Defiant former information minister Zainuddin Maidin has told Indonesians "angry with (his) writing" on the republic's leaders that even Malaysia's former inspector-general of police Abdul Rahim Noor agrees with him.

Rahim had, in an interview with Mingguan Malaysia on Dec 16, revealed that Indonesia's leaders are mentors to PKR de facto leader Anwar Ibrahim, Zainuddin said in a posting on his blog yesterday.

Referring to Indonesia's third president BJ Habibie, fourth president Abdurrahman Wahid (Gus Dur) and Amien Rais, who played a prominent role in ousting Suharto, Rahim said Anwar learnt about "reformasi and democracy" from Indonesia.

"It's not wrong for Anwar to befriend them, it's his right, but it's wrong when he makes up conspiracies to betray his own country," Zainuddin (left), a former editor-in-chief of Utusan Malaysia said.

Zainuddin added that this was why Rahim, when commenting on his (Zainuddin's) article calling Indonesia's former president BJ Habibie a "dog of imperalism", advised Malaysians to "defend the Malaysian way of life".

"We Malaysians have always been alert to the dangers (of globalisation) since accepting democracy from the British, and we will continue to be on alert against elements of globalisation, especially Anwar.

"The evidence is too many. Read Rahim's interview with a cool head," says Zainuddin, whose writing has prompted an official complaint from Indonesian President Susilo Bambang Yudhoyono.

'Invisible hands'

In the interview, Rahim said Anwar's close relationship with the Indonesian leaders was a cause of concern as it could mean the spread of Indonesia's liberalism and secularism to Malaysia.

"I am worried that the opposition is not only learning from the Indonesian experience of political struggle, but trying to bring the reformasi-style struggle to our country.

"From a wider perspective, there are invisible hands playing their role in the background to ensure that Muslim leaders are liberal, open and suitable to their global strategy," Rahim (right) says in the Mingguan Malaysia report.

Among others, he said, Habibie in his speech in Malaysia was reported to have given the impression that Indonesia was more "advanced" when it came to issues surrounding sexuality and gender.

"It is as if Habibie is proud of Indonesia's lifestyle (on lesbian-gay-bisexual-transgender issues) and felt it was odd for Malaysians to have such a reaction on such moral issues," he said.

Commending Zainuddin for a "brave" article, the former top cop said Indonesia's leaders had "sketchy" backgrounds and associations, and alluded that they may have been "chosen" by the global superpowers.

Amien chosen by the US?
"It is expected for a superpower like the US to take proactive measures, like choosing individuals to be pushed up, as leaders in the Muslim world.

"Amien was considered a moderate and liberal Muslim in Indonesia, and a member of the NGO Jaringan Islam Liberal (JIL) with... Gus Dur," he said.

He claimed that liberalism flourished under the rule of Gus Dur (left), which saw the growth of Komunitas Utan Kayu "which is active in defending freedom of speech and the LGBT agenda".

He also said that "there is information that Gus Dur had admitted" to connecting Anwar with former World Bank president Paul Wolfowitz.

"Apparently, the meeting was to make Anwar the middleman in their efforts to stop Muslim youths from making Islam as their life guide and from pursuing the goal of an Islamic state.

"In short, their goal was to turn the younger generation of Muslims into liberal thinkers," Rahim said, adding that Wolfowitz is part of a "neo conservative Jewish lobby group".

They never been in Indonesia when Suharto was the President , they never been in Indonesia when Suharto fall, they don’t know what happen when Indonesians Majlis Perwakilan Rakyat (MPR) voted to release Timor Timor, they was not there when B.J.Habibie, Gus Dur, Megawati and Bambang was the President. What the fuck they know. I was there since 1993 to 2001 and always visit my family and friends there after that.

Indonesia has become the biggest economy among south east Asia country, even though they have tsunami, earthquake and lots of natural disaster and huge politic crises. But they still become the strongest economy. They have more FDI than Malaysia.

All this because of, they change the government from Suharto. They change it with REFORMASI. Also because they are liberal and secular country. Even though they are liberal that doesn’t mean they don’t go to mosque or church or they stop praying. They are more pious than most Malaysians Muslims. Just look at our mosque when Friday prayers come. It’s half empty all the time since long time ago. Don’t tell me the population doesn’t grow. Come la, don’t they produce babies anymore?

I know who is Gus Dur, BJ Habibie, Amien Rais, Megawati, Bambang and more other, that I can’t mention their name here. They are champion of democracy and human value. They love their country and people. They hate corruption. After Suharto fell the authority of Indonesia put lots of corrupted official and businessman into prison. Even Bambang (the President now) put his father in law in jail for corruption.

Maybe this is why Zainuddin Maidin and Abdul Rahim and most of the former ministers and official are scared. They scared they will end up in prison. They said we must defend the Malaysian way of life. Arent we are bangsa serumpun. Doesn’t most of Malaysian come from Indonesia? Where did Parameswara the first Sultan of Melaka come from????
And what is Malaysia way of life??? Is it corruption is our way of life???? Fuck no man…. NOOO….

BJ Habibie said Indonesia are more “advanced “ when it came to issues surrounding sexuality and gender not because he supports LGBT, he said that because Indonesians respect human value and human rights. BJ Habibie is a pious Muslim and one of the most brilliant guys in the world. He is one of the best Aviation Engineer in the World. He is not stupid when he said that and he is not certainly a dog of imperialism. He hates imperialism and so all the Indonesians. Remember one thing, Indonesia get they independent from the Dutch with blood and lifes. I know how Indonesians way of thinking because I stay there for 8 years. I have a wife and family there.

Gus Dur is the leader of Nahdlatul Ulama(NU), NU is a Islam Movement. Amien Rais is a leader of Muhammadiyah the biggest muslim movement in Indonesia. Both have early education in Islam, they even studied in sekolah pondok and pesantrian. Well do you think they support LGBT???? Zainuddin Maidin know about this. But still he accused them wrogly. He should apologize. Zainuddin Maidin also know both of them hate corruption. Because of Gus Dur and Amien Rais, lots of ex Ministers in Indonesia which are corrupt and misuse their position have ended up in prison. This is what Zainuddin Maidin is scared of. Don’t be scared, if u don’t do anything wrong. And always remember, what goes around will come back to you. Allah is Great and Fair.

And whats wrong if Anwar have friend with with former World Bank president Paul Wolfowitz???? Whats wrong if he have financial support from World Bank. Everybody needs financial support. Nobody can survive in this world without money. And politics need lots of money. Even Mahathir asked support from World Bank and IMF when he was just coming up in politics. But he didn't get it, he get it from Ananda Krishnan. Everybody knows that. I think its nothing wrong to get financial support from anyone for your politics.

Again Zainuddin Maidin said Malaysian youth are stupid. Especially Muslim youth. Muslim youth must be like idiots and follow what government says. They should not have freedom of thinking, and they should not ask any question. Just follow. They want the youth to be dummy. This is wrong. Youth in Malaysia have already and always following the way of Islam. Islam always will be their guide in life. That’s why we need to change. Changing to something good is the way of Islam. Put corrupted ministers, officials, businessman and people into prison is the way of Islam. This is the youth want and nobody can change that.

Please don’t insult a great leader like BJ habibie, Gus dur, Amien Rais or other refomasi leaders from Indonesia. Because of them, Indonesia economy is getting better day by day and one day will become like China and Japan. All these because of them who started first. They change the broken one to a new one, because they know old one can’t be fix anymore.

That what I mean by, When it is Broken, Don’t Fix it, Just CHANGE it to a New one …….

Puad: Pakatan cooperation is like a 'gay marriage'

Deputy Education Minister Puad Zarkashi today likened the cooperation between Pakatan Rakyat parties to a “gay marriage” as no clear roles are defined.

Speaking to reporters at the Parliament lobby, he said that this is because there appears to be no consensus on important matters.

Puad (right) said this was evident during the recent PAS muktamar when grassroots members proposed that its president Abdul Hadi Awang be appointed prime minister instead of PKR de facto leader Anwar Ibrahim if Pakatan takes over Putrajaya.

“It’s unclear who is the leader. Even in their parties, in PAS there is the spiritual leader and then there is the president. In PKR there is the president and the de facto leader and then there is DAP, where there is the chairperson and the secretary-general.

“It’s like a gay marriage where one doesn’t know who is the father and who is the mother,” he said.

In response, opposition leader and PKR de-facto leader Anwar Ibrahim was dismissive of Puad's description of Pakatan.

"It is his political way. It shows the level of politics being practised by Puad in saying so," he said.

Opposition bashing expected at Umno AGM

Meanwhile, on a separate matter, Puad said that the upcoming Umno general assembly (AGM) is likely to focus on the impending general election, and to give endorsement to the prime minister to lead the party through this.

He added that the AGM is also likely see delegates go “on the offensive” against Pakatan Rakyat, particularly on the administration of Selangor, Kedah, Kelantan and Penang.

He also advised all delegates who will speak during the debates to not use the platform to showcase themselves as “winnable candidates” rather, to present “critical” ideas to improve the party.

There will be no guarantee of security for PKR’s nationwide Merdeka Rakyat tour, says Home Minister Hishammuddin Hussein.

"No need for guarantees. It is decided by the people of Johor themselves.

"I think PKR knows this and can judge for itself from what is happening there," he told Malaysiakini when asked about this on the sidelines of the Home Ministry’s open house in Putrajaya today.

PKR's campaign tour bus was splashed with red paint while on its Johor leg today, the third such incident in the two weeks since it started the tour on Aug 31.

Asked whether he thought so because PKR went into Johor mindful of the risks of being in a state widely considered to be an Umno fortress, Hishammuddin replied that politics was all about taking risks.

"If even the calculated risks are a no-go, that means it is not their place to be there. The people of Johor will decide," said the home minister, who himself is from Johor.

At a press conference earlier, Hishammuddin was also asked to comment on criticism that he had not issued strong statements against political violence.

He replied that he had been consistently making strong statements rejecting the politics of hate, but more important than that was the action taken.

"This is better than empty rhetoric. So what can we see here (at the open house) we are flying the flag, (it) shows that we want peace, and we mobilised the Home Ministry Youth Club... all that are towards ensuring peace while rejecting the practice of politics of hate," he said.

Hishammuddin was also asked to comment on International Trade and Industry Minister Mustapa Mohamed’s statement that foreign investors are concerned about crime, particularly cargo theft and personal security.

He agreed that the issue needs to be addressed, but stressed that the areas that Miti is concerned about are where there is intense development to draw foreign investors, and not Malaysia as a whole.

He cited Pengerang and Iskandar Malaysia in southern Johor as an example, which are being developed under the Economic Transformation Program (ETP).

Expansion of the NKRA
He said he had spoken to the Johor police contingent on the matter, and hopes that the National Key Results Area (NKRA) would be expanded to address the issue.

“God willing, after the soon-to-be-tabled budget, the second phase of the NKRA would be expanded to give attention to the aforementioned considerations (security of investments especially foreign investments) in context of the ETP,” he said.

When asked about the 30 Internal Security Act detainees who are still in detention almost exactly a year after Prime Minister Najib Abdul Razak announced its abolition in his eve of Malaysia Day address, Hishammuddin said they were detained before the abolition, so it does not apply to them.

However, he said several detainees have been released prior to the Hari Raya celebrations as they are no longer deemed to be a security threat.

“For me, it (the release of the detainees) depends on the current situation and the threat they pose to national security interests,” he said.

This, he said, would depend on feedback and intelligence from the police and prison authorities.

He added that the government is also in talks with the governments of foreign nationals who are detained under the now-abolished law to work out a deal, so that “the responsibility of ensuring regional stability is shared together.”

Cops: Handcuffed girl got it 'very mild'

The Kuala Lumpur police chief Mohmad Salleh has defended his men for handcuffing a 19-year-old girl who surrendered herself yesterday.

Speaking to reporters today, Mohmad said the the matter was considered "light" and that proper procedures were followed.

"Handcuffing someone is an arrest procedure... I think (in her case) it was very mild. If we follow (the procedures strictly), she would be cuffed behind her back.

"So during an arrest, the handcuffs are not an issue. In any arrest, the suspect must be handcuffed.

"This is prescribed by law. It is not wrong for us to use handcuffs when apprehending a (suspect)," he said.

He was responding to questions from reporters at a function in Kuala Lumpur. Mohmad was shown a news clipping depicting the girl in handcuffs.

The girl is accused of violating the Sedition Act 1948 at Dataran Merdeka on Merdeka Day eve by stepping on Prime Minister Najib Abdul Razak's photograph.

Quizzed of the use of the law, which is soon to be abolished and replaced with the Harmony Act, Mohmad said the law has yet to be repealed.

"This means that the Act is still in force. Thus we have the right (to use it)," he said.

Mahmod said his men are still pursuing eight out of 11 people wanted over several incidents in connection with the incident.

He added that 238 police reports were lodged over the incident.

Lawyer: Don't be selective in probe on butt flasher

A criminal lawyer has called on the police not to be selective in investigating cases involving indecent acts being allegedly done to pictures of political leaders.

Referring to the arrest of a student for flashing his bare butt at pictures of Prime Minister Najib Abdul Razak and his spouse during the Merdeka Eve celebrations last week, Baljit Singh Sidhu asked why other similar acts went unpunished.

"Why no action?" Baljit (right) asked, referring to the picture of Penang Chief Minister Lim Guan Eng stepped on by demonstrators and when a group of army veterans exercised their buttocks in front of Bersih co-chairperson S Ambiga's house.

He said that while he saw no "impartiality" in the action of the police, he felt that if the case went to court, lawyers would question the apparent "preferential treatment" for the Najib case.

It was clear to him that police did not take action in the case of Lim and Ambiga.

"I hope there is no selective investigation in this matter," Baljit told Malaysiakini today.

However, he said, the butt-flashing student could be charged with indecent behaviour, under the Penal Code.

Flag incident: Sedition Act can be used

Commenting on another incident at the Merdeka Eve celebrations involving individuals waving the Sang Saka Malaya flag, Baljit said he believed they could be charged under provisions of the Sedition Act.

Police have also asked for those involved in the flag incident and 10 other individuals who stepped on the pictures of Najib and his wife Rosmah Mansor after the student bared his buttocks to come forward.

Three police task force units have been formed to investigate the incidents under the Sedition Act, Peaceful Assembly Act and Sections 290, 504 and 509 of the Penal Code.

Baljit's call for an impartial and non-selective investigation echoes that from opposition leaders who have lamented that similar incidents involving their leaders were allowed to pass without any action taken.

Q & A on the Hudud and Qisas Enactment

1. What is the Hudud and Qisas Law?

Hudud and Qisas laws deal with offences and punishments that are interpreted by Muslim juristic scholars to be derived from the Qur’an and the Sunnah (of the prophet). Hudud literally means limit. According to some scholars, the word “hudud” is not used in the Qur’an specifically in terms of punishment. However juristic opinion has reduced hudud to mean mandatory punishment. Under Hudud law, theft, robbery, illicit sex, alcohol consumption and apostasy are considered offences. Punishment for these offences are corporal in nature, involving whipping, stoning to death and amputation of limbs. Qisas (law of retaliation) refers to offences that involve bodily injury or loss of life. The punishment is death or imprisonment, but compensation in the form of a sum of money or property (diyat and irsy) is accepted if the guardian of the victim forgives the offender. In Malaysia both Hudud and Qisas offences are contained in the set of legislation known as the Syariah Criminal Code Enactment. In Kelantan the law is formally called the Syariah Criminal Code (11) Enactment 1993 and was passed on November 25, 1993. In Terengganu the Syariah Criminal Offences (Hudud and Qisas) Bill was passed on July 8, 2002.

2. What offences are covered in the Kelantan and Terengganu Enactments?

Six offences are recognised under the Enactment as Hudud offences, namely:

Sariqah (theft)
Hirabah (robbery)
Zina (unlawful carnal intercourse)
Qazaf (accusation of zina which cannot be proved by four witnesses)
Syurb (drinking liquor or intoxicating drink)
Irtidad or riddah (apostasy)

The second set of offences refer to homicide and bodily injury and listed under Qisas.

3. What are the punishments prescribed for the offences?

Syurb - is consumption of liquor or other intoxicating drinks. The act of consumption in itself regardless of whether a person is intoxicated by it, is punishable with whipping of not less that 40 stripes for first offenders, 80 stripes and imprisonment for repeat offenders.
Sariqah (theft) - is punishable by the amputation of the offender’s right hand. For a second offender, amputation of his left leg and for a third and subsequent offender imprisonment as deemed fit by the court. However the offender shall not be liable for the above punishments if amongst others, the value of the stolen property is less than a prescribed sum, the owner of the stolen property failed to take adequate steps to protect his property, the property is freely available or the property is valueless in Islam e.g. liquor or entertainment equipment.
Hirabah - For the crime of armed robbery, the punishment is:- death and thereafter crucifixion if the victim is killed and his or another person’s property is taken; or death if the victim is killed but no property is take; or amputation of the right hand and left leg if the victim is not killed or injured.
Zina - is categorised under the Bill as:-illicit intercourse by an unmarried person with another person the punishment for which is whipping of 100 stripes and 1 year imprisonment; and adultery; the punishment for which is stoning until death.
Qazaf - The Qur’anic injunction against qazaf is to prohibit the accusation of chaste women of zina (illicit intercourse). Under the Bill, any person who accuses another of illicit intercourse without bringing forth 4 adult male Muslim witnesses, is to be punished with whipping of 80 stripes. Section 9 specifically states that any person complaining of rape in a case where such rape is not proven shall be deemed to have committed qazaf. In relation to married couples, zina may be proven by unrebutted sworn allegation of a person against his/her spouse.
Liwat - is defined under the Bill as sodomy by a man with another person who is not his wife. Liwat is to be proven in the same manner as zina.
Irtidad or Riddah - The punishment for blasphemy or apostasy by an unrepentant offender is death and forfeiture of property.

4. What evidence is needed to prove Hudud offences?

Every offence except zina must be proven by the testimony of 2 adult principled male Muslim witnesses who have not committed any major sins nor continue to commit minor sins. Zina is to be proven by the testimony of 4 adult principled male Muslim witnesses. Zina can also be proven by pregnancy of or birth of a child by a woman not then married unless she brings proof to the contrary. In the event there is insufficient evidence for the purposes of meting out hudud punishments, then the offender may nevertheless be punished by the court with non-hudud punishments. This is known as ta’zir punishment.

5. Can Hudud punishment be reduced and adjusted?

Hudud punishment is mandatory. Section 50 of the Terengganu Enactment provides that hudud punishments may not be reduced, substituted, stayed or in any way varied. Nor can the offender be forgiven.

6. What is the difference in the notion of crime between Hudud and any secular penal code?

Under secular laws, an action is considered criminal if it brings about serious harm or death to another party or when there is victimization involved. The violation of private property rights, including bodily rights (as in physical assault and rape) is also construed to be a crime. Although Hudud and Qisas are informed by these premises, there are additional areas in the Islamic law which are outside the bounds of these justifications. For example, under secular law, a sexual relationship between consenting adults is not a crime as it does not bring injurious harm to another party. Drinking of alcohol is not a victimizing act, hence it is also not a crime. However, drunken driving is, as it can potentially cause serious harm to another party. The right to renounce one’s religion is also not a crime as it is considered a human right to religious freedom, with no repercussions of victimization. In contrast, Hudud law “criminalizes” all of these actions, namely, sex outside marriage, drinking of alcohol and the renouncement of the Islamic religion. Hudud proponents say that these laws are divinely ordained by God. However, the codification and formalization of these laws are mediated by human actions and subjected to human interpretations.

7. How can Hudud be subjected to human interpretations?

The hudud provisions have been formed through the opinions of jurists in Muslim jurisprudence. The methodology of interpretation that is used involves ijtihad (independent reasoning) and qiyas (analogy). Their views are further subjected to sanctions through a politico-legal process of ijma or consensus of the jurists or through majority opinion (jumhur). The founding of the four schools of jurisprudence by the four great imams (Abu Haniffa, Malik ibn Anas, Shaf’i and Hanbal) were all in the Abbasid period, stretching from the 8th to the 13th century, or 100 years after the Prophet’s death.

8. What other countries have a similar law?

Hudud laws were introduced in Pakistan in 1979 under the rule of General Zia ul-Haq. In Sudan President Numeiri introduced Hudud by replacing the old Penal Code of 1974 with the new Penal Code of 1983. In the new Penal Code of Sudan, Hudud offences such as adultery are unlawful and the punishment will vary for Muslims and non-Muslims and whether one was married or unmarried. In Nigeria the northern state of Zamfara was the first to introduce the Hudud law in January 2000. Nine other Muslim-majority states in Northern Nigeria have subsequently adopted the Hudud to a lesser or greater extent.

9. Is Hudud only applicable to Muslims?

In countries with a population that are not predominantly Muslim (e.g Nigeria and Sudan), the laws are not applicable to non-Muslims. In countries where non-Muslims are of very small minority or non-existent and where an Islamic state is established (such as in Saudi Arabia, Iran), Hudud offences and punishments are incorporated into the law of the land and apply to all citizens.

10. Is there a chance that Hudud may overstep the legal rights of non-Muslims?

In all likelihood it will. As Malaysia is a plural society and where the concentration of one ethnic community is not necessarily confined to one region or state there are bound to be clashes and overlaps in application. For example in any crime the victim and perpetrator may be of different religions. If the alleged rapist is a Muslim and the victim is a non-Muslim, there will be the question as to under what law the charge would be brought about. Under Hudud the alleged male perpetrator may stand to gain because of the impossibility of getting the testimonies of four Muslim male witnesses. Under Hudud, Muslims who commit robbery of property that is valueless in Islam e.g. liquor or entertainment equipment will have a chance of escaping any prosecution. In another worst-case scenario, such as in an incident of gang-rapes, where there are multiple perpetrators and victims (comprising Muslims and non-Muslims), eye-witness accounts of the rapes which may be offered by the victims would not be admissible as evidence as they may not be Muslim and male. In all of these hypothetical cases non-Muslims will stand to see justice taken away from them.

11. What effect will Hudud have on race relations?

The bleak scenario is that Muslim and non-Muslims will be forcibly divided not just in the cultural and social sense but in a legalistic sense too. A parallel legal system established exclusively for Muslims will lead to the enhancement of structural discrimination, where race and religion (and gender) can be legally invoked to justify unequal treatments and other unfair provisions in society. Eventually it will also lead to a geographical divide between Muslims and non-Muslims where one can expect an exodus of non-Muslims to more “non-Muslim” states or even emigration abroad.

12. What effect will Hudud have on gender relations?

Like race relations Hudud will also setback the struggle for gender equality in society. Many provisions in the Hudud discriminate against women. Women are not accepted as witnesses and women are also most likely to be prosecuted for slander if they are not able to prove rape. In cases of adultery, women on account of them being pregnant will immediately be charged for the offence while it will be impossible to charge the male partner because of the requirement of four male Muslim witnesses.

Evidence for rape is ocular evidence of four adult male witnesses or confession of the accused. The victim’s own statement has no testimonial value. Even if medical examination is taken and a sexual act has been proved to have taken place, the accused can still be acquitted. The woman is then convicted of zina. The onus is upon the victim to prove that she was not a consenting party to her rape. Even minors can be convicted of zina, unlike what is provided in the existing penal code, where consent of a minor is immaterial and statutory rape is applicable. In Pakistan, even twelve-year old victims of rape have received punishment for zina. In Pakistan today, there are hundreds of women in jail on charges of Hudud offences. This number is rapidly increasing and there is even a new jail in Larkana especially built for women.

13. Is Hudud law presently being implemented in this country?

Although the Kelantan State Assembly has passed the Syariah Criminal Enactment in 1993 it has yet to be implemented. So far nobody has been charged for the Hudud or Qisas offence.

14. Is the law constitutionally legal?

Criminal law is in federal hands. But the power to create and punish offences against the precepts of Islam has been assigned to the states by Schedule 9, List 2, Item 1. However, this power is still subjected to several restrictions. Syariah courts only have jurisdictions over persons professing the religion of Islam. Syariah courts also do not have jurisdiction in respect of offences “except in so far as conferred by federal law”, and also state authorities can only legislate for Islamic offences “except in regard to matters included in the Federal List”. As one legal expert Dr Shad Faruqi opines, this has made the Constitution “..hopelessly ambiguous”. He states that, “In Schedule 9, List 1, Item 4 it assigns the entire field of criminal law and procedure to the federal Parliament without specifying the areas permitted to the states.” As it stands now it appears that the states can enact laws for residual matters as khalwat, zina, drinking, not fasting or missing Friday prayers. But in the last two decades the state legislatures have also interpreted their powers expansively by enacting laws against homosexuality and apostasy. Law on apostasy is nevertheless a violation of the constitutional guarantee of freedom of religion in Article 11. Because of the ambiguous nature of the Constitution and irregular precedence set before, there is no clear legal opinion as to whether the Kelantan and Terengganu Enactments are outright unconstitutional. Until and unless the Hudud is enforced and challenged on constitutional grounds there will be no basis to conclude on the validity or invalidity of the law.

15. What is the part in Hudud which violates the principles of the Malaysian Constitution?

Article 11 is interpreted to mean freedom of religion and therefore is supposed to be a guarantee against prosecution on the basis of choice of religion. Article 8 provides that every citizen is equal before the law, hence the discriminatory nature of the Hudud against non-Muslims and women can be interpreted as being unconstitutional. Hudud also regulates and controls private and consensual activities unlike secular law which generally does not legislate on “private matters”, especially on activities that are not injurious and “victimizing”. Hudud also specifies punishments that cannot be substituted or lessened at the discretion of the judge. There is no such finality in secular law as law reforms are an ongoing concern, and adjustments are made in accordance with changing place, time and current sensitivities.

16. Is there a difference between a ‘PAS’ Hudud and an ‘UMNO’ Hudud?

It will be hard to imagine the difference between a “PAS” Hudud and an alleged “UMNO” Hudud. Perhaps in the UMNO case, the standards and requirement of evidence will be modified so as not to appear too gender-biased and discriminatory against non-Muslims. Perhaps certain offences such as drinking and the renouncement of Islam (apostasy) will not be subjected to harsh punishments, but with more emphasis on “forced rehabilitation”. Until UMNO is prepared to present its own version of the Hudud, we cannot be sure that it will be “more just”. Whatever it is, Hudud in whatever form is already a manifestation of an imminent parallel legal system aiming to separate the rights of Muslims from non-Muslims. In the worst-case scenario all citizens will be subjected to the sovereignty of one (most likely, Islamic) law. Ironically, in the best-case scenario this may lead to the creation of a non-Muslim nation alongside a Muslim one. We may be heading for a constitutional crisis if this delicate issue is not handled decisively.

17. What is to be done? It will be difficult to repeal any law once passed. The strategy of stalling the implementation of Hudud (in the Kelantan case) is only temporary. If PAS manages to win the overwhelming support of the Malay electorate there will be less of a reason to postpone the implementation of the law. On a long-term basis the struggle to repeal Hudud law must involve the struggle to repeal all draconian and unjust laws, whether passed under religious or secular guises. All laws that violate the principles of human rights and equality must be abolished. The movement to institute human rights is not necessarily western-oriented. It is as much a cultural need to want human dignity to be protected as it is a universal obligation to appreciate the rights of a community to cultural and religious practice. However, ultimately we must recognize that the greatest rights worth defending are rights that are invoked purely on the basis of us being humans. Which means equal treatment, equal access to opportunities and equal dignity for all, regardless of religion, race, class, nationality and gender. The only viable movement in this direction would be to restore our democratic institutions and push for a genuine regime of human rights.

Its been long time I have not write anything here, its not because I don’t want to write, its just because the people who support certain politic party is getting much racist and ‘munafiq’. Just really hurt when someone say bad thing about other race. And my race is supreme than your race. Those entire allegations will make our country going backward.

Another things is going bad are about religion. We have less than 70% of the population is Muslims. If you compare our neighbor Indonesia, has more than 90% of the population are Muslims. Indonesia is not like Malaysia in many ways. Indonesians don’t insult each other religion or anybody claim theirs is more supremacy.

In fact they lived more harmony than us. I know because I stay 8 years there. I embraced Islam there. Islam there is more beautiful over there in many ways. If I was in Malaysia all the while, I’m sure I won’t become a Muslim. Maybe I will be scared and confuse like most of my non Muslim friends.

Lot of you will say, if you like Indonesia so much, why not go and stay there. Well if I think of doing that, it’s the same as running away from problems rather than solving it. People in Malaysia need to change their mindset. If this race and religion still a problem here, I’m pretty sure no investor will come here and the remaining foreign investor here will go away to.

We can solve this by doing an Act or rule that prevent people talking such things like the Act in Britain. We should also abolish the entire old act, such as sedition act. We must educate our children about racial harmony starting from the kindergarten days.

Now the fact is Indonesia have a better economic and FDI then Malaysia. Indonesia will become economic power in 10 – 15 years time even though they have lots of natural disasters. All this because they are more harmony and peaceful country. Just think if you are investor where you will go if you have to choose between Indonesia and Malaysia. Come on la, even Air Asia already move there. A Malaysian giant company. What a fucking shame to our government, it’s like slap in the face.

Change is what we need. The people thinking have to change. And the most important of all we need to change the government. Change man, please change. Tolong ubah!!!!
Well I’m not a supporter of Pakatan Rakyat (PR) but what choice I have rather than I give my vote to them. If Barisan Nasional (BN) changes, of course I will vote them. But seem like they only saying to change, but still not doing it. They don’t have strong leaders. Just see our Merdeka Day slogan, song and logo. All are not good. You know what I mean.

Controversial book seized by Islamic authorities

Enforcement officers from the Federal Territory Islamic Religious Department (Jawi) last night confiscated seven copies of the book, ‘Allah Liberty & Love - Courage To Reconcile Faith & Freedom’ by controversial author, Irshad Manji, as the content is deemed to be contrary to Islamic teachings.

Chief senior assistant director of Jawi's enforcement division, Wan Jaafar Wan Ahmad said the raid, involving eight officers, was conducted at 8.45pm on a bookshop in a well-known shopping complex in Bangsar.

"We received information that 500 copies of the translated edition of the book have been printed and available in the market nationwide, and we are still tracking them," he told reporters.

The Uganda-born Irshad, who has Canadian citizenship, has also created controversy by supporting the lesbian, gay, bisexual and transexual movement.

Wan Jaafar said following the seizure, the case would be investigated under the Federal Territory Syariah Offences Act for publishing copies of a book that ran contrary to Islamic teachings and violating the sanctity of Islam.

Irshad was in Malaysia last week to launch the book.

Controversial Uganda-born Canadian author Irshad Manji hit out at certain muftis and clerics, including those in Malaysia's National Fatwa Council, which she said are trying to impose their own mores and dogma upon the populace.

"Muftis, imams and clerics of various stripes love to tell us what we are to believe; in the course of telling us this, they also want us to adopt a particular identity.

"What they will never tell us is that they expect us to adopt their identity," said the 44-year-old New York University (NYU) professor in an exclusive interview with Malaysiakini in Kuala Lumpur yesterday.

She was responding to a question on the recent National Fatwa Council edict forbidding Muslims from taking part in certain demonstrations, particularly targeting the Bersih 3.0 pro-electoral reform rally.

Manji argued that "good believers" cannot be expected to uncritically submit to the religious scholars without question as the scholars themselves too are humans and neither perfect nor divine as Allah is.

"Here's some breaking news for these muftis. You're not God. There is only one God and that job is not vacant.

"Put all your fatwas out as you wish, but your fatwas do not hold divine authority, and neither do you," said the successful author and film-maker.

Manji believes that The Quran - which she posits is the only divine document and sole guiding light of the faith - instead encourages Muslims not only to question but to seek out the truth on their own and think for themselves.

Such, she claimed, was the tradition prevalent in the heyday of Islamic civilisation until the slide into our current situation where mullahs and ulamas claim to know everything and dictate all to a public which is expected to obey without question.

'They don't have humility'

"I think that if more and more Muslims understand that there is a difference between the ulama and Allah - just as I realised at the age of 14 that there is a difference between the madrasah and Allah - we would be more willing to give ourselves the permission to do exactly what the Quran asks of us, which is to think for ourselves in order to deepen our faith and realise the humility that these fatwa-flinging mullah clearly don't have," argued the feisty Islamic reformist.

Earlier this month, the National Fatwa Council declared that it is haram (not permissible) for Muslims to participate in any gathering or demonstration that is unproductive and is against the law or causes disturbances in the country.

Its chairperson Abdul Shukor Husin said the council viewed seriously this issue as some Muslims had previously resorted to rioting during street demonstrations.

The council's decision, however, was met with stringent criticism from PAS spiritual leader Nik Abdul Aziz Nik Mat, who lambasted that the body for not looking at the issue clearly, while others quoted influential Egyptian Islamic theologian Yusuf al Qaradawi, who maintains that rallies or actions to fight against tyranny is encouraged in Islam.

Manji is in Malaysia to launch the Malay translation of her latest book ‘Allah, Liberty & Love'. However, her events and several speaking engagements had to be cancelled because of "security concerns", protest notes and alleged "pressure" from the authorities.

PAS - which ironically agree with Manji's criticism of the fatwa council on Bersih 3.0 - and several conservative Muslim NGOs have spoken out against her presence in Malaysia, claiming that her very liberal stance on Islam is dangerous to the faith of local Muslims.

Her first book, the international bestseller ‘The Trouble with Islam Today: A Muslim's Call for Reform in Her Faith' has been banned in Malaysia.
As evident in her books and an Emmy-nominated PBS film, ‘Faith Without Fear', her work mostly challenges accepted notions in Islam, in the belief that education and the freedom to think is paramount and not the indoctrination, which she believes is commonly practised in most religious teachings.

Medical Insurance @ Medical Card

On the subject of medical insurance, to be fair, most people realize that having medical insurance is important because medical treatment can be costly if one were to seek treatment at private hospitals. In Malaysia, we are still very fortunate because we can still relatively easily seek treatment at government or public hospitals which are heavily subsidized – unlike people in developed countries such as in the U.S., U.K., Europe, Australia, Japan, etc. In developed countries (which we as a country aim to attain by year 2020), whilst public funded medical facilities are available, they are not so prevalent and thus are less easily accessible for those living in areas where there are none. Most people in these countries will therefore have to rely on getting treatment at private medical facilities, but because of the high costs involved most will have no access to treatment unless they are covered by some form of medical insurance.

Luckily for us in Malaysia, we are still able to have access to treatment at very low cost at government medical facilities. The downside however is having to contend with the huge crowds seeking treatment at Government hospitals and the consequently long waiting time. This is unavoidable simply because government facilities are affordable, and therefore most people, rich and poor alike, will want to seek treatment there – the rich if they didn’t mind the wait, the poor because they had no choice.

To give an example of this at our government hospitals, a few years back, there was a case of a 76 year old man who had a fall and fractured his pelvis and thigh bone (femur). Being a government pensioner, he enjoyed (almost) free medical treatment at government hospitals. (Note that even for non-civil servants the costs of medical treatment are just nominal and still very affordable to most.) Naturally, the man was admitted into a government hospital, a well known one with excellent facilities. The doctor who examined him ordered surgery to repair the fractures. In the meantime traction was administered for his fractured leg in order to prevent further injury. An appointment for surgery was set for about two weeks or so depending on availability. This was unavoidable simply because with the limited facilitiesavailable doctors had to ensure that those with more critical or life threatening injuries were given preference for surgery. Now having to lie on a hospital bed (thankfully this hospital was air-conditioned) with one leg immobilized by traction and with as little movement as possible permitted for two whole weeks can be awfully agonizing! Needless to say, if one can’t afford to seek treatment and surgery elsewhere, there will be no choice but to continue in that state and wait the two weeks or so out.

Fortunately for the man, his family could afford the additional costs of about RM20,000 to seek treatment at a private medical facility, and off he was transferred to one close by. Surgery was carried out the day after and just about a week later, he was discharged from the private hospital.

This is but an example of a relatively minor problem which involved about RM20,000 in treatment costs. What if it were something more serious and the costs had been higher? Say, RM50,000 or RM100,000 or even RM200,000? With the double-digit rate of inflation in costs of medical treatment, it would not be surprising at all if a procedure which today costs RM50,000 may very well cost RM209,000 in 15 years’ time (just using an inflation rate of 10% - statistics for Malaysia from the World Health Organization website show the rate to be higher). See the table on current costs of certain medical procedures – note however, these costs do not take into consideration costs of hospitalization, ICU, etc. yet.

If it costs RM200,000 for a treatment that we need, do we have the financial resources to pay for it? If not, what are our alternatives?

Fortunately, for those who are in employment generally would enjoy some form of coverage from their employers. However prudence dictates that we ought to find out what and how much are we covered for exactly. In fact, not too long ago, a very senior executive of a very large public listed conglomerate discovered to his own dismay that his medical coverage entitlement had a limit of just RM30,000 per annum – after he had undergone a heart bypass operation which had cost RM65,000. The poor chap had to pay the balance (of RM35,000) from his own pockets – what a way to learn.

To add salt to the wound, the man was retiring the following year. Double jeopardy for him in that he now had RM35,000 less in retirement funds as he had used part of his retirement funds for the surgery, and secondly, the prospect of him qualifying for medical insurance upon his retirement has now become pretty slim. Even if he did qualify, the premiums would have been substantially higher because of his age and health condition, and besides that it would have been very likely that his coverage would have a permanent exclusion on treatment for heart related diseases which is now a pre-existing condition.

Suffice it to say therefore that people who are currently covered under their employer’s Group Hospitalisation and Surgical Policy will still need to consider the following:

As mentioned above, we’d need to find out what and how much are we covered for – to make sure the coverage is adequate, and whether it is in our employment contract that the employer will pay for any medical expense above the insured amounts.

Getting a medical insurance policy after retirement may perhaps be one of the worst approaches simply because we might not qualify for medical insurance when we retire – there have been lots of such cases. Secondly, even if we are of excellent health, the premiums will be very high, and surely, we will not want to incur such high expenses when we are retired.

If I were to get a separate medical policy of my own, wouldn’t it be a waste of my money because surely I can’t claim from my employer’s as well as from my own medical policies. While that is correct, today there are medical insurance policies which are designed to have high deductibles (that is, the first amount of the expense that we will pay for ourselves) and therefore have much lower premiums. The large deductible will mean that the first layer of expense can be covered by our employer’s policy leaving only the amounts exceeding the limit to be claimed under our own policy. Further, some of such medical policies even allow for the deductibles to be removed when we retire – i.e. the insurer guarantees that we will continue to be insured when we retire.

Determining how much is adequate for a medical insurance policy can be pretty tricky. A sum of RM100,000 might be adequate today for many types of medical treatments, but would the same be adequate in the years to come? There are medical insurance plans today that have a benefit called “annual limit waiver” which effectively allows one to have access to the high lifetime limits, usually 10x the annual limits. For instance, if one had a medical insurance plan that had an annual limit of RM50,000, the lifetime limit would be RM500,000. In this case, therefore, if the person had a medical treatment that costs., say RM250,000, he would still be able to claim for these expenses as they would still be below the lifetime limit. Very useful benefit to have, but usually the premium for this benefit can be very high especially for those in the older age category.

Now, in general, whether we are covered by our employers or not, we need to ask ourselves:

Am I in the financial position to self-insure? To answer this question, we can ask ourselves; have I set aside a reasonable amount of money to cater for my medical expenses – say, have a sum of at least RM100,000 today not to be used for anything else?

If I can’t even afford the insurance premium today, what will I do if I am faced with a huge medical bill tomorrow? This is of course a tough question. Some will just throw their hands in the air and say; well, that’s just my fate. Only God can help…. true, but remember, God helps those who help themselves.

EC chief, deputy admit they ‘could have been’ Umno members

KUALA LUMPUR, April 27 — Both the Election Commission (EC) chairman and deputy chairman have admitted that they could have been Umno members a long time ago, but stressed that it did not affect their ability to carry out their professional duties.

Chairman Tan Sri Abdul Aziz Mohd Yusof and his deputy Datuk Wan Ahmad Wan Omar took great pains to point out that it (being Umno members) happened a long time ago, and that they were inactive members, having not paid any fees or attended any party meetings.

“I can’t remember when and where I once became an Umno member, anyone could have put my name in after I graduated from university in the 1970s.

“I can’t even remember which branch (I was an Umno member in) because after I finished my studies I lived in several areas — Segambut, Selayang and Ampang. So if anyone had named me (as an Umno member) I don’t know which branch,” Abdul Aziz told Sinar Harian.

Wan Ahmad confirmed that he was an Umno member, but like Abdul Aziz, he too claimed he could not remember which Umno branch he was registered in.

When asked whether he was still an Umno member, Wan Ahmad said: “I don’t know and have never bothered to find out. I am not a politician, I am a government servant and this has stayed till this day. I am speaking the truth.”

Wan Ahmad stressed that all government servants were barred from being active members in any political party, and that they had to relinquish their government posts if they wanted to do so.

“I am still in service (as a government) servant) and that it proof that I am not an active (Umno) member,” he said.

Similarly, Abdul Aziz said that being an Umno member did not make him biased in any way when it came to running the EC.

“I’ve never felt tied down in all my years here (in the EC),” he said.

Both the EC chief and deputy chief were accused yesterday of being Umno members, with a senior PKR official alleging that he had evidence of their membership in the ruling party.

The duo have come under intense scrutiny in the past year over claims of fraud in election practices and the electoral roll as federal polls draw near.

“I know Aziz’s membership number and I have information on which branch Tan Sri Aziz and his deputy are from.

“This is the only EC in the world where its chief and his deputy are officially members of a party that contests elections,” Sinar Harian quoted PKR secretary-general Datuk Saifuddin Nasution as saying.

The Machang MP then challenged the duo to prove they were not members of the senior party in the ruling coalition, failing which he would reveal the branches to which he alleged they belong.

He also told the Malay-language national daily that Tan Sri Pandikar Amin Mulia, who quit the Kota Marudu Umno when he was appointed Dewan Rakyat Speaker in 2008, had informed him that the EC’s top two officers were still party members.

The EC was heavily criticised in the lead-up to Bersih’s rally for free and fair elections on July 9 last year in which tens of thousands flooded the streets of the capital in chaotic scenes that saw over 1,500 arrested, scores injured and the death of an ex-soldier.

Widespread condemnation of the Najib administration’s clampdown saw Putrajaya make major concessions including announcing a bipartisan Parliamentary Select Committee to look into improving the electoral system.

During the committee’s six-month tenure, Pakatan Rakyat (PR) accused the EC of not being committed to reforms and eventually rejected the panel’s findings.

Early this month, Bersih, a coalition of 84 civil societies, also announced a sit-in protest at Dataran Merdeka for tomorrow, saying the findings of the select committee were disappointing and did not meet its demands for electoral reform.

A 42-year-old mechanic has claimed that he was stopped and assaulted by eight Rela personnel after filling petrol in his car in Kajang four days ago.

On top of that, when the Rela officers turned him in to the Taming Jaya police station, he was assaulted by four police personnel who allegedly wanted him to admit to car and lorry theft.

S Mogan (left), of Balakong, said his ordeal began about 5am before he was to meet a friend who had sought his help at his workshop and house.

“I decided to fill up my car with petrol as I wanted to send my children to school soon after. As soon as I filled up, I was stopped by the Rela personnel who accused me of car theft,” he said at a press conference today.

“They searched my Nissan Sunny car and saw that I had many spare parts. I told them that I am a mechanic but this was met with one of them using a metal rod to hit my left leg. Then the other Rela personnel assaulted me, punching and kicking me on the body and in the back.”

Mogan said he was then taken to the Taming Jaya police station by the Rela personnel where they told the police that he was a drug addict.

There, the police personnel allegedly assaulted him with a water hose and hit him on the feet, to get him to confess to stealing cars and lorries.

“At one point, one of them pointed a gun at my head, threatening to kill me if I did not confess. The police officers showed me vehicles (outside the police station that they said) had been stolen. (They said the cases) remained unsolved and (that they) would put the blame on me to have the cases closed.

“They continued to beat me on the feet and shouted verbal abuse. I was in severe pain as I suspected that my left leg had been fractured by the use of the iron rod.

“When they pointed the gun at my head, I told them to shoot me as I could not stand the pain. They wanted me to sign a blank letter but I refused.”

Mogan, who said he was held at Taming Jaya from 6am to 9am, was taken to the Kajang district police station where a police officer put him through a urine test.

Mogan, who is married and has three children, said the officer also checked his background and noticed that he does not have a criminal record.

“As the urine test proved to be negative and as I do not possess any criminal record, the officer decided to release me. He told me to seek medical treatment and to come back to lodge a police report afterwards.”

Losses of RM5,000

That afternoon, after seeking medical treatment, he went to retrieve his car from the Taming Jaya police station and noticed that the spare parts, spare battery, alternator, and tools were missing.

“I had RM1,300 in my wallet, which was given to the police, but the money is missing. My Nokia handphone and other spare parts like spark plugs are also missing. I estimate my loss to be in the range of RM5,000,” he said.

“I have lodged a police report soon as I wanted the police to investigate the matter. There are receipts for all the items at my workshop. If the items are from stolen vehicles, come and prove it to me.”

He claimed that his injuries have caused bruises all over his body, a fracture to his left leg, and slight difficulty in hearing.

Mogan said a police officer had taken photos of his injuries yesterday.

“I am scared as one of the police officers in Taming Jaya warned me that they will watch me closely. I fear for my life,” he said.

Hindu Rights Action Force (Hindraf) leader P Uthayakumar (right), who was present, said there has been a concerted effort by the authorities to pick up Indian Malaysians and to try to force confessions out of them to resolve crime.

“Hindraf does not condone crime but we are concerned if the Rela and police are going about this in such a way as to force a confession. This is illegal and worrying and we want the inspector-general of police (IGP) and the attorney-general (AG) to investigate the matter,” he said.

“For this reason, I have written to the AG and IGP today to investigate this allegation. Mogan does not have a criminal record as verified by the Kajang police but why subject him to such treatment?”

Uthayakumar said Hindraf wants to see the formation of the Independent Police Complaints and Misconduct Commission as proposed by former Chief Justice Mohd Dzaiddin Abdullah.

60 Muslims arrested for gambling in Rembau
(Bernama) - REMBAU: Sixty Muslims who patronised a computerised gambling premises near Taboh Naning, here, were detained in a raid, early this morning.
Negeri Sembilan Islamic Religious Affairs Department (JHEAINS) operations unit chief Ahmad Zaki Hamzah said 41 computers and RM6,000 in cash were also seized in the raid.
He said those detained were aged between 20 and 60.
"They were taken to the Rembau district police headquarters to have their statements taken. They were then released on bail and will have to return on a specified date to help in investigation," he said after the raid, here, today.
Ahmad Zaki said they would be charged under Section 79 (a) of the Negri Sembilan Syariah Criminal Enactment 2004 which carries a RM3,000 fine or two years jail or both.
He said four caretakers of the premises were issued with letters ordering them to turn up at the JHEAINS enforcement unit on a specified date to help in investigations on the case.
Members of the Negeri Sembilan National Security Council and police from the State Police Contingent Headquarters also took part in the operation which started at midnight and ended at 5am.

Widow goes from mosque to mosque for shelter
(The Star) - A HOMELESS woman has been staying in over 30 mosques in the Klang Valley for the past two years, reported Harian Metro.
The woman, known as Fazilah, said she had been taking shelter in mosques since her husband died in 2009, adding that it was safer than sleeping in corridors.
She said almost all the mosques in Kuala Lumpur and several government hospitals had become her “homes” at one time or another, adding that she had become used to the situation.
Fazilah, 59, said she lived like this because she had no means of getting enough money to support herself and her 34-year-old disabled son, who is being cared for by her sister.
“In my heart, Allah knows how hard it was for me to make that decision. I have been asking for alms and sheltering in mosques,” she said, adding that her four other children were also being cared for by her ex-husband.
She said she was trying to get a low-cost house from Kuala Lumpur City Hall with the RM500 aid from Baitulmal.
“Until then, I will keep wandering from mosque to mosque as being there calms my heart. However, I hope to get my own home one day because I don't want to burden anyone,” said the former civil servant, whose squatter house was demolished in 2002 by the Selayang Munincipal Council.

Bedridden woman starves to death after hubby dies
(The Star) - A 74-YEAR-OLD bedridden woman starved to death after her husband, who had been taking care of her, collapsed and died at their home in Hong Kong, China Press reported.
The retired couple had been living alone after their son moved out. However, he would return to their home to see them once in a while.
On Tuesday, the son was shocked to find his parents dead after he came back from Taiwan.
His mother's body was on the bed while her 76-year-old husband was found on the living room floor.
Police believed that the man had initially fainted but died without proper medical care. His wife starved to death a few days later.

Ibrahim Ali, Hasan Ali, Baba Ali, and all the sons and daughters of the Alis all over Malaysia are foaming at the mouth on what they allege are Christians trying to convert Muslims to Christianity. True or not, I really don’t know. But even if it is true, so what? If they no longer believe in Islam (or have become an atheist who no longer believes in God) that is their problem, not ours.
Actually, those who are Muslims by name only but are no longer Muslims at heart are not but a few. Many fall into that category. Of course, those who still believe in God and feel that Christianity is the correct religion would want to denounce Islam so that they can become Christians. Those who do not have the guts to do that, as they know it will attract controversy, and probably detention as well, quietly become Christians without telling even their closest family members.
How do you know how many Muslims have left Islam? By the couple of thousands who have applied to the National Registration Department to change their Muslim names to Christian names? By the ten or twenty who attend ‘Christian events’? Or by the millions who no longer live the adeen (lifestyle or ‘way’) of Islam?
If a Muslim is defined by his or her lifestyle, then there are a very few Muslims left in Malaysia. Islam has to be about akidah. And if you do not have akidah you are not a Muslim, never mind if you were born into a Muslim family and carry a Muslim name on your identity card. You can’t be born a Muslim. You can’t be a Muslim in name. You have to be a Muslim at heart.
And in that spirit there are very few Muslims left in Malaysia. And if I need to explain to you what a Muslim at heart means, send me your bank account details and I will send you enough money to buy a gun so that you can shoot your brains out.
I have been detained in police lockups. I have been to prison. And the people I meet inside those places are ‘Muslims’, the majority of them. Some, such as rapists, even wear white skullcaps and never miss their five-times a day prayers.
Why worry about ex-Muslims who no longer believe in Islam and wish to leave Islam or wish to become Christians? What about those ‘true’ Muslims who never miss their fasting or prayers but who violate every Islamic rule in the book?
Why are Muslims so preoccupied with numbers? This is not a numbers game. This is not about which religion can attract the most number of followers. It should be about the quality of the practitioners. And that is one thing that Islam lacks, Muslims of quality who live the adeen of Islam.
Cock fighting is a favourite pastime in the Malay-Muslim heartland of Terengganu and Kelantan. Cock fighting is basically gambling. AIDS is critical in Kelantan. The drug problem is critical in Terengganu. And so on and so forth. And the majority under detention and in prison are Malays-Muslims.

What are those rich Malays-Muslims who live in places like Damansara, Bangsar and Taman Tun and who own RM20 million apartments in London doing about this? Why must things like this happen in today’s day and age?
Then read about an old Chinese couple in Hongkong dying without their children even knowing about it. Sure, it is Chinese culture NOT to give out money in white envelopes. Is it Chinese culture to let your parents die of starvation?
Anyway, don’t feel too bad about it. This also happens in the UK. It also happens in America. There are 100,000 homeless HOUSEHOLDS in the UK. In America it is 500,000.
We are now experiencing a very cold winter. Since yesterday we have been seeing ice in the UK. Tonight it is going to snow and we are expecting below zero temperatures. The government has just announced that many homeless people and old people living alone are going to die of cold. By this weekend the mortuaries are going to be full.
All this talk about Islam and Chinese culture disgusts me. Why not we talk about how to be good Muslims rather than how to prevent Muslims from leaving Islam? Why not we talk about how to help the homeless and old folks living alone who are going to die over the next 48 hours because they are being neglected rather than whether the envelope should be white, red, green or pink?

Minister says being gay is unconstitutional

KUALA LUMPUR, Nov 21 — A federal minister said today it is unconstitutional for a person to be homosexual in Malaysia, but did not back up his claims with any provision.

There are no provisions in the federal constitution which directly mention the sexual preference of individuals. Minister in the Prime Minister’s Department Datuk Seri Jamil Khir Baharom (picture) however cited sections 377(a), (b), (c) and (d) of the Penal Code to justify his argument.

The sections relate to carnal intercourse against the order of nature. “In reality, in the country’s constitution it is not allowed, including sections 377(a), (b), (c) and (d) which prohibit sexual relations between two men,” said Jamil, who is in charge of Islamic affairs and head of the Malaysian Department of Islamic Development (Jakim).

Jamil’s remarks were in response to a question about the banned “Seksualiti Merdeka” event, during an interview with Umno-owned Utusan Malaysia.

The minister said Malaysians had a responsibility to unite and stop any promotion of homosexual, lesbian or bisexual practices.

Jamil said his understanding of the event was that its organizers wanted “freedom” of sexual orientation for lesbians, gays, bisexuals and transsexuals (LGBT).

“This is a deviation from society’s norms. We should help them go back to the right path, not acknowledge their practices,” he added.

Gay rights were a hotly debated topic here recently after a police clampdown saw organisers of Seksualiti Merdeka call off the festival early this month.

Seksualiti Merdeka, a movement championing the freedom of sexual orientation and gender identity, was banned by authorities despite having held its festival annually since 2008.

Human rights activists, including Datuk Paduka Marina Mahathir, lashed out at media reports describing the event as a “free sex festival”, and threatened to sue if the matter was not clarified.

Four other activists, including electoral reform movement Bersih 2.0 chairman Datuk Ambiga Sreenevasan, were also questioned by police over their involvement in the festival that outraged several Muslim groups.

The ruling Barisan Nasional’s (BN) Chinese party said its research showed most Malaysians outside the country only received information from questionable news sources, which it said may not reflect the “true situation” ongoing in the country.

“The future of Malaysia should be determined by those who have faith and still remained in the country,” Datuk Ei Kim Hock, a member of the MCA central committee who headed the party’s team told the Parliamentary Select Committee (PSC) on electoral reform today.

ADUAN MENGENAI CARA-CARA KENDALIAN PESAKIT DI POLIKLINIK TAIPING SEMASA PENGAMBILAN DARAH

Peristiwa ini berlaku semalam 8hb November 2011, sekitar pukul 5.30 petang. Ibu saya Meenakshi mengalami sakit demam, selsema dan batuk , dan saya telah membawa ibu saya untuk diperiksa ke Poliklinik Komuniti Taiping, Jalan Tupai, Taiping. Selepas diperiksa, ibu saya diarah oleh Doctor Amutha (doctor bertugas) untuk memeriksa darah. Pada masa itu pesakit hanya ada 10 orang saja.

Dibilik pengambilan darah pegawai yang bertugas adalah (nama-nama diambil dari pintu bilik yang memaparkan nama pegawai bertugas), PPP Ahzam, PPP Mansor Shah dan PPK Aziah Hassan Basri. Ibu saya telah diambil darah langsung di pergelangan tangan tanpa dicuba di lengan tangan. Ibu saya protes tapi tak diendahkan langsung. Pegawai itu langsung tak minta izin untuk diambil darah dipergelangan tangan. Adakah ini polisi jabatan kesihatan untuk ambil darah sesuka hati anda? Pegawai itu tak pandai ambil darah dan tercucuk apa entah dan pagi tadi tempat ambil darah itu bengkak. Takkan ambil darah pun boleh bengkak, macam mana pegawai itu ambil. Sekarang yang tanggung sakit ialah ibu saya. Kalaulah ini ibu kamu, adakah anda akan layan begini?

Selepas diambil darah ibu saya diarah datang pada 8.30 malam untuk diambil darah kali kedua. Waktu itu saya pun hairan kenapa nak ambil dua (2) kali, saya ingat ini prosidur baru kali. Kerana saya sibuk dan ada urusan, saya pun langsung bawa ibu saya pulang. Pada pukul 8.00 malam saya pun bawa ibu saya untuk diambil darah kali kedua. Pengambilan darah pada masa ini berjalan lancar. Pegawai itu suruh ibu saya bawa sampel darah itu ke Lab(makmal), pada masa itu pegawai lab suruh letak sampel darah di rak di meja dan menyuruh ibu saya datang seminggu lagi untuk keputusan dan diperiksa doctor. Ibu saya beritahu saya mengenai hal itu. Saya pun hairan ibu saya datang untuk demam, selsema dan batuk, tapi disuruh pulang tanpa ada ubat.

Saya pun pergi tanya pegawai lab apa hal, doctor nak keputusan sekarang. Dia suruh saya pergi ke tempat pengambilan darah balik dengan sampel darah itu. Sekarang saya dah tahu bahawa pegawai yang ambil darah itu telah buat kesilapan dalam membaca slip pengambilan darah. Pegawai itu ambil sampel darah itu dan buka botol darah itu dan tuang ke botol lain dan beri balik kepada saya untuk bawa ke Lab. Apakah prosidur ambil darah dari botol lain dan tuang ke botol lain itu betul? Bukankah darah itu tak boleh dipakai lagi dan harus ambil darah baru? Pegawai itu meminta maaf kerana berlaku kesilapan, kesilapan itu berlaku kerana ramai orang. Satu alasan yang saya tak boleh terima. Kalau tak boleh kerja dengan betul dalam keadaan ramai orang kerjalah di klinik swasta. Jangan susahkan orang ramai.

Sekarang, saya nak tanya kepada tuan:-

1. Kerana pegawai anda cuai pergelangan tangan saya ibu saya bengkak, siapa nak tanggungjawab?

2. Kerana pegawai anda cuai baca slip, saya dan ibu saya terpaksa datang dua(2) kali ke klinik, siapa nak bayar wang minyak saya dan masa saya?

3. Masa saya terbuang kerana pegawai anda dan saya terpaksa bawa ibu saya yg tua dan sakit ulang alik ke poliklinik, apakah perasaan anda kalau ini ibu anda?

4. Saya nak tahu tindakan yang akan diambil kepada pegawai-pegawai yang tidak bertanggungjawab ini.

5. Negara kita nak maju tapi pegawai-pegawai anda bermentaliti negara dunia ketiga.

Saya berharap dengan aduan ini anda dapat memperbaiki layanan dan urusan di Poliklinik Komuniti Taiping. Saya selalu ke Poliklinik Komuniti Taiping dan Hospital Taiping, selama ini saya tak pernah nampak perkara seperti ini berlaku. Saya mendapati layanan pegawai dan doctor di sana semua bagus dan cekap dalam menjalankan kerja. Saya berharap Tuan dapat menjaga dan meningkatkan mutu perkhidmatan di Poliklinik Komuniti Taiping.

Muhyiddin: BN Has Never Disappointed Indian Community

MUAR, 28 OCTOBER, 2011: The Barisan Nasional (BN) government, which has ruled the country ever since the nation gained independence 54 years ago, has never disappointed the Indian community by implementing various programmes for their benefit, said Tan Sri Muhyiddin Yassin.

The Deputy Prime Minister, who is also the BN deputy chairman, said through thorough planning, the BN government had succeeded in resolving the various problems faced by the Indian community in this country.

"Only the Barisan Nasional is capable of resolving the people's problems and not the opposition, because they (the opposition) are only quarrelling among themselves to achieve their own agendas.

"How can they (the opposition) resolve the people's woes if they can't even settle their own problems," he said at a Deepavali celebration for the Pagoh Parliamentary constituency at Bukit Pasir, today.

Muhyiddin, who is also Umno deputy president and the Member of Parliament for Pagoh, said this to about 2,000 people who attended the event at the Taman Bintang Emas, here.

The Deputy Prime Minister said although the Indian community in this country constituted only between six and seven per cent of the total population, the government had never ignored them.

"This is because the Indian community are also Malaysian nationals and the Barisan Nasional government has done everything it can to look after their interests by providing various assistance to them," he said.

Muhyiddin said the government had set up a committee at the cabinet level, chaired by Prime Minister Datuk Seri Najib Tun Razak himself, to assist the Indian community.

At the Pagoh parliamentary level, he said, the BN had provided various aid to the local Indian community such as the construction of Sekolah Jenis Kebangsaan Tamil, temples and others.

At the function, which was also attended by Johor MIC chairman Datuk K.S Balakrishnan, Muhyiddin presented aid to the poor in the Pagoh parliamentary constituency comprising 250 Indians, 25 Malays and 25 Chinese.

Ibrahim Ali disappointed by Himpun turnout

KUALA LUMPUR, Oct 26 – Perkasa president Datuk Ibrahim Ali has expressed
embarrassment over the poor turnout at the Himpunan Sejuta Umat rally, despite the Malay
rights movement earlier shrugging off the low attendance.

Only 5,000 people filled the 100,000-seat Shah Alam Stadium where the

rally against the alleged Christianisation of Malaysia took place last
weekend.

“Even as late at 4pm, there were fewer than 10,000 people... I was

embarrassed as a Malay and a Muslim. Where are our Malays?

“But when there’s a conference or an assembly, why this, why that?”

Ibrahim said in his winding-up speech at the 2nd Perkasa general

assembly here.

The Malay rights leader lamented that Malays were very good at asking

for things but were reluctant to put their money where their mouth was
when time came for action.

“What is our sacrifice? How far are we willing to go?” he said.

Ibrahim added that if Malays remained too passive in voicing their

objections despite being “under attack from within and without”, they would suffer the same fate as Singaporean Malays and Malays in Penang, whom he said were marginalised.

Himpun was organised by various right-wing religious groups calling for Muslims to rise up and fight the “challenge of

Christianisation” to Muslims in Malaysia.

The mass rally was mooted following the controversial August 3 raid by Selangor Islamic authorities on Damansara Utama

Methodist Church (DUMC), where it was alleged that Christians were converting Muslims.

Christian leaders have denied claims that Christians were attempting to convert Muslims and have called Himpun’s fight “irrelevant”.
