Have Moorcroft Debt Recovery recently contacted you about debts which they allege are owed to them?

You are not the only one. In fact, there are millions of others like you who are struggling with debt and are being pursued by debt collectors. But even still, this can be a stressful time.

No worries, we are here to help. In this guide, we will discuss the steps you need to take to stop Moorcroft Debt Recovery in their tracks. By the end of this guide, you will know the steps you need to take to get your finances back in order and, at the same time, stop debt collectors from pursuing you.

But first, let’s look at who Moorcroft Debt Recovery are, why they contacted you, and show you what to do next…

Who Are Moorcroft Debt Recovery?

Moorcroft Debt Recovery are a debt collection company based in the United Kingdom. Their full company name is Aberdeen Financial Limited. Like all debt collection agencies, they are registered with the FCA, the Financial Conduct Authority, to collect debts in England, Wales, Scotland, and Northern Ireland.

Moorcroft Debt Recovery collect debts from other companies at a reduced rate and use their own debt collection staff to contact customers for repayments (usually council tax debts). They also employ field agents, who may visit your home to collect debts.

If you have been contacted by this debt collector, then it’s likely that they have contacted you to collect your outstanding debts.

In this case, here is what you should do…

I Have Been Contacted by Moorcroft Debt Recovery, What Should I Do?

First of all, don’t panic. We are here to help you to get back on track.

If you have received a letter or multiple letters, you’ll notice that it probably requests a total balance, including charges on top. All of Moorcroft’s debt recovery letters are mass-produced from a computer system, usually when they first buy the debt.

Is Moorcroft Debt Recovery legitimate? Unfortunately, yes. It is tempting just to ignore the first letter you receive from Moorcroft Debt Recovery and hope the matter sorts itself out.

But in truth, it never does. Our advice is to take action quickly to pay Moorcroft Group before fees and charges increase further. That’s the only way to get rid of them.

What Happens Next?

If you don’t want visitors from Moorcroft Group PLC to your home, our advice is to act quickly to stop the Moorcroft debt collection process in its tracks.

The Moorcroft debt collection process starts with phone calls. If you don’t respond on the phone, they will no doubt look to visit your property if you are not in contact with them.

Of course, this is stressful, and some people can find this very intimidating, but it can be avoided.

When you are at this point, you need to speak to an Independent Debt Advisor about being contacted by Moorcroft Debt Recovery Limited. There are many advantages of this, doing it sooner rather than later will no doubt help you in the long run (and avoid any unnecessary home visits).

An Independent Debt Advisor will:

Look at the debts you currently have

Assess the assets which you own (such as houses, savings, and shares)

Provide you with a reference number. With this reference number, you will get breathing space. Your creditors will not be able to chase you, visit your home, or call you within this period.

But don’t delay.

If you do not act instantly, debt collectors and bailiffs can look at escalating the matter further. Which can include:

Home visits by field agents

Car repossession

They can remove goods from your home to pay for the debt (with the necessary county court order)

What about If I Choose to Ignore Moorcroft Debt Recovery?

One of the first things you need to know about dealing with any debt recovery company is this: ignoring them is a bad idea. It makes sense to switch to that sort of thinking if you don’t want to pay immediately.

However, by ignoring their calls and letters, you’ll be inciting them to seek legal enforcement action. In short, you’ll only be making matters worse.

But before it gets there, you’ll be plagued by frequent phone calls and letters. If a debt collector or Enforcement Agent has tried to make contact with you a number of times, the next logical and, more importantly, legal step for them would be to visit your home to make contact.

If this happens, it is likely that more debt will be added to your account. This can make the situation a lot worse than it needs to be. You obviously don’t want to end up with more debt than you already have!

The sooner you deal with them, the sooner you can stop Moorcroft from contacting you. But remember, you can make a complaint if they harass you.

Can Moorcroft Debt Recovery Freeze My Money?

The company, Moorcroft Debt Recovery Limited, is not capable of freezing your money or assets. But the sheriff officers of Moorcroft Group PLC do have the ability to contact the county court and place a formal appeal.

Once the county court has reviewed the presented documents, they might move to place you under arrest for your outstanding debt.

Unfortunately, the wide renown of Moorcroft Group PLC is what allows them to hold this level of sway over county court judgement, which other debt collection agencies might not have. So, they can take legal action, which we discuss below.

Diligence and the Risk of Court Issues

Things start getting a little less manageable here. “Diligence” gives Moorcroft’s sheriff officers the ability to press legal charges against you. This, in turn, authorizes Moorcroft PLC to collect debt payments from you in various ways. Here are 4 of the possible avenues they might take to do this:

Earnings Arrestment

If you have a job, a letter will be sent by the Moorcroft Group sheriffs via the court to your employer. This letter will request your employer to deliver a portion of your monthly earnings to the company to write off the debt that you owe Moorcroft Group.

Attachment Order

Together with the debt council, the Moorcroft Group sheriff officer might start seizing your assets, which they will then put up for sale or auction. The revenue from this will be counted as a payment of your outstanding debt.

Bank Arrestment

As the name suggests, a bank arrestment order is a legal action that directs your bank to freeze your account. This is a way of ensuring that you cannot access your assets or money until your debt has been paid in full.

Unfortunately, your bank also reserves the right to make a debt payment from your existing balance without your prior knowledge.

Inhibition

An inhibition orders that you’re legally barred from selling any of your property or assets until your debt to Moorcroft Group has been paid in full.

What Do I Do If Moorcroft Debt Recovery Visit My Home?

It is not uncommon for debt collectors to visit your home to collect debts.

If they have, or if they have set an appointment to visit, then you should follow these steps:

Remove any vehicles from the driveway to a safe place

Make sure all doors and windows are locked and shut

Do not allow them access to the property (they are not permitted to push past you)

Contact us before they arrive

What to Do If a Sheriff Officer from Moorcroft Breaks In?

Know your rights. Sheriff officers are only allowed to break into the home of a debtor if they have been permitted to do so with an Exceptional Attachment Order. So, if a sheriff makes their way into your home against your will, ask them to show you the permitting documents.

If they have the required documents, there is, unfortunately, not much you can do. Also, know that they might be able to break in and enter into establishments outside your home (discussed below).

However, even if the sheriff has obtained permission to enter your home, they are not permitted to touch or tamper with any of your possessions. For that, they need a separate Attachment of Goods issued by the county court.

Second, don’t be intimidated. Sheriffs of debt collection agencies tend to overstate their capabilities in order to get away with certain activities.

If you think that the sheriff has stepped out of line, you have the right to file a complaint against them with the Sheriff’s Principal, who will then take action to prevent any further harassment.

What Is an Attachment Order Outside Home?

In the event that you fail to respond to Moorcroft’s prompts or make any debt payments, then the county court might issue an attachment order of property, which is enacted outside your home. Put simply, the sheriff officer then has permission to seize assets outside your home.

In case this happens, you should hasten to remove any visible vehicles to a safe place (as we discussed above). Other possessions should also be removed from your porch or backyard promptly to prevent the sheriff from getting access to them.

What Rights Do Moorcroft Debt Recovery Have?

The simple answer is, not many – to start with.

As their function is debt recovery, Moorcroft have similar rights as the original creditor does.

At first, they can:

Send you letters

Make phone calls

Send you emails

Text you

Visit your home

They do not have the same rights as bailiffs. Debt collectorscannot enter your property (without your permission). They cannot repossess goods on your property, and they cannot take your vehicles, for example.

But what they can do is make an unlimited amount of visits to your property to collect the money they are owed, especially if you don’t respond to their phone calls. And, if they contact a bailiff, they might take you to court.

Knowing Your Options

It is easy to get worked up when you are being chased by debt collectors. In fact, this is a natural response that they rely on. But what can you do if you cannot afford to pay Moorcroft?

Before you agree on a payment plan with Moorcroft, it is important to review all of your available options. Here’s some debt advice.

Debt Management

If you have over £2000 worth of debt, you can look at a debt management plan. Debt management plans are informal agreements that can be set up by either yourself or a debt management company.

The debt management company will ask your lenders to agree to receive a lower payment and to temporarily pause interest and charges. They do not have to agree to this, and these plans are not always successful.

IVA

If you have over £5000 of debt, you may be eligible for an IVA(Individual Voluntary Arrangement). An IVA is a formal debt solution that is set up by an IVA company and managed by an Insolvency Practitioner (IP).

All of your interest and charges would be frozen. Your creditors would not be allowed to contact you anymore, and you would agree to an affordable monthly payment, starting at £70 per month.

Bankruptcy

If you cannot afford to repay any of your debts, you can apply to make yourself bankrupt. The cost for this is £680. There would be no monthly repayments, and your creditors would not be allowed to contact you after you are declared bankrupt. However, this is the last resort debt solution.

Frequently Asked Questions

Who regulates Moorcroft Debt Recovery?

Like all Debt Collection Companies, they are regulated by the FCA or Financial Conduct Authority. Since they are registered in England, you also have the option of contacting the Financial Ombudsman Service if you feel you’ve been harassed.

Can Moorcroft Debt Recovery take my property?

No, they cannot; neither do they have the right to harass you or force their way onto your property. However, Moorcroft Debt Recovery can involve bailiffs and debt collectors, who do have the right to take your property.

Can I write off the debt I owe to Moorcroft Debt Recovery?

Yes, it’s possible to write off what you owe to Moorcroft Debt Recovery with the use of an IVA. With an IVA, it’s possible to write off about 50% to 60% of your debt. However, note that you can only get an IVA if your debt is above £5000.

What are unsecured debts?

An unsecured debt is one that does not have any collateral; i.e., it’s not supported by any asset of value. Unsecured debts which are not paid off on time can cause you to be sued by your creditor. However, since there is no collateral, your assets/property won’t be seized.

Here are the different types of unsecured debts:

Credit card

Store cards

Loans

Parking fines

Council tax

HMRC debts

Utility bills

Criminal fines

Are Moorcroft Debt Recovery bailiffs?

Bailiffs, Moorcroft Debt Recovery are not, neither is any other debt collection agency. Neither do they have the rights of bailiffs. However, a Moorcroft debt collector does reserve the right to enlist the help of bailiffs if need be, who will then begin the county court judicial process.

Remember, any bailiffs Moorcroft Debt Recovery contact have the right to seize your assets.

What is an IVA?

IVA stands for Individual Voluntary Arrangement (IVA). It is a formalized solution for debt that allows you to consolidate your debts and pay them off using only one affordable monthly payment (starting at £70 to £80).

This payment is made to an Insolvency Practitioner (IP) and must be made for a fixed term which usually lasts about 5 years. Once that term is over, all outstanding payments are written off completely legally.

Does an IVA affect my credit report?

Yes. An IVA appears on your credit file for up to 5 years, so you can expect to encounter difficulty getting credit during that time. After the legitimate debt payment term has ended, it can take up to 12 months for the IVA to be removed from your credit file.

How long does the debt collection process last?

Put bluntly—as long as it takes. While you still owe money to Moorcroft, they won’t let you be. This is because debt collectors buy debts from your original lender at extremely low prices. So, debt collectors are motivated by recovering not only the original value but the interests, fees, and charges.

If you feel cornered or pressured by any debt collection company, you can contact us directly, and we’ll be on it as soon as possible. With our extensive experience dealing with Moorcroft Debt Recovery and other similar companies, we’ll be able to help you pay back what you owe and be on your way to a debt-free existence.

If a Whyte & codebt collector or Enforcement Agent has tried to make contact with you a number of times, the next logical step for them would be to visit your house.

If this happens, it is likely that more debt is added to your account. This can make the situation a lot worse than it needs to be. So, do not ignore but think of ways to deal with the situation.

What to Do If a Sheriff Officer Breaks into Your House?

Only an Exceptional Attachment Order by the law permit can allow a Sheriff officer to break into your home.

Howver, they have the right to enter any establishments or area that is outside of the house, such as your car parking.

Upon entering the house, they may make you leave the premises and put pressure on you for debt recovery or repayment. To do that, they will present the necessary documents to you. Dealing with a Sheriff can be a tricky business, but we are here to provide you with the right solutions.

Now when a Sheriff arrives at your doorstep, ask for the legal permit that allows them to enter your house. Ensure that you do not display your fear while dealing with them.

Even if they do have the grant, they are not allowed to touch your belongings or sell them. For doing that, they need to show you a legal attachment of goods given from the court.

One thing you should keep in your mind that Sheriffs tend to show more authority or power than they actually have. They will try to intimidate you into doing the things that they do not have permission for, but don’t get frightened.

If you think they are doing so, calling for help will be the right thing to do. You will be able to file a complaint against that Sheriff by law.

What Do I Do If Whyte and Co Visit My Home?

It is not uncommon for debt collectors or a professional from the agency to pay a visit to your address to collect debts and keep in check with the debt collecting process.

If a Whyte & coenforcement has, or if they have set an appointment to visit then you should follow these steps:

Remove any vehicles from the driveway to a safe place

Make sure all doors and windows are locked and shut

Do not allow them access to the property (they are not permitted to push past you)

Calling or texting us before they arrive is a must as we will give you proper solutions

What Rights Do Whyte & Co Have?

The simple answer is, not many.

As a debt collector, they have similar rights as the original creditor does.

At first, they can:

Send you letters

Call you

Send you emails

Text you

Visit your home

They do not have the same rights as bailiffs. Debt collectors cannot enter your property (without your permission). They cannot repossess goods in your property, and they can’t take your vehicles or sell them, for example. But what they can do is make an unlimited number of visits to your property to take the money they are owed.

Is There a Chance of Losing My Home?

While the chances of that happening is not very likely, but it can possibly happen. Usually, your property is not used to secure unsecured debts as it is your asset.

Nevertheless, Whyte & Co could go to the courts and apply to secure the debts you have against your property, aka your house. Therefore, there is a possibility, even if it is small, that you might end up losing your home.

What If I Can’t Afford to Pay Whyte & CoDebt?

If you are going through this article, there is a chance that you can’t afford to make the payments. You might not have it easy and maybe in debt to many companies, which makes it harder to clear off the debt.

Nevertheless, you have come to the right place as we will give you right debt advice and solutions to your problems. We will be dealing with your problems so that you don’t have to deal with them.

How Can I Stop Whyte & Coenforcement from contacting me?

Upon taking our service, you won’t need to worry anymore. We will stop any sort of direct contact from Whyte & Co. You will not be receiving any of those letters that are laced with threats, and neither will you get any kind of in-person visits.

Our help is not just limited to Whyte & Co, though. After enlisting our services, you won’t be in direct contact with any debt collection company.

We will deal with your credit issues. Our aim is to free you of your debt by giving you good and affordable solutions. You will be debt-free, hopefully, if you decide to take our service.

Knowing Your Options

It is easy to get worked up when you are being chased by debt collectors. In fact, this is a natural response that they rely on.

But before you agree on a payment plan with a debt collector, it is important to review all of your available options.

Debt Management

If you have over £2000 worth of debt, you could look at a debt management plan. These plans are informal agreements that can be set up by either yourself or a debt management company.

The company will ask your lenders to agree to receive a lower payment and to temporarily pause interest and charges. They do not have to agree to this, and these plans are not always successful.

IVA

IVA stands for Individual Voluntary Arrangement. If you have over £5000 of debt, you may be eligible for an IVA. An IVA is a formal arrangement that is set up by an IVA company and managed by an Insolvency Practitioner (IP).

All of your interest and charges would be frozen. Your creditors would not be allowed to contact you anymore, and you would agree on an affordable monthly payment, starting at £70 per month.

Bankruptcy

If you cannot afford to repay the money, you can apply to make yourself bankrupt. The cost for this is £680. There would be no monthly repayments, and your creditors would not be allowed to contact you after you are declared bankrupt.

Who Can I Go to for Help?

If you owe money to an agency and you are being chased by debt collectors, like Whyte & Co, then you should seek independent debt advice as soon as you can. Here, at IVA TV, our main goal is to help people like you. So, the sooner you contact us for help, the faster we can help you in dealing with these debt issues.

Frequently Asked Questions

Can Whyte & Co take my property?

If you owe money to Whyte & Co and they decide to take you to court, they may be awarded a Court Order, which allows them to instruct Whyte & co Enforcement Agents.

Whyte & co Enforcement Agentshave greater rights than normal Debt Collectors.

Because Whyte & co enforcement takes property from your household to sell towards the debt. They can also repossess vehicles that are parked on the property.

Can I write off the debt I owe to Whyte & Co?

There are a number of legal ways to write off the debt which you owe to Whyte & Co.

You can look at formal agreements such as an IVA, bankruptcy or a debt relief order. In some circumstances, it is common that people have written off 100% of the total debt amount through these methods.

What are unsecured debts?

Unsecured debts are debts that are not secured against the value of a property or vehicle.

Typical examples of unsecured debts are:

Catalogues

Credit cards

Loans

Payday loans

Overdrafts

Parking fines

Utility bills

HMRC bills

And many more.

Are Whyte & cobailiffs?

No, they are not. A bailiff has different rights do debt collectors and should be treated differently. Read our full guide for further information on this

Have Debt Recovery Plus been pulling into your garage for a fast debt settlement? If the answer is no and you received just a letter only recently, then you can wait some more and handle your debt issue with professional help.

GET STARTED FOR FREE

DRP Debt Recovery Plus is an agency that follows up with the defaulters of its customer companies – to the point that it drags you to court.

Even so, you should not panic and give in to the pressure, especially when you can write off most of the debt!

Today, we’re going to tell you more about Debt Recovery Plus, its course of action, and legal authority. We’ll also discuss the services we provide at IVA TV and how we can help solve your debt problem once and for all!

Let’s get right into it!

What Is Debt Recovery Plus?

Debt Recovery Plus is a debt collection agency registered in England. Their agents recover parking fines and County Court Judgements.

Basically, the company deploys its own staff to go after the defaulters and claim the money. Agencies like DRP have a number of field agents across the UK. They follow a set of rules for initiating the debt collection procedure.

DRP Debt Recovery will look at your file where your contact number, address, and due payments are listed. The process usually starts with issuing a letter in your name from their registered office. It can soon advance to phone calls and house visits frequently.

Ever thought a parking charge notice could bring so much trouble? No? Then you should jump to the section where we discuss what happens when you ignore calls from Debt Recovery Plus.

What Companies Does DRP Collect for?

Debt Recovery Plus collects priority debts such as council tax debts and debts related to County Court Judgements. The average value of these debts is usually above the $750 mark.

However, you’ll see DRP Debt Recovery mostly collecting parking fines for private parking operators. It’s a popular debt collection agency that almost exclusively collects money against parking charge notices.

In the coming days, it won’t be uncommon for DRP to collect your credit card dues. After all, DRP Debt Recovery extends its debt recovery service to a broad client base. They’re also known to collect borrowed money on behalf of United Utilities, Virgin Media, Council Tax, and Court Orders.

What Rights Does DRP Have?

If you owe money to any of the client companies of Debt Recovery Plus, you’ll be hearing from DRP Debt Recovery sooner than you think. DRP is rigid in its ways of debt recovery. So, if you’ve missed parking charge notices from DRP more than one time, you can be sure of the fact that they will take a legal step against you.

Debt Recovery Plus could apply for a County Court Judgement (CCJ), and the court, in turn, could force you to clear the dues. On top of that, the court action can definitely show up on your credit card files and affect your credit limit to some extent.

When DRP chooses the hard way, which is to take you to court, you will receive a letter or an email regarding the issue and date.

What DRP Debt Recovery Cannot Do?

Understanding the “dos and don’ts” is favorable in all types of proceedings. Not only can you state your rights upfront but also know the consequences of the actions of both parties.

For example, if DRP forces entry into your home, you can report them to the police. The only way in which Debt Recovery Plus Ltd. can access your residential property is by appointing a bailiff. It’s a long haul, and chances are you’ll find a solution way before that even happens.

DRP legally cannot issue arrest warrants, confiscate your property or put you in jail. In fact, their debt collection includes a CCJ and the assistance of a bailiff at max. The Debt Recovery Team cannot exercise the rights of a bailiff.

What Can I Do About It?

Collecting the parking fines in due time is difficult for parking operators, especially when the traffic offenders don’t comply. This is where Debt Recovery Plus comes in and starts chasing you.

We are not surprised. The UK, after all, had made almost half a billion pounds (£454.4M) revenue from parking charges, that too in the year of 2019 alone. The parking fee is currently £90 in the UK. If you pay the money in two weeks from the issue date, you’ll be offered a 50% discount.

But if you avail our service, we can sort this out with the debt collectors on behalf of you.

Appeal the Penalty Charge Notice (PCN)

As the registered owner of your vehicle, you can either pay or contest the parking fine that was issued to you.

Think that the parking fee was a mistake? In that case, you can dispute your parking charge notice online or by contacting the Parking Enforcement Processing Unit.

Debt Recovery Plus may contact you within this period if they don’t know your appeal.

You need to mention your appeal to DRP Debt Recovery should they have a CCJ in order.

If the private parking operator company involved had already appointed DRP for debt collection, you will have to deal directly with the agency, and not the parking company. But why face debt collectors yourself when we can do it for you?

Respond to Your First Debt Recovery Plus Letter the Right Way!

In our career as IVA advisors, we have seen plenty of cases where our client is not even the one concerned with the court action letter issued in his name. So, if you don’t acknowledge the debt in your Debt Recovery Plus letter, do contact their office and demand legal proof.

Debt Recovery Plus Ltd will inform you about your parking charge notice via a letter. If you let it go unaddressed, the debt collectors will opt for a phone call and then a CCJ.

First things first, the letter will contain your parking fee details and vehicle information. Double-check your car’s license number and the correct date and time of the issuance of the parking ticket.

Debt Recovery Plus sends out their first letter as a simple notice. It’s a reminder to address your parking fee notices as soon as possible.

If it’s inconvenient for you to pay the parking fine, you may take some time to gather the money. Our advice for you is to make sure DRP doesn’t mistake your delay as a gesture to not pay. In that case, DRP will move to the next solution. Yes, a house visit!

What to Expect After Receiving a Letter from DRP?

After you receive a letter from Debt Recovery Plus Ltd. and choose not to address it, you’re likely to receive another letter from them. Field agents of the Debt Recovery Plus company will also give you a call to discuss the money issue.

However, things will get complicated if Debt Recovery Plus employs a bailiff for their debt collection. Bailiffs have the permission to confiscate belongings that would be of the same value as your debt. Debt Recovery Plus would not appoint a bailiff unless you ignore the County Court Judgement.

Before things exacerbate regarding debt collection, we suggest consulting a debt management agency such as ours. At IVA Tv, we analyze, negotiate and lessen your debt payment so that you can get your finances right back on track!

Could I Lose My House and Car?

Just because you received a reminder letter from Debt Recovery Plus Ltd. does not mean they are going to pack your car up and leave. It might not get to that even if you’re unable to clear the payment. There are debt charities, monthly installments, and debt settlement policies that can help you out.

Navigating your available options is not as easy as it seems, especially when you’re not from a finance or law background. We are a team of financial advisors and IVA experts, and we know how to stall debt collection agencies and negotiate favorable installment plans for you!

Moreover, it’s unlikely that a parking fee issue will cost you your car. If you’re wondering what’s the worst that could happen, you can think of a CCJ and a visit from the sheriff. But that’s it.

What to Do When DRP Visits My Home?

There’s nothing much to do when Debt Recovery Plus finally visits you except for showing them the door. As we’ve already mentioned, Debt Recovery Plus Ltd. does not have the authority to break into your home and claim your debt payment.

It’s also not going to be that iconic scene from Schitt’s Creek when the Rose family got all their stuff confiscated.

The best thing you can do when DRP Debt Recovery visits is to talk to them outside. If you have expensive items inside your home and Debt Recovery Plus indeed knows about them, it might get difficult for us to negotiate the payment in your favor.

How Our Services Can Help You with Debt Recovery Plus?

We are an IVA advisor company, and we have several packages that exclusively deal with debt collectors. At IVA TV, we help you settle feasible payments with the debt collection agency involved.

If you’re someone with multiple parking fee notices, you must have had Debt Recovery Plus contact you several times.

Our service can cut your net payable by a large amount. We have clients who were exempted from paying as much as 60% of their debt money with our help. Apart from resolving debts regarding parking penalties, we also offer debt management programs.

So, if you happen to have outstanding debts from other sectors, we can help you write them off. We also had the pleasure to successfully decrease the levied interest rate on the debts of our clients.

Frequently Asked Questions

Where do I contest a parking charge notice in the UK?

If you feel that your parking charge notice has been wrongly issued, you can challenge it or appeal it to the Parking Enforcement Processing Unit. What it’s going to do is extend that 14-day discount period until the authority reviews the case.

Will issues with Debt Recovery Plus show on my credit file?

Ignoring letters and calls from DRP Debt Recovery won’t show up in your financial logs. However, neglecting a County Court Judgment regarding your parking charge notices may show up on your files.

Are Debt Recovery Plus bailiffs?

Debt Recovery Plus is not entitled to the rights of bailiffs. They cannot come inside if you send them away from the door. However, they can appoint bailiffs who will handle the debt collection process by means of repossession.

Bottom Line

If your debt from Debt Recovery Plus has spiralled out of control, you are welcome at IVA TV. Together, we’ll alleviate your debt situation and stop Debt Recovery Plus from chasing you.

It’s always wise to deal with debt today so that you can get out of debt tomorrow! Let’s get a debt-free life off the ground, shall we?

Who Is Wilkin Chapman?

Their official full company name in registration is Aberdeen Financial Limited, under which they are registered with the Financial Conduct Authority (FCA).

Wilkin Chapman is registered and authorized to collect debts in England, Scotland, Wales, and Northern Ireland.

What Does Wilkin Chapman Do?

As a debt collection firm, Wilkin Chapman is in the debt business. That means that they purchase other companies’ debts at a fraction of the original price, then employ their debt collectors to retrieve payments from debtors. Field agents may also visit you.

Who Does Wilkin Chapman collect for?

Wilkin Chapman is a business mainly engaged in collecting council tax debts from their “customers.” Besides, they also collect debts, related to county court judgment, typically for the amount of £750 and above.

As these are priority debts, there is a possibility of it leading to bailiff or solicitors action.

They may also collect for the following:

● Credit Cards

● Utilities

● Court Orders

If Wilkin Chapman has been in touch with you, that means you have an outstanding debt with them. But don’t pay them just yet. Follow along for what to do next.

I Have Been Contacted by Wilkin Chapman. What Should I Do?

If you have received a letter or email from Wilkin Chapman LLP, it may request you to pay a total balance, including fees and charges.

This is a mass-produced email or letter, and that might make you want to ignore the letter. You may even start to think that if you do, the problem will go away.

Long story short: it will not. Instead, your fees and charges will soon start piling on top of the total. So, it would be best if you did not ignore them.

We understand if you’re feeling anxious in the wake of being contacted by this debt collection agency but, it is imperative to know that you have multiple options in dealing with them. Don’t give them any money just yet.

What Happens Next?

The debt collection process starts innocently enough: with a letter and perhaps a telephone call. It would be best if you, act quickly; otherwise, Wilkin Chapman agents will find your address and show up at your door.

You want to prevent this. It can be pretty unsettling and stressful to think that these agents may swoop in to get their money back. But even if you can, you must not agree to a payment plan just yet.

Our advice is to start by getting in touch with an Independent Debt Advisor. There are myriad benefits of doing so, not least of which is, preventing home visits by debt collectors.

How Can An Independent Debt Advisor Help Me?

Please consider the services of an independent debt advisor. He/she can do the following for you:

● Gather information of all of your current outstanding debts

● Evaluate your assets, and property, (e.g., shares, savings, houses, cars)

● Provide you with your very own reference number. This reference number prevents Wilkin Chapman from chasing you further, including calling you and visiting your home.

All that said, you need to get in touch with an independent debt advisor as quickly as you can.

Otherwise, debt collectors can get in touch with bailiffs, who can obtain permission to break into your home, repossess your vehicle (if you have any), and/or remove your property for auction or sale (with which to make debt payments).

What Happens If I Ignore Wilkin Chapman?

If you ignore Wilkin Chapman’s attempts to contact you, you will only be making the situation worse.

Don’t be surprised if the frequency of contact increases and spills onto other channels: they might find and contact you at your job office or through social media.

Beyond this, they might begin home visits and even legal proceedings.

Not only does this mean that the company can take you to court, but the balance of the debt you owe might increase, thanks to the addition of charges and fees, which you will then have to pay.

Our advice? Please don’t ignore them, especially if you want to avoid legal repercussions.

What Do I Do If Wilkin Chapman Visits My Home?

Unfortunately, it is common for debt collectors in England to visit debtors’ homes to collect payments.

If you’re very unlucky, they won’t notify you before coming. However, they might also make an appointment with you to visit your home. In that case, you must take action to protect your property:

● Lock all of your windows and doors

● Remove any vehicles you have sitting in the driveway

● Prevent them from gaining access to your property—know that by law, they are not allowed to harass you or push past you (except in special situations)

● Contact us before their scheduled arrival time.

What Rights Does Wilkin Chapman Have?

Not very many, in the first place. As they are a debt collection agency, they have rights similar to your original creditor. They are authorized to:

● Send you emails

● Send you letters

● Call you on the phone

● Text you

● Visit your home (but not push past you).

It is important to understand that agents of debt collection companies do not have the same rights as bailiffs.

They are not authorized to enter your property without your permission or to repossess any of your belongings (including your vehicle), without a court order.

However, they can make unlimited visits to your home until your total account is settled.

What Are My Options to Pay Wilkin Chapman?

We know you’re currently in a nervous or anxious state. But don’t let those emotions drive you to agree to pay according to plans suggested to you by Wilkin Chapman.

Instead, consider the options available to you. Here they are.

● Debt Management

If your outstanding debts amount to over £2000, you might want to consider a debt management plan.

It’s an informal arrangement in which your creditors are presented with a proposition to lower the payment and to temporarily pause charges and interest.

You can initiate this yourself or take the help of a debt management company to set it up. However, know that your creditors are not bound to agree to this, so you may not be successful.

● IVA

If your outstanding debts amount to over £5000, you may be b eligible for an Individual Voluntary Arrangement (IVA).

This is a formal arrangement managed by an Insolvency Practitioner (IP) and set up by an IVA company.

An IP consolidates all of your existing debts (including what you owe to Wilkin Chapman, of course), and allows you to pay one affordable monthly amount, usually not more than £80.

If you go with an IVA, no other additional charges and interests would be added to your balance. Also, it bars any creditors from contacting you further.

● Bankruptcy

If you’re unable to pay off your debts, you have the option to declare bankruptcy. Your creditors would stop contacting you, and you would no longer have to make monthly payments.

If you wish to declare bankruptcy, you will need to submit an application and pay a fee of £680.

Who Can I Go to For Help?

If debt collection agencies are constantly chasing you and you’re unable to pay off your debts, you must aim to seek out independent debt advice without any delay.

Going to a debt charity is one of your options if you cannot afford to pay. If your debt is less than £2000, a debt charity might be able to help you.

However, note, that if you avail the services of a charity and simultaneously opt for an IVA, your fees will be similar to using a private IVA company.

Here are some of the companies you might want to contact:

● Christians Against Poverty

● Debt Advice Foundation

● Debt Support Trust

● IVA Advice

● Shelter

If your debt with Stirling Park is no longer affordable, you may be able to write them off.

GET STARTED FOR FREE

Has Stirling Park recently been chasing you for debts which they demand are owed to them?

Well, don’t get worried just yet.

There is a way out. You have to be patient and stay with us as we guide you through a diversion process on this website.

Millions of people are struggling with debt and are being chased aggressively by debt collectors. We know how daunting the experience is.

But the truth is that no matter how much you are being chased, it’s not a good idea to pay out your debts through an agency like Stirling.

So, in this article, we will discuss the steps you need to take to stop Stirling Park in its tracks. By the end of this read, you will know how to get your money back in order and have those pesky Stirling Park LLP debt collectors back off.

Who Is Stirling Park?

Stirling Park is a debt collection company based in the United Kingdom. The full company name is Aberdeen Financial Limited. They are registered with the Financial Conduct Authority (FCA) to collect debts in England, Wales, Scotland, and Northern Ireland. They have a website for their operations too.

A short summary of their services is that they buy debts from other companies at a reduced rate and use their own staff to chase customers for the debt. They also employ field agents, who may visit your home to collect debts.

Stirling Park employs about 20 sheriff officers and 11 messenger-at-arms to carry out their debt collection services.

If a sheriff officer has contacted you, then it’s likely that they have contacted you to collect outstanding debts that you had with other companies.

So, if Stirling Park sounds unfamiliar to you, then this is why. They’re just doing a service on behalf of another entity. You’re correct in not being able to form a connection with them. So, in this case… what to do?

Find out below.

What Rights Does Stirling Park Have?

The simple answer is not many – to start with.

As debt collectors, Stirling Park has similar rights in business as the original creditor does.

They do not have the same rights as bailiffs. For example, debt collectors cannot enter your property (without your permission).

They can only do the following:

Send you letters

Call you

Send you emails

Text you

Visit your home

As such is the extent of their primary business, do not be surprised if you get an unlimited number of visits from them – they will basically try to catch you off guard at any time of the day. From the time of the first contact, you have to always be on alert mode until you sort out an arrangement.

What to Do If Stirling Park Visits My Home?

It is not uncommon for debt collectors, like Stirling Park, to show up at your doorstep for debt collection services.

If they have, or if they have set an appointment to visit, then you should follow these steps:

Make sure all doors and windows are locked and shut

Please do not allow them access to the property (they are not permitted to push past you)

Contact us before they arrive

Should I Ignore My Stirling Park LLP Contacts?

Choosing to ignore Stirling Park is a bad idea. This is what most people do if they don’t want to pay immediately, but this sort of thing only makes matters worse.

If you start ignoring your debt collector, they will use their authority to take enforcement action.

So, instead of ignoring them straight away, you need to look for ways to counteract them in their business.

What Should I Do After Being Contacted by Stirling Park?

The first thing you need to do is to verify the exact line of business for which you are being contacted by Stirling Park.

Ask how much money you owe them

Ask who the debt is addressed to

Ask for any evidence that backs up their claim of the owed money

The second thing to do is to verify the authenticity of the contact. Make sure that you check with the authority whether it really is Stirling Park with the contact request.

Stirling Park LLP is an actual company that is registered in Scotland under the registered key of SO300097. Their address in Glasgow is 24 Blythswood Square, Glasgow G2 4BG. They also have a Sheriff helpline number that you can call for purposes of authentication.

The third thing you should do is check whether the case of their request is binding. Two conditions make a binding debt case, and they are:

The debt has to be written to your name

The debt must not be expired for collection

The letter that you have received will usually request a total balance, including charges on top. This letter will be mass-produced from a computer system, usually when they first buy the debt.

Just Received a Letter from Stirling Park: What Should I Do?

The letter you have received can be sent back to Stirling Park for verification. If you think that it contains details about someone else’s debts or it talks about debts that you have already paid off, then you can challenge them to prove the validity of the demands stated in their letter.

You can do this in one of two ways – shoot them an email on their website or send a letter to their Scotland address through the postal service. To write the letter, follow a specific template, and mention the reference number you were provided with.

Do NOT include your contact details in the letter, especially your phone numbers.

If your case is enforceable, then you will receive a letter from Stirling Park mentioning and crediting the proof of their claim.

And if you do not receive any letter back from them, consider the case to be closed. This will also mean that you won’t be harassed by Stirling Park anymore.

What to Expect After a Stirling Park Letter?

You will be visited by a sheriff officer. The sheriff officer will call you and knock on your door to deliver documents to you.

This person is not a police officer, he/she is a representative of the Scottish court, so their power has been bestowed upon them by the court of Scottish law. In summary, they can just do the following:

Evict you

Pressurize you to return payment of loans that you owe

Deliver all necessary documents to your doorstep

Get inside your house in case there is a court issue with it

Sheriff officers with more clout can do more than the above. They will also have the power to break a window to enter and break the locks of your house to get inside by force.

What to Do If a Sheriff Officer Breaks In?

Sheriff officers can only break into your home if they have been permitted an Exceptional Attachment Order by the law. But they can break and enter any business, garage, etc., that are outside your home even without that permit.

Ask the Sheriff officers to show you the document that issues their entry into your premises.

If there is such a grant, there’s not much that you can do.

But you should remember that even if the Sheriff has permission to enter your house, he/she cannot touch any of your assets/possessions without a special attachment of goods issued from the court.

Sheriffs are known to overstate their power to the customer in order to do more than they have been granted to do. If you feel that the sheriff has overstepped his/her boundary, then by law, you can file a complaint against him/her with the Sheriff’s Principal.

They will look into the matter and prevent sheriffs from harassing you constantly.

What Happens Next?

Now the next thing they will do is increase the number of times they call you.

When you are at this point, you need to take the services of an Independent Debt Advisor. There are many good benefits of this; doing it sooner rather than later will undoubtedly help you in the long run (and avoid any unnecessary home visits).

An Independent Debt Advisor will:

Look at the debts you currently have

Assess the assets which you own (such as houses, savings, and shares)

Provide you with a reference code. With this reference, you will get breathing space. Your creditors will not be able to chase you, visit your home, or call you within the specified time indicated by data packed in the reference code.

But it would be best if you tried to find a solution quickly.

How Are We Going to Help You with Stirling Park Debt Collection?

We are an IVA advisor company, and our services enable you to integrate all the debts that you owe to Stirling Park and bundle them up into a singular monthly payment that will be affordable for you.

You will submit this ascertained sum of money every month to an IP.

We help to bring down the monthly payment to some value that’s as low as £80. After you get your consolidated value, you have to pay that money for a fixed term of about 5 years or so.

Once you complete paying the full term, any debt that stays in your name will be written off – this is the main significance of our company. We can bring down your total debt payment by about 60%.

Before you seek out any debt advice, it is wise to check your total debt value. And doing this has never been easier; you can do this any time on our website! Try our online debt calculator by clicking “get started for free” now.

I Can’t Afford to Pay Stirling Park: What Are My Options Now?

Don’t panic if you can’t pay Stirling Park. Take the time to prepare yourself so that you can take steps to help yourself out of the situation.

It is easy to get worked up when Stirling Park is chasing you. But, unfortunately, this natural response is what they rely on.

Before you submit yourself as a customer to the payment plan of a debt collector, pay heed to the debt advice below. This might help you wring free out of the grasp of Stirling Park and company.

Debt Charities

If you have to account for less than £2000 worth of debt payments and don’t know where to turn, you may want to speak to a debt charity.

It is also important to mention that if you approach a “charity” and opt for an IVA, the fees will remain the same as when you use the service of a private IVA company.

The following companies may be able to help you:

Christians Against Poverty

Debt Advice Foundation

Debt Support Trust

IVA Advice

Shelter

Debt Management

If you have over £2000 worth of debt payments, you can look at a debt management plan. Debt management plans are informal agreements set up by either yourself or a debt management company to your benefit.

The debt management company will ask your lenders to agree to receive a lower payment and temporarily pause interest, charges, and fees. However, the debt collectors do not have to agree to this, and these deals are not always successful.

IVA

If you have over £5000 of debt, you may be eligible for an IVA solution. An IVA is a formal arrangement set up by an IVA company and managed by an Insolvency Practitioner (IP). All of your interest and charges would be frozen.

In addition, the sheriff officers would not be allowed to contact you anymore, and you would shake hands on a deal to submit an affordable monthly payment, starting at £70 per month.

Bankruptcy

If you cannot afford to make direct payments towards any of your debts, you can apply to make yourself bankrupt. You will have to pay £680 for this service.

This is a legal process that doesn’t involve a monthly repayment deal, and it will also stop the sheriff officers from contacting you any further after you have put out the notice.

Diligence and the Risk of Court Issues

This is where things get more serious.

Diligence allows the sheriff officers of Stirling Park to press legal charges against you. It will give Stirling Park free authorization to collect council tax debts from you in several ways – this includes putting you under bank arrestment and seizing your accounts.

There are four court issues via which the sheriff officers of Stirling Park can employ their diligence to extract money from you without your consent. They are –

Earnings Arrestment

Your employer will receive a letter via the court from the sheriff officer of Stirling Park requesting to divert a portion of your monthly earnings to pay off the debt that you have to your name.

Bank Arrestment

Your bank account and credit card will get frozen so that you no longer have access to your money and assets until you pay off the debt with Stirling Park.

Under special circumstances with the court, the bank may also decide to make a payment from your account to your creditor without consulting you.

Attachment Order

With an attachment order, the Stirling Park sheriff officer and debt council will start to seize your property and assets to sell them out at an auction and extract money as payments towards your credit.

Inhibition

You will be legally inhibited from selling any of your assets until you repay the money that you owe to Stirling Park council in debt.

What Is an Attachment Order Outside Home?

If you do not respond to their prompts, do not forward payment to debt collector’s council, and don’t even take any steps to mitigate the situation, then the court might issue an attachment order of property outside your home.

What this means is that the officer and debt collection team will be able to take assets that are outside your house.

To avoid getting into this trap, make sure that you remove any vehicles from the driveway to a safe place. Remove all other items of value from your backyard or your porch so that the sheriff officers don’t get the upper hand on you.

File a Complaint Against Stirling Park

Please note that if you want to make a legal complaint about Stirling Park, you can do so by contacting the Financial Ombudsman Service or by speaking to the CSA, which is the trade association for the Debt Collection industry.

Frequently Asked Questions

Can Stirling Park take my property?

Yes, they can, but in special cases. Sheriffs can take a percentage of your property to compensate for the debt you owe them if they receive a court order issuing an attachment of goods.

However, with this attachment of goods, they won’t be able to enter your home. They will only get access to the inside of your house if the court issues an exceptional attachment of goods to them.

Can I write off the debt I owe to Stirling Park?

You can write off your debt to Stirling Park by using an IVA. You can write off about 50 – 60% of your debt via the IVA.

You will be eligible to benefit from a successful IVA if you’re 18+, owe more than £5,000 to more than two creditors.

Is there any possibility that Stirling Park will forget about me if I don’t respond?

No, Stirling Park keeps a solid note on all of their debtors. They will also retain records of your response time, the total debt before and after incremental charges, and so on.

As you prolong the delay, more money will be added to your debt than the initial debt you owed them.

What are unsecured debts?

If you have loans that are not backed up by any asset of value, then the debt you have on that loan will be called unsecured debt. If you don’t pay an unsecured debt, your lender can exercise their authority to sue you for the delay instead of seizing your assets.

What exactly is earnings arrestment?

This is a way for Stirling Park to gain control of your money directly through your place of employment. They can contact your employer and propose to take money from your wages. They have the authority to do this if you go missing on them for a long time without any contact.

At the end of the month, with earnings arrestment, they will take a necessary cut from your wages and leave you with just enough money to pay for essentials like bills, fares, etc.

What is a bank arrestment?

You have bank arrestment when you cannot get access to your own bank account.

This can happen if your creditor grows impatient with your repayment delays. If the creditor follows some legal arrestment procedures correctly, they can freeze your bank account and lock you out of it.
