New Notary Laws for 2012

Posted below are some of the significant law changes that affect active notaries in 2012. For further details and explanation, please refer to the PDF link at the bottom of this article.

1)A subscribing witness appearing before a notary public on behalf of the person who actually signed a document (a principal) cannot be used on powers of attorney or any documents requiring a notary public to obtain a thumbprint in the notary public journal from the party signing the document.

2)Under California Commercial Code section 3505, and Government Code sections 8205 and 8208, only notaries public employed by a financial institution, during the course and scope of the notary’s employment with the financial institution, are authorized to demand acceptance and payment of foreign and inland bills of exchange, or promissory notes, or to protest such bills or notes for
nonacceptance or nonpayment.

3)Signers requesting an acknowledgment should be asked: “Do you acknowledge that this is your signature and that you signed this document?”

Fixed Mortgage Rates Sink to New Low

Data released by Freddie Mac Thursday puts the average 30-year fixed-rate mortgage at 4.01 percent (0.7 point) This follows the announcement of a new program by The Federal Reserve called "Operation Twist". This is a new stimulus policy introduced by the central bank. The program will reinvest principal payments from its holdings of GSE debt and mortgage-backed securities back into new mortgage bonds issued by Fannie Mae and Freddie Mac. The Fed also intends to purchase $400 billion more of Treasury securities by the end of June 2012.

Notary of the Month

This month we are featuring LaShon James-Major – The Document Diva. The Document Diva is based out of Long Beach, Ca.

She has been a full-time notary for nearly eight years. Although, her mainstay is in Long Beach, she provides service to Orange County and Los Angeles County as well.

We caught up with LaShon and asked her a few questions about her business and about being a notary in these difficult economic times.

Do you have any advice for anyone considering becoming a notary?

I suggest if they are working, that they keep their day job and start off part-time. They shouldn't consider full-time until they have established their client list. Further, you may love being a notary or you may determine that this industry is not for you.

So, LaShon has your income been affected by the downturn in the economy?

No, it has not – I have a good web presence and excellent clients that refer business to me. That keeps my income flow steady.

What do you do to stay busy?

I manage my web presence, I constantly analyze my marketing efforts; and I make sure that I regularly thank my loyal clients for their business.

How do you handle difficult clients?

I find that when I disclose my costs up front and explain the process, I minimize difficult situations. If I encounter an unpleasant situation, I attempt to reason with the client. Overwhelmingly, most of my clients are very pleasant and I enjoy working with them.

Being a notary myself, I have a few memorable stories – tell me what is your favorite story experience?

Meeting a client at a local port and signing the documents in the back of my car. It was difficult, yet humorous attempting to complete a 100 page document in the back seat of a car.

Lastly, any regrets about becoming a notary?

No, I do not have any regrets about becoming a notary. The one regret I do have is not becoming a notary sooner.

Notary Test with American Society of Notaries

It’s time to renew my California notary commission. I can’t believe I’m this close to renewal time once again. I am taking my 3-hour required course with The American Society of Notaries. The test is available on-line and cost $31.00 to members.

The 3-hour test is comprised of numerous sections on various notary topics. The wording on the test is clear and simplistic. There is a short test after each one of the sections.

The CA Secretary of State recommends that all notaries take the state test at least six months before their current commission expires. I highly recommend the test offered through the American Society of Notaries to any notary that is needs to renew their commission.

Sometimes Being a Notary Requires Patience

It has truly been a challenging couple of weeks for me in the Notary world. I’ve spoke with numerous people that were looking for walk-in locations instead of a mobile notary. Finally, I scheduled three notary appointments for this past Sunday. I couldn’t schedule with a couple of prospective clients; however the ones I did schedule – all canceled for one reason or another.

I received a call yesterday to perform a notary at Inland Valley, a local hospital. Much to my surprise, when I arrived I discovered the client had checked out earlier in the day. That was a 1st time occurrence for me – I have to laugh to myself at that incident.

Finally, late yesterday afternoon, I received a call from one of the clients that couldn’t meet with me on Sunday. I was riding home from Orange County and I had to race home to print out a couple of power of attorney forms. I drove another 50 miles after having been on the road for an hour and ½ less than 30 minutes before.

I arrived at West Valley Detention Center and met with the client. I am admitted to the attorney booth to garner the inmate’s signature. He was hesitant to sign the forms. Of course, I couldn't coerce him; however he asks to read the forms over.

After about what seemed like forever, he was satisfied with the documents and he signed them. I received payment from my client and I was finally on my way home to relax after long, long, long day.

Riverside County Clerk Mandatory Requirements for Jail Marriages

If your fiancée is incarcerated at a local detention center and you would like to get married – you must have the information outlined below for the Riverside County marriage license office.

Keep in mind; each license bureau has their own requirements and their rules vary. It is very important that you verify all information with the particular license bureau before making any wedding plans.

Following are some key items you should be aware of when seeking to obtain a marriage license from the Riverside County Clerk’s office:

ID and Riverside County Residency Requirements:
Riverside County requires a picture id such as Drivers License or other valid identification. Some counties recommend bringing certified copies of your birth certificates.
Information you need to know before you start filling out the marriage license application:
• Where each of your parents were born (city and state)
• The names of your parents including your mother’s maiden name

Confidential License in Riverside County:
If you have lived together as a married couple, you can apply for a confidential license. This means there is no public record of your marriage.

Previous Marriages:
You must show proof of divorce, death or annulment. You need to bring a copy of your final divorce decree if you have divorced within the 90 days through past year (varies by county).

Riverside County Waiting Period:
There is no waiting period in Riverside County.

Fees:
It will cost you $68 for a public license and $76 for a confidential license.

Other Tests:
Riverside County doesn't require blood tests.
You do not have to be a resident of Riverside County to apply for a marriage license there.
