So...even if your state has a lemon law, do you need an extended warranty? The answer is a definite yes. Cars that are not qualified as lemons can suffer wear, tear, and component failure. If your state does have a lemon law, it's still quite prudent to purchase an extended warranty. Problems with a vehicle do not necessarily qualify it as a lemon, and that's a crucial fact you need to understand when considering purchasing a warranty. If you fail to purchase an extended warranty and end up needing repair, it's unlikely that your state's lemon laws will cover you, unless of course the vehicle has experienced the same problem multiple times with no record of satisfactory repair after numerous attempts. &lt;br /&gt;

There are many types of extended auto warranties available. You can purchase one from the dealership where you got your vehicle, or go to the source and deal directly with a company that specializes in extended auto warranties. &lt;br /&gt;

To note, under the California Lemon Law, a vehicle is considered a lemon if it fails 2 attempts at repairing life-threatening defects. &lt;br /&gt;

This is especially dangerous for cars with “unibody” or cars that have the floor, roof and other panels welded together to produce a car unit. “Unibodies” are designed to absorb more force but is prone to bending. • Get opinions – Talk to people who own the same model as the car you want and ask if they encountered any problems and/or are they satisfied with the car. &lt;br /&gt;

These unlucky few are the people who find themselves with an automobile that will, after much frustration and exhaustion on the part of the owner, be classified on a lemon. &lt;br /&gt;

So just what is a lemon car? After all, we've all had the occasional breakdown of some part of our car. And no matter when it happens, it is extremely inconvenient (and often quite expensive.) When does "regular wear and tear" flow into the realm of having a true lemon. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Typically a lemon is a new vehicle (or in some states a used vehicle under certain circumstances) that has had a large number of repair attempts on a single defect or an overall large number of repair attempts overall. It can also include just a single repair attempt on a portion of the car where failure could be a life threatening situation. Each state has their own lemon law warranty act and each of them defines what will make a vehicle a lemon. For instance, in California, a lemon automobile can be summarized as follows: &lt;br /&gt;

&lt;br /&gt;
&lt;br /&gt;
Vehicles Covered by California Lemon Law - California lemon law covers any new motor vehicle used primarily for family, personal or household purposes. It also includes the chassis portion of motor homes. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Repair Interval / Coverage Period Details - To be considered a lemon law vehicle in California , the vehicle must either be out of service for 30 calendar days or have 2 repair attempt for a defect that could cause death or a serious injury or have 4 repairs for the same defect. The coverage period is for 18 months or 18,000 miles, whichever occurs first. &lt;br /&gt;

&lt;br /&gt;

If you believe your car is a lemon, it is very important that you have proper records to show this. That means that each time you go to your service center, it is very important that they record exactly what you believe the problem is in the car and specify what they did to try to solve the problem. You need to do this for two reasons. First, you will need these records when making a claim for restitution. Second, for these "mystery" problems, dealers will try many different things and it may not be clear to an adjuster that they were all related unless you ensure this is the case on the receipts. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Once your car has passed the state hurdle to be classified to become a lemon, you must take actions to get restitution. Each state has a different procedure you must follow. Some states requre that you send a letter to the manufacturer to give them one last chance to repair the defect. Other states have arbitration panels you must deal with to get restitution. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
No matter what method the state has in place for you to seek restitution, you always have the option of working with an attorney if you do not feel the issue was solved to your satisfaction. You should consider an attorney as a last resort as not all states allow you to be reimbursed for your legal fees if you win. (And of course if you lose, you would not get reimbursed.) So as frustrating as this situation may be, it is best to persue all state sponsored remedies before seeking legal help. &lt;br /&gt;

What happens if you win? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
If your vehicle is determined to be a lemon under your state's law, you are entitled to a refund or a comparable replacement vehicle. A comparable vehicle most be indentical or a reasonable equivalent of your current vehicle. A refund will include your purchase price, taxes and any other options installed in the vehicle minus a usage fee based on how much you used the car. The terms will very a bit from state to state but this is generally what you can expect. &lt;br /&gt;

&lt;br /&gt;
&lt;br /&gt;
What happens to the car after the manufactuer takes it back? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The manufacturer will generally recondition it and put it back for sale within its network. Depending on the state where the problem occurred, the title may or may not be stamped with a phrase like "Lemon Law Buyback" when it is returned to that state for resale. However, not all states require this and if the car was transferred from one state to another, the information may not follow on the title issued from the new state. &lt;br /&gt;

While lemon cars are only a very small percentage of the used cars that are sold, this issue with titles not always conveying the true history of the car, it shows the importance of doing research on any used car purchase. If you are buying a used car from a dealer, you should insist on a Carfax lemon check report and if you are buying from an individual, you should do one yourself at carfax.com. It is a very reasonable price to pay to be sure your car has no hidden defects. &lt;br /&gt;

Did you buy it brand new only to find out it is a dud, something like a car lemon? Your rights as a consumer when it comes to the lemon law and its interpretation depends on which state you live in. Nope, it is not the state of denial, which is what you would like to live in after spending all that money, only to get a dud vehicle! &lt;br /&gt;

Let’s look at the lemon law Florida has passed through legislature. Their lemon law only covers new vehicles bought or leased. The vehicle use must be for private or personal use and does not include any vehicles ridden off road or any vehicles less than four wheels. And the lemon law California has does not take into account the off-road vehicles and other modes of transportation other than a new vehicle with four wheels. However, motor home chassis are covered, but not the body. &lt;br /&gt;

&lt;br /&gt;
If you live in Texas, however, you can enjoy one of the most liberal lemon laws in the United States. Recreational modes of transportation like three or four wheelers, motorcycles, motor homes, cars, trucks and vans are all covered as long as they are new vehicles. No used car lemons or the like are considered. Other states are a bit more liberal in their interpretation of these laws. New Hampshire is one of them as is New Mexico and North Carolina. &lt;br /&gt;

&lt;br /&gt;
Other states typically cover new cars, small trucks and vans in their car lemon law. Some are conditional when it comes to recreational vehicles, motorcycles and motor homes. For instance, the state of Illinois covers recreational vehicles under their lemon law but not motorcycles. In New Jersey however, they do cover motorcycles and even motor homes. Ohio covers motorcycles as does Washington. &lt;br /&gt;

&lt;br /&gt;
Depending on where you live, you will probably want to consult with one or two lemon law attorneys to interpret the law for you. Because some states just mention any motorized mode of transportation that you use for family or personal use that leaves the field wide open to speculation. What is interpreted as a motorized vehicle? Each state will probably have a different answer. Virginia, Wyoming, Oregon, Maine and Minnesota have more general interpretations than most. &lt;br /&gt;

&lt;br /&gt;
You could be a retiree with a brand new motor home, ready to hit the open roads of the United States. Or you could be a farmer or rancher that used tractors and recreational vehicles like a four-wheeler for farm work. Maybe you are a motorcycle rider trying to save on gas or you ride a moped around your college town. No matter what the circumstance, brush up on the lemon laws your state has or consult with lemon law lawyers if you are having difficulties with your new mode of transportation. Remember your rights will vary depending on where you reside. &lt;br /&gt;

The term “Lemon-Law” is a nick name derived from other common terms such as “Lemon-Car”, “Monday-cars” and “Friday-Cars”. &lt;br /&gt;

A lemon car is a defective car that, when purchased new or used, is found by the purchaser to have numerous or severe defects not readily apparent before the purchase. Any vehicle with these issues can be termed a "lemon car" and by extension, any product which has major flaws that render it unfit for its purpose can be described as a "lemon product". &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
New vehicles directly from the factory may contain hidden mechanical flaws or defects in workmanship, usually caused by an error during the build process of the car. These errors can range from parts being installed incorrectly, a tool that was used to build the car not being removed, a batch of materials with structural or chemical flaws or simply bad design. Usually, a car is labeled a lemon if the same problem occurs 3 times in a row over a short period, and previous attempts at repair have not repaired the problem. In most cases, if you get a lemon, lemon laws will make the company buy back the car or exchange it. &lt;br /&gt;

Many of you might remember that during the late eighties the average American consumer almost lost faith completely with the American made cars. &lt;br /&gt;

The amount of lemon cars along with the high rate of over the average visits to the car garages as well as the high repairs and spare parts cost, caused many Americans to switch to Japanese and even European cars. &lt;br /&gt;

This was a period of time when Americans were reluctant to go to the dealers garages and preferred to go to oil &amp;amp; lube services only. &lt;br /&gt;

At that time Lee Iacocca the CEO of Chrysler Corp identified immediately the problem of mistrust of American consumers in American made cars, Chrysler launched a campaign on national TV promising to provide a bumper-to-bumper warranty coverage for 50,000 miles or five years, which ever comes first! Then GM came with the answer of 60,000 miles or 6 years, which ever comes first! Chrysler returned with the final stroke of 70,000 miles or 7 years which ever comes first. &lt;br /&gt;

Few months later I went to the Buick main dealer garage in long Island, I was seating in the waiting room, next to me was a very nervous guy, I asked him why was he so upset with the garage, he explained to me that even though he had this bumper-to-bumper warranty It doesn't cover labor and the damn car is more than a week in the garage and they don't seems to be able to find what is the problem with the car... &lt;br /&gt;

The Magnuson-Moss Warranty Act is Known as the "Lemon Law" &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The Magnuson-Moss Warranty Act is a United States federal law codified at 15 USC 50. Enacted in 1975, it is the federal statute that governs warranties on consumer products. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The Act was sponsored by Senators Warren G. Magnuson of Washington and Frank Moss of Utah, both Democrats. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
State Lemon Laws have some differences like coverage of motorcycles and used vehicles, but there are some basic guidelines that they do share. (See 50 state by state Lemon Law Summaries at: http://autopedia.com/html/HotLinks_Lemon2.html). &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
In passing the Magnuson-Moss Warranty Act, Congress specified a number of requirements that warrantors must meet. Congress also directed the FTC to adopt rules to cover other requirements. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The FTC adopted three Rules under the Act, the Rule on Disclosure of Written Consumer Product Warranty Terms and Conditions (the Disclosure Rule), the Rule on Pre-Sale Availability of Written Warranty Terms (the Pre-Sale Availability Rule), and the Rule on Informal Dispute Settlement Procedures (the Dispute Resolution Rule). &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
In addition, the FTC has issued an interpretive rule that clarifies certain terms and explains some of the provisions of the Act. This section summarizes all the requirements under the Act and the Rules. &lt;br /&gt;
&lt;br /&gt;

&lt;br /&gt;
The Act and the Rules establish three basic requirements that may apply to a warrantor or a seller. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
A. As a warrantor, you must designate, or title, your written warranty as either "full" or "limited." &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
B. As warrantor, you must state certain specified information about the coverage of your warranty in a single, clear and easy to read document. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
C. As a warrantor or a seller, you must ensure that warranties are available where your warranted consumer products are sold so that consumers can read them before buying. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The laws define what a lemon car is and require that the manufacturer, not the dealer, takes care of the defects. If a number of attempts have been made to repair a defect that significantly impairs the use, value or safety of a car and the car continues to have this defect, the car is than considered to be a "lemon". &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Most statutes set up a warranty rights period of either 12 to 24 months or 12,000 to 24,000 miles. The defect(s) must occur sometime during this period. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Many of the state laws contain specific guidelines as to what constitutes a sufficient number of attempts to repair, and whether these attempts entitle the consumer to a refund or replacement. These are: &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
a. If the defect is a serious safety defect involving brakes and or steering, the manufacturer is granted one attempt to repair. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
b. If there is a safety defect that is not considered a serious safety defect, the manufacturer has two attempts to repair. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
c. For any other defect, the manufacturer is usually given three or four chances to repair the same defect. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
d. If at any time the vehicle is in the shop for a cumulative total of 30 days in a one year period, with at least one of those days occurring the first 12,000 miles. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
If any one of these of these guidelines can be satisfied, the consumer is usually given the right to require repurchase or replacement of his/her vehicle. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Most lemon laws do allow an offset for use of the vehicle by the consumer. Oftentimes, a reduction in the consumer's purchase price return is used in relation to the number of miles he/she had put on the car. One law spells out the reduction in refund for use as follows: &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
(miles at time of refund X purchase price)/100,000 &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Only about one half of the lemon laws allow the consumer to recover attorney's fees in his/her action. Those states that do allow attorney's fees provide for a greater likelihood of success and representation in warranty disputes. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
What the Magnuson-Moss Act – Lemon Law, Does Not Require &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
First, the Act does not require any business to provide a written warranty. The Act allows businesses to determine whether to warrant their products in writing. However, once a business decides to offer a written warranty on a consumer product, it must comply with the Act. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Second, the Act does not apply to oral warranties. Only written warranties are covered. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Third, the Act does not apply to warranties on services. Only warranties on goods are covered. However, if your warranty covers both the parts provided for a repair and the workmanship in making that repair, the Act does apply to you. (Source: http://www.ftc.gov/index.html). &lt;br /&gt;

Finally, the Act does not apply to warranties on products sold for resale or for commercial purposes. The Act covers only warranties on consumer products. This means that only warranties on tangible property normally used for personal, family, or household purposes are covered. (This includes property attached to or installed on real property.) Note that applicability of the Act to a particular product does not, however, depend upon how an individual buyer will use it. &lt;br /&gt;

If you buy, lease or transfer a car or motor home, new or used, and it develops serious defects that cannot be fixed by the manufacturer you can get even with the dealer or manufacturer under a law called New York Lemon Law regardless of the warranty clause or waiver signed by you. &lt;br /&gt;

&lt;br /&gt;
What defects qualify for redress? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
New York Lemon Law takes up and determines all major defects i.e. engine trouble, transmission problem, wobbles, stalling, starting trouble, leaks, rattles etc, except the normal wear tear. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
What the law requires? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
· That your car should be registered with New York State and covered with warranty. &lt;br /&gt;
&lt;br /&gt;
· That serious defects must have developed within first 18,000 miles or two years from the date of original delivery, which ever is earlier. &lt;br /&gt;
&lt;br /&gt;
· That even after four or more repaires for the same defects the problem has not been solved completely. &lt;br /&gt;
&lt;br /&gt;
· That it remained at the workshop for a period of 30 cumulative calendar days. &lt;br /&gt;
&lt;br /&gt;
· That driving such a car is fraught with danger to your life. &lt;br /&gt;
&lt;br /&gt;
· That the car was for personal use. &lt;br /&gt;
&lt;br /&gt;
· That due to the defects the value of the has diminished. &lt;br /&gt;
&lt;br /&gt;
· That you have not made any alterations in the car. &lt;br /&gt;
&lt;br /&gt;
· That you have performed your contractual obligations. &lt;br /&gt;
&lt;br /&gt;
· That the dealer or the manufacturer refused to carry out repairs. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
How to initiate an action? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Within 4 years of original purchase, you must fill up a Request for Arbitration form available at the Attorney Generals Regional office enclosing all documents, relevant bills, correspondence, job work records etc. If the request is tenable, you would be required to deposit the request fees. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
You can go directly to court but arbitration is cheaper and convenient. You can also opt for mediation with dealers/manufacturers under the rules framed by Federal Trade Commission. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
You may go for an oral hearing in presence of your mechanic or seek justice on the basis of the document disclosed. Verdict, which is appealable, is out within 10 days of the final hearing. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
It is best to appoint a qualified Attorney to pursue your case as from time to time new notifications are issued by the government in the matter. Lawyers' fees are payable by the Dealer/Manufacturers and consultations are free. &lt;br /&gt;

The late 1980’s saw a new lemon law that holds car makers accountable, by particular situations of course, for refunding the purchaser’s money or exchanging the problem vehicle with a new, comparable model. This law does not cover a used car lemon nor does it provide coverage for ATV vehicles, motorcycles, dirt bikes, motorized scooters or large trucks with a weight of over 10,000 pounds. &lt;br /&gt;

This lemon law Florida has also only covers new vehicles, either bought or leased in the state. There are very few exceptions. Defective operation or a major flaw in the car has to be present which would impede the safe use of the vehicle. You have heard that beauty is in the eye of the beholder? Well, the same goes when judging whether or not your vehicle has a legitimate defect. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The owner of the car has to have had wasted a lot of time taking the vehicle into the dealership or certified service provider, losing family time and possibly loss of wages due to missed work. Ok, so the lemon laws do not exactly say that, but that is the reality of it right? Technically, you had to have taken the vehicle in at least three occasions for identical problems or have had the car out of commission for fifteen straight days due to the flaw or defect. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Here is where it starts getting irritating. After all this time and aggravation of taking your vehicle in without the problems being fixed, THEN you have to fill out a form from the lemon law Florida handbook. You can state your grievances on there and describe your vehicle problems. The next step is mailing it straight to the manufacturer via certified or receipt mail and waiting for a response. (All this hassle almost makes you want to make lemonade with that car lemon, doesn’t it?) &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The manufacturer has ten days to pony up a response to your grievance. If you do not hear from them, then their rights are waived. Usually though, you will hear back from the manufacturer where they will direct you to yet another authorized service provider for another inspection of the alleged car lemon. Sounds like a lot of fun! &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
If you get disgusted with the entire process, do a search on the internet or ask around for some reputable lemon law lawyers that can fight the battle for you. Just be sure to keep track of all your repair receipts, any rental car fees due to your vehicle being out of commission and any other warranty work. If the dealer is unable to repair the car after a reasonable number of attempts, then according to the used car lemon law consumer is entitled to a full refund of the purchase price. &lt;br /&gt;

In such a case the auction company should be registered with the Department of Motor Vehicles. During any sales by an auction company or the dealer, the seller must provide the lemon law warranty at the time or before the sale. In cases where a dealer fails to give you the written lemon law warranty, the dealer is nevertheless considered to have given the warranty and you are entitled to all the protections under the law. &lt;br /&gt;

The used car lemon law sets only the minimum obligation for the dealers. However, a dealer may choose to provide additional warranty or may limit the coverage of the vehicle under warranty. The exclusion may include service or repair asked for due to consumer negligence, vandalism negligence, collision, abuse or theft, etc. Exclusion can also be for motor tune-up or repairs asked if the odometer has been tampered. There can be other several exclusions depending upon the dealers warranty provided. &lt;br /&gt;

Adjudged from this point, Texas Lemon law is an automobile law that supports the consumers who buy or lease new vehicles with severe concealed defects, to get their vehicles repaired, repurchased or replaced. Texas Lemon law was put into effect in 1983 by the Texas Legislature and is administered by the Texas Department of Transportation's motor vehicle division and motor vehicle board. &lt;br /&gt;

Under what circumstances can you file the Texas Lemon lawsuit? &lt;br /&gt;

The Texas Lemon law is not applicable for those vehicle-related problems, which are caused by the owner's neglect, abuse or any unauthorized changes done to it. There are certain pre-requisites for your vehicle to be considered as "lemon" (worthless) and then only are you eligible to file a Texas Lemon lawsuit. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Firstly, it has to be a new vehicle purchased or leased from a licensed dealer in Texas. Secondly, the vehicle has to have severe defect affecting its performance, value or safety, which is covered by the manufacturer's warranty. Thirdly, the defect must be reported to the manufacturer in writing and he must be allowed to give a reasonable number of attempts (usually four) to rectify it. Finally, the vehicle has to meet the mileage requirement (not applicable for TRVs). After this the owner can file a Lemon law complaint by paying the proper filing fees. &lt;br /&gt;

How many chances the dealer stands? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Before filing the Texas Lemon lawsuit, the owner of the defective car must give the manufacturer reasonable chances to fix the problem. To determine this "reasonable" period, you need to pass the Four-times test or the serious safety hazard test or the 30 days test. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
- If you take your car twice for repair during the first 12 months or 12,000 miles (whichever comes first) followed by two more in the next 12 months or 12,000 miles and still it is not repaired, you pass the four-times test. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
- If you take your car for fixing a serious safety hazard once during the first 12 months or 12,000 miles (whichever comes first) followed by another in the following 12 months or 12,000 miles, then you pass the serious safety hazard test. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
- If your car is out for servicing for a total number of 30 days during first 24 months or 24,000 miles and there were two prior repair attempts during the first 12 months or 12,000 miles just after delivery and a sincere defect still exists, then you are eligible to pass the 30-days test. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
What does the Texas Lemon law cover? &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
The Lemon law is applicable to cars, trucks, SUVs, vans, motorcycle, motor homes, all- terrain vehicles and Towable recreational vehicles (TRVs). Moreover, the TRVs must be registered and titled in Texas, built on a single Chassis and must contain one or more life support systems. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Remember, that you must know your rights and have all the records of the repair before you file the Lemon law suit.&lt;br /&gt;

The owner of the Chevrolet claims he experienced repeated problems that caused him to fear for his safety. &lt;br /&gt;

This is not the first time GM has been sued for safety issues - in 2009 a wrongful death suit was filed against them for defective seat belts. 2009 also saw a recall of almost 1.5 million mid- and full-size Buick, Chevrolet, Oldsmobile and Pontiac vehicles because of an engine oil leak problem that could pose a fire risk. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
This kind of defect in a vehicle is precisely what the lemon law is about. It protects consumers from the harm or loss caused by purchasing a defective vehicle. Who has what rights and what duties in lemon law matters? It seems clear. The consumer has the duty to present the vehicle to the manufacturer or its representative, the dealership, in order that they are able to diagnose the defect and repair it. Along with the duty, the consumer has a right to expect the dealership to repair the vehicle honestly and expeditiously. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
What are the rights of the manufacturer? Simply put, they have the right to expect that the consumer will present their defective vehicle at an authorized dealer for repair in a timely manner, and that the consumer properly maintain the vehicle. The manufacturer should have no other expectation. They should not expect a consumer to perfectly describe the defect they are experiencing or any other limiting requirement. &lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
Of the thousands of lemon law clients we have spoken with, it is extremely rare that a manufacturer makes a legitimate offer to buy back or replace a defective vehicle. In each of these cases no hint of awareness of their affirmative duty was present. &lt;br /&gt;

&lt;br /&gt;
Not all manufacturers or dealerships are the same. Some, certainly not enough, really do have the consumer’s best interests at heart. &lt;br /&gt;

If however you find yourself with a defective vehicle and a manufacturer who is not ready to step up and replace or refund as they should, find yourself an experienced lemon law attorney. Do your homework. Look at their record. See what others who have used their services have to say. &lt;br /&gt;
