<p>In another DUI case (where I was not the atty) our Municipal Court Judge qualified a police officer as an expert to foundation the HGN.   I got his training records and they don’t reveal anything other than what training is received at the academy.   I asked for a pretrial hearing on whether he can qualify and the judge indicated that he believes that once he has allowed the officer to testify as an expert he is qualified for all time.   We have a briefing schedule on this issue.</p>
