Going Paperless - Electronic Signatures- DocuSign and EchoSign

Going Paperless, using electronic signatures with DocuSign and EchoSign - As a Real Estate agent in Decatur GA, it seems that we have more and more documents that need to be signed. By the time a transaction closes, we can easily have 100 pages or more printed and faxed back and forth, from listing agreements to disclosures to purchase and sale agreements to counter offers and amendments. Managing the paper can be a lot to handle and a lot to store. I decided that there had to be a better way and there is.

I checked out 2 different electronic signature companies, DocuSign and EchoSign. I have now tried them both. Here's my comparison of the 2.

Docusign

Limit of 40 envelopes per month. An envelope is the same as an email basically.
No fax option as of yet, that option is said to be coming 9/18/09.
Easy to use and for clients to use

Echosign

Option for people to print, sign and then fax it back to keep it in the online folder on Echosign
Easy to use and for clients to use
Cost $14.95 a month for unlimited signatures
No limit on the amount of emails or envelopes

Free account that limits you to 5 free documents a month.

I first tried EchoSign with my client who lives in Washington DC. I manage his property in Tucker, GA. The tenants called and said they wanted to extend their lease. I contacted my client in DC. I sent an extension via email through EchoSign to the tenants, they signed off electronically and it was forwarded to my Client in Washington, DC, he signed off on it and it was automatically forwarded to me. I clicked sign and then a fully executed signed agreement was sent to all the parties involved. It took a total of 30.5 minutes. EchoSign keeps track of the time for you. That was pretty amazing. I didn't have to drive anywhere to get it signed or wait for a fax to come in or keep sending anything to multiple parties.

The next day I tried DocuSign with a Buyer Client. The whole transaction has been done paperless except for the Buyers Broker Agreement that I brought with me when we went to look at the house. My client didn't need to have a scanner or a printer or a fax. All she needed was internet access. It has saved a tremendous amount of time and paper. The contracts are clear and not fuzzy from being faxed back and forth. You put the "signature" boxes where they need to go on the document by dragging and dropping it in place. Your client sees the "sign here" yellow tabs and that's where they know to click.

Last night I sent off a 14 page offer through DocuSign to another Buyer client. He commented that even his mom thought it was cool. Just think if I had to print that document, send it to my client for him to print, then he signs it and faxes it back to me that's already 42 pages! By the time I send it to the listing agent it used up 56 pieces of paper. They send to their client, add 14, their client sends it back add 14 and then the listing agent sends back to me there we are at 84 pages and we have hardly started! Whew! Tired yet??? With an electronic signature, there is nothing to print and everyone gets a clean copy.

I have been using the electronic signatures for about 2 weeks now on 6 different transactions. My clients love that it's easy to use. (They knew they were my guinea pigs in my test. ) I haven't been able to use it on my short sales yet because the banks I'm dealing with aren't taking documents via email. That's a story for another post. The other great part about an electronic signature company is that you can access your documents from anywhere you have computer access. Using an electronic signature makes it easy for home sellers, home buyers and real estate agents. It's a beautiful thing!

Appealing Property Tax in Dekalb County GA

Appealing property tax in Dekalb County GA - This week I've been busy contacting all of my clients that bought a home with me in 2009. The purpose of my call is to make sure everyone has filed for their homestead exemptions. The deadline is March 1. It only needs to be done once and then it stays in force until the status changes.

A full 50% of the homes I sold in 2009 were foreclosures. My clients got great deals. What does that mean as far as their property taxes go? It means that they could be seriously overpaying!

One of my client's homes is assessed by Dekalb County at more than 30% over what she paid for it. So she was asking me how she can get that re-assessed. I pulled some info together and sent it to her.

Here's the same information for people who want to appeal their property tax bill. The following is from the Dekalb County Tax Assessor's office:

"How do I appeal?
If you wish to appeal the value of your property, you may file a tax return with the Property Appraisal Department between January 2nd and March 1st, at which time you may declare what you consider to be the fair market value of the property. This will generate a review of the value by the Property Appraisal Department; a notice of assessment change will be sent to you in late March or early April if the Board disagrees with your value. You will then have thirty (30) days to file an appeal if you continue to disagree with the assessment as set by the Property Appraisal Department. "

Real Estate Agents Fined for Code Enforcement Violations on Listings

This should be the outrage of the day - The City of Atlanta, GA has decided that Real Estate Agents should be fined for not maintaining properties if they cannot locate the Owner. That is ridiculous. As Real Estate Agents, we are marketing the property, not the owners or operators of it. Thankfully, the Georgia Association of Realtors is backing their members. They advise Realtors to not pay any fines or penalties for code enforcement violations, as this could be setting a dangerous legal precedent for the real estate industry.

Down Payment Assistance Still Available in Dekalb County, GA

Down Payment Assistance is available for 1^st Time Home Buyers in Dekalb County. Applications are being accepted for the DeKalb County First-Time Homebuyer Program, funded by the DeKalb County Community Development Department and administered by the Housing Authority of DeKalb County.

Here's how it works: All eligible applicants will receive $5,000 towards their down payment, closing costs, or other prepaid expenses. Those who successfully improve their FICO credit scores to 620 or higher may receive up to $8,000.

What are the maximum annual income limits?

Household of 1----$39,850

Household of 2----$45,550

Household of 3----$51,250

Household of 4----$56,950

Household of 5----$61,500

Household of 6----$66,050

Household of 7--- $70,650

Household of 8+- $75,200

What is the maximum purchase price? The purchase price of the home cannot exceed $160,000.

Who is eligible? First-time homebuyers that have not owned a home during the last 3 years are eligible. Displaced homemakers and single parents may also qualify. Successful applicants must meet maximum income guidelines, be creditworthy, participate in home ownership pre-purchase counseling, and plan to purchase a single-family home anywhere in DeKalb County, outside the city limits of Atlanta. Homes must be up to all DeKalb County codes at the time of purchase.

What is the first step to apply? Applicants must first attend a workshop with one of the approved counseling agencies listed below.

How will my credit history affect eligibility?Applicants must be credit-worthy as determined by one of the program's participating lenders. Judgments, garnishments, bankruptcy, collections or too many bills may affect your ability to qualify for a loan.

Is any other assistance available? Qualified buyers may be eligible for $5,000-$20,000 in additional funds through the Georgia Dream Homeownership program, under the Georgia Department of Community Affairs.

Housing counseling with an approved agency is the 1^st step to enter this program. If you already have a contract on a house at the time of application, please be aware that your closing date must be at least 45 days away in order to complete processing. Because of the many HUD rules and regulations, this program may not be for you if you have already signed a contract on a home.

How much cash must buyers contribute? Buyers must contribute 1% of the total purchase price. So if you are buying the maximum purchase allowed of $160,000, you will need to contribute $1,600.

A certificate of completion can be obtained by attending classes and individualized counseling that will prepare you to make an informed choice when you purchase your home.Topics covered in the classes include:

How to get a mortgage
Money for down payment
Planning for homeownership responsibilities
Evaluating your ability to afford a home
Types of financing available
Budgeting and credit
Understanding your FICO score
Avoiding foreclosure

Following class completion, you will also be required to sit down with a certified housing counselor who will go over your own personal situation and advise you on the best way to proceed to become a new homeowner in a way that works out best for you. Class times and locations will vary by the counseling agency, so call now to enroll in a class that fits your schedule.

Bank of America Short Sales

Bank of America Short Sales - I received some great news from Bank of America and their short sale department the other day. As many of us real estate agents know, short sales can be a tedious task. In the past when doing a short sale with Bank of America and the buyer walked away, we had to start the process all over again, dragging out the time line and causing us to do a lot of repetitive and time consuming work. It wasn't any fun.

Bank of America has heard our complaints and they seem to be listening. Now when we are working a short sale, we have a buyer and the house is under contract, if that buyer walks away, we can now simply replace the buyer with our backup offer. By the way, a true backup offer has the 1 form in place that says if the current named buyer's contract falls apart, their contract becomes primary. If your buyer's agent isn't doing this, ask for it. It makes it more solid than simply telling the listing agent, "Hey, if that offer doesn't work out, please keep us mind!" Remember if your offer is a backup offer, make it a real one by submitting the proper documentation.

We are seeing a lot of short sales in our Cobb and Dekalb County real estate markets. As a buyer, if you are patient, you can get a great deal. As a seller, if you want to avoid a foreclosure on your credit report and are willing to fully cooperate with the people that are trying to help you, it can also be a good thing.

In case you are wondering what a short sale is, that's when the bank agrees to take less than is owed on the property. The owner is the person that bought the home. They are the seller, not the bank. The owner is the one that signs that purchase and sale agreement, not the bank. The bank just signs the approval letter after reviewing the bottom line by getting a preliminary HUD-1 or settlement statement. That way they know what they will get at closing. A short sale seller does not and cannot get any proceeds from the sale of the home. The only way that can happen is if they go through the HAFA program because they have an FHA loan and then they could get up to a few thousand dollars for moving expenses on owner occupied homes.

There is so much to know about short sales, so I'll add a few things in:

1. If the seller doesn't sign the contract you are not under contract.

2. The bank is going to require that the seller sign the contract (purchase and sale agreement) to even consider the terms.

3. The contract should always have the short sale special stipulations in it or the Short Sale Addendum attached. Basically, it says that if the bank doesn't accept the terms, the seller doesn't have to sell.

Keller Williams Realty Day of Volunteering - Keller Williams Realty gives back to the community, nationwide. Keller Williams Realty sets aside May 12th every year for Red Day. Red Day is a day of volunteering where each office across the country does projects to give back. We call it giving where we live. Last year my office Keller Williams Realty Atlanta Partners, Sugarloaf Market Center with about 200 agents collected over 10,000 cans of food and non-perishable items for a local food bank. This year we have decided to do more for more groups that need our help. Each office chooses their own projects. Volunteering is not just for the real estate agents, we're inviting the community to come join us. Lullwater Park is a gated community in Atlanta GA built in 2008. Homes currently listed range in price from $479,900 to $749,900. The 4 sided brick homes are beautiful with hardwood floors and elegant trim work. All have 2 car garages. Lullwater Park in Atlanta, GA is conveniently located in town between Virginia Highlands and Druid Hills. HOA dues are $250 a month and cover exterior maintenance and water/sewer.

I visited Lullwater Park the other day. Come along with me as I describe this home currently listed at $749,900. As you enter the home you go up a few steps to the kitchen level. There's a formal dining room with rear balcony and a powder room. The gourmet kitchen with granite counters and Viking appliances separates the dining room from the family room with coffered ceiling and fireplace.

Go upstairs one level to the huge Master suite with sitting room and spa like bathroom. The huge walk in closet should be roomy enough for everything. The laundry is on this level as well as another bedroom with its own private full bath.

Go on up the hardwood stairs to the next level and you'll find another room with full bath that could be used as a bedroom or a media room. The other half of the upstairs has a wet bar and a room that would be ideal for a pool table or additional entertaining area. Off of this room is a fabulous rooftop terrace with ceiling fans and stone tiled floor. I think this would be the place I would always want to be.

The lower level has a 2 car garage and another room with full bath that could be used as an office, bedroom or fitness room. This home at Lullwater Park has 4 levels of fabulous space with an elevator.

To get to Lullwater Park, from I-75 North take Exit 248-C, Freedom Parkway to right on Ponce de Leon Ave going East. Turn left at Briarcliff Rd across from Moreland Ave. Follow Briarcliff Rd and the residences at Lullwater Park will be on the right about 1/3 of a mile. The address is 855 Briarcliff Rd NE, Atlanta, GA 30306.

Not to confuse anyone: There is another townhome community in the area called Lullwater Parc with "c" instead of a "k". Those brick townhomes were built around 1970 and range in price from around $220,000 to $280,000. They are located on Ponce de Leon Ave in Atlanta, GA.
