Read the entry here.</p><h1>Regulation of  Artificial Intelligence: The Americas and the Caribbean</h1><p class="">What are they proposing to be the most important considerations of AI rules?</p><ol data-rte-list="default"><li><p class=""><strong>Public Trust in AI. </strong>Any  government regulation of public sector AI must encourage “reliable,  robust, and trustworthy AI” and these standards should be the  overarching guiding theme.</p></li><li><p class=""><strong>Public Participation. </strong>Agencies  should leverage existing mechanisms and requirements to allow for  public oversight and participation in any AI regulations or rules. The  hope here, as underpins much of the APA, is that the public will voice  concerns and share information not considered internally by the  government agencies that will reshape the regulations.</p></li><li><p class=""><strong>Scientific Integrity and Information Quality. </strong>The  draft rules require agencies to engage with, and rely on, quality  scientific research and information when designing regulations on AI. It  also requires transparency of this research to allow for updated or  contradictory information to be presented. The gets to the heart of the  requirements for validity standards for AI models.</p></li><li><p class=""><strong>Risk Assessment and Management. </strong>The  draft rules require agencies to approach AI regulations from a  risk-based approach. This acknowledges there will be imperfection in AI,  but allows for context-based risk assessments in regulation. Therefore,  some risks are acceptable if they allow AI to progress in line with the  overarching goals, but AI which pose “unacceptable harm, or harm with  greater harm than benefits” can be regulated.</p></li><li><p class=""><strong>Benefits and Costs. </strong>A  long theme in regulation requires agencies to only pursue rules if the  intended benefits of the regulations outweigh the costs of them. This  must be true in AI regulations according to the draft rules.</p></li><li><p class=""><strong>Flexibility. </strong>The  draft rules require that agencies regulate AI in a way that is flexible  to accommodate rapid growth and changes in AI. This should be  accomplished by focusing on performance-based regulation, rather than  design-based. This means that rules will not dictate “how”, but rather  will focus on the “what” of AI.</p></li><li><p class=""><strong>Fairness and Non-Discrimination. </strong>Importantly,  the focus of regulations in this area highlights the need for agency  regulations to ensure fairness and non-discrimination in accordance with  existing laws and rules only. Additionally, the focus should be on the  outcomes of the AI decisions and and unintended discrimination compared  to existing processes as a baseline.</p></li><li><p class=""><strong>Disclosure and Transparency. </strong>The  requirements for regulations of transparency under the draft must be  “context based”. The context must consider potential harms, the  magnitude of those harms, technical state of the AI, and the potential  benefits of the AI. This is an interesting assessment for regulations as  it allows for a number of subjective determinations for agencies to  consider when determining whether or not o require transparency of AI in  the private sector.</p></li><li><p class=""><strong>Safety and Security. </strong>Under  this section, agency regulations must focus on the controls over  confidentiality, integrity, and availability of the data used in an AI  application. The goal is to ensure private sector resilience and  protection against attack and exploitation by bad actors.</p></li><li><p class=""><strong>Interagency Coordination. </strong>And  the final requirement of the OMB draft rules is to ensure sharing and  commonalities between agencies’ regulations.
