Follow the four easy steps, you can get your will done!
(Please note that, only valid will is acceptable by high court)

1. List your assets

Include details of bank accounts, properties, businesses, vehicles, jewellery, antiques or other valuables, investments such as shares or other instruments.
Note whether these are held in your name or jointly with a spouse or family member.
Do gather all the supporting documents and place them together in an easy-to-retrieve file or folder.

2. Appoint Executor(s)

Think about who you will name as an Executor in your will.
There could be more than 1, you can appoint up to 4. It is best to have more than 1 in fact, so that if that Executor dies or is unwilling to act, there is another.
Discuss first, with the person you have chosen. Don’t assume he/she is willing to act.
You could also appoint a trust corporation instead of a natural person, as the Executor.

3. Who is the beneficiaries

This would normally be your immediate family.
You are actually free to choose who, or which entity, you wish to leave your assets to.
Some people have willed all their assets to charitable or non-profitable organisations, as their children are grown up and have acquired their own wealth.

4. Signed with two witnesses

The will must be signed in the presence of two witnesses, who must also sign it.
The two witnesses cannot be beneficiaries (or spouses of beneficiaries).
The will needs to be kept in a safe place.
There will be no point at all to the exercise if no one can locate the physical will once you have passed on.

Although, you will see just four simple steps to get a will done, please bear in mind, what you need is a valid will ----- a will which truly help you to accomplish your wish & help to ease your family when you are not around. Do think thoroughly what you want to give and do make sure all necessary information needed are complete.

Common mistake - part 3

Ya, I admit, I would like buy something cheap and useful.
I don't like to pursue my client to spend too much unnecessary expense on will writing if the clause is not a necessary issue or better not to be listed in will (funeral arrangement, etc)

However, some client would like to reduce this and that clause, which is very dangerous -- it can lead to invalid will.
I will say, I can only suggest, advice and remind. If you insist the cheaper but dangerous will, I can't help much.

5. Not Identifying Assets Adequately
Assets with legal titles are easily identified. However with assets like jewelry, paintings and collectibles, you must identify them clearly to ensure there is no ambiguity.

虽说，在遗嘱里，你能够注明要什么样的葬礼，但，我不想贪你这一个条款的佣金。
我并不鼓励把葬礼的进行方式、灵位地点等与资产无关的事放进去。

原因 —— 你的遗嘱执行者通常会在处理好葬礼的事宜才会去想分配财产的事。而若葬礼已经结束了，而且家人用的方式不是往生者所想要的，那么试问把这一项列入遗嘱里有什么用？

器官捐赠也是如此。若已经火化了，才领出遗嘱来看 —— 哪个骨灰是肝、哪个是肾都不懂了，怎样捐？？？

喜欢图中的一句 —— “什么东西留给什么人都说清楚了，不然我走后才来争吵，不是很头痛？” —— 不过，话说回来，说归说，有与没有遗嘱的差别在分配过程中就一清二楚了！

There are some very clear advantages in making sure that you have a valid will in place. It is [1] cheaper to extract grant of probate (meaning, there is a will) than it is to extract Letters of Administration (where there is no will). It is also [2] faster. [3] No guarantors are required for probate.

You also [4] get to choose and specify clearly who will administer the estate and who should be the rightful guardian of children if any. You can also [5] provide for your beneficiaries in a very specific way and know that your wishes will be carried out.

It also serves to [6] avoid bickering and squabbles among family members which as we know, can be very damaging. As we have seen all too often, even families can fight bitterly, when money is involved.

We can see, it is much easier to extract Grant of Probate!

3. Selecting The Wrong Person To Be Witness
If your witness is also a beneficiary or the spouse to a beneficiary in your Will, then that person forgoes his or her gift. A gift made to someone who witnesses your Will is deemed to be null and void.
HOW TO PREVENT THIS - It is better asking close friends to be witnesses rather than family members who may be a potential beneficiary.

You sure need to know about "sureties"

If we die intestate, [1] our assets will be distributed according to the formulas set out in the Distribution Act 1958, and NOT according to your wishes or the needs of your family members.

[2] The court will appoint a trustee and executor to administer your estate, and this may give rise to disputes between family members or beneficiaries on who should be appointed.

[3] The court will appoint a guardian for your minor children, and the person appointed may not be your preference.

[4] The distribution process will take longer and cost more, ordinarily requiring a bond and the appointment of 2 sureties to guarantee the proper administration of the estate.

Know more about SURETIES:

2 sureties who must have assets within the jurisdiction equivalent to the amount of the Deceased’s estate as security for the due administration of the estate.

Due to the difficulties in finding the required sureties, the applicant for the Letter of Administration will usually be advised to file an application for dispensation of sureties to dispense with the requirement of Section 35(1) Probate and Administration Act 1959 and it usually will be granted by the Court.

With a will, there is NO requirement to provide for the sureties as a form of securities for the due administration of the estate.
There is also NO NEED for the executor to apply to the High Court for distribution order because distribution is in accordance with the terms of the will.

我一直很佩服我的外婆，她如果还在，应该有90多岁了吧。
那个年代的人们，尤其是华人，最避忌谈“死”。
可是我的外婆，在50、60岁左右，就开始买了牌位、丧礼要用的毛巾，还交代我们所有子子孙孙，她的私房钱要怎么分、丧礼要怎样办。
但，她并不悲观，她安排是一回事，另一边，她好好的活着，做自己喜欢做的事，念念佛，拜拜佛，日子过得很好。
我想，这就是——善生、善终

为自己铺好“走后”要走的路，何尝不是一件好事？

Without a Will, all of these decisions are left to a court to determine in accordance with distribution laws in Malaysia.

1. Unknown Location Of Your Will
If a Will cannot be found, it is assumed that you have not written one.
HOW TO PREVENT THIS - tell others where your Will is kept. If you change its location, remember to inform them. Alternative, keep all the important documents like titles, insurance policy
documents and your Will together in one location.
BEST SOLUTION - keep under trustee company's custody

2. Failure To Date a Will
Without a date, it is almost impossible for the court to determine whether this is an old Will that has been revoked by a newer one.

'kuasa' before or after? which is better?

Many people thinking, better kuasa before I die, so that my children won't argue among them, no hassle after I die, senang lenang ~

Here's some special case, which happen quite often in anywhere, any country and anytime.
We often see such case in TV drama, and yes, it could happen to us as well.

Despite being 'betrayed' by your beneficiaries before you leave the world, do you know that -- the processing fee of 'kuasa' when we're still alive is much more expensive than doing through a will?

重点1：要获取不同保险公司的批准，是需要一段较漫长的时间。（遇到当事人是成植物人之类的事件）需要等所有的医药报告，在这段期间，家属得自己支付家庭的日常费用和医药费

重点2：不同保险公司有不同的保单政策。领取保金所需的文件、条件、手续各不相同

重点3：保险保单虽然能在当一个人遇到不测时提供资金担保，可是若当事人处在昏睡或植物人状态，保险公司无法正确的将保金支付给提名人。因为保单人已处在不清醒状态，所以需要一段蛮长的手续来证明提名人身份

解决方案：
通过信托公司设立保险信托——将保险保单信托于一家信托公司。
在担保人逝世或遇到不测后，保险公司会将保金过户给信托公司，再由信托公司直接过户给保单受益人。
若信托人处在植物人或不清醒状态，信托公司将直接支付医药费。
此外，信托公司也会依照信托人在信托遗嘱里的旨意过户保金给其家人

怎样才算数？

1. 只要符合法律制定条件，即立遗嘱人达到法定年龄，且神智清醒，遗嘱以书面方式呈现，有立遗嘱人及两名证人签名，并列明受益人和执行人，遗嘱就具备法律效益。

2. 只要立遗嘱人亲手签署遗嘱，并符合上述提及条件，就具有法律效益。

3. 婚姻状态产生变化会导致遗嘱失效，比如说单身时所立定的遗嘱，结婚后便会失效，除非遗嘱上清楚阐明不管婚姻状态是否改变都以原先遗嘱为标准。这是基于法律要保障伴侣和孩子的利益。

4. 立遗嘱人须在遗嘱内附上剩余遗产条款（Residuary Clause），以确保日后增加的财产涵括在遗嘱内。附上剩余遗产条款的好处是立遗嘱人可以依据自己意愿，将日后增加的财产按照不同比例分配给受益人。如果没有附上这项条款，日后增加的财产将会依照1958年遗产分配法令分配给受益人。

5. 在孩子未满18岁时立遗嘱，立遗嘱人需要委任两名监护人，以在过世后代为管理遗产。比如立遗嘱人留下房子，监护人可以运用遗产帮忙交水电费等，直到孩子满18岁，再交还孩子自行打理。另外，至少要委任两名监护人的用意是可以互相进行监督，以防发生滥用遗产情况。

如果遗嘱是由律师负责，而该律师楼倒闭，律师公会将会介入，把倒闭律师楼处理的法律文件转介给其他律师楼，而相关律师楼事后会通知当事者案件已转介给它。因此律师楼倒闭并不会影响法律效益，只是负责处理案件的律师更换了。

Love is sweet, we should never take it for granted. We should treasure it.

Before is too late, say it out and say it loud. Tell your love one how much you love him / her. Let your family know how much you care about them.

In my opinion, I seldom encourage my clients to have this statement in their will, instead, it's better to tell them right now, before everyone regret for not speak it out face to face.

To me, a good way to show your love to family is by having a well written will, if possible with a proper plan trust, which able to prevent families from hactic process & make sure their living able to carry on without financial issue.
