However the magic did not materialise. The Indians could not be “contained” any longer. They rose to the call of HINDRAF to articulate their inner feelings of oppression suppression marginalisation and permanent colonization.

Then came the avalanche of criminal charges slapped on them. Illegal assembly, failure to disperse, criminal damage to property, and a range of “offences” allegedly committed.

The instant UMNO were made aware that I had left the country to lobby International support, more “magic formula’s” were formulated. Suddenly the Batu Caves devotees were rearrested and charged with attempted murder. Upon hearing the rearrest many devotees went into hiding which they rightly did for that was the only way to escape this oppressive police force and fascist Government. Those who were unlucky, 31 in total were slapped with another charge of “attempted murder”. WHY? Because UMNO had to satisfy their thirst of EGO to overcome the “insult” to their authority as ” super masters of the Malaysian race” by the Indians.

Even then the civil societies and political parties claiming to champion Human Rights didn’t utter a word of objection. For the first time in history the Attorney General of Malaysia made a personal appearance in such a case to send a muscular and vibrant signal to the Indians that “watch out”. We are seriously going against you. WHY did the AG make a personal appearance??? To demonstrate to his UMNO masters he is doing the job for them!!! Everyone knew what was the motive of those Attempted murder charge but none dared speak!!!! WHY?

Lawyers M.Manoharan and P.Uthayakumar had emotional arguments in open court with the Presiding Judge and the Attorney General who objected to the bail applications of the 31 on flimsy grounds that he had evidence that they had links to terrorist organisations. Those close to hundred who managed to squeeze into the courtroom would bear witness to what happened in the courtroom. Manoharan and Uthayakumar made their most emotional and poignant arguments in open court for they could no longer take the oppression of the state against the particularly targeted innocent Indians. The public who were in courtroom would testify the potency and fervour of those arguments of these two great Lawyers assisted by R.Kenghadaran. Malaysian Indians would never have in their lifetime seen such courageous arguments by Mano and Uthaya. A group of Bar Human Rights committee lawyers hastily walked out in protest of the manner Mano and Uthaya argued for their clients! WHY???? The answer is obvious- because the accused in the dock is not a human by the name of Anwar or Lim . THEY WERE INDIANS!!!!!!

Having denied all 31 bails including those sickly and needed medical attention UMNO was still not satisfied with their thirst. The Indians still need to be taught a lesson. What next “magic formula”. Arrest the Lawyers under the ISA and break up this new freedom movement from within their lock up in Kamunting. And to justify the arrests under the draconian ISA, bizarre allegations were made that HINDRAF and its leaders were linked to terrorist organisations particularly the LTTE. When challenged to a joint press conference for each party to prove and disprove those allegations the 4 Lawyers were immediately arrested under ISA within days. No need to hold the first 60 days enquiries!! Yes within days there was a break up within them and suddenly the “planted” guy made a startling police report of RM700,000 financial scandal against Uthaya and his family members.

Immediately after the ISA arrest the ferocious Attorney General decided to be magnanimous by withdrawing the attempted murder charge. His words in court was “it was the only fair thing to do- 31 people cant be charged with attempted murder of one policeman”. HOW CONVENIENT? WHY were they treated this way???? BECAUSE THEY WERE INDIANS.

Trial was fixed for the KLCC demonstrators (more than 51 persons) for 2 continuous week by the Judge. WHY 2 continuous week??? Is it a priority case as per the Practise Directions from the Chief Justice??? It has to be- that’s the reason the Presiding Judge even forsaken the remand prisoners and Government Servant cases. So this was a priority case!!! What was the motive of the Presiding Judge???? To satisfy his UMNO masters!!!! Why did he do it so openly? BECAUSE THEY WERE INDIANS.

I beg you to imagine the predicament of these innocent human beings. Two weeks off their work? What do they say to their bosses? Many lost their jobs after the initial arrest. How do they justify their absence to their new bosses?

“Hi boss, I’m terribly sorry. I exercised my fundamental right to assemble peacefully once in my lifetime on NOV 25th and I got my arse burnt. I’m sorry but please give me 2 weeks time off without remuneration to attend court to “defend myself” under the “due process of Law” !!!!!!.

What does he tell his wife ” My darling forgive me, I attended the rally on NOV 25th for our future Indian generation and now you have to excuse my absence from the house for 2 weeks to enable me to attend court. By the way prepare the whole family to slash their meal next month as half my wages will be deducted for my absence from work. By the way from the following month onwards I’m jobless because my boss came to know I’m in trouble with the state for exercising my right under the Constitution!!!.

To his children he says “my dear children forgive your appa’s absence from home for the next 2 weeks. Appa have to face the “due process of Law” for exercising my right as a good citizen for you and your future generation. Please understand next month we may have to eat only porridge or boiled rice as I would be paid half and we wouldn’t afford normal healthy meal. We may have to survive with this longer as I have lost my job and most likely would end up in prison and we have to respect the due process of law “.

The trial of the more than 50 accused kicked off for 2 continuous weeks. At the end of the 2 weeks, 27 were “compelled” by circumstances to plead guilty. The Judge on Wednesday told all the accused that he would fix the case for 2 continuous month beginning next Tuesday 23rd Sept 08. This sent shockwaves and arrhythmias to all the accused . Another 2 months in court!!!! What are to happen to their families? Jobs? Future? Loan repayments? Instalments? Hence the 27 were successfully stifled into pleading guilty.

So what was the rationale and urgency behind this oppressive form of trial!!!! After two continuous week of hearing they are slapped with another 2 months of continued hearing. I wonder was this attempt to “kick their arses” to plead guilty and get lost from the face of JUSTICE. What is the best method to stifle them to plead guilty!!! UMNO works out a “magic formula” again. Slap them with a 2 months trial, which would be “a trial of their lifetime”, that they and the whole Indian community would never forget.

27 courageous citizens decided to satisfy the thirst of UMNO by pleading guilty. They were slapped with a RM1000 fine. The remaining determined to fight for their innocence. But don’t you think it is an attempt by the Judge to stifle them into pleading guilty by fixing the trial to continue for 2 continuous month? They are bound to lose their jobs. They and their families are bound to starve countless days. How are they going to pay their monthly Housing loan repayment or house rental. Are their children going to have nourishing food? What would their children respond their friends when questioned about their fathers’ exercising their rights? What about the stigma on children that their father is a criminal that’s why he ended up in court. These are the serious question that not only the presiding judge should ask himself but by the entire judiciary, legal fraternity, civil societies and all those who love and cherish democracy and fairness.

I question myself why none choose to speak? Is it because THEY ARE INDIANS??? Yes we are a weak society. We are politically weak. We are financially weak. We are economically weak. We are an “insignificant” society.

BUT WE ARE HUMAN BEINGS. WE BELIEVED THE PROVISIONS OF THE FEDERAL CONSTITUTION WOULD PROTECT US. WE BELIEVED MALAYSIANS ARE NOT RACIST AND WOULD COME TO OUR DEFENCE IN THE NAME OF DEMOCRACY.

We too deserve the Protection of the Law. We too deserve protection of the Federal Constitution. We too deserve protection of all civil societies. We too deserve protection of the Judges, legal fraternity. We too deserve the protection and support of all peace loving, democratic, fair and caring society that Malaysians truly are.

One can’t keep mum forever as if we are a species that never exist. I beg you - all Judges, Lawyers, Human Rights Organisations, Civil Societies, fair minded citizens please explore the plight and predicament of these neglected community who form part of the democratic Malaysian society. They are human beings too. The entire society spoke when our 3 fellow citizens were arrested under ISA last week. The BAR immediately choose to hold an EGM to discuss the issue. All political parties and leaders spoke up vociferously.

But the 4 HINDRAF lawyers were left “orphaned” post December 13th 2007. Their fellow brothers and sisters did not bother initiating an EGM!!! No legal team was set up to protect their fellow brothers unlike the 50 strong legal team of the Bar announced last week. The great Malaysian who would be the legal legend Karpal Singh immediately volunteered to take up the matter pro bono for Mano and Ganapathi Rao for they were his brothers in the DAP. Poor Kenga his habeas corpus application was the last to be filed as it was suddenly realised days after that none acted for him and Karpal undertook the noble task eventually.

The 2 months fixed for continued hearing should be challenged at all costs. The Bar which provided legal aid to those accused should immediately issue a strong statement against these forms of “oppression” by the Court and take up the matter on a revision to the High Court. Nothing prevents any of the numerous High Court Judges sitting in the same precincts to call up the matter for revision in their Courts. The Amnesty International, which has an office in Malaysia, could issue a strong statement. The scores of Human Rights Organisations and Civil Societies could raise concerns. It would be fantastic if Respected individuals who have standing in the society speak up.

I mean no insult or disrespect to any who may be affected by this article. Forgive me for I could have erred. Let us speak up for this particular minority community in the spirit of Malaysians. I dread the thought of the consequence of the 2 months continued trial of these fellow Malaysians on their family and loved ones.

I beg you all Malaysians. PLEASE SPEAK FOR THIS MINORITY INDIAN COMMUNITY. PLEASE SPEAK AGAINST THE INJUSTICES OF “DUE PROCESS OF LAW”. PLEASE SPEAK UP FOR THOSE UNJUSTLY BEING PUT ON TRIAL FOR MORE THAN 2 MONTHS. PLEASE SPEAK UP FOR OUR LAWYERS INCARCERATED UNDER THE ISA. THEY ARE HUMAN BEINGS WHO DESERVE RESPECT, DIGNITY AND EQUAL PROTECTION OF THE CONSTITUTION.

Reason of Arrest:
The police were worried that PKR de facto leader Anwar Ibrahim would not show up at the Kuala Lumpur police headquarters by 2pm and therefore decided to arrest him.

Star Online quoted Federal CID director Bakri Zinin as saying that Anwar was supposed to have gone directly to the police headquarters immediately after giving his statement to the Anti-Corruption Agency (ACA) in Putrajaya.

Dad was arrested by the cops whilst on his way to the IPK to give his statement. The cops gave till 2pm for dad to report but still arrested him before the deadline. Dad was on his way back home to have lunch in Bukit Segambut, and then head to the IPK but the cops blocked off the road and arrested him like a criminal. And the cops who arrested him were Special Squad cops with balaclavas!!! Is that necessary!!!

Private investigator P Balasubramaniam has made shocking claims that Deputy Prime Minister Najib Abdul Razak had links with murdered Mongolian Altantuya Shaariibuu.

Deputy Prime Minister Najib Abdul Razak today denied allegations that he had links with murdered Mongolian Altantuya Shaariibuu as claimed by a private detective.

Reading out from a prepared statement at a packed press conference in Parliament this evening, the embattled deputy premier reiterated that he had never met or knew Altantuya.

Satish has been discharged for the hospital on previous Monday. He is in his Mother in law’s place now, seems to be stable but still bed ridden. He has a follow up check up this coming Monday.

Does Satish have Insurance? Why he doesn’t have it?
Insurance - Yes that is true he has no insurance policy. Insurance is compulsory for every individual. I totally agree with you. Unfortunately I never know that he has no insurance policy until the day of accident. If I knew, would have knock his head and ask him to get one immediately. It’s a good lesson for all our Indians.

Can I know information about the accident, his injuries and current diagnosis, expected treatment costs and recuperation period?

This is the info everybody telling me but that is not true. Those work as teacher need protection “get your own insurance”. It is a lesson to other teachers.

Weekly courtesy Public Transport for ISA detainees families from
KL to Kemta, Taiping, Perak.

We refer to the above matter and your statement in Utusan Malaysia last week offering transport and travelling expenses to Kemta prison Kamunting and school children’s allowances.

May we propose that the Selangor state government provides a free courtesy bus service belonging to the Selangor State Government from K.L. to Kemta prison once every week until all ISA detainees are released. This bus service could take off from outside Malaysiakini office in Bangsar, KL at 7am on every Sunday and ISA detainee families to be dropped back at the same point on the return journey. The Y.A.B. Menteri Besar could officially flag of this bus service on a date to be fixed preferably on or in conjunction with Father’s Day shortly. The Gabungan Mansuhkan ISA could be the co-coordinator to inform and publicise this bus service to the ISA detainee families.

This would help further create public awareness to the atrocities of ISA detention without trial besides enhancing family support groups and fellowship among ISA detainee’s families. We would then be able to create a multi-racial ISA family. There would literally be an 8 hour weekly meeting of the ISA families in the bus itself “without the risk of being arrested for unlawful assembly”. Wives and children who have been cruelly separated from their fathers and husbands would be able to show their love, care and affection with courtesy of the Selangor State Government.

This bus service would go a long way in easing the burden of the already financially drained out ISA detainee’s families especially so in the light of the 41% increase in petrol prices announced by the ISA Minister Datuk Seri Abdullah Ahmad Badawi on 04/06/08.

Further this would also reduce the risk of a road traffic accident as what happened to the Kota Alam Shah State Assemblyman and ISA Detainee M.Manoharan’s wife and son who were injured in a road traffic accident last Sunday.

This proposal when approved would be the strongest ever Makkal Sakti “people power” support by the Selangor PKR, DAP and PAS State Government in putting to an end to the draconian ISA.

On Father’s Day June 15, 2008, seventy (70) HINDRAF children below the age of 10 years will lead a procession to the Agong’s Palace to present him with seventy (70) teddy bears as a Father’s day gift. This symbolic act is to show that at least seventy (70) children have been denied the right to celebrate father’s day with their fathers who are held as detainees in Kamunting under the cruel and inhuman ISA.

On this day, the Agong shall play the role of the father for these children as all Malaysians are his loyal citizens irrespective of their color, race, religion or following.

We invite HINDRAF supporters to contact Mr. Sambu should you wish to include your child/children to join this historic and symbolic occasion.

The Commissioner of Law Revision of Malaysia, Late Hugh Hickling when he drafted the ISA in 1960, it was pre-ambled in the context of organized violence ie communist during the Malayan emergency and afterward. In his 86th birthday in Kuala Lumpur in 2006, he did voice his frustration that he did not expect the law to be used against political opponents or those dedicated to non-violent activities.

These of course was echoed earlier by true leaders and Malaysian such as Tunku Abdul Rahman who defined the purpose of the act as to “be used solely against the communists and the immense powers given to the government under the ISA would never be used to stifle legitimate opposition and silence lawful dissent”.

Tun Hussein Onn later stated during his time that his administration had enforced the act only with a view to curbing communist activity, and not to repress “lawful political opposition and democratic citizen activity”.

Today, the society is in doldrums as the present government uses it to their own purpose without regard to public opinion, freedom of speech and above all a blatant disregard to basic humanity aspects ie education, freedom of speech, religion within our multicultural society.

The Agong, in his prerogative power vested in the Constitution is the flag bearer of our Malaysian society who had been continuously failed over and over again by the unfair and unjust governance of the present government for the well being of the Malaysian society.

The Agong, I trust will not remain reticent on the misfortune of his subjects and look over the welfare of his humble subjects irrespective of their color, religion, race and following to create what Malaysia should actually be.

BLOGGER WHO WAS AMONG THE 7 ARRESTED IN PENANG INVOLVED IN A ACCIDENT AND NEEDS HELP !!!!

Dear friends,

Mr. Satish Kumar a blogger from Olaichuvadi was involved in an bad accident
on the 2/6/08. He was one of the 7 who were arrested during the anti ISA campaign last month in Penang Gurney Drive when he was covering the event for his blog. He is also a Tamil school primary teacher.

Mr. Satish has no any supports and lives all by his own. He was hit and run by a vechicle in Kluang Johor while he was riding on his motorbike. He has serious injuries including multiple broken bones, Shoulder dislocated and a broken thigh bone. He was first admitted to the General Hospital, Kluang but the nurse there informed that he would only go through a check up next Monday and did not take it seriously. His condition was neglected by Kluang General hospital. Fearing on this, our team decided to transfer him to the Kluang Utama Specialist Centre. The operation has been completed at 3am this morning based on humanitarian grounds but need to pay. As for now the bill has been amounted to RM 7000. He badly needs financial support to carry on with the treatment and save his legs.

There are a number of foreign doctors (mostly from Pakistan, Bangladesh, Myanmar and India) (presumably Muslims) from unrecognised Universities who are working in rural areas and university hospitals with the blessings of the health ministry. They do not have to sit for examinations to be registered and are given annual practicing certificates for up to three years. This is unfair as Malaysian doctors from unrecognised Universities have to sit exams. Why not employ them instead? Foreign doctors are also given places in the Master’s courses in public universities such as University Malaya and University Kebangsaan Malaysia when our own doctors are not given such privileges.

These foreign doctors are then given registration and annual practicing certificates so that they can undergo these courses and perform surgeries and procedures on patients. Isn’t it ridiculous that our own doctors from the same unrecognised universities are not allowed to do so? These foreign doctors then do locum in private hospitals and clinics and are therefore practically earning a living and studying at the same time while local doctors have to sit exams, do houseman ship and then work for the government for three years in order to apply for masters course. Foreign students are readily accepted into the medical courses in public universities.

Why are they given preference when there is an acute shortage of doctors in this country? (Dr.TSK Kuala Lumpur)

ANSWER - Racism and religious extremism by UMNO. UMNO rather take in foreign doctors rather there being a shortage of doctors by 100% rather clinics not be manned by doctors, rather patients wait for hours before being treated THAN giving the opportunities to Malaysian Indian doctors from “unrecognised foreign universities”. UMNO rather see these Indian doctors unemployed to quench their racist and religious extremist thirst. UMNO does not care that these Indian doctors parents labour, sweat, pain, soil and toil and their hard earned money goes down the drain. Umno does not care that it was these innocent poor man’s children’s dream to become a doctor was probably no different from a dream to become a “criminal”. This is how vindictive UMNO’s Health Ministry Director General Datuk Dr Ismail Merican can get. Vote UMNO out with a fatal blow and once and for all at the 2012/13 general elections.

Patient overload at public hospitals where staff (and doctor) shortage is a perennial problem says Health Minister (NST 28/05/08 front page and pg 6). The doctor patient ratio in Malaysia is 1:1,200 whereas the ideal position is 1:600. Malaysia’s shortage of doctors by 100%. Further follow up treatment from GH to be referred to private clinics because of shortage of doctors at GH and the government will pay for the consultation and medication (Utusan Malaysia 28/05/08 pg 15). But Indian medical graduates rejected because they are from “recognised universities” deliberately not recognised by UMNO. Why can’t these Indian medical graduates be absorbed into especially the rural areas, extend their housemanship for six months (because they are from “unrecognised universities”) and allow them to practice medicine in Malaysia.

Why this outright racism and religious extremism by UMNO? Most of these unrecognised medical degrees are recognised by the British and US Medical Councils but not by the Malaysian Medical Council. UMNO and other UMNO extremists, racist Director General of the Health Ministry Datuk Dr Ismail Merican must be removed first for there to be a start to genuine racial harmony and racial integration. Launching National Unity colourful dances and drums, launched by UMNO’s DPM Najib last week is eyewash that is obsolete.

And then up to 20 per cent of foreign doctors recruited to work in the country are later kicked out. As Malaysian Medical Resources writes: “Health Ministry Parliamentary Secretary Lee Kah Choon disclosed that between 10 and 20 per cent foreign doctors and medical experts recruited by the Government to work in Malaysia had to be sent back as their service was not up to the standard required. Language, background and cultural differences were among the reasons why they had failed to perform their duties well. He said at present, most foreign doctors in Malaysia (eds. note: there are about 1000 of them) were from Indonesia, Bangladesh and Pakistan, and lately, the Government was eyeing to recruit more doctors from Myanmar. Lee said the Government spent about RM40 million annually to pay their salaries. The government is the single largest employer of doctors. About half the doctors in Malaysia are employed by the government and the other half work in the private sector.

UMNO is not dealing with the third and fourth generation Malaysian Indians who demand equal rights and equal opportunities which right is acceptable in any part of the world except in Malaysia. UMNO can fool all the Indians some of the time and some of the Indians all the time. But UMNO cannot fool all the Indians all the time especially the current third and fourth generation Malaysian Indians.
