Yep, you heard me right, and it all steams from my last post titled &#8211; <a href="http://www.mlmhelpdesk.com/2010/03/05/data-network-affiliates-narc-technologies-may-be-lying-to-their-distributors/">Data Network Affiliates and Narc technologies May be Lying to Their Distributors</a>. </p>

<p>See in the video, I stated &#8220;it&#8217;s been purported Phil Piccolo has signed an agreement with FTC &#8211; NOT to be be associated in MLM ever again.&#8221; Well, that seems to have been the catalyst for Phil Piccolo.<br />

So Piccolo called his MLM Attorney Mr. D. Jack Smith and Jack told him &#8220;Make an example of Troy Dooly.&#8221; Which I truly find funny, because lord knows Rod Cook the MLM Watchdog has said far worse things than I have ever said or written about Phil Piccolo. But hey, I&#8217;m the new kid on the block.</p>
<p>Anyway, after over two hours on the phone with Phil Piccolo, which by the way, he was an enjoyable guy to talk with, I did come to the following conclusions&#8230;</p>
<p>1. Phil Piccolo, if he is not MLMs most notorious scammer, (which by the time I am done, I will know one way or another) has to be one of the most unlucky MLM professional in history.  </p>
<p>2. Phil Piccolo has NEVER (according to Phil himself) signed or agreed to any form of agreement with the FTC to never be affiliated with MLM, Network Marketing, Direct Selling or any other term we want to give our great profession. </p>
<p>3. Phil Piccolo has at least one very well respected MLM Professional as a very close friend. This person is someone I respect, admire and have called on more than once for advice, either directly or through the training they provide. </p>
<p>4. Phil Piccolo understands I will not take anything off of MLM help Desk, but I will continue to write blog posts, and shoot videos sharing the facts as they become available. </p>
<p>What I want from every person who reads this blog post, is for you to write a comment covering one of the following&#8230;</p>

<p>Now don&#8217;t get me wrong the products are great. But&#8230; It doesn&#8217;t matter how great the product is, if you don&#8217;t have a field force to sell it! Just look at the predecessor of MonaVie, Monarch Health Sciences.  </p>
<p>The engine behind the massive success of MonaVie is the field culture which has develop based on the people who have joined the company. I&#8217;m not talking about the great successful leaders we have all heard abut over the years&#8230; Brig Hart, Orrin Woodward, Chris Brady, Rodney Howard-Browne just to name a few. </p>
<p>Nope, it is this new breed of leaders&#8230; Leaders who are where the above leaders were twenty years ago&#8230;</p>
<p><strong>Steve &#038; Gina Merritt</strong> &#8211; Built their MonaVie business part-time while working two full-time jobs and raising a family. </p>
<p><strong>Corbin &#038; Holly Roush</strong> &#8211; Holly was a closet drinker, hiding in the closet making calls so her husband would not get upset. Today, Holly is out of the closet and Corbin is a true MonaVie raving fan.<br />

Matthew &#038; Kimberly Curtis</strong> &#8211; High school sweethearts, Matthew thought functional health beverages were a six pack of bud light. From the ground up, they have built a successful MonaVie business. </p>

<p>yesterday I had a couple of fantastic phone calls with the former Founder, CEO, and Chairman of the Board of Data network Affiliates, Dean Blechman. He was very open and upfront on several fronts, and in a couple of weeks, I&#8217;ll do a couple of articles on Dean Blechman, the past present and future&#8230; Stay tuned. </p>
<p>But&#8230; After talking with Dean, I started doing some new research and realized that although Rod Cook the MLM Watchdog broke the story of <a href="http://www.mlmwatchdog.com/mlm_scams_phil_piccolo.html">Phil Piccollo being the mastermind behind DNA</a> and <a href="http://www.businessforhome.org/2010/02/phil-piccollo-review/">Business From Home put up a review of Phil</a> which set off a wave of controversy. And let&#8217;s not forget Patrick Pretty was really the first big blog to break the stories on both Narc Technologies (<a href="http://patrickpretty.com/2010/03/05/bulletin-narc-that-car-gets-f-from-bbb-rating-is-lowest-on-14-step-bbb-scale/">Narc That Car</a>) and DNA (<a href="http://patrickpretty.com/2010/03/02/data-network-affiliates-dna-issues-bizarre-announcements-meanwhile-narc-that-car-promoter-says-ntc-like-working-for-census-bureau/">Data network Affiliates</a>.)  </p>
<p>But a couple of things have not been touched on.</p>
<p>1. Why is Arthur Kurek and Donald Kessler still at DNA? Both of these guys use to have clean reputations. However, based on the validated information which has come forward, these two guys stand to lose more than anyone else. </p>
<p>If it&#8217;s true that Phil Piccolo is the mastermind behind DNA (Rumors are starting to flow that Phil may also be focusing on Automatic Geek another MLM startup) and the FTC comes down on this company. Then these both Arthur Kurek and Donald Kessler could be fined huge amounts for allowing Piccolo to run the company behind the scenes. But even worse Arthur Kurek who has worked in the highly regulated Insurance Industry for over 40 years could see his career go down the drain, or at the very least be faced with early retirement. </p>
<p>2. Both DNA and Narc continue to promote their propaganda that law enforcement wants and needs access to the databases. Yet, from the news reports this is the farthest thing from the truth. </p>

<p><a href="http://www.theaustralian.com.au/australian-it/privacy-concerns-on-speed-cameras/story-e6frgan6-1111117557005">Even Austrian citizens are concerned over the privacy issues raised from Law Enforcement using Cameras.</a></p>
<p><a href="http://www.drivers.com/article/1058/">And let&#8217;s be fair, there are those who are not worried about the privacy issue.</a></p>
<p>At America.Gov the following has been posted: <a href="http://blogs.america.gov/bythepeople/2010/02/19/are-traffic-cameras-unfair-and-an-invasion-of-privacy/">Are Traffic Cameras Unfair and an Invasion of Privacy? </a></p>
<p>By now you may be asking &#8220;What does any of this have to do with Narc That Car and Data network Affiliates? Simple, it brought the following questions to my mind. </p>
<p>1. If private citizens are concerned about the videos and pictures taken from public highways, how are they going to feel when they learn their neighbors and friends are also placing their personal information into a database to be used by people who are not in law enforcement?</p>
<p>2. Since I am not the only person concerned about privacy issues, I wonder if maybe the distributors of Narc and DNA should give a second thought to the concern, and not just rollover and accept the Indoctrination propaganda being fed to them from the company and top leaders who both have huge monetary reasons to keep them from asking hard questions?</p>
<p>3. Is this the reverse of the traditional training message we have heard for years&#8230; Instead of go to your friends and family and get them to join, now the new message seems to be go get even with your friends and family and get us their license plate number&#8230; It will not hurt anyone&#8230; But who truly knows?</p>

However, to date there are still some issues which has left us no choice but to list them under Scam Alerts. However, </p>

<p><strong>However, I want to make it perfectly clear, I DO NOT think these guys are scammers, or trying to take everyone&#8217;s money without delivering mobile services.</strong> This is strictly due to the fact, they have have the following issues on their site which can cause major issues with the state of TX, FTC, and ACN. </p>
<p>I have brought these concerns to Kevin Sipes, Harry Aston and Chris Greco more than once. Although, I am sure they are very busy, I also made it clear time was of the essence because people were waiting for a review of the company. </p>
<p>1. They have a dead link to their <a href="http://panthermobile.com/affiliate.asp?id=1">affiliate program</a>. Based on the fact they currently do not have a place for a person to join Panther Mobile who just wants to make personal sales, or market Panther Mobile in a retail location, and not be a part of the matrix this is a huge Red Flag, causing the company to fall under current definition of MLM Pyramid.</p>
<p>2. The Panther Mobile <a href="http://panthermobile.com/pantherTERMS.asp?id=1">Terms and Conditions</a> (which are found under &#8220;Terms of Use&#8221; state IBR have to be part of the Panther Mobile Matrix compensation plan. Which does not line up with the Panther Mobile <a href="http://panthermobile.com/pantherPRIVACY.asp?id=1">Policies &#038; Procedures</a> which state the opposite.  </p>
<p>3. The links inside the <a href="http://panthermobile.com/pantherTERMS.asp?id=1">Terms and Conditions</a> (Scroll to the bottom of the T&#038;Cs) which link to the Compensation Plan and the Policies and Procedures link to pdf copies of the <a href="http://www2.acninc.com/join/301.pdf">ACN compensation plan</a> and a copy of the <a href="http://www2.acninc.com/join/USPP.pdf">2008 ACN Policies &#038; Procedures</a>. </p>
<p>4. The T&#038;Cs are found under the &#8220;<a href="http://panthermobile.com/pantherTERMS.asp?id=1">Terms of Use</a>&#8221; and the <a href="http://panthermobile.com/pantherPRIVACY.asp?id=1">Polices and Procedures</a> are found under the &#8220;Privacy Policy&#8221; link. Which means the average distributor will never read these before they sign the agreement to join Panther. This can hurt both Panther and the Distributors. </p>
<p>5. This one is small. But, since the company has announced new Florida offices, yet their agreements and website state TX, there needs to be come clairity as to where this company is calling its home state of record. </p>
<p>So, in closing, I believe if this company fixes these issues, they can become a serious player in the MLM Wireless Niche. However, if they do not start focusing on the small things, they may get hit by a regulatory agency with a cease and desist. </p>
<p><strong>As soon as we have verified all these red flags have been fixed, we will gladly move this company from Scam Alert to MLM Companies.</strong> Until then I can&#8217;t play favorites, when a company is not protecting their distributors, then we have no choice but to call them on it. </p>
