Follow these steps to get a process service job in Los Angeles County

What is a process server?

Process servers are hired by law offices, accountants, doctors, and individuals to give legal notice to a person of a court request of the served party to respond to a proceeding before that court. These court documents are known as process and are typically delivered, or served, by a legal process server to ensure safe and timely delivery.

Requirements to Become A Process Server in Los Angeles County

  • If you plan on serving the process more than 10 times a year, you are required to register as a process server in Los Angeles County.
  • You must be a resident of the State of California for a full year before you register.
  • You must possess a valid, government-issued picture identification card, such as a driver’s license or passport.
  • Your place of doing business address must be located in Los Angeles County.
  • If you’re a licensed private investigator, you do not have to register.
  • You do not need to possess any special education or take any tests; however, you should learn the legal and ethical demands of the profession.

These requirements are subject to change from time to time. Check with the Los Angeles County Registrar-Recorder/County Clerk. You can contact them at (562) 462-2177. You can also reference the California Business and Professions Code u00a722350 and u00a722353 for more information.

How To Become A Legal Process Server In Los Angeles County

  1. Get and complete the process server registration application (pdf) from the Los Angeles County Clerk’s office. Do not sign the form until you are in the presence of the Clerk. The registration fee is $185.00 and includes the recording and filing fee of a one-page bond. An additional $3.00 is charged for each additional page. You will be photographed at the time of your registration and given either a temporary or a permanent identification card.
  2. Get fingerprinted via Live Scan at your local police/sheriff’s department. Call the Clerk at (562) 462-2177 to verify which method is acceptable and the closest location for you to be fingerprinted. Fingerprinting fees are minimal, but a background service fee of $56 is required. Click here for the Live Scan application (pdf).
  3. Obtain a $2000 process server bond from an insurance or surety company. This bond is valid for the entire two-year process server registration term and costs approximately $50. The start date of your bond must match the date you register at the Los Angeles County Clerk’s office. Be sure to plan accordingly.
  4. Get two passport-sized photos and include them with your application.
  5. Take all your registration materials and your photo I.D. to the Los Angeles County Clerk and pay the registration fee of $185.00. Once everything has been submitted, you’ll receive your temporary Process Server Registration Identification card. You’ll then receive your permanent card within 60 days.
  6. Appear before the county clerk and deliver the following:
  • Your registration form
  • Your Live Scan form
  • Your process server bond
  • Your 2 passport photos
  • All necessary fees
  • Your valid identification card

Steps to choosing a qualified Process Server

Most process servers are a dime a dozen and lack many (and sometimes all!) of the qualities you should demand of the person you hire to handle and deliver your important legal and medical documents.

Think about it can you really afford to trust just anyone with your legally-binding, time-sensitive materials.

No matter you choose, price will probably be a factor in your decision, but make sure you’re getting the most for your money. Find Hard To Locate Targets

You’d be surprised how many process service companies keep your money, even after failing to locate a target because they moved or are aren’t using a current address.  Would you rather pay once and make sure your documents are delivered or save a few bucks and hope you don’t have to pay again.

5 Reasons why you pay more for a Process Service

 

For the most part, process service companies have competitive prices and rely on a number of tactics, including charging for gas mileage and additional delivery attempts, to turn those prices into bigger profit margins.

So while you’re looking around for a process server, you’re probably going to see similar prices.  But dig a little deeper and you’ll begin to see what sets the good process servers from the risky.

 

To help you avoid getting caught in a situation where you owe more for add-ons and taking chances than you were originally quoted, here are 5 questions you should ask a process service company before giving them your money.

 

1. What do you charge for gas mileage?

 

There are about as many mileage schemes as there are process servers. The most common way process servers build up their fees is by charging for all, most or a specific amount of the gas money used in the delivery of your documents.  In some cases, the first X amount of miles are free and you’re responsible for all the gas after that. Process service companies have also been known to charge up to twice as much for gas as you’d pay at the local gas station. Find process servers who do not charge for gas mileage or have a clearly- stated, flat fee you are comfortable with.

 

2. What do you charge for deliveries?

 

Another common up sell is charging for additional deliveries. You’d think that paying to have something delivered would include having that thing delivered, but for many process servers, this is not the case. If the target is not at home, work or the address you supplied when they process server arrives, they will return and try again for a fee. Sometimes it takes half a dozen attempts to successfully serve someone with paperwork. Find out how many delivery attempts are included in your fee and how much is charged for each additional delivery.

 

3. What do you charge for database queries?

 

Tracking down a target for delivery isn’t always cut and dry. For any number of reasons, a target may not want to be found, has outdated information or is simply on an irregular schedule. In these cases, process service companies use database queries of the DMV, tax bureaus and others to secure the most recent data possible. Unless you’re completely positive the contact information you supply about your target is up-to-date and accurate, ask how much you’ll be charged for these database queries.

 

4. What do you charge for mailings?

 

Sometimes a target is located, but they are out of the county, state or even the country. In these cases, process servers will drive to them when possible, and attempt to deliver the documents through the mail (either to the target or to a local process server) if not. Depending on what needs to be mailed and how far, these fees can really start to add up. Work with process servers who go the extra mile to complete their deliveries and don’t charge you for doing it.

 

5. What do you charge for proof of delivery?

 

Do you really think you should be charged for proof of delivery? Unfortunately, a high percentage of process service companies actually charge you for an affidavit of service. Look for process servers who stand behind their work and proudly provide you with proof of their completed delivery.

In addition to these add-ons, process servers can cost you even more money in the long run by not following California and federal laws governing the process service industry. Using an uninsured process server could put you in legal jeopardy and make you liable for any damages they’ve caused and using an unlicensed process server could make your court order invalid.

All process servers should be licensed and insured and include most or all of the above items in their fee, but it’s up to you to make sure.

RESTRAINING ORDERS : WHY, WHEN AND HOW?

 

Restraining Orders are Court Orders designed to protect individuals from others who have previously harmed, abused or harassed them by prohibiting abusers from coming into close proximity to those who have filed for the restraining order. 

Restraining Orders direct an alleged abuser to stay away from the victim and/or specific locations, including the home or work place of the abused.  Each victims circumstance is different and there are many options that you can seek in the Request for Restraining Order, including but not limited to, child custody, child stay away Orders and/or financial orders.

 

So when might you need a Restraining Order?

Some offenses that could compel a judge to sign a Restraining Order are as follows:

 

ORDERS MAY INCLUDE:

 

  • Assault
  • Burglary
  • Trespassing
  • Terrorist Threats
  • False Imprisonment
  • Harassment
  • Kidnaping
  • Lewd Behavior
  • Stalking
  • Sexual Assault

 

If you’re the victim of one of these crimes in California and you wish to seek a Restraining Order from your abuser, you will need to fill out, at a minimum, the following Judicial Council Forms

Restraining Orders Process Service

Depending on your situation and County, there may be additional forms you need to fill out and file with the Court. You can begin the process by clicking on the above links that you navigate you to the forms. If you need any assistance and/or have questions regarding the forms, you can seek the advice of an attorney, or, your local Courthouse may have a Domestic Violence Unit where they can assist you. It is important you bring any police reports, pictures of injuries or any other evidence you feel may help prove your need for a Restraining Order. In some instances, you may need to give telephonic notice to your abuser of the Restraining Order hearing so it is important you contact either an attorney or the Court to learn what your obligations are.

Once you have complied with the procedural aspect and filed the correct forms with the correct venue, or Court, a Judge will review your Request for Restraining Order. If the Judge finds enough evidence or testimony in support of the Restraining Order, he will sign a Temporary Restraining Order against your abuser. If your abuser is not in Court when the Order is signed, he/she will need to be served with the Temporary Restraining Order by someone other than yourself. The Court will then set another hearing, in approximately three (3) weeks, to decide whether a Permanent Restraining Order is applicable. It is important that you appear at the Permanent Restraining Order hearing otherwise, the Restraining Order will become ineffective at the end of the time frame (usually three (3) weeks) for the Temporary Order.

Restraining Orders are very serious and in this situation, it is very important that you use a trusted source that will ensure your safety and the proper service of the Court documents. Do not attempt to serve the paperwork yourself, it not legal, nor safe. Why a third party registered agent? 

 

Most states, including California, require business entities such as corporations or limited liability companies (LLC) to have registered agents. Registered agents are third-party individuals or businesses who are registered in the same state your business entity was established.

These third-parties are designated to receive service of process notices and other government notifications such as tax forms and notice of lawsuits on your behalf. They must also register with the State of California so it knows there is a contact person for your business within the state at all times.

When Due Process was born..

Most people know very little about process serving and why it’s important, but its history goes all the way back to the year 1215. That year, the term due process was first used in one of the most famous documents of all time: the Magna Carta. Over the last 800 years, due process has evolved to include what today are known as process servers

 

History of the Legal Process Service

 

To see this evolution, check out this timeline:1215. English barons extracted the principle of due process of law from King John. Clause 39 of the Magna Carta guaranteed that no free man may be taken or imprisoned, or ousted of his lands, or outlawed, or banished, or hurt in any way; nor will we [the king] go against him, nor send our officers against him, save by lawful judgment of his peers or by the law of the land.  And just like that, due process was born.

1787  For more than 500 years, there was little change to due process, but on September 17, 1787, the Constitution of the United States of America was completed to be the basis as the law of the land.  In this perhaps most famous document ever written, the Founding Fathers included the following language: No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

1970. The United States Supreme Court holds that the Due Process Clause protects the accused against conviction except upon proof beyond a reasonable doubt of every fact necessary to constitute the crime with which he is charged, requiring states to carry the ultimate burden of persuasion by proof beyond a reasonable doubt.

1982  A group of process servers from 11 states met in Las Vegas to form an association for the principal purpose of combating proposed federal legislation that would allow service of a summons and complaint by certified mail. That group, under the leadership of two members of the California Association of Legal Support Professionals, approved the formation of the National Association of Professional Process Servers (NAPPS). All legitimate commercial process servers should be affiliated with this group.

Bank Levy law updates

JPL Process Service LLC has up-to-date information on the Bank Levy Laws for Assembly Bill 2364 in the State of California.

With each New Year comes a bumper crop of new laws on the books, numerous of which you’ll never hear about. Our job as licensed Orange County process servers is to keep our customers abreast of any new laws which could influence them, their cases or their sensitive legal papers. The major law concerning our clients this year is California Assembly Bill 2364.

California Assembly Bill 2364

The law, which took effect January 1, 2013, regulates the service of particular legal procedures against deposit accounts, safe deposit boxes and individual homes held by big California monetary establishments. What does this mean for you?

It generally suggests if you require a bank levy, writ of execution, or some various other judgment collection served, it will have to be served to a centralized location marked by Bank of America with the California Department of Financial Institutions. Refraining from doing so will render your service invalid.
