Initiative 25-0022, officially titled the “Protecting Automobile Accident Victims from Attorney Self-Dealing Act,” is scheduled to appear before California voters on November 3, 2026. While its name suggests the measure champions injured consumers, attorney Damoun Yazdi, founding attorney of The Accident Network Law Group, says the opposite is true.

“This initiative is not written to protect victims. It is written to protect Uber,” said attorney Yazdi. “Uber has invested over $32 million to get this on the ballot because the company knows that if it passes, fewer injured people will be able to find lawyers willing to take their cases. That means fewer lawsuits against Uber, less accountability, and less money paid to people they injure.”

What the Initiative Actually Does

Beneath its consumer-friendly title, Initiative 25-0022 contains provisions that critics say systematically disadvantage injured Californians:

• The measure would impose a hard 25 percent cap on attorney contingency fees. That model is what currently makes it possible for injured people with no money to hire experienced lawyers and pay nothing until they win. Reducing the cap to 25 percent makes many cases financially unworkable to pursue, particularly complex injury claims that demand expert witnesses and months of litigation. Attorneys will be forced to turn those clients away.
• Medical expense recovery would be calculated using Medicare, Medi-Cal, and insurance database rates rather than actual treatment costs. Most California providers bill well above those government benchmarks, which leaves injured victims responsible for the difference between what their settlement covers and what their doctors actually charge.
• Referral agreements between attorneys and medical providers would be prohibited outright. Proponents frame this as rooting out conflicts of interest. In practice, those referral networks are what allow uninsured and underinsured patients to get treated after an accident with nothing due upfront. Doctors agree to wait for payment until the case resolves. Without those arrangements, injured people without coverage will find far fewer options for immediate care.

Who Really Wins If This Passes

Yazdi argues the beneficiaries of Initiative 25-0022 are corporate defendants and insurance companies, not accident victims.

“Insurance companies stand to gain enormously from this measure,” said attorney Yazdi. “If victims can’t find attorneys to represent them, or can only recover a fraction of their medical costs, insurance companies pay out less. Period. This is a multi-hundred-million-dollar investment by corporate interests to rig the system against the very people the legal system is designed to protect.”

Attorney Yazdi Calls on Californians to Reject the Initiative

Attorney Yazdi is urging fellow Californians to research the initiative beyond its title before the November vote, and to be skeptical of any measure bankrolled overwhelmingly by a single corporation with a direct financial interest in reducing injury payouts.

“When a company like Uber spends $32 million to put something on your ballot, you have to ask yourself: who is this really for?” said attorney Yazdi. “It is not for you. It is for them.”

The law firm did an analysis of May because, historically, Memorial Day is the start of Summer travel. This year, drivers in Illinois are facing historically high gas prices, which are possibly shifting would-be drivers into the bike lane.

According to data provided by the City of Chicago and reviewed by Briskman Briskman & Greenberg’s attorneys, total vehicle crash records in May fell to 19,700 in 2026, the lowest figure in four years. That marks a 1.3 percent decline from 2025 and sits 6.4 percent below the May 2024 peak of 21,056. May crash volume has now decreased two years in a row.

The trend for cyclists ran in the opposite direction. Bicycle involvement in May crashes climbed from 181 in 2023 to 279 in 2026, a 29.2 percent increase over the past year and a 54.1 percent rise across the full period. Pedestrian involvement followed a similar upward path, increasing 6.4 percent year over year.

The report also documents a steady change in the vehicles on Chicago roads. Passenger car involvement declined 11.3 percent over the four years, while SUV involvement rose every single year, for a cumulative increase of 26.8 percent.

Paul Greenberg, the managing member of Briskman Briskman & Greenberg, is an avid cyclist and bicycle safety advocate. Last month, Greenberg shared the firm’s research on the growing dangers to bicyclists in the windy city on CAN TV’s Chicago This Week, airing on Channel 21.

“A citywide decline in crashes is genuinely encouraging, but it can mask who is still being put at risk,” Greenberg said. “Bicycle accidents in Chicago are up more than fifty percent since 2023. That is the trend we want drivers, planners, and policymakers paying attention to, because those are the collisions where a person on a bike has very little to shield them and most at risk of serious injury.”

The report behind the story, “Chicago Bike Accidents Have Surged 46% Over Four Years,” is based on City of Chicago crash records. The findings document 8,389 reported bike accidents, 6,248 injuries, and 11 cyclist fatalities across the four-year study period. Every year set a new record.

In 2025 alone, drivers struck Chicago cyclists and fled the scene 694 times, up from 497 in 2022. That is a 39.6% increase over four years, outpacing the growth in total bike accidents and amounting to roughly 1 in 3 bike crashes citywide.

“What stands out in the data is that the hit-and-run problem is growing faster than the accident problem itself,” said Paul Greenberg, partner at Briskman Briskman & Greenberg. “Drivers are choosing to flee at an accelerating rate. For an injured cyclist lying in the road, that decision compounds every other danger they already face.”

The firm’s analysis also identified specific corridors and dangerous roads in Chicago where the risk is concentrated. N. Milwaukee Ave recorded 329 bike accidents over the study period, the most of any road in Chicago. N. Clark St followed with 274, and the combined Halsted corridor (N. Halsted St and S. Halsted St) accounted for another 318 accidents. W. North Ave registered the highest hit-and-run concentration among high-volume corridors at 38.2%.

Driver behavior tells the story behind the numbers. Failing to Yield Right-of-Way is the single most identifiable cause, responsible for 2,165 accidents and 1,777 injuries. Improper Overtaking or Passing accounts for fewer accidents in total but carries a 49.0% hit-and-run rate, meaning a driver who illegally passes a cyclist is more likely than not to leave the scene.

“When you injure someone in an accident and you flee, you’re potentially facing a serious criminal charge,” Greenberg told Hawes in the segment.

Beyond the criminal exposure drivers face, injured cyclists often have civil remedies available even when the at-fault driver is never identified. Uninsured motorist coverage, underinsured motorist coverage, and other options may apply. The Court ruled that a Federal Aviation Administration Authorization Act exception for state safety regulation covers claims that one company negligently hired another to transport goods. Justice Amy Coney Barrett wrote the opinion. The decision allows a man who lost part of his leg in a 2017 tractor-trailer crash to proceed with his lawsuit against Minnesota-based freight broker C.H. Robinson.

The plaintiff alleged that C.H. Robinson hired Caribe Transport II despite a recordable crash rate that should have signaled the carrier was likely to injure someone on the road.

“For families who have lost loved ones or who are living with catastrophic injuries from a truck crash, this ruling matters,” said Hatfield, founder of the Law Office of Jason M. Hatfield, P.A., based in Springdale with an additional office in Fort Smith. “Until now, brokers in many cases could point at the carrier and walk away. The Court has confirmed that when a broker chooses a carrier with a known safety problem, that choice is part of the case.”

Hatfield has practiced personal injury law in Arkansas for more than 25 years, with a focus on motor vehicle and trucking cases. He noted that Arkansas roads are among the deadliest in the country for large truck crashes. State data shows Arkansas has lost between 600 and 700 people each year in motor vehicle accidents since 2020. A TRIP study placed Arkansas in the top five states for fatal large truck crashes.

“Most of the truck cases I handle involve a chain of decisions that started long before the crash,” Hatfield said. “Who was hired, what their record looked like, whether anyone bothered to check. The Supreme Court has now said that piece of the chain belongs in front of a jury.”

The Court’s opinion explained that the Federal Aviation Administration Authorization Act, passed in 1994 and later amended to cover brokers, preempts state laws related to prices, routes, and services. The justices held that state authority to regulate safety with respect to motor vehicles survives that preemption, and that a negligent hiring claim falls within the safety exception.

The Arkansas Trucking Association reacted positively to the ruling. Industry trade group the Transportation Intermediaries Association expressed disappointment, arguing that brokers do not have access to the carrier records needed to evaluate safety. Hatfield said modern broker platforms collect more carrier information than they often admit.

“Brokers run sophisticated technology,” Hatfield said. “They see safety scores, inspection results, and crash histories. They have a choice about which carriers they put on a load. The families I represent are not asking for the impossible. They are asking brokers to act on the information already in front of them.”

Hatfield encouraged Arkansas families affected by a serious truck crash to ask questions about every company connected to the load, not just the driver or the trucking company.

“The driver is the most visible person in a truck crash, but the driver is rarely the only person who made a decision that mattered,” he said. “Sometimes the most important decision was made weeks earlier in a broker’s office.”
