Rideshare services have revolutionized private transportation. Gone are the days of standing on a street corner hoping to hail a taxicab. Instead, millions of people throughout the world book their rides from the comfort of their homes or from restaurants, airports, and sporting events and then walk out directly to a vehicle and driver waiting for them.

Unfortunately, this convenience has come with a cost: safety. Rideshare apps have loose requirements for hiring drivers, and that can put their customers at risk. To make matters worse, rideshare drivers are often distracted by their phones. They need their phones to work and to get to their destinations on time, but that also means they aren’t paying close attention to the road.

In addition to being distracted, rideshare drivers are also pressed for time. They are under significant pressure to get their customers to their destinations as quickly as possible. In order to accomplish that, some drivers speed, run red lights, follow too closely, change lanes without signaling, and more. They may willingly put themselves, their passengers, and other motorists in danger to shave a few minutes or even seconds off their drop-off times.

At Ferrer, Poirot & Wansbrough, we know that it’s hard to beat rideshare services for their convenience and ease of use, but we also know how dangerous they can be for many customers. If you or someone you love was hurt in a rideshare accident, you may be eligible for compensation. Contact our rideshare accident attorneys for a free consultation.

In Nov. 2022, Walmart announced that it would pay $3.1 billion to settle opioid lawsuits filed by state and local governments for its role in the nation’s opioid crisis. To date, more than 500,000 people are estimated to have died as a result of opioid use and misuse in the U.S. during the past 20 years.

Opioids are highly effective painkillers that are also highly addictive. Countless Americans have experienced severe health problems as a result of opioids and their addictive properties, and the CDC says that the number of opioid overdose death is increasing annually. It’s estimated that more than 75,000 people died from opioid overdoses in a 12-month span from April 2020-2021 alone.

At Ferrer, Poirot & Wansbrough, we believe that opioid manufacturers and distributors, including large supermarkets and pharmacies, should be held accountable for their role in the nation’s opioid epidemic. These powerful and addictive drugs have ravaged entire cities and communities throughout our nation and have cost innocent people their savings, their careers, and even their lives.

If you or someone you love was harmed by an opioid, including fentanyl, hydrocodone, oxycodone, or hydromorphone, we want to help you get the compensation you’re owed. The parties behind these drugs knew their dangers and addictive potential and continued making, selling, and recommending them to vulnerable people and populations—all in the name of profit.

Contact our drug injury lawyers anytime for a free consultation. You shouldn’t have to deal with the devastating effects of an opioid injury, addiction, or overdose alone.

Millions of women use chemical hair straighteners in America, and studies show that women who use them at least five times per year are 2.5 times more likely to develop uterine cancer than women who don’t.

This conclusion came after an 11-year study that followed more than 33,000 women. Women typically have around a 1.64% chance of developing uterine cancer by age 70, but for those who frequently used chemical hair straighteners, their risk increases to 4.05%.

Because Black women use chemical hair straighteners more frequently and at earlier ages than women from other races and ethnicities, these results are considered particularly relevant to them.

Chemical hair straighteners are believed to be linked to uterine cancer due to their harmful effects on the female reproductive system. Some of the chemicals contained in chemical hair straighteners can disrupt the production of hormones, and those chemicals are more easily absorbed into the body due to the products causing inflammation and abrasions on the scalp.

At Ferrer, Poirot & Wansbrough, we know how devastating all types of cancer can be to women as well as men, especially when they’re preventable and are caused by defective or dangerous products and drugs. If you or someone you love developed uterine cancer or another type of reproductive cancer after frequently using chemical hair straighteners, we want to hear from you.

On Nov. 17, 2022, the Federal Motor Carrier Safety Administration (FMCSA) ordered two trucking companies based in Houston to cease all interstate and intrastate operations due to posing an “imminent hazard” to public safety.

The FMCSA order was due to excessive violations for things like drug and alcohol usage, unlicensed drivers, drivers with no records of duty status, avoiding required weigh-ins and inspections, and more. In addition to receiving an order to cease operations, the trucking companies were also fined for each violation.

At Ferrer, Poirot & Wansbrough, we know how dangerous FMCSA violations can be for drivers who need to share the road with big trucks. Trucking is an essential but dangerous industry, and truck drivers, truck companies, and truck owners must follow all safety precautions to reduce their risk of causing serious and potentially fatal accidents. When they don’t, these negligent truck companies risk being shut down and sued by injured victims.

Our Dallas truck accident lawyers help injured truck accident victims get the compensation they’re owed for disabling injuries, including medical bills, years of lost wages, and immeasurable pain and suffering.

Getting compensation after truck accidents isn’t easy, and insurance companies often wage fierce fights to avoid paying victims the money they’re owed. However, we’re confident in our experience and abilities to win against even some of the biggest trucking companies and insurers in the state and the U.S.

As Dallas car accident lawyers, we know that there are many major misconceptions about personal injury lawsuits among injured victims and their families. One of the most common is that people who are partially at fault for their accidents and injuries can’t file injury claims.

While that’s true in a handful of states in the U.S., it’s not true in Texas. The Lone Star State has a modified comparative negligence law for injury claims. It means that as long as you are less than 51% at fault for your accident or injury, you can still sue for your damages for things like medical bills, lost wages, and pain and suffering.

However, the amount of money you can receive is reduced by your percentage of fault. That means if you’re hurt in a car accident that was caused by a driver who ran a stop sign at night, but you were assigned 10% of fault for driving with a burned out headlight, you will lose 10% of your settlement. In other words, a $10,000 settlement would be reduced to $9,000.

The amount of money you may be eligible to receive, even with a reduced settlement, is likely to be significant and enormously helpful when it comes to paying for your accident-related expenses. That’s why you should always contact a lawyer after a crash, even if you were assigned partial fault.

Contact the experienced legal team at Ferrer, Poirot & Wansbrough for a free consultation after a crash. We’ve helped victims with a wide range of fault assigned to them after accidents, and we know how to maximize our clients’ compensation.

If your loved one lives in a nursing home, you may worry about their health and well-being. Nursing homes are designed to provide a level of care and attention that families can’t give their loved ones at home, but too many nursing homes in the U.S. and the Dallas-area are designed only to rake in big profits—not provide top-level care.

When nursing homes focus primarily on profits, they may cut corners in many ways that ultimately harm residents. For example, they may fail to hire enough staff to check on residents often enough throughout the day to ensure they get the care and attention they need. They also may hire inexperienced and unqualified staff members to care for residents. These staff members may make the wrong decisions or fail to follow-up on potential problems that they encounter while caring for residents.

Nursing homes that are excessively profit-driven often put residents at risk for both abuse and neglect. When staff members are overworked due to understaffing, they may lash out at residents more frequently and violently. They also may be stretched so thin that they forget about residents or are forced to leave residents alone for long periods of time.

At Ferrer, Poirot & Wansbrough, our team of Dallas nursing home abuse lawyers believes that all nursing home residents should be treated with respect, dignity, and care. In Texas, nursing home residents are granted certain rights, and when those rights are violated, we hold the violators accountable for any injuries or damages that occur.

Contact us anytime if you suspect your loved one is a victim of nursing home abuse or neglect. We want to help your family get maximum compensation.

Around seven million Americans are living with joint replacements. Whether they’re hip, knee, or ankle replacements, lower-body joint replacements can give patients their mobility and independence back after injuries and bone degeneration. However, they can also put them at risk for serious complications.

Several joint replacement manufacturers have released products that are linked to dangerous complications, including:

Bone loss

Joint dislocation

Hip pain

Joint instability

Infection

Implant loosening

Swelling and inflammation

People who have defective joint replacements suffer from these symptoms, and their only option for getting relief is by having their joint replacements surgically removed and replaced. This means they must endure potentially dangerous surgeries, long recovery times, and big medical bills.

At Ferrer, Poirot & Wansbrough, we believe this is unacceptable. Patients shouldn’t have to suffer because a product manufacturer chose profits over safety, but that’s exactly what’s happening to countless joint replacement patients nationwide.

If you or someone you love received a defective joint replacement that has failed or is failing and are suffering from serious complications, our defective medical product lawyers want to help.

On Oct. 17, 2022, Insulet Corporation announced it was recalling all of its Omnipod DASH® Personal Diabetes Managers (PDMs) worldwide. This recall was initiated after the company received 50 complaints concerning the devices having issues with their batteries, including swelling, leaking, and extreme overheating, which has resulted in fires. The device is prone to failure when overcharged beyond the maximum battery voltage, which the company says can lead to potentially serious injuries or death.

Insulet says that it will begin shipping updated Omnipod DASH PDMs to current users during the coming months. All affected customers will be notified by email and local mail about the issue and steps to receive a replacement, as well as instructions to help them reduce the risk of their PDMs having potentially dangerous battery issues.

At Ferrer, Poirot & Wansbrough, we know how stressful it can be when medical devices are recalled, especially when they pose dangers to users. Countless patients throughout the U.S. trust their medical devices to help them control their health problems, only to later find out that a defective design or manufacturing process is putting them at risk for injuries they never could have anticipated.

If you or someone you love was harmed by a defective medical device, it’s important to get the experienced legal representation you deserve.

Earlier this year, Congress passed the PACT Act, which included the Camp Lejeune Justice Act. These acts paved the way for countless people who were harmed by the toxic water at Camp Lejeune in Jacksonville, North Carolina to receive benefits and compensation for serious health problems they suffered as a result of being exposed to the contaminated water on the U.S. Marine Corps base.

If you or someone you love was harmed by Camp Lejeune’s water, we want you to know that you still have time to file a claim to get the compensation you’re owed. The U.S. military knew that Camp Lejeune’s water was potentially dangerous for many years, and servicemembers and their families were exposed to it for more than 30 years between 1953 and 1987.

With Congress approving the PACT Act, the path to compensation for victims has never been clearer or more straightforward than right now. The Veterans Administration website has all the info you need about Camp Lejeune water-related injuries, illnesses, and the available benefits that victims and their families can receive. While you can file for benefits on your own through the VA.gov portal, having an experienced lawyer on your side can help you expedite your claim and increase your chances of success.

At Ferrer, Poirot & Wansbrough, we believe in holding negligent parties accountable when innocent people are injured—and that includes the U.S. government and military. Contact us today for a free consultation of your Camp Lejeune injury or illness claim.

Benzene is a chemical that’s found naturally in the environment and in many products. When products have benzene levels that are above the accepted standard, they can put people exposed to them at a higher risk of developing certain types of cancer.

Recently, Unilever United States issued a voluntary product recall of several of its dry shampoo products due to them containing elevated levels of benzene. The brand names with recalled products include Dove, Nexxus, Suave, TIGI, and TRESemmé.

Retailers have already been notified to remove the products from their shelves, and if you or someone you love owns any dry shampoo products from these brand names, stop using them immediately. You can also visit UnileverRecall.com to learn how you may be eligible for a refund for your purchase.

Unfortunately, many people who are harmed by defective products need far more than a simple refund of their purchase. They need compensation for their related medical bills, lost wages, pain and suffering, and more. However, they may feel helpless when it comes to going up against multi-billion-dollar corporations.

At Ferrer, Poirot & Wansbrough, that’s part of our bread and butter. We take on some of the biggest companies in the world every day when their negligence puts innocent people in harm’s way. If you or a loved one were hurt by a defective dangerous product, we want to help. Contact our defective product lawyers today for a free consultation.
