On May 22, Gary Hendershott, a Little Rock, Arkansas, dealer in Civil War memorabilia and U.S. Western historical objects, sued Heritage and its six business partners in Dallas County’s 101st Judicial District Court under the federal RICO (Racketeer Influenced and Corrupt Organizations) Act and for violating several Texas state laws. He alleges that the Dallas-based firm used shill bidding to drive up prices "in surreptitious competition with other valid bidders."

Published in exactly the same size and format, and employing the same typefaces and graphics, they both preface their lavishly illustrated directories of artists and their curating, collecting, and organizing supporters with sets of introductory essays. Each also has the multitalented Hossein Amirsadeghi at the helm of its writing and editing team. The principal difference between them, of course, is the area on which each focuses: While the slightly earlier Different Sames features the work of 111 Iranian artists, New Vision covers 69 Arabic artists, from Morocco to Saudi Arabia.

The film, photography, and video installation artist — known for wistful, haunting images of Iranian women oppressed by a postrevolutionary regime she has watched from exile in America — makes no secret of her disdain for the authoritarian actions in that country. In July she participated in a three-day hunger strike at the United Nations headquarters in New York to protest the recent elections there. Now, five years after shuttering its space, Dia has announced plans to return to the neighborhood — which has blossomed into New York's premiere gallery district — and construct a new building on land its owns at 545 West 22nd Street.

Dia’s chairman Nathalie de Gunzburg and director Philippe Vergne had stated in recent interviews that they were committed to establishing a permanent exhibition space for the foundation, which maintains sites around Manhattan and has programmed a handful of projects in space provided by the Hispanic Society of the Americas in Washington Heights.

News published by katie
NEW YORK—The Impressionist and Modern evening sale last night at Sotheby’s exceeded all expectations, as the 56 lots sold fetched a rousing $181,760,000, easily hurdling pre-sale expectations of $115,250,000 to 163,600,000. Only 10 works failed to find buyers, delivering a svelte 15 percent unsold rate by lot and an impressive seven percent unsold by value.

Two artist records were set, and 40 of the 56 lots made over one million dollars. Of those, five exceeded the $10 million dollar mark. The evening proved to be a 360-degree turnaround for the market after a relatively lackluster $65.6 million sale at Christie’s on Tuesday evening.

“We beat Christie’s by lot 14,” Sotheby’s Impressionist Modern expert David Norman boasted, indicating the surprise and elation felt by his house after the wobbly evening experienced by its arch rival, Christie’s, on Tuesday night.

The Sotheby's sale blasted out of the starting gate with Salvador Dali’s enigmatic gouache and charcoal work on paper, 1937's Girafe en feu (est. $150–200,000), which sold to a telephone bidder for $1,874,500 as seven other bidders chased the Surrealist piece.

London jewelry magnate Laurence Graff nabbed Pablo Picasso’s Femme assise dans un fauteuil, another work on paper, from 1938 (est. $500-700,000) for $902,500, and Swiss private dealer Beda Jedlicka won Alberto Giacometti’s Buste de Diego, a 13 1/8 inch high bronze conceived and cast in 1961 (est. $1.5–2 million) for a relative bargain at $1,650,500.

That sale seemed like a bargain compared to the evening’s top lot, Giacometti's rare, painted bronze, L’homme qui Chavire, conceived in 1950 (in plaster) and cast in 1951, which sold after fevered bidding from four determined telephone bidders for a whopping $19,346,500 (est. $8-12 million). Hailing from an edition of six, it was the only cast in the edition to be hand painted by the artist. Collector and publishing titan S.I. Newhouse, Jr. had reportedly decided to offer the piece after shopping it through dealer Larry Gagosian at a price believed to be in the $20 million range. The low-ball estimate seemed, on paper, to admit that number was way too high. Tonight, the market disagreed.

A spectacular result was also achieved for the color-charged Fauve painting by Andre Derain, Barques au port de Collioure (circa 1905), estimated at $6–8 million, which sold to newly minted private dealer Guy Bennett for a record $14,082,500.

It shattered the previous mark set back at Christie’s London in June 1989, when Bateaux dans le port Collioure made $6,160,00.

Bennett, the former head of Christie’s New York Impressionist and Modern department, declined to comment about the purchase, claiming he didn’t want to grandstand about his new role — at least not yet.

Another overachiever — and there were plenty tonight — was the sexy cover lot, Kees van Dongen’s sultry and bare-chested Jeune Arabe from 1910, which attracted at least four bidders, selling to an anonymous telephone bidder for a record $13,802,500 (est. $7–10 million).

It was part of a rich trove of some 24 works designated as property “from an important European collection.” The group made $58.5 million against a pre-sale estimate of $35.6–51 million.

The seller, Dutch financier Louis Reijtenbagh, had recently settled a number of lawsuits with three separate banks over loans and liquidated the trove to regain some financial footing.

Impressionist pictures also sparkled during the marathon sale, topped by Camille Pissarro’s stunning cityscape, Le Pont Boieidieu et la Gare d’ Orleans, Rouen, soleil from 1898, which sold to the artist's great-grandson, Lionel Pissarro of the New York and Paris private dealership Giraud Pissarro Segalot, for a hefty $7,026,500 (est. $2–3 million).

“Obviously, the cityscapes keep attracting higher prices than the rural landscapes,” Pissarro said, shortly after the sale. “It’s a big price and couldn’t be more fresh to the market, coming from the artist’s studio to Durand-Ruel.”

Five of the six lots offered from the fabled French dealer family of Durand-Ruel made a total of $18.9 million against a high pre-sale estimate of $12.6 million.

Of the eight Picassos offered during the evening, Femme au chapeau vert from 1947 shot past its high estimate of $6 million, thanks to a quirky telephone bidder who played a kind of cat-and-mouse game, jumping bids at $400,000 increments when it was only necessary to bid $100,000 higher.

The bids were taken by Mandarin-speaking private client specialist Xing Li, who bought another three works for the client with the paddle number L0057, including another Picasso, Claude a deux ans from 1949, one of the two so-called ‘irrevocable bid’ properties. It made $6,642,500 on estimates of $5–7 million.

Opinions seemed crystal clear as bidders and viewers exited the salesroom, trying to catch up with the World Series or late dinner reservations.

“It looks like the rich have fully recovered,” said seasoned private New York dealer Paul Herring.

Next week's Post-War and Contemporary auctions will test whether he is right.

News published by katie
NEW YORK—Midway through a Sunday night performance in the Museum of Modern Art’s atrium, Casey Spooner signaled his band Fischerspooner to a sudden halt. “I’m going to die!” he screamed to the young, fashion-conscious crowd, apparently displeased with their level of enthusiasm. “I’m a showbiz disaster. This is your last chance to show your love!” The crowd cheered, trying to oblige their fated star, and the noise appeared to be sufficient. Spooner who takes the role of a rampaging showman on stage — equal parts Boy George and Roman gladiator — motioned to his team, and the group’s raucous club music started again.

Later, Spooner explained his tantrum. “Sorry guys, they’re filming these shows,” he told the audience. “The film is what matters.” He noted that the performance would be included in a movie the group was making about a fictional pop star. Everything had to be perfect. As his meltdowns mounted, though, the crowd realized these show-stopping diatribes had been carefully choreographed — designed in part to provide time for performers to rest over the course of the three-hour show and change into new, Rococo costumes (designed by artist K8 Hardy).

Now two former Christie’s executives have announced that they have launched a consultancy to advise clients in the field as well.

Michael Plummer and Jeff B. Rabin say that they plan to use their new venture, Artvest Partners LLC, to advise clients on purchase and sale transactions, special-purpose investment partnerships, wealth transfer, and the restructuring of art business and collections.

Both partners formerly worked in Christie’s Financial Services Business, Plummer as chief operating officer and Rabin as vice president.

In an e-mail sent to ATM’s mailing list, director Bill Brady said that the two galleries had decided to form an “alliance under one roof… in an effort to consolidate our talents and reach an even broader audience.” Brady, also stated that ATM will henceforth be referred to as Bill Brady~ATM, and that the two galleries will present separate shows in the space.

ATM’s roster includes Huma Bhabha, Eric Sall, and Alison Fox. Freight + Volume’s counts Chris Gilmore, Jim Lee, and Laurina Paperina among its list.

News published by katie
LOS ANGELES—Ed Ruscha seems to be having a great year. London’s Hayward Gallery feted him in a massive retrospective, the philanthropic group Americans for the Arts awarded him its Artistic Excellence Award, and now bidders have set a new record price for his prints at auction.

Buyers competed vigorously on Tuesday at Bonhams and Butterfields, pushing the price of the artist’s Standard Station E.5 (1966) well above its $30-40,000 estimate to an astounding $170,000. It is the highest price ever recorded for one of the artist’s prints on the auction block. The previous highpoint for a Ruscha print was set in 2007, when an edition of his Hollywood print went for $133,000.

Perhaps most remarkable about the price is the fact that the work — which depicts a red gasoline station (one of Ruscha’s most iconic images) against a gradient background of orange and gray — is numbered 33 of a fairly sizable edition of 50. After the triumphant evening last night, it will be interesting to see if collectors decide to cash in other Ruscha prints or hold them even more tightly.
