HEARINGS MONDAY, MAY ^ ON BILLS TO GUT MEDICAL MARIJUANA IN MASSACHUSETTS

Hearings on a bill that would gut the medical marijuana program approved by Massachusetts voters in November will be held Monday, May 6 at the State House. One bill, Senate Bill 1031, would reduce the number of dispensaries statewide from 35 to 10, forcing disabled and painridden patients to travel long distances for relief. The bill would also tie the hands of doctors by limiting prescriptions to a short list of specified conditions, not including chronic pain, clinical depression, or any number of other conditions where cannabis has been shown to help.

The hearing will be at 10 AM in hearing room A-2 at the State House. The Joint Committee on Public Health will be holding a hearing on Senate Bill 1031 and several other proposals that would prevent patients from safely accessing their medicine.

SB 1031 is being filed by state Senator John F. Keenan (D-Quincy), a longtime opponent of common sense marijuana policies in the Commonwealth. .

Senate Bill 1031 would reduce the number of dispensaries allowed in the state from a voter-approved 35, including a minimum of 1 and maximum of 5 per county, to only 10 dispensaries allowed state-wide. The proposal would also limit medical marijuana patients to a supply of two ounces per month, down from the 60-day supply of ten ounces recommended by the Department of Public Health.

Most notably, Senate Bill 1031 limits the list of qualifying conditions to cancer, glaucoma, HIV/AIDS, hepatitis C, amyotrophic lateral sclerosis (ALS), Crohn’s disease, Parkinson’s disease, and multiple sclerosis. This restrictive list does not include chronic pain, ulcerative colitis, paralysis, PTSD and many other conditions that patients can find relief from medical marijuana.

“After four months of soliciting input from all stakeholders in the state, the Department of Public Health has almost finished with writing regulations for the initiative approved by the voters,” said the Massachusetts Patient Advocacy Alliance in a statement. ”Let’s let the state move forward with implementing the safest and most secure medical marijuana law in the country rather than starting all over again from scratch.”

Hearings will also be held on House Bill 2039, sponsored by Rep. James Murphy (D-Weymouth) which would establish zoning standards for the siting of medical marijuana dispensaries in Massachusetts, preventing them from being located within a 1000-foot radius of a school, place of worship, civic center, drug free zone or non smoking zones as set by a municipality or the state.

Medical marijuana advocates say that this would prohibit medical marijuana dispensaries from opening anywhere in the state, due to Massachusetts’ workplace smoking ban.

The Joint Committee on Public Health is co-chaired by Sen. Keenan and Rep. Jeffrey Sanchez (D-Jamaica Plain), both longtime opponents of medical marijuana in Massachusetts.

Massachusetts residents are urged to contact their elected officials and encourage them to oppose Senate Bill 1031.

The Massachusetts Senate candidates on drug policy

BOSTON, MA — This is not normally election season, but the open U.S. Senate seat from Massachusetts needs to be filled, so primaries are being held on Tuesday, April 30. One of the candidates, Mr. Winslow, has come out for marijuana legalization.

There are a total of five hopefuls in the two primaries. On the Democratic side, Ed Markey and Stephen Lynch face off. The Republicans have Gabriel Gomez, Michael Sullivan, and Dan Winslow on the ballot.

Markey and Lynch are both sitting Congressmen with voting records. NORML rates Congressional voting on drug policy bills on a scale of -30 to +30.

Mr. Markey, a long time supporter of medical marijuana, has a +30, and Mr. Lynch’s score is -20, a significant difference. Mr. Lynch, in a recent radio interview circulated by Mike Cann, hinted at a willingness to listen to a dialog on the subject. But, at least on the historical record, Markey is the clear leader.

History however is moving so fast these days, that yesterday’s star is rapidly overshadowed.

Mr. Winslow is campaigning for full legalization, for all uses, not merely medical.

Neither of the other Republican candidates mention anything about drug policy on their websites, and a search of news reports has failed to find anything as well.

It is especially odd on Mr. Sullivan’s part. He is the social conservative in this race, who as a former prosecutor, both for the state and federal governments, was no doubt involved in causing much human suffering. This is such an indication of our changing times, since in past years a “get tough on drug users” stance would have been routine and well publicized during a political campaign.

Rules in Massachusetts require Democrats to vote in the Democratic Primary, and Republicans in the Republican Primary, but Independents, the largest voter demographic, have a choice in which one to vote.

It is important to show support for candidates courageous enough to get out in front on the issue. So, even if he ultimately fails to win the Senate in the June election, just getting Dan Winslow onto the ballot as a major party finalist, would be a significant accomplishment. If at all possible, Independents who back reform, should support him with their vote.

Thank you for providing this forum to comment on the proposed DPH regulations on medical marijuana.

Two provisions in particular appear to make it virtually impossible for caregivers to provide the marijuana patients need while dispensaries are slowly organizing themselves:

1) Each caregiver must provide marijuana for only one patient.

2) The caregiver is not supposed to receive any compensation whatever from the patient for providing the marijuana.

Put these two provisions together, and very few people can practically step forward and become caregivers.

Bear in mind that growing marijuana indoors requires investing several hundred dollars in equipment to get started, paying high electrical bills in the ensuing months as well as ongoing costs for soil and fertilizer, and putting in hours of very real physical labor. If a patient grows for herself, these costs are repaid by the marijuana harvested and the relief it brings. But if a patient cannot grow for herself, the very considerable costs and burdens of producing the marijuana fall totally on the caregiver, with all compensation prohibited. This isn't just unfair: it has the practical effect of making it virtually impossible to be a caregiver, which means no one can help the person who cannot grow for herself. If you wish to limit the ability of a caregiver to profit from their cottage industry, you could set a maximum number of patients (but not a maximum of one), or a maximum price per ouince, or both. A limit of, say, 20 patients per caregiver and $100 per ounce would keep caregivers and their homes from turning into for-profit dispensaries but would not leave patients with no one to turn to during a long period when cities and towns are enacting moratoriums and potential dispensary operators are clearing numerous legal hurdles.

The provision that a patient must have no more than two total sources of marijuana is also unnecessarily onerous. If all providers are supposed to use a common state database, any user of the database should be able to verify that the same patient isn't filling the same prescription multiple times at different locations. If a further check is needed, patients could be issued something like a ration book.

One senses in all these regulations the underlying assumption that a set of air-tight regulations is both necessary and sufficient to prevent medical marijuana from being diverted to healthy recreational users, and that without such air-tight regulations, large-scale diversion is inevitable, with disastrous social consequences, particularly the increased availability to minors.

Let's be realistic: recreational users, including minors, already have total access to marijuana if they want it. Kids themselves, when surveyed, report that marijuana is easier to get than alcohol. Those who get their dope from dealers needn't fear being rejected as too young, and most of them get it, not from dealers, but from each other, in a vast informal network where everyone is both a user and a distributor. Likewise, almost all Massachusetts adults who wish to consume marijuana recreationally have found or could find a connection: marijuana prices have actually come down in recent years due to market saturation.

As officials responsible for public health, your first priority must be to make sure that patients who need marijuana for relief of painful and debilitating conditions can get it.

Minimizing diversion cannot be the main goal: it will never be effective for its stated purpose and is certain to cause unnecessary stress and pain for patients who need relief now and for the caregivers who would like to provide it .

    Thank you for contacting my office regarding state and federal marijuana laws. I appreciate your views and having the benefit of your opinion.

    On November 6th 2012, Massachusetts residents voted yes on a ballot question to authorize the use of medical marijuana. I, along with a majority of Americans, support making marijuana available for medicinal purposes for sick patients who truly need it. Numerous studies suggest that marijuana has medical value in treating patients with serious illnesses such as cancer, multiple sclerosis, epilepsy, and chronic pain. It is important that we continue to develop an understanding of the effects of medical marijuana and work to ensure proper control of its use as opposed to criminalizing patients for receiving effective medical treatment.

    18 states and the District of Columbia have enacted laws to legalize medical marijuana and four states have pending legislation to legalize medical marijuana. However, the United States Supreme Court has ruled in United States v. Oakland Cannabis Buyers' Coop and Gonzales v. Raich that the federal government has a right to regulate and criminalize marijuana usage, even for medical purposes. A person can therefore be prosecuted for a marijuana-related crime even if it is medical marijuana that is legal according to the laws of a particular state.

    As a result, we are going to have to figure out a way to reconcile state and federal law as more states make their support for medical marijuana known. As you mention in your letter, there were several pieces of legislation introduced in the 112th Congress that hope to change the way that medical marijuana dispensaries are treated at the federal level. H.R. 6134, the Truth in Trial Act, would allow any person being federally prosecuted for a marijuana related defense to prove that their actions were protected under state law. HR. 1983, the States' Medical Marijuana Patient Protection Act would require the Secretary of Health and Human Services to begin the process of recommending that marijuana not be classified as a Schedule I or II substance by the Drug Enforcement Administration (DEA). H.R. 1984, the Small Business Banking Improvement Act of 2011 would allow banks to accept deposits from state-certified medical marijuana dispensaries, without reporting them as suspicious transactions. And, H.R. 1985, Small Business Tax Equity Act of 2011 would allow legal medical marijuana dispensaries to write off business expenses as tax deductions. I will keep your thoughtful views in mind and their potential impact on the Commonwealth should these pieces of legislation be reintroduced in the 113th Congress.

Defiance of prohibition comes to a head in New Hampshire trial

On March 26 in Keene, NH, when prominent marijuana legalization advocate Rich Paul goes on trial, we will be seeing a new willingness to stand up to the bigots who run the machinery of Prohibition. Like Martin Luther King before him, Mr. Paul will not plea bargain; thereby refusing to concede he is doing anything wrong, and at the same time demonstrating he will not crumble under the threat of jail.

The civilly disobedient boys and girls of Keene have been remarkably defiant in their effort to live as if they were free, regardless of the consequences. Of course the government hates defiance, and loves to dish out consequences. When it comes to the Drug War, New Hampshire is surprisingly primitive and harsh. However, in one area of human rights, NH is light years ahead of other states, in that it allows jury nullification to be argued during trials.

The trial is at Cheshire Superior Court, 12 Court St. Currently, pre-trial motions are scheduled for Tuesday March 26, at 10 AM, with jury selection over the following week or two.

This trial seems destined to be a media circus, and a watershed event in the struggle against the Drug War.

Defenders of Mr. Paul are urging all legalization supporters to make an effort to attend the trial, or the picket line outside the courthouse. Anonymous Hackers Target CEOs in Operation Wall Street

Anonymous hackers have launched ‘operation wall Street’, a new protest started by the loosely organized hactivist collective against the US government, Wall Street and the financial services industry.

The operation is a call to all Anonymous “members” and citizens of the world and seeks justice for the “innocent and exploited people being forced into homelessness” because of the “crimes of Goldman Sachs and other firms who have indulged in sinister and criminal practices.”

The official proposal for the operation calls for a release of the the Dox on the “CEOs & any and all executives of Goldman Sachs, AIG, Wells Fargo, Chase, Meryl Lynch, and any other guilty party”. The goal of Operation Wall Street is to spread the personal information of those responsible for the crimes to the people who have lost their homes and had their lives destroyed.

According to links that began appearing on Twitter on March 2nd, Anonymous has already released 4.6 gigabytes of data providing the personal information of Wall Street CEOs and other high level executives.

Last week the group calling themselves the “Anonymous Intelligence Agency“, or Par:AnoIA, released 14 gigabytes of information implicating Bank of America and others in a massive spying operation. Anonymous claims the data dump proves that Bank of America contracted at least one private intelligence firm to spy on numerous private citizens including hackers and social activists.

The following statement was released on the Anonymous public relations website:

“It is no longer tolerable that these men and women get to live in luxury and lawlessness while innocent people are pushed into poverty and people who fight for freedom are prosecuted and demonized.

They must be stopped … OPERATION WALL STREET, must be launched.
We promise not to hurt you once we release your information but we cannot hold the people you screwed over responsible for their actions once they know who you are and where you live. You are not free to escape the consequences of your actions, no one is.
We are Anonymous, We are Legion, We do not Forgive, We do not Forget.

Rasquera asks again for a change in the cannabis laws

Leading the initiative also followed by 20 other municipalities, the village of Rasquera urges the Catalan Government for real changes in reference to the cannabis legalization laws.

Although the initiative to create a large-scale plantation of marijuana was driven by the mayor of Rasquera, Bernat Pellisa, together with a cannabis Social Club based in Barcelona (ABCDA), there are now several municipalities that agree with such a project. For the moment, the decision lies in the hand of the newly elected Catalan government since it was behind the decision to prevent the plantation of cannabis seeds last year.

In most cases, instances the answer is No. Largely, I am providing this service for free because I know there is a great need that is going completely unserviced. One person did donate some medicine but for the rest of the patients? Over 15+, I've helped so far? None have paid for my services. Most of these patients are of limited resources, the reason why they need this help...

Do you offer Patient Confidentiality? Yes. I do offer Patient Confidentiality in all consultations.

Why are you becoming a Patient Consultant? Because I know and hear from many patients in MA that need this help. I know the pain/frustration that comes of not having access to the best medicine for your condition.

Greetings!

Lots has been happening in the push to fully decriminalize, tax and regulate marijuana for recreational purposes. Today, people flooded the state house to educate lawmakers on the importance of protecting and improving Maine's medical marijuana laws. I've already been hearing from my colleagues that they want to learn more!

Also, MPBN's MaineWatch episode this week included a segment on my upcoming bill to tax and regulate marijuana. You can watch it on PBS tomorrow evening at 9:00 p.m. or Sunday at 5:00 p.m.

I've been buried in rewrite edits for the bill, meeting with folks to garner constructive feedback and focusing my time on strengthening the bill. Once the edits are finished, I'll be working to sign up co-sponsors for the bill - several have already committed.

Finally - we will be announcing details for a press conference and rally in the near future to properly announce the bill. Thank you again for all your support and encouragement; it is coming together!
