Most people intuitively know that medical evaluation is important after a worker’s comp injury.

But that’s not where it ends…

You should know a little more than that if you’ve been injured on the job.

So what do you need to know about medical evaluation for your worker’s compensation injury? Here are a few quick tips. 

Timely Medical Evaluation

A timely medical evaluation is important.

But, what is CRUCIAL is getting the RIGHT doctor.

If you end up with an insurance company doctor, you are going to have lots of problems.

This is why your choice of a doctor is absolutely crucial!

You only get ONE choice for a doctor.

Once you make that choice, it is over and you are stuck with the doctor.

So, how do you make the choice?

You make it by signing something.

Usually, your employer will put something in front of you and say something such as, “Sign this to get your medical treatment.”

You sign it and you’ve chosen and insurance company doctor.

This is similar to taking a shotgun and blowing your own foot off.

Don’t do it.

Even if you don’t want to hire me, I’ll still tell you who the fair doctors are, just call me BEFORE you sign something choosing a doctor.

Impartial Medical Review

Now here’s the important part:

Quick medical review doesn’t mean they just run to the first doctor!

Specifically, it doesn’t mean that you should take a doctor recommendation from an insurance company.

You might not think about it right away, but someone might have a conflict of interest in sending you to one doctor or the other.

You have to get a doctor who is not bought and paid for by the insurance companies

Know the Context

It’s also important to know the context of the injury.

Companies like to wriggle out of worker’s comp claims by contending that the injury didn’t happen at work.

They like to look at issues like whether the work injury was something that happened on-site. 

But, when you know the context and how these claims are usually handled, you can respond to these concerns more easily, and more capably.

Now, let’s talk about the four big questions you must know in worker’s comp cases.

Where Did It Happen? 

Did the injury happen at work? In other words, were you on your employer’s property when you got hurt?

Did the injury happen when you were doing your job?

Believe it or not, this can get complicated.

Frankly, when you have lawyers involved, anything can get complicated. 

How Did It Happen? 

This can become important when a doctor determines what body parts you hurt in the injury.

You already know your doctor is not listening to you. As a result, your medical records are probably wrong.

This can become a serious problem if it is not taken care of right away.

Who Saw It? 

First of all, it’s important to make it clear who the injury happened to. That’s just a given. But it’s also important to know who saw you get hurt.

The first line of defense for the insurance company is they are going to say you didn’t get hurt at work.

It doesn’t matter if you had 5 people see it. They will STILL say you didn’t get hurt at work.

Is that nuts?

Yes. But, it is how they operate.

Have you been in a car wreck? If so, your focus should be on recovering from your injuries and getting the needed repairs to your car to get back on the road. 

For most people moving forward is a top priority. 

However, at some point, you may receive a call from the at-fault party’s insurance company. Do you know what to do when an insurance adjuster calls (or comes knocking)? If not, you may inadvertently say the wrong thing and ruin your ability to recover compensation for your injuries and damages. 

Keep reading to learn more about how you should handle a conversation with the other party’s insurance company.

You probably know this already but you don’t have to talk to an insurance adjuster from the at-fault party’s insurance company.

But, you need your car fixed.

So, how do you do that?

Just communicate by email.

Take your car to your mechanic and get an estimate.

Take a picture of the estimate and email it to the insurance company.

Do NOT let the insurance company tell you that you have to get your car fixed at their shop.

This is NOT true.

Insurance Adjusters Aren’t on Your Side

It’s important to remember that insurance companies are for-profit businesses.

They are like bookies. . .whether you win or lose, they always win.

There is no time in History when insurance companies have not made incredible profits.

Don’t let them fool you.

And don’t fall for their “tricks,” insurance adjusters are trained to get information from you to protect the company’s bottom line. 

Don’t Agree to a Written or Recorded Statement 

Remember, insurance adjusters aren’t going to come to you in full force. Instead, they may be chatty and convince you they are just looking for details about what happened and what led to the wreck. A common method the adjuster will use to do this is asking to record the conversation you are having. 

Don’t agree with this. 

Giving a recorded statement will likely damage your case. The recorded statement they get will be used to undermine your accident claim. Once they get a recorded statement, the adjuster will examine it against the statement you gave to the police when the accident happened. If there are any inconsistencies (which there may be), the adjuster will use this to say you have “changed your story” or use it in another way to reduce the compensation you receive. 

If you aren’t sure what to do in this situation, it is always best to say nothing or refer the insurance adjuster to your attorney.

What are the costs Covered By Workers’ Compensation?

So what are the costs covered by workers’ compensation insurance?

Getting up and going to work daily is something you do every day.

You work your butt off to pay the bills.

You work your butt off to pay for things your family needs.

But, when you get hurt at work, the insurance company tries to jack you around.

Getting hurt at work is very common.

On average, an American worker is injured on the job every seven seconds.

Filing an accident report with your employer should be your top concern after being injured on the job.
The workers’ compensation policy your employer has SHOULD pay for a number of things while you recover
from your injuries. BUT, most insurance companies will jack you around instead of doing the right thing.

Here are some things you need to know about the costs covered by workers’
compensation insurance.

Costs Covered By Workers’ Compensation Insurance – Covers Your Medical Bills

When you get hurt at work, you can have very serious injuries. These injuries will
have to be treated by FAIR medical professionals. CAUTION!!!! DO NOT just go to the doctor the insurance company tells you to go to!!!

You must get a fair doctor!!!

Of course, the cost of receiving medical care is extremely high in the United States.

If your employer has workers’ compensation insurance, the medical bills you get as a result of your work injury SHOULD be covered.

You MUST make sure when you fill out any forms at the doctor’s office that you write on the form: THIS WAS A WORKERS’ COMPENSATION INJURY.

If you know who the insurance company is, write down the name of the insurance company.

If you know what the claim number is, write down the claim number also.

Of course, if you have any contact information for the insurance company, write that down also.

AGAIN, YOU MUST WRITE DOWN ON ANY FORM THIS WAS A WORKERS’ COMPENSATION INJURY!!!!

I cannot tell you how many times I’ve seen people fail to write this down.

If you fail to do this, it WILL blow up on you later.

It’s like taking a shotgun and blowing your own foot off so make sure you do it.

Costs Covered By Worker’s Compensation – Ongoing Care

If the workplace accident you were involved in causes serious injuries, you might have to get
ongoing treatment. This treatment will generally come in the form of physical therapy. Paying for this
ongoing treatment out of pocket can be extremely expensive.

Don’t let your insurance company jack you around – they MUST pay for this by law.

Luckily, workers’ compensation insurance policies are designed to cover the cost of this ongoing treatment.

BUT, will they pay for what you need? In my experience, most of the time, the answer is “No.”

Common conditions like back problems, traumatic brain injuries and exposure to harmful chemicals can
take a long time to treat. If you are getting push-back from your employer regarding payment for your
ongoing care, then you MIGHT need a lawyer.

I say “MIGHT” because you MIGHT not need a lawyer.

How To Get Your Kid A 30 On The ACT For A Full Academic Scholarship | Tough Times

I know it is hard right now.

You are stressed.

Stressed from this stupid virus.

Stressed from work or lack of work.

Stressed from trying to teach your kid school right now.

I know it’s tough.

I’ve got 5 kids – can you tell I’m Catholic? 🙂

So with that many kids I have to stay organized.

But, be tough on your kids.

Don’t let them whine their way out of getting a 30 on the ACT.

How about if your kid has NO WAY TO PAY for college???

That’s stress.

Listen, tough times require tough actions.

Your kids HAVE MORE TIME RIGHT NOW THAN THEY WILL EVER HAVE due to this stupid virus!

PLEASE, I’m begging you, do NOT let them waste it by playing video games and watching tv!!!

How To Get Your Kid A 30 On The ACT | FREE Chromebook

This is part two of an on-going series of blog posts about how to get your kid a 30 on the ACT.

You see if your kid gets a 30 on the ACT, your kid will go to college in Mississippi for FREE!!

I have already got two kids making a 34 on the ACT and I want to teach you how I did it.

This is what I suggest you do next.

First, I know computers can be a challenge but I’m hoping your school has given your kid a chromebook.

If not, here is on website you can go to so you can get a free one: https://theonitfoundation.org/

After you get that laptop, if you get a Windows laptop, it will probably be incredibly slow.

So, I recommend converting it to a Chromebook for free.  Click on converting to a Chromebook for free to do this.

You’ll want to convert to a chromebook for several reasons but primarily, the issue is speed.  I find that Windows laptops slow down so much it will drive you and your kid crazy if you fail to convert it.

Also, most of the schools are using Google classroom anyway so a chromebook works nicely for this.

How To Get Your Kid A 30 On The ACT For A Full Academic Scholarship | Part Two – Typing

So, this part of the blog deals with typing.

Typing!!!???!!!

You must be crazy Jay, why in the world would my kid need to learn to type????

Are you stupid or something Jay???!!!??  Give me a break!!!???

Allow me to explain.

First, your kid is going to need to learn how to type anyway.

Why?

Your kid will have to do research papers either in high school or college.

Who the heck is going to type a paper for your kid if they can’t type?

How the heck is your kid going to get done with their paper in time if they can’t type?

Why WASTE so much time right now with your kid hunting and pecking instead of typing 65-70 words per minute?

The TIME is what you and your kid can NEVER get back.

Time is the ONE thing we can never get back.  It is THE MOST VALUABLE commodity in the world!!

So why waste it hunting and pecking on a keyboard as if you are some idiot?

You might think, well, Jay you are stupid, why don’t I just use one of the speaking software things to just do the typing for me?

Why you ask?

I’ll tell you why: those supposed “naturally speaking” software programs do not work very well.  They stink.  Your kid can type it and edit it much faster if they just learn to type.

This isn’t hard to learn.

Please click on typing.com and sign your kid up for an account.

It is FREE!

Now, why else do I want your kid to sign up for typing?

A LOT of classwork and homework is done on the computer.

Typing will increase the speed this gets done.

Remember, TIME is the one commodity that we can’t get back.

Your kid has limited time to study for the ACT so we need to maximize that time by eliminating time-wasters.

Heck, both of the software programs that I recommended to you in my first blog on how to get your kid a 30 on the ACT REQUIRE typing.

Just have your kid spend 15 minutes a day learning how to type.

Start them early!!!

I started my 5 year old on this and you can do it also!!

Don’t take “no” for an answer.

Your job as a parent is to make your kid better than you.

Don’t let your kid be another education statistical failure in Mississippi.

I see sometimes that people in Mississippi make fun of others with advanced educations.

This has to be THE STUPIDEST thing I have ever heard.

Why in the heck would you set that example for your children???

Why???

Why would you not praise the people with advanced degrees and hammer it into your kids head every day about how important education is???

There is simply no reason at all to do this and I don’t get it at all.

We seem to pass down from generation to generation that it is okay to be stupid.

IT IS NOT OKAY!

Why can’t your kid be a lawyer????

Why can’t your kid be a doctor????

Why can’t your kid be a rocket scientist????

There is ABSOLUTELY NO REASON your kid can’t do that or any other challenging academic profession!!!

As I said, I know times are tough.  I know it sucks right now but don’t let your kid waste the time.

You can do it!!!

How I Got Not One But Two Kids Making At Least A 34 on the ACT

Your kid is at home now, PLEASE do NOT let them waste time like I see most kids in my neighborhood doing!

They have PLENTY of time to do what needs to be done to go to college for free.

I got a lot of questions from my newsletter about HOW I was able to get not just one, but now two kids making at least a 34 on the ACT.

But, if you can get your kid to a 30 on the ACT, you will send your kid to any Mississippi College for FREE!

First, let me explain.  As my Momma used to say to me, “I’m not your friend, I’m your Momma.”

This is exactly what I say to my kids.  I’m not their friend.  I’m their Daddy.

This means I have certain expectations of my kids.

I tell my kids, “You can either meet those expectations or suffer the consequences.  The choice is yours.”

This is really how I view my law practice.  People can either abide by the law or suffer the consequences.  The choice is yours.  You can abide by the driving laws or not.  However, be aware if you choose to break those laws, then there are consequences for your actions.  The choice is yours.

But, I digress.

Back to our story.

ACT Score of 30 Gets A Full Academic Scholarship

Now, on to my son.

I am so proud of my son for getting admitted to medical school!  He was admitted to medical school BEFORE he graduated high school!!!

Now, that is the hard work I have tried to teach my kids.

My oldest is leading by example and this sets a fantastic goal for the rest of my kids to try and achieve.

Someone asked me the other day how he did it.

So what’s the secret to getting at least a 30 on the ACT????

I will tell you: he grinded.

He didn’t get this because of some supposed natural talent.

There is NO such thing as talent and anyone who tells you otherwise hasn’t read the books and the studies that disprove it.

You see, while some kids were out all summer, every summer going to the river, playing video games or watching stupid tv, he was GRINDING.

Use IXL.com For Your Kid

He was grinding on an online software program called www.IXL.com and if your kids is not on it, please get them on it RIGHT NOW.

The great thing about IXL is it sends you an email and let’s you know if your kid is really doing the program or playing around.

IXL will also let you know where your kid is having trouble.

The message I’m trying to give you is don’t rely on the schools to educate your kid.

I always tell my kids that my job on Earth is to make them more successful than me.

I want them to pass that along to their kids.

One of the ways I do that is by educating myself on how to best prepare my kids for college and for life.

So now, my oldest has a full scholarship to go to college, plus he gets paid $2,000.00 to go to college!!!

On top of that, the college gives him another $2,000.00 to go study abroad!!! He was one of three students to get accepted to medical school!!!

By the way, a friend asked me if there was an a free alternative to IXL.

There is.

Try it if you can’t afford IXL.

By the way, where does Mississippi Rank?

Almost DEAD LAST in ACT scores.  Our average in 2018 was an 18.6
