Alternatively, a debtor may consent to the deduction of the plan payments, from the debtor's paycheck, to be sent directly to the Chapter 13 trustee. He must begin making payments under his Chapter 13 repayment plan within 30 days after he files it with the bankruptcy court. After the meeting of creditors is concluded, the bankruptcy judge must determine at a confirmation hearing whether the plan is feasible and should be approved. A Chapter 13 plan must pay certain debts called priority debts in full. Creditors may object to confirmation of the plan based on various grounds that are set forth in the Bankruptcy Code. In that instance, the bankruptcy court will hear and rule on the objections. Once the payment plan is confirmed, the trustee will distribute the money to his creditors. Usually, the debtor makes payments directly to the bankruptcy trustee. If you repay all of your debts in full, even if you have not yet reached the three or five year mark your plan will end no matter how much you earn. The bankruptcy court can also give you a hardship discharge.

Contact us if you want to file for bankruptcy. Under Chapter 13, debtors are permitted to repay creditors, in full or in part, in installments over a three- to five-year period, during which time creditors are prohibited from starting or continuing collection efforts. A plan providing for payments over more than three years must be for cause (a reason) and must be approved by the court. In no case may a plan provide for payments over a period longer than five years. Chapter 13 contains a special automatic stay provision applicable to creditors. A Chapter 13 case begins when a debtor files a petition with the bankruptcy court serving the area where the debtor has a residence. Unless the court orders otherwise, the debtor also shall file the following documents with the court:

1. Schedules of assets and liabilities;
2. Schedule of current income and expenditures;
3. Schedule of unfulfilled contracts and unexpired leases; and
4. Statement of financial affairs.

The debtor must file a plan of repayment with the petition or within 15 days thereafter, unless extended by the court for cause. The Chapter 13 plan must, among other things, provide for the debtor to contribute that portion of his or her future income as is necessary to meet the terms of the plan.

Contact us if you want to file for bankruptcy. Although each chapter differs from the others in significant ways, there are important elements that are common to all bankruptcy cases: automatic stays and discharges. Filing for bankruptcy puts into effect an "Order for Relief" -- known informally as the "automatic stay." The automatic stay immediately stops most creditors from trying to collect what you owe them. The second of these common elements is the bankruptcy discharge. The primary objective of bankruptcy is to discharge certain debts to give an honest individual debtor a fresh start. The discharge operates differently in the various chapters. Some debts are not discharged by bankruptcy. These include:

1. Alimony and child maintenance and support obligations,
2. Certain taxes,
3. Debts for certain educational loans made or guaranteed by a governmental unit,
4. Debts for willful and malicious injury inflicted by the debtor,
5. Debts for death or personal injury caused by the debtor's operation of a motor vehicle while the debtor was intoxicated from alcohol or other substances, and
6. Debts for criminal restitution orders.

Contact us if you want to file for bankruptcy. If your assets are exempt, you may not lose anything. The other process is Chapter 13 bankruptcy, also known as a "Wage Earner’s Plan". Under Chapter 13 you retain control of your assets, but you are required to make monthly payments for a three to five year period to repay your creditors. Filing for bankruptcy puts into effect an "Order for Relief" -- known informally as the "automatic stay." The automatic stay immediately stops most creditors from trying to collect what you owe them. So, at least temporarily, creditors cannot legally grab your wages, empty your bank account, go after your car, house, or other property, or cut off your utility service or welfare benefits. The first of these elements is the automatic stay. The filing of a bankruptcy petition automatically stays most actions against the debtor or the debtor's property. Creditors normally receive notice of the filing of the petition from the clerk. The stay arises by operation of law and requires no judicial action. As long as the stay is in effect, creditors generally cannot initiate or continue any lawsuits, garnish wages, or make telephone calls demanding payments. The automatic stay provides a period of time in which all judgments, collection activities, foreclosures, and repossessions of property are suspended and may not be pursued by the creditors on any debt or claim that arose before the filing of the bankruptcy petition. The stay provides a breathing spell for the debtor, during which time negotiations can take place to try to resolve the difficulties in the debtor's financial situation.

Contact us if you want to file for bankruptcy. This is because the new law would require a debtor having salary above the median income level to undergo credit counseling at least 180 days prior to filing for bankruptcy.

The credit counseling services check out whether debtors can pay at least 60% or more of their debts so that they don't have to file bankruptcy. Moreover, those opting for bankruptcy will have to go through a Means Test which can determine the type of bankruptcy that he should file. When you qualify through the Means Test, the court appoints a bankruptcy trustee to supervise the payment of your debts. Usually payments towards secured debts like mortgages are given priority over unsecured debts during a bankruptcy case. Otherwise the lender may take away the property acting as collateral for the secured debt. Through bankruptcy, most of the debtor's debts are eliminated, thereby providing an honest but unfortunate debtor a fresh start. Get an attorney who can help you work through the issues, alternatives, and conclusions of your own choices. Choose an attorney with whom you are comfortable, one who you can ask questions and get responses you understand. A bankruptcy attorney should be specialized, well-trained and experienced in bankruptcy. Getting an effective bankruptcy attorney will help you get fast debt relief and to be provided with valuable resources, services and expert advice to get all your financial affairs back in order. Try not to retain the cheapest attorney.

It may cost you more if you do not have a sufficient budget for an effective attorney. You will have to pay attorney fees but remember that, if successful, much of your other outstanding debt could potentially be discharged, making the attorney fees you incur much more manageable. In case you intend to file bankruptcy, you can approach the court and file the list of all outstanding debts and assets. But you can only sell off those assets which are non-exempt, that is, which can be used for the repayment of debts. However, under the new Law, it is not that easy to qualify for bankruptcy. This is because the new law would require a debtor having salary above the median income level to undergo credit counseling at least 180 days prior to filing for bankruptcy.

Contact us if you want to file for bankruptcy. Most or all debts are cancelled under chapter 7. Usually a trustee is appointed to take over your property. As discussed earlier, some specific assets must be surrendered to the trustee or sold in order to reimburse your creditors. You may be able to keep some personal items and possibly real estate depending on the law of the state. The filing of a petition under Chapter 7 automatically stays most actions against the debtor or the debtor's property. This stay arises by operation of law and requires no judicial action. As long as the stay is in effect, creditors generally cannot initiate or continue any lawsuits, garnish wages, or make telephone calls demanding payments. Grounds for denying a discharge to a Chapter 7 debtor include that:

1. The debtor failed to keep or produce adequate books or financial records;
2. The debtor failed to explain satisfactorily any loss of assets;
3. The debtor committed a bankruptcy crime such as perjury;
4. The debtor failed to obey a lawful order of the bankruptcy court; or
5. The debtor fraudulently transferred, concealed, or destroyed property that would have become property of the estate.

Contact us if you want to file for bankruptcy. Sometimes this can of great benefit because you can usually keep your property and you must agree to pay part of your income to your creditors. The court must approve your repayment plan and your budget. Usually, a trustee is appointed and who collects the payments from you, pays your creditors, and makes sure you live up to the terms of the proposed repayment schedule. There's a trustee fee in these repayment plans and sometimes it's not inexpensive. The plan which must be approved by the court provides for payments of fixed amounts to the trustee on a regular basis, typically biweekly or monthly. The trustee then distributes the funds to creditors according to the terms of the plan, which typically offers creditors less than full payment on their claims. If you have a regular job with regular income, the bankruptcy court may order that your monthly payments be automatically deducted from your wages and sent directly to the bankruptcy court. You are entitled to a discharge upon successful completion of all payments under the Chapter 13 plan.

Contact us if you want to file for bankruptcy. An attorney can help give you advice about the bankruptcy laws and what is best for your current situation. Bankruptcy law is a specialized area that can be far more complex than it appears. The issues are not always apparent or simple. Pick a bankruptcy attorney who can help you work through the issues, alternatives, and conclusions of your own choices. You are not required to have an attorney file your bankruptcy case. You can file it yourself. There are many do it yourself bankruptcy kits. But it is advisable not to do so. Bankruptcy law is complex. If you do not get a discharge, there are restrictions on future bankruptcy filings.

One of the primary purposes of bankruptcy is to discharge certain debts to give an honest individual debtor a fresh start. The discharge has the effect of extinguishing the debtor's personal liability on discharge able debts. Filing for bankruptcy puts into effect an "Order for Relief" -- known informally as the "automatic stay." The automatic stay immediately stops most creditors from trying to collect what you owe them.

Contact us if you want to file for bankruptcy. The process is not always the same and it depends on who is actually filing. If a person or an individual files bankruptcy the process is completely different than if a business files for bankruptcy. An experienced bankruptcy attorney can guide you to select the most appropriate Chapter. He can analyze your financial situation and tell you what your alternatives are, as well as answer any of your questions. Bankruptcy filing is a complex procedure. Do not use those do it yourself bankruptcy kits. Use an experienced bankruptcy attorney. Under Chapter 11, the company is allowed to "reorganize" its business and attempt to develop into a profitable corporation.

The company still functions on a day-to-day basis other than the fact that all important business decisions have to be agreed upon by a bankruptcy court. Chapter 11 bankruptcy is called the reorganization bankruptcy because a person may be allowed to propose a plan of reorganization or repayment so that they can continue with his business while paying for his debt. Companies affected with this type of condition can still trade stocks. Chapter 11 Bankruptcy is almost certainly the most flexible of all the chapters, and the same time the hardest to generalize. Under Chapter 7, the company will stops all it operations and completely shut all its functions. The court assigns a trustee to "liquidate" (sell) the company's assets.

Contact us if you want to file for bankruptcy. Choice of these plans is never easy. It is always advisable to consult an attorney with your specific problems. By filing for bankruptcy, you are technically placing the property you own and the debts you owe in the hands of the bankruptcy court. You can't sell or give away any of the property you own when you file, or pay off your pre-filing debts, without the court's consent. However, with a few exceptions, you can do what you wish with property you acquire and income you earn after you file for bankruptcy. To begin the bankruptcy process, you file legal papers called a petition with the Bankruptcy Court. You must list all your debts and property on the petition. After you file for bankruptcy, your creditors cannot try to collect from you directly, but they must take any claims they have against you to the Bankruptcy Court. It prohibits your creditors from debt collection actions without the court's approval.

Contact us if you want to file for bankruptcy. However, this does not necessarily mean that they would not have to pay their debts anymore. In fact, when an individual or a company declares bankruptcy, they are protected from any further complications resulting from the bankruptcy itself. Their creditors, or the people and companies that they owe, are also given the assurance and guarantee that they will be able to get back and receive a portion of what they are owed. Bankruptcy is a legal procedure for dealing with the debt problems of individuals and businesses and discharges financial obligations. This procedure is covered under Title 11 of the United States Code (the Bankruptcy Code). The vast majority of cases are filed under the two main chapters of the Bankruptcy Code, which are Chapter 7 and Chapter 13. Filing for bankruptcy puts into effect an "Order for Relief" -- known informally as the "automatic stay."

The automatic stay immediately stops most creditors from trying to collect what you owe them. So, at least temporarily, creditors cannot legally grab your wages, empty your bank account, go after your car, house, or other property, or cut off your utility service or welfare benefits.

Contact us if you want to file for bankruptcy. Experience has shown that this practice increases the likelihood that payments will be made on time and that the plan will be completed.

In either case, failure to make the payments in accordance with the confirmed plan may result in dismissal of the case or its conversion to a liquidation case under Chapter 7 of the Bankruptcy Code. With certain exceptions, the debtor has the right to dismiss the Chapter 13 case at any time. If you use Chapter 13, the entire repayment plan must be completed in three to five years in order to have your remaining debts discharged unless the court lets you off the hook early, for hardship reasons. If for some reason you are unable to finish a Chapter 13 repayment plan the bankruptcy trustee may modify your plan. The trustee may:

1. give you a grace period, if the problem looks temporary
2. reduce your total monthly payments, or
3. extend the repayment period.

All remaining debts that are eligible for discharge will be wiped out once you complete your repayment plan.

Contact us if you want to file for bankruptcy. If your income is sufficient, after subtracting what you'll spend on certain allowed expenses and monthly payments for child support, tax debts, secured debts such as a mortgage or car loan, and a few other types of debts, to fund a Chapter 13 repayment plan, you won't be allowed to file for Chapter 7. Probably the main reason most people prefer Chapter 7 is that it doesn't require you to repay any portion of your debts, as Chapter 13 does. A Chapter 13 case begins when a debtor files a petition with the bankruptcy court serving the area where the debtor has a residence. Upon the filing of the petition, an impartial trustee is appointed to administer the case. The primary role of the Chapter 13 trustee is to serve as a disbursing agent, collecting payments from debtors due under the plan and, in turn, distributing these payments to creditors.

Chapter 13 contains a special automatic stay provision applicable to creditors.

The grounds for denying an individual debtor a discharge in a Chapter 7 case are very narrow. Grounds for denying a discharge to a Chapter 7 debtor include that:

1. The debtor failed to keep or produce adequate books or financial records;
2. The debtor failed to explain satisfactorily any loss of assets;
3. The debtor committed a bankruptcy crime such as perjury;
4. The debtor failed to obey a lawful order of the bankruptcy court; or
5. The debtor fraudulently transferred, concealed, or destroyed property that would have become property of the estate.

A typical Chapter 7 case is opened and closed within three to six months, and the person filing emerges debt-free except for a mortgage, car payments, and certain types of debts that survive bankruptcy, such as student loans, recent taxes, and back child support. Once you receive your bankruptcy discharge, you no longer legally owe your creditors for any discharged debts. Although you can lose property in Chapter 7, most filers don't. Bankruptcy lets you keep most necessities if you have little to begin with, chances are good you'll be able to keep most items unless you pledged the item as collateral when you bought it.

Contact us if you want to file for bankruptcy. There are certain types of debts that can not be discharged under Chapter 7. Court ordered child support; alimony and debts incurred by fraud are not dischargeable. Some taxes and student loans may also not be dischargeable.

Creditors normally receive notice of the filing of the petition from the bankruptcy court clerk. One of the schedules that will be filed by the individual debtor is a schedule of exempt property. Upon the filing of the Chapter 7 petition, an impartial case trustee is appointed by the U.S. trustee to administer the case and liquidate the debtor's nonexempt assets. The primary role of a Chapter 7 trustee in an asset case is to liquidate the debtor's nonexempt assets in a manner that maximizes the return to the debtor's unsecured creditors. A discharge releases the debtor from personal liability for discharged debts and prevents the creditors owed those debts from taking any action against the debtor or his or her property to collect the debts.

Contact us if you want to file for bankruptcy. When a debtor files a bankruptcy petition, the debtor must provide the following information:

1. A list of all creditors and the amount and nature of their claims;
2. The source, amount, and frequency of the debtor's income;
3. A list of all of the debtor's property; and
4. A detailed list of the debtor's monthly living expenses (food, clothing, shelter, utilities, taxes, transportation, medicine, etc.).

Certain debts that can’t be discharged by bankruptcy. These debts include taxes, child support or alimony, student loans, or any fraudulent debt. Although some legal settlements may be removed it’s not guaranteed.

Choice of these plans is never easy. It is always advisable to consult an attorney with your specific problems. If you are about to loose your home in foreclosure, you should seriously consider filing a bankruptcy petition. This can stop the foreclosure process and allow you time to regroup and try to work out a plan to keep the home. Bankruptcy may also help past defaults and make future payments.

Contact us if you want to file for bankruptcy. Although being bankrupt does lighten one's financial burden, it also has drawbacks. First, the debtor loses all control over his properties and assets. Any business the debtor owns is closed and all its employees are dismissed. Second, his credit accounts are closed such as loans, credit cards, and bank accounts. Also, bankruptcy remains in a person's credit history for 10 years which can seriously damage his credit reputation. Third, his bankrupt state is made public by advertisements in local papers. In addition, the bankrupt individual must inform every person he deals with about his bankrupt state unless after he is discharged. Now to the positive side. First of all, when you file for bankruptcy – Chapter 7 or Chapter 13, an automatic stay comes into affect. Your creditors cannot seek to recover the debts from you without the permission of the court. When you are in deep financial mess, your credit score is the last thing on your mind. Bankruptcy law is a federal law; however, there are state laws pertaining to bankruptcy, especially on exemptions. So specific rules governing bankruptcy depends on the state of residence and filing. Before you can proceed with filing a chapter 13, you are required to complete a course in personal financial management. This credit counseling course has to be approved by the court trustee. There is a fee for this course, but if you are unable to pay, you will receive the counseling free of charge. The changes to the bankruptcy code have made it difficult for many individual debtors to qualify for Chapter 7. Any individual, even if self-employed or operating an unincorporated business is eligible for Chapter 13 relief. Eligibility is contingent on the fact that the individual's unsecured and secured debts are between certain dollar amounts that are adjusted annually by statute. A corporation or partnership may not be a Chapter 13 debtor. Chapter 13 is designed for individuals with regular income who want to pay their debts but are unable to do so in a timely manner. The purpose of Chapter 13 is to enable financially distressed individual debtors to propose and carry out a repayment plan under which creditors are paid over an extended period of time. During this time the law forbids creditors from starting or continuing collection efforts.
Under chapter 13, there are certain debts that must be paid in full. These include child support, alimony and some tax obligations. These debts are non-dischargeable and must be paid one-hundred percent. They are called priority debts because they're considered sufficiently important to jump to the head of the bankruptcy repayment line. The debtor must make regular payments to the trustee, which requires adjustment to living on a fixed budget for a prolonged period. Alternatively, a debtor may consent to the deduction of the plan payments, from the debtor's paycheck, to be sent directly to the Chapter 13 trustee. He must begin making payments under his Chapter 13 repayment plan within 30 days after he files it with the bankruptcy court. Usually, he makes payments directly to the bankruptcy trustee. Once there payment plan is confirmed, the trustee will distribute the money to his creditors. The Chapter 13 debtor is entitled to a discharge upon successful completion of all payments under the Chapter 13 plan. In return for the willingness of the Chapter 13 debtor to undergo the discipline of a repayment plan for three to five years, a broader discharge is available under Chapter 13 than in a Chapter 7 case.

When a debtor files a bankruptcy petition, the debtor's relationship with his creditors is adjusted. Many of his debts are forgiven and he is also allowed to keep some properties known as exempt items. However, his non-exempt items which includes most of f his valuable properties are sold off and the proceeds are distributed among his creditors by the bankruptcy trustee appointed by the bankruptcy court. As a result, some of his debts can be paid in full or just partly. If most of his valuable properties (i.e. house, car) are named as collateral for any debt such as mortgage or a car loan, the proceeds from the selling of these items are used to pay these specific debts. Only the balance or excess is used to pay off the other debts. In a sense, bankruptcy fulfills two objectives: it frees the debtor from paying his debts and ensures that all assets are distributed among the creditors.
However if the debtor files a Chapter 13 bankruptcy proceeding, the debtor is allowed to keep his assets as long as he stick to the payment plan. The plan which must be approved by the court provides for payments of fixed amounts to the trustee on a regular basis, typically biweekly or monthly. The trustee then distributes the funds to creditors according to the terms of the plan, which typically offers creditors less than full payment on their claims.

More often than not, the Chapter 11 Bankruptcy does not have any amount of debt limitation unlike Chapter 13. Chapter 12 bankruptcy is another bankruptcy plan. It is almost identical to Chapter 13 bankruptcy. The main difference is that to be eligible for Chapter 12 bankruptcy, at least 80% of your debts must arise from the operation of a family farm. Chapter 12 has higher debt ceilings to accommodate the large debts that may come with operating a farm, and it offers the debtor more power to eliminate certain types of liens. Any individual, even if self-employed or operating an unincorporated business, is eligible for Chapter 13 relief. Eligibility is contingent on the fact that the individual's unsecured and secured debts are between certain dollar amounts that are adjusted annually by statute. A corporation or partnership may not be a Chapter 13 debtor.

One of the main purposes of bankruptcy law is to provide the debtor who is hopelessly burdened with debt an opportunity to free him or herself of the debt and start fresh - "almost like having a new lease on life." By law, all actions against a debtor must cease once you file bankruptcy. Creditors can’t initiate or continue any lawsuits, wage garnishees, or even telephone calls demanding payments. Your wife or husband will not be affected if you file bankruptcy, if they are not responsible (did not sign an agreement or contract) for any of your debt. Once you receive your bankruptcy discharge, you no longer legally owe your creditors for any discharged debts. You can resume your economic life without court supervision, except you must tell the court if you receive or become eligible to receive an inheritance, insurance proceeds, or proceeds from a divorce settlement within 180 days of the date you originally filed your papers. Debts for money or property obtained by fraud, debts for willful and malicious injury inflicted by the debtor, and debts arising from a property settlement agreement incurred during or in connection with a divorce or separation unless a former spouse timely files and prevails in an action to have such debts declared excepted from the discharge are discharged.

Chapter 12 Bankruptcy provides debt relief to family farmers with regular annual income. The process under chapter 12 is very similar to that of chapter 13 under which the debtor proposes a plan to repay debts over a period of time - no more than three years unless the court approves a longer period, not exceeding five years. There is also a trustee in every chapter 12 case whose duties are very similar to those of a chapter 13 trustee. The chapter 12 trustee’s disbursement of payments to creditors under a confirmed plan parallels the procedure under chapter 13. Chapter 12 allows a family farmer to continue to operate the farm while the plan is being carried out.
Chapter 12 is only available to persons who meet the definition of "family farmer" set forth in the statute. A family farmer may either be an individual or a corporation or partnership. There are several tests which must be met in order to qualify as a family farmer. According to this definition, the farmer's debts cannot exceed $3,544,525. Fifty percent of this index adjusted debt must arise from the farming operation. A farming operation includes "farming, tillage of the soil, dairy farming, ranching, production or raising of crops, poultry or livestock, and the production of poultry or livestock products in an unmanufactured state." For purposes of computing the debt ceiling, any debt on a homestead will not be included unless it was granted in connection with the farm operation. In addition to the debt ceiling, the statute also requires that the farmer debtors must have earned more than one half of their gross income from farming in the year prior to the filing of the Chapter 12 petition. The final requirement for eligibility is regular annual income. This income must be "sufficiently stable and regular to enable such family farmer to make payments" under a Chapter 12 plan.
