<p><strong>Background information<br />
</strong></p>
<p>Former police officer turned professor Phil Stinson conducted a national analysis of more than 500 officer arrests for sexual misconduct over a three-year period. He found that half involved on-duty misconduct and noted that off-duty misconduct is often facilitated by the power of the badge or the presence of an official service weapon.</p>
<p>In a second study, funded by the National Institute of Justice and analyzing more than 6,700 officer arrests nationwide during a seven-year period, found that half of police arrested for sexual misconduct were for incidents involving minors. </p>
<p>According to a 2010 Cato Institute review, sexual misconduct is the second-most-frequently reported form of police misconduct, after excessive force.</p>
<p>Research consistently shows that police officers target young women. A 2000 survey of nearly 1,000 New York City youth found that 2 in 5 young women — almost half of whom were black, Latina or Asian — reported sexual harassment by officers. </p>
<p>A 2003 national study of cases reported in the media over more than a decade, conducted by the Police Professionalism Initiative at the University of Nebraska at Omaha, found that 40 percent of reported cases of police sexual misconduct involved teens.</p>
<p>Officers also prey on domestic-violence survivors, who are particularly vulnerable to abuses by people they call on for protection. One officer quoted in an investigative report by the Philadelphia Inquirer said, &#8220;I would see women that were vulnerable where I could appear as a knight in shining armor.&#8221; He explained, &#8220;I&#8217;m going to help this woman who&#8217;s being abused by her boyfriend, and then I&#8217;ll ask for sexual favors.&#8221;</p>

That is true for those involved in civil rights work, as well as everyone in society. Activists who support racial equality, gun rights, gay rights, and just about every other issue have been targeted by the police and other governmental agencies. Whether a person&#8217;s politics lean left or right, speaking up can cause governmental scrutiny and abuse. Beyond governmental abuses, common criminals steal identities and data, causing billions of dollars of harm and much grief every year.</p>
<p>The good news is that a few simple steps can go a long way towards improving your privacy and security, and that those steps will help prevent abuses by governments and criminals alike.  </p>
<p>For the short version of what to do, I would recommend the following:</p>
<p>1. <a href="https://signal.org/">Install the Signal app</a>. It allows for secure, end-to-end encrypted text messaging, group chats, voice calls, and video chats. Then, get your friends to install and use Signal too.</p>
<p>2. <a href="https://www.torproject.org/">Use the TOR Browser</a>. TOR provides anonymous web browsing, blocking trackers and defending against surveillance.</p>
<p>3. Use a strong password for your phone.  Simple passwords can be easily broken.  If you believe your phone may be taken, turn it off so that fingerprint/FaceID unlocking can&#8217;t be used to gain access to your phone.</p>
<p>4. Enable privacy settings on your phone. There are guides for <a href="https://www.techradar.com/how-to/how-to-protect-your-privacy-on-your-android-phone">Android</a> and <a href="https://mashable.com/article/apple-iphone-privacy-settings/">iPhone</a> that go over the various settings.</p>
<p>5. Use a password manager.  Using a password manager makes it easy to use strong, random passwords for each website. This is much more secure than reusing the same (easy-to-remember and therefore weak) password on each website. There are numerous commercial and free options.</p>
<p>6. Enable 2 Factor Authentication everywhere you can. 2 Factor Authentication involves using an app such as Google Authenticator to generate a 6 digit code that changes frequently.  When you log in, you enter not only your username and password, but the proper 6 digit code. That way, a person who has stolen your username and password cannot log into your account unless they can also access that app on your phone.</p>

<p><strong>Cruelty and depraved hearts can&#8217;t be fixed with training</strong></p>
<p>Some problems can be fixed by training, while others cannot.</p>
<p>A pilot who is unskillful due to a lack of training can have their airmanship improved through additional training. That makes sense, as the pilot desires to do a better and safer job of flying. That is especially true because a pilot (by virtue of their seat at the front of the plane) is actually the first person to arrive at the scene of crash if they make an error. Since the pilot&#8217;s doesn&#8217;t wish to crash, and does wish to become more skillful, additional training does work to improve pilots. Indeed, it is mainly that additional training &#8211; especially crew resource management training &#8211; that has led to aviation being so much safer today than it was 50 years ago.</p>
<p>Unfortunately, police brutality is a different story. Police brutality is caused by police officers intentionally setting out to inflict harm upon their victims. Unlike plane crashes that pilots desperately wish to avoid, police brutality is not something that bad cops try to avoid; it is something that those bad cops intentionally do. Unlike plane crashes that are just as bad for the pilots as they are for the passengers, the bad cops who engage in police brutality are not the ones physically hurt. Nor are the cops who engage in brutality generally harmed in other ways, since the legal system protects the overwhelming majority of cops who engage in such misconduct. Taken together, the intentional nature of police brutality and lack of an incentive for police to cease it mean that more training cannot be the solution.</p>
<p>Since a picture is worth a thousand words, and since video has many frames (pictures) per second, the following video clips should help drive home the point that the brutality police officers enthusiastically engage in is intentional cruelty, rather than something that can be fixed by training:</p>

<p><strong>Police training actually makes things worse</strong></p>
<p>It is worth nothing that the training given to police is often a very cause of the brutality that police engage in. The &#8220;<a href="https://harvardlawreview.org/2015/04/law-enforcements-warrior-problem/">warrior training</a>&#8221; that many cops receive teaches them to see the public as the enemy and only serves to <a href="https://www.msn.com/en-us/news/us/one-of-americas-most-popular-police-trainers-is-teaching-officers-how-to-kill-with-fear-based-warrior-tactics/ar-BB14WbY9">increase brutality on the part of the police</a>.  This training teaches police officers to fear the public and to endanger the very people they are sworn to serve and protect by encouraging (often baseless) fear in the minds of cops. More funding for this training would only produce more brutality.</p>
<p><strong>Calls for more training is just a deflection intended to increase police budgets</strong></p>
<p>The calls for additional training are worse than useless, as they really are just attempts to increase police budgets that are already bloated. The $118 billion dollars that was spent on US police in 2018 is astronomical. That is an amount <a href="https://boingboing.net/2021/04/20/u-s-policing-budgets-would-rank-as-the-worlds-third-highest-military-expenditure.html">sufficient to exceed MILITARY spending of every country in the world other than the USA and China</a>. With a budget like that, there is no shortage of funds for training.</p>

Instead, you see people mourn the loss of life and then demand an impartial investigation into what happened so that any accidents, mistakes, errors, or crimes can be appropriately addressed.  That is why the various design defects and pilot errors in the Boeing 737 have been detected and corrected, thereby saving many lives.  That is why in most years, 0 people die in airliner crashes in the USA.</p>
<p>When the police kill someone (as happened locally yesterday), there is a vocal contingent of people who start &#8220;backing the blue&#8221; and talking about how being a cop is such a hard job. If those people were present in aviation to impede progress the way they impede progress on police brutality and racism, we would have airliners falling out of the sky every week.</p>

Guns have been essential for protecting black civil rights since the antebellum period, Cottrol tells Reason.</p>
<p>Following &#8220;the tremendous push&#8221; for black voter registration in the 1950s and &#8217;60s, when the Ku Klux Klan decided to try to &#8220;intimidate and kill&#8221; those who were involved, Cottrol says, &#8220;you have [armed] groups beginning to be formed designed to protect the black community and the Civil Rights community.&#8221;</p>

<p>Under House File 756, an adult Iowan will be able to conceal carry without having to beg the government for a permit. Permits will still be optionally available for reciprocity reasons to carry in other states. </p>
<p>Iowa is set become the 19th state to recognize American citizens have a right to carry firearms without getting a permission slip. </p>
<p>While we hope Governor Reynolds is already planning on signing this into law, we need your help to urge her to pass HF 756 ASAP, and restore your Constitutional rights! </p>

<p><strong>The text of the First Amendment</strong></p>
<p>Freedom of speech is enshrined in the First Amendment to the United States Constitution. The text of the First Amendment reads as follows:</p>
<blockquote><p>Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.</p></blockquote>
<p>In a nutshell, the 1st Amendment means that federal, state, and local governments are prohibited from preventing or punishing speech. There is nuance to that in that some speech that is criminal can be prohibited and punished. One classic example is how falsely yelling &#8220;fire&#8221; in a crowded venue so as to incite a dangerous panic is a crime. Another example would be that speaking to a hitman to have a person killed is also criminal. The fact that both of those crimes involve speech doesn&#8217;t run afoul of the First Amendment. But, the point is clear: the 1st Amendment applies to prevent the <em>government</em> from punishing or preventing most speech, and the goal behind that protection is to ensure that political speech is not prevented by the <em>government</em>.  The rationale is that a government which can prevent itself from being criticized will turn tyrannical, and the founders of the country wanted to prevent that from happening.</p>
<p><strong>The First Amendment (and rest of the Bill of Rights) apply against the Government only</strong></p>
<p>The First Amendment applies only against the government, as the plain language shows. Court case after court case has made that clear. Indeed, that makes sense, as the bill of rights (where the 1st Amendment is found) is there to restrain the power of government, not to control individuals or companies:</p>
<ul>
<li>The 1st Amendment protects people against the government controlling or punishing their speech.</li>
<li>The <a href="https://www.learnaboutguns.com/2008/06/26/district-of-columbia-v-heller-supreme-court-declares-gun-ownership-an-individual-right/">2nd Amendment</a> protects people against the government infringing their ability to have guns and other arms.</li>
<li>The 3rd Amendment protects people against the government forcing them to house and feed soldiers in their homes.</li>
<li>The 4th Amendment protects people against the government unreasonably searching and seizing their property.</li>
<li>The 5th Amendment protects people against the government making them testify against themselves.</li>
<li>The 6th Amendment protects people against the government denying them a jury trial or a lawyer (and other rights of the accused).</li>
<li>The 7th Amendment protects people from the government&#8217;s federal court in a civil context.</li>
<li>The 8th Amendment  protects people from the government imposing excessive bail, cruel punishment, etc.</li>
<li>The 9th and 10th Amendments act as a catch-all to say that the government is retrained in general from doing things it is not otherwise authorized to do, thereby further protecting the people from the government.</li>
</ul>
<p><strong>Individuals and companies cannot violate free speech</strong></p>
<p>The takeaway here is that the 1st Amendment protects people from the government. The 1st Amendment does not, and was never intended, to prevent private actors such as individuals or companies from deciding who they will hire, associate with, fire, or ridicule.</p>
<p><span style="text-decoration: underline;">Indeed, the whole purpose of free speech is to have a marketplace of ideas where the best ideas win out, and the repugnant ideas (and those who embrace them) feel the negative consequences.  By preventing the government from silencing our punishing people for speech, the First Amendment ensures that marketplace will exist &#8211; and it would be nonsensical to think that the First Amendment should then be used to prevent the marketplace from working as intended.</span></p>
<p>When Twitter banned <a href="https://www.learnaboutguns.com/2020/06/05/trump-race-and-police-brutality/">Donald Trump</a>, his free speech rights were not violated. When an actor is fired by a studio for their racism, there was no free speech violation. When a racist relative is uninvited from Thanksgiving or blocked on Facebook, there is no free speech violation. Each of those people are not being silenced or punished by the government, and are free to take their speech elsewhere if they wish. The marketplace of ideas is working as intended.</p>
<p>Individuals and companies are free to decide with whom they will associate, and who they will allow to use their property. That is true whether the property at issue is Twitter&#8217;s server, a movie studio&#8217;s building, or an individual&#8217;s dining room table.  Indeed, it would actually be a constitutional violation if the government (through a law or through its courts) forced someone to allow another to use their server, building, or dining room table.</p>
<p><em>Note: For the sake of completeness, please note that there is always much nuance in every complex constitutional issue. The foregoing is intended as an overview, not a 1,000 page treatise that fully explores every facet. Nonetheless, the foregoing is an accurate summary and correctly disposes of the untrue notion that a person&#8217;s freedom of speech is being violated when a private individual or company chooses not to associate with someone as a result of their speech.</em></p>

<p>If you think that being unarmed or supporting anti-gun laws is a prudent response to recent events (e.g. the attack on the capitol and the risk of white supremacist violence) then your thought process is defective.</p>
<p>Remember, there are more guns than people in this country, and 2020 set records for gun/ammunition sales. The violent people you worry about are already armed to the teeth, and it is laughable to think they would obey a gun control law when they are willing to disobey so many other laws (like the law against murder). As an attorney who has handled murder cases and felon in possession of firearms cases, allow me to assure you that people who want guns will get them, and no law will ever change that.</p>
<p>So, if you want to actually do something productive about the issue of violence, I would suggest starting by ensuring that you and your loved ones can defend yourselves. The police aren&#8217;t going to save you from violence, and neither will gun control laws. So, I invite you to learn about guns, get your permit to carry, get a gun, and practice using it. Teach your children and other relatives how to be safe and responsible gun owners. When it comes to children, studies have shown that children who are taught safe and lawful gun ownership are less likely to be involved in gun-related crime than children who do not receive that education.</p>

		<content type="html" xml:base="https://www.learnaboutguns.com/2020/10/18/why-i-wont-waste-my-time-debating-with-you/"><![CDATA[<p>I spend a fair amount of time on in-person and online discussions about politics, civil rights, gun rights, etc.  While I love a good debate, I have come to recognize that not all debates are worth having. So, if you&#8217;re reading this, I&#8217;ve determined that debating with you is not worth my time for one or more of the following reasons:</p>
<p>1. <strong>Ignorance on your part makes a debate pointless</strong>. Debating the relative merits of different viewpoints only makes sense when both people have spent a somewhat similar amount of time to educate themselves on the basic facts of a situation. By way of example, a person with a Ph.D in orbital mechanics would be wasting their time if they had a debate about whether the earth is round or flat with a person whose formal education ended at the 10th grade, and who thinks YouTube conspiracy theory videos which say the earth is flat are the pinnacle of knowledge.  The situation is similar when I (as an attorney who has litigated cases involving police brutality and racism) am debating with someone who has spent all of 10 minutes thinking about the issues and whose sources of information are <a href="https://www.learnaboutguns.com/2020/06/05/trump-race-and-police-brutality/">Trump</a>&#8216;s talking points.  Since the amount of time I have available for debates is limited, that time is best spent on meaningful discussion with people who have taken the time to learn basic facts. It just isn&#8217;t worth my time to have this discussion with you as doing so would prevent me from using my limited time for a discussion that is actually meaningful.</p>
<p>2. <strong>Debating with you is a waste of time because you are debating in bad-faith</strong>. Some people&#8217;s lives are so devoid of meaning from work and enjoyable hobbies that they spend hours of their time online &#8220;trolling&#8221; other people for amusement value.  Since I would much rather work as an attorney, fly an airplane, shoot guns, practice martial arts, or otherwise enjoy my life than troll people, I don&#8217;t get how anyone gets enjoyment from doing so. But, some people do, and I&#8217;m not going to waste time debating with them. I hope that those people are able to one day recognize that serious political issues are not a game, and that playing games with people&#8217;s rights and lives is pathetic.</p>
<p>But, just because I won&#8217;t spend my time debating this particular issues doesn&#8217;t mean that I hate you (I don&#8217;t). It doesn&#8217;t mean that I won&#8217;t debate other issues with you where the above reasons for me refusing this debate don&#8217;t apply.</p>
<p>What I do want is for you to take the time to develop a better understanding of the issues.  Towards that end, the following links will give you my thoughts on some important issues related to what I refused to spend my time to debate with you.  If you feel like reading, go right ahead. <p>It is not the role of a citizen to quit their job and start a new job working for the government in order to fix a problem with how the government is rendering a service.  The idea that a person should have to give up their existing career and become a government employee before they can object to existing government employees committing murder is beyond ridiculous.</p>
<p>By that same logic, if the post office decides to shred and burn my mail I should have to quit my job and become a mail carrier before I can complain.  If the city-owned water company starts pumping sewage instead of fresh water through my water pipes, I should have to quit my job and work for that water company before I can object.  If the garbage service run by the city crashes into my car every week, I should apply for a job before I voice my displeasure.  Obviously none of that makes any sense, and neither does the Dallas police chief&#8217;s retort.</p>
<p>The real problem with this argument is that it is yet another attempt to deflect from the very real issue of police brutality.  Failing to address that problem is costing lives, and the sooner we cut through baseless retorts and get to work on fixing the issue, the sooner that lives will not be needlessly lost.</p>

<p>I&#8217;ve seen some variation of the image shown below posted by some friends. Please allow me to explain why this is utter garbage.</p>
<p>The reason why we protest police brutality and racism is because the police (who are sworn to serve and protect, and who are paid with our tax dollars) get away with murder and lesser forms of brutality on a daily basis. The law as written prevents the police from being held accountable, and leaves us vulnerable to abuse by the government. The goal of the protests is so seek a change in that legal and political situation such that the police stop engaging in that brutality and racism.</p>
<p>As a simple example, the police who killed Breonna Taylor as she slept in her own bed have not been charged as I write this article months later. Similarly, the cop who invaded Botham Jean&#8217;s home and murdered him was initially free to walk away from the scene of the murder without charges. Those situations and many more warrant protests.</p>
<p>There is absolutely no reason to protest in regard to the murder of Cannon Hinnant, as the person responsible was swiftly apprehended and charged with murder. The full weight of the police force and the legal system was brought to bear against that man, and he will surely spend the rest of his life in prison. Since there is no miscarriage of justice, there is nothing to protest.  Since the person who committed the crime is not protected by a law that only the government can change, there is no need to assemble and demand a change in the law.</p>
<p>Finally, the attempt to somehow conflate a black person randomly killing a white child with the racism that is systematic in policing is disingenuous and intentionally race-baiting in many cases. Although I don&#8217;t think that was the specific intent of everyone who shared such a meme, I know it was for some of them. Note: I commented on the posts of two friends who shared a meme like this, saying substantially what I said above. One of them deleted the entire post. The other deleted just my comment.</p>

		<content type="html" xml:base="https://www.learnaboutguns.com/2020/09/13/what-defunding-the-police-means/"><![CDATA[<p>Defunding the police is a simple and viable solution that will go a long way towards reducing police <a href="https://www.learnaboutguns.com/2020/06/17/police-use-of-force-depends-upon-the-race-of-the-suspect/">brutality</a> and racism.  It involves having other agencies that are better equipped to handle a specific problem get the mission (and budget) to handle that problem, instead of giving the over-worked police departments that mission. Scaremongering from those who oppose defunding of the police lacks a basis in fact or reason, as is explored below.</p>
<p><strong>Why defunding the police is necessary<br />
</strong></p>
<p>Police officers are currently tasked with doing so much more than they are equipped and able to properly do. The police are called upon not only to handle criminal law enforcement, but to respond to people having a mental health crisis, dogs on the loose, civil disputes that don&#8217;t rise to the level of needing actual law enforcement, etc. Since police training in the United States tends to range from several weeks to perhaps half a year at the most, it is no wonder that the police officer who responds to all those different types of calls is not very well equipped to properly handle each of those situations. By being a jack of all trades, the modern police officer is a master of none.</p>
<p>Police are not mental health experts. They are not domestic violence experts. They are not animal control experts. They are not equipped to effectively handle a great many problems.  As a result, police officers facing a difficult situation tend to fall back on their training. Since police training includes significant use of force components, and since police culture glorifies use of force, it is unsurprising that police gravitate towards use of force as a means of resolving problems.</p>
<p>More concretely a 22 year old police officer with a badge and a gun is not going to do nearly as good of a job as a trained mental health care worker when it comes to handling a call regarding a person who is having a mental health crisis.  The odds of injury or death for the citizen, the cop, and bystanders is higher when the cop responds to that call than when a mental health professional who is trained in deescalation and is used to spending their days dealing with people in crisis responds.  Similarly, that cop is not nearly as likely to catch a loose dog without injury to the dog, themselves, and bystanders as someone who works at an animal shelter and deals with rowdy dogs every day.  Sending the cop to do that job increases everyone&#8217;s risk. The result in every case where a police officer is sent into a situation they are unqualified to handle is unnecessary risk of to members of the public, unnecessary danger for police officers, and more distrust of the police when something bad does happen.</p>
<p>Indeed, a single instance of seeing the police unnecessarily use violence can stick with a person for the rest of their life and make them reluctant to seek assistance from the police in the future. This produces secondary effects that are not good for society. As a simple example, my first memory of the police involved a police officer falsely accusing my parents of shoplifting a baby carrier. The situation was resolved with the police officer acknowledging that my parents had not shoplifted anything, but being detained and seeing that officer rudely treat my parents like they were less than human has stuck with me for decades. That comparatively mild experience (along with many instances of racial profiling I&#8217;ve experienced as an adult) still causes me to be apprehensive around the police, so it is is no wonder that people who have seen and experienced much worse are even more afraid of the police. It is no wonder that some people have panic attacks or try to <a href="https://www.learnaboutguns.com/2020/09/02/why-innocent-people-run-from-the-police/">run from the police</a> even when completely innocent.  Indeed, a cycle is created where abuses committed by the police lead to fear and distrust of the police, which in turn manifests in fear or even combativeness with the police, which in turn results in police using more force&#8230;</p>
<p><strong>What defunding the police means</strong></p>
<p>Defunding the police means taking some of their responsibilities (and the budget to go with it) away from the police department, and giving those responsibilities to agencies that are better equipped to handle that area.  Instead of having the police handle a loose dog, let&#8217;s have the animal control agency (or a local animal shelter) get the call. Rather than having police officers respond to a person having a mental health crisis, we can have trained mental health professional show up. When a homeless person is loitering or aggressively panhandling, an advocate from a local homeless shelter can be given the opportunity to address the problem. To be sure, not every such problem can always be completely solved without the police becoming involved. But most of them can be solved without the police getting involved, and doing so results in better outcomes with less danger for everyone.</p>
<p><strong>Real examples of what happened when the police were defunded</strong></p>
<p>The city of Denver, Colorado has implemented a system of having a van with mental health workers and other trained professional dispatched to nonviolent 911 calls. The program has been a resounding success and more information on it can be seen <a href="https://www.denverpost.com/2020/09/06/denver-star-program-mental-health-police/">here</a>.</p>
<p>Camden, New Jersey abolished it existing city police department, shifted law enforcement duties to the county, reallocated resources to other agencies that could assist with mental health and related issues, and as a result saw a 47% drop in violent crime. The doom and gloom about defunding the police leading to violence was entirely unfounded. <p><strong>Don&#8217;t buy in to the scaremongering about defunding the police</strong></p>
<p>Defunding the police doesn&#8217;t mean that police will be unavailable to respond to violent crime. It doesn&#8217;t mean that citizens will be left to fend for themselves. That is not what is being sought.  Don&#8217;t buy into the fearmongering. Instead, see defunding the police for what it is &#8211; an opportunity to have better-equipped agencies handle things like mental health and homelessness, resulting in better outcomes and greater safety for everyone (<a href="https://www.learnaboutguns.com/2020/07/16/police-in-america-are-so-violent-and-trigger-happy-that-they-are-accidentally-killing-each-other/">including police officers</a>).</p>

		<content type="html" xml:base="https://www.learnaboutguns.com/2020/09/07/a-response-to-the-why-are-you-protesting-for-this-criminal-attempt-at-excusing-police-brutality/"><![CDATA[<p>When speaking out against instances of police brutality and racism, I often hear a response along the lines of &#8220;why are you protesting for this criminal?&#8221; Since I hear it enough, I thought I would write a brief response here so that I can just provide the link in the future and not waste type typing a separate response. For all the reasons stated below, the &#8220;why are you protesting for this criminal?&#8221; retort is baseless and often disingenuous.</p>
<p><strong>Background on the &#8220;why are you protesting for this criminal?&#8221; retort</strong></p>
<p>When I&#8217;ve commented online about police brutality and protests that I have organized in response to that brutality, there are invariably comments made by people who assert that because the person who the police abused had a criminal history, there should be no protests over that instance of brutality. There are similar memes shared online, expressing the idea that if the person who was abused by police has a criminal history then it is wrong to protest that abuse committed by the police. Sometimes these memes will take the form of &#8220;[Insert name of police brutality victim] beat up his ex-girlfriend in 2009, why are you all protesting a domestic abuser. Imagine how she must feel about people saying his name like he is a hero.&#8221;</p>
<p>Obviously I don&#8217;t endorse people committing crimes, but that is not a reason to ignore instance of police brutality and racism, as I&#8217;ll discuss below.</p>
<p><strong>Police shouldn&#8217;t execute or otherwise abuse anyone</strong></p>
<p>Whether a person is a cancer-curing, Noble-prize-winning, orphan-rescuing hero or a terribly violent jerk, it is not the role of the police to meet out vengeance through unwarranted violence.  A person does not need to be venerated as a hero for us to conclude that the police were wrong for mistreating them.  The way I see it, standing against government-sponsored violence against a vulnerable individual is always right &#8211; whether that vulnerable individual is someone who I would want to have over for dinner or not.</p>
<p>Remember, the foundation of our existence as a country under the rule of law is that no one is above the law&#8217;s prohibitions, and no one is beneath the law&#8217;s protections.<br />
This is a pretty simple concept so I won&#8217;t spend much more time on it.  We have courts and a criminal justice system to decide whether a person is guilty and what sentence they should receive. Extrajudicial violence from police officers (who are themselves breaking the law and the oaths they took when becoming police officers) is not justice and should always be condemned.</p>
<p>Anyone who still doesn&#8217;t get this should look at numerous examples where vigilante &#8220;justice&#8221; has resulted in terrible atrocities. The lynching of Emmett Till is a good starting point.</p>
<p><strong>The focus on the criminal record of a person wrongfully killed by the police is grasping at straws to find a reason to oppose much-needed social change<br />
</strong></p>
<p>Those who are opposed to civil rights progress search for any reason to justify their opposition.  When <span class="module__title__link">Colin Kaepernick</span> peacefully and silently took a knee, those opposed to civil rights falsely claimed he was disrespecting American soldiers.  When professional athletes when on strike, attacks were made on their characters. Trying to find ways to smear the victims of police brutality and use that as an argument against protesting that instance of brutality is just another such tactic. Literally every approach taken by civil rights activists to fix the problems of police brutality and racism are met with scorn and derision.</p>
<p><strong>Police manage to arrest many violent, terrible white people without murdering them</strong></p>
<p>I have already written a separate article addressing the fact that police choose to use force more often and with more violence when dealing with black people than when dealing with white people.  In that article I provide scientific evidence to support that conclusion, discus how the studies mirror what I have seen in my personal life as a black man and as an attorney who has represented people who were mistreated by the police, and provide links to that evidence. <p><strong>Violent police pose a danger to us all</strong><br />
A situation where the police are permitted to brutalize someone who they believe has a bad criminal history poses a very real danger to us all. Many of the cases of police brutality that have led to protests involve the police misidentifying an innocent person as a criminal and then using violence against that innocent person.  Any of us (or our loved ones) could be the next innocent person who the police brutalize.  As such it behooves everyone to take a stand against police brutality.</p>
<p>Indeed, the &#8220;mistaken identify&#8221; risk is so high that police are actually killing each other because they are so violent and trigger-happy.  If those opposed to civil rights actually cared about the well-being of the police officers they claim to back, they would want to see the problem of police brutality fixed so that those police officers would stop killing each other.  More on that issue can be seen in the separate article I&#8217;ve written here: <a href="https://www.learnaboutguns.com/2020/07/16/police-in-america-are-so-violent-and-trigger-happy-that-they-are-accidentally-killing-each-other/">https://www.learnaboutguns.com/2020/07/16/police-in-america-are-so-violent-and-trigger-happy-that-they-are-accidentally-killing-each-other/</a></p>
<p>Finally, given the inherent racism in our criminal courts where many black and brown people are convicted of crimes they didn&#8217;t commit, or convicted in factual situation where a white defendant would not have had the conviction go on their record, the fact that someone has a criminal conviction should not be seen as conclusive evidence that they are factually guilty or are a bad person deserving of hatred. 		<content type="html" xml:base="https://www.learnaboutguns.com/2020/09/02/respondeat-superior-liability-for-protesters-but-not-police/"><![CDATA[<p>The idea that protesters should be collectively responsible for the small number of people who engage in violence or property damage lacks merit. On the other hand, the same logic does factually work when it comes to police officers engaging in brutality, racism, and other misconduct.</p>
<p><strong>Respondeat Superior</strong></p>
<p>Starting with some legal history, Respondeat Superior is a longstanding legal doctrine whose Latin words roughly translate as &#8220;let the master answer.&#8221;  It is a doctrine that uses vicarious liability to make an employer responsible for the actions of a subordinate who is acting at the direction of the employer.  In essences, the idea is that a person who is harmed by an employee doing the biding of the employer should be able to hold the employer responsible for that harm.</p>
<p>The crux of Respondeat Superior is that the employer is benefiting from the employee doing their bidding, that the employer has the ability to control the employee through their power to hire/fire/discipline, and that the employee&#8217;s bad act was something within the general duties of their employment.</p>
<p><strong>Applying this sort of reasoning to protesters and rioters</strong></p>
<p>It is plainly apparent that the Respondeat Superior reasoning doesn&#8217;t fit the scenario when a rioter engages in violence or property damage and then some people try to blame protesters as a whole (or the organizers of the protest who have not committed any crimes).  Protests are events that take place in public where anyone can walk up and protest (or commit a crime). The protest organizers and attendees do not employ rioters and cannot control the conduct of random people who show up in a public place at the same time as the protest.  Nor are rioters doing the biding of the protest organizers who desperately want peaceful demonstrations.  Indeed, the private actions of a looter who is stealing shoes for themselves does not advance the interests of the protest organizer one bit. Protest organizers and attendees cannot fire the rioters the way that an employer can fire an employee, and again cannot exclude them from the public space in which the protest is taking place. </p>
<p>Every aspect of the Respondeat Superior test fails, and so imposing vicarious liability (legally or morally) upon peaceful protesters and protest organizers for the actions of rioters makes no sense.  Instead, it is just a means of trying to ignore the much-needed police reform and injustice that led to the protests by smearing the protesters.</p>
<p><strong>Applying this sort of reasoning to police</strong></p>
<p>A place where Respondeat Superior does fit is the police.  Police officers are employees of the police department. The police chief and others within the government have the authority to hire, fire, and discipline police officers. Police use department-issued badges, uniforms, guns, cars, handcuffs, etc. When a police officer uses force they are doing so in the scope of their employment, using training that they were given at work.  When they exceed the scope of what is proper by engaging in brutality or racism, they are still acting within the time and space of the agency relationship between themselves and the department. Respondeat Superior fits like a glove.</p>
<p>That is all the more true when police chiefs and other governmental actors choose not to fire bad cops who have engaged in misconduct, only to have them commit further abuses.  Similarly, police officers who have sworn an oath to uphold the law yet choose to ignore misconduct on the part of other police officers, and themselves culpable.</p>
<p><strong>Conclusion</strong></p>
<p>For all the reasons expressed above, it makes no sense to blame protest organizers and attendees for the criminal actions of a few rioters. However, it does make sense to hold police departments, police chiefs, and other police officers accountable for the actions of police officers who commit misconduct.</p>
<p>Finally, please note that a lot of the so-called &#8220;protesters&#8221; committing acts of violence and property destruction are either made-up stories or acts of violence/destruction that were later found to be committed by white supremacists who are trying to smear the protesters. <p>In response to the question of &#8220;if they are innocent why do they run from the police&#8221; I would note that there are many sound reasons for innocent people to run from the police.  Those include fear of having evidence planted by the police, fear of torture by the police, fear of being wrongly framed for a crime, fear of being brutalized even if compliant, and even just the desire to avoid the indignity of repeated racial profiling. Each of those is explored below, with real-life examples.</p>
<p><strong>Innocent people understandably fear the police will plant evidence on them</strong></p>
<p>Police plant evidence on people to justify arrests, and absent video providing it the police almost always get away with it.  As an example, this cop planted meth on dozens of people, causing them to go to jail and even lose custody of their children. <p>When innocent people are falsely convicted of crimes and later freed, in more than half of the cases, misconduct by police and prosecutors played a contributing role. That&#8217;s the primary theme of a new report, &#8220;Government Misconduct and Convicting the Innocent,&#8221; released today by the National Registry of Exonerations, which has been tracking all known exonerations in the United States for the past 30 years. Police and prosecutors, in general, engaged in misconduct at about equal rates, 35 percent for cops, 30 percent for prosecutors at the state level. <p><strong>Innocent people fear being tortured by police officers trying to extract a confession</strong></p>
<p>Police have tortured countless confessions out of innocent people. One particularly notorious case is that of former Chicago detective John Burge, who led a ring of cops that tortured confessions out of over 200 people (mainly black men) who were innocent. <p><strong>Innocent people fear being framed for a crime they didn&#8217;t commit</strong></p>
<p>In an effort to close cases, police have been known to frame innocent people for crimes that the police know they did not commit. An example is that of the Florida police department where multiple cops (including the chief of police) were engaged in a conspiracy to frame innocent black men for burglaries. <p><strong>Innocent people rightfully fear being beaten by the police, even if they are compliant</strong></p>
<p>There are many cases where police beat or otherwise harm people why are fully compliant.  The prospect of being attacked even if compliant can motivate innocent people to run.  Since video really shows the point here, I&#8217;m going to provide a few videos of police attacking compliant people.</p>

<p><strong>Innocent people may be tired of racial profiling and not want to experience it again</strong></p>

<p><strong>Innocent people may fear rape while in police custody</strong></p>
<p>Police officers have forcibly raped or sexually assaulted many people (women and men) who were in custody. Making the problem worse, any states don&#8217;t make it a crime for a police officer to have &#8220;consensual&#8221; sex with a person who is in their custody, which makes proving the rape case even harder for the victim. <p><strong>Innocent people worry about the legal system being stacked against them</strong></p>
<p>A completely innocent person who is arrested has legitimate cause for concern, and a desire to avoid that arrest is understandable. That causes many innocent people to run from the police.  The idea of &#8220;comply and fight it in court&#8221; makes sense if fighting it in court can be expected to produce a fair outcome, but not when a person can reasonably expect time in jail, financial ruin, and even a lengthy but undeserved prison sentence.</p>
<p>Being arrested is unpleasant, as no one enjoys having their freedom taken away as they are hauled off to jail. Often high bond amounts keep people in jail for days or even years as they await trial, and living conditions in jails are generally terrible.  Even worse is being taken away from one&#8217;s loved ones.  The economic impact of losing a job, a house, a car, and everything else due to a lack of money when incarcerated only adds to the misery.  The prospect of a prison term when ever so innocent is emotionally devastating, as is the embarrassment of having one&#8217;s family and friends know that one is incarcerated.  The fact that such a person can be ever so innocent doesn&#8217;t change that analysis, as our jails (and prisons) contain many innocent people. <p>Those concerns are especially true for Black people given the racism inherent in our criminal court system that leads to Black people having higher bail set, more serious charges, longer sentences, juries who are biased against them, and a whole host of other disadvantages that can be scientifically shown to be a result of race and not other factors. <p><strong>Conclusion</strong></p>
<p>Against the backdrop of the information provided above, is it any wonder that some people who have done nothing wrong run from the police? It is unreasonable to expect a person who know that the police can plant evidence, frame them for a crime they didn&#8217;t commit, and physically harm them (will likely getting away with all of that) will try to avoid that mistreatment by rapidly leaving the area when the police appear?</p>
<p>It is hard for me to fault those people who run, even though I personally (as a lawyer) take a <a href="http://pgjustice.com/">different approach involving the legal system</a> when the police mistreat me.</p>
<p>Finally, note that in the interest of brevity I provided just a few examples of real-life abuses by police for the above categories, but a simple online search will show a great many other examples for every one of those categories.</p>
