"Fake News", Censorship, Darwin and Democracy

The mainstream media is awash with hyper-active headlines about "fake news." How can we make sense of this sudden obsession?

Perhaps we can start by separating "news" from "analysis" from "commentary." "News" is "he said this, she did that, this happened." Analysis tries to make sense of trends that are apparent in the news longer-term--for example, why did Trump win? Is the economy actually healthy or not? "Commentary" is opinion that establishes a point of view and defends it while attacking other POVs.

All three of these news flows are constantly being spun /manipulated to support specific agendas and narratives. Now we are being told some of these news flows are false/ misleading and their intent is to disrupt democracy.

I would counter that censorship is not helpful to democracy--rather, it is the death of democracy. It's all too obvious in the MSM hysteria over "fake news" that the narrative being pushed is: any criticism of Hillary or questions about her health, foundation, etc., were BY DEFINITION Russian propaganda.

Never mind that few if any voters changed their mind as a result of the "Russian hacking" (the Podesta emails); voters were already so polarized that the content of the the emails did not influence their decision, which was based on deeper foundations than "news."

The fear of those who want to preserve democracy is that under the excuse of "eliminating Russian propaganda" the status quo will restrict everyone who is inconveniently challenging the status quo narratives with data-based analysis.

One of the underlying issues in the "fake news" narrative is: the Internet is a new medium. It enables seamless surfing over an endless range of topics and images, it enriches those who design click-bait headlines that grab our attention, it enables access to "forbidden" material such as pornography, and it enables participation in content creation: posting text and photos on Facebook, Twitter, etc., adding comments to others' posts, and establishing feeds, websites and blogs.

Media philosopher Marshall McCluhan proposed asking four questions of any new medium--with "medium" meaning the type of media: film, TV, print, comics, etc.

What does the medium enhance?

What does the medium make obsolete?

What does the medium retrieve that had been obsolesced earlier?

What does the medium flip into when pushed to extremes?

If we ask these questions of the World Wide Web/Internet, how do we answer?

What does the medium enhance? One possible answer is attention deficit disorder, as the web enables and even encourages a prosess of surfing that deranges our attention and our ability to think critically about the flood of content we're leapfrogging.

But a second potential answer is that the web enhances accessing the truly vast array of human knowledge and a taggering trove of information.

What does the medium make obsolete? One answer is "the conventional centralized corporate media" which curates, edits and massages the news flow to support specific narratives.

Another possible answer is "deep learning" as the temptation to jump to the next lilly pad overwhlems the discipline and focus needed to master difficult and nuanced material.

What does the medium retrieve that had been obsolesced earlier? One answer might be "decentralized content creation and opinion." As the new mediums of newspapers, radio and TV expanded into every nook and cranny of the nation/world, the creation, curation, editing and massaging of content and opinion became intensely centralized.

This centralization led to a homogenization of content: no matter which of the three networks you were watching as the Vietnam war raged, the "news", content and opinion were basically the same.

Centralization of "news" and opinion enabled the central state to push a narrative that made its vested interests appear as inevitable elites rather than total fabrications that were dependent on the consent of the governed--a consent that was manufactured, in Noam Chomsky's phrase, to support the status quo narratives and thus the status quo's wealth and power.

But there was a problem with this centralization of content/opinion creation and curation: it no longer explained the events or trends that were visible in the "news."

If the federal government and the mainstream media were correct that we were "winning the war in Vietnam" and there was "light at the end of the tunnel," how could we explain what looked like a quagmire?

When the only medium available to dissenters and those challenging the status quo narratives was print (mimeographs, web offset printers, etc.) and physical gatherings (meetings, demostrations, lectures, etc.) then the central state could limit or disrupt dissenting narratives fairly easily.

This was the impetus behind the CIA's CHAOS surveillance/disruption program and the FBI's COINTELPRO programs to infiltrate and disrupt dissenting groups.

Limiting dissent in the age of decentralized content creation and curation is far more problematic. The Chinese central state supposedly pays hundreds of thousands of people to maintain its Great Firewall, but despite this gargantuan expenditure of treasure and effort, non-approved ideas are still leaking into China via the web/Internet.

200 years ago people printed pamphlets and spoke to small gatherings on street corners. That decentralized chaos was replaced by homogenized, centralized "news" and content curation.

Now the web has enabled millions of pamphlets and small gatherings, and the Powers That Be rightly feel their ability to control the "news" and narratives to support the rulign elites is irrevocably eroding--and hence their panicked demands to be given the power to eradicate "fake news," i.e. the baby of dissent will conveniently be tossed out with the dirty bathwater of click-bait and "foreign propoaganda."

What does the medium flip into when pushed to extremes? That is the question of the moment. Does the Internet flip into centralized censorship a la China's Great Firewall, where only ruling-elite approved "news" is distributed as "truth," or does the Internet descend further into a Wild West where anything goes, and the worst impulses of the human Id run amok.

This chaos has been described as a "failed state," and this choice of words is quite interesting. For it suggests that the Internet should be an orderly, centrally managed "digitally state" much like the central states that govern physical nations.

Perhaps what has failed here is the narrative that everything fails and falls apart if it isn't centrally managed and curated, a narrative that inevitably leads to censorship under the guise of "protecting you, the easily confused sheep, from these nasty wolves."

Censorship then enables another, much more well-organized and centralized pack of wolves (the ruling elites) to prey on the obedient sheep at their leasure, without fear of any disruptive dissenting narratives.

What the ruling political elites and their mainstream media shills fear is a wide-open, chaotic and very Darwinian competition of concepts and ideas.

they fear this so profoundly because they all know, somewhere in their hearts and minds, that their narrative is bankrupt, and that it no longer explains the world around us. It has failed, and this failure is now self-evident.

The mainstream media has faithfully promoted a neoliberal, neoconservative, Keynesian narrative that has failed to produce the expected results. No wonder trust in the mainstream media has declined sharply in the past few years. Why should we trust a centralized institution that has parroted policies and narratives that haven’t produced the widespread security and prosperity that its proponents promised?

The mainstream media’s “experts” who decry populism would rather blame "foreign propaganda" than examine why populism is on the rise: the mainstream political, financial and social institutions have failed to deliver what they promised, implicitly or explicitly.

This failure is powering a search for new ways to understand our world, and this is a positive dynamic. The process is messy and fraught with bad ideas, fake news, hidden agendas, propaganda, and here and there, powerful new ideas and narratives.

The ruling elites and their mainstream corporate media desperately want to shore up their failing narrative by censoring the creation, curation and distribution of competing ideas and narratives.

Censorship is not helpful to democracy--rather, it is the death of democracy. We should ponder that as the mainstream media's increasingly frantic cries for censorship fill the airwaves and print media.

Unfortunately for the ruling elites and their mainstream media shills, you can't put the Internet genie back in the bottle without destroying the economy and democracy.

Counter-Propaganda Bill Quietly Creates US Propaganda Factory

The Writing of John Laurits - On Thursday December 8th, the US senate quietly passed the National Defense Authorization Act ( or the ‘NDAA’ ) for the fiscal year of 2017. Basically, the NDAA is passed every year to re-approve & add to the United States’ so-called “defense” spending — which is sort of like Christmas for the officials who run the profitable death-machine called “US foreign policy.”

However, many would likely be shocked by the ridiculous and terrifying laws that our treacherous congress usually buries inside the yearly bill — for example, Congress just used the NDAA to create a “Global Engagement Center,” headed by the Secretary of State. Sounds harmless, right? Well, it might seem that way until you realize that “Global Engagement Center” is code for our new “Ministry of US Propaganda.”

Counter-Propaganda = Propaganda

Hidden in the fantastically boring depths of the 1,576-page NDAA, in §1259C, below Subtitle E, labeled “Other Matters,” below Title XIII, is approval for the funding of a new propaganda agency which will be managed by the secretary of state. The text was pretty much lifted word-for-word from the Portman-Murphy “Countering Disinformation & Propaganda Act,”except that congress changed the name from the slightly ominous-sounding “Center for Information Analysis and Response” to a happier “Global Engagement Center.” Among other things, the center’s function is to —

…develop, plan, and synchronize… whole-of-government initiatives to expose and counter foreign propaganda and disinformationdirected against United States national security interests and proactively advance fact-based narratives that support United States allies and interests
— §1259C, a3

Or — to put it simply — they’re going to help the US government distribute information that will support their interests, especially those interests that face scrutiny in other countries. However, as I’ve written about before, it’s often very difficult or impossible for the public to verify whether the godless communists or whoever else are actually messing with us or whether our public officials are only making excuses for their own corruption.

Regardless, it seems reasonable to assume WikiLeaks-style journalism (like the email leaks during our “elections”) will now be considered “foreign propaganda and misinformation...”

If this isn’t a big enough red flag for you already, consider the fact that, not only does the new Ministry of Propaganda plan to “proactively advance fact-based narratives,” they plan on doing it with the help of both our schools & the private sector:

To establish cooperative or liaison relationships with foreign partners and allies… and other entities, such as academia, nongovernmental organizations, and the private sector
— §1259C, a5

Or, in other words, they’ll be planting their people in academic situations & working with pretty much any industry they think will enhance their propaganda’s reach & effectiveness. The section even approves funding to spy on journalists, social media groups, political parties, & NGOs — all of this is to “proactively advance fact-based narratives,” of course. See for yourself — the NDAA lists one of the center’s functions as:

“Identifying current and emerging trends in… information obtained from print, broadcast, online and social media, support for third-party outlets such as think tanks, political parties, and nongovernmental organizations… and the use of covert or clandestine special operators and agents to influence targeted populations and governments…”
— §1259C, b4

Is this the end of journalism?

Lastly, I’d like to show you the part of all of this that, as a journalist, I find most worrying:

AUTHORITY FOR GRANTS.—The Center is authorized to provide grants or contracts of financial support to civil society groups, journalists, nongovernmental organizations, federally-funded research and development centers, private companies, or academic institutions for the following purposes:

[…]to counter efforts by foreign governments to use disinformation, misinformation, and propaganda to influence the policies and social and political stability of the United States

— §1259C, f(1) & §1259C, f(1)D

In plain English, this is saying that the US is going to start subsidizing journalists, researchers, and even schools who agree with the regime — which, incidentally, will punish and potentially threaten the viability of truly independent media altogether.

Government Propaganda is Dangerous

Now, this bill does contain vague wording, like the Global Engagement Center’s function being “to demonstrate new technologies, methodologies and concepts relevant to the missions of the Center,” which could mean pretty much anything. This has always been one of congress’ favorite tricks — to pass legislation that could be interpreted in different ways, so that they can deny responsibility while making funds available to do whatever they want.

That means that this legislation is a lot like a loaded gun — harmless in one person’s hands but potentially devastating & destructive in the hands of another, depending on how the scope & language of the bill is interpreted. Which “new technologies” will they “demonstrate” and what will the “missions of the Center” be? Which “populations” will they “target” and with who’s “fact-based narratives” will they be “targeted” with? What will the “interests” of the US be, who is “foreign,” & will journalists who report this foreign “disinformation” be considered propagandists for foreign agents?

The answers to these questions depend on who is in charge of interpreting them — which means that the most important question of all is do you trust the United States, and particularly the incoming administration, to make those decisions?

War on 'fake news' is part of a war on free speech

RonPaul.com - A major threat to liberty is the assault on the right to discuss political issues, seek out alternative information sources, and promote dissenting ideas and causes such as non-interventionism in foreign and domestic affairs. If this ongoing assault on free speech succeeds, then all of our liberties are endangered.

One of the most common assaults on the First Amendment is the attempt to force public policy organizations to disclose their donors. Regardless of the intent of these laws, the effect is to subject supporters of controversial causes to harassment, or worse. This harassment makes other potential donors afraid to support organizations opposing a popular war or defending the rights of an unpopular group.

Many free speech opponents support laws and regulations forbidding activist or educational organizations from distributing factual information regarding a candidate's positions for several months before an election. The ban would apply to communications that do not endorse or oppose any candidate. These laws would result in the only sources of information on the candidate's views being the campaigns and the media.

Recently the Federal Election Commission (FEC) rejected a proposal to add language exempting books, movies, and streaming videos from its regulations. The majority of FEC commissioners apparently believe they should have the power, for example, to ban Oliver Stone's biography of Edward Snowden, since it was released two months before the election and features clips of Hillary Clinton and Donald Trump discussing Snowden.

The latest, and potentially most dangerous, threat to the First Amendment is the war on "fake news." Those leading the war are using a few "viral" Internet hoaxes to justify increased government regulation — and even outright censorship — of Internet news sites. Some popular websites, such as Facebook, are not waiting for the government to force them to crack down on fake news.

Those calling for bans on "fake news" are not just trying to censor easily-disproved Internet hoaxes. They are working to create a government-sanctioned "gatekeeper" (to use Hillary Clinton's infamous phrase) with the power to censor any news or opinion displeasing to the political establishment. None of those wringing their hands over fake news have expressed any concern over the fake news stories that helped lead to the Iraq War. Those fake news stories led to the destabilizing of the Middle East, the rise of ISIS, and the deaths of millions.

The war on "fake news" has taken a chilling turn with efforts to label news and opinion sites of alternative news sources as peddlers of Russian propaganda. The main targets are critics of US interventionist foreign policy, proponents of a gold standard, critics of the US government's skyrocketing debt, and even those working to end police militarization. All have been smeared as anti-American agents of Russia.

Just last week, Congress passed legislation creating a special committee, composed of key federal agencies, to counter foreign interference in US elections. There have also been calls for congressional investigations into Russian influence on the elections. Can anyone doubt that the goal of this is to discredit and silence those who question the mainstream media's pro-welfare/warfare state propaganda?

The attempts to ban "fake news;" smear antiwar, anti-Federal Reserve, and other pro-liberty movements as Russian agents; and stop independent organizations from discussing a politician's record before an election are all parts of an ongoing war on the First Amendment. All Americans, no matter their political persuasion, have a stake in defeating these efforts to limit free speech.

A new series of realities is on the way.

Centralized information-reality is on the way out.

It’s going to be thrills and chills.

Major newspapers are dying. The internet is crushing them. And yet, if the NY Times and the Washington Post and the LA Times wanted to resuscitate themselves, they could.

I’m not talking about one-day headlines. I’m talking about investigations that pound and pound on issues of corruption day after day, month after month.

For example, these issues:

* The Federal Reserve/a clandestine private corporation.
* Medically caused death.
* Toxic vaccines.
* Trillions of dollars of missing US government money.
* The power of the Trilateral Commission over US government policy.
* The covert implementation of the UN agenda of destruction in US communities.

And a hundred more issues.

Expose these down to the core, and people would buy newspapers off the rack like they buy coffee and beer and video games and cell phones and gasoline and underwear and toilet paper and lipstick and fast food. The Times would have to schedule extra press runs just to keep up with the demand. Its financial bottom line would soon look like Christmas.

But the great esteemed centers of American journalism are part of the Matrix. They are in the business of falsehood, omission, diversion, and obfuscation. They live by those hallmarks.

You could talk to the publisher of the New York Times and present him with an ironclad business plan for pulling his paper out of its deep financial trouble, based on covering true stories like those above, and you would find no joy, because he would rather go down with the ship than go against the Matrix.

The Times and other hoary media outlets live by the rule of limited hangout. In intelligence parlance, that means admitting a small piece of the truth in order to hide the rest.

“We’ll show you a tree in the forest, but not the whole forest.”

I know how it works, because as a reporter I’ve been there. I’ve approached editors of various media outlets with stories that crack the Matrix trance, and I’ve had those stories tossed back at me.

“We’re just not interested,” they say. “This isn’t our kind of piece.” Or: “Well, we already covered that.” But they didn’t cover it. They did a limited hangout on it. They ran a story that exposed one tiny corner of a whole bloody mess.

I fully understand that media outlets black out stories that would endanger their own advertising dollars. But that’s just the beginning of the true reason the major newspapers and television networks decline to run pieces that would once again make them gigantically successful.

To understand the true reason, you need to grasp something about the Matrix itself. It is a reality that maintains its power because it can engineer SILENCE. It can create EMPTY SPACE. Not only can it invent pictures that are false, not only can it pander to certain emotional links in people’s shrunken universes, it can make Swiss Cheese appear as if it has no holes in it. This is an art.

To see what the Matrix is and how it operates, you need imagination. You need to use that imagination to understand what COULD BE but ISN’T. You need to be able to project how the truth could actually storm the bastions of planned ignorance and impel people to perceive startling new realities beyond the dross of what they have now.

I say this—partially as a boast and partially as simple fact—if I were the managing editor of the New York Times and I was given the corner office and free rein, I would have that paper back in the black in a year. I would have it roaring on all cylinders. I would have people fighting each other in the streets to grab the last copy off the newsstands. Every day. Journalism schools all over the country would close down in shame. Because we would be running stories that would crack the whole rotting edifice of cartel-control along many fronts, and we would be filling up a PLANNED VACUUM with something super-real.

But I gave up on that fantasy 20 years ago. Instead, I saw a day when these giants would wither like old men on their back porches staring out at the rain. And that day is here. It has come.

They gave up their right to cover the news. And now they’re paying.

—It may have occurred to you by now that one of my main targets is: people dedicated to cynicism, despair, passivity, and self-imposed victimhood. They clog forward progress. They hold up the train. They drag down the future. They sit in their own puddles. They opt for abstract spectatorship, hoping for the occasional stimulation of adrenaline to relieve a permanent state of paralyzing boredom.

I don’t write for those people. I never will.

I write for the people who can envision WHAT COULD BE and will at least consider making their stand there.

Like many other people, I know what cynicism, despair, and passivity are. I’ve visited that land. I’ve checked into those motels. But in the end, they’re a joke. You know why? Because: what do they get you? They get you nothing. Zero.

At best, they get you the temporary hope that someone else will rescue you and drag you from the depths.

One thing that’s going to happen as independent news takes over from the old goofs: there will be information, more information about workable solutions to vital problems. People need to be ready for that.

They need to be ready for answers that are shocking because they ARE answers.

It’ll seem surreal. Workable answers? What??

Yes.

People will need to adjust their minds.

The business of news outlets without solutions will be eclipsed.

If you think this is impossible, then become a citizen journalist, and make it possible.

No one of good will and intelligence needs to be on the outside looking in.

This is not an article attempting to support or debunk the claims made by the popular "PizzaGate" theory which, despite censorship on platforms such as Reddit and YouTube, continues to gain traction. Although yes, we plan on "going there", just not right now.

Instead, we would simply like to remind our dear readers that selecting "all the news that's fit to print" is by no means an exercise in objectivity.

The New York Times has now run numerous stories in an attempt to debunk PizzaGate and shame anyone who thinks such a theory could even be possible.

The claims made by PizzaGate are serious and deserve close scrutiny. But is the New York Times really the correct outlet for an impartial investigation into an elite pedo ring?

While the Times has reached out to those implicated in the theory for their comments and retorts — standard operating procedure for any competent journalist — it's important to remember that the CEO of the fabled newspaper is none other than Mark Thompson, the former BBC director who "lied" during the Jimmy Savile investigation, and is at least partly to blame for allowing a monster like Savile to operate within the BBC for so long "undetected".

15 years ago, anyone who alleged that the BBC was covering up widespread child abuse would have been called a nutter.

Not so nutty today, is it?

Let's just come out and say it: If Mark Thompson was willing to help cover up disgusting crimes that were committed within his own organization, why would we think twice about trusting the NYT when it comes to something like PizzaGate?

And we love how the word "conspiracy" is used as a derogatory term to describe the theory. Sort of like the conspiracy to cover up Savile's unspeakable crimes, a conspiracy in which Mark was a leading participant?

It's a contentious subject. We are, by good breeding, diametrically opposed to witch hunts. But why such an insane overreaction by the government and media, if it's just a dumb, baseless theory? The internet is full of wild claims. Did you know that Obama is a reptile from outer space? The internet says so. But the New York Times, along with Hillary Clinton, doesn't seem to give a hoot. And they shouldn't.

There's something going on here, friends. Discuss.

The U.N. estimates that close to 30,000 people have been displaced by the latest fighting, 18,000 to government-held areas, a further 8,500 to the Kurdish-controlled neighborhood of Sheikh Maqsoud and the rest within rebel-held areas.

U.N. envoy Staffan de Mistura has said more than 100,000 people may still be in the rebel-held area.

The opposition Aleppo council claims that there are 150,000 left in the "rebel"-held area. Official UN refugee numbers say that some 26,500 fled from east-Aleppo to the government controlled areas. Another 8-9,000 fled yesterday and today. The Takfiri held areas have shrunk to some 4% of their original extension in east Aleppo. If the original Mistura numbers were correct those must by now be the most densely inhabited area of the world.

But somehow those numbers are now inoperative.

275,000 civilians - 35,000 refugees = 240,000. But there are only 100,000 to 150,000 left in east-Aleppo? Where are the 90,000-140,000 people missing from those numbers? Where did they go?

Equally false numbers were used by the UN and other with regard to Mardaya and Daraya.

A map of southern Lebanon released this week by the Israeli military that ostensibly showed Hezbollah positions, infrastructure and armaments along a section of the Israeli border was a fabrication, the army admitted Thursday.

The map, tweeted by the army Tuesday, appeared to feature over 200 towns and villages, which the IDF said the organization had turned into its operations bases, along with over 10,000 potential targets for Israeli strikes in the event of a new war with the terror group.

The IDF spokesperson posted the map with the remark: "This is a war crime". But the map is fake and as it claims that Hizbullah positions are near villages and cities it was though up as propaganda cover for the future IDF war crime of bombing those build up areas.

In reality Hizbullah takes special care to position its missile forces away from any settlements.

I doubt that people will, over time, continue to fall for such nonsense. Information availability has increased. The people can get better informed with only little effort. In consequence the people will look, and vote, for outsiders to govern them. Radicals on the right of the political spectrum will gain more from this trend than the dispersed forces on the left.

Those predictable consequence may be consistent with a general political plan.

Sorry, U.S. Census Bureau, I.R.S. and St. Louis Federal Reserve--you're issuing "Russian propaganda" according to The Washington Post's shoddy "fake news" methodology.

In case you missed it, The Washington Post's criminally careless publishing of "fake news" about purported "Russian propaganda" created a backlash--and the Post's attorney-approved bleating to sidestep responsibility for publishing "fake news" failed to calm the waters.

The "experts" claims of expertise were not validated or investigated by the Post, and the Post prominently linked to a list of 200 websites (oftwominds.com among them) that purportedly "wittingly or unwittingly" promoted "Russian propaganda"--but The Washington Post did zero journalistic work to investigate the list or the anonymous "experts" that published it.

Since the list is bogus, the entire story qualifies as "fake news"--exactly what the Post claims to be investigating. Talk about irony....

This criminally sloppy publishing of "fake news" isn't journalism--it's propaganda. No amount of slippery legalese can erase the fact that The Washington Post published a "fake news" story and featured it prominently on page one.

Let me explain the "methodology" behind the "Russian propaganda" list: guilt by association. Here's how this works. Say you're in a totalitarian state with a media controlled by a handful of state-corporate interests. (Sound familiar?)

You have lunch with a colleague who is an acquaintance, discuss kids' soccer and gripes about the boss, and you go home, thinking nothing of it.

The secret police are waiting to arrest you. Your crime is "consorting with an "enemy of the state:" your colleague, unbeknownst to you, is considered an "enemy of the state," and by having lunch with him, you are guilty by association.

This is the precise methodology of The Washington Post's shoddy "fake news" list of "Russian propaganda" websites. Any association with an "enemy of the state" site like RT (Russia Today) convicts you by association of being an "enemy of the state."

Neither the "fake news" publishers of the list nor The Washington Post combed through the thousands of pages of blog posts on my site and identified those purported to be "Russian propaganda." They didn't bother, because, well, that would have taken some serious journalistic work.
Instead, they labeled oftwominds.com as guilty by association. Here is a chart of my guilt by association:

Just as a reminder, every major power funds international media outlets.consider BBC (U.K.); Radio Liberty (USA); France 24 (France); NHK (Japan) and China's overseas broadcast empire.

So let's extend The Washington Post's shoddy "fake news" methodology just a bit, to the sources of oftwominds.com's "Russian propaganda." Since oftwominds.com's content relies on statistics from these three websites, clearly they are guilty by association.

Here's the revised chart with another layer of "Russian propaganda" sites: the U.S. Census Bureau, the I.R.S. and St. Louis Federal Reserve (FRED). These sites are integral to oftwominds.com's output, and so by supplying oftwominds.com with anti-status quo content, they too are guilty of wittingly or unwittingly spreading "Russian propaganda."

Michigan Border Patrol Is Getting Sued for Ridiculously Claiming Entire State Is a “Constitution-Free Zone” (GOOD)

Customs and Border Patrol in Michigan is being sued by the American Civil Liberties Union in federal court for proclaiming the entire state is a “border zone” where the Constitution of the United States no longer applies and anyone traveling anywhere within the state can be detained and searched at any time, for any reason, without a warrant.

Via Courthouse News:

In a complaint filed Wednesday in Detroit federal court, the ACLU of Michigan alleges the Department of Homeland Security and CBP violated the Freedom of Information Act with a late and insufficient response to a request for documents about Border Patrol enforcement operations in Michigan between fiscal years 2012 and 2014.

The ACLU and its co-plaintiffs – the Michigan Immigrant Rights Center and University of Arizona professors and immigration experts Jeffrey Boyce and Elizabeth Oglesby – demand the immediate processing and release of agency records.

The complaint is centered on the CBP’s interpretation of a 100-mile zone regulation and how it is applied in Michigan.

“In order for the public, policymakers and the courts to evaluate the proper scope of warrantless searches conducted by the CBP and to examine whether it is ‘reasonable’ for the CBP to define the entire state of Michigan as a border zone, it is critical that more information be made publicly available about CBP’s extensive but largely opaque interior enforcement operations in Michigan, and particularly about its interpretation and application of its authority within the ‘100 mile zone,’” the lawsuit states.

The law is so vaguely worded that it is rife for abuse, so border patrol in Michigan is milking a semantic argument for all it is worth to give themselves maximum power over the people with zero regard for how fascist that is. The federal law regarding the border zone, while obviously unconstitutional, is supposed to allow agents to conduct warrantless searches within a “reasonable distance” from a U.S. border in order to stop illegal immigrants, terrorists, terrorist weapons, and the illegal trafficking of people and contraband from entering the country; however, it has already come out time and again that the unconstitutional law gets abused all the time to detain and terrorize innocent Americans well past the border and even well past the 100-mile line, as CBP fully admits that only 40 percent of the U.S.-Mexico border is operationally protected and the agency only stops less than ten percent of illegal drugs that enter the country anyway (as Aaron Dykes explains in this old Truthstream video report).

In Michigan, the agency has now declared itself as a statewide gestapo, interpreting the entire state as a “reasonable distance” border zone where they can detain anyone, anywhere, at anytime without a warrant or even reasonable suspicion that a crime has been committed.

What this effectively means is that every American citizen in Michigan is having their right to unreasonable search and seizure as enshrined in the 4th Amendment of the Bill of Rights blatantly ignored.

Not only that, but Courthouse News points out that data does not even remotely justify this interpretation:

These trends show that 31 percent of people processed by the Border Patrol – almost one in three – are United States citizens, and over 63 percent of those apprehended had been stopped by other law enforcement agencies before their CBP encounters, according to the complaint.

Other statistics allegedly show that less than 2 percent of foreign citizens processed by the CBP have a known criminal record and just over 5 percent of foreign citizens processed arrived in the U.S. in the preceding 30 days.

On an aside, we traveled through Michigan on a road trip to Canada from Texas (I know, long drive) for the first time earlier this year.

Not only did we observe a predator drone patrolling the skies about highway 401 that runs through Canada just north of the US border (a sight which is blood curdling enough), but coming back through the border checkpoint from Canada into Michigan on the Blue Water International Bridge was one of the most horrifying experiences with border patrol or even law enforcement that I’ve ever had in my entire life.

We were on a filming trip for our upcoming movie, so we had camera equipment with us. While its well known these agents are trained to regard photography with suspicion, this particular agent acted like a tripod might be part of a nuclear weapon or something. After he located the suspected terrorist weapon, he asked us repeatedly what it was and what it was for. Our answers (“a tripod, for filming”) garnered more questions of why and what were we filming, and the fact that we were filming anything at all seemed to freak him out so much, he decided that was justification to dig through our entire car including every suitcase, souvenir postcard set, and bag of dirty laundry we had. As you can imagine after a two-week road trip, that means I had a grown man in a uniform digging through 14 days of my dirty underwear.

Worse, the entire time we were sitting there detained on the bridge between Canada and the US (besides asking us ignorant questions about filming equipment that made me wonder what his IQ test score was), he asked us blatantly stupid questions that were so ignorant, I would have been giggling in his face if I wasn’t too busy lamenting the fact that we live in a total police state with pretend freedom where a man this idiotic is given a costume along with the power to enslave his fellow citizens.

He didn’t just ask how we knew each other (even though we have the same last name on our passports, so it’s a high probability we are in some way related…) but….

We live in Texas. Our passports? Texas. Our license plate? Texas. After we told him we were headed home after our trip, he again asked us where we were headed (take a guess where that might be), like he was trying to trip us up (you know those suspicious photographers, they’re so untrustworthy). The more polite I tried to be answering his questions, the angrier he seemed to get for some inexplicable reason.

After he went through every item in our car and asked us numerous stupid questions, then got mad because he couldn’t figure out how to open one of our lens cases, he walked back around to the front of the car and decided to try and stump us with further questions. At that point I started to wonder if I had accidentally slipped into a game show on the set of the film Idiocracy, not sure if this guy was going to let us back into the country so we could go home or not (and, secondarily, whether or not I even wanted to go “home” to a country where innocent citizens are subjected to this kind of treatment for simply trying to go home).

Because this encounter had nowhere to go but dumber, he proceeded to ask us if we planned to stop anywhere along the way. The sarcastic part of my brain (which is pretty much all of it) went, “No sir, we plan to drive 21 straight hours without so much as a stop for gas or going to the bathroom because we’re magic, our car is a time machine, and it runs on unicorn kisses and fairy wishes!”

Then, as if that wasn’t ridiculous enough, he asked us if we planned to contact anyone while we are in the country.

UM.

Well.

We are US citizens with US passports. We already told him (because he asked) that we LIVE here and where. It’s a good bet we, ya know, have family and friends here we just miiiight want to see again sometime in the future considering we’re from here and our home with all of our worldly possessions is here.

This stupidity went on and on until he realized I had been filming the whole time (oops), at which point he got real mad and took away my camera and tried to delete my footage.

Problem is, he didn’t know how. What ensued was him repeatedly accidentally filming Aaron’s crotch (Aaron was in the driver’s seat) as he tried to figure out how the camera’s delete button worked. He couldn’t. Finally he gave me my camera back and forced me to delete my footage while he watched and double checked that it was gone.

After being there for what seemed like forever, and realizing that the border is interpreted as a Constitution-free zone, and knowing from past reporting how much worse things can get for innocent American citizens who dare to leave their country and attempt to come back in at the border during these kinds of “searches,” I obliged.

But I was pissed.

So pissed in fact, that I immediately downloaded a computer program that would recover my deleted footage, which I have since fully restored. See, because these goons claim the border is Constitution-free, that also means they’ve decided we have no First Amendment rights at the border either. They enforce a no phone, no filming policy at patrol checkpoints, lest your filming gives away the magical secret to how they conduct searches (see above).

I believe, however, that God gave us all rights that are unalienable, so I filmed. And I kept my film. I’m still debating whether or not to upload it, but it was admittedly humiliating and I’m not sure how much people really want to watch me get angry and cry about it afterward (which I also filmed).

It was actually a pretty terrifying experience and as I type this now, I can remember how it felt, being an innocent American whose privacy was invaded for no real reason, forced to delete my footage, and wondering if I would even get to go home or not where my children were waiting for me… All of it based on some maniacal idiot’s power trip and nothing more.

It dawned on me that this was why, on the way to the checkpoint, I saw other people who were obviously Americans pulled over on the side of the road cleaning out their cars and looking nervous as hell while doing it. It is to the point where people are afraid to come back into their own country here because of guys like that agent who can randomly deny them entry for whatever reason they feel like or no reason at all.

I got so angry, I wept as soon as we got off the bridge for how little freedom the supposed “land of the free” really has.

Wanna hear the punchline? Border patrol on the way into Canada was less invasive than a trip to the DMV. I think the lady asked us if we had any fruits or vegetables in the car, smiled at us, and waved us through in under two minutes.

My experience with Michigan border patrol was bad, but I know it could have been so much worse.

A 54-year-old New Mexico woman recently won a $1 million settlement because border patrol in El Paso selected her for a random search that turned into six hours of having her vagina and anus probed by a female agent’s fingers for drugs, being forced to squat with her pants and underwear pulled down in front of a drug sniffing dog while they peered at her private parts with a flashlight, then, still unsatisfied even though she was clean, she was forced into a hospital for further medical tests that involved being shackled to a bed, forced into stirrups, being forcibly searched vaginally again by a doctor with a gynecological speculum while agents watched, made to defecate in front of the agents, given an abdominal CT scan on top of it all and, in the end, GUESS WHAT?

THEY FOUND NOTHING! Not a single damn thing. Oh, and to literally add insult to injury, they sent her a bill for $5,000 worth of “medical services” after she refused to sign a paper under coercion that stated she consented to her own government raping!

According to reports, she was so traumatized by her experience just trying to go home that she had been unable to be physically intimate with her husband since the incident. One million dollars won’t buy her sanity back or undo that trauma.

Roving patrols like the ones border patrol is being sued for in Michigan have also occurred in Washington, Arizona, and Texas, well past the already blurry 100-mile line. In fact, the agency has insisted the 100-mile line doesn’t limit them in their duties.

In short, this agency doesn’t really care what the law or the Constitution says. The ACLU has filed similar lawsuits in both Washington and Arizona as well.

Meanwhile, waves of illegal immigrants continue to flood the country at our borders anyway, and our soldiers continue to protect poppy fields for the opium trade in Afghanistan in the fake war on terror, the product of which ends up coming here as illegal heroin anyway in the fake war on drugs, so the real point of it all seems just to be to condition a fear-based, unquestioning slave-to-authority mentality in the citizens of this country, many of whom just keep telling themselves if they’ve done nothing wrong they have nothing to worry about…

Something I can personally attest is simply not true.
