a little over a month ago, I am bringing my blog back up online. Now is as good of a time as any.

Things are going well. It is New Years Eve and about to bring in the New Year. The new year looks great. I met up with a old high school friend last night. He has a wonderful wife and two adorable children. I am excited about our continued friendship. There are so many stories (most of which will not be repeated here). However, they are the stories that make since to life in general. Here's to a long continued friendship -- and many more birthdays :) LOL.

The old cliche was derived in some truth (as I suspect most are). It is not the destination but the journey there that makes life worth living. Author??? I would like to make an attribution to the author is known. Let me know.

Well, we are about to go out. I need to get dressed.

~James

Ok... I am excited to start my new career and I am antsy to get my first case. I guess this is normal for most new attorneys. I have done alot of soul searching and now have a good idea on where I want to go from here.

My current job has opened my eyes to the fact I do not want to practice in a large firm. A large firm does give one a feel of security; however, it also seems to put you on the track of working in a basement. A supervising attorney once told me that by working in a large firm it could be three to five years until you see your first client. I wish I could say more about my current position but I will leave at this.

So where now? Well that is a good question. I am attacking the "job search" on a three prong approach:

1. I am going to contact the small and medium size firm in the local vicinity. I hope to find an associate position or at least a mentor.

2. Networking: I will continue to netowrk at bar functions.

3. Business Approach: I am working on a business plan to start my own firm. This option is appealing but it is the last option. There is an enormous amount of risk in this option not to mention the lack of capital. However, I feel that it is feasible given the right amount of work and luck.

I must admit I am a little discouraged by the stories of the attorneys I work with. They have an outlook on the job market that is dismal.

Visit my new site: http://www.eshesq.com

Until the next time -- stay tuned.

Jay

Official Now

It is official. I am an Attorney licensed to practice in the State of Texas. My mom came down to Austin to watch the ceremony. My mom, Clay and I drove down to Austin on November 12. At approx. 10:45 I was sworn in with approx. 3,000 other attorneys.

I thought the cermony was pretty cool. The Supreme Court of Texas and the Court of Criminal Appeals opened a session. While the introductions took a little time, the rest of the ceremony went pretty smoothly.

I will post pictures soon.

Stay tuned for updates. :) -- Jay

I'm officially an Attorney (sorda)

Ok... I lost my last post.

I PASSED THE TEXAS BAR!!!!!! I am extremely excited. I would have posted sooner; however, I had to take time to relax and celebrate. I would like thank everyone who stood by me over the years. Yes, through the constant talk of the "law" and for those non-lawyer types who attended law school functions where the entire crowd was doing nothing but talking about the law. I would like to especially thank my mom and Clay. I know it was a long haul over the years. A special thanks to some of my close friends and colleagues -- Judge Taylor, Staff Attorney Jim Longino, Scott Hall, and Cameron McCree. Oh year, and Ashley Hudson. The list goes on and on. I hope to highlight more in the coming days.

I state "I'm officially an Attorney (sorda)." I received a letter for the Board of Law Examiners and they asked for more $$$$. I expected that but I did not know it would be so soon :) I immediately signed the registration form and sent in my dues. I expect by the end of the week my application for a license should almost be complete.

On November 12, I will be attending the swearing in ceremony in Austin, TX. If would like to attend, please send me an email at james.esh@gmail.com I will get you the specifics. I completely understand if you can not make it. We will be taking plenty of pictures and I will share.

Well I leave it at that for right now.

---- Jay

Hmmmmmm.... I am getting real anxious. The Texas Bar results are expected to be released no later than Friday, November 2, 2007. That's right. The results will be released next week. I have been told that last year they released the results the day before the "posted" release date. I feel no better about the potential results than I did in July. In fact, I feel less confident. (See my post in July regarding the bar exam). In any event, I completed the exam in July and nothing has changed with the actual contents of the exam since that date.

Well, I will be sitting quietly waiting. To everyone else waiting -- good luck.

http://www.ble.state.tx.us

-- Jay

Life Passing By

Ok, allow to me to begin by apologizing for the delay in this post. It has been almost two weeks since my last post.

It is has been pretty crazy here. Last week I lost my cell phone. Now, if you know me, you can only imagine the headache that created. I literally live by my phone. My cell phone is the only contact number for job leads. We do not use our home phone at all. If the house phone rings, it is a telemarketer (which surprisingly -- we do not know the home phone number -- however, the telemarketers have gotten a hold of it). Not to mention, I use my phone to check my email and to assit me navigate here in Dallas.

Well, I lost it last week. I am glad we had insurance on it. I remember the sales rep asking if I wanted insurance on the phone and I heard my mother's voice loud and clear "As many times as you loose that thing, I don't know why you don't have insurance on it". Let's look at why such a statement was sparked (rough estimates looking back)--

2000 -- 2 New Cell Phones

2001 -- Good year for my phone -- same phone as 2000

2002 -- 1 New Cell phone -- (One of which was flushed down the toliet. The amazing fact is it still would ring.)

2003 -- Good year.

2004 -- Good year.

2005 -- 1 New Cell phone

2006 -- 2 New Cell Phones (our dog ate one of them -- seriously -- and lost one).

2007 -- 1 New Cell phone -- AT&T did not want our business anymore. We moved to Sprint. See previous post regarding the details.

Aside from losing my cell phone, life has been pretty non-eventful. I enjoy substitute teaching. I specifically enjoy teaching elementary kids. They are a lot of fun and full of energy. The kids want to be there and are excited to learn. I don't know what happens between the summer of 5th grade and the entry into middle school.

Well, I guess I will leave at that for right now.

-- Jay

Fort Worth

We went to Fort Worth this weekend. It was a lot of fun. It is the first time that I have been in Fort Worth. I traveled through Fort Worth once before. I think it was when I was around 16 when I drove through the city. My mom allowed me to borrow the family car and drive to Dallas and visit a friend of mine in Dallas. When I look back at my mom's decision, I realize how big of a decision that was for my mom. Think about it -- my mother allowed a 16 year to drive the family car 6 hours away. At the time we lived in a city of about 3,000 people. She allowed me to drive to a city with over 5 million people with a traffic like few cities. I remember telling my mom that I would be fine.

Now that I am substitute teaching and working with teenagers ranging from 12 to 18 years old (adults), I realize how much trust that took.

Well, I will leave it at that. I might expand on that experience in the near future.

-- Jay

Powered by ScribeFire.

Finality and the Judicial System

I must say that I am awed by the finality in the judicial systems. For better or worse, it is a cornerstone in our legal system. I do not know how it compares to other legal systems; however, when a court reaches a decision in this country it is almost rock solid.

I was reminded of the finality when I heard Senator Craig is going to try to have his guilty plea overturned. It is not my intention, nor will I, provide a legal analysis of his chances. I will that to the pundits and -- oh yeah -- the parties involved. I will say that overturning a guilty plea is a high standard.

The high standard serves a strong public interest. By ensuring a court's decision is "final", the public can rely on the direction of the law and how it will be applied. I would say almost every facet of our general life benefits. From families knowing that their children will not be pulled from their home to business knowing that their conduct is inline with the law ensuring the markets can rely on businesses. Higher courts (appellate courts) generally give deference to lower courts decisions. The deference promotes this same public interest.

I accept the criticism that comes with the view of "finality" in courts decisions. I do not propose every decision is final. Furthermore, it can take years for the "finality" to be determined.

Powered by ScribeFire.

McKinney Officer Accused of Sexual Harassment

Dallas Morning News reported an issue with a McKinney (a local city near Dallas) Police Officer Accuse of sexual harassment. It is alleged the officer offered a fellow female officer $20 dollars to do a "pole dance."

I do not want to speak to the sexual harassment issue reported in the paper. However, I do wish to comment on the Capt. Roland's position. Capt. Roland is a police spokesman. When Dallas Morning News requested documents relating to the incident, the police department fought the release of the documents. The Police did not feel they should be required to release disciplinary records. In fact, Capt. Roland claims these types of disclosures are absurd. Specifically, he asks whether he should be required to release documents to disciplinary actions taken against officers who are late to work. Capt. Roland believes he should not be required to release those documents.

I respectfully dissent. Capt. Roland and the police department work for the general population. I can respect Capt. Roland's position, however, I feel it misses the thrust of the intent behind information acts (here the Texas Information Act). This legislation is designed to shine light on the government. It is a matter of public concern whether a police officer has been disciplined for sexual harassment. It is a matter of public concern whether an officer is able to make it to work on a regular basis. It is a matter of public concern whether a police officer is disciplined for breaking the laws he/she is employed to uphold. It is a matter of public concern whether the employees the Mayor allows to work for the people are actually doing the work they are hired and are competent in doing that work.

While I can appreciate a discipline being sometimes personal, the police department works for the community. They are paid out of the taxes from the people. I am confident a line can be drawn between truly "personal" information and disciplinary information.

The full article can be found at http://www.dallasnews.com/sharedcontent/dws/dn/latestnews/stories/090207dnmetmckpolice.247466f.html

-- Jay

Deletion of Email Account

Hello everyone --

I want to get this information to as many people as possible.
