The firm represents the estate of Lily Carle, a resident with dementia who died after a preventable fall which occurred less than 12 hours after being admitted to the facility&#8217;s memory care unit. </span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400">According to the wrongful death complaint, Carle suffered severe neglect during her time at the facility, including multiple preventable falls and inadequate supervision. The lawsuit alleged that staff failed to properly monitor residents with dementia and high fall risks, failed to implement appropriate fall prevention measures or provide sufficient assistance with daily living activities, and delayed obtaining emergency medical care as Carle’s health deteriorated.</span></p>

This decision now governs Hague Convention proceedings in California courts and reflects McKeon&#8217;s command of both international family law and the California appellate process at its most consequential.</p>



<p class="p2 wp-block-paragraph">Her additional published decisions — Plummer v. Day Eisenberg (2010) on attorney liens and quantum meruit, and Wilson v. Shea (2001) on child support and travel credits — span the full financial and procedural breadth of family law. Her national publication record includes two chapters in the Matthew Bender Child Custody and Visitation Guide for 50 States (2002, 2003), a contributing authorship in the Continuing Education of the Bar&#8217;s Domestic Violence Remedies in California Family Law Cases (2008), and the co-authored mainstream press book Stop Domestic Violence: An Action Plan for Saving Lives (St. Martin&#8217;s Press, New York, 1997).</p>

<p class="wp-block-paragraph"><strong>Detroit, Michigan</strong> &#8211; The ongoing search for accountability and justice in the aftermath of the 2020 <a href="https://lawfirmnewswire.com/2023/09/midland-dam-flood-victims-can-seek-compensation-after-sommers-schwartz-gets-a-victory-in-the-michigan-court-of-appeals/">Edenville Dam collapse</a> will be in the spotlight as Detroit’s Local 4 News airs “Washed Away in Edenville” on Thursday, Nov. 13, at 5:30 p.m. The special broadcast comes at a critical juncture in the litigation, as the Michigan Court of Claims recently issued a detailed opinion allowing plaintiffs’ central expert witness to testify in the landmark case, David Krieger, et al. v. Michigan Department of Environment, Great Lakes, and Energy, et al. (Case Nos. 20-000094-MM and related matters).</p>



<p class="wp-block-paragraph">The May 19, 2020, failure of the Edenville Dam, followed by the overtopping of the Sanford Dam, led to catastrophic flooding across Midland, Saginaw, Arenac, Gladwin, and Losco counties. Nearly 11,000 residents were forced to evacuate, and more than 2,500 homes and buildings were damaged or destroyed. Damages have been estimated at over $1 billion, according to court filings.</p>



<p class="wp-block-paragraph"><a href="https://www.sommerspc.com/" target="_blank" rel="noopener">Sommers Schwartz, based in Detroit</a>, represents plaintiffs in the consolidated litigation pending before Hon. James Robert Redford in the Michigan Court of Claims. The lawsuits allege that state agencies, including the Michigan Department of Environment, Great Lakes, and Energy (EGLE) and the Michigan Department of Natural Resources (DNR), engaged in actions and omissions that substantially contributed to the dam’s failure, resulting in devastating losses for thousands of Michiganders.</p>



<p class="wp-block-paragraph">Central to the plaintiffs’ case is the testimony of William Sturtevant, a professional engineer and accomplished dam safety expert. In a recent opinion and order, Judge Redford denied the state’s motion to bar Sturtevant’s testimony, finding that his report and qualifications meet Michigan’s standards for expert evidence. The court’s analysis relied on the Michigan Rules of Evidence and key legal precedents, including the U.S. Supreme Court’s Daubert v. Merrell Dow Pharmaceuticals, Inc., which guides the admissibility of scientific and technical expert testimony.</p>



<p class="wp-block-paragraph">In his order, Judge Redford stated, “Sturtevant’s opinions easily satisfy this standard. Defendants acknowledge, and the Court agrees, that Sturtevant is qualified as an expert in dam safety and regulation whose testimony in this area is based on methods and procedures that are well-recognized in his field.” The court emphasized that the role of the judge at this stage is to act as a gatekeeper, ensuring that expert opinions presented at trial are both relevant and reliable, but not to weigh competing evidence before trial.</p>



<p class="wp-block-paragraph">The opinion further noted that Sturtevant’s declaration spans 22 pages and addresses technical questions central to the case, including the extent of state knowledge about the dam’s hazardous condition and the regulatory actions taken leading up to the disaster. Plaintiffs allege, as detailed in court documents, that state regulators “willfully and with reckless disregard” ignored escalating risks, compounding the danger to the public and ultimately contributing to the dam’s collapse.</p>



<p class="wp-block-paragraph">The court rejected the state’s arguments that the expert report’s form was insufficient, writing, “Simply put, the fact that plaintiffs submit Sturtevant&#8217;s expert report in the form of a declaration does not support exclusion of Sturtevant&#8217;s testimony at trial or another sanction under MCR 2.313.”</p>

<p class="wp-block-paragraph"><span style="font-weight: 400;">The lawsuit, led by attorneys </span><a href="https://www.sommerspc.com/people/lisa-esser-weidenfeller/" target="_blank" rel="noopener"><span style="font-weight: 400;">Lisa M. Esser</span></a><span style="font-weight: 400;"> and </span><a href="https://www.pittlawpc.com/megan-bonanni" target="_blank" rel="noopener"><span style="font-weight: 400;">Megan Bonanni</span></a><span style="font-weight: 400;">, alleges that Figueroa-Berrios sexually assaulted vulnerable female patients for years while working as a registered nurse at Detroit’s Sinai-Grace Hospital, a facility operated by Tenet Healthcare and its subsidiaries. The complaint seeks class action status on behalf of all Michigan women who were reportedly assaulted or harassed by Figueroa-Berrios while they were patients at the hospital.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">According to the complaint, the Detroit Police Department identified numerous former female patients who may have experienced sexual assault by Figueroa-Berrios during his employment at the Detroit Medical Center (DMC) Sinai-Grace Hospital. The court filing details multiple incidents, including an August 2025 episode for which Figueroa-Berrios faces criminal charges, as well as other alleged assaults stretching several years back.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">The case not only targets Figueroa-Berrios as an individual but also the hospital’s corporate owners, asserting that Tenet Healthcare, VHS of Michigan, and VHS Sinai-Grace Hospital failed to properly screen, supervise, or remove Figueroa-Berrios despite warning signs and past allegations of misconduct. The complaint alleges that these failures created conditions in which vulnerable patients were exposed to sexual abuse.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">Plaintiff Jane Doe 1, the named representative for the proposed class, alleges she was sexually assaulted by Figueroa-Berrios during a visit to Sinai-Grace Hospital’s emergency department in March 2025. The complaint suggests that the assault occurred under the guise of medical care, violating accepted standards of nursing practice and pointing to broader institutional lapses in supervision and patient safety.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">In 2024, the Michigan Department of Health and Human Services reportedly found Sinai-Grace Hospital out of compliance with patient protection standards, citing deficiencies in abuse reporting, staff training, and oversight. The complaint further references a 2024 state licensure survey that found the hospital failed to conduct fingerprint-based background checks on new hires, including nurses with direct patient contact.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">The lawsuit asserts claims of negligence, negligent hiring and supervision, premises liability, and violations of Michigan’s Elliott-Larsen Civil Rights Act. The complaint seeks damages on behalf of the class for physical and emotional harm and asks the court to certify the class action under Michigan law.</span></p>



<p class="wp-block-paragraph"><span style="font-weight: 400;">Attorneys for the plaintiff argue that the case underscores broader concerns about patient safety and the responsibility of healthcare institutions to protect those in their care, particularly in facilities serving vulnerable populations.
