Jack Herer Cannabis & Hemp Act of 2014

(formerly known as Cannabis & Hemp Freedom Act of 2014 CHFA)

This Initiative may allow for the Freedom to use, grow, transport and sell Cannabis in California.

Sales will be taxed, with an exemption for medical use.

This initiative measure is submitted to the People of the State of California in accordance with the provisions of Article II, Section 8 of the Constitution.

This initiative measure adds Chapter 6.7, entitled “The Jack Herer Cannabis & Hemp Act” to

Division 10 of the Health and Safety Code.

SECTION 1. Sections 11420.100 to 11420.710 are added to the Health and Safety Code, to read:

11420.100 Definitions:

(a) This Act shall be known and cited as the Jack Herer Cannabis & Hemp Act.

(b) “Cannabis” means “marijuana” as defined in Section 11018, “concentrated cannabis” as defined in Section 11006.5.11421(a), the “Hemp” plant, or any other variety of the Cannabis Genus.

11420.110 No California resident or person located within the State of California shall be subject to any discrimination in any courts including but not limited to civil and family court, nor be charged with any crime, felony or misdemeanor related to the use, growth, possession, transportation, or sales of the Cannabis plant, seeds, or pollen, nor for land use related to any such activity.

11420.120 Using, selling, cultivating, or producing Cannabis in any form, including any concentrated form of the separated or extracted resins, whether obtained in crude or purified form, or extracted using any solvents, shall not be prohibited.

11420.130 Cannabis that is sold, cultivated, or produced for medical purposes shall not be taxed, but Cannabis intended for recreational or religious usage may be taxed at any rate up to that at which alcohol is taxed, at the discretion of local or state authorities.

11420.200 Discrimination:

(a) No California resident or person located in California shall be subject to any discrimination in employment based on that individual’s use of Cannabis or their involvement with the sale, cultivation, or production of Cannabis, except when performing a task where temporary physical impairment due to cannabis use has been scientifically proven to endanger human life (e.g. driving a school bus, piloting a commercial aircraft, or operating heavy equipment).

(b) Providers of electricity, water or other public utility services shall not charge higher rates to any individual, business or group, nor otherwise discriminate against individuals or businesses, based on the presence, use, or handling of Cannabis.

11420.300 Limitations:

(a) The use, cultivation, or sales of the Cannabis plant by persons under the age of 21 for any purpose other than medical use may be prohibited, but punishment shall not exceed a civil infraction.

(b) Sections 23152 and 23153 of the vehicle code shall not apply to anyone using cannabis unless the individual is committing an act forbidden by law, or neglecting a duty imposed by law in driving the vehicle, and is proven to be cognitively impaired or operating under reduced functional capacity, and has a THC content of more than 25 nanograms per milliliter of blood.

(c) The protections provided by this Act shall not apply to any person or group that sells or supplies cannabis to a minor without the consent of his or her parents or guardians, engages in the harboring of undocumented migrants used in connection with the protections of this Act, or deliberately aids any criminal organizations or cartels primarily operating in a foreign jurisdiction.

11420.400 Reasonable Regulations:

(a) No government entity shall enact any unreasonable regulations that exceed regulatory requirements for any similar business or organization.

(b) Any total ban or prohibition on any Cannabis related business, storefront, grower, collective, cooperative, association, dispenser or provider must appear on a general election ballot during an even numbered year.

11420.500 Prohibition:

(a) The use of any State of California resources to enact, enforce, or fund the prohibition of possession, use, cultivation, transportation or sale of the Cannabis plant is expressly prohibited.

(b) State authorities, including the California Department of Justice, shall protect and defend all provisions of this Act from any and all challenges or litigation, whether by persons, officials, cities, counties, or the federal government.

11420.600 Release from prison & expungement of records:

(a) Enactment of this initiative shall include: amnesty, immediate release from prison, jail, parole, and probation, and clearing, expungement, and deletion of all criminal records including all arrest records for all persons currently charged with, or convicted of any non-violent cannabis offenses included in this initiative which are hereby no longer illegal in the State of California. People who fall within this category that triggered an original sentence are included within this provision.

(b) Within 60 days of the passage of this Act, the Attorney General shall develop and distribute a one-page application, providing for the destruction of all cannabis criminal records in California for any such offense covered by this Act. Such forms shall be distributed to district and city attorneys and made available at all police departments in the State to persons hereby affected. Upon filing such form with any Superior Court and a payment of a fee of $10.00, the Court shall liberally construe these provisions to benefit the defendant in furtherance of the amnesty and dismissal provision of this section. Upon the Court's ruling under this provision the arrest record shall be set aside and be destroyed. Such persons may then truthfully state that they have never been arrested or convicted of any cannabis related offense that is hereby no longer illegal in the State of California. This shall be deemed to be a finding of factual innocence under California Penal Code Section 851.8 et seq.

11420.700 Any law, statute, regulation or policy of the State of California that conflicts with this section shall be amended or revised within one year of the adoption of this language in order to comply with the intent of this Act. Any such law, statute, regulation or policy not amended or revised within that time period shall be considered void and without legal effect.

11420.710 Should any provision of this Act, or its application to any person or circumstance, be determined by a court of competent jurisdiction to be unlawful, unenforceable or otherwise void, that determination shall have no effect on any other provision of this Act or the application of this Act to any other person or circumstance and, to that end, the provisions hereof are severable

So this is what I do most days now think so today is my first day of walk. Those that follow me will love the out come of the walk even if in secret you will still want to know what the walk is all about.

So this is it in a nut shell. I want to see everyone on this side of the water legal to grow our own meds.

The laws are wrong we can make a change. But we have to first come together.

To unite under one banner Freedom, to do what ever it is we want to do.

The world in this day in age is a new world things never seen are now getting light.

I Sit Here with Nothing to Do,

Yes I Do!!

I sit here with nothing to do,

there was once a time of work, where I was a slave to the man, in the hot sun 12 to 16 hours a day.

My work history isn't really the topic of this so I will be brief,

In my younger days, I was a carpenter's helper.

My second and first real all my own was a cook, and still today love too.

Then for too long I was a inmate, slave in another fashion.

Once the down time was over I was off to the races. I did some pretty big jobs.

I worked for day labor to get me something on hand. Then was able to get a job with total site development.

The hours were the same as sun required. But the difference is the job was so much better than others that I have had in my life coming full circle to my point.

Sitting in the garden for me is a thing of the past. No More,

Coming into the garden and looking at my plants, one of the most peaceful times that you will find.

No More hours spent everyday working on the plants and rooms.

No More sitting and thinking of upgrades and ways to better the rooms or how to better the growth pattern of the plants. Truly the best job I ever had. The time that I put into the plants and all the things for the grow.

I will miss it, until my next garden.

Now I am the legal buff. I am also the WXII12 star.

Neither of which I wanted to be. I wanted to be the one that had the nice house and grew his own meds in the basement. Someone that no one knew anything about him. I cut my grass and make my yard look nice and wave when someone goes by. I am a nice guy, truly a nice guy. Some say that I am too nice to do everything that I can to help my friends. That's just me, something that is the person that I am. What I have done is something that hurt no one other than the local dealer on any corner. Think about that really who is hurt by someone trying to save money by growing his/her own medicine. Thats what I was doing. Trying to save the love of my life and some money. My wife has had quite a hard life. Things that she has been through @38 with 2 hip replacements, and 2 really bad relationships before our reuniting, has had its toll on her body and mind. I myself have many things wrong with my mind I have schizoaffective disorder and bipolar so as you can imagine dinner in my house is a fun time. lol

So now I must do what i can and get my story out there that's what I have been told so there it is in a nutshell. Not a good story just one that many people are doing the same waiting to be the same story that I have now. So always remember to hold your tongue when it needs to be held and don't fight with yourself.

My name is Jack Wells and I am asking for donations to help hire a lawyer before my court date.

I was arrested for growing cannabis for personal use for me and my wife. I suffer from bipolar and schizophrenia...Cannabis has helped me deal with the symptoms of both as far back as I can remember. But in the state of North Carolina it is still illegal to use. As for my wife, she has Multiple Sclerosis, Osteogenesis Imperfecta, and glaucoma. She uses cannabis to deal with the pain she has on a daily basis.

I hated that my wife was using so many pills that where killing her slowly, so I started growing cannabis to help her. I had 13 plants growing and none had smoke able parts on them when I was arrested. The police and sheriff departments charged me with manufacturing, maintaining a dwelling, and less than an 1/2 ounce of product.

The laws need to be changed so people who use cannibis as medicine can benefit from the many benefits of the plant. My wife does not smoke cannibis, she ingest it in cookies and brownies. Since she has started this her use of pain medicine has drastically decreased. Her hope is to get off the pain medicine completely and stop damaging her liver and heart with each pill.

As for me, the use of pharmaceuticals has been a nightmare...I shake uncontrollable, my balance is gone, and my memory is slowly going down hill. Almost all my family members deal with a chemical imbalance and this causes pharmaceuticals to have an opposite effect on us as a whole. This being said, I have never had these effects from the use of cannabis.

Due to North Carolina's laws, I am looking at prison time and that means leaving my wife behind for a undetermined amount of time. She is about to have a major surgery, hip replacement, and she has no one else that can take care of her after the surgery. My hope is to get donations to help with hiring a lawyer before my court dates. The first one is on August 26th, which doesn't give me much time.

Any amount will help us, even a dollar. I am in the process of filing for my disability and my wife's only income is her disability, so hiring an attorney isextremely hard, especially with rent and other household bills each month.

Cannabis? Never going to happen GOD made it all you have to do is grow it. Then you will have all that you need to handle anything that ills you. (Other than ignorance, sorry WWW READ!!!) Knowledge and Information is what?? Come on you know the answer right? Do you read your bible or go to a fashion show and listen to someone tell you what they got from a passage to give you a message.

Think about it, you are saying that just because, "a ADULT medicine, (you say tomato i say tamato) that GOD created (that should be controlled by someone more professional than a thug with a gun) a natural plant that is and has been cultivated for 10's of thousands of years, that even grows in many countries in this world on the side of the street. Augustine's Medical Marijuana testamony

This is a testimony that I received today, that I would like for everyone to read.

Hi I'm Augustine I'm 28 years old and have been self medicating for about 7 years now. When I was 17 I was diagnosed with a brain tumor and given a year to live. By the grace of God in a great support system and an even better team of doctors I'm here tell my story today.

After my surgery I suffered from anxiety, massive headaches, and Grand Maul seizures. I tried many prescription medications to try to control my pain and seizures but none of them helped. My mom and dad came to me about smoking marijuana I had never tried it before. It's kind of funny I freaked out a little bit first, but after I got use to it and made it part of my daily routine I didn't freak out anymore I was able to control my pain is needed and surprisingly I haven't had a seizure since I can't say for sure but I went from 4 or 5 a year to be able to say I haven't had a seizure in over 2 years. I went on to try to help others like myself we have opened the Oakville medical caregivers collective Garden as well as the Hoquiam medical caregivers collective Garden. To try and help others like myself find an alternative medicine for anyone it might help.

Thank you for sending in this wonderful testimony of your battle and ultimately your win with with the use of Cannabis. I hope that you will continue to improve your health and one day be seizure free. I have a friend that has Epilepsy and has never used Cannabis to help control her seizures. Last night I sat and watched her have tremors for about 30 minutes with her telling me that she would be OK. (with them looking like they were getting worse the whole time). I took it a-pun myself to take a big ass rip of the bong and blow it right in her face after doing this about 4 times she started calming down and within another 10 minutes she was fine, the tremors had stopped and she was back to her self again.

I have no drought that it could have gotten worse than it did, had I not done what I did.She has told me of all the side effects that she has with her prescribed medicine and I think I can find a strain that would do her better than any pills out there. I will be growing a strain just for her once she comes over to my side of the tracks. Cannabis is natural it comes from a seed and it doesn't need anything to make it something that it's not. God gave us the best medicine that we could ever have. He even told us in Gen.1:29.

What's up guys I know it has been a while since my last post but things have been busy in the home front.

I wanted to take this opportunity to introduce a new product on the market for our Cannabis plants, Bat Guanoman check them out and let me know what you think of it.

This is the first plant that I have grown, we have had quite a time together. I now have it in a 5 gal pot that it will be in until harvest. I will be letting it veg under 400 watts of MH for 12 more days before I throw it into the flower room that I have setup for them.

Plant 2 as I so lovingly call it lol is days behind it at about 16 days out. As you can see I have done this plant completely different I am pulling down to let the undergrowth, grow out instead of lollipoping it. Just to see the difference that it makes at harvest.

Chris O'Flynn's Medical Marijuana testimony

This is a good friend of mine, who has had the courage to tell his story.

Medical marijuana has always been a very important part of my life. Without it I honestly don't believe I could be a normal and functioning member of society. You see, I suffer from various mental aliments both from birth and throughout my life and the hardships I faced growing up.

Since a young age I was bullied and that had resulted in issues with both depression and anxiety which spiraled out of control in my teenage years. Added on a disassociation with people and places and my Multiple Personality Disorder, I was medicated by physicians to help stabilize my emotions and actions.

Needless to say I was practically a zombie. I couldn't pay attention or hold a conversation, didn't hate or enjoy anything and as I entered high school I was introduced to the good old Mary Jane by a childhood friend. Since that day I have been off my prescribed medicine and have relied entirely on Medicinal Marijuana for these problems. I have not had a major incident in years.

It is only an added bonus that it greatly helps with chronic neck pain (something over the counter medications like NSAIDS or Naproxen do not help at all with) and Osteo Arthritis that I have had since I was a teenager. So I am definitely Pro Medical and even Recreational Marijuana and can only hope that it is legalized nationally in the near future.

Thank you Chris for sharing your story with all my readers I know that it was hard to write.

My friends story is like so many others and today the government still fight's the users that benefit from the use of Medical Marijuana.

This is my new veg chamber. The top is 10" from the light and the bottom shelf is 24". This gives my plant plenty of room to grow.

Marijuana day 16-19

I went ahead and topped it

For a little while I had thought about tossing this plant altogether and not wasting my time with it. I knew that there was a problem with the plant on day 14 the edges started to curl.

I have found out after talking with a fellow grower on The Dank Den today that my plants were to close to the light's. I had them at about 3 or 4 inches away from the light's and it was burning them up. He told me that when growing with T5's you should try and keep your plant 6 - 8 inches away from your T5 lights. Well I say it was the light, I did accidentally grab the wrong bottle and dowse the plants leaves with nutes. (nts: no bowls before tending) So that in it's self could have killed the plant. But luckily just look at this plant now on day 19 after topping on the day 16. You can see the growth that a few days ago wasn't there just tiny dark green leaf sicking up.

This plant has suffered some major heat damage and it will defiantly stunt the growth of the plant and could even kill it, but lets hope that is not the case this time. I may have caught the heat problem in time to save the plant. Only the next days will tell. With a little luck and some good grow energy I think it will pull through and I now have my heat problem fixed with a 120mm fan that pushes 78 FPM so it say's. lol I must say it is working so far. Just in-case I have another one that is rated the same that will match it on the opposite side if I see that the one fan isn't enough I have the second one ready to go in.

Heat is a very important thing to be aware of, heat with dry plant's will kill them in a matter of hours. Even under T5 they do put off heat, and will bring the temperature up in your room not as fast as a MH or HPS would. There is a way to fight this heat! Exhaust it out of the box. simple right? I did it the other way and brought air into the box and didn't have much of an exhaust and my heat stayed high until I opened my doors. This problem was fixed by reversing the fan to draw heat from the top (exhaust) and leave the bottom open for air flow this brought the room temperature down and it's staying in the mid to high 80's it's still a bit hot though. So I will cut another hole for air to flow from the bottom and see how that does.
