If you’ve driven in Philadelphia for any amount of time, you know the endeavor can be a dangerous one. In fact, studies have shown drivers in the city will be involved in a motor vehicle collision every 6.2 years and are 61.2 percent more likely to be involved in a crash than the average American.

Teen drivers seem to be at the highest risk of being involved in a Philadelphia car accident. That’s why state and local officials have created a set of rules young, inexperienced drivers must abide by.

An article from CBS Philly News explains teens in Pennsylvania must be 16-years-old to obtain a learner’s permit. Then, they must complete 65 hours of driving training prior to testing for a junior license. They must hold that restricted license for one year without any accidents before being allowed to test for a full license.

The system seems to be working too. Research has shown the required driving courses have reduced collisions by 4.3 percent.

At Lundy Law, our team of Philadelphia personal injury attorneys knows parents talking to teen motorists about driving safety is also crucial in keeping our roadways safe. That’s why we suggest creating a driving contract you and your teen both sign that outlines the rules of the road, such as no distracted driving, always wear a seat belt, and never get behind the wheel of a vehicle after consuming drugs or alcohol.

Doctors and medical staff have a legal and ethical obligation to protect the well-being of patients who are under their care; however, the Philadelphia personal injury attorneys with Lundy Law point out these individuals too often fail to uphold these obligations by making mistakes, providing negligent care, or in some cases, purposefully harming patients.

Take the case of a Pennsylvania gynecologist who recently lost his license after engaging in inappropriate behaviors with patients. The Branford Era reports patients and employees of the doctor began to come forward claiming he had sexually assaulted and abused them. An employee stated that on January 27 the doctor grabbed her buttocks and made a sexually suggestive comment to her. A patient is arguing that she was fondled following an examination that occurred in June.

Charges are being brought against the doctor, and in addition to punishment for his actions, his license was suspended indefinitely. Officials state that while the patients who were victims may have rights to file a Pennsylvania medical malpractice claim against the doctor, no such civil claims have been made.

At Lundy Law, we understand how traumatizing mistreatment by a doctor can be and we are here to help. If a medical professional has harmed you, we can answer any questions you have regarding your legal rights. Call us today at (800) LUNDY-LAW to discuss your case.

As Americans, we often have a choice between using brand name or generic medications. While the latter can be a great way to save money on your prescriptions, it may also put you at risk of suffering a drug injury.

The manufacturing of brand name drugs is heavily regulated. Both active and inactive ingredients in these products must meet exact measurement standards. Furthermore, they undergo a rigorous testing process to ensure safety. On the other hand, generic medications are allowed to have different amounts and types of inactive ingredients than their name brand counterparts. Also, generics can have slight variations on the amount of active ingredient they contain.

These variations can lead to patients getting too much or not enough of a drug. Take for instance the numerous cases of generic Keppra anticonvulsant dangers. Patients who control their seizures by using brand name Keppra have reported experiencing a reoccurrence in seizure episodes when they swap to certain generic forms of the drug.

The claims are supported by publications from the National Institute of Health that suggest anticonvulsant drugs should be exempt from generic medication substitutions due to potential adverse health events and the risk of a seizure occurring.

If your health has suffered as the result of using a generic Keppra drug to control seizures, you may be entitled to compensation. Our team of Pennsylvania drug injury attorneys can help answer any questions you may have and guide you through the process of beginning to file a claim. To speak with a member of our legal staff, just call (800) LUNDY-LAW.

Most employers in Pennsylvania are required by law to carry insurance to cover the expenses associated with a worker’s injuries in the event of an accident. Despite these regulations, some employers attempt to save money by not carrying such coverage. This can leave injured workers struggling to make ends meet.

Luckily, there is assistance available to workers who are hurt during their employment by a company who is not carrying Pennsylvania workers’ compensation coverage. The state has established a trust fund that supplies monetary support to injured workers who are injured while working for an uninsured employer; however, the rules to receive part of these funds are complicated.

First, a claim for funds from the Uninsured Employer Guaranty Fund must be filed with the Pennsylvania Department of Labor and Industry within 45 days of the worker discovering their employer is not covered by workers’ compensation insurance. Furthermore, there are two forms that must be completed in order for benefits from the fund to be awarded.

Any mistakes that are made during the filing process can also result in the claim being denied or an answer simply not being given.

The Philadelphia personal injury attorneys with Lundy Law are aware of the difficulties that can be associated with a workplace accident, which is why we are here to help. If you’ve been hurt through no fault of your own while working, give us a call at (800) LUNDY-LAW for a free consultation of your case.

When a loved one is no longer able to care for themselves, a home health care provider or a long-term care facility may be a solution. It’s important to remember that nursing home abuse is a very real risk. In fact, the National Center on Elder Abuse reports as many as one-third of all nursing home patients will be the victims of abuse or neglect this year. Their experts concede this number may be conservative as well, considering the number of cases that go unreported.

These figures leave many citizens wondering what they should if they suspect their loved one living in a nursing home is suffering abuse or neglect at the hands of care providers. The first thing that should be done in this situation is filing a report with the proper authorities.

The Pennsylvania Department of Health explains the first person who should be contacted is management at the facility where your loved one is staying. You should then reach out to your local advocates for the elderly and disabled. Finally, be sure to contact the Department of Health to launch an investigation into the potential abuse.

If incidents of abuse or neglect are confirmed, it may be wise to speak with a Pennsylvania personal injury lawyer regarding you and your loved ones legal rights. At Lundy Law, we have decades of experience in helping victims of abuse and can help answer any questions you may have regarding your situation.

There are thousands of children in the Philadelphia area who are living in poverty. That’s why at Lundy Law, our Philadelphia personal injury lawyers take great pride in giving back by helping the youth of the city.

The firm’s team has assisted many of Philadelphia’s young people by sponsoring two unique organizations. The first is Blessings in a Backpack. This group provides Philadelphia’s school age children with backpacks filled with food items that can be consumed during the weekends when they are away from school—where free or reduced cost meals are offered. The program not only helps to fight hunger, but also works to ensure students are energized and ready to learn when in the classroom setting.

Another way we are working to assist and educate the city’s children is by sponsoring a book drive for the Children’s Hospital of Philadelphia. We asked books to be donated so that children staying in the medical facility could be supplied with reading materials to occupy their time. As of August 6, the latest collection blitz has resulted in more than 1,000 books being gathered.

At Lundy Law, our firm is proud to give back to our community where we can. That’s why we encourage you to stay up to date on our latest philanthropic endeavors by regularly checking our website and social media outlets, such as Facebook and Twitter.

Every year in Pennsylvania there are a large number of motorcycle accidents reported. Experts believe a large portion of these accidents could be avoided if more motorcycle riders received professional safety training prior to taking their bikes on the road.

This is made apparent by statistics from the Pennsylvania Department of Transportation that shows last year, there were 860,377 licensed motorcyclists and 405,209 registered bikes in the state; however, there were only 21,196 riders who participated in motorcycle safety training programs despite the number of training centers offering these courses steadily growing.

The state is hoping to reduce Pennsylvania motorcycle accident numbers by getting more riders to participate in these courses. One way they are doing so is by offering the classes to motorcyclists at no charge.

An article from The Meadville Tribune states there are three different courses to choose from: a beginner, an intermediate, and an advanced class. The classes focus on offering riders both classroom and hands-on training covering all aspects of motorcycle safety. A schedule of dates and times these courses can be taken is available on the web and by calling (800) 845-9533 Monday through Friday from 8 A.M. to noon.

At Lundy Law, our Pennsylvania personal injury attorneys are aware of the importance of motorcycle safety and encourage riders of all experience levels to sign up to participate in one of these courses.

The U.S. Department of Veterans’ Affairs (VA) is currently facing a scandal involving the improper processing of veterans disability claims, which in turn led to a massive backlog that left many former service members struggling to receive the medical care and benefits they desperately are in need of. Now, one lawmaker is calling for the Philadelphia VA office to be investigated for manipulating Pennsylvania veterans’ disability benefit claims.

Congressman Mike Fitzpatrick alleges the employees at the Philadelphia VA office destroyed paperwork and mail for financial gain. He went on to claim that dates on disability documents were also altered.

According to The Newtown Patch, Fitzpatrick explained the bonuses of VA Executives and employees were directly tied to the processing of disability claims. By changing the dates and shredding mail that came in, the VA was able to manipulate claims processing data in their favor. This led to some VA employees receiving bonuses of more than $2,000.

Fitzpatrick was part of a congressional committee that questioned VA officials and has since penned a letter to federal authorities asking them to investigate his claims of wrongdoing.

At Lundy Law, our team of Pennsylvania personal injury lawyers knows how badly many veterans are in need of assistance and are hopeful the investigations of the VA that are taking place are effective in giving veterans better access to the benefits they are entitled to.

Each week in the city of Philadelphia, hundreds of motorists are arrested for driving under the influence of drugs or alcohol. New transportation services that have been introduced in the area recently may be significantly impacting the number of Philadelphia car accidents associated with intoxicated driving—and in a good way.

Reports indicate the city recorded an average of around 1,262 Driving Under the Influence (DUI) arrests per month between January 2004 and January 2013. By the end of 2013—when all ride sharing services were in effect in Philadelphia—that number plummeted by more than 11 percent to an average of around 1,121 DUI arrests per month. According to an article from NBC-Philadelphia News, the decrease in DUI arrests among drivers under the age of 30-years-old was even greater.

In response to these findings, ride sharing company Uber has partnered with the nonprofit organization Mothers Against Drunk Driving (MADD) in an effort to raise funds to combat intoxicated driving. For every ride that is taken through Uber, the company will donate $1 to MADD’s cause.

At Lundy Law, our team of Philadelphia personal injury attorneys has seen the devastating results drunk or drugged driving can have. That’s why the firm encourages you to stay safe and possibly support a good cause by using taxis or ride sharing services if you’ve had too much to drink.

Property owners have a responsibility to ensure the safety of visitors. That’s why the case of a Pennsylvania deck collapse in Penn Forrest Township has gained so much attention.

The Pennsylvania Slip and Fall Accident that left almost one dozen people injured occurred on the evening of July 8 at a Carbon County rental property. Reports indicate 11 people were standing on a deck of the property during a child’s birthday party when the structure beneath their feet suddenly gave way, causing them to fall to the ground below.

According to a release from NBC-Philadelphia News, the incident resulted in four people being airlifted to a local hospital for treatment, while two others were transported via ambulance. A handful of other victims suffered cuts and bruises and were treated at the scene.

Investigators are still looking into the cause of the accident, but they state there seems to be no indication that too many people were standing on the structure at the time of the collapse. Neighbors say the deck had just passed a safety inspection.

At Lundy Law, we know the devastating results accidents can have on victims. That’s why our Philadelphia personal injury lawyers are here to help by answering any questions you may have if you or a loved one were injured on someone else’s property.
