Police are under fire for attacking a volunteer medic during a pro-democracy protest on Saturday night that ended with eight demonstrators detained and 20 wounded.

A group representing doctors who work in provincial hospitals issued a statement on Sunday denouncing police for beating a medical volunteer outside the Supreme Court compound near Sanam Luang. The group, the Rural Doctor Society, demanded explanations and legal action against those responsible, saying it was a serious violation of human rights.

ประเทศไทย จะถือหลัก"การเยียวยาให้ผู้เสียหายอยู่ในฐานะเดิมก่อนถูกทำละเมิด" คือเสียหายเท่าใด ชดใช้เท่านั้น แต่มีกฎหมายพิเศษบางฉบับ กำหนดให้ศาลมีอำนาจกำหนดค่าเสียหายเชิงลงโทษจำเลยโดยเฉพาะไว้ เช่น

News: Gunman Fires Shots in Bangkok, Rattling Thailand After a Massacre

BANGKOK — A gunman who fired multiple rounds toward people in Bangkok was arrested on Friday after a standoff, in an incident that alarmed a country still grieving after Thailand’s deadliest mass shooting.

There were no injuries or deaths in the shooting, which began in the early morning hours when the man, whom the police identified to local news media as Ekkachai Charueksilp, began firing shots from his home above a sports equipment store in a central Bangkok neighborhood.

The gunman fired at least 20 shots, leading to the six-hour standoff with police officers on a street cordoned off to the public. The standoff ended after the police asked for help from the man’s relatives and sent a team in to mediate with the gunman.

The gunman eventually surrendered and was being questioned about his motives, said Colonel Krissana Pattanacharoen, a spokesman for the Royal Thai Police.

The gunman told investigators in initial interviews that the shooting was motivated by family problems, the colonel said.

News: Korat shooter killing guard goes viral

A clip showing the soldier involved in a mass shooting in Nakhon Ratchasima last weekend firing shots at an army private before taking firearms and ammunition from an armoury went viral online on Saturday.

The authenticity of the three-minute-long clip, reportedly obtained from rescue workers in the province, has not been confirmed.

The clip is a compiliation of three sets of footage. In the silent one-minute first set, a man who looked like Sgt Maj 1st Class Jakrapanth Thomma, 32, armed with a shotgun, walked to the armoury at the Surathampitham military camp. He talked to Pvt Metha Lertsiri, 23, who was guarding the place on Saturday afternoon. Pvt Metha then walked into a nearby room with open doors and the soldier fired two shots in his back. He fell to the ground.

The man then fired shots at the lock of the wooden door to the next room and opened the door.

According to army chief Gen Apirat Kongsompong, Jakrapanth took several weapons and ammunition from the armoury before going on a rampage that killed several innocent people on that day.

News: Gold robber kills staff, shoppers, young child

Police are hunting a gold-shop robber who killed three people, including a young boy, and wounded four others in the Robinson department store complex in Lop Buri on Thursday night.

The man robbed the Aurora gold shop inside the mall about 8.44pm.

He was wearing a woollen balaclava, black shirt and camouflage trousers, and carrying a handgun with a long sound suppressor attached to it.

As he approached he fired at shop staff and customers, then jumped across the counter and snatched three trays of gold necklaces worth about 500,000 baht. As he left he shot a security guard dead before fleeing on a red-white Yamaha Fino motorcycle without a licence plate.

Three people died of their bullet wounds, including a two-year old boy shot in the head while walking past the gold shop with his mother. The boy succumbed to the wound at a local hospital.

Police said the man used a 9mm pistol. Security camera footage showed that the robber arrived at the store alone.

"I wonder what state his mind was in. A woman died. A child died. You wanted gold. But why must people be killed? I cannot imagine such a cruel mind. I ask people to help find him... It was appalling," police commissioner Pol Lt Gen Amphol said.

Senior officers were handling the case and armed police commandos were being used in the hunt, he said. They would do their very best to catch him.

ผิดสัญญาจ้าง เรียกค่าเสียหาย

โจทก์กล่าวในคำฟ้องเกี่ยวกับการกระทำของจำเลยอันเป็นการผิดสัญญาจ้างทำของ ทำให้โจทก์ได้รับความเสียหาย โจทก์จึงเรียกค่าเสียหายจากจำเลยหลายรายการ แต่โจทก์คิดเพียง400,000 บาท โดยแนบภาพถ่ายทาวน์เฮาส์ เครื่องโม่ปูนวัสดุก่อสร้างที่เหลือ บ้านพักคนงาน รวมทั้งสิ่งก่อสร้างตามโครงการก่อสร้างของจำเลยที่ถนนเทพารักษ์มาท้ายฟ้องด้วยแม้มิได้บรรยายว่าโจทก์เริ่มลงมือก่อสร้างเมื่อใด ทำงานเสร็จไปถึงงวดที่เท่าใดวัสดุก่อสร้างที่เหลืออยู่ จำนวนและราคาเท่าใดและการว่าจ้างโจทก์ก่อสร้างที่เทพารักษ์ มีหลักฐานอย่างใด ก็ไม่เป็นฟ้องที่เคลือบคลุม เพราะข้อเท็จจริงดังกล่าวไม่ใช่สภาพแห่งข้อหา ไม่จำต้องกล่าวในฟ้องทั้งเป็นรายละเอียดที่โจทก์สามารถนำสืบในชั้นพิจารณาได้ จำเลยต่อสู้คดีได้ถูกต้องแล้วคำฟ้องของโจทก์จึงไม่เคลือบคลุม กรณีเพิ่งเริ่มงานตามสัญญา จำเลยก็ไม่ประสงค์ให้โจทก์ทำการก่อสร้าง เหตุบอกเลิกสัญญา ก็อ้างเหตุโจทก์ทิ้งงานเท่านั้น ซึ่งยังไม่พ้นกำหนดระยะเวลาก่อสร้างแล้วเสร็จ และโจทก์เองมิได้ทอดทิ้งงาน ส่วนเรื่องโจทก์ก่อสร้างผิดแบบผิดหลักวิชาการก็รับฟังไม่ได้ ดังนี้เมื่อ สัญญาจ้างยังไม่ถึงกำหนด และจำเลยผู้ว่าจ้างเห็นว่าหากให้ โจทก์ทำการก่อสร้างต่อไปจะเกิดความเสียหายเพราะงานล่าช้างานจำเลยจะเลิกสัญญาได้ก็ต้องบอกกล่าวกำหนดระยะเวลาให้โจทก์ปฏิบัติเสียก่อนตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 387แต่จำเลยก็มิได้ทำเช่นนั้น จึงบอกเลิกสัญญาโดยเหตุดังกล่าวไม่ได้ การที่โจทก์ขอทำการก่อสร้างต่อไปและจำเลยไม่ยอมโดยว่าจ้างผู้อื่นก่อสร้างต่อไปและให้เลิกสัญญา จะถือว่าโจทก์เป็นฝ่ายผิดสัญญาไม่ได้ แต่เป็นเรื่องจำเลยใช้สิทธิเลิกสัญญาโดยไม่ชอบ และต้องถือว่าจำเลยเป็นฝ่ายผิดสัญญาเอง กรณีจ้างทำของเมื่อจำเลยผู้ว่าจ้างได้บอกเลิกสัญญาเองโดยโจทก์ผู้รับจ้างไม่ได้ทำผิดสัญญา จำเลยจึงต้องรับผิดใช้ค่าสินไหมทดแทนให้แก่โจทก์เพื่อความเสียหายใด ๆ อันเกิดแต่การเลิกสัญญานั้นตามประมวลกฎหมายแพ่งและพาณิชย์มาตรา 605 ส่วนค่าเสียหายที่จำเลยต้องรื้อถอนซ่อมแซมและเสียค่าก่อสร้างบ้านจนแล้วเสร็จ เมื่อโจทก์มิได้เป็นฝ่ายผิดสัญญาจำเลยจึงไม่มีสิทธิเรียกร้องเอาจากโจทก์ได้ โจทก์ฟ้อง จำเลยให้การและฟ้องแย้ง โจทก์ให้การแก้ฟ้องแย้งแล้ว ศาลล่างทั้งสองพิพากษาให้โจทก์ชนะคดีตามฟ้องโดยมิได้พิพากษายกฟ้องแย้งด้วยนั้น ศาลฎีกาเห็นสมควรแก้ไขเสีย ให้ถูกต้อง

ย่อยาว

โจทก์ฟ้องขอให้บังคับจำเลยชำระเงิน 400,000 บาท พร้อมดอกเบี้ยในอัตราร้อยละเจ็ดครึ่งต่อปี นับแต่วันฟ้องจนกว่าจะชำระเสร็จ และให้จำเลยระงับการก่อสร้างตึกพิพาทไว้ก่อนจนกว่าศาลจะพิพากษาถึงที่สุด

จำเลยให้การและฟ้องแย้ง ขอให้ยกฟ้องและบังคับให้โจทก์ชำระหนี้ 224,000 บาท พร้อมดอกเบี้ยในอัตราร้อยละเจ็ดครึ่งต่อปีนับแต่วันยื่นคำให้การและฟ้องแย้งจนกว่าจะชำระเสร็จ

โจทก์ให้การแก้ฟ้องแย้งว่า โจทก์ไม่ได้เป็นฝ่ายผิดสัญญาขอให้ยกฟ้องแย้ง

ศาลชั้นต้นพิพากษาให้จำเลยชำระเงินจำนวน 302,000 บาทพร้อมดอกเบี้ยร้อยละเจ็ดครึ่งต่อปีนับแต่วันฟ้องเป็นต้นไปจนกว่าจะชำระเสร็จแก่โจทก์

ศาลอุทธรณ์พิพากษาแก้เป็นว่า ให้จำเลยชำระเงินจำนวน252,000 บาท นอกจากที่แก้ให้เป็นไปตามคำพิพากษาศาลชั้นต้น

จำเลยฎีกา

ศาลฎีกาวินิจฉัยว่า ข้อเท็จจริงที่ไม่โต้เถียงกันฟังได้ว่าเมื่อเดือนเมษายน 2532 จำเลยได้ทำสัญญาว่าจ้างให้โจทก์ก่อสร้างบ้านแบบทาวน์เฮาส์ตามแบบแปลนจำนวน 2 หลัง ให้แล้วเสร็จภายในวันที่ 15 มิถุนายน 2532 ในราคารวมทั้งค่าแรงและค่าวัสดุเป็นเงิน 536,000 บาท กำหนดจ่ายเงินค่าจ้างเป็น 4 งวดตามผลงาน โจทก์ได้ดำเนินการก่อสร้างไปจนถึงงวดที่ 2ยังไม่แล้วเสร็จ โดยได้รับเงินค่าจ้างเพียง 50,000 บาทวันที่ 5 มิถุนายน 2532 จำเลยได้มีหนังสือบอกเลิกสัญญากับโจทก์และให้นายสุรวิชญ์ วงศ์พรหม เข้าไปดำเนินการก่อสร้างต่อจากโจทก์ ขณะนั้นโจทก์ยังมีเรือนพักคนงานชั่วคราว เครื่องโม่ปูน1 เครื่อง กับวัสดุก่อสร้าง เช่น อิฐ หิน ทราย ไม้แบบ และเหล็กเส้น อยู่ในบริเวณงานก่อสร้างของจำเลย

ปัญหาข้อแรกที่จำเลยฎีกาว่าฟ้องโจทก์เคลือบคลุมนั้นเห็นว่าโจทก์กล่าวในคำฟ้องเกี่ยวกับการกระทำของจำเลยอันเป็นการผิดสัญญา ทำให้โจทก์ได้รับความเสียหาย โจทก์จึงเรียกค่าเสียหายจากจำเลยหลายรายการแต่โจทก์คิดเพียง 400,000 บาท โดยแนบภาพถ่ายทาวน์เฮาส์ เครื่องโม่ปูน วัสดุก่อสร้างที่เหลือบ้านพักคนงานรวมทั้งสิ่งก่อสร้างตามโครงการก่อสร้างของจำเลยที่ถนนเทพารักษ์มาท้ายฟ้องด้วย แม้มิได้บรรยายว่า โจทก์เริ่มลงมือก่อสร้างเมื่อใด ทำงานเสร็จไปถึงงวดที่เท่าใดวัสดุก่อสร้างที่เหลืออยู่จำนวนและราคาเท่าใดและการว่าจ้างโจทก์ก่อสร้างที่เทพารักษ์มีหลักฐานอย่างใด ก็ไม่เป็นฟ้องที่เคลือบคลุมเพราะข้อเท็จจริงดังกล่าวไม่ใช่สภาพแห่งข้อหา ไม่จำต้องกล่าวในฟ้อง ทั้งเป็นรายละเอียดที่โจทก์สามารถนำสืบในชั้นพิจารณาได้และจำเลยต่อสู้คดีได้ถูกต้องแล้ว คำฟ้องของโจทก์จึงไม่เคลือบคลุม

ปัญหาข้อสองที่จำเลยฎีกาว่า โจทก์เป็นฝ่ายผิดสัญญาต้องรับผิดชดใช้ค่าเสียหายให้จำเลย จำเลยไม่ต้องรับผิดต่อโจทก์นั้นเห็นว่าจำเลยอ้างว่าโจทก์ละทิ้งงาน จำเลยจึงว่าจ้างนายสุรวิชย์ วงศ์พรหม ให้ดำเนินการก่อสร้างต่อไป แต่ได้ความจากคำของนายสุรวิชญ์พยานจำเลยว่าในเดือนเมษายน 2532นั้นเอง จำเลยได้ไปว่าจ้างนายสุรวิชย์ให้ไปทำการก่อสร้างบ้านตัวอย่างที่หมู่บ้านรินรดา แต่นายสุรวิชญ์เห็นว่ามีผู้รับเหมาเดิมทำงานอยู่ จึงไม่รับจ้าง แสดงว่าทั้ง ๆ ที่เพิ่งเริ่มงานตามสัญญา จำเลยก็ไม่ประสงค์ให้โจทก์ทำการก่อสร้างเหตุบอกเลิกสัญญาตามเอกสารหมาย ล.5 ก็อ้างเหตุโจทก์ทิ้งงานเท่านั้น ซึ่งข้อเท็จจริงก็ได้ความชัดว่า ยังไม่พ้นกำหนดระยะเวลาก่อสร้างแล้วเสร็จ และโจทก์เองก็ได้นำสืบว่าได้ก่อสร้างบ้านให้จำเลยโดยมีช่างทำงานอยู่ตลอดมา มิได้ทอดทิ้งงานจึงไม่พอรับฟังว่าโจทก์ทอดทิ้งงาน ส่วนเรื่องโจทก์ก่อสร้างผิดแบบผิดหลักวิชาการเช่นผสมปูนเหลวเกินไป ตั้งเสา ตั้งกำแพงตั้งวงกบเอียง ก็ปรากฏว่าจำเลยไม่เคยท้วงติงหรือโต้แย้งมาก่อนทั้งจำเลยก็ยอมรับว่าได้จ่ายเงินค่าจ้างงวดแรกให้โจทก์แล้วจึงรับฟังไม่ได้เช่นกัน เมื่อสัญญาจ้างยังไม่ถึงกำหนด และจำเลยเห็นว่าหากให้โจทก์ทำการก่อสร้างต่อไปจะเกิดความเสียหายเพราะงานล่าช้ามาก จำเลยจะเลิกสัญญาได้ก็ต้องบอกกล่าวกำหนดระยะเวลาให้โจทก์ปฏิบัติเสียก่อนตามประมวลกฎหมายแพ่งและพาณิชย์มาตรา 387 แต่จำเลยก็มิได้ทำเช่นนั้น จึงบอกเลิกสัญญาโดยเหตุดังกล่าวไม่ได้ การที่โจทก์ขอทำการก่อสร้างต่อไปและจำเลยไม่ยอมโดยจำเลยว่าจ้างนายสุรวิชญ์ก่อสร้างต่อไป และให้เลิกสัญญาตามเอกสารหมาย ล.5 จะถือว่าโจทก์เป็นฝ่ายผิดสัญญาไม่ได้แต่เป็นเรื่องจำเลยใช้สิทธิเลิกสัญญาโดยไม่ชอบ และต้องถือว่าจำเลยเป็นฝ่ายผิดสัญญาเอง และที่จำเลยฎีกาว่า การที่โจทก์สร้างสำนักงานชั่วคราวและวางผังสร้างตึกแถวที่ถนนเทพารักษ์โจทก์เป็นผู้รับเหมาก่อสร้างจากบริษัทรินรดา จำกัด ซึ่งมีนายไพโรจน์ ลิมป์ทองทิพย์ เป็นกรรมการผู้เดียว ศาลฎีกาวินิจฉัยข้อเท็จจริงฟังได้ว่า จำเลยผิดสัญญาในการก่อสร้างตึกแถวที่ถนนเทพารักษ์ด้วย

ปัญหาที่จำเลยฎีกาเรื่องค่าเสียหายนั้น ศาลฎีกาเห็นว่ากรณีนี้เป็นเรื่องจ้างทำของและจำเลยผู้ว่าจ้างได้บอกเลิกสัญญาเอง โดยโจทก์ผู้รับจ้างไม่ได้ทำผิดสัญญาตามที่ได้วินิจฉัยมาแล้วจำเลยจึงต้องรับผิดใช้ค่าสินไหมทดแทนให้แก่โจทก์เพื่อความเสียหายอย่างใด ๆ อันเกิดแต่การเลิกสัญญานั้น ตามประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 605 กล่าวคือ ค่าก่อสร้างงวดที่ 2 จำนวน160,000 บาท ที่โจทก์ยังทำไม่เสร็จบริบูรณ์ โดยเทพื้นชั้นสองไม่ครบ ขึ้นโครงหลังคาไม่ครบ และยังไม่ได้มุงกระเบื้องหลังคาซึ่งศาลอุทธรณ์กำหนดไว้เป็นเงิน 80,000 บาท ค่าวัสดุก่อสร้างมีอิฐมอญ 1 กอง หิน ทราย ไม้แบบ และเหล็กเส้นจำนวน 120,000 บาทเครื่องโม่ปูน จำนวน 12,000 บาท ค่าบ้านพักคนงานจำนวน20,000 บาท กับค่าก่อสร้างที่ถนนเทพารักษ์ จำนวน 20,000 บาทรวมเป็นเงิน 252,000 บาท เป็นจำนวนที่พอสมควรแล้ว ส่วนค่าเสียหายที่จำเลยฎีกาว่า จำเลยต้องรื้อถอนซ่อมแซมและเสียค่าก่อสร้างบ้านจนแล้วเสร็จ เมื่อหักค่าก่อสร้างและทรัพย์สินของโจทก์แล้วจำนวน 121,835 บาท กับค่าปรับที่จำเลยต้องก่อสร้างล่าช้าไปอีก67 วัน เป็นเงิน 100,500 บาท นั้น เห็นว่า จำเลยมิได้ทักท้วงหรือโต้แย้งให้โจทก์แก้ไขมาก่อน เมื่อโจทก์มิได้เป็นฝ่ายผิดสัญญาดังได้วินิจฉัยมาแล้ว จำเลยจึงไม่มีสิทธิเรียกร้องเอาจากโจทก์ได้ ศาลอุทธรณ์พิพากษาชอบแล้ว แต่ที่ศาลล่างทั้งสองมิได้พิพากษายกฟ้องแย้งด้วยนั้น ศาลฎีกาเห็นสมควรแก้ไขเสียให้ถูกต้อง

พิพากษาแก้เป็นว่า ให้ยกฟ้องแย้งของจำเลย นอกจากที่แก้คงให้เป็นไปตามคำพิพากษาศาลอุทธรณ์

อำนาจปกครองบุตร ไม่จำเป็นต้องหย่าก่อน

โจทก์ฟ้องหย่าจำเลย ขอให้เพิกถอนอำนาจปกครองบุตรผู้เยาว์ทั้งสองของจำเลย และให้โจทก์เป็นผู้ใช้อำนาจปกครองบุตรผู้เยาว์ทั้งสองฝ่ายเดียว จำเลยให้การและฟ้องแย้งว่า จำเลยไม่ได้ทำการเป็นปรปักษ์ต่อการเป็นสามีภริยา โจทก์ไม่อาจฟ้องหย่าได้ จำเลยยังประสงค์อยู่กินฉันสามีภริยากับโจทก์ และแก้ไขเพิ่มเติมฟ้องแย้งว่า หากศาลพิพากษาให้โจทก์และจำเลยหย่าขาดกัน ขอให้บุตรทั้งสองอยู่ในอุปการะเลี้ยงดูของจำเลย ให้จำเลยมีอำนาจปกครอง ให้โจทก์ชำระค่าอุปการะเลี้ยงดูบุตรผู้เยาว์ทั้งสองนั้น แสดงให้เห็นถึงเจตนาแท้จริงตามฟ้องแย้งจำเลยว่า ไม่ประสงค์หย่ากับโจทก์และยืนยันว่าโจทก์ไม่ปฏิบัติตาม ป.พ.พ. มาตรา 1564 วรรคหนึ่ง โจทก์ในฐานะบิดามารดามีหน้าที่ต้องรับผิดชอบ และปฏิบัติตามบทบัญญัติดังกล่าวไม่ว่าโจทก์จำเลยยังคงเป็นสามีภริยาหรือหย่าขาดกันแล้วหรือไม่ กรณีมีเหตุสมควรที่ศาลจะมีคำสั่งให้อำนาจปกครองบุตรอยู่กับโจทก์หรือจำเลยตามมาตรา 1566 (5) ไม่ว่าโจทก์จำเลยจะหย่าขาดจากกันหรือไม่เช่นเดียวกันแม้ศาลจะมิได้พิพากษาให้โจทก์จำเลยหย่าขาดจากกัน โจทก์ก็ยังคงมีหน้าที่ตามกฎหมายดังกล่าวได้ หาใช่ข้อที่มิได้ยกขึ้นว่ากันมาโดยชอบในศาลชั้นต้นดังที่ศาลอุทธรณ์ภาค 8 วินิจฉัย จำเลยมีสิทธิอุทธรณ์ขอให้โจทก์ปฏิบัติตามฟ้องแย้งได้

BANGKOK, Nov. 23 (Xinhua) -- A driver was killed and six female students injured when the van they were traveling in hit the rear of an 18-wheel trailer truck in Thailand's eastern province of Chonburi on Saturday.

Thai police told the media that rescue workers retrieved the body of the driver who died on the spot.

Six passengers, including one university student and five high-schoolers, were hurt and rushed to nearby hospitals, Thai media reported.

Police said the 18-wheel trailer truck loaded with steel rods, suffered little damages at its rear. No one was injured in the trailer truck.
