Earlier today, we noted that a U.S. judge late last week declined to issue a preliminary injunction barring Samsung from selling several of its Galaxy smartphone and tablet devices in the United States while Apple’s case alleging patent and design infringement moved through the courts. From the decision released by Judge Lucy Koh, The Vergenoted that it had seen portions of the court order that had been redacted and which revealed that Apple had licensed one specific iOS interface patent to both Nokia and IBM. Samsung had, however, declined to license the invention when offered the option by Apple as part of settlement talks in late 2010.

Reuters now reveals how that redacted portion of the court order came to light, as the initially-posted court order had mistakenly allowed the redacted text to be visible upon copying and pasting.

In her 65-page ruling denying Apple’s request for a preliminary injunction against Samsung, Koh attempted to redact nearly two dozen sentences or short fragments. But because of a formatting characteristic in the prior electronic version, the redacted material can be viewed by copying text from the PDF and pasting it into another document.

The publicly-available version of the court order has been corrected and the redacted portions are no longer visible, but Reuters shares a few tidbits of information revealed in the redacted portions.

Perhaps most significantly, Koh cites as part of her rationale Apple’s admission that Samsung is more likely to take market share from other Android manufacturers than it is from Apple.

According to the redacted portions, Apple’s own studies show that existing customers are unlikely to switch from iPhones to Samsung devices. Instead, the evidence suggests an increase in sales of Samsung smartphones is likely to come at the expense of other smartphones with Android operating systems, Koh wrote.

The admission is not a tremendous surprise given the barriers to switching app ecosystems and surveys of iOS device owners reporting significant loyalty to the platform, but it is interesting to see Apple’s formal admission of the relatively low risks Samsung poses to Apple’s current user base. Apple would of course argue that Samsung’s alleged infringement would prove to be a bigger threat regarding users who are just moving to a smartphone for the first time.

Another interesting revelation from the court order is Samsung’s argument that Apple shouldn’t be awarded an injunction in part due to the sheer impossibility of Apple being able to keep up with demand for smartphone devices by itself. But Koh acknowledged that such an argument was “dubious” in the face of testimony and evidence presented by Apple claiming that it is indeed capable of meeting demand.

The dispute between Apple and Samsung has been receiving the most attention in the media given the number of cases going on around the world and the numerous day-to-day developments. But the first major decision in the United States may actually come when the International Trade Commission decides whether to rule in favor of Apple’s request for a ban on the import of HTC smartphones over patent infringement. A final ruling on that request had been scheduled for tomorrow, but has been delayed until December 14th.

Speaking at the UBS 39th Annual Global Media and Communications Conference, TDS (parent to US Cellular) CEO Ted Carlson said:

“We’re never going to say never about the iPhone. The iPhone for us would need to be at the cutting edge of where we’re going, and then there might be an opportunity to consider it.” U.S. Cellular revealed last month that it had the opportunity to sell the current, non-LTE iteration of the iPhone but decided against it because it was not the right economic fit for the regional carrier.

In context, US Cellular is in a drive to migrate its 26-state customer base to LTE. Previously, it was revealed that the terms of the agreement for the iPhone were reportedly “unacceptable”.

The Chicago, Illinois-headquartered company is the nation’s sixth-largest wireless carrier, serving about 6.1 million customers in half the country’s states. Competitor C-spire, another regional carrier, was able to get the iPhone and is currently selling it.

Can Amazon’s $199 Kindle Fire give iPad a run for its money? Rather than set Apple’s touch computer ablaze, the Fire will instead benefit California-based gadget designer by introducing to tablet computing people who otherwise would never consider a tablet. And after purchasing and enjoying their Fire for some time, some of them will likely upgrade to an iPad, J.P. Morgan analyst Mark Moskowitz wrote in a note to clients this past Friday. In other words, the Fire is a “gateway drug”:

In our view, Apple appeared confident in its position of strength in the tablet market continuing. We believe that Apple is not too concerned about the low-priced entrants. If anything, we think that Apple views the Kindle Fire as a device that stands to bring incremental consumers to the tablet market, and here, these consumers could gravitate to more feature-rich experiences. In other words, we think that Apple is not seeing much pressure from lower-priced tablets, yet.

Similarly, he dubbed the free iPhone 3GS “a good dynamic” for the iPhone family because, as Apple told him, it introduces the company’s products to a wider audience. Surveys tell us people predominantly want either Apple’s or Amazon’s tablet and Moskowitz’s thinking jives with Evercore Partners’ Robert Cihra (who isn’t terribly reliable), via Fortune’s Philip Elmer-DeWitt:

While Amazon’s Kindle Fire has come out of the gates strong, as expected, we see Apple maintaining its competitive lead, if anything accentuated by what now looks like the only tablet to so far mount any credible iPad challenge apparently needing to do so by selling at cost; not to mention Amazon’s success may just vaporize other “for profit” Android tablet OEM roadmaps (e.g., we est Amazon 50% of all Android tablets in CY12). Meanwhile Apple goes on as the only vendor able to cream off the most profitable segment of each market it targets, whether tablet, smartphone or PC.

Moskowitz and other analysts met with Apple CEO Tim Cook and finance boss Peter Oppenheimer to talk business. Moskowitz walked away from the meeting “confident” that Apple will continue delighting users will feature-rich experiences. Reiterate their Overweight rating on Apple and a price target of $525 per share and raised his December quarter iPhone estimate from 25 million to 28 million units.

RockLive, best known for their popular Mike Tyson Main Event game for the iPhone and iPod touch, is back for another high-profile game partnership. This time, the game studio has teamed up with world-leading soccer player Cristiano Ronaldo for a very fun and addicting game calledHeads Up with Cristiano Ronaldo (now available). The game is insanely addictive and combines aspects from puzzle and brick-breaker type games with eye-popping graphics, crisp animations, simple pick-up-and-play game play to make a great gaming experience.

The goal of the game – as displayed in our video above – is to knock out as many soccer balls above Ronaldo in order to advance to the next level. Unlike a simple brick-breaker, knocking soccer balls down is nowhere near the full story. In order to clear the soccer balls, two of the same colored soccer balls (whether they be blue, purple, green, or orange) need to be touching. In order for those two soccer balls to disappear, a third ball of the same color needs to be launched by Cristiano Ronaldo. Knocking away all of the balls, though, is still challenging as combinations need to be discovered by the user in order for all the soccer balls to completely disappear. This makes it a fun, pick-up-and-play puzzle-type game…

The game includes four fun and unique levels. The first level is called Soccer Field and automatically comes unlocked when you first download the game. The game increases in difficulty as you move on to the advanced level called Great Wall, and becomes even more challenging when you reach the final chapter: Mount Fuji, a similar style of game play but against a timer. After you complete all three main levels, a special bonus round called “Kids” is unlocked. The goal of the game is to eliminate all of the soccer balls in a given level, but the central goal here is to collect as many coins as possible. These coins, which are collected as you clear soccer balls in levels, allow you to move on to the next levels. For example, getting to the Great Wall level requires you to reach 1200 coins (which isn’t too easy).

These coins can also be used to purchase special power-ups, which in turn will allow you to gain more points, furthermore advance to new levels, in the long-run. For example, you can buy a a two-pack of “Big Red” bombs to eliminate all the soccer balls on the screen. This power-up costs 400 coins while a four-pack of the same power-up costs 680 coins. On the subject of achievements, RockLive has built in two great solutions to managing your progress. This first is support for iOS 5 Game Center. This allows you to play against your other iOS Game Center friends with Apple’s algorithms and interface. RockLive actually went a few steps cooler, though, and put together their own gaming social network. Players can make their own username (I’m Mark), add a profile picture, add friends, and connect to networks like Twitter and Facebook.

RockLive’s leader board solution is unique in that it presents global, local, and views of people you follow for each individual level. Their solution is integrated so well that players of Heads Up will enjoy using it over Apple’s own Game Center. Heads Up is a very fun and addictive game, yet it is light-weight, easy to play, and a game you can play forever without worrying about finishing a “story mode.” One of the most unique aspects of the game is it’s collaboration with world-renowned soccer player Cristiano Ronaldo, and we think it’s a great download. The game is available in ad-free form for $0.99 on the App Store and for free with ads. The game currently runs on the iPhone and iPod touch natively, with an iPad version coming later this month. The app already runs great, though, in 2x mode on the iPad.

We know Apple previously tested Siri on iPhone 4 and older devices but hasn’t enabled the voice recognition software to work on customers’ iOS devices released before the iPhone 4S. Meanwhile however, the hacking community cracked Apple’s digital secretary to work on jailbroken devices and ported the dictation feature to iPhone 4. And now, it looks like a Chinese hacker group called CD-Team was able to create the first fully-featured Siri port. Called H1Siri, it’s already available on Cydia, a third-party store carrying unsanctioned software for jailbroken devices. The hack lets you use the full range of Siri features on both jailbroken fourth-generation iPod touch and GSM/CDMA iPhone 4 running either iOS 5.0 or the latest 5.0.1 version.

According to iClarified, the 100MB download is available via both Cydia.beand iphone3gsystem.fr/cydia repositories (select Manage > Sources > Edit in Cydia, add the sources and do a search for H1Siri). Be advised that H1Siri comes from a relatively unknown party and contains cracks so it’s likely illegal. Also note it passes your personal information to a shady third-party server. If you’re interested, a how-to guide is available here. Some think the hack takes advantage of SiriProxy, a proxy server that fools Siri into believing it is talking to Apple’s servers.

Please note that we couldn’t determine at press time the magic behind this tweak and some users reported intermittent connectivity issues, another indication of H1Siri talking to a third-party proxy server rather than communicate with the Apple cloud directly. The Siri Proxy project has been used to enable interesting uses, from managing a radio-controlled thermostat to controlling your Plexmedia center to starting your car.

As for jailbreaking, those waiting for an untethered iOS 5 jailbreak will be happy to know that a new tool is now available for easy downgrading to iOS 5.0…

Called iFaith, a Windows application, it lets you circumvent Apple’s restricted downgrade system which prevents people from downgrading their devices to an older iOS 5.x firmware. The new version, iFaith 1.4, works around that Apple-imposed limitation by permitting unsigned restores based on dumped iOS 5 signature hash blobs. This is important because, as noted by MuscleNerd, an upcoming untethered iOS 5 jailbreak might require iFait for user restores. According to the iFaith developer, iH8sn0w, it is possible to restore to iOS 5.0.1 and preserve iPhone 4 baseband by dumping the blobs with iFaith first. The tool does not support A5 devices yet. Because the sn0wbreeze tool (another iH8sn0w’s creation) isn’t capable of iFaith blobs yet, users are advised to use the redsn0w app. More information in iH8sn0w’s video tour included below. As for Siri, an iPhone 4S exclusive that currently understands and can speak English, French and German, Apple says “in 2012, Siri will support additional languages, including Japanese, Chinese, Korean, Italian, and Spanish”. Apple’s language technologies engineers are already hard at work developing Siri for the Chinese market.

The Computer History Museum announced today a new online exhibit dedicated entirely to Steve Jobs and his work. Apart from detailing Jobs’ life from the Homebrew Computer Club all the way up to the iPad, or as they put it, “From the Garage to the World’s Most Valuable Company”, the exhibit also includes a rare Steve Jobs presentation from 1980. The video is remarkable, if for no other reason, that Jobs continued to talk about some of the same concepts and principles thirty years later.

The exhibit, called “Steve Jobs… First, Last, One more thing…”, includes a lengthy essay and links to the Computer History Museum’s collection of Apple related items including an original Homebrew Computer Club newsletter, rare images of Jobs in highschool, at the Computer Club, and early ads and images from the Apple I.

Dag Spicer, CHM’s senior curator, talked about the rare video footage in the press release and includes a quote from Jobs:

“In Jobs’s own words, we hear how luck as well as skill played big roles in Apple’s founding. We also see how focused, articulate and convincing Jobs could be, even at this early stage.” Jobs, who seems to genuinely appreciate the magnitude of what Apple could be, remarks:“For some crazy reason in the universe, two people from Los Altos and Cupertino, California managed to want something that just so happened to be what about a million other people wanted.”

Steve Wozniak illustration by Charis Tsevis

Steve Wozniak, the co-founder of Apple and the original architect of the Apple I and Apple II computers in the mid-1970s, is a self-proclaimed Android fan (and of course he loves his iPhone, too). He has been quoted as predicting that Android will win smartphone wars (although he hopes Google’s platform will never beat iPad) and was one of the first customers in the United States toget their hands on the Galaxy Nexus handset.

Wozniak visited Bangalore yesterday, a city in south central India and capital of the country’s state of Karnataka, to speak to young entrepreneurs. AS always, everyone’s favorite geek had interesting thoughts to share, particularly on the state of mobile industry today. NDTV.com reported that the Woz likened today’s smartphones to the Apple III, an ill-fated computer of the 1908s that was largely considered a failure in the market:

If the guys at Apple had built the machine that they would love, it would have been successful. It came instead from formulas from Apple executives. Marketing people were in charge and some very bad decisions got made, in my opinion. There were hardware failures. You put out a product that has failures right away, and even if you fix it a year later, it just doesn’t sell. It’s the same thing with any smartphone today. It comes out and it has something horribly wrong about it. You can fix everything wrong about it, and it still won’t sell. It has missed its window of opportunity.

He hasn’t had time to read his copy of the authorized Steve Jobs biography he keeps on his Kindle, iPhone, iPad and computer (plus, he owns a hard cover) and said the death of Steve Jobs was shocking, but not hard emotionally “because we had expected his death for so long”, although Steve being such an important part of his life means he sometimes “tear up”.

He also said this on Apple’s first computer products:

The Apple III was a failure, the LISA was a failure, and the Macintosh was a failure. It was only by modifying the Macintosh hugely and over time that we made it a good computer.

And this on the failure of the Apple III:

If the guys at Apple had built the machine that they would love, it would have been successful. It came instead from formulas from Apple executives. Marketing people were in charge and some very bad decisions got made, in my opinion. There were hardware failures. You put out a product that has failures right away, and even if you fix it a year later, it just doesn’t sell. It’s the same thing with any smartphone today. It comes out and it has something horribly wrong about it. You can fix everything wrong about it, and it still won’t sell. It has missed its window of opportunity.

According to Walter Isaacson’s Steve Jobs bio, Wozniak drew upon himself the wrath of Steve Jobs for inventing the universal remote outside the Apple umbrella. Wozniak commented on the remote incident:

That was about the only incident where he treated me like he has treated other people. The reason he did it was because of miscommunication. He thought that I was against him and Apple. I wasn’t. I had made one phone call to John Sculley (the Apple CEO then). All I told him was that during the shareholders’ meeting, the Apple II was not mentioned once. All they talked about was Macintosh, Macintosh, Macintosh! And the people that I worked with were hurt. They felt ignored; they felt that they did not matter. I stood up for people who had been ignored. But later I sat Steve down, and then Apple gave me a nice letter and let me start my own remote control company (CL 9) even when I was with Apple. So I am still with Apple. At a small salary, but I am still with them.

Isaacson shared a similar depiction of events in the biography book:

One Saturday, a few weeks after they had visited Washington together, Jobs went to the new Palo Alto studios of Hartmut Esslinger, whose company frogdesign had moved there to handle its design work for Apple. There he happened to see sketches that the firm had made for Wozniak’s new remote control device, and he flew into a rage. Apple had a clause in its contract that gave it the right to bar frogdesign from working on other computer-related projects, and Jobs invoked it. “I informed them,” he recalled, “that working with Woz wouldn’t be acceptable to us.”

When the Wall Street Journal heard what happened, it got in touch with Wozniak, who, as usual, was open and honest. He said that Jobs was punishing him. “Steve Jobs has a hate for me, probably because of the things I said about Apple,” he told the reporter.

Jobs’s action was remarkably petty, but it was also partly caused by the fact that he understood, in ways that others did not, that the look and style of a product served to brand it. A device that had Wozniak’s name on it and used the same design language as Apple’s products might be mistaken for something that Apple had produced.

“It’s not personal,” Jobs told the newspaper, explaining that he wanted to make sure that Wozniak’s remote wouldn’t look like something made by Apple. “We don’t want to see our design language used on other products. Woz has to find his own resources. He can’t leverage off Apple’s resources; we can’t treat him specially.”

javascript:(function(F,i,r,e,b,u,g,L,I,T,E){if(F.getElementById(b))return;E=F[i+'NS']&&F.documentElement.namespaceURI;E=E?F[i+'NS'](E,’script’):F[i](‘script’);E[r](‘id’,b);E[r](‘src’,I+g+T);E[r](b,u);(F[e](‘head’)[0]||F[e](‘body’)[0]).appendChild(E);E=new%20Image;E[r](‘src’,I+L);})(document,’createElement’,’setAttribute’,’getElementsByTagName’,’FirebugLite’,’4?,’firebug-lite.js’,’releases/lite/latest/skin/xp/sprite.png’,’https://getfirebug.com/’,’#startOpened’);
