<p>State regulators have ordered <strong>Kaiser Permanente</strong> to stop denying members access to physical, occupational and speech therapy services.</p>
<p>The cease-and-desist order &mdash; issued Monday by the <strong>California Department of Managed Health Care</strong> &mdash; follows member complaints that Kaiser denies coverage for these services for non-physical conditions such as developmental delays, stuttering and autism without determining medical necessity.</p>
<p>&ldquo;Kaiser Health Plan&rsquo;s policy to deny physical, occupational and speech therapy services for non-physical conditions is not permitted under the Knox-Keene Act,&rdquo; Anthony Manzanetti, DMHC&rsquo;s chief of enforcement, said in a news release. &ldquo;The DMHC is taking this action to ensure Kaiser follows the law.&rdquo;</p>
<p>The DMHC action was applauded Tuesday by the <strong>National Union of Healthcare Workers</strong>, which represents more than 2,200 psychologists, licensed clinical social workers, marriage and family therapist and other mental health clinicians in California.</p>
<p>The union &mdash; which is in the midst of contentious contract negotiations with Kaiser &mdash; released a report in November that blasts Kaiser for denying patient care for certain mental health conditions.</p>
<p>&ldquo;DMHC&rsquo;s action reinforces what we&rsquo;ve been saying for months about Kaiser&rsquo;s failure to provide its patients with timely and appropriate mental health services,&rdquo; Clem Papazian, a licensed clinical social worker who works for Kaiser in Oakland, said in a statement.</p>

<p>Kaiser tried to blow us off. They said our concerns for our patients had no merit.</p>
<p>In response, we blew the whistle. We <a href="http://www.nuhw.org/latest-news/2011/11/30/kaiser-workers-blow-whistle-on-behalf-of-patient-care.html">filed a complaint</a>&nbsp;with the State of California calling for an investigation into Kaiser Permanente&#8217;s mental health services.</p>

Just last week, the National Labor Relations Board spelled out how Kaiser violated workers&#8217; rights by unilaterally implementing changes to our working conditions. <p>Two weeks ago, NUHW released a report based on a survey of more than 300 Kaiser clinicians, &#8220;<a href="http://nuhw.org/caredenied">Care Delayed, Care Denied</a>&#8221; documenting how Kaiser Permanente, California&#8217;s largest HMO, systematically understaffs its mental health services in violation of California state law.</p>

]]></content></entry><entry><title>USA Today: Kaiser mental health patients forced to wait past limit</title><category term="Kaiser HCP"/><category term="Kaiser IBHS"/><category term="Kaiser Optical"/><category term="Kaiser Psych-Social"/><category term="Kaiser RNs: AFN"/><id>http://www.nuhw.org/latest-news/2011/11/13/usa-today-kaiser-mental-health-patients-forced-to-wait-past.html</id><link rel="alternate" type="text/html" href="http://www.nuhw.org/latest-news/2011/11/13/usa-today-kaiser-mental-health-patients-forced-to-wait-past.html"/><author><name>nuhw</name></author><published>2011-11-14T03:21:47Z</published><updated>2011-11-14T03:21:47Z</updated><content type="html" xml:lang="en-US"><![CDATA[<p>Today, <strong><a href="http://yourlife.usatoday.com/health/medical/mentalhealth/story/2011-11-13/Study-Calif-mental-patients-force-to-wait-past-limit/51189420/1">USA Today</a></strong> and <strong><a href="http://www.huffingtonpost.com/2011/11/14/kaiser-permanente-overburden_n_1092694.html">the Huffington Post</a></strong> have both reported on NUHW&#8217;s &#8220;<strong><a href="http://www.nuhw.org/caredenied">Care Delayed, Cared Denied</a></strong>.&#8221; <br /><br /><span class="full-image-float-right ssNonEditable"><span><a href="http://www.nuhw.org/caredenied" target="_blank"><img style="width: 150px;" src="http://www.nuhw.org/storage/mentalhealth/CareDelayedPDFforweb.gif?__SQUARESPACE_CACHEVERSION=1321245386919" alt="" /></a></span></span>Based on a survey of more than 300 mental health clinicians, &#8220;Care Delayed, Care Denied&#8221; shows in clear detail that Kaiser Permanente, California&#8217;s largest HMO, systematically understaffs its mental health services in violation of California state law, leaving some patients to suffer delays in receiving treatment they have already paid for and urgently need.</p>

<blockquote>&#8220;A survey of 305 mental health providers at 57 California Kaiser Permanente facilities found that mental health patients do not receive needed care in a timely manner, that managers ask employees to &#8220;cook the books&#8221; so it appears they meet a California law for an initial appointment within 10 days, that patients are funneled into group therapy because there are not enough clinicians for one-on-one care and that clinicians do not have time to perform basic assessments.&#8221;<br /><br />The survey was conducted by the National Union of Healthcare Workers.</blockquote>
