city, Nepal

Victim(s) or Community Affected:

The possible demolition of the temple is particularly concerning to Tamrakar people, a sub-group of Newar peoples, of Lalitpur and the whole valley and general concern of the overall Newar community. The centuries old temple inhabits the clan god and thus is one of the holiest shrines for Tamrakars – one of the larger sub-groups of Newars. The native inhabitants of Kathmandu valley and surrounding areas - Newars make around 6% of total national population. Nonetheless, they have very little say in development strategies carried out in their ancestral lands due to lack of participation in decision making levels and non-consultation by the government.

What happened:

The Kathmandu Valley Town Development Committee (KVTDC) earlier this year began demolishing of homes of residents, mostly Newars, of various areas of Kathmandu metropolis in the name of widening the road based on a half-century old government policy regarding the space to be left on both sides of road. Among those areas, local residents are still fiercely protesting against the expansion of Lazimpat-Lainchaur section of the road where most houses were to be demolished.

The project was stalled for a while when implementing agency changed from KVTDC to a more powerful recently formed Kathmandu Valley Development Authority (KVDA). The road expansion drive was also taken ahead around the same time in Lalitpur but until this incident, no personal or community properties were affected. Nonetheless, in July, the government officials marked the land where Ugrachandi temple stands for demolition of road in the area. A committee formed for preservation of the temple, mainly composed of Tamrakars, has since been protesting the action. If continued, the demolition will mark the loss of a vital historical, cultural and religious site for Newars representing another attack on their identity that has been gradually eroding due to assimilation and loss of language.

Perpetrator(s):

As mentioned above, KVDA is currently overseeing the road expansion project of Kathmandu, previously undertaken by KVTDC. The line ministry of KVDA is not clear as it is inter-ministry level body.

Action taken by State authorities:

Immediately after the temple area was marked for demolition, the temple preservation committee has led a delegation to KVDA; however, the authority has denied any clear response. In recent demolitions, the government officials have only provided very short prior notice. Thus, the committee has demanded timely notification for future actions regarding the temple so as to seek appropriate remedy.

Action taken before international bodies:

This communication to the Special Rapporteur is the first action taken before an international mechanism on the incident and the overall situation of Newars vis-à-vis road expansion drive in Kathmandu Valley.

Additional Comments
This communication presents only a representative case while several Newar families have already been displaced from their homes in Kathmandu with prior consultation and adequate compensation due to aggressive road expansion projects in different parts of the metropolis. Further, Newars have continuously protested against number of similar projects such as Kathmandu Outer Ring Road project[2], among others through the years that threaten further loss of their lands in the name of development.

सिन्धुली । करिव चारवर्षदेखि संगठित रूपमा खिम्ती–ढल्केबर २२० के.भी विद्युत प्रसारण लाईन विस्तार परियोजनाविरूद्ध संघर्ष गर्दै आएका स्थानीय आदिवासी जनजातिको आन्दोलनले नयाँ मोड लिने भएको छ । निर्माणस्थल आसपासमा विरोध, धर्ना, जुलुश जस्ता गतिविधिमा सीमित उनीहरूको आन्दोलन विश्व बैंकको उजुरी सुन्ने उच्च निकाय इन्सपेक्सन प्यानलसम्म मुद्धा दर्ता गर्न पुगेपछि उनीहरुको आन्दोलनको स्वरूप फेरिएको हो ।

जिल्ला प्रशासन, विद्युत प्राधिकरण, उर्जा मन्त्रालयदेखि मन्त्रिपरिषद र सर्वोच्च अदालतसम्म पुग्दा पनि पीडितहरूले न्याय नपाएपछि इन्स्पेक्सन प्यानलमा उजुरी गर्न बाध्य भएको उनीहरूले बताएका छन । १ सय ३ जना पीडितहरूको तर्फबाट हाइस्टेसन पीडित संघर्ष समितिका अध्यक्ष सुरेन्द्रश्वर मोक्तान र आदिवासी जनजातिहरूको तर्फबाट नेपाल आदिवासी जनजाति महासंघ, जिल्ला समन्वय परिषद् सिन्धुलीका तत्कालिन अध्यक्ष सूर्य पाख्रिनले संयुक्त रूपमा २४ जुलाई २०१३ मा इन्स्पेक्सन प्यानलमा मुद्दा दायर गरेका थिए । इन्स्पेक्सन प्यालनका अध्यक्ष इमी वातानावेले १३÷०५ नम्बरमा उजुरी पत्र दर्ता गर्न तोक आदेश गरेपछि हाइस्टेसन पीडितहरूको मुद्धा पहिलोपटक अन्तर्राष्ट्रियकरण भएको हो ।

उजुरी पत्र दर्ताका लागि आदिवासीहरूको मानवअधिकारसम्बन्धी वकिल समूह (लाहुर्निप)का सचिव एवम् राष्ट्रिय अन्तर्राष्ट्रिय कानुनका विज्ञ अधिवक्ता शंकर लिम्बुले कानुनी सहयोग प्रदान गर्नुभएको थियो ।

उता हाइस्टेसन पीडितको आवाजलाई दवाउन राज्य शक्तिको दुरूपयोग गरेको भन्दै तत्कालीत प्रमुख जिल्ला अधिकारी केशवराज आचार्यविरूद्ध अख्तियार दुरूपयोग अनुसन्धान आयोग २०४८ को दफा ३ र ८ विपरीतको कार्य गरेको आरोपमा २०७० फागुनमा उजुरी दर्ता गराएका छन् । हाइस्टेसन पीडितहरूले आन्दोलनकारीमाथि दमन गरेको, हुँदै नभएको फिडर रोडको नाममा करोडौं रूपैयाको मुआव्जा वितरण गरेको आरोप लगाउँदै छानविनका
लागि अख्तियारमा मुद्धा दर्ता गराएको खुलासा भएको छ । सो फिडर रोडको नाममा १५९ कित्ता जग्गाधनीहरुलाई मुआब्जा वितरण गर्ने भनिएपनि अहिलेसम्म ११२ कित्ता जग्गा धनीहरुले मात्र मुआब्जा लिएका छन् । मुआब्जा लिनेहरु उक्त क्षेत्रको स्थानीय बासिन्दा नभएको र बाहिरबाट गएर घडेरी किन्नेहरु र उत्पादनमा प्रयोग नभएको जग्गा पर्नेहरु मात्र भएको संघर्ष समितिका उपाध्यक्ष उक्तबहादुर थापाले
बताउनुभयो ।

अधिवक्ता शंकर लिम्बुका अनुसार विश्व बैंकको नीति र आदिवासीसँगको सुरक्षा कानुन ४.१० को विरूद्ध परियोजनाले आदिवासी जनजाति अधिकारको दुरूपयोग गरेको, नेपालले अनुमोदन गरेको मानव अधिकारको विश्वव्यापी काजीमान थिङ तामाङ अध्यक्ष नेपाल आदिवासी जनजाति पत्रकार महासंघ सिन्धुली हाइटेन्सन लाइन पीडितहरु सिन्धुलीमाढीमा विरोध प्रदर्शन गर्दै । घोषणापत्र, आदिवासी अधिकारसँग सम्बन्धित अन्तर्राष्ट्रिय श्रम संगठन महासन्धी नं. १६९, नेपाल पक्षराष्ट्र भएको आदिवासी अधिकारसँग सम्बन्धित संयुक्त राष्ट्रसंघीय घोषणा पत्रमा व्यवस्था भएको स्वतन्त्र, अग्रिम जानकारी सहितको मञ्जुरी’ को व्यवस्थालाई उल्लंघन गरेको, आदिवासी जनजातिहरूलाई मातृभाषामा सूचना नदिएको, परामर्श नगरेको, परियोजना सञ्चालनमा सहभागिता र लाभको बाँडफाँड गर्न पाउने अधिकारबाट बञ्चित गरेको लगायतका आरोप लगाएको छ । साथै, नेपाल विद्युत नियमावली २०५० को नियम ५१ को उल्लंघन गरी हाइभोल्ट विद्युत लाईनका तारहरू मान्छेको घर र विद्यालय माथिबाट लगिएको, परियोजनाले प्रचलित राष्ट्रिय अन्तर्राष्ट्रिय ऐन, कानुन र नियमको उल्लंघन गरेको, वातावरणीय, मानवीय तथा साँस्कृतिक प्रभाव मूल्याङ्कनको सत्य–तथ्य जानकारी नदिएको र सुरक्षाकर्मी परिचालन गरी महिला, बालबालिकालाई कुटपिट गरेको समेत उजुरी पत्रमा उल्लेख छ ।

खिम्तीमा उत्पादित विद्युत दोलखा, रामेछाप, सिन्धुली, धनुषा र महोत्तरी गरी ५ वटा जिल्ला हुँदै ढल्केबरमा ल्याइ भारत निकासी गर्नु परियोजनाको वातावरणीय प्रभाव मूल्याङ्कन अध्ययन अनुगमन प्रतिवेदनको पेज नं. २३ को बुँदा नं. ३.४ मा प्रष्ट उल्लेख गरिएको हुँदा परियोजना नेपालको हितमा नभएको अधिवक्ता लिम्बुको भनाइ छ । उजुरीपश्चात् इन्स्पेक्सन प्यानलका प्रतिनिधिहरू गोप्यरूपमा उजुरी पत्रमा उल्लेखित आरोपहरूको छानविन गर्न गत असोजमा नेपाल आएका थिए । असोज १५, १६ र १७ गते परियोजना अवरोध स्थलका समुदायहरूसँग छलफल गर्दै उजुरीपत्रमा उल्लेखित आरोपहरूको अध्ययन अनुसन्धान गरी उनीहरु फर्केका छन् ।

अध्ययन टोलीले उजुरीमा उल्लेखित आरोपहरूमा सत्यता रहेको, परियोजना सञ्चालनमा राष्ट्रिय अन्तर्राष्ट्रिय रूपमा प्रचलित ऐन, कानुन र मूल्य–मान्यताको उल्लंघन भएको ठहर गर्दै ३ महिनाभित्र परियोजनाले गल्ती सच्याउन र परियोजना सञ्चालकले स्थानीय पीडितहरूसँग बसेर समस्याको समाधान खोज्नुपर्ने सुझाव सहितको ८८ पेज लामो प्रतिवेदन विश्व बैंकका व्यवस्थापन पक्षलाई बुझाइएको छ ।

सो प्रतिवेदनको आधारमा छलफल गर्न विश्व बैंकका उर्जा विशेषज्ञ रविन श्रेष्ठ सहितको टोली सिन्धुली आएका थिए । टोलीले पीडितहरूसँग छलफल गरेको थियो । छलफलका क्रममा पीडितहरूले परियोजनाले
पार्ने वातावारणीय तथा मानवीय प्रभाव मूल्याङ्कनको प्रतिवेदन सार्वजनिक नगरिएको र नक्कली हस्ताक्षर गरेर सार्वजनिक सुनुवाइको प्रतिवेदन तयार गरेको, परियोजना क्षेत्रको जग्गाहरू विनाजानकारी बेच्न र धितो राख्न नपाउने गरी जिल्ला प्रशासन कार्यालयको निर्देशनमा मालपोत कार्यालयले रोक्का गरेको, सशस्त्र प्रहरी लगाएर महिला तथा बच्चाहरूलाई कुटपिट गरेको लगायतका विषयहरू उठाएका थिए ।

पीडितहरूसँगको छलफलपछि स्थानीय सञ्चारकर्मीहरूसँगको भेटमा विश्व बैंकका नेपाल उर्जा विशेषज्ञ श्रेष्ठले परियोजनाले कमजोरी गरेको स्वीकार गरेका थिए । परियोजना र त्यसले पार्ने सामाजिक, मानवीय तथा वातावरणीय प्रभावहरूको बारेमा परियोजनाले स्पष्ट नगरेको पाएको उहाँले बताउनुभयो ।

परियोजनाको बारेमा स्पष्ट जानकारी गराउन सूचना अधिकृतको व्यवस्था नगरिएको भन्दै उर्जा विशेषज्ञ श्रेष्ठले भन्नुभयो, ‘परियोजनाको बारेमा सवैलाई जानकारी हुनुपर्छ, दिनु पनि पर्छ, जसको लागि ठाउँ–ठाउँमा होर्डिङ्ग बोर्ड राख्नु पर्ने र रेडियो, पत्रपत्रिकाहरूमार्फत स्थानीय भाषामा जानकारी प्रसारण र प्रकाशन गरिनु पर्नेमा त्यो नगरिएकाले यो समस्या आएको हो ।’

पीडितहरूसँग छलफल गर्न विश्व बैंकका प्रमुख उर्जा विशेषज्ञ जी ताङ (Jie Tang) देखि कन्ट्री डाइरेक्टर जोहानस जुट (Johannes Zutt) समेत सिन्धुली आइपुग्नुभयो । तर तीन महिना भित्रमा समस्याको समाधान गर्न दिएको सुझाव अझै कार्यान्वयन हुन सकेको छैन । विश्व बैंकले समुदायसँग छलफल गरेर सूचना अधिकृत नियुक्त गरी परियोजनाबाट संकटमा परेका समुदायका लागि विकास कार्यक्रम सञ्चालन गर्न भनेकोमा छलफल नै नगरी गैरसरकारी संस्थाका सञ्चालक खेटराज अधिकारीलाई सूचना अधिकृत नियुक्त गरेको पीडितहरूको भनाइ छ ।

परियोजना सञ्चालन हुनुपूर्व गरिनुपर्ने कार्यहरू गरिएन । अहिले आएर गर्न थालेका छन् । सरोकारवालाको छलफल र आवश्यकताविना संकटाविमुख समुदाय विकास कार्यक्रम (VCDP) तयार गर्दै अहिले पनि हाइस्टेसन पीडितको मागलाई दिग्भ्रमित बनाउन खोजिएको संघर्ष समितिको आरोप छ ।

धेरैले हाइस्टेसन पीडितको मुद्धा क्षतिपूर्ति र विकिरण फैलिनसक्ने त्राससँग मात्र जोडेर बुझ्ने गरेका छन् । तर हाइस्टेसन पीडितहरू भन्छन् ‘हामीले उठाएको सवाल क्षतिपूर्ति र विकिरणको त्रासले उब्जाएको समस्या होइन ।

यो राष्ट्रियताको सवाल हो ।’ वातावरणीय, जैविक विविधता विनाश र मानवीय, साँस्कृतिक, धार्मिक मूल्य–मान्यताको विनाश तथा विस्थापित अनि मान्छेको सूचना पाउने अधिकार हनन विरूद्धको उठेको आवाज भएको पीडितहरु बताउँछन् । तीन महिनामा समाधान गर्न दिएको सुझाव कार्यान्वयन नभएपछि विश्व बैकका व्यवस्थापकीय टोली पूर्ण अनुसन्धानका लागि जुनको अन्तिम साता फेरि सिन्धुली आउने भएको छ ।

परियोजना सञ्चालनका लागि नेपाल सरकारले विश्व बैंकसँग सन् २००३ मा ऋण सम्झौता गरेको थियो । त्यसपश्चात् नेपाल सरकारको तर्फबाट नेपाल विद्युत प्राधिकरणले परियोजना निर्माण कार्यलाई अगाडि बढाउन अन्तर्राष्ट्रिय स्तरको टेन्डर आव्हान गरेपछि भारतका कल्पतारू कन्ट्रक्सन कम्पनीले २००६ मा टेन्डर पारेको थियो । कम्पनीले २००७ को जनवरीदेखि निर्माणको कार्य अगाडि बढाएको थियो ।

माइपोखरीको अस्तित्वसँगै आदिवासीको संस्कृति पनि संकटमा

जैविक विविधताको दृष्टिकोणले अत्यन्तै महत्वपूर्ण क्षेत्र र धार्मिक तथा सांस्कृतिक रुपमा पनि विविधयुक्त छ इलामको माइपोखरी । माइपोखरी करिब दुई हेक्टर क्षेत्रफल छ । पोखरीको दक्षिणी कुनामा प्रवेशद्धार छ भने पूर्वी कुनामा किरातधर्म आस्थाको शिवमन्दिर, उत्तरी दिशामा हिन्दुहरुको धार्मिक अनुष्ठान गर्न बनाइएको टहरा छ । पोखरीको वरिपरि विभिन्न जातका स्थानीय बोटविरुवा, जडीबुटीहरु पाइन्छन् भने विभिन्न जातका वन्यजन्तु, चराचुरुङ्गी, माछाहरु पाइन्छन् । यही पोखरीको आसपासमा बस्ने गर्थे आदिवासी सुनुवारका पूर्खाहरु । उनीहरुका पूर्खाहरुको भेडागोठ थियो, पोखरी आसपासमा पाइने मालिङ्गो, बाँसको चोयाबाट डोको, नाम्लो, डालो, थुन्छे, आदि बुनेर बेसीतिरका छिमेकीहरुसँग धानचामल, नुन साटी ल्याउँथे । नजिकैको बजारमा भेडाको घ्यू मानादेखि धार्नीसम्म बेच्थे । हत्तपत रोगी बिरामी हुँदैनथे सुनुवार परिवारमा । भइहाले पनि स्थानीय जडिवबुडीको प्रयोग गर्थे । उभौली र उधौलीमा सेउली काट्न, मौसमअनुसार सिकार खेल्न, शुद्ध जल प्रयोग गर्न, घाँस दाउरा लिन माईपोखरी आसपासमा नै जान्थे । तर अहिले पहिलाजस्तो माइपोखरी आसपासको क्षेत्रमा सहजै आवतजावत गर्न पाइँदैन । पोखरीमा पानीको सतह पनि घट्दै गएको छ, पोखरीमा फोहोरको थुप्रो बढेको छ, समय समयमा बनेको माई पोखरीको गुरुयोजनाहरुले उनीहरुको साँस्कृतिक अधिकारमाथि बन्देज लगाएको छ, पोखरी आसपासका वनलाई धार्मिक वन र सामुदायिक वन बनाएपछि उनीहरुको परम्परागत ज्ञान सीपहरु पनि संकटमा पर्दै गएका छन् ।

माईपोखरीको अस्तित्वसँगै सुनुवार समुदाय लगायत स्थानीयवासी र आदिवासीहरुको परम्परागत संस्कृतिहरु प्नि संकटमा पर्दै गएकोप्रति चिन्ता रहेको स्थानीय कलम मुखिया बताउनु हुन्छ । मुखियाको भनाइ छ् “आदिवासीहरु प्रकृतिपूजक भएकोले हाम्रो सम्बन्ध जल, जमिन र जंगलसित छ, तर विभिन्न किसिमका वन ऐन लागू भएपछि हाम्रा पुर्खाले गर्दै ल्याएको भेडी गोठसँगै राडीपाखी बुन्ने सीप हरायो, मालिङ्गो काट्न नपाएर बाँसका सामग्रीहरु हराउँदैछन्, पोखरीको पानी सुक्दै जान थालेपछि हाम्रो जलदेवी, वन देवीहरुलाई कसरी पुज्ने ?”

माइपोखरी संरक्षणमा धेरै निकायले काम गर्दै आएको भएपनि पोखरी संरक्षण हुन नसकेको स्थानीयको चिन्ता छ । ‘पोखरी संरक्षण गर्ने भन्दै विभिन्न गैरसरकारी संस्था र जिल्लास्थित कार्यालयले काम गर्छन भन्ने सुनिन्छ’ स्थानीय दिनेश सुवेदीले भन्नुभयो ‘कसले के गर्छ हामीलाई थाहा हुँदैन, माइपोखरीको लागि भन्दै वर्षेनी बजेट खर्च हुन्छ तर त्यसको संरक्षणमा ठोस काम भएको छैन ।’ माइपोखरी आर्थिक मूल्यका विषयमा खोज गरेका विष्णु काफ्लेले माइपोखरीबाट प्रत्यक्ष र अप्रत्यक्ष रुपमा इलामका लागि वार्षिक औषत आम्दानी ३ करोड २८ लाख २९ हजार रुपैयाँ हुने गरेको जानकारी दिनुभयो । ‘यत्रो आर्थिक महत्व भएको पोखरीको पानीको सतह वर्षेनी घट्दैछ’ उहाँको भनाइ थियो, ‘हाम्रो जिल्लाको आम्दानीको स्रोत बचाउन माइपोखरीको वैज्ञानिक परीक्षण हुन जरुरी छ, त्यसपछि गरिएको संरक्षणको प्रयास मात्र प्रभावकारी हुन्छ ।’

माइपोखरीमा सरकारी तवरबाट संरक्षणका कार्य गर्दै आएका जिल्ला वन अधिकृत राजेन्द्र काफ्लेले गैरस्थानीय प्रजातिको जापानी सल्ला, गैरस्थानीय माछा, पोखरी नजिकैको मोटर बाटो, फोहोर मैला पोखरीमा पानी सुक्नुका कारण भएको बताउनुभयो ।

केही बर्ष पहिला माइपोखरीमा पानीको सतह घट्न नदिनका लागि जिविस इलामले पोखरीको लेदो हटाएको थियो । त्यस्तै सीमसार क्षेत्रको सीमाङ्कन, अल्पकालिन ब्यवस्थापनका लागि रिचार्ज पोखरी मार्फत पानी हाल्ने काम शुरु भइसकेको स्थानीय विकास अधिकारी मदन कोइरालले बताउनुभयो । त्यस्तै जिल्ला वन कार्यालय इलामले पोखरी आसपासका सामुदायिक वनहरुको कार्ययोजना तयार पारी जापानी सल्लालाई क्रमशः हटाउँदै स्थानीय प्रजातिका विरुवाहरुको बृक्षारोपण थालिएको जिल्ला बन कार्यालय इलामले जनाएको छ ।

त्यसैगरी शहरी विकास तथा भवन निर्माण विभाग डिभिजन कार्यालय इलामले विशेष भौतिक पूर्वाधार विकास कार्यक्रमअन्तर्गत २०५८ सालमा माईपोखरी गुरुयोजना तयार गरी उत्तर र पश्चिमतर्फका सानापोखरीमा चेकड्याम निर्माण शुरु गरेको इन्जिनियर सुरेश कुमार नेम्बाङले बताउनुभयो । तर, पोखरी संरक्षण हुन सकेको छैन ।

सन् २००८ अक्टोवर २८ मा रामसार सूचीमा सूचीकृत माइपोखरी सीमसार क्षेत्र नेपालको नवौ र मध्य पहाडी क्षेत्रको पहिलो रामसार क्षेत्र हो । जैविक विविधता तथा धार्मिक दृष्टिकोणले महत्वपूर्ण मानिएको माइपोखरीलाई इरानको रामसारमा भएको रामसार महासन्धिको दशौं बैठकले विश्व संरक्षण सूचीमा सूचीकृत गरेको थियो । यो क्षेत्रमा रैथाने, गलैंचे, झ्याउ, रुख भ्यागुत्तो, ठकठके जस्ता दुर्लभ बन्यजन्तु तथा वनस्पति पाइन्छन् । प्रकृति र संस्कृतिको जीवन्त महसुस गर्न सकिने यो क्षेत्रमा तीन सयभन्दा बढी प्रजातिका चराहरु, १७ प्रजातिका सुनाखरी, गुराँस, ६२ प्रजातिका जडीबुटी, २ सय ३१ प्रजातिका बोटबिरुवा, ३ प्रजातिका रैथाने माछा, ६ प्रजातिका उभयचर, १२ प्रजातिका सर्प र १४ प्रजातिका स्तनधारी प्राणी तथा लोपोन्मुख रेडपाण्डा, काँडेभ्याकुर माइपोखरी क्षेत्रमा पाइने गरेको अनुसन्धानकर्ताहरु बताउँछन् । २ हजार १ सय २१ मिटरको उचाइमा रहेको माइपोखरी ९० हेक्टर क्षेत्रफल जमिनमा फैलिएको छ । यसको १ दशमलव ८५ हेक्टर जलाशय सहित १२ हेक्टर क्षेत्रलाई जैविक विविधताका दृष्टिले अति संवेदनशील मानिन्छ ।

गुठीको जग्गा हड्पेर निर्माणाधीन “ठमेलभित्रको ठमेल” छायाँदेवी कम्प्लेक्स विरुद्ध सर्वोच्चमा रिट

काठमाडौँको पर्यटकीय क्षेत्रमा निर्माणाधीन “ठमेलभित्रको ठमेल” भनेर चिनाइएको छायाँदेवी कम्प्लेक्सको निर्माणको लागि नजिकै रहेको थं विहारका परम्परागत कार्यको लागि प्रयोग गरिँदै आएको प्राचीन कमल पोखरीको गुठी जग्गा गैरकानुनीरुपमा हरण गरिएको भन्दै त्यस्तो निर्माण कार्य रोक्न अन्तरिम आदेशसहित सो जग्गालाई सार्वजनिक नै कायम गर्न उत्प्रेषणयुक्त परमादेश लगायत को माग गर्दै सर्वोच्च अदालतमा मंगलबार रिट निवेदन दर्ता गरिएको छ ।

अधिवक्ता दिपक विक्रम मिश्रको निवेदनमा दर्ता गरिएको सो रिटमा नेपाल सरकार प्रधानमन्त्री तथा मन्त्री परिषद्को कार्यालय, संघीय मामिला तथा स्थानीय विकास, संस्कृति, पर्यटन तथा नागरिक उड्डयन, शहरी विकास र वातावरण विज्ञान तथा प्रविधि मन्त्रालय, काठमाडाँै जिल्ला प्रशासन कार्यालय, पुरातत्व विभाग, काठमाण्डौ महानगरपालिका, मालपोत कार्यालय, गुठी संस्थान र उपत्यका विकास प्राधिकरणलगायत छायाँदेवी कम्पलेक्स प्रा. लि., सो जग्गा आफ्नो नाममा दर्ता गराएका केशर शम्सेरको बुहारी केयुर शम्सेरको पत्नी अम्बिका राणा तथा उक्त थं विहार (विक्रमसिल महाविहार) गरुड भगवान गुठीका गुठीयारहरुलाई समेत विपक्षी बनाइएको छ ।

रिटमा साविक काठमाडौँ नगरपंचायत वडा नं.२९ को क्षेत्रफल २६–८–०–० (छब्बिस रोपनी आठ आना) भएको जग्गा पुरातात्विक ऐतिहासिक, धार्मिक एवं सांस्कृतीक महत्वको कमलपोखरी, पोखरीको डिल र कित्ता.नं. १०४० को क्षेत्रफल ०–९–२–३ भएको जग्गा चोक जनिई नापजाँच भएको उल्लेखित पोखरी र चोक समावेश भएको जग्गा सार्वजनिक जग्गा भएकोले उक्त क्षेत्र सार्वजनिक नै कायम हुनु पर्छ भनिएको छ । साविक काठमाण्डौ नगरपंचायत वडा नं. २९ को श्री सिहसार्थ वाह गरुड भगवानको नाममा रहेको कि.नं. १६७ को कमल पोखरीको डिल सहित २६–८–० जग्गा साविकमा दर्ता श्रेस्ता कायम हुनुपर्नेमा उक्त जग्गा मध्ये कि.नं. १६७ को क्षेत्रफल १२–१३–२ तथा कि.नं. १०४० को क्षेत्रफल ०९–२–२ जग्गा कायम राखी बाँकी जग्गा स्व. केयुर शम्सेरले आफ्नो पर्खाल भित्र पारी अन्य कित्ता जग्गामा समावेश गर्नु भएको रहेछ । २०३३ सालमा स्थानीय गुठीसँग गरिएको मिलापत्र अनुसार पोखरीको क्षेत्रफल २६–८–० हुनुपर्नेमा कि.नं. १६७ मा जम्मा १२–१३–२ मात्र जग्गा रहेको देखिन्छ । कि.नं. १६७ पोखरी र कि.नं. १०४० चोक जनिई नापचाँज भएकोले उल्लेखित पोखरी र चोक ऐतिहासिक, पुरातात्विक धार्मिक सांस्कृतीक सम्पदा भएकोले सार्वजनिक जग्गा हो भन्ने स्पष्ट हुन्छ ।

त्यसो हुनाले नेपालको अन्तरिम संविधान २०६३ को धारा १२, १३, १६, २२, ३२, १०७(२), जग्गा नापजाँच ऐन, २०१९, मालपोत ऐन, २०४३, स्थानिय प्रशासन ऐन, २०२८, वातावरण संरक्षण ऐन, २०५३, गुठी संस्थान ऐन, २०३३, प्राचिन स्मारक संरक्षण ऐन, २०१३ समेतको आधारमा उक्त क्षेत्र सार्वजनिक नै कायम हुनुपर्नेे निवेदनमा माग गरिएको छ ।

सो कम्प्लेक्स निर्माणको लागि काठमाडाँैँ महानगरपालिकालगायतका निकायबाट नक्सापास गरी निर्माण कार्य थालिएको भन्ने सुन्न र बुझ्न आएकोले उक्त कार्य यथावत राखी निर्माण कार्य नगर्न, यथास्थानमा राख्नु भौतिक स्वरुप परिवर्तन नगर्न साथै हक हस्तान्तरण धितो वन्धक समेत नराख्न भनी सर्वोच्च अदालतको अन्तरिम आदेश माग गरिएको छ । प्रस्तुत विवादमा बिपक्ष्ँी छायादेवी कम्पलेक्स प्रा.लि.ले सरकारी निकायको समेत सहयोग लिई सार्वजनिक रुपमा रहेको सार्वजनिक सम्पत्ति, पोखरी, पोखरीको डिल, मठ मन्दिर चोक समेत नासी, मासी उक्त स्थानमा छायादेवी कम्पलेक्स निर्माण गरिदैँ रहेको हुनाले उक्त ऐतिहासिक, धार्मिक, सांस्कृतीक र पर्यावरणीय क्षेत्रको रुपमा रहेको साविक क्षेत्रफल २६–८–०–० र हाल कायम कि.नं.हरु १८७, १६१७, १६१८, २४१२, २२२४, २२२६ क्षेत्रफल १३–१५–१–० र बिपक्षी अम्विका राणाले आफ्नो पर्खाल भित्र घुसाउनु भएको जग्गा र विभिन्न व्यक्तिहरुलाई विक्री गर्नु भएको जग्गाहरु समेत गरी जम्मा २६–८–०–० क्षेत्रफल पोखरी कायम गरी साविक कि.नं. १०४० को जग्गा क्षेत्रफल ०–९–२–३ चोक कायम गरी दुवै जग्गाहरु साविक पोखरी र चोक नै कायम गर्नका लागि उत्प्रेषणयुक्त परमादेश लगायत कानुन अनुसारको आदेश पनि माग गरिएको छ ।

साथै सार्वजनिक सम्पत्तिको संरक्षण, सम्बद्र्धन गर्नको लागि आवश्यक भए एउटा उच्चस्तरीय समिति बनँई सार्वजनिक सम्पत्तिको संरक्षण गर्ने, तर्फ पहल गर्नु साथै एकिकृत रुपमा सार्वजनिक सम्पत्तिको संरक्षण गर्नु पर्ने भएमा सो सम्वन्धि कानुनको मस्यौदा व्यवस्थापिका संसदको यसै अधिवेशनमा पेश गर्नु भनि बिपक्ष्ँीहरुको नाममा उत्प्रेषण परमादेश लगायतको आदेश पनि माग गरिएको छ ।

काठमाडौँको पर्यटकीय क्षेत्रमा निर्माणाधीन “ठमेलभित्रको ठमेल” भनेर चिनाइएको छायाँदेवी कम्प्लेक्सको निर्माणको लागि नजिकै रहेको थं विहारका परम्परागत कार्यको लागि प्रयोग गरिँदै आएको प्राचीन कमल पोखरीको गुठी जग्गा हरण हुने भएको छ ।

सात व्यवसायीको ३ अर्ब रुपैयाँ लगानी रहेको सेन्टर आगामी दुई वर्षभित्र संचालनमा आइसक्ने छ । मल्ल होटलको पछाडी करिव १५ रोपनी क्षेत्रफलमा छायाँदेवी कम्प्लेक्सले व्यवसायिक भवन निर्माण गर्न लागिएको हो । सो कम्प्लेक्सको निर्माणको लागि नजिकै रहेको थं विहार (विक्रमशील महाविहार)को परम्परागत धर्मकृतिको लागि प्रयोग हुने गरेको कमल पोखरीको जग्गा पनि प्रयोग गर्न लागिएकोे छ । उक्त विषयमा उक्त महाविहारका ६ जना गुठियारहरुले पोखरी गुठी जग्गाको रुपमा सार्वजनिक नै रहनुपर्ने माग गर्दै काठमाडौँ जिल्ला अदालतमा मुद्दा दायर गरी मुद्दा विचाराधिन अवस्थामै रहँदा पोखरी भित्र पर्ने गरी निर्माणस्थल वरिपरि पर्खाल लगाएर कम्प्लेक्सको निर्माणकार्य धमाधम अघि बढाइएको छ ।

थं वहिल (ठमेल)को प्राचीन नाम सिंह कल्पनगर हो । यस क्षेत्रका सामन्त राजा श्री सिंहसार्थ वाहरा लगभग मल्लकालको पूर्वाद्घमा एक विशाल विहारको निर्माण गराए । यिनीद्वारा बौद्घ धर्म अनुशरण गरी सिद्घ भई यिनी भगवान कहलाइयो । उक्त विहार कान्तिपुरको उत्तरी माथिल्लो भेकमा पर्ने भएको थं विहार भनियो । थं वहिलबाट यस क्षेत्रको नाम ठमेल हुन गएको हो । उक्त विहारलाई विक्रमशील महाविहार भनिन्छ । सामन्त राजा श्री सिंहसार्थ वाहलाई ठमेल प्रधानहरुका पूर्वज भनिन्छ । प्रधानहरुका पूर्वजहरुद्घारा यसक्षेत्रमा सामन्तको हैसियतले प्राचीन समय देखि मल्लकालको उत्तराद्र्घ सम्म शासन गरेको देखिन्छ । प्रधानका पूर्वजहरुले धर्म किर्तिका निम्ति तथा यस स्थानका शोभा बढाउने खालका कैयन ऐतिहासिक, पुरातात्विक, सांस्कृतिक, धार्मिक महत्व बोकेका धर्मशाला, ढुंगेधारा, पोखरी, चोक, डबली पाटी, मन्दिर आदिहरु निर्माण गराए । कैयन गुठीहरु राखेर गए । जात्रा पर्वहरु प्रचलनमा ल्याए । धार्मिक नाचहरु देखाउने चलन चलाए । उक्त गुठी सञ्चालन गर्नको निम्ति प्रशस्त जग्गाहरु राखिदिए ।

यस विहारको पूर्वतिर डवली सहितको चोक छ । उक्त चोक परापूर्वकालदेखि धार्मिक जात्रा तथा नाचको निमित्त प्रयोग भैरहेको गुठीजन्य सार्वजनिक डवली सहितको चोक हो । यस क्षेत्रको नापी हुँदा कित्ता नं १०४० मा पर्ने ९ आनाभन्दा बढी क्षेत्रफलको यो चोक नापी शाखामा रहेको फिल्ड बुकमा समेत सार्वजनिक चोक जनाइएको छ । गुठी संस्थानमा रहेको फिल्ड बुकमा पनि जग्गा धनकिो नाम गरुड भगवान गुठी उल्लेख गरिएको छ यस्तो सम्पदाहरु व्यक्तिगत तवरमा दर्ता हुने, मोही लाग्ने, लेनदेन, बेचविखन हुने मुलुकमा कुनै कानुनी प्रावधानहरु नभएकोले उक्त फिल्ड बुकमा अरु महलहरु रिक्त छन् ।

परापूर्वकालदेखि चलिआएको श्री लुमडी भद्रकालीको प्रख्यात १२ वर्षे धार्मिक नाच यस विहारका गुठीयारहरुले उक्त नाचका प्रमुख व्यक्ति संग परामर्श गरि उपर्युक्त समय निर्धारण गरेर नाच देखाउन निमन्त्रणा गरी डवलीको पश्चिम भागमा विधिपूर्वक पूजा गरेर भोज खुवाई नाच देखाउने चलन रहिआएको छ । हाल आएर यस्तो चोक व्यक्तिको नाममा (श्रीमती अम्विका राणा) दर्ता गरिएको छ । उक्त चोकको स्वरुप परिवर्तन गरिएको छ ।

यस चोकको पछाडि पूर्वतिर परापूर्वकालमा स्थापना गरेको सुन्दर कमल पोखरी थियो । त्यस पोखरीमा कमलको फूल फुलाई उक्त फूल टिपि विहारको भगवानलाई चढाई दिनहु नित्य स्नान तथा पूजा गराइने तथा पोखरीको डिलमा स्थानीयहरुले गरेका श्राद्वको पिण्ड फाल्ने धार्मिक सस्कार गर्ने परम्परा रहिआएको थियो । मालपोतमा रहेको यस विहारको गुठीको १९६५ सालको गुठीको लगतमा कमलपोखरी डिलसमेतको जग्गा उल्लेख गरिएको छ । उक्त जग्गा मध्ये शहरी क्षेत्रमा नापी हुदा कित्ता न १६७ मा पर्ने यो पोखरी २०३३ सालको नापी शाखामा रहेको फिल्ड बुकमा समेत सार्वजनिक पोखरी जनाई बाँकि महलहरु रिक्त छोडिएको छ । गुठी संस्थानमा रहेको फिल्ड बुकमा समेत जग्गा धनीको महलमा गरुड भगवान गुठी उल्लेख गरिएको छ भने जग्गाको क्षेत्रफल १२ रोपनीभन्दा (१२।१३।२।३) उल्लेख गरिएको छ ।

यस्तो धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व वोकेको गुठीजन्य सार्वजनिक सम्पदाका पोखरी र डिल राणकालमा बलजफती दरवारको शोभा बढाउन भनेर केशर शमसेरले आफ्नो कम्पाउण्ड भित्र पारे । केही समय सम्म स्थानीयहरुलाई परापूर्वकालदेखि चलिआएको धार्मिक परम्परा कायम नै राख्ने बाहानामा सानो ढोका बनाई आवत जावत गर्न दिए ता पनि केही समय पश्चात धर्म, सांस्कृतिक, परम्परानै नष्ट हुुने गरी उक्त ढोका वन्द गरियो । पोखरीको डिलमा विभिन्न देवीदेवताहरुको मूतिहरु तथा चैत्यहरु थिए जहाँ दिनहुँ नित्य पूूजा गरिने परम्परा रहिआएको थियो । सम्पूर्ण देवीदेवताहरुको मूतिहरु तथा चैत्यहरु नष्ट गरिएको छ भने ५०० साल भन्दा पुरानो रुख उक्त स्थानमा कायम नै छ । केशर शमसेर राणाले उक्त पोखरी लिए पश्चात त्यस पोखरीको कमलको फूल टिपि विहारको भगवानलाई चढाई दिनहु नित्य स्नान, पूजा गराइने तथा उक्त पोखरीको डिलमा स्थानीयहरुले गरेका श्राद्वको पिण्ड फाल्ने धार्मिक सस्कार गर्ने परम्परा नष्ट भएको छ । भने धार्मिक पिण्ड फाल्ने संस्कार कायम राख्न हाल स्थानीयहरुले सरस्वती मन्दिर पछाडि रहेको ढुंगामा पिण्ड फाल्ने कार्य गर्दछन् ।

पछि केशर शमसेरले सालान्या १२५ विहारको गुठीलाई उक्त पोखरी प्रयोग गरेबापत दिने गरियो । मोही नलाग्ने, व्यक्तिगत नाममा दर्ता नहुने गुुठीजन्य सार्वजनिक पोखरी दर्वारिया शक्तिको आडमा आफुलाई उक्त विहारको गुठीको मोहीमा दर्ता गराए । केशर शमसेरको मृत्यु पश्चात मोहियानी छोरा केयुर शमसेरमा सारिने काम भयो । केयुर शमसेरद्वारा उक्त पोखरी र डिलको केही भाग सस्कृति परम्परा नै नष्ट हुने गरी पुर्ने काम गर्न थालियो । यस्तो नहुन दिन विहारका गुठियारहरुदारा धर्मलोपको मुद्दा दिएकोमा तह तह फैसाला हुंदा २०३३ सालमा सर्र्बाेच्च अदालतबाट धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व वोकेको गुठीजन्य सार्वजनिक सम्पदाका पोखरीको पोखरी र डिल नै कायम गर्र्नै गरी दुवै पक्ष विच मिलापत्र गराइयो । गुठीजन्य सार्वजनिक सम्पदा ः पोखरीमा मोही लाग्ने मुलुकमा कुनै कानुनी प्रावधान नभए ता पनि उक्त मिलापत्रमा केयुर शमसेर मोही भै पोखरी प्रयोग गर्न पाउने उल्लेख गरिएको छ ।

उक्त विहारको गुठीको सार्वजनिक पोखरी नष्ट गरिएको केही भाग दरवारिया शक्तिको आडमा गुठी संस्थानको मिलोमोतोमा २०३९ सालमा गुठी रैतानीमा परिणत गरी ०–६–० सुधा पौडयाललाई र २–१०–० विना पौडयाललाई १६१६, १६१७ कित्ताकाट गरी उक्त पोखरी पुरेको जग्गा केयुर शमसेरले राजिनामा गरिदिए । १६७ कित्ता नम्बरमा पर्ने बांकि पोखरी पुरेको जग्गा केयुर शमसेरको नाममा नै १६१८ कित्ता नं कायम रहन गयो ।

केयुर शमसेरको मृत्यु पश्चात १६१८ कि. न. अम्बिका राणाले नामसारी गरे कित्ता नं १६१६ र १६१७ अम्बिका राणाको नातेदार शकर प्रशाद शाहले २०४४ सालमा राजिनामा गरिलिए पछि अम्बिका राणा र शकर प्रशाद शाहले २०४७ सालमा गुठी रैतानी कायम गरे । गलत तरिकाले गुठी रैतानी कायम भएको हुदा गुठी सस्थान केन्द्रिय कार्यालयले २०४७ सालमा त्यस्तो पोखरी र डिलमा मोही नलाग्ने गुठी रैतानी नहुने भनि रोक्का राखे । सो रोक्का राखेको बदर गरी पाउ भनि अम्बिकाराणा र शकर प्रशाद शाहले मुद्दा गरेकोमा जिल्ला अदालतले निर्णय बदर हुने भनि भएको फैसला २०५३ सालमा पुनराबेदन अदालतले सदरको फैसला बदर गरि पाउ भनि गुठीयारहरुले धर्मलापको मुद्दा गरेकेमा २०६२ सालमा अम्बिका राणाले एक करोड पचास लाख उक्त विहारको गुठीलाई दिई सम्पूर्ण मुद्दा छोडने गरी जिल्ला अदालतमा गुठी सस्थानलाई जानकारी नदिई कानुन विपरित मिलापत्र गरियो । २०२४ सँलमा विक्रमशील महाविहारका गुठी उक्त विहारको गुठीयारहरुको पहलमा राजगुठी छुट गुठीमा परिणत गराई सम्पूर्ण उक्त गुठी अधिनस्त जग्गाहरुको लगत खडा गरी गुठी संस्थानलाई जिम्मा दिई गुठीयारहरुको सम्पूर्ण हक अधिकारसमेत गुठी संस्थानलाई सुम्पेकोले यस विहारका गुठीयारहरुले गरेको मिलापत्र कानुन बिपरित हुन आउंदछ भने मुलुको सार्वजनि ऐतिहासिक सास्कृतिक धार्मिक धरोहरको संरक्षण गर्न धर्मलोपको मुद्दा दायर गर्ने अधिकार सरोकारवालमलाई मात्र नभई मुलुका सम्पूर्ण नागरिकहरुलाई जुनै बेला पनि छ ।

कित्ता नं १६७ को पोखरीको जग्गाबाट कित्ताकाट भै आएको कित्ता नं १६१६, १६१७ को जग्गा शकर प्रशाद शाहले प्रतिमा पाण्डेलाई २०६४ सालमा राजिनामा गरे । अम्बिका राणाले कित्ता नं १६१८ को जग्गा मध्येबाट ९।९।२।२ सुरेशाय हाउजिंगलाई २०६३ सालमा राजिनामा गरि दिएपछि कित्ताकाट भै २४१२ कायम रहयो । सुरेशाय हाउजिंगले कित्ता नं २४१२ को २०६४ सालमा प्रतिमा पाण्डेलाई राजिनामा गरि दिएको उक्त कित्तासहित कित्ता नं १६१६, १६१७ प्रतिमा पाण्डेले प्राप्त गरिसके पछि २०६५ सालमा छायादेवी कम्प्लेक्सले लिखत गरि लिए ।

यसरी मुलुकको ए्ेतिहासिक धरोहर नष्ट गरेर कानुन विपरित मोही कायम गराई केही गुठीयारहरु, गुठी सस्थानका तत्कालीन पदाधिकारिहरु, मालपोतका पदाधिकारिहरु तथा नगरपालिकाका पदाधिकारिहरुको समेत मिलोमोतोमा व्यक्तिगत नाममा दर्ता गराई आधुनिक व्यापारिक भवन छायादेवी बन्दै गरेको देखिन्छ । मुलुकको त्यस्तो वैभवपूर्ण धरोहर सुरक्षित गर्न यस विहारका गुठीयारहरुद्वारा धर्म किर्ति लोप नहुन दिन पोखरी नै कायम गराउने उद्देश्यले प्रमाण सहित जिल्ला अदालतमा मुद्दा दायर गरेका छन् । हाल विचाराधिन रहेको उक्त मुद्दाको अर्को पेशी चैत्र ६ गतेबाट २० गतेको लागि सारिएको अवस्थामा जिल्ला अदालतबाट कस्तो फैसला हुने हो हेर्न बाँकि नै छ ।

नेपाल प्राकृतिक, प्राचीन, धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, सम्पदाहरुले भरिएको मुलुक हो । सम्पदाहरुको धनी देश भनेर विश्वमा प्रख्यात छ । यस्तो सम्पदाहरु स मन्दिर , देवालय, पोखरी, चोक, इनार, डवली, धर्मशाला, परम्परागत रुपमा चलिआएको पूजा, वाजा, नाच, पर्व, जात्रा, आदिहरुले नेपालको इज्जत, मान, तथा प्रतिष्ठा वढाएको छ । वास्तवमा भन्ने हो भने मुलुक, व्यक्ति, तथा समूदायको वास्तविक परिचय तथा पहिचान दिने आधारहरु भनेका यिनै भौतिक तथा अभौतिक सम्पदाहरु हुन् ।

यस्ता सम्पदाहरुको वैभवताले हाम्रो मुलुक अन्तर्राष्ट्यि क्षेत्रमा एक महत्वपूर्ण पर्यटकीय गन्तव्य बन्न पुगेको छ । मुलुकलाई सम्मानित, प्रख्यात गराउनुको साथै आर्थिक विकासमा पनि विशेष योगदान दिदै आइरहेका छन् । पर्यटन क्षेत्रलाई मुलुकको अर्थतन्त्रको मेरुदण्ड भन्न सकिने अवस्थाको यस्ता सम्पदाहरुले तुल्याइएका छन् ।

आज मुलुकमा रहेका यस्ता गौरवमय सम्पदाहरु नष्ट गरिंदै छन् । ज्वलन्त उदाहरण थं वहिल विक्रमशील महाविहार प्रधानहरुको गुठी श्री सिहसार्थ वाह गरुड भगवान गुठीको परापूर्वकालदेखिकोे परम्परागत धार्मिक संस्कार पूजा, जात्रा, तथा नाचका निम्ति परापूर्वकालमा निर्माण गरिएको ऐतिहासिक सांस्कृतिक, धार्मिक, पूरातात्विक महत्व वाकेको सम्पदा,यस विहारको पूर्वपट्टिको डवली सहितको चोक तथा उक्त चोक पछाडिको कमल पोखरी हो ।

थं वहिल (ठमेल)को प्राचीन नाम सिह कल्पनगर हो । यस क्षेत्रका सामन्त राजा श्री सिंहसार्थ वाह द्घ।रा लगभग मल्लकालको पूर्वाद्घमा एक विशाल विहारको निर्माण गराए । यिनीद्घारा बौद्घ धर्म अनुशरण गरी सिद्घ भई यिनी भगवान कहलाइयो । उक्त विहार कान्तिपुरको उत्तरी माथिल्लो भेकमा पर्ने भएको थं विहार भनियो । थं वहिलबाट यस क्षेत्रको नाम ठमेल हुनगएको हो । उक्त विहारलाई विक्रमशील महाविहार भनिन्छ । सामन्त राजा श्री सिंहसार्थ वाहलाई ठमेल प्रधानहरुका पूर्वज भनिन्छ । प्रधानहरुका पूर्वजहरुद्घारा यसक्षेत्रमा सामन्तको हैसियतले प्राचीन समय देखि मल्लकालको उत्तराद्र्घ सम्म शासन गरेको देखिन्छ । प्रधानका पूर्वजहरुले धर्म किर्तिका निम्ति तथा यस स्थानका शोभा बढाउने खालका कैयन ऐतिहासिक ,पुरातात्विक , सांस्कृतिक , धार्मिक महत्व बोकेका धर्मशाला , ढुं¨े ढारा , पोखरी, चोक, डवली पाटि , मन्दिर आदिहरु निर्माण गराए । कैयन गुठीहरु राखेर गए । जात्रा पर्वहरु प्रचलनमा ल्याए । धार्मिक नाचहरु देखाउने चलन चलाए । उक्त गुठी सञ्चालन गर्नको निम्ति प्रशस्त जग्गाहरु राखिदिए ।

यस विहारको पूर्वतिर डवली सहितको चोक छ । उक्त चोक परापूर्वकालदेखि धार्मिक जात्रा तथा नाचको निमित्त प्रयोग भैरहेको गुठीजन्य सार्वजनिक डवली सहितको चोक हो । यस क्षेत्रको नापी हुदा कि. न. १०४० मा पर्ने क्षेत्रफल ०।९।२।३ को यो चोक नापी शाखामा रहेको फिल्ड बुकमा समेत सार्वजनिक चोक जनाइएको छ । गुठी संस्थानमा रहेको फिल्ड बुकमा पनि जग्गा धनकिो नाम गरुड भगवान गुठी उल्लेख गरिएको छ यस्तो सम्पदाहरु व्यक्तिगत तवरमा दर्ता हुने, मोही लाग्ने, लेनदेन , बेचविखन हुने मुलुकमा कुनै कानुनी प्रावधानहरु नभएकोले उक्त फिल्ड बुकमा अरु महलहरु रिक्त छन् ।

उक्त चोकको भित्रको उत्तरी भागमा निकै पुरानो सरस्वतीको मन्दिर छ । पश्चिममा प्राचीनकालमा निर्माण गराइएको तीन वटा चैत्यहरु छन् । यस चोको उत्तरमा निकै पुरानो सरस्वतीको मन्दिर छ ।
यस चोकको सरस्वती मन्दिरको दक्षिणमा रहेको चारपाटे डवलीमा हरेक साल फाल्गुण कृष्ण पक्ष परेवा तिथिमा यस विहारको दक्षिणमा रहेको तुं चोकबाट विहारका भगवान(चकस् देवता) लाई वाजा गाजा सहित उक्त चोकमा रहेको डवलीमा मण्डप बनाई विराजमान गराई विधिपूर्वक पूजा गरि परम्परागत बाजाका साथ काठमाडौ शहर परिक्रमा गराई जात्रा मनाउने धार्मिक परम्परा परापूर्व कालदेखि रहिआएको छ । यस जात्रा चकस् धो जात्रा भनेर काठमाडौमा प्रख्यात छ ।

परापूर्वकालदेखि चलिआएको श्री लुमडी भद्रकालीको प्रख्यात १२ वर्षे धार्मिक नाच यस विहारका गुठीयारहरुले उक्त नाचका प्रमुख व्यक्ति संग परामर्श गरि उपर्युक्त समय निर्धारण गरेर नाच
देखाउन निमन्त्रणा गरि डवलीको पश्चिम भागमा विधिपूर्वक पूजा गरेर भोज खुवाई नाच
देखाउने चलन रहिआएको छ ।यस्तो चोक व्यक्तिको नाममा (श्रीमती अम्विका राणा) दर्ता गरिएको छ । उक्त चोकको स्वरुप परिवर्तन गरिएको छ ।

यस चोकको पछाडि पूर्वतिर परापूर्वकालमा स्थापना गरेको सुन्दर कमल पोखरी थियो । त्यस पोखरीमा कमलको फूल फुलाई उक्त फूल टिपि विहारको भगवानलाई चढाई दिनहु नित्य स्नान तथा पूजा गराइने तथा पोखरीको डिलमा स्थानीयहरुले गरेका श्राद्वको पिण्ड फाल्ने धार्मिक सस्कार गर्ने परम्परा रहिआएको थियो ।

मालपोतमा रहेको यस विहारको गुठीको १९६५ सालको गुठीको लगतमा कमलपोखरी डिलसमेत २६।। उल्लेख गरिएको छ । उक्त जग्गा मध्ये शहरी क्षेत्रमा नापी हुदा कित्ता न १६७ मा पर्ने यो पोखरी २०३३ सालको नापी शाखामा रहेको फिल्ड बुकमा समेत सार्वजनिक पोखरी जनाई वाकी महलहरु रिक्त छोडिएको छ । गुठी सस्थानमा रहेको फिल्ड बुकमा समेत जग्गा धनीको महलमा गरुड भगवान गुठी उल्लेख गरिएको छ भने जग्गाको क्षेत्रफल १२।१३।२।३ उल्लेख गरिएको छ ।

यस्तो धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व वोकेको गुठीजन्य सार्वजनिक सम्पदाका पोखरी र डिल राणकालमा बलजफती दरवारको शोभा बढाउन भनेर केशर शमसेरले आप–नो कम्पाउण्ड भित्र पारे । केही समय सम्म स्थानीयहरुलाई परापूर्वकालदेखि चलिआएको धार्मिक परम्परा कायम नै राख्ने बाहानामा सानो ढोका बनाई आवत जावत गर्न दिए ता पनि केही समय पश्चात धर्म, सांस्कृतिक, परम्परानै नष्ट हुुने गरी उक्त ढोका वन्द गरियो । पोखरीको डिलमा विभिन्न देवीदेवताहरुको मूतिहरु तथा चैत्यहरु थिए जहां दिनहु नित्य पूूजा गरिने परम्परा रहिआएको थियो । सम्पूर्ण देवीदेवताहरुको मूतिहरु तथा चैत्यहरु नष्ट गरिएको छ भने ५०० साल भन्दा पुरानो रुख उक्त स्थानमा छदैछ । केशर शमसेर राणाले उक्त पोखरी लिए पश्चात त्यस पोखरीको कमलको फूल टिपि विहारको भगवानलाई चढाई दिनहु नित्य स्नान , पूजा गराइने तथा उक्त पोखरीको डिलमा स्थानीयहरुले गरेका श्राद्वको पिण्ड फाल्ने धार्मिक सस्कार गर्ने परम्परा नष्ट भएको छ । भने धार्मिक पिण्ड फाल्ने संस्कार कायम राख्न हाल स्थानीयहरुले सरस्वती मन्दिर पछाडि रहेको ढु¨।मा पिण्ड फाल्ने कार्य गर्दछन् ।

पछि केशर शमसेरले सालान्या १२५ विहारको गुठीलाई उक्त पोखरी प्रयोग गरेबापत दिने गरियो । मोही नलाग्ने, व्यक्तिगत नाममा दर्ता नहुने गुुठीजन्य सार्वजनिक पोखरी दर्वारिया शक्तिको आडमा आफुलाई उक्त विहारको गुठीको मोहीमा दर्ता गराए । केशर शमसेरको मृत्यु पश्चात मोहियानी छोरा केयुर शमसेरमा सारिने काम भयो । केयुर शमसेर द्घारा उक्त पोखरी र डिलको केही भाग सस्कृति परम्परा नै नष्ट हुने गरी पुर्ने काम गर्न थालियो । यस्तो नहुन दिन विहारका गुठियारहरुदारा धर्मलोपको मुद्दा दिएकोमा तह तह फैसाला हुंदा २०३३ सालमा सर्र्बाेच्च अदालतबाट धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व वोकेको गुठीजन्य सार्वजनिक सम्पदाका पोखरीको पोखरी र डिल नै कायम गर्र्नै गरी दुवै पक्ष विच मिलापत्र गराइयो । गुठीजन्य सार्वजनिक सम्पदा ः पोखरीमा मोही लाग्ने मुलुकमा कुनै कानुनी प्रावधान नभए ता पनि उक्त मिलापत्रमा केयुर शमसेर मोही भै पोखरी प्रयोग गर्न पाउने उल्लेख गरिएको छ ।

उक्त विहारको गुठीको सार्वजनिक पोखरी नष्ट गरिएको केही भाग दरवारिया शक्तिको आडमा गुठी संस्थानको मिलोमोतोमा २०३९ सालमा गुठी रैतानीमा परिणत गरी ०–६–० सुधा पौडयाललाई र २–१०–० विना पौडयाललाई १६१६, १६१७ कि का. गरी उक्त पोखरी पुरिको जग्गा केयुर शमसेरले राजिनामा गरिदिए । १६७ कि. न. मा पर्ने बांकि पोखरी पुरेको जग्गा केयुर शमसेरको नाममा नै १६१८ कि. न. कायम रहन गयो ।

केयुर शमसेरको मृत्यु पश्चात १६१८ कि. न. अम्बिका राणाले नामसारी गरे कि न १६१६ र १६१७ अम्बिका राणाको नातेदार शकर प्रशाद शाहले २०४४ सालमा राजिनामा गरिलिए पछि अम्बिका राणा र शकर प्रशाद शाहले २०४७ सालमा गुठी रैतानी कायम गरे । गलत तरिकाले गुठी रैतानी कायम भएको हुदा गुठी सस्थान केन्द्रिय कार्यालयले २०४७ सालमा त्यस्तो पोखरी र डिलमा मोही नलाग्ने गुठी रैतानी नहुने भनि रोक्का राखे । सो रोक्का राखेको बदर गरी पाउ भनि अम्बिकाराणा र शकर प्रशाद शाहले मुद्दा गरेकोमा जिल्ला अदालतले निर्णय बदर हुने भनि भएको फैसला २०५३ सालमा पुनराबेदन अदालतले सदरको फैसला बदर गरि पाउ भनि गुठीयारहरुले धर्मलापको मुद्दा गरेकेमा २०६२ सालमा अम्बिका राणाले एक करोड पचास लाख उक्त विहारको गुठीलाई दिई सम्पूर्ण मुद्दा छोडने गरी जिल्ला अदालतमा गुठी सस्थानलाई जानकारी नदिई कानुन विपरित मिलापत्र गरियो । २०२४ सँलमा विक्रमशील महाविहारका गुठी उक्त विहारको गुठीयारहरुको पहलमा राज गुठी छुट गुठीमा परिणत गराई सम्पूर्ण उक्त गुठी अधिनस्त जग्गाहरुको लगत खडा गरी गुठी संस्थानलाई जिम्मा दिई गुठीयारहरुको सम्पूर्ण हक अधिकारसमेत गुठी संस्थानलाई सुम्पेकोले यस विहारका गुठीयारहरुले गरेको मिलापत्र कानुन बिपरित हुन आउंदछ भने मुलुको सार्वजनि ऐतिहासिक सास्कृतिक धार्मिक धरोहरको सरक्षण गर्न धर्मलोपको मुद्दा दायर गर्ने अधिकार सरोकारवालमलाई मात्र नभई मुलुका सम्पूर्ण नागरिकहरुलाई जुनै बेला पनि छ ।

कि न १६७ को पोखरीको जग्गाबाट कि का भै आएको कि न १६१६, १६१७ को जग्गा शकर प्रशाद शाहले प्रतिमा पाण्डेलाई २०६४ सालमा राजिनामा गरे । अम्बिका राणाले कि न १६१८ को जग्गा मध्येबाट ९।९।२।२ सुरेशाय हाउजि¨लाई २०६३ सालमा राजिनामा गरि दिएपछि कि. का. भै २४१२ कायम रहयो ।

सुरेशायले कि. न. २४१२ को २०६४ सालमा प्रतिमा पाण्डेलाई राजिनामा गरि दिएको उक्त कि. सहित कि न १६१६, १६१७ प्रतिमा पाण्डेले प्राप्त गरिसके पछि २०६५ सालमा छायादेवी कम्प्लेक्सले लिखत गरि लिए ।

यस्तो मुलुकको ए्ेतिहासिक धरोहर नष्ट गरेर कानुन विपरित मोही कायम गराई केही गुठीयारहरु , गुठी सस्थानका तत्कालीन पदाधिकारिहरु , मालपोतका पदाधिकारिहरु तथा नगरपालिकाका पदाधिकारिहरुको मिलोमोतोमा व्यक्तिगत नाममा दर्ता गराई आधुनिक व्यापारिक भवन छायादेवी वन्दैछ । यस्तो मुलुकको वैभवपूर्ण धरोहर सुरक्षित गर्न यस विहारका गुठीयारहरु द्वारा धर्म किर्ति लोप नहुन दिन पोखरी नै कायम गराउने उद्देश्यले प्रमाण सहित जिल्ला अदालतमा मुद्दा दायर गरेका छन् । हाल यो मुद्दा विचाराधिन अवश्थामा छ ।

यस्तो धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व बोकेको गुठीजन्य सार्वजनिक सम्पदाको व्यक्तिगत नाममा दर्ता हुनुबाट आज मुलुकको यस्तो धार्मिक तथा सास्कृतिक सम्पदाहरु नष्ट हुने अवस्थामा छैन भन्न सकिने अवस्था अव रहेको छैन ।

मुलुकमा रहेका यस्ता निजी, सार्वजनिक तथा गुठीजन्य सार्वजनिक भौतिक तथा अभौतिक सम्पदाहरुको सरक्षण गरि मुलुकको गौरव बढाउने कार्य हरेक जिम्मेवार सचेत नागरिक, सम्पदा संरक्षण संवद्र्घन गर्न खोलिएका गैर सरकारी संंस्थाहरु , गुठीजन्य सम्पदाको संरक्षण संवद्र्घन गर्न गठित सरकारी निकाय गुठी संस्थान तथा पूरातत्व विभागको हो । कुुनै ब्यक्ति विशेषको पहलबाट मात्र यस्तो सम्पदाहरु सरक्षण गर्ने कार्य गर्न कठिन भएकोले मुलुका सचेत नागरिकहरु,सरकारी तथा गैर सरकारी सस्थाहरु एकजुट भई यस कार्यमा लागे यस्तो सम्पदाहरुको अवश्य पनि रक्षा गर्न सकिन्छ ।

आज मुलुक रहेका यस्ता प्राचीन, धार्मिक, सांस्कृतिक, ऐतिहासिक, पूरातात्विक, महत्व बोकेका सम्पदाहरुले गर्दा हाम्रो मुलुक सम्पदाहरु को धनी देश भनेर विश्वमा प्रख्यात छ । यस्तो सम्पदाहरु स मन्दिर , देवालय, पोखरी, चोक, इनार, डवली, धर्मशाला, परम्परागत रुपमा चलिआएको पूजा, वाजा, नाच, पर्व, जात्रा, आदिहरुद्घारा नेपालको इज्जत, मान, तथा प्रतिष्ठा वढाएका छन् । वास्तवमा भन्ने हो भने मुलुक, व्यक्ति, तथा समूदायको वास्तविक परिचय तथा पहिचान दिने आधारहरु भनेका यिनै भौतिक तथा अभौतिक सम्पदाहरु हुन् ।

यस्ता सम्पदाहरुको वैभवताले हाम्रो मुलुक अन्तर्राष्ट्यि क्षेत्रमा एक महत्वपूर्ण पर्यटकीय गन्तव्य बन्न पुगेको छ । मुलुकलाई सम्मानित, प्रख्यात गराउनुको साथै आर्थिक विकासमा पनि विशेष योगदान दिदै आएका छ । पर्यटन क्षेत्रलाई मुलुकको अर्थतन्त्रको मेरुदण्ड भन्न सकिने अवस्थाको यस्ता सम्पदाहरुले तुल्याइका छ ।

आज मुलुकमा रहेका यस्ता गौरवमय सम्पदाहरु नष्ट गरिंदै छन् । ज्वलन्त उदाहरण थं वहिल विक्रमशील महाविहार गरुड भगवान गुठीको परापूर्वकालदेखिको परम्परागत धार्मिक पूजा, जात्रा, तथा नाचको निम्ति परापूर्वकामा निर्माण गरिएको ऐतिहासिक, सास्कृतिक, धार्मिक, पूरातात्विक महत्व वाकेको सम्पदा यस विहारको पूर्वपट्टिको डवली सहितको चोक हो

यस चोकको पछाडि पूर्वतिर परापूर्वकालमा स्थापना गरेका सुन्दर कमल पोखरी थियो । त्यस कमल पोखरीमा कमलको फूल फुलाई उक्त फूल विहारका भगवानलाई चढाई दिनहु नित्य पूजा, स्नान गराइने तथा पोखरीको डिलमा स्थानीयहरुले गरेका श्राद्वको पिण्ड फाल्ने धार्मिक सस्कार गर्ने परम्परा रहिआएको थियो । हाल यस्तो धार्मिक परम्परा नष्ट भएको छ भने धार्मिक पिण्ड फाल्ने संस्कार कायम राख्न हाल स्थानीयहरुले सरस्वती मन्दिर पछाडि रहेको ढु¨।मा पिण्ड फाल्ने कार्य गर्दछन् ।

अपर मर्स्याङ्दी ए जलविद्युत आयोजनाको काल्पनिक चित्र ।

नेपाल आदिवासी जनजाति महासंघ र आयोजनामा कार्यरत नेपाली मजदुरहरुले छुट्टा– छुट्टै माग राखी १३ फागुनदेखि आयोजनाको निर्माणकार्य अनिश्चितकालका लागी बन्द गराएका छन् ।

नेपाल आदिवासी जनजाति महासंघ लमजुङले अन्तर्राष्ट्रिय श्रम संगठन महासन्धी नम्बर १६९ र सोही महासन्धीले प्रत्याभुत गरेको स्वतन्त्र अग्रिम जानकारी सहितको सहमति लागु गर्न माग गरेको छ ।
आयोजनाले स्थानीयवासीलाई पारेको प्रभाव र आदिवासी जनजातिको अधिकारका विषयमा पटक पटक जानकारी गराउँदा समेत आयोजना निर्माण पक्षले बेवास्ता गरेकाले बन्द आह्वान गरिएको महासंघ लमजुङका अध्यक्ष खेमजंग गुरुङले बताए । आयोजना निर्माण पक्षले आफुहरुको माग पुरा नगरे सधैँका लागी बन्द गर्ने समेत गुरुङले चेतावनी दिएका छन् ।
यसैबीच, आयोजनामा कार्यरत नेपाली मजदुरहरुले पनि विभिन्न माग राख्दै आयोजनाको काम बन्द गरेका छन् । मजदुरले पेश गरेको मागपत्रमा ज्याला बढाउनुपर्ने, कम्तीमा १५ देखि २० लाखको व्यक्तिगत विमा गरिनुपर्ने, संचयकोषको व्यवस्था हुनुपर्ने, सुविधा सम्पन्न प्राथमिक उपचार केन्द्रको व्यवस्था गर्नुपर्ने, बन्द गरिएको दिनको हाजिरी दिनुपर्ने लगायतका माग छ ।
आयोजना व्यवस्थापन पक्षले मजदुरको मागका विषयमा सहमति जनाएपनि कार्यान्वयन नगरेकाले पुन बन्द आह्वान गर्नुपरेको अखिल नेपाल उर्जा तथा खानी मजदुर संघका अध्यक्ष विष्णु तामाङले बताए ।
आयोजना बन्द गर्नुपुर्व मजदुरहरुले बेसीशहरमा प्रदर्शन गरेका थिए । आदिबासी जनजाति महासंघ र मजदुरका प्रतिनिधि जिल्ला प्रशासन कार्यालयमा ज्ञापन पत्र बुझाउन संगै पुगेका थिए ।
यता प्रशासनले भने आयोजनाको निर्माण कार्य बन्द गरेर बार्ता हुन नसक्ने स्पष्ट पारेको छ । आयोजनाको सुरक्षा दिनु आफ्नो दायित्व भएको भन्दै प्रमुख जिल्ला अधिकारी बाबुराम भण्डारीले आयोजना निर्माण कार्य सुचारु राखेर समस्या समाधानमा लाग्न आग्रह गरेका छन् ।
मजदुरका जायज माग प्रति आफुहरु पनि संवेदनशिल भएको भन्दै प्रजिअ भण्डारीले संयमित भएर आफ्ना माग प्रस्तुत गर्न मजदुर पक्षलाई आग्रह गरे भने आदिबासी जनजाति महासंघले उठाएको आईएलओ १६९ को मुद्दा आफुले समाधान गर्न नसक्ने स्पष्ट पारे ।
विगत डेढ बर्ष देखि निर्माणकार्य शुरु भएको अपर मस्र्याङ्दी ए जलविद्युत आयोजनाको निर्माण कार्य यस बर्ष ७० प्रतिशत पूरा गर्ने लक्ष्य राखिएको छ । आगामी २४ महिनामा निर्माण सम्पन्न हुने उक्त आयोजनामा चिनियाँ सिनो हाईड्रो पावर कम्पनीको ९० प्रतिशत र नेपाली सगरमाथा पावर कम्पनीको १० प्रतिशत लगानी छ ।
आयोजना निर्माण कार्य शुरु भएपछि दर्जनौ पटक भएको बन्द हड्तालले तोकिएको समयमा आयोजना सम्पन्न हुनेमा निर्माण पक्ष शशंकित बनेको आयोजनाका जनसम्पर्क अधिकृत अर्जुन गुरुङले बताए ।

लमजुङ : लमजुङको भुलभुलेमा निर्माणाधीन ५० मेगावाट क्षमताको माथिल्लो मर्स्याङ्दी ए जलविद्युत् आयोजना फेरि बन्द भएको छ। मजदुरले विभिन्न माग राखी आन्दोलन गरेका कारण आयोजना बन्द भएको हो।
स्थानीय युवालाई क्षमताअनुसार रोजगार दिनुपर्ने माग राख्दै मजदुर आन्दोलनमा उत्रिएका छन्। मजदुर आन्दोलनका कारण आयोजनाको सबै काम बन्द भएको आयोजनाका जनसम्पर्क अधिकृत अर्जुन गुरुङले जानकारी दिए।
नेपाल आदिवासी जनजाति जिल्ला समन्वय परिषद् लमजुङको अगुवाइमा सोमबार जिल्ला प्रशासन कार्यलयमा धर्ना तथा ज्ञापनपत्र बुझाउने कार्यक्रम सम्पन्न भएको छ। ज्ञापनपत्रमा मजदुरको दैनिक ज्याला ८ घन्टाको ६ सय रुपैयाँ हुनुपर्ने, २६ दिनको ज्याला २० हजार हुनुपर्ने, महिनामा चार दिन बिदाको व्यवस्था हुनुपर्ने माग गरिएको छ।
ज्ञापनपत्रमा आयोजनामा काम गर्ने मजदुरको १५ देखि २० लाख रुपैयाँसम्मको बिमाको व्यवस्था हुनुपर्ने, मजदुरलाई सञ्चयकोषको व्यवस्था हुनुपर्ने, जोखिम भत्ता हुनुपर्ने माग पनि अघि सारिएको छ।
ज्ञापनपत्रमा आयोजना स्थलमा स्रोतसाधन सम्पन्न स्वास्थ्य सेवा केन्द्र हुनुपर्ने, २४सै घन्टा एम्बुलेन्सको व्यवस्था हुनुपर्ने, मजदुरले आन्दोलन गरेको दिनमा पनि भत्ता व्यवस्था हुनुपर्ने आदिवासी जनजाति महासंघ लमजुङका अध्यक्ष खेमजंग गुरुङद्वारा हस्ताक्षरित ज्ञापनपत्रमा उल्लेख छ। ज्ञापनपत्र बुझाउनुअघि आयोजनाका मजदुर, जनजति महासंघका पदाधिकारी, प्रभावित क्षेत्रका बासिन्दाले नाराजुलुस गरी प्रशासन कार्यालयमा धर्ना दिएका थिए।

वार्ताका लागि आग्रह
माथिल्लो मर्स्याङ्दी जनसरोकार समितिले विज्ञप्ति जारी गरि आफूहरू मजदुरका मागप्रति सकारात्मक रहेको भन्दै आयोजनामा हडताल बन्द गर्न छाडेर वार्तामा बस्न आग्रह गरेको छ।
सरोकार समितिका अध्यक्ष जीतबहादुर गुरुङद्वारा हस्ताक्षरित विज्ञप्तिमा आयोजना पक्ष, सरोकार समिति र मजदुर युनियनबीच आपसी सहकार्य, सहमतिमा विश्वासिलो वातावरण बनाउन सबै पक्ष जिम्मेवार हुनुपर्ने उल्लेख छ।
जिल्लाका राजनीतिक दलले जलविद्युत् आयोजनामा कुनै बन्द हडताल नगर्ने प्रतिबद्धता जनाए पनि माथिल्लो मर्स्याङ्दी ए पटकपटक बन्द हुँदै आएको छ। मजदुर र स्थानीयको नाममा कतिपय समयमा असान्दर्भिक माग राखेर आयोजनालाई क्षति पुर्‍याएको जलविद्युत् क्षेत्रमा काम गर्ने प्रवर्द्धकले बताएका छन्।
आयोजना सुरु भएको एक वर्षमा करिब डेढ महिना बन्द भएको आयोजनाका जनसम्पर्क अधिकृत अर्जुन गुरुङले बताए। एक वर्षको अवधिमा स्थानीय बासिन्दाले कहिले रोजगारीको माग राखी बन्द गराएका थिए भने कहिले मजदुरले विभिन्न माग राखी आयोजना बन्द गराउँदै आएका थिए।
भुलभुलेको ङादीमा बाँध बाँधेर ६ दसमलब ५ किलोमिटर सुरुङबाट भुलभुलेकै वडा नम्बर ३ को मर्स्याङ्दी तटमा विद्युत् गृह निर्माण गर्ने आयोजनाको अहिलेसम्म झन्डै दुई किलोमिटर सुरुङ निर्माण भइसकेको छ।

Nepal’s Nomadic Rautes Changing Their Way Of Life: For Good Or Bad?

Rautes, who have been living in forests for centuries, are now changing their way of living. The standards of this nomadic tribe are also improving with changes in their food and dressing. They had been living in forests and eating forest edibles but are coming in contact with other communities these days.

They have started visiting town and market areas from forests. Unlike in the past, they have now begun living near settlement areas. They used to live in straw huts but now live in bamboo huts. Satyadevi Adhikari, Chairperson of Raute Development Foundation and also known as Rautes’ niece, says that Rautes are gradually changing.

‘When I first met them, they used to defecate standing up. They did not agree to sit for defecating, as that would require them to bow down. Later, I taught few women to sit to defecate without letting the Raute Chief know. After showing that those women were cleaner, I taught others too. Now they clean their hands with soap after defecation,’ Adhikari stated.

Mobile Craze

Rautes are getting drawn towards modern technologies. They enjoy talking on mobile phones when somebody lets them use it. A Raute Chief, Surya Narayan Shahi says that he feels delighted talking on mobile phones. When an outsider goes to a Raute community, he asks for the phone to call his acquaintances.

Towards Dependency

Rautes had been living by selling wooden goods but now are getting dependent on others after various organizations and government agencies are providing them with cash and food. Nepal’s government is providing them an allowance of NRs. 1,000 per month per person. Their daily life of trading wooden cases, containers and chests for food grains at the nearest settlement, collecting forest edibles and hunting wild animals is gradually changing. They have now started to come to towns and beg for money and food.

They ask money and even goats with anyone who goes to them for collecting information or undertaking studies or research. They spend money provided for allowance or as assistance by organizations on meat and alcohol. They even use the rice provided as food to make alcohol for their consumption. They beg for money with anyone who reaches their community.

Rautes used to eat wild roots (yam/beetroots) and meat of wild birds and monkey but now are drawn to having rice, goat meat and alcohol. Former Raute Chief, Maina Bahadur Shahi says prey (meat) is his favorite.

He says that their occupation of making wooden goods is now in risk due to allowance and other assistance. He states, ‘Rautes have stopped working after receiving allowances.’ He also adds that they cannot produce wooden goods because the villagers do not let them to cut tress in the forests.

Practice of Beating Paddy Disappearing

Rautes used to go to villages to exchange the wooden goods they produce for paddy and beating the paddy in mortar to make rice. However, the practice is now disappearing after government agencies and organizations began providing them with rice. Their traditional mortars have become toys for children.

For past few months, Rautes have been living along Jhupra River in Satakhani village of Surkhet district in far-western Nepal. Former Chief Shahi informed that they were preparing to move to Dailekh, an adjoining district, from there. He said, ‘Now we should move to Dailekh, Rautes should not stay at one place for long.’

Sensitive Towards Health

Recently, Rautes have gotten sensitive towards their health. They have started to bathe, comb their hair and wash their hands after eating. They have begun wearing sewn clothes and go to hospitals when they fall sick. Though they do not take medicine, they have started using treatment for injuries.

They go to hospitals when they get in street accidents. They only used to take medicinal herbs before. Dr. Suresh Kumar Kanaudiya, director of Nepalganj Medical College who has conducted health camps in Raute communities says that Raute youths are drawn to health check-ups.

Give Forests to Rautes

Though Rautes are undergoing changes in terms of visiting towns, eating goat meat, they do not agree to building and living in houses. A Raute Chief Aina Bahadur Raute says that they do not need houses. He says, ‘Rautes do not need houses, they live in forests.’ He adds that they also do not need citizenship.

Former Chief Maina Bahadur Raute demanded to give forests to the Rautes. He requested to create conditions where Rautes can live freely in forests – not houses. ‘Give Rautes the forests not houses,’ he said.

Democratic exercise among Rautes

Following rivalry among former Chiefs, Rautes have adopted democratic practice to appoint a Chief for each of their sub-group (clan). A gathering of all Rautes, held two months ago, has decided on three Chiefs through consensus for their three sub-groups – Kalyan, Raskoti and Samal. The gathering held in Satakhani village of Surkhet district picked Bir Bahadur, Dil Bahadur and Surya Narayan for Chiefs. Former Chief Maina Bahadur said, ‘After my resignation, we picked three Chiefs. I am an advisor now.’

Harisiddhi locals demand return of their lands acquired for Brick and Tiles Factory

Locals of Harisiddhi village, around 8km south of Kathmandu, have demanded that the Government return the lands acquired for Harisiddhi Brick and Tiles Factory as the lands are not being used for running the factory. They are knocking the doors of Supreme Court to get the lands returned as per Nepal’s existing laws and international human rights standards.

Around 700 ropanies of lands of local Newars was acquired at the rate of NRs. 1,500 per ropani for the establishment of the factory almost 50 years ago with assistance from China. Through an agreement in 1992 (2049 BS), management of the lands under the factory was handed over to Sundar Lal Bhawanani and Narsingh Bahadur Shrestha, after its machineries, buildings and other equipment were sold to them for meager amount of NRs. 220 million, without even informing the local agency and concerned stakeholders in the name of increasing the production and machineries of the factory.

Later, the locals learnt that they have used the lands as collateral at various financial institutions and made attempts to transfer the ownership of those lands to those institutions after shutting down the factory. Thus, an all-party meeting at Harisiddhi Village Development Committee in November 2008 formed a Struggle Committee to protest against those actions and take initiatives to resume operations of the factory as per the original purpose of land acquisition, otherwise demand return of the lands if used against such purpose. Despite Finance Ministry’s order to resume operations of the factory as per the original agreement in April 2010 in response to the correspondence of the Struggle Committee, the processes of transferring ownership of lands continued while the factory remained shut.

Responding to a complaint filed by the Struggle Committee in May 2010, Commission for Investigation of Abuse of Authority, in January 2012, recommended the Finance Ministry to investigate and decide on the issue following its yearlong investigation during which transactions of the lands were halted. Since then, the Ministry has not made any progress on the issue despite repeated calls from the landowners to its officials.

In September 2010, it was found that most of the lands had been transferred to various financial institutions and housing companies in course of collecting details at Land Registration Office, Lalitpur for an application requesting return of lands of 22 of the local landowners submitted to Ministry of Land Reforms and Management. Earlier, in 1995 (2052 BS), 151 ropanies of lands not used by the factory had been returned to original landowners through a decision of Council of Ministers. Presently, the Ministry of Land Reforms and Management has held all details of the lands including recommendations that the Ministry is prepared to return the remaining lands if decided by the Government; however, such a decision requires endorsement of the Finance Ministry. Thus, the Struggle Committee, in November 2012, had also submitted a memorandum to the then Prime Minister calling for an order to the Finance Ministry for necessary action.

When all of their efforts with government agencies went unheeded, the Struggle Committee in February 2012 filed a writ petition at Nepal’s Supreme Court demanding return of the lands to original landowners. The case is now sub-judice at the Court that has scheduled a hearing on it for 10 March 2014.

Nepal’s Land Acquisition Act, 2018 BS provides that lands, acquired for a certain purpose, can be returned if the purpose is postponed or annulled. Further, Indigenous and Tribal Peoples Convention of the International Labour Organization (ILO C169) and United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), both of which apply to Nepal, ensure the right of indigenous peoples to return to their lands as well as to just compensation, including restitution, for any action dispossessing them of their lands.
The factory, in its response to the Court, asserts that it is still operating while the records of Land Registration Office, Lalitpur clearly shows transfer of ownership of most of the lands to various institutions. Now, it remains to be seen what Nepal’s Supreme Court will decide on the issue.

ललितपुरको हरिसिद्धिका स्थानीय हरिसिद्धि ईटा तथा टायल कारखानाको निम्ति अधिग्रहण गरिएको आफ्ना जग्गा हाल आएर उक्त कारखानाको लागि प्रयोग नगरिएको हुँदा नेपालको कानुनतः र अन्तर्राष्ट्रिय मानव अधिकारबमोजिम फिर्ता गर्न सरकारसँग माग गर्दै सर्वोच्च अदालतसम्म पुगेका छन् ।

२०२१ सालमा चीन सरकारको सहयोगमा स्थानीय नेवारहरुको करीब ७०० रोपनी जग्गामा प्रति रोपनी रु. १,५००।– का दरले मुआब्जा दिएर उक्त कारखानाको स्थापना भएको थियो । पछि २०४९ सालमा स्थानीय निकाय तथा सरोकारवालाहरुलाई जानकारी सम्म नगराई कारखानाको मेसिन, घर टहरा, आदि सामाग्रीहरु सिन्काको भाउमा रु.२२ करोडमा सुन्दरलाल भवनानी र नरसिंह बहादुर श्रेष्ठको नाममा बिक्रि गरी निजिस्तरबाट सञ्चालित उद्योगले उत्पादन वृद्धि गर्ने र मुसिनहरु थप गर्ने नाममा कारखाना एरिया भित्रका जग्गाहरु व्यवस्थापन जिम्मेवारी हस्तान्तरण गरिएको थियो ।

तिनले आफनै कारखाना बन्द गरी विभिन्न वित्तिय संस्थाहरुमा जग्गा धितो बन्दक राखी वित्तिय संस्थाहरुमा जग्गाहरु नामसारी गर्न पहलहरु भएको जानकारी पाएपछि २०६५ कात्र्तिकमा हरिसिद्धि गाविसमा सर्वपक्षीय बैठकद्वारा उक्त कार्यको विरोधमा संघर्ष समिति गठन गरी अधिग्रहण उद्देश्य अनुरुप कारखाना सञ्चालनमा ल्याउन पहल गर्ने सो नभएमा जग्गा प्राप्तीको उद्देश्य विपरित प्रयोग भएमा साविक जग्गावालाहरुलाई नै फिर्ता लिने निर्णय गरियो । त्यसको प्रक्रिया स्वरुप संघर्ष समितिले अर्थ मन्त्रालयमा पत्रचार गर्दा मन्त्रालयले २०६७ बैशाखमा सम्झौता बमोजिम कारखाना सञ्चालन गर्नु भन्ने आदेश हुँदा पनि सञ्चालन नगरी जग्गाहरु नामसारी गर्ने कार्य निरन्तर रह्यो ।

संघर्ष समितिले २०६७ जेठमै अख्तियार दुरुपयोग अनुसन्धान आयोगमा उजुरी गरी सम्पूर्ण जग्गा रोक्का राखी एक बर्ष अनुसनधान गरीे आयोगबाट २०६८ माघमा निजीकरण गर्ने निकाय – अर्थ मन्त्रालयलाई छानविन गरी निर्णय लिन सिफारिस गरियो । हाल सम्बन्धित फाईलहरु अर्थ मन्त्रालयमा रहेको हुनाले आयोगको निर्णय बमोजिम कारबाही अगाडि बढाउन पिडित साविक जग्गावालाहरु पटक पटक जाँदा पनि कारबाही अगाडि नबढाई फाईलहरु दराजमा ठन्की राखेको अवस्था छ ।

२०६७ असोजमै भुमिसुधार मन्त्रालयमा २२ जनाको जग्गा फिर्ता पाउन निवेदन दर्ता भएकोमा मन्त्रालयबाट मालपोत कार्यालय ललितपुरमा विवरण र राय लिने क्रममा अधिकांश जग्गा विभिन्न वित्तिय संस्था तथा हाउजिङ्गको नाममा समेत गएको देखिन्छ । त्यसअघि २०५२ सालमा मन्त्री परिषदको निर्णयबाट उक्त कारखानाको जग्गा मध्ये कारखानाले उपयोग नगरेको १५१ रोपनी जग्गाहरु साविक जग्गावालाहरुलाई नै फिर्ता गरिएको थियो । बाँकी जग्गाहरु पनि सरकारी निर्णय भई आएमा फिर्ता गर्न तयार रहेको राय सुझाव सहितको पत्रलगायत सम्पूर्ण विवरण हाल भुमिसुधार मन्त्रालयमा रहेकोले सो अर्थ मन्त्रालयमा समेत रहेको कारवाहीका मिसिल कार्यान्वयन गर्न उपयुक्त आदेश गर्न निवेदन गर्दै संघर्ष समितिले २०६९ कात्र्तिकमा तत्कालिन प्रधानमन्त्रीलाई ज्ञापनपत्र पनि बुझाएका थिए ।

तर केही कारवाही नभएपछि पिडितसाविक जग्गावालाहरुलाई जग्गा फिर्ता गरी पाउनको लागि २०६८ माघमै सर्वोच्च अदालतमा रिट निवेदन पनि दर्ता गराएका थिए जसमा पछि २०६९ सालमा निवेदक र जानकारी थप गरिएको र हाल बहसको क्रममा रहेको छ । अदालतले उक्त मुद्दामा बहसको लागि पछिल्लो पटक यही फागुन २६ गतेको मिति तोकेको छ ।

नेपालको जग्गा प्राप्ति ऐन, २०१८ ले जुन प्रयोजनको लागि जग्गा प्राप्त गरिएको हो सो नै स्थगित वा रद्द भयो भने त्यस्तो अवस्थामा जग्गा फिर्ता हुन सक्ने व्यवस्था गरेको छ । साथै नेपालको हकमा लागु हुने अन्तर्राष्ट्रिय श्रम संगठनको आदिवासी जनजाति सम्बन्धी महासन्धि १६९ (क्ष्ीइ ऋज्ञटढ) तथा आदिवासीहरुको अधिकार सम्बन्धी संयुक्त राष्ट्रसंघीय घोषणापत्र (ग्ल्म्च्क्ष्ए)मा पनि आदिवासीहरुको जमिनमाथि उनीहरुको स्वामित्व हरण हुने कार्यको लागि परम्परागत भूमिमा फर्कन पाउने तथा प्रत्यव्यवस्थापनलगायत न्यायोचित क्षतिपूर्ति उपलब्ध गराउनुपर्ने अधिकार सुरक्षित गरिएको छ ।

उक्त कारखानाको तर्फबाट अदालतमा पेश गरिएको जानकारी कारखाना संचालनमै रहेको भनिए तापनि मालपोत कार्यालय ललितपुरको अभिलेखबाट अधिकांश जग्गा विभिन्न संस्थाको नाममा गएको स्पष्ट देखिन्छ । अब सर्वोच्च अदालतले स्थानीय आदिवासीको हकमा कस्तो फैसला गर्ने हो हेर्न बाँकि रहेको छ ।

Submission on Nepal's Universal Periodic Review mid-term implementation assessment concerning rights of indigenous peoples and minorities

National Coalition Against Racial Discrimination (NCARD) and Indigenous Peoples' Rights Activists Network (IPRAN) in October 2013 made a submission to Geneva-based UPR Info on mid-term implementation assessment of recommendations relating to indigenous peoples and minorities made during Universal Periodic Review (UPR) of Nepal in 2011. The assessment involves evaluation of the human rights situation in the country two years after the examination at the UPR for reference during Nepal's review in second cycle scheduled for 2015.

Cases of persecution of indigenous peoples in Nepal under law against cow-slaughter reported in 2012/13

Indigenous peoples in Nepal continue to be persecuted under its law against cow-slaughter—a law deeply rooted and wholly justified by Hindu (and therefore non-secular principles) and one which historically has been used to carry out the State’s forced cultural assimilation of indigenous peoples and to forge a homogenous identity for Nepali citizens.

The act violates namely article 8 of UN Declaration on the Rights of Indigenous Peoples (UNDRIP) that states that “indigenous peoples and individuals have the right to not to be subjected to forced assimilation or destruction of their culture.” Further, under Article 1 of UNDRIP and Article 3 of International Labour Organisation Convention No. 169 (ILO C. 169), indigenous peoples are due the full measure of human rights and fundamental rights promised to all peoples under international human rights law—including the rights to freedom of religion, equality before the law and minority rights to cultural expression as protected respectively in Articles 18, 26 and 27 of International Covenant on Civil and Political Rights (ICCPR).

Seven cases involving persecution of more than two dozens indigenous as well as non-indigenous persons under Nepal's law against cow-slaughter reported in 2012/13 are documented in Khas-Nepali language in the file below.

This urgent communication is respectfully submitted for consideration of the European Union Election Observation Mission – Nepal 2013, under the mandate and objectives of the Mission, concerning the legal framework for Nepal’s Constituent Assembly Elections 2013 and its implementation in relation to representation of indigenous peoples in the Elections and forthcoming Constituent Assembly.

We hope that the information that follows will demonstrate failure of the Government of Nepal to adhere to its national and international legal obligations to ensure effective representation and participation of indigenous peoples and other marginalized groups in the Elections and following constitution-drafting process through the Constituent Assembly.

Legal framework for Nepal’s Constituent Assembly Elections 2013 and its implementation in relation to representation of indigenous peoples in the forthcoming Constituent Assembly

The history of Nepal's nation building is marked by a variety of challenges, among them social exclusion, which has prevented indigenous peoples and other marginalized groups to participate in and contribute to the country's development processes.

Indigenous peoples, also known as indigenous nationalities (Adivasi Janajati in official language) in Nepal, are those ethnic groups or communities that “have their own mother tongue and traditional customs, distinct cultural identity, distinct social structure and written or oral history of their own”[3]. Fifty-nine ethnic groups officially listed as Indigenous Peoples make more than one third of Nepal’s population. However, the official list is contested and there are several groups that share in the history, characteristics and common problems of Indigenous Peoples recognized in Nepal and elsewhere but not on the list.[4]

Participation of indigenous peoples in Nepal’s constitution writing process is one of the major issues for promotion and protection of indigenous peoples’ rights within a developing constitutional order in Nepal.[5] In this context, on 12 February 2009 immediately after Constituent Assembly Elections 2008, indigenous people and their organizations filed a writ petition with Nepal’s Supreme Court alleging their exclusion from the constitutional reform process in contravention of constitutional norms and Nepal’s international treaty obligations.[6]

The writ petition formally invoked provisions of International Labour Organization Convention No. 169 concerning Indigenous and Tribal Peoples in Independent Countries, United Nations Declaration on the Rights of Indigenous Peoples, and the International Convention on the Elimination of All Forms of Racial Discrimination, particularly article 5(c) which guarantees the right, without discrimination of any kind to participate in elections and to take part in government, and the conduct of public affairs, at any level. Further, UNDRIP provides for the right of indigenous peoples to participate in decision-making in matters which would affect their rights, through representatives chosen by themselves in accordance with their own procedures as well as to maintain and develop their own indigenous decision-making institutions.

The discriminatory effect of sole reliance on the political party system exclusively controlled by Bahun/Chhetri elites for indigenous peoples to participate in constitution making process was compounded by the refusal to register political parties that claim to represent indigenous peoples on the basis of provision in Nepal’s Interim Constitution that prohibits a political institution that may jeopardize social harmony on the basis of race, ethnicity, religion or sect, the petition claimed.

While the petition had requested an interim Court order at the same time that was ignored, the State in response to the petition had argued that the petitioners’ arguments should be dismissed for failure to state a colorable claim and indigenous people were presently adequately represented in the Constituent Assembly irrespective of the manner by which they were selected and the party discipline conditions applied.

The State’s submission to the Court was accompanied by a number of affidavits, including one by then Constituent Assembly Chairperson, explaining that it was not possible to establish a separate committee on indigenous people within the Constituent Assembly and moreover, in 2009, he had already rejected the establishment of a separate committee on indigenous peoples.

However, indigenous people had no say in choosing who would represent them in the Constituent Assembly or in its various committees, since these decisions were made by political parties without any reference to indigenous peoples’ right to participate through their own freely chosen representatives. In addition, the Government failed to propose an effective alternative that could otherwise ensure indigenous peoples’ participation in political life and the constitutional reform process.

The Court repeatedly postponed hearings up to 21 times on the case after a preliminary hearing on 1 March 2009 and submission by the Government the same month until 6 January 2013. Meanwhile, indigenous peoples and their organizations communicated the issue to the UN Special Rapporteur on the Rights of Indigenous Peoples and also submitted a complaint to the Committee on the Elimination of Racial Discrimination (CERD). In response, the Committee and Rapporteur since 2009 had repeatedly called for establishment of special mechanism to ensure effective participation of indigenous peoples and obtain their free, prior and informed consent in constitution making process.[7]

Directive Order of the Supreme Court on representation of indigenous peoples in Constituent Assembly

After the Court heard arguments from both sides of the case on 6 January 2013, final decision of the Court on the case was again deferred for 6 times until 21 April 2013. By then, the Constituent Assembly had already been dissolved on 28 May 2012 after completion of even its extended term. Accordingly, the Court decision states that

“While the petition concerning representation [of indigenous nationalities] in the Constituent Assembly formed as per Interim Constitution of Nepal, 2007 following Constituent Assembly elections in 2008 was sub-judice, the Constituent Assembly was dissolved on 28 May 2012 after completion of its term. Hence, the Supreme Court concludes that the writ has been purposeless and is annulled, as conditions to issue a writ as per the demands in the petition do not exist.

However, the issues raised in the petition regarding representation [of indigenous nationalities] in Constituent Assembly seem contextual even in relationship to forthcoming Constituent Assembly elections. Thus, regarding how the representation of socio-economically backward and marginalized classes or communities including indigenous/nationalities can be successful and effective, [the Court orders the defendants] to study and investigate international laws including International Covenant on Civil and Political Rights, 1966, International Covenant on Economic, Social and Cultural Rights, 1966, International Labour Organization Convention No. 169 as well as set norms used by civilized nations about and through discussions and consultations with various affected groups about what arrangements are appropriate for successful and effective representation of marginalized and backward classes including indigenous nationalities as per the principle and aspirations of the Constitution in the context of future Constituent Assembly. For this purpose, the Court decides to issue a directive order in the name of the defendants to take necessary initiatives for required amendments or revisions in the laws including Election to the Members of Constituent Assembly Act, 2007, Regulation Relating to Election of the Members of Constituent Assembly, 2007 and Constituent Assembly Regulation, 2007.”[8]

Following the directive order of the Court, indigenous peoples and their organizations have called on the Government of Nepal and its concerned agencies as well as the political parties to amend the required laws as per the order, among other demands in relation to Nepal’s Constituent Assembly 2013.[9] Those demands have gone completely unheard.

Recommendations

This communication is submitted to the European Union Election Observation Mission – Nepal 2013, under the mandate and objectives of the Mission, with a view of bringing to the attention of the Mission the failure of the Government of Nepal, as described above, to adhere to its national and international legal obligations to ensure effective representation and participation of indigenous peoples and other marginalized groups in the Elections and following constitution-drafting process through the Constituent Assembly.

Thus, we request the Mission to immediately give consideration to this communication, and the information therein, in its observation of the electoral processes and reflect the inadequacy of the Government to fulfill its obligations for formulating necessary legal framework and ensuring its implementation for democratic elections. Further, we recommend the Mission to reflect the issue of the communication in its comprehensive Final Report, including appropriate technical recommendations for future elections.

आदिवासी जनजाति बृहत् संयुक्त मोर्चाको संविधानसभा निर्वाचनसम्बन्धी प्रेश विज्ञप्ती

आदरणीय दाजुभाइ तथा दिदीबहिनीहरु,

आदिवासी जनजाति बृहत संयुक्त मोर्चा संघीय लोकतान्त्रीक गणतन्त्र नेपालको संविधान अनुसार गठीत संविधानसभाको राज्य पुनर्संरचना समिति तथा उच्चस्तरिय राज्यपुनर्संरचना आयोगद्धारा प्रस्तावित लिम्बुवान, किरात, ताम्सालिङ, नेवाः, मगरात, तमुमान, थरुहट, शेर्पा लगायतका स्वायत्त प्रदेशहरुको सुनिश्चितताका साथै सबै प्रदेशहरुमा रहेका अल्पसंख्यक आदिवासी जनजातिहरुको पहिचानमा आधारित स्वायत्त, संरक्षित र विशेष संरक्षित क्षेत्रहरुको प्रत्याभुतिका लागि विगत लामो समयदेखि संघर्षरत रहेको छ । यो कार्यको लागि मोर्चाले पहिलो संविधानसभाभित्र निर्मित भएको आदिवासी सभासद ककस र अन्य पहिचान पक्षधर सभासदहरुसँग समन्वय गर्दै संविधानसभा बाहिरको आन्दोलनमा खेलेको सशक्त भूमिकाका वारेमा सबैमा सर्वविद्धितै छ । परिणाम त पहिचानसहितको संघीय संविधान निर्माण अन्तिम चरणमा पुगेको वेला प्रमुख तीन दल र मधेशी मोर्चा प्रक्रियामा नगई अकर्मन्यतामा रहेका कारण विना परिणाम संविधान सभा भङ्ग भएको कुरा थाहा भएकै कुरा हो । त्यसैले नेपालमा संविधानसभाको दोस्रो निर्वाचन गर्नु परेको छ । संविधानसभाको निर्वाचन देशको संविधान बनाउने निर्वाचन हो तसर्थ यो निर्वाचनमा देशमा विद्यमान सबै खाले विचार र तह तप्काका जनताको सहभागीता अनिवार्य र महत्वपूर्ण पक्ष हो । अतः आगामी २०७० मंसीर ४ गते हुन लागिरहेको निर्वाचन प्रक्रिया वा संविधानसभामा बहिष्कारमा रहेका शक्ति (३३ दलीय मोर्चा)लाई समेत समेटी अगाडी बढ्न राज्य पक्षलाई आग्रह गर्दछौं ।

दशवर्षे जनयुद्ध र २०६२।६३ को जनआन्दोलनका उपलव्धिहरु खास गरेर संघीयता, गणतन्त्र, धर्मनिरपेक्षता तथा राज्यको संरचनामा समावेशी समानुपातिक सहभागीताको मुद्धालाई संस्थागत गर्न संविधानसभाको निर्वाचनबाट मात्र सम्भव हुने कुरा प्रष्ट छ । यस प्रक्रियामा राज्यको मूलधारबाट बाहिर पारिएका उत्पीडित, उपेक्षित र अल्पसंख्यक जात जाति, भाषाभाषी, वर्ग र क्षेत्रका जनताको सहअस्तित्वलाई स्वीकार गर्दै पहिचानसहितको संघीयताको निर्माणको कुराले मात्र मुलुकको सबै जाति, वर्ग र क्षेत्रको जनताको भावनाको सम्बोधन गर्न सक्ने र अग्रगामी राज्य पुनर्संचना हुने कुरा पनि स्वतः सिद्ध छ ।

यस सन्दर्भमा जातिय पहिचानसहितको संघीयता, लोकतान्त्रीक गणतन्त्र, धर्मनिरपेक्षता, सबै जात जाति, भाषाभाषी, क्षेत्र र अल्पसंख्यक जनताको सहअस्तित्व, एवं राज्यको सबै अंग र तहमा जातिय जनसंख्याको आधारमा पुर्ण समानुपातिक समावेशी प्रतिनिधित्व र अल्पसंख्यक आदिवासी जनजाति समुदायवाट कम्तिमा एक जाति एक प्रतिनिधित्वको व्यवस्थासहितको समावेशी सहभागिता र धेरै जनसंख्या भएका आदिवासी जनजातिहरुको पहिचानको आधारमा प्रदेश र कम जनसंख्या भएका आदिवासी जनजातिहरुको स्वायत्त क्षेत्र, संरक्षित क्षेत्र र विशेष संरक्षित क्षेत्र आदि जस्ता मुद्धाहरुलाई आफ्नो मुद्धा बनाउँदै अग्रगामी राज्य निर्माणको पक्षमा लडिरहेका शक्तिहरुलाई संविधान सभाको दोस्रो निर्वाचनमा साथ र सहयोग गर्न हार्दिक अनुरोध गर्दछौं । साथै, हाम्रो साझा माग, मुद्धा र सरोकारका विषयहरु संबैधानिक रुपमा प्रत्याभुत नहुन्जेल निरन्तर खवरदारी र आन्दोलन जारी राख्न पनि हामी सबैमा हार्दिक अपिल गर्दछौं ।

YFIN and IPRAN submit comments on Draft Youth Charter of SAARC

In response to call for comments from Nepal's Ministry of Youth and Sports, Youth Federation of Indigenous Nationalities (YFIN) Nepal and Indigenous Peoples' Rights Activists Network (IPRAN) have today submitted comments on the draft of SAARC Youth Charter.

YFIN and IPRAN drew particular attention of the Ministry to the following issues with regards to the Charter :

The Draft Charter largely ignores the diversity of peoples, and hence the youth, in SAARC region. We are particularly concerned about non-recognition of disadvantaged and marginalized groups in the region, including indigenous and tribal peoples, Dalits, sexual minorities, persons with disability, linguistic and religious minorities, among others, in the Draft. Youth from these groups have distinct identity than other youth and have specific needs arising from long-standing marginalization, discrimination, exclusion and oppression against those groups. Thus, we highly suggest, as reflected in our comments, that the Draft obliges State Parties to recognize such diversity, distinct identities of groups and their specific needs and take targeted actions to address those needs.
Further, the Draft Charter proposes for a national mechanism for the implementation of the Charter and a Youth Plan of Action to operationalize the provisions of the Charter. We strongly emphasize that such mechanism and plan of action should ensure full, effective, meaningful and inclusive representation and participation of youth from the country, including those from indigenous and tribal peoples and other disadvantaged and marginalized groups.

The organizations have urged the Ministry for continued consultation and participation with stakeholders in finalizing the Charter and the following implementation thereof.

गोरखाको आदिवासीका पानीका मुहानमा पहुँचमाथि अवरोध गरिएको सम्बन्धि उजुरीमा अख्तियारको प्रतिक्रिया

गोरखाको आदिवासी समुदायका पानीका परम्परागत मुहानमा पहुँचमाथि अवरोध गरिएको सम्बन्धि गरिएको अनौपचारिक उजुरीको प्रतिक्रियामा अख्तियार दुरुपयोग अनुसन्धान आयोगले उजुरी सम्बन्धित निकायमा पेश गरिएको जानकारी दिएको छ ।

जिल्लाको बक्रांग गाविसका आदिवासी गुरुङ र मगरहरुले खानेपानी, सिंचाई लगायतका प्रयोजनका लागि परापुर्वकालदेखि प्रयोग गर्दै आएका गाउँका दुई मुहानको सार्वजनिक जग्गा केही स्थानीय र जग्गा दर्ता तथा नापजाँचका अधिकारीहरुको मिलेमतोमा २०६४ सालमा व्यक्तिको नाममा बेचिएको थियो । समुदायलाई कुनै जानकारी बेगर जग्गाधनीले २०६९ साल असारमा पानीको मुहान थुनी अन्य गाउँमा बेच्ने कार्य थालनी गर्दा समुदायले विरोध गरेपछि निर्माण कार्य रोकिएको थियो ।

तथापि, समुदायको विरोधको बावजुद स्थानीय प्रहरी र प्रशासनको सहयोगमा जग्गाधनीले २०७० साल बैशाखबाट पानी बेच्न थालेका छन् भने तिनले यसको विरुद्ध पेश गरिएको समुदायको निवेदन पनि दर्ता गर्न अस्वीकार गरिआएको अवस्था छ । अझ विरोधको क्रममा विभिन्न समयमा प्रहरी र प्रशासनबाट समुदायका प्रतिनिधिहरुलाई कुटपिट गर्ने तथा ज्यानको धम्की दिने र थुनामा हाली ठुलो रकम धरौटी तिराउने कार्य भएको छ ।

२०७० असार ७ गते स्थानीय संघर्ष समितिले लाहुर्निपको सहयोगमा समुदायका परम्परागत पानीका मुहान निरन्तर प्रयोग गर्न पाउने अधिकारको संरक्षण गर्न र अधिकार उल्लङ्घनमा जिम्मेवार पक्षमाथि कारवाहीको सिफारिश गर्न माग गर्दै राष्ट्रिय मानव अधिकार आयोगमा उजुरी दर्ता गरेको छ ।

Nepal's CIAA acts on complaint regarding access to traditional water sources of indigenous community in Gorkha

In response to an informal complaint regarding obstructions to access traditional sources of water for indigenous community in Gorkha district in western Nepal, Commission for Investigation of Abuse of Authority (CIAA) has informed that complaint has been submitted to the concerned authorities.

Indigenous Gurung and Magar people in Bakrang village of the district have been denied access to freely use two major traditional sources of water located in public land for years now. The public land was sold under individual title in collaboration of few locals and land registration and measurement officials in 2008. The landowner, without information to the locals, began diverting sources for selling water to another in mid-2012 to which the locals protested and the diversion stopped.

However, the landowner, despite local opposition, has started selling water from the sources in early 2013 using local police and administration to quell local protests while they have denied registering complaint against the owner. In course of the protests, locals have been repeatedly detained and have had to pay hefty sum for bail in course of the protests besides being beaten and threatened for life.

On 4 July 2013, a struggle committee of local indigenous people, through support of LAHURNIP, has submitted a complaint to National Human Rights Commission of Nepal on the situation demanding protection of their human rights to continuously use their traditional sources of water and recommendations for actions against those violating the rights.

कांक्रेविहारमा बुद्धको मूर्ति राख्न नदिई धार्मिक तथा सांस्कृतिक अधिकार उल्लङ्घन गरेको भन्दै आदिवासीद्वारा राष्ट्रसंघमा उजुरी

सरकारले सुर्खेतको कांक्रेविहारमा बुद्धको मूर्ति राख्न नदिएर आदिवासी जनजातिका धार्मिक तथा सांस्कृतिक अधिकार उल्लङ्घन गरेको सम्बन्धमा आदिवासी जनजातिका संस्थाहरुले संयुक्त राष्ट्रसंघमा उजुरी दिएका छन् ।

आदिवासीका अधिकारसम्बन्धि, सांस्कृतिक अधिकारका क्षेत्रमा तथा धार्मिक स्वतन्त्रतासम्बन्धि संयुक्त राष्ट्रसंघका समाधिक्षकहरुलाई सोमबार पठाइएको अत्यन्त जरूरी पत्राचारमा लाहुर्निपसहित आदिवासी जनजाति र बौद्ध संघसंस्थाका प्रतिनिधिहरुले सो उजुरी गरेका हुन् । उजुरीमा ११ जेठ २०७०मा बुद्ध जयन्तीको अवसरमा बुद्धमूर्ति स्थापनार्थ निकालिएको झाँकीमा प्रहरीले गरेको हस्तक्षेपसहित बुद्धमूर्ति स्थापनामा सरकारले गरेका अवरोधहरु व्याख्या गरिएको छ । उक्त हस्तक्षेपमा प्रहरीको निर्मम कुटाईबाट ५३ जना घाइते भएको वा तिनको धनमाल लुटिएको थियो ।

मन्त्रिपरिषद् अध्यक्षसहित सम्बन्धित निकायका प्रतिनिधिहरुसँग पटकपटक भेट गरी मौखिक तथा लिखित उजुरी दिनुका साथै विभिन्न बिरोधका कार्यक्रमहरु गरे तापनि सरकारबाट विवाद समाधानको लागि कुनै पहल नभएको र उल्टै कुनै हालतमा कांक्रेविहारमा बुद्धको मूर्ति राख्न नदिने भन्दै अप्रत्यक्ष धम्की दिइएको उजुरीमा उल्लेख गरिएको छ । यसबाट आदिवासी जनजातिका धार्मिक तथा सांस्कृतिक अधिकारका साथै अन्तरिम संविधानमा प्रत्याभूत गरिएको धर्मनिरपेक्षताको सिद्धान्तसमेत उल्लङ्घन भएको भनिएको छ ।

कांक्रेविहारमा बुद्ध मूर्ति प्रतिस्थापन गर्न अनुमति दिई आदिवासी जनजातिका धार्मिक तथा सांस्कृतिक अधिकार उल्लङ्घन रोक्न र तिनका अधिकारको सम्मान गर्न नेपाल सरकारलाई सिफारिस गर्न उजुरीकर्ताहरुले संयुक्त राष्ट्रसंघका समाधिक्षकहरुलाई अनुरोध गरेका छन् । साथै नेपाल सरकारलाई आदिवासी जनजातिका अधिकार सम्मान गराउन संयुक्त राष्ट्रसंघ तथा अन्य सम्बन्धित संस्थाहरुले सहजीकरण गर्न सिफारिस गर्न पनि अनुरोध गरिएको छ ।

Indigenous peoples submit complaint to the UN on violations of religious and cultural rights in Surkhet

Indigenous peoples’ organizations have submitted a complaint to the United Nations concerning the violations of religious and cultural rights of indigenous peoples due to denial of installation of Buddha idol in Kakre Bihar, a monastery in Surkhet district of mid-western Nepal.

Representatives of indigenous peoples’ and Buddhist organizations, on Monday, emailed the complaint in an urgent communication to the UN Special Rapporteurs on the Rights of Indigenous Peoples, in the field of cultural rights and on freedom of religion or belief. The complaint details obstructions by the Government to install the idol even after fulfilling all necessary procedures, including police intervention on the rally taken out on 25 May 2013 for installing the idol. More than 50 devotees were reportedly injured or looted of their belongings in the brutal police assault.

Despite holding number of meetings with the concerned authorities, including Chairperson of the Council of Ministers and peaceful protest programs, the Government has not taken any measure to resolve the dispute. Rather there has been indirect threat to prevent installing idol in the area at any cost. This has violated religious and cultural rights of the indigenous peoples as well as the principle of secularism as declared in the Interim Constitution of Nepal, 2007.

The complainants have requested the Special Rapporteurs to recommend the Government to permit installation of idol in the area, halt violations of and respect religious and cultural rights of indigenous peoples. Further, they have urged the Rapporteurs to recommend the United Nations and other concerned agencies to facilitate the Government to respect those rights.

संविधान सभाको निर्वाचनमा आदिवासी जनजातिको भोट कस्लाई?

निर्वाचन हुन अव पाँच हप्ता जति मात्र बांकी छ । आदिवासी जनजातिहरुलाई यो संविधान सभाको निर्वाचन तातो आलु निल्नु न ओकल्नु भएको छ अर्थात खाउं भने २३९ वर्षको बाहुनवादी पितृसत्तावादी पहाडीया एकाधिकारवादीको सिकार, नखाउं भने आफ्नो मूलथलो, जमीन, जंगल, पानी, खानी, चरण लगायतका प्राकृतिक स्रोतहरु माथिको अधिकार गुमाएका कान्छा बा र कान्छी आमाको अनुहार भएको छ ।

बिषय प्रवेश

लैनचौर स्थित भारतीय राजदूतावासमा भारतीय राजदूत शिब शंकर मुखर्जीले नेपाली कांग्रेस र मधेशी आन्दोलनका नेताहरुको बीच बैठक गराए पछि प्रधानमन्त्रि र मधेशी आन्दोलनका विच सहमती भई आन्दोलनका कार्यक्रमहरु फिर्ता भएर मधेशी आन्दोलनकारीहरु निर्वाचनमा होमीए पछि अव भने घोषित तिथी चैत २८ गते निर्वाचन हुने सुनिश्चितता बढेको छ । संघात्मक लोकतान्त्रिक माचहरु र आदिवासी जनजाति आन्दोलनकारीहरु पनि निर्वाचनमा होमीए पछि सुनिश्चतता झन बढ्यो । नेपालको आन्तरिक समस्या भारतीय पक्षको मध्यस्थतामा गरिएको सम्बन्धमा भने भारतको हस्तक्षेपको विरोधहरु पनि भइरहेका छन् र हुनु पर्दछ । प्रथम हुने निर्वाचित हुने र समानुपातिक निर्वाचनको बन्द सुचीको टुंगो लागिसकेकोले दल र उम्मेदवारहरु प्रचार प्रसारमा लाग्न थालेका छन् ।

निर्वाचन हुन अव पाँच हप्ता जति मात्र बांकी छ । आदिवासी जनजातिहरुलाई यो संविधान सभाको निर्वाचन तातो आलु निल्नु न ओकल्नु भएको छ अर्थात खाउं भने २३९ वर्षको बाहुनवादी पितृसत्तावादी पहाडीया एकाधिकारवादीको सिकार, नखाउं भने आफ्नो मूलथलो, जमीन, जंगल, पानी, खानी, चरण लगायतका प्राकृतिक स्रोतहरु माथिको अधिकार गुमाएका कान्छा बा र कान्छी आमाको अनुहार भएको छ ।
संविधान सभाकेा निर्वाचन पद्धती आदिवासी जनजाति आन्दोलनले चाहे जस्तो हुन नसकेकेाले यसले बनाउने संविधान आदिवासी जनजातिले चाहे जस्तो आउने सम्भावना कम छ ता पनि पर्ख र हेर केा निती अनुसार यही संविधान सभाले केहि चमत्कार गरी पो हाल्छ की भन्ने झीनो आशा भने वांकी राख्न बाध्य छौं । चुनावी माहौल बनीरहेको सन्दर्भमा आदिवासी जनजाति मतदाताहरुमा अव कसलाई मत खसाल्ने भन्ने चिन्ता पलाउन थालेकेा छ । सो साताकेा साप्ताहिक झटारो आदिवासी जनजाति मतदाताहरुले के हेरेर भोट दिने भन्ने विषयमा केन्द्रित छ ।

भोट खसाल्न के हेर्ने?

विकल्प १

पहिलो महत्वपूर्ण पक्ष भनेकेा बहुदलीय व्यवस्थामा दलहरुकै भूमिका महत्वपूर्ण हुने हुनाले कुन दललाई भोट खसाल्ने भन्ने कुरा नै सर्वाधिक महत्व केा हेा । दलहरुलाई दृष्टिगत गर्दा अहिलेसम्म सात राजनैतिक दलहरुले सात राजनैतिक दलहरु मिलेर जान पर्ने सहकार्य गर्न पर्ने जस्ता कुरा व्यक्त भएबाट यदी यस्तै हुने हो अर्थात संविधान सभा पछि पनि संविधान सभा अघि जस्तै सबै निर्णयहरु सात दलको सहमतीमा गर्ने हो भने यी सात दलहरु जस्ले जती जिते पनि खासै फरक पर्दैन । यस्को अर्थ आदिवासी जनजातिहरुले यि सात दल मध्ये जस्लाई मन पर्छ त्यसैलाई भोट दिए भयो ।

सात दलको सहमतीबाट धर्मनिरपेक्ष राज्य घोषणा भयो तर कार्यान्वयन फितलो भयो समाबेशी सामानुपातिकको कुरा उठ्यो तर व्यवहारमा प्रयोग गरिएन संघात्मक राज्यलाई स्वीकार गरीयो तर यस्को आधार जाती भाषा र क्षेत्र हुने भन्ने कुरालाई हल्का रुपमा लिइयो तर संवैधानिक सुनिश्चितता गरिएन । थोरै गर्छु भन्ने तर त्यहि पनि नगर्ने प्रबृति देखिएकोले त्यहि प्रबृत्ति संविधानसभाले गर्ने निर्णय र कार्यान्वयनहरुमा दोहोरीने सम्भावना कायमै छ । यस्तो भएको खण्डमा आदिवासी जनजातिहरुलाई केहि नाम मात्रका उपलब्धि हुने देखिन्छ तर यसरी जातीय भाषिक र क्षेत्रगत स्वायत्तता कुनै पनि हालतमा आउने देखिदैन । त्यसैले यो विकल्प रोज्नुको राजनैतिक औचित्य छैन ।

बिकल्प २

सात दलीय सहमती भनेकेा संविधान सभाका निर्वाचन देखि पहिलो बैठकबाट गणतन्त्रको कार्यान्वयन गर्दासम्म हो त्यस पछि दलहरु आआफना बाटा लाग्न पर्छ लाग्ने छन् भन्ने हेा । आपुनो बाटो लाग्दा प्रत्येक दलहरुको आआफ्नै खाका हुन्छ । एउटा दलले यस्तो गर्ने भन्छ अर्को दलले त्यस्तो गर्न हुंदैन यस्तो गर्न पर्छ भन्दछ । मतदातालाई कस्को प्रतिबद्धता मन पर्छ र विश्वास हुन्छ त्यहि दललाई भोट दिने हो । आदिवासी जनजाति मतदाताहरुले आत्मनिर्णयकेा अधिकार सहित जातीय भाषिक र क्षेत्रगत स्वायत्तता सुनिश्चित गर्ने राजनैतिक दललाई नै सर्वाधीक भोट दिएर जिताउन पर्ने हुन्छ । यस्को लागि पार्टीको निती हेर्नुपर्ने हुन्छ ।

नेपाली कांग्रेसको निती जातीय स्वायत्तताको विरोधी छ । कांग्रेसका नेताहरुले जातीय स्वायत्तताले नेपालको विखण्डन हुन्छ साम्प्रदायिक सद्भाव विथोलिन्छ भन्ने जस्ता गलत सोचहरु हावी छ । । एमालेले स्वायत्तताको कुरा त गर्छ तर त्यो आदिवासी जनजातिहरुले खोजेको जातीय स्वायत्तता भने होइन । एमालेले आदिवासी जनजाति र मधेशी मतदताहरुलाई स्वायत्तताको ललिपप देखाएर भोट बटुल्ने रणनीति मात्र हो । एमालेले सोचे जस्तो स्वायत्त प्रदेशमा अहिले नेपालमा जसरी बाहुन क्षेत्रीहरु हावी छन् त्यहि स्वायत्त प्रदेशहरुमा पनि दोहोरिने छ । तै पनि आदिवासी जनजातिहरुले नेपाली कांग्रेस र एमाले विच एउटा रोज्नु परेका खण्डमा कांग्रेसलाई भन्दा एमालेलाई राज्नु उपयागितावादको आधारमा बेश देखिन्छ । निर्वाचन परिणाममा कांग्रेस एमाले आदिले एक्लै वा मिलेर बहुमत ल्याएको खण्डमा जातीय स्वायत्तता सोम शर्माको लड्डु सावीत हुनेछ ।

जातीय स्वायत्तताको आधारमा भन्ने हेा आदिवासी जनजातिले खोजेको जातीय स्वायत्तता ने।s।पा। माओवादीले विगतमा घोषणा गरेको ९ र अहिलेको ११ जातीय भाषिक र क्षेत्रगत आधारको स्वायत्त प्रदेश हो । फरक के मात्र हो भने माअेावदीले छुट्याएको स्वायत्त प्रदेशहरु आत्मनिर्णयको अधिकार प्रयोग गरी तय भएको होइन र माओवादीहरुको केन्द्रीय सवाल वर्गीय नै हो जातीय भाषिक र क्षेत्रगत होइन । भएका राजनैतिक दलहरुमा माओवादीले प्रस्ताव गरेकेा जातीय भाषिक र क्षेत्रगत स्वायत्त गण राज्यहरु आदिवासी जनजातिहरुको चाहना र भावनासंग सबैभन्दा नजिक देखिन्छ ।

त्यसैले सम्पूर्ण आदिवासी जनजातिहरुले ने।s।पा। माओवादीलाई एक लौटी भोट दिएर अत्यधिक मतबाट विजय गराउन सहयोग गर्न सके संविधानसभाले बनाउने नयां संविधानमा जातीय भाषिक र क्षेत्रगत स्वायत्तता सुनिश्चित हुने पक्का छ । यस्कालागि अर्को आन्दोलन र दवाव गर्न आवश्यक हुने छैन । तर यस्तो गर्न कांग्रेस एमाले र अन्य पार्टीका आदिवासी जनजातिहरु जो पार्टीको नितीमा कट्टर छन् उनीहरुले आफनै पार्टीलाई भोट खसाले पनि जो जातीय स्वायत्तताको चाहना राख्छन् उनीहरुले पार्टी लाइन तोडेर माओवादीलाई भोट दिन पर्ने हुन्छ । के यस्तो व्यवहारमा सम्भव हुन सक्छ माओवादीहरुको उपस्थिती सकभर दुइ तिहाइ र नभए पनि बहुमतमा भए मात्र जातीय स्वायत्तता सुनिश्चित हुन सक्दछ । आदिवासी जनजातिहरुले माओवादीलाई एकलौटी भोट नदिए माओवादी बहुमतमा आउन सक्दैन । बहुमतमा नआए माओवादीले आफू प्रतिबद्ध भएको जातीय भाषिक र क्षेत्रगत स्वायत्तताकालागि संघर्ष गर्दै रहने छ तर संविधानमा यस्को सुनिश्चिता हुने छैन र व्यवहारमा भोग गर्न पाइने छैन ।

जातीय स्वायत्तताकै लागि नयां निर्माण भएको नेवाः राष्ट्रिय पार्टी तामसािलंग राष्ट्रिय पार्टी र संघात्मक लोकतान्त्रिक राष्ट्रिय पार्टीहरुलाई यि दलहरुले उम्मेदवारी दिएका निर्वाचन क्षेत्रका आदिवासी जनजासतहरुले अत्यधिक मत खसालरे जिताउन पर्ने हुन्छ । तर दल गठन भए देखि अहिलेसम्म राजनैतिक तरंग नआएको हिसावबाट यि दलहरुले अहिललेलाई केहि राजनैकित अर्थ दिए पनि पहिला हुने निर्वाचित हुनेबाट भन्दा समानुपातिक निर्वाचनबाट केहि सिटहरु ल्याउन सक्छ । यदि यस्तो भयो भने अरुले दिएको सिट भन्दा आफूले जितकेा सिट बढि शक्तिशाली हुन्छ ।

आदिवासी जनजाति मतदाताहरुले माओवादी र जातीय स्वायत्तताकै आधारमा आदिवासी जनजातिहरुले नै नेतृत्व गरेका दल र माओवादी विच रोजेर भोट खसाल्न पर्दा माओवादीलाई भन्दा पनि आदिवासी जनजातिहरुले नेर्तत्व गरेकेा दललाई नै अत्यधिक भोट दिएर जीताउन पर्ने हुन्छ । यसो भयो भने पनि यी जातीय दलहरु संविधानसभामा निर्णायक बहुमतमा नभए पनि जातीय स्वायत्ताका सावललाई जोडदाररुपमा उठाउने र जातीय स्वायत्ताका पक्षधर माओवादी लगायतका पार्टीहरुसंग तालमेल गरेर बहुमतमा पुग्ने सम्भावना रहन्छ ।

समानुपातिकमा माओवादीहरु र आदिवासी जनजातिहरुले नेतृत्व गरेकेा जातीय स्वायत्तताका लागि संगठित पार्टीलाई मात्र भोट खसाल्ने तर पहिला हुने निर्वाचित हुनेमा भने राजनैतिक दलहरुलाई हेरेर भन्दा पनि उम्मेदवारहरुलाई हेरेर भोट खसाल्ने अर्को विकल्प हुन सक्छ । आत्मनिर्णयको अधिकार सहित जातीय भाषिक र क्षेत्रगत स्वायत्तताकावारेमा सार्वजनिक प्रबिद्धता व्यक्त गरेका जुनसुकै दल वा स्वतन्त्र उम्मेदवारलाई भोट दिने ।

नेपाली कांगेस एमाले लगायतका दलहरुमा दलको निती जे जस्तो भए पनि केहि उम्मेदवारहरु व्यक्तिगतरुपमा जातीय भाषिक र क्षेत्रगत स्ावयत्तताका पक्षधरहरु पनि छन् । पहिले यस्तो प्रतिबद्धता नदेखाएका भए मतदान गर्ने दिन सम्ममा यस्तो गर्ने उम्मेदवारलाई भोट खसाल्ने । यस्तो गर्नेहरु आदिवासी जनजाति र गैर आदिवासी जनजाति छन् भने आदिवासी जनजातिलाई भोट दिने । यस्तो गर्ने गैर आदिवासी जनजाति छ तर नगर्ने आदिवासी जनजाति छ भने गैर आदिवासी जनजातिलाई भोट दिने । यस्तो प्रतिबद्धता गर्ने उम्मेदवारहरु पुरुष र महिलाहरु छन् भने महिलालाई प्राथमिकता दिने । यथार्थमा यहि विकल्प बढि प्रयोमा आउने सम्भावना देखिन्छ । यस्तो भएको खण्डमा संविधान सभामा जातीय भाषिक र क्षेत्रगत स्वायत्तताका सावलहरु जोडदार रुपमा उठ्ने छन् तर सम्बन्धित दलले यसका विरुद्ध व्हीप जारी गरेकेा खण्डमा थान्को लाग्ने हुन्छ ।

बिकल्प ४

आपुूले भोट खसाल्न पर्ने निर्वाचन क्षेत्रमा जातीय स्वायत्तताका वारेमा प्रतिबद्ध एक जना पनि उम्मेदवार छैन भने या त आफूले भोट नखसाल्ने या त खसाल्नै परेकेा खण्डमा जुन उम्मेदवारले गणतन्त्रका लागि प्रतिबद्ध छ उसैलाई भए पनि भोट खसाल्ने । यस्तो उम्मेदवार पुरुष र महिला दुवै उस्तै भए महिला उम्मेदवारलाई भोट खसाल्ने ।

बिकल्प ५

आदिवासी जनजातिका सवालहरु प्रति प्रतिबद्ध भए पनि नभए पनि कुनै उम्मेदवार आफ्नो नाता गोता पर्दछ वा ईष्टमीत्र पर्दछ वा आपुूलाई पैसा दिएको छ वा जांड रक्सी र मासुभात खान दिएको छ वा आफूलाई फायदा हुने काम गरिदिएको छ भने सो उम्मेदवारलाई भोट खसाल्ने प्रबृत्ति छ । यस्तो प्रबृत्तिलाई त्याग्नु आदिवासी जनजाति लगायत सबैका लागि राम्रो हुन्छ ।

बिकल्प ६

आफूलाई केा उम्मेदवार कस्तो हो थाहा छैन वा थाहा भए पनि आपुनो स्वःविवेकले भन्दा पनि परिवारका वा समाजका ठूला बडाले वा टोलका दादाहरुले जस्लाइ भन्यो उसैलाई भोट दिने गलत प्रबृत्ति पनि छ । यस्तो प्रबृत्तिबाट पनि मुक्त हुन पर्दछ । आफनो स्वःविवेक प्रयोग गरेर भोट खसाल्न राम्रो हुन्छ ।

बिकल्प ७

आफूलाई मनपरेकेा वा आदिवासी जनजातिका सवालमा संवेदनशील उम्मेदवार नभए भोट खसाल्न नजाने पनि विकल्प हुनसक्छ । तर लोकतन्त्रमा भोट खसाल्न जान आवश्यक हुन्छ । भोट त्यसै खेर जान दिनु भन्दा भएका मन नपरेका उम्मेदवारहरु मध्ये कुन महिला उम्मेदवार सापेक्षरुपमा ठिकै देखिन्छ उसैलाई खोट खसाल्ने । महिला उम्मेदवार नभए भएका पुरुष उम्मेदवार मध्ये सापेक्षरुपमा ठिकै देखिने उम्मेदवारलाई भोट खसाल्ने ।

अन्तमा

नेपाल आदिवासी जनजाति महासंघ राष्ट्रिय आदिवासी जनजाति महिला महासंघ लगायतका आदिवासी जनजातिका सबै संघ संस्थाहरु र आदिवासी जनजाति आन्दोलकर्मीहरु बसेर दलहरुले उम्मेदवारी दिनु अघि सामुहिक छलफल गरेर आफनो रणनिती तय गर्न सकेन । अव निर्वाचन संघारमा आइसकेकेा र उम्मेदवारहरु प्रचार प्रसारमा लागिसकेकेा बेलामा पनि मैले माथि उल्लेख गरेका विकल्पहरु र अन्य छुटेका भए सो समेतका वारेमा सामुहिक छलफल गरेर एउटा प्रभावकारी निर्णय गर्न सके आसन्न संविधान सभाले आदिवासी जनजातिको जातीय स्वायत्ताको सपना पुरा गर्न मदत गर्न सक्छ ।

हामी सुतेर बसेकेा खण्डमा अर्थात ट्युवलाईट भएको खण्डमा निकट भविष्यमा हामी आदिवासी जनजातिहरुले पछुताउने सिवाय अरु केहि वांकी रहने छैन । निर्णय गर्न ढिला भइसके पनि अझै केहि समय वांकी छ । वांकी समयको सदुपयोग गरौं ।

Indigenous peoples demand to stop army mobilization in Nepal’s Makalu Barun National Park

Local indigenous peoples and their organizations have demanded for immediate halt to the process of army mobilization in Makalu Barun National Park condemning the Government for violating human rights of indigenous peoples by beginning preparations for army mobilization without their free consent.

In a memorandum submitted to the Chairperson of Council of Ministers and other concerned state agencies on 26 August, representatives of indigenous communities and their organizationshave asked the Government to rather formulate conservation program through community participation with respectto their rights to Free, Prior and Informed Consent (FPIC). They have also demanded to form security mechanism under the control of local indigenous peoples to stop hunting and conservation of bio-diversity in the park and have warned to organize protests if the Government takes action against them.

Local Kulung, Sherpa, Yamphu, Sinsawa, Mewahang, and Bhote indigenous communities are likely to be affected by the mobilization of army in the national park area as they would be denied access to forests and natural resources on which, they largely depend for their livelihood. The memorandum further states that the army mobilization violates indigenous rights as guaranteed by the United National Declaration on the Rights of Indigenous Peoples (UNDRIP) 2007 and International Labor Organization’s Indigenous and Tribal Peoples Convention (ILO Convention 169).

Park authorities of Makalu Barun National Park situated in Sankhuwasabha and Solukhumnu districts had recommended concerned government agencies to mobilize army in the name of conservation wildlife and biodiversity of the Park. The Park covers area of Bung and Chheskamvillages of Solukhumbu district and Sisuwakhola, Tamnku, Mangtewa, Bala, Yaphu, Makalu, Hatiya, Kimathanka, Pathibhara and Chepuwa villages of Sankhuwasabha district in the eastern hilly region of Nepal. The Park was declared in 1991 without taking consent of local indigenous peoples.
