HELP University Malaysia has awarded an honorary doctorate in Economics to North Korean supreme leader Kim Jong-Un.<br />
<br />
News of the conferment turned viral after a blog entry on Tuesday by ForeignPolicy.com detailing the award, started circulating on social media.<br />
<br />
The blog quoted a Korean Central News Agency (KCNA) article that reported on a ceremony conveying the certificate.<br />
<br />
The simple ceremony was held on Oct 3 in the DPR Korean (North Korean) embassy in Kuala Lumpur and was attended by 35 invitees including the HELP University president Datuk Dr Paul Chan and the North Korean ambassador to Malaysia, who received the honour on Kim's behalf.<br />

It was also mentioned that Kim Jong Un was the first foreign head of state to receive the honorary degree from the university.<br />

In a press statement released by HELP University, Dr Chan confirmed the awarding of the degree and expressed his hope that education could be used as a bridge to reach out to the people of North Korea.<br />
<br />
"We should use education to help the people of DPR Korea have a better life and a higher standard of living. Above all, let's help them integrate faster into the global network of open societies," said Dr Chan.<br />
<br />
"I hope that using this 'soft constructive' approach we can help them and North Asia and the world to be a better place for mankind," he added.<br />
<br />
In the letter, Chan shared his vision for North Korea's future and how education was an important tool for the reclusive nation's progression.<br />
<br />
"I anticipate that it is a matter of time, within the next six years or so, that DPR Korea will engage the world in many constructive ways. I feel no one at this moment has the courage to do this though their hearts tell them to do so," he said.<br />
<br />
Dr Chan also stressed the importance of accessible education in paving the way for a better quality of life for the people of North Korea.<br />
<br />
"To help DPR Korea in the way we do it is a road untravelled, but we hope our first small crucial step will contribute to peace and prosperity for all."<br />
<br />
HELP University, founded in 1986, offers pre-university and degree certifications and is known locally for its business studies and psychology programmes.<br />
<br />
Malaysia is one of the few countries in the world who have good ties with North Korea and whose citizens are not required to have visas for entry into the nation.<br />

The body of Ng Yuk Tim was found stuffed into a green suitcase, clad in a T-shirt and underwear, but did not show any signs of sexual abuse.<br />

Selangor deputy police chief Deputy Comm Datuk Abdul Rahim Jaafar said a post-mortem conducted at the Universiti Malaya Medical Centre (UMMC) showed that Ng died of severe head injuries due to three heavy blows to the head and there was no evidence to suggest she was raped.<br />

He also said her body bore no post-mortem injuries from placing her into the suitcase.<br />

"She was discovered in a fetal position," he said when contacted Wednesday.<br />

"There were no signs that her joints were broken in order to fit her into the suitcase.<br />

"The suspect revealed that the murder was not premeditated. However, we will investigate the matter thoroughly as it is too soon to come into such conclusion," he said.<br />

It is believed the suspect stuffed Ng's body into the suitcase after killing her before dumping the body at the side of road along Jalan Kebun Nenas in Shah Alam.<br />

DCP Abdul Rahim added the suspect was remanded until Oct 29 at the Petaling Jaya Magistrate's Court.<br />

"We also seized several items from the suspect's home, including the dumbbell," he said.<br />

Meanwhile, The family of Ng has identified and claimed the body of the 15-year-old.<br />

The victim's mother, Sim Yee Leng, 35, was seen crying after identifying her daughter's body at the UMMC mortuary at 6.45pm.<br />

Sim was unable to walk and had to he carried by her ex-husband and father of the victim, Ng Sai Kuan, 38, who returned from Johor earlier Wednesday.<br />
The body of the 15-year-old will be sent to the Kwang Tong Funeral Parlour at Jalan Dewan Bahasa Pustaka in Kuala Lumpur and will be cremated on Friday.<br />

The girl has once again left their home in Lorong Lai Chee and Kunyang had no choice but to go to the police.<br />

Speaking to newsmen after lodging his report yesterday, the parent said his daughter Sheila’s ( left pic) latest disappearing act was the third time, and this time she did not even bring along her identity card let alone her clothes.<br />

The first time Sheila, who was working as a handphone shop assistant, disappeared from home was on Oct 20 last year. The second time was on Nov 16 the following month.<br />
<br />
On both occasions, however, Sheila would return home to stay for up to a week after a police report was lodged.<br />

“I have no appetite for food as I am worried that she might fall into bad company. In the two previous incidents, she was with some boyfriends of hers.<br />
<br />
“At one time, she had injuries on her private part and we had to send her to the hospital for treatment,” he added.<br />

Kunyang said Sheila was a good girl before she stopped schooling to work in the handphone shop.<br />

The Penal Code amendment prohibiting the leaking of government information showed that Putrajaya was not serious in combating corruption, Pakatan Rakyat (PR) lawmakers said today.<br />

PKR’s Pandan MP Rafizi Ramli criticised the amendment, which was passed in Parliament yesterday, for promoting a “yes-man culture” in the civil service, pointing out that the law did not specifically protect leaks of information on corruption.<br />

“What the amendment does is effectively creating a civil service who will not want to rock the boat because there is a heavy price to pay, even if he whistleblows on corruption,” Rafizi told The Malay Mail Online in a text message today from Mecca.<br />

De facto law minister Nancy Shukri was reported by news portal fz.com yesterday as saying that the new Section 203A clause in the Penal Code - which punishes those who “disclose any information or matter” obtained in the performance of their duties with a fine of not more than RM1 million, or up to one year’s imprisonment, or both - was not meant to prevent whistleblowers from leaking information to the Malaysian Anti-Corruption Commission (MACC).<br />
<br />
“If the Malaysian Anti Corruption Commission (MACC) gets a tip off, those who have given the information will be protected under the MACC Act itself,” she was quoted as saying.<br />
<br />
But Rafizi, who shot to fame after exposing the National Feedlot Centre (NFC) cattle-farming scandal in 2011, said that allowing whistleblowers to report solely to national graft busters goes “against the very basis for whistleblowing”.<br />
<br />
“In fact, a majority of people who come to NOW have already gone to MACC, but were frustrated by what they perceived as a lack of action,” said Rafizi, referring to the National Oversight and Whistleblowers Centre (NOW) organisation that he had set up last year.<br />
<br />
“If BN is serious about allowing whistleblowing culture as a mechanism to check corruption, it will promote an ecosystem where whistleblowers can go to competent parties and get protection under the law. Such competent parties include NOW, media, politicians and NGOs. Such is the Whistleblowers Protection Act in UK, Australia and Europe,” he added.<br />

Rafizi accused Putrajaya of wanting to “eliminate whistleblowing altogether” by restricting information leaks to the MACC, “knowing that people don’t want to go to the authorities or MACC for fear no action will be taken, and instead, that they will be prosecuted”.<br />
<br />
The young lawmaker, however, vowed to continue exposing corruption, saying: “I will be more than happy to be charged in court again for defending the public’s interest”.<br />
<br />
PAS’ Shah Alam MP Khalid Samad pointed out that the Penal Code amendment contradicted the Najib administration’s commitment to transparency and accountability.<br />
<br />
“We find it ludicrous where it’s so sweeping, even in issues which are not classified as OSA (Official Secrets Act),” Khalid told The Malay Mail Online today.<br />
<br />
“What Nancy should be more concerned about is making sure that government officers are allowed to inform all parties, including the MACC, but not limited to just the MACC...It’s a proven fact corruption is getting from bad to worse. MACC has become a toothless tiger in many aspects,” added the PAS central committee member, highlighting MACC’s apparent inaction in graft allegations against Sarawak Chief Minister Tan Sri Abdul Taib Mahmud.<br />

Transparency-International’s (TI) recent Global Corruption Barometer 2013 survey revealed that 30 per cent of respondents thought the Malaysian government has been effective in fighting corruption, down from 49 per cent in 2011.<br />

Malaysia is also seen as the most corrupt country in the world for business, according to TI’s 2012 Bribe Payers Survey.<br />
<br />
DAP’s Klang MP Charles Santiago said that the RM1 million fine is a “major deterrent” to civil servants against leaking information relating to corruption.<br />

“No civil servant in his right mind would attempt to whistleblow or go to MACC,” Santiago told The Malay Mail Online today.<br />

“It also causes problems to the PR (Pakatan Rakyat) state governments of Selangor and Penang. Their commitment to practising an open and transparent government will not be possible, given that federal laws take priority over state laws,” he added.<br />

Today, Minister in the Prime Minister’s Department Nancy Shukri said Putrajaya would adopt “progressive amendments” to the Penal Code Amendment Bill, including more specific wording of Clause 11 on disclosure of information by civil servants that she conceded was too vague.<br />

A confession alone is not admissible in court and it does not mean that the person who confessed has committed a crime, said a criminologist.<br />
<br />
Prof Dr P. Sundramoorthy, from the School of Sciences in Universiti Sains Malaysia, said that the law was amended a few years ago so that confessions did not carry weight in court anymore.<br />

“We can’t make assumptions. A confession alone does not mean the person is guilty.<br />
<br />
The person could be mentally ill or covering up for someone,” he said.<br />

He was commenting on the 23-year-old man who was remanded on Wednesday for the murder of 15-year-old Ng Yuk Tim.<br />

Kuan said the man admitted that he tried to rape Ng in his house and hit her with a dumbbell when she resisted. <br />

Section 113 of the Criminal Procedure Code (CPC) states a confession or similar statements may be admissible as evidence if made to a police officer ranked Inspector or higher unless certain conditions can be proven.<br />

“The benchmark for a burden of proof to convict someone has increased significantly to a certain extent,” explained Sundramoorthy.<br />
<br />
He explained that such statements would only be admissible if they were backed up by physical evidence such as DNA or blood and collaborating statements from witnesses if there were any.<br />
<br />
Sundramoorthy said the suspect was only a person of interest at this point of time.<br />
<br />
“You can’t determine his guilt straightaway. There is much more to be learnt about the events that took place,” he said.<br />
<br />
He added that the police should be given time and space to conduct their investigations.<br />
<br />
Criminal defence lawyer Farhan Read said that confessions made to almost anybody when someone is under arrest is inadmissible.<br />
<br />
It was also inadmissible if that someone was not under arrest but they were still able to impose their authority such as a parent to a child. <br />
<br />
He however said that if someone was casually talking over coffee to a friend who happened to be a Deputy Public Prosecutor a confession of a murder then might be admissible.<br />
<br />
“A confession has to be reliable in order to be admissible. It has to be given voluntarily and it must not be as a result of oppression or interrogation,” he said.<br />

In the post, which was written in Chinese, the suspect said he "went shopping after paying respects to my ancestors, and came across a shop selling fitness equipment.<br />

"I decided to buy these (the dumbells). (Maybe) after saving more money, I will buy more (weights) to make it heavier," he said in his post.<br />
<br />
The suspect, on Tuesday, had confessed to Selangor Community Policing founder Kuan Chee Hong that he had attempted to rape the 15-year-old Ng in his house and had hit her in the head with a dumbbell after she resisted, killing her on the spot.<br />
<br />
He then proceeded to stuff her body in a suitcase and dumped it at the side of a road in Shah Alam.<br />
<br />
Kuan handed in the suspect to the police after the confession.<br />

A community crime watcher said the man who last saw 15-year-old Ng Yuk Tim alive had confessed to killing her.<br />

The 23-year-old suspect, who initially claimed that he had dropped the girl off at the Kelana Jaya LRT station at 2pm on Monday, had admitted that he lied, said Selangor Community Policing founder Kuan Chee Hong (pic).<br />

“I noticed he had bite marks on his left hand, so I asked him if he had anything to do with Yuk Tim being missing as he was the last person to have seen her,” he said.<br />

He said the suspect at first denied that he had harmed the girl or that he was responsible for her disappearance.<br />
<br />
However, after persistent questioning, the suspect admitted to killing the girl, Kuan added.<br />
<br />
“He told us that Yuk Tim had fought back and bit him which made him angry and he hit her head with the dumbbell, killing her.<br />
<br />
“He also told us that he stuffed her body into a bag, carried it into a car and drove to a place near Kota Kemuning where he dumped it,” he said.<br />

It is believed that the suspect and Yuk Tim, who shared the hobby of cosplaying, had met on Facebook about five years ago.<br />
<br />
They had met a few times while participating in cosplay events.<br />
<br />
However, it is understood that the meeting on Monday was only the second time that the two of them had met alone.<br />

"Why did you do this?" asked reporters as the suspected killer of 15-year-old Ng Yuk Tim was hauled into the Petaling Jaya Magistrate's Court on Wednesday morning.<br />

A 15-year-old girl who was reported missing is believed to have been murdered, with the suspected killer in police custody.<br />

The 23 year-old suspect, a male friend of the girl, led police to her body which was in a suitcase beside Jalan Kebun in Shah Alam.<br />

Her aunt, Sim Yee Lian, 31, said the girl had left home at about 11am on Monday to meet some friends for breakfast.<br />

“After breakfast, she took the train to the Kelana Jaya LRT station to meet her friend to work on some cosplay costumes for an event,” she said.<br />

(Cosplay, short for “costume play”, is a performance art where participants wear costumes and accessories of their favourite manga or anime characters.)<br />

“He said he dropped my niece off at the same LRT staion at about 3.30pm and left.<br />
<br />
“Nobody has seen or heard from her since,” said Sim, who was sobbing over the phone.<br />
<br />
Yuk Tim’s parents are divorced and she had been living with her mother, younger sister, aunt and grandmother.<br />
<br />
“We called up the telecommunication service provider and they traced her last SMS.<br />
<br />
“She had sent a message to her friend, asking to meet up for tea that night,” Sim said.<br />
<br />
At about 1.30am yesterday, her mother lodged a report at the Salak South police station.<br />
<br />
“We went to all the nearby hospitals but there were no records of her name or of any unidentified person.<br />
<br />
“She only had RM20 with her, given by her grandmother that morning. She had even forgotten to take her identity card with her,” said the aunt.<br />
<br />
The girl’s mother said Yuk Tim was not captured on the CCTV footage at the LRT station between 2.30pm and 5pm on Monday.<br />

Yuk Tim was the elder of two children, had short hair, was about 163cm in height and had a small mole on her chin.<br />

A well-known American Muslim theologian has joined a long list of critics over the recent Court of Appeal ruling on the use of the word Allah, saying it was a "political decision more than anything else".<br />

Aslan insisted that Christians using the word Allah - which means God in Arabic - were not a threat to Islam.<br />

"A Taliban put a bomb in the Quran and took it to a mosque in Pakistan, where Muslims were slaughtered on one of the holiest days in the Muslim calendar. You want to talk about threats to Islam? That's a threat to Islam," he said, in dismissing the argument that allowing Christians to use the word in their worship was a threat to Malaysian Muslims.<br />

He was referring to an incident during the Aidiladha holidays, in which Afghan governor Arsala Jamal was killed while scores were injured after a bomb placed in a copy of the Quran went off in a mosque during the Eid sermon.<br />

Aslan, who wrote the international bestseller No God But God: The Origins, Evolution, and Future of Islam, said he was mystified by the court ruling on October 14, stressing that the word Allah was merely an Arabic term for God, "any God".<br />

"Allah is constuction of the the word al-Ilah. That's what the word is," he explained.<br />

"Al-Ilah means 'The God'. Allah is not the name of God. Frankly, anyone who thinks that Allah is the name of God, is not just incorrect, but is going against the Quran itself. It is almost a blasphemous thought to think that Allah has a name.<br />

"And this is not an interpretation. It is a historical fact," Reza added.<br />

In its judgment, the Court of Appeal's three-man panel ruled that the word Allah "was not an integral part of the Christian faith and practice and that such usage if allowed, will inevitably cause confusion within the community".<br />

The United Arab Emirates's The National called the court ruling "wrong", and said the word Allah was never exclusive to Islam but used by both Christians and Jews to refer to God even before the advent of Islam.<br />

Aslan poured scorn on the court verdict, asking, "How can you read that and not laugh?"<br />

Soon after the court ruling last week, he had taken to Twitter and remarked, "How stupid has Malaysia just become? In honor of Malaysia banning the word Allah by non-Muslims I suggest US ban the word 'twerking' by anyone over age of 17," he said, referring to a type of sexually provocative dance.<br />

Much of Aslan's interview yesterday was made available on Podcast.<br />

In it, he slammed those who argue that the faith of Malaysian Muslims can be undermined if Christians use the word Allah.<br />
<br />
"This idea that not only should Christians not be able to use this word, but that using the word is somehow a threat to Islam... that Malaysian (Muslims) are so stupid if they hear a Christian use the word Allah, they will accidentally become Christians. I mean, the idiocy of that statement speaks for itself," he said.<br />

Echoing many other Muslim scholars and writers, Aslan said Christians and Jews in the Arabian peninsula since before the time of the Prophet Muhammad had been referring to God as Allah.<br />

"Why? Because they spoke Arabic... that's why. Not because Allah meant a specific God but because that it is nothing more than the Arabic word for God. It is not an opinion. It is a fact," he pointed out.<br />

"Any Imam that tells you God has a name, is blasphemous. It is as simple as that. Allah is not God's name. Muslims do not own the word itself," said the 41-year-old Iranian-American, who is Visiting Professor of Islamic Studies at the University of Iowa. <br />

The head of the Malaysian Catholic Church today said that the decision of the Court of Appeal on the Allah issue was tantamount to persecuting Christians in Malaysia.<br />

Archbishop Tan Sri Murphy Pakiam (pic) noted that the three judges were grossly misinformed in arriving at the decision to ban Catholic weekly Herald from using the word Allah.<br />

"As president of the Catholic Bishop’s Conference of Malaysia, I want to say that the three judges were grossly misinformed in their finding that the word Allah is not essential or an integral part of Christianity,” said the archbishop in a statement today.<br />
<br />
He added that the first article of faith in the creed for all Christians is “I believe in One God, the Father Almighty, Creator of heaven and earth”.<br />
<br />
"As such, any Christian who denies or modifies this statement of faith, incurs excommunication and would be considered a heretic," he stressed, adding that Allah was the Bahasa Malaysia translation and the Arabic equivalent of “One God”.<br />
<br />
He also pointed out that to conclude that the word was not essential to the Christian faith was a grave denial of a fundamental right of the Bahasa Malaysia-speaking Christian community, who use Allah in their worship, prayer books, the Alkitab and other publications.<br />
<br />
Pakiam said there were thousands of Bahasa Malaysia-speaking Christians from Sabah and Sarawak who were in universities, the armed forces, police and in the civil and private sector in Peninsular Malaysia.<br />
<br />
Pakiam added that half of the churches and chapels in Peninsular Malaysia currently conduct at least one worship service or catechism lesson in Bahasa Malaysia every week.<br />
<br />
“As committed religious leaders, we have to ensure that we respectfully minister to them in the national language.<br />
<br />
“For this reason, we do not accept the statement of these judges and stand in solidarity with other church leaders who have also voiced their objection.<br />
<br />
"We are heartened that other religious leaders and organisations have echoed similar statements."<br />
<br />
He called on Prime Minister Datuk Seri Najib Razak to take steps to “stop the indoctrination of unwitting Malays by individuals and organisations from swinging towards a divisive radicalism”.<br />
<br />
Pakiam also urged all Malaysians to invoke the good sense of their Malay brothers and sisters, many of whom have greatly benefitted from the education offered in mission schools, and who were familiar with Christians’ belief in God.<br />
<br />
“We continue to pray that God will bless and enlighten all Malaysians to accept one another in unity and diversity,” said the head of the Catholic Church.<br />
<br />
Last Monday, a three-man Court of Appeal bench ruled that the Herald was banned from using the word Allah, overturning a High Court decision in December 2009.<br />
<br />
In the judgment, the Court of Appeal ruled the word Allah was not essential to or an integral part of Christianity. (Read the three grounds of judgment here, here and here).<br />
<br />
Politicians and lawyers have argued that the decision is binding on all and that it also affects Christians in Sabah and Sarawak who worship in Bahasa Malaysia.<br />

The Christian Federation of Malaysia (CFM) is concerned over Putrajaya's inaction in cooling rising temperatures on the Allah issue, ahead of the case which will be heard at the Court of Appeal tomorrow.<br />

Its chairman Rev Dr Eu Hong Seng said there had been calls by various groups to defend Islam from being insulted and threatened.<br />

"The call for 'action' by some Muslims is incendiary and alarming to ordinary Malaysians.<br />

"Worst of all, there appears to be no action or statement from any government authority calling for calm or even ordering a stop to such actions, which is clearly stoking anger," Dr Eu said in a statement.<br />

Tomorrow, the court will hear the government's appeal against a 2009 High Court ruling that allows the Catholic Church to use the word Allah in the Herald, a weekly Catholic newspaper.<br />
<br />
In documents sighted by The Malaysian Insider recently, it was revealed that Putrajaya aims to use cases of arson attacks on several churches and an incident of vandals tossing a pig’s head into a mosque to bolster its argument that there will be tension and trouble if the Court of Appeal upholds the 2009 High Court ruling.<br />
<br />
Dr Eu said a television programme with untrue and unsubstantiated accusations were made about so-called Christian plots to convert Muslims.<br />
<br />
He also drew attention to the Friday sermon by the Department of Islamic Development Malaysia (JAKIM), which called for action in defence of Islam by Muslims over the use of the word by Christians.<br />
<br />
"Even a cursory examination of these accusations and statements will clearly show that they are emotional and without factual basis," he said.<br />
<br />
The undisputed facts, Dr Eu said, are that about 60% of the 2.6 million Christians in Malaysia have been using Allah to refer to God and that Bumiputera Christians have used the Bahasa Malaysia Bible containing the word for a long time without any objection.<br />
<br />
He also noted the the problem on the use of "Allah" was an issue unique to Malaysia and not a problem in the Middle East.<br />
<br />
As such, CFM called for a stop to the repeated accusations that the use of the word was a Christian conspiracy to convert Muslims.<br />
<br />
"This is blatant scare-mongering which provokes religious tension," Dr Eu said.<br />
<br />
He instead called on Muslims to understand and appreciate the context of how, when and why Christians use the word Allah, adding that it is carried from centuries ago through shared history without any problems.<br />
<br />
"We need to look at facts and evidence, instead of appealing to emotional rhetoric or talk of plots and alleged conversions," he advised.<br />
<br />
Dr Eu also called on the government, which represents all Malaysians, to uphold and protect freedom of religion in the country.<br />

Young Malaysians between the ages of 20 and 39 formed the largest segment of those infected with HIV over a five-year period.<br />
<br />
That is pretty much general knowledge, but the most alarming piece of statistic is the dramatic jump in the number of students contracting HIV.<br />
<br />
The total number of new cases of Malaysians infected with HIV and AIDS had held steady over the five years since 2008.<br />
<br />
The number of cases in 2008 was 4,633, while in 2012, the figure was 4,799.<br />
<br />
The number of deaths from HIV and AIDS over the period, however, declined from 1,050 in 2008 to 702 in 2012.<br />

In 2008, only 28 students contracted HIV and seven contracted AIDS.<br />
<br />
That figure rose to 35 and six in 2009, 44 and eight in 2010 and 69 and 15 in 2011.<br />
<br />
But in 2012, a startling 170 students contracted HIV while 16 contracted AIDS.<br />
<br />
The number of students contracting HIV that year saw an explosion of 148 per cent — from 69 to 170.<br />
<br />
In contrast, the increase of new HIV cases from 2008 to 2010 was at a steady 25 per cent.<br />
<br />
These figures are striking compared to those from the period between 1986 to 2007.<br />
<br />
Over the earlier 22-year period, only 205 students had been found to be HIV positive, while only 48 were found to be suffering from AIDS.<br />
<br />
Over the 2008 to 2012 period, 35 students died from either HIV or AIDS.<br />
<br />
The ministry was not forthcoming in outlining the details, but it is believed that the majority of students newly-diagnosed as HIV infected were college and university students.<br />
<br />
Malaysia Aids Council Executive Director Roswati Ghani said they are deeply concerned by the growing number of new HIV infections among students.<br />
<br />
“What’s also alarming is the proportion of new HIV cases reported in the younger age group of 13-29 years, to the overall population (1 to 4 in 2012),” she said.<br />
<br />
“We are also cognizant of this situation; and that the HIV epidemic in this country continues to be driven by sexual transmission since beginning 2010.”<br />
<br />
She encouraged students, especially those who engage in high-risk behaviours, to get tested regularly and be aware of their HIV status.<br />
<br />
“To address the rising number of new HIV infections among students, the management of universities and colleges must also make accurate HIV information accessible to their students,” she said.<br />
<br />
“They should formalise HIV education in the curriculum and provide counselling services that are evidence-based while, at the same time, respecting the students’ sensitivities and rights.”<br />
<br />
The health ministry, upon learning of a student diagnosed as HIV positive or having AIDS, will set in motion a chain of actions.<br />
<br />
The amount spent in response to HIV and AIDS, such as on antiretroviral therapy and treatment, medicines and campaigns, since 1993 has reached RM1.<br />

The Malaysia Hindu Sangam, the MIC youth chief, an Indian opposition politician and a lawyer took the minister to task.<br />

On Tengku Adnan's suggestion that only Hindu temples were problematic, Malaysia Hindu Sangam president Datuk R.S. Mohan Shan shot back that it was because the government did not provide Hindus a proper site to build their temples.<br />

"This is a ridiculous statement by the minister. We are the victims here. We are not the trouble-causers," Mohan responded.<br />
<br />
"I have written a letter to Tengku Adnan on this matter and I am hoping for a speedy response," he revealed to The Malaysian Insider today.<br />

MIC Youth chief T. Mohan, who was arrested when he tried to stop City Hall officers from demolishing part of the temple last week, was also upset by the remark that only Hindu temples caused problems.<br />
<br />
He said, "If Hindus were given the proper avenue to fulfill their spiritual obligations in peace, issues such as this would have never occured."<br />
<br />
Parti Keadilan Rakyat vice-president N. Surendran said Tengku Adnan has failed to realise that a shrine is the sacred spot of any Hindu temple.<br />

"Tengku Adnan is simply mocking Hindus," he said.<br />

Former Teluk Intan parliamentarian M. Manogaran said, "We have been sidelined and marginalised and this is why we remain a 'problem' according to Tengku Adnan.<br />
<br />
"It is such a shame that Indians who are in the country's mainstream politics and economy get bullied this way."<br />

Manogaran said this is the main reason that Indian leaders from the opposition pact had called for an “Indian Affairs Department” or a “Minority Affairs Ministry” under Prime Minister Datuk Seri Najib Razak's purview.<br />

MIC’s Mohan also was disappointed with Tengku Adnan for claiming that political parties were exploiting this issue for mileage.<br />

Mohan said, "When the Pakatan Rakyat state government in Selangor had demolished a shrine inside a home in Sepang, MIC Youth had intervened to condemn the act. We were then hailed as heroes. Now we are being accused of playing politics."<br />

Tengku Adnan told reporters today that the Hindu temple in Kuala Lumpur's Golden Triangle in Jalan P. Ramlee has always been a shrine and not a temple.<br />
<br />
"I know what a temple and shrine is all about. I am also a pious man. I pray. I would not want to break something which people pray to,” he had said.<br />
<br />
The temple sits on reserve land meant for roads or walkways and the Kuala Lumpur City Hall had wanted to claim back some eight feet of land.<br />
<br />
This was resisted by scores of worshippers who rushed to protect the temple, raising the temperature in Malaysia's religious landscape and pitting the ruling Barisan Nasional government against politicians from its own coalition.<br />

Tengku Adnan said the ministry will be upgrading the temple into a tourist attraction and look into gazetting the land where the “shrine” sits.<br />

He had also said the temple, which he insisted be called a "shrine" from now on, will not be given the entire land on which it is currently situated.<br />

There may be a deadly cost to raising pump prices for RON95 petrol and diesel without serious effort to upgrade the country’s public transport system, a DAP lawmaker warned Putrajaya today.<br />

The DAP legal bureau today offered its services to prosecutors in the high-profile murder of Mongolian Altantuya Shaariibuu, suggesting that an overworked Attorney-General’s Chambers (AGC) may have led to the acquittal of two former policemen previously convicted of the killing.<br />

This comes as Segambut MP and bureau member Lim Lip Eng (picture) lodged a police report in Jinjang here over the Court of Appeal’s decision to free ex-police commandos Azilah Hadri and Sirul Azhar Umar of their conviction in 2009 of the gruesome murder.<br />

Lim said the bureau was offering its help to the AGC due to the high-profile nature of the case.<br />

He pointed out that the move was permissible by law, citing the recent appointment of lawyer Datuk Seri Muhammad Shafee Abdullah as public prosecutor in the appeal against Datuk Seri Anwar Ibrahim’s Sodomy II acquittal.<br />

Muhammad Shafee was given the authority by the Attorney-General to lead the prosecution team in its appeal against Anwar’s acquittal on a charge of sodomising his former aide Mohd Saiful Bukhari Azlan.<br />

Anwar’s defence team, however, filed a motion in the Court of Appeal in Putrajaya yesterday to disqualify the appointment.<br />

Earlier today, PKR’s R. Sivarasa criticised the Court of Appeal over the two former policemen’s acquittal, saying it should have ordered a retrial instead.<br />

The Subang MP stressed that the appellate court was empowered to do so, especially when there were a number of key witnesses who were not called during the High Court trial that led to the duo’s conviction in 2009.<br />

“There is ample power under the law in section 60 of the Courts Judicature Act 1964 to order a retrial which is regularly done in appeals,” Sivarasa said.<br />

In a decision that stirred controversy yesterday, a three-man panel of the appellate court unanimously allowed Azilah and Sirul’s appeal.<br />
<br />
Azilah and Sirul, both formerly with the police’s Special Action Unit (UTK), had been found guilty in 2009 of the murder of Altantuya in Mukim Bukit Raja in Klang between 10pm on October 19, 2006 and 1am on October 20, 2006.<br />
<br />
The Mongolian model’s murder trial had been surrounded by political intrigue due to links drawn from the personalities involved in the case.<br />
<br />
Azilah and Sirul had been part of a security detail for then-Defence Minister Datuk Seri Najib Razak while Abdul Razak Baginda, who was charged with and later acquitted of abetting the duo, was a former adviser to Najib.<br />
<br />
During the course of their trial, it was revealed that Altantuya was shot and her body blown-up with explosives in a jungle clearing on the night of October 19.<br />

The duo had been charged under section 149 of the Penal Code, which carries the mandatory death sentence upon conviction.<br />

A smoking worker nearly sets rescue crew aflame after wreckage started leaking fuel<br />

RESCUE personnel had a close call when the stage bus they were lifting from Wednesday's crash site started leaking fuel.<br />

About 100 firemen and police personnel at the scene reacted immediately to avert another catastrophe.<br />

As soon as the wreckage was laid down on the road after being hauled up by a mammoth crane, diesel started flowing from the fuel tanks onto the road. Recovery personnel scrambled to put sand and earth as well as sawdust from their rescue vehicles to plug the tanks.<br />

Before anyone could breathe a sigh of relief, a foreign worker ambled into view with a lit cigarette, risking a massive conflagration, just metres from the wreckage.<br />

Operations to lift the 14.5 tonne wreckage from the 60m-deep ravine began at 10am .<br />

Genting Fire and Rescue Department chief M. Mahandran said rescuers did not find any signs of a fuel leak when conducting search and rescue operations following the accident.<br />

The bus was lifted vertically after a hook was attached to its towbar.<br />
<br />
"We saw diesel leaking from the bus as soon as it was placed on the road. We are just glad the bus didn't explode," he said, adding that the bus had about 20 litres of diesel left in its tanks.<br />

The bus was only moved after the tanks were emptied.<br />
<br />
"We scaled down to the wreckage 30 minutes after the accident, and as we neared the scene, some of the survivors called out to us, asking to be saved.<br />
<br />
"By the time we got to them, some of them could not hold on any longer. I saw several of them die in front of me," said Mahandran.<br />

His biggest relief was when he saw two survivors trapped in the last row of the bus.<br />

Bentong district police chief Superintendent Mohd Mansor Mohd Nor said Puspakom and Road Transport Department engineers would examine the wreckage to determine the cause of the accident.<br />

The bus was taken to Bentong police headquarters, and operations to clear the scene of the crash was called off at 4.15pm yesterday.<br />

The bus was carrying 53 passengers when it plunged into the ravine, killing 37 and injuring 16.<br />

Meanwhile, Health Minister Datuk Seri Dr S. Subramaniam said as of 2pm yesterday, 11 bodies remained unclaimed at Kuala Lumpur Hospital.<br />

Of the total, six remained unidentified. Of the five identified, three were confirmed as foreigners. He said 25 bodies had been released to their next of kin.<br />

He also called on those with information that could lead to the identification of the victims to come to HKL's Forensics Department.<br />

Dr Subramaniam said all 16 survivors were recovering. One was moved to the normal ward from the intensive care unit (ICU), after showing progress.<br />

In George Town, a wake was held for one of the victims, Tan Chor Boon, at his home in Sungai Pinang.<br />

Ten victims of the Wednesday's Genting bus tragedy who were hospitalised at the Selayang and Sungai Buloh hospitals were reported to be in stable condition.<br />

Selayang Hospital director Dr Siti Zaleha Mohd Salleh said all eight victims admitted to the hospital, three locals, three Bangladeshis and two Indonesians, were recovering and that some of them might be discharged soon.<br />

The director of the controversial film Tanda Putera, which has upset the opposition, now admits it is a fictional account of events surrounding the May 13 racial riots.<br />

“It is tough for me to throw away scenes that are called sensitive. If I have to follow the opinions of everyone then the first 20 minutes of the film depicting incidents of 13 May would not even be there. So I have to defend my work,” she told The Malaysian Insider today.<br />

Suhaimi’s admission that the film is a fictional account of events is a comedown from her stand at the film’s premiere this week where she asked the public to give the film a chance since it is about the nation’s history based on “true stories".<br />

The film is set to start its run in local cinemas on August 29.<br />

“That incident did happen but no one could identify who was the one who did it,” Shuhaimi said in reference to the urinating scene, which purportedly portrayed a young Lim Kit Siang, now the DAP adviser.<br />

Shuhaimi said the movie showed the friendship between two leaders, then prime minister Tun Abdul Razak and his deputy, Tun Dr Ismail Abdul Rahman, and how they faced the challenge of developing the country while battling racial tensions and their health problems.<br />

Shuhaimi said she did not feel any scenes in the movie were too radical and described the protests of DAP leaders as a political gimmick.<br />

The director said that it was Kit Siang himself who took offence and felt that the scene depicted him.<br />

On Thursday, The Malaysian Insider reported that DAP had urged Tanda Putera’s producers to declare the film a fictitious work.<br />

DAP national publicity secretary Tony Pua said the film would provoke anger and racial tension.<br />

Last year, Lim criticised the production company when it uploaded a photograph of him being arrested by the police, with a caption “Lim Kit Siang urinating on the flagpole at the home of Selangor Menteri Besar” on the film’s official Facebook page.<br />

Azilah and Sirul, both formerly with the police’s Special Action Unit (UTK), had been found guilty in 2009 of committing the offence in Mukim Bukit Raja in Klang between 10pm on October 19, 2006 and 1am on October 20, 2006.<br />

During the course of their trial, it was revealed that the Mongolian model was shot and her body blown-up with explosives in a jungle clearing on the night of October 19.<br />

The duo had been charged under section 149 of the Penal Code, which carries the mandatory death sentence upon conviction.<br />

Altantuya was said to have acted as a translator for Perimekar Sdn Bhd in Malaysia’s multi-billion ringgit purchase of two Scorpene-class submarines from French firm DCNS, prior to her murder.<br />

Perimekar is owned by Abdul Razak Baginda, and reportedly received RM574 million in commission for providing support and co-ordination services to Putrajaya for the 2002 deal, back when Datuk Seri Najib Razak was the defence minister.<br />

Abdul Razak was initially charged with abetting Azilah and Sirul but was acquitted on October 31, 2008, after the Shah Alam High Court ruled that the prosecution had failed to establish a prima facie case against him.<br />
<br />
Today, Sivarasa named DSP Musa Safiri, a former aide-de-camp to then defence minister Datuk Seri Najib Razak, as one of the main witnesses today, highlighting his link to Abdul Razak.<br />

Besides Musa, Sivarasa also listed Najib, his former private secretary of 20 years Nasir Safar, his brother Nazim Razak, his wife Datin Seri Rosmah Mansor, businessman Deepak Jaikishan, and senior lawyer Tan Sri Cecil Abraham among key witnesses for the trial.<br />

According to him, the witnesses would have been able to provide a possible motive for the murder if they had been called.<br />
<br />
High Court judge Datuk Mohd Zaki Md Yassin has previously said that he had a problem establishing a motive for the case.<br />
<br />
PKR is also calling for a royal commission of inquiry (RCI) into what it has called a “failed prosecution”, especially with the acquittal of Abdul Razak, Sirul and Azilah.<br />
<br />
Sirul and Azilah were both released from Tapah Prison yesterday after the Court of Appeal overturned the decision on the high-profile 2006 murder.<br />

Inconsistent information surrounding one of Malaysia’s deadliest bus crashes requires a comprehensive investigation to ensure the victims and families are afforded the “truth and justice” due to them, MCA publicity chief Datuk Heng Seai Kie said today.<br />

“As Deputy Prime Minister Tan Sri Muhyiddin Yassin has proposed to set up a special investigation committee to probe the cause of the accident, we urge the committee to leave no stone unturned as this issue has befallen several times already,” she said in a statement.<br />

“The findings must be made public.”<br />

On Thursday, a day after the ill-fated bus that plunged into a ravine on Wednesday and killed 37 people, English daily The Star reported that the vehicle was placed on a blacklist by the Road Transport Department (JPJ) prior to its journey to Genting Highlands.<br />

The newspaper said this was confirmed from checks on the bus’ records in the JPJ website. It is not known, however, the reason for the blacklist.<br />

But later the same day, the Land Public Transport Commission (SPAD) said at a press conference that the bus had not been blacklisted nor overloaded, as alleged in a separate report.<br />

Its chief, Tan Sri Syed Hamid Albar, said the bus was classified as a feeder bus, and explained that it was within regulations for the vehicle to ferry the reported 53 passengers at the time of the incident.<br />

The Home Ministry plans to use the electronic monitoring device (EMD) on offenders charged under the Security Offences (Special Measures) Act 2012 by end of next month.<br />

Attorney-General Tan Sri Gani Patail confirmed that the government had approved the use of EMDs to track organised and violent crime suspects to ensure they would not commit other crimes while out on bail.<br />

"For me, the faster (this is implemented), the better. Of course, we would like to see this (device) used as soon as possible. We believe that it will be implemented by September," he told reporters after the Crime Prevention Forum, here today.<br />

She had said the device, used in many countries such as the United States (US) since 1994, would reduce the risk of repeat offenders and played a role in effective police enforcement.<br />

"The device will also be cost effective as it will lead to reduced overcrowding in prisons," she said in her presentation on current and future initiatives taken by Pemandu to curb crime.<br />
Gani, in his special address at the forum, said the country did not need preventive laws to curb serious crimes, as the nation had a good police force to handle crime effectively and efficiently.<br />

"I have complete trust in the police to do their job without the need for preventive laws. This is proven when they (police) proved their capabilities in taking care of crimes, over the past few weeks.<br />
<br />
"Therefore, I find it difficult to rationalise reasons on why we need to inroduce again preventive laws such as the Internal Security Act and Emergency Ordinance," he said.<br />
<br />
Although the new preventive law to be tabled in Parliament in the next session, he said the Attorney-General's Chambers would review any amendment and input from various parties.<br />
<br />
He noted that if the nation really needed preventive laws to fight serious crime, then a thorough study and proposal on these laws must be carefully considered.<br />

Citing a violent crime case involving Botak Chin, Abdul Gani said the then Attorney General managed to solve the case and sentenced the criminal, without using any preventive laws (ISA or EO), but merely using ordinary laws.<br />

Asked for his stand on re-introducing the EO, Abdul Gani said: "My stand remains the same."<br />

Before this, he had stressed that existing laws were sufficient to tackle criminals, adding it was better to let more guilty people go free than to send the innocent to jail.<br />

Commenting on the Court of Appeal's acquittal and discharge of two police special action unit personnel convicted by a High Court of murdering Mongolian Altantuya Shaaribuu, Abdul Gani said: "I have already made the statement that I will file and appeal. I am waiting for the grounds of judgement, and carry on from there.<br />

"I have given directions today, as it is a Saturday. Yesterday was the case. I have 10 days to file the appeal. It will be filed and it shall be appealed. There is no issue about it." — Bernama<br />
