Introduction Everyone in India is disgusted by the massive corruption in India! Many people blame Indian genes for the corruption in India. And there are others who blame the government for the corruption. As looked deeper and deeper in to the stuff I came to know that if a game of baseball/football/cricket is corrupt then the umpire has been complicit in it. If an umpire has low tolerance towards foul play in a game he would show the yellow or red cards when there is a foul. The players who win on the strength of fowls will re-work their strategies and try to play better. But if the umpire is complicit or inactive or incompetent or insensitive then there would be a selective or discretionary show of yellow or red cards. Now imagine who wields the position of an umpire in any rule of law country which is a democracy? It has to be the judiciary. I have heard a British athlete of Jamaican origin saying, "My grandfather told me when a fish rots it rots from the head!" In other words all corruption begins and ends with the people at the top who are supposed to stop it. If they do not stop it then the judiciary has to grow some teeth and claws to stop it. This is the tragedy of India. The failings of the Indian judiciary is the main culprit behind the corruption in India. So I decided to pursue the Chief Justice of India under his Administrative cum Supervisory jurisdiction over all other courts in India besides his own Supreme Court! I copied my letter to the Prime Minister of India to the Chief Justice of India invoking his Administrative cum Supervisory jurisdiction over the issues which were relevant as on 15 February 2011. No body replied as is what happens in India which includes the Prime Ministers, the President's, the Speaker's, the Chief Justice's offices under this dispensation. They are so shy it seems!!! Making the Chief Justice of India realise that the Chain of Command in matters of Administration of Justice, Rule of Law and Protecting the integrity of the Constitution of India stops at his door steps is fraught with many dangers for me as I am a lawyer whose licence could even be cancelled if the Chief Justice or his fellow judges were to side with the Bar Council of India on a trumped up complaint. But I want to stand my ground as far as I can. That's all I can do now. I do not blame the opposition leader for not replying but the people who are in government has a higher duty I suppose. So I am not going to let this issue disappear and have put the ball back in the court of the Chief Justice of India!!! So today 3 September 2012 I submitted a copy of my Representation to the Chief Justice of India at the website of change.org believing that it is the least I can do for my country. The Representation is reproduced as below; Second Representation dated 03 September 2012 to the Chief Justice of India invoking his Administrative cum Supervisory Jurisdiction over the Supreme Court and High Courts in India I Johnson Thomas K write as a former advocate of the Supreme Court of India and a solicitor of the Supreme Court of England & Wales and a citizen of India and an author and a conscientious citizen in my capacity also as a “Whistle Blower” further to my letter and representation to the Honourable Chief Justice of India Justice Mr. Kapadia (“the Chief Justice”) dated 15 February 2011 and submit as below; I as citizen of India is deeply concerned about the inability of the Indian Judiciary presided over by the Chief Justice to dispense, protect, guarantee and preserve the fundamental rights guaranteed under the Constitution of India (“the Constitution”) for the following reasons as below; 1. Could the Chief Justice ensure that his fellow Judges at the Supreme Court of India (“the Supreme Court”) and indeed the Chief Justices of the High Courts in the federal states of India do not act with any conflict of interest by presiding over matters where they have a conflict of interest or potential conflict of interest due to their affinity or opposition to any subject matter before them or due to the involvement of any of their family members as defined under the Prevention of Corruption Act so that the citizens at large are relieved that justice is not only being done but it also seems to have been done? 2. Could the Chief Justice ensure that the Executive allocates sufficient funds for setting up competent civil and criminal courts in sufficient numbers on a war footing in all villages/townships or municipalities with a population of more than ten thousand so that justice is not denied to the people at large by delayed justice which is the norm in India? 3. Could the Chief Justice in his jurisdiction ensure that there is a Code of Conduct which stipulates to all sitting and retired judges that they would not seek or allow themselves to seek any political postings such as was the case where a former judge of the Allahabad High Court became the Chief Minister of Uttarkhand just recently clearly exposing a conflict of interest raising questions about the integrity of that judge’s rulings due to valid apprehensions about nepotism and corruption? 4. Could the Chief Justice ensure that a communication goes out from the Supreme Court due to their supervisory cum administrative jurisdiction over all courts in India asking them to treat all corruption cases pending in all courts as a serious breach of rule of law as in every act of corruption there is one or more laws, rules, norms and best practices are breached to favour one or more parties against the informed consent of the majority of the citizens of India? 5. Furthermore, in matters of corruption could the Chief Justice and his fellow judges make an administrative declaration to all courts in India that every incidence of corruption breaches right to equality before law, right to equal protection of the laws, right against discrimination, harassment and bullying all guaranteed under the fundamental rights of the Constitution and any attempt to delay prosecution by the state machinery on a case by case basis subverts rule of law especially in corruption cases involving political leaders? 6. Could the Chief Justice and the Supreme Court ensure that all police station interrogations are conducted in the presence of a lawyer and video-graphed to prevent witnesses from turning hostile at a future date and/or being intimidated or pressurised to lie which all pervert the course of justice rendering the outcomes of such trials and the judgements unsafe to be implemented? Could the Chief Justice direct the Union and State governments to implement urgent witness protection schemes? 7. Could the Chief Justice and his fellow judges at the Supreme Court and the various High Courts ensure that they would not hold any office in a trust or a charitable organisation where there is direct or indirect charitable funding from foreign entities or their citizens or their charities? 8. Could the Chief Justice and his fellow judges in the Supreme Court and the High Courts take staggered holidays instead of shutting down the courts during summer, Christmas and other holidays which is a colonial practice and is a grave injustice to the people of India who suffer from exorbitant delays in court proceedings as none of the developed democracies in the world has a pendency of over 50 million cases some going on for decades? 9. Could the Chief Justice and his fellow judges appoint court clerks who are qualified advocates with a minimum of five years’ experience as in Britain in addition to stenographers to reduce their work load which is impairing the quality of their judgements which will also provide employment for a lot of unemployed or under employed lawyers? 10. Could the Chief Justice and his fellow judges stop giving any lee way to the government in allocating sufficient funds for ensuring a decent judge-population and advocate-population ratios as administration of justice to ensure Rule of Law is a sovereign function of the government unlike running an airline, train, transport or banking or steel company/ies? 11. Could the Supreme Court declare to the lawyers who are deemed to be officers of the court that they could not give adjournments at the drop of a hat after having a pre-hearing conference in all courts so that the court, the lawyers for each of the parties and the state lawyers all agree to the mile stones going to be achieved in each case so that hearing s are conducted in an orderly fashion instead of like in a market inconveniencing litigants who travel long distance spending their limited resources to attend cases and these delays are often created to cause a duress or pressure tactics? 12. Could the Supreme Court and the fellow judges ensure that whoever commits perjury/perversion of the course of justice/evidence tampering/smudging of exhibits or any such criminalities are duly punished so that justice prevails in the courts under the Supreme Court’s jurisdiction? 13. Could the Chief Justice and his fellow judges at least have the decency to admit that India is at the top of the list in corruption according to Transparency International not because Indian people are genetically corrupt but Indian people cannot get anything official done without paying the corrupt officers? It is important to reiterate here that any developed country could become a third world country if their judiciary and policing systems are dysfunctional, inefficient, lethargic, burdened by colonial laws which do not speak the language of the majority unlike in the United States of America or United Kingdom or Australia or Canada or any other developed English speaking countries and non-English speaking countries where the language of the law is in the mother tongue of the majority of the people or the language of the courts is multilingual as in European Union courts? How can any Chief Justice and judiciary with any sensitivity to the concerns of the ordinary citizens of India speak in a language not known to the majority of the people considering over 20% or more illiteracy in India? 14. Have the judges ever considered that all colonial laws made by the British were for perpetuating their rule over India through a system of duress which is being continued by the Indian bureaucracy despite their apparent sophistication and no truly independent colony would perpetuate those same draconian laws as is evident from the administration of justice in a former colony like the United States of America which does not follow the Westminster form or their system of unwritten constitution or their business of law lords with funny wigs or lawyers wearing funny scare crow gowns? A decent sombre suit is all that is needed in all lower courts! 15. Do the judges believe former Chief Justice of India Justice Mr. K.G Balakrishnan being mired in corruption cases is a fit and proper person to be the Chairman of the National Human Rights Commission of India which has an overwhelming relevance in the protection and advancement of human rights including gender rights across India? 16. Do the judges believe that it is a third world judiciary that creates a third world country and economy mired in corruption, delayed justice, denied justice covered up by pretentious body language and through perversion of the course of justice, witnesses turning hostile, no independence for police or the CBI to favour dynastic democracies such as in India, Pakistan, Bangladesh, Syria, Libya, Egypt, Iraq who all had judiciaries of varying independence but compromised their integrity unlike the first world judiciary in the developed countries? 17. Do the judges believe that having undefined expressions like socialism and secularism in the Constitution of India which are currently being defined by corrupt and substandard politicians, ideologically compromised Nobel Prize winners, artists, film directors, religious figures or journalists is itself a trickery on the constitution of India as the judiciary alone is the competent authority to define and interpret these cardinal doctrines of the Constitution of India? Why did the judges having had reason to know that the lack of clarity and certainty on these fundamental doctrines of socialism and secularism outsourced it to the politicians and other busy bodies allowing them to define these doctrines especially when India suffered about 30,000 communal riots since 1947 and many more violent strikes, hartals, bandhs, embargoes, political skirmishes, regional conflicts, destruction of property infringing the right to trade/ profession/ right to settle down anywhere in India all in the name of a parochial interpretation of socialism and secularism by trade unions and political outfits? How is it reasonable to allow these concepts of socialism and secularism left undefined either in the constitution or in the official gazettes so that no body appropriates it for their petty political gains? 18. Do not the judges believe that the sovereign function of a government is to guarantee the legitimacy of the Constitution of India and the fundamental rights guaranteed there in which is not any charitable dispensation of the Indian judges but is the fruitage of the struggle of millions of Indians against British colonialism, genocide, heritage, cultural and livelihood destruction including through the destruction of cottage industries? It is pertinent to reiterate here that it was from a cottage/house the steam engine emerged before they were made in factories or internal combustion engines from Germany or other inventions from France, Europe and the USA like a personal computer evolving in to a lap top to a tablet computer from a garage like that of Steve Jobs or Bill Gates or others. The evidence of the homesickness of the Indian judges for the brutal colonial Raaj is evident in their attire and their reliance on British judicial precedents despite the colonial loot and plunder? All discretions are designed to derail meritocracy as is the case in the judiciary and Justice Mr. K. G Balakrishnan is only an example. 19. The fact that Indians can perform well and they do so exceedingly well in all rule of law countries including in the United States of America, UK, Germany, France, Scandinavia having one of the highest per capita incomes, one of the least criminal records and family break downs, one of the highest educational achievements is proof enough that it is not Indians who are at fault but the third rate Indian judiciary who dispenses them the so called justice that is at fault. The Time Magazine recently had a cover story on the New York State Attorney who is of Indian origin for pursuing corporate corruption vigorously in America unlike India’s national Attorney General or the Attorney Generals in the Indian federal states. It is high time the judges in India introspected whether they are worthy enough to be portrayed as a cover story by an international magazine of any standing for their role in protecting India; the world’s largest democracy against official corruption and restoring to them the democracy the people of India fought for under Mahatma Gandhi without devaluing the standing of such magazines? The proof of the pudding in the administration of justice like in eating is how it tastes or works at the ground level and not in the Latin terms or the flowery English they use in their judgements. 20. Do the Judges admit that the biggest misfortune of India and Indians are their judiciary whilst it claims to be the custodian and guardian of the Constitution and the Fundamental Rights and then watch helplessly as the Constitution and its guarantees are blatantly subverted through corruption, perversion of the course of justice/perjury/obstruction of justice/delayed justice/nepotism etc. including through the judiciary in India? 21. Do the Judges believe the inaction of the Human Rights Commission at the Centre and the States, the National Commission for Women and similar ones for the welfare of children are all institutionally inefficient, insensitive as was evidenced by their inaction during the recent Assam tragedy and the flight of people from North Eastern States from various cities in India whilst foreign nationals have an implicit right to infiltrate, steal cattle, vote in elections due to official inefficiency, corruption or nepotism? How come the Indian Judges have to be told that Right to Vote is a fundamental right that should only be available to Indian citizens and is so vital to retain the sanctity of democracy in India besides curbing unemployment where India has a higher congregation of poverty than Sub Saharan Africa? This is a blatant subversion of the Constitutional Democracy of India with the help of alien citizens on top of the massive corruption and all other problems referred to in paragraphs 1 to 20 above! 22. Do the judges believe that the inaction of the Central Bureau of Investigation, the Enforcement Directorate, the Income Tax department in the matter of laundered money stashed away in foreign tax havens contributes a threat to the national security of India as was observed by the Daily Mail of UK on 08 and 15 August 2012 quoting the New York State Department of Financial Services (DFS), the SEC, the American Justice Department, the Federal Reserve whilst proceeding against the UK banks including HSBC, Standard Chartered, Lloyds TSB, Barclays for indulging in money laundering for UN sanctioned regimes like Sudan, Libya, Iran, Burma besides the mafia and drug syndicates in Mexico? What are SEBI and the Reserve Bank of India and the Ministry of Finance doing in this regard under the supreme jurisdiction of the Supreme Court of India and their judges? It is in the fitness of things for the judges to declare whether they hold any accounts in any foreign banks to allay concerns about a conflict of interest or potential conflict of interest! 23. What does the inaction of the Election Commission of India under the Chief Justice’s jurisdiction signify when even an authorised office bearer of a political party in Kerala Mr. M. M Money publically confessed on television that his party prepared lists to kill off political opponents and always dealt with the murder charges as they knew how to deal with the police, judges and lawyers by offering dummies as accused to cheat the administration of justice? It is pertinent in context for the judges to declare that whether they assumed judicial positions to administer the Communist Manifesto or the Constitution of India as Mr. Money’s political party the CPI (M) is the monopolistic interpreter of Socialism and Secularism in India? Why did not the judges express any views on all of these political murders in Kerala even when Mr. Money’s petition was before the Supreme Court argued by one Mr. Harish Salve despite the fact that many of these political murders were very sickening, traumatic and brutal needing acute counselling to the surviving descendants who had to endure it. Even the Supreme Court acquitted some of these accused persons relying on the ineptitude of the police and prosecution whilst it ought to have known any failing by them to is a vicarious failure by the judiciary if not a direct one as is understood in all rule of law countries! Some of these murders took place in front of little school children but some of the accused were let off by the Supreme Court in few of these cases whilst not even thinking about the need for counselling for these little children exposing the insensitivity of the Indian Supreme Court. Personal Declaration 24. I do not have any cases pending against me in any courts in India to the best of my knowledge and information and this representation to the Chief Justice is in pursuance of my civic duties as a citizen of India and in furtherance of my right to blow the whistle on the ineptitude of the Supreme Court which alone is duty bound to ensure Administration of Justice through the Constitution and Rule of Law prevails even when all other organs of the state fails and flounders. 25. Pursuant to paragraph 1 to 23 above I appeal to the Chief Justice of India to take urgent and time bound steps to sort out the judicial mess that the nation is in due to the colossal failure of the administration of justice in India under the jurisdiction of the Chief Justice (literally und his nose) and is a joke not only for Indian citizens but also for many in the developed countries! My Direct Appeal to the Indian Prime Minister on Corruption- Excerpts From My Letter

Direct Appeal to the Prime Minister for Urgent Action

1.The onus is on the Prime Minister to consult the state governments where the matters below are exclusively in the state or the concurrent list as he is the leader of the nation. Most of the much needed reforms below could be achieved within a year if there is a political will. The nation would be behind the Prime Minister if investigations he orders results in his unseating or expulsion from the ruling party. However, it is alarming to learn about the Prime Minister’s criticisms about Judicial Activism when it is warranted by the “In-activism” of the Executive of which he is the de facto head. The proactive Judiciary is the only hope for the millions of people in India who are persecuted, harassed and bullied by the bureaucrats through corruption and injustice. From these premises the Informant appeals the Prime Minister to be proactive in the coming Budget Session and implement the following governance, legal, administrative reforms as listed below;

a) The Informant appeals to the Prime Minister to allocate 2% of the GDP for Judicial and Regulatory institutional infrastructure in the coming budget

b) The Informant appeals the Prime Minister to set up sufficient number of civil and criminal courts and other regulatory institutional infrastructure across India so that justice is not denied through delayed justice

c) To abolish all British era draconian laws which were orientated to make the Indian citizens to be at the mercy of the Indian bureaucrats who use this as duress to extract bribes.

d) To initiate amendments to the Prevention of Corruption Act to enable the bribe payers to be whistle blowers and witnesses if they so choose so that the corrupt bureaucrats do not escape conviction due to the lack of witnesses. Decriminalisation of the bribe givers as in most cases of corruption only two sides privy to the criminal transaction are the bribe giver and the bribe taker.

e) To initiate steps to bring back all the Black and Laundered money in European tax havens and Swiss banks which is the plundered property of the state and qualify as proceeds of crime liable to be seized both under domestic tax laws as well as under UN regulations. The failure of the dictatorships and dynastic rulers besides the aggressive prosecution of the corrupt would erode the customer base of the tax havens and they have an interest in keeping India a corrupt country plagued with separatist movements often facilitated, fomented or funded by EU charities as could have been the case with the LTTE.

f) To stop any further resignations of election commissioners and other constitutional functionaries as was in the case of Mr. Gill who was used to bring in Mr. Balakrishnan especially when the current Chief Election Commissioner Mr.Chawla himself is of dubious integrity and independence according to his own predecessor. The need to secure the resignation of people of disputable integrity like Mr. Thomas at the CVC ought to be seen as part of this wider reform.

g) To publish a white paper on the looted Indian Heritage expropriated under the duress of European colonial occupation of India and its recovery so that the people’s right to their heritage including sacred, semi sacred and secular are protected in full both under domestic laws as well as under the UNESCO directives to the former colonial powers.

h) To commence the video recording of all police station interviews in the presence of the lawyers to prevent witnesses claiming duress and turning hostile later in judicial proceedings. Please inform the public and police that all police officers are officers of the court and they could be proceeded against if they were to intimidate, influence, bully or harass or seek bribes in any of their investigations or forge or doctor documents as it could amount to perversion of the course of justice/obstruction of justice/evidence tampering. And strive to make the Police and the CBI independent of the Executive so that they do their duties without fear or favour solely under judicial scrutiny instead of the scrutiny of the dynastic rulers and their bureaucratic and political coterie.

i) To modernise all polluting industries instead of shutting them down causing massive unemployment and social unrest through a dedicated Environment Fund which could be funded from the recovery of the Black/Laundered money in European Tax Havens including Swiss banks.

j) To set up an independent Project Implementation Department in the Centre and the States to monitor all project implementation to check diversion of funds, tardy implementation, corruption, inefficiency, cost overruns etc which cumulatively is wasting over 50% of the governments’ outlay whilst the Prime Minister is refusing to enhance the outlay for the Judiciary to 2% of the GDP.

k) To set up Anti-Corruption Courts in all Districts in India to facilitate timely prosecution of all corruption cases where the courts have the power to freeze the assets of the corrupt until they are acquitted as being tried out in Bihar.

l) To set up adequate number of Environmental cum Planning Courts in all states in India so that planning permission cum environmental clearances for all industries and businesses are given or rescinded by such courts instead of the piecemeal action of the environmental ministries which do not even care about open drains, littering, lack of toilets or running water or in India which do not attract media headlines. The biggest cause of pollution is inefficiency which results in the wastage of resources both human and natural besides energy, time and investment. Even planning permission for pubs in the UK is granted by the Magistrates Courts after hearing the potential landlord, the relevant council/police agency.

m) To implement mass legal literacy campaigns across India informing the Indian citizens about their rights in general and how and where to access them through the print, television media. Without knowing about a right no one can claim a right. Spreading legal literacy in India would empower people democratically and cost very little money as corruption would fall once people are given an opportunity to assert their rights especially when the victims of corruption are from the poor/ disadvantaged/ the OBC/SC and ST communities.

n) By increasing the budgetary allocation for the Judiciary and Regulatory institutions to a minimum of 2% of the GDP from less than 1% now especially because the domestic black economy is estimated to be around 50% of the official economy. The tax recoverable from this 50% domestic black economy will recover the 2% budgetary allocation several times over in a year. It would also address the issue of judge and lawyer population ratios where India is at the bottom of the league.

o) To issue a Gazette Notification to define Secularism and Socialism inserted in to the Constitution of India without any attempt to define it in the Constitution itself whilst the powers, duties, limitations of powers of the President, the Prime Minister, the Chief Justice of India, the Lokh Sabha Speaker the Union Bureaucracy and their counter parts in the states are all clearly defined. After all Secularism and Socialism are our cardinal constitutional principles. Politicians, academics, artists, writers, actors etc are not a competent authority to define socialism and secularism but the union government comprising the Parliament, the Executive and the Judiciary alone could do that. This particularly important as thousands of people in India lost their lives in about 30,000 communal rights across India since independence. Thousands also lost their lives in political clashes, strikes, bandhs etc since independence.

The Informant undertakes to submit documentary evidence before the Prime Minister upon reasonable notice and is even prepared to testify before any other agency or institution in the interest of promoting Rule of Law and Constitutionalism in India if he is accorded the protection under Witness Protection Schemes and provided legal aid both in India and the United Kingdom.

ANNA HAZARE'S HUNGER STRIKE! WILL IT REMOVE CORRUPTION IN INDIA? WHAT'S YOUR TAKE?

My dear brothers and sisters of India my views on this fight against corruption are as below,

1. I SALUTE ANNA HAZARE FOR HIS EFFORTS IN GETTING THE COUNTRY TO FOUCS ON CORRUPTION.

2. However there are people like Medha Patkar, Swami Agnivesh, Ms Sarabhai, Santhosh Hegde and others from the anti-development lobby who could use this campaign against corruption to sabotage development in India which alone can create jobs, homes, slum free cities, roads, schools, hospitals etc across India.

3. Please don't get carried away by slogans as it was such slogans like Socialism, Garibi Hattao, and Aaam Aadmi which were once used by the ruling dynasty of India to perpetuate their rule over India.

4. If the government officers like the police, the CBI, the Enforcement Directorate and the courts were doing their duty the corrupt who bribe their way out or in would have been long ago in jails.

5. India needs more courts, judges, prosecutors, police stations, jails and police with modern training across the country to have speedy trials, decisions, investigations so that the corrupt do not get away.

6. The police and the CBI ought to be made independent of the Executive. The biggest cause of corruption in India is that the bureaucrats devise duress through laws so that people have to pay up to start a business or get a certificate or legitimate welfare benefits or a ration card. The Bribe Giver must be treated as a whistleblower. Ever wondered why bribe giving was made a crime? To criminalize potential witnesses to corruption and thereby protect the corrupt Indian babus who thrive on corruption!!! It is the same Indian babus who are educated who teach our illiterate politicians how to be corrupt!!!

7. The Indian citizens are not directly facing the corruption of the Prime Minister but of the corrupt police, village officers, civil supplies officers, and tax officers across our villages, towns, cities, street corners, collectorates, village offices which will not be solved by the Lok Pal Bill unless it is brought to every village police station premises.

8. Please don't be fooled by Medha Patkar, Mallika Sarabhai, Swami Agnivesh, Santhosh Hegde, and Shanthi Bhushan unless they declare that their agenda is not to stall development in India under the cover of the anti-corruption campaign. I hope this is not to give an election fillip to Manmohan Singh and Sonia Gandhi through a photo opportunity just before the polls like Mallika Sarabhai and Subhashini Ali did.

The comments below are in response to Mr.Gopalakrishna Gandhi's articles in the Hindustan Times of 29, 30 and 31 of March 2011. As you know Mr.Gopalakrishan Gandhi is a grandson of Mahatma Gandhi and was removed from the directorship of a Gandhian Foundation in the USA for his outbursts against the Jewish people which Mahatma Gandhi himself would not have tolerated.

NO!!! The book should not be banned!!! Gandhi is my hero and will always be despite his failings. The next in line for me are Abraham Lincoln, Martin Luther King and Napoleon in the Western hemisphere. In the East I have other heroes like Valmiki and Vyasa and others. I have a complaint to make to the grand son of Mahatma Gandhi as below;

1. Did Gandhi have any clue that his anointment of Nehru would lead to a dynastic rule in India through the abuse of his surname?

2.Did Gandhi have any idea that the British were planning ahead of him to install their chosen heirs for India and indeed the whole of South Asia besides the former colonies who later became members of that organization headed by the British Monarch whilst claiming to uphold democracy? Please refer to the Commonwealth Charter to appreciate whether it was intended to perpetuate a rag tag colony for the ego of the British Monarch. The freedom struggle that Gandhi led was not to fight American Imperialism but British Imperialism but then how did it gradually became a fight against American Imperialism under the Nehru clan? Was this the so called Hindu extremists' making or the communist Nehru's making? Are you or your grandfather privy to all private communications/conversations between the British and the Nehru family?

3.Kripalani in his biography on Gandhi says that after Gandhi's death Nehru shunned Indian advisors for Mountbatten which is corroborated by Harold McMillan’s (former British Prime Minister) diaries wherein he claims, "the atrocities the Mountbatten’s did on India was horrendous”

4. Even if your theory about the Hindu extremists killed Gandhi could be right neither you nor Gandhi were investigators of any standing. Could it be the British behind Gandhi's assassination just like their influence in getting even the Nobel Committee deny Gandhi the Nobel Prize five times? The employee/employer relationship between Rabindranath Tagore’s family and their connection to Rajaram Mohan Roy who is buried in Bristol in Britain are all well known. Brahmo Samaj was founded by Rajaram Mohan Roy who is an uncle of Tagore. The Janagana Mana Athi Nayaka of India at the time of its writing in 1911 was the British and no wonder Tagore got a Nobel Prize and the British scuttled Gandhi’s chance to get the Nobel Prize five times admitted by the Nobel Peace Committee some time in 2010. The translation of the Jana Gana Mana is available on Wiki Pedia through a Google search.

5.Please have a look at the dynastic rulers and dictatorships in South Asia and West Asia all of them have a deep rooted allegiance to Britain and European tax havens. the fake Gandhi's in India, the Bhuttos in Pakistan, Bandaranaike in Sri Lanka, the Gaddaffi's in Libya, the Mubarak's in Egypt, the Azads and Hussein of Syria and Jordan whether through second homes, tax evasion or education or military training. Even Robert Mugabe was knighted by the John Major's government before he became an international paraya (pariah). Does anyone in India know what Sonia Gandhi the most powerful person in India doing from 16 March to 21 March of 2011 in London? Even a holiday of the democratic leaders attract media coverage. As she is the most powerful person in India the people of India has a right to know what she was doing in London for 5 days? How did Motialal become such a wealthy lawyer, one of the wealthiest in the world under the British Raj when even today Clifford Chance the wealthiest law firm in the world cannot achieve number one position without the support of the British establishment?

6. We the people of India request you the grandson of Mahatma Gandhi whom we love not to allow your grandfather's name to prop up a dynastic rule in India. This is the least we ask from you as there are already 460 government programs named after the Indira-Nehru dynasty who abuse your grandfather's surname "Gandhi" besides all the prominent landmarks in all major cities be it JNU, IGNOU, JNPT, IGIA, to name a few.

7. Hindu extremism you allege is now mellowing Hindus also had a case as you ought to appreciate and unfortunately no body told the Muslims about the Hindu sufferings due to political correctness. If you can take out an injunction against the use of Mahatma Gandhi's pictures by the dynastic ruling party in India to befool the nearly 50% illiterate Indian voters through unfair voter recognition and thus voter decision it would be a great service from you to India. Images for nearly 50% illiterate voters in India are what mould their perception and eventually decision making. I think Abraham Lincoln is from Springfield Illinois and you should be concerned about the dynastic slavery India is undergoing now through dynastic rule through the abuse of your grandfather's surname. Accidents are one offs or rare incidents but when they repeat itself it is a pattern even under basic logic!!! The British the largest losers in human history always tried to divide the Hindus up to keep their empire going and has now become the world’s 5^th largest economy from the first in early 1900 despite their Booker Prizes, Amnesty International, the BBC, the Oxfam etc with the active support of the Indian leftists and Naxals.

This book ban is to justify the banning of a book on Sonia Gandhi by a Spanish author. Even Kama sutra was not banned in ancient India!!! Banning is a Taliban policy and not good for any democratic country! The tragedy in India is even the election commission and police act as plaintiffs in defamation matters to prop up dynastic rulers. The rules prohibiting personal attacks on candidates is clearly a rule to protect Sonia/Rahul and the Indira-Nehru dynasty as such defamation ought to be a civil matter in all elections as in other sound democracies. No body banned personal attacks on Obama when he was a candidate in the last US elections as people have a right to know about the personality, friends, faith, policies, antecedents of political candidates as the voters are those who deserve protection from parting with their mandate through deception or misleading claims.

Just to compare the standard of Indian History taught in Indian schools I bought a travel guide on India. It was shocking to see that the Indian History books written by the so called eminent historians do not even have the academic standing of a travel guide publisher on India.

The travel guide I am talking about is "Eyewitness Travel Guides" by Dorling Kindersley or DK which is part of Penguin and a major supplier of school texts in Britain.

I think every Indian who wants to learn more about India should buy a copy of the DK's Eye Witness Travel Guide on both India and Europe. It has pictorial details on many of the ancient Indian cities, the plan, photos, details of construction and scale legends and myths associated with it.

The drydocks of Lothal - carbon dated to 2500 BC- historical significance. The world's oldest known dry dock proves that Indians had knowledge of navigation and shipbuilding techniques at least 2000 years earlier than the Greeks. Please see the link below;

The Submerged City in Bay of Kambhat- The objects recovered from the site such as a stone slab with mysterious markings probably the earliest form of writing, the submerged city has streets, houses, staircases and temples and is carbon dated to circa 8000 BC. The Ajantha & Ellora Temples- They still call it Cave Temples but the fact of the matter is unlike the pyramids it was carved from top to bottom where the sculptors chiselled through 85,000 cubic meters (about 3 million cubic feet and is believed to be built in 8 century AD. This temple complex is 81 meter by47 meter and does not deserve to be called a cave temple.

The Adilaj Vav- In Gujarat could be called a Step Well or could be called one of the finest pieces of architecture and sculptoring depending upon one's political correctness. Please see the link below. It was built around 1499 AD.

Another Intricately Carved Step Well in Gujarat- Remember working on granite is much harder than working on marble- Please compare this to the best swimming pools or roman baths anywhere in the world.

The Brihadhishwara Temple-Built around 1000 AD this temple has an octoganal single piece granite weighing 80 tonnes atop the Vimanah at a height of 66 meters or about 217 ft. The Discovery Channel had a programme on this temple a few years ago- wondering how they managed to lift an 80 tonne object to a height of 217 ft without electricity or crane.

Bill Gates Charity Letter of 2011 Unresolved Issues

I wished there were a section for people to comment on Bill Gates Letter for 2011! With all due respect to Bill Gates (He is an icon for humanity, a philosopher but with wealth, a thinker, an empathetic billionaire and above all a role model for humanity, a revolutionary of Gandhian/Martin Luther King proportions and above all a great human being and I pray God gives us more people like Bill Gates but these are my personal views on Bill Gates and I am not going allow my following views on his 2011 letter.

Therefore with great admiration I dare to criticise Bill Gates on the issues he raised up to the section (Miracles of Vaccines) in his letter as follows;

1. Gate's demand for more AID pledges from the rich countries whilst being an issue ignores the problem of under utilization of AID in many of the developing countries. For instance India is still hoarding about $20 billion in AID received and is paying millions in fines for that according to a report in the Indian media upon which I had responded through Twitter. Under utilization of AID is not a political or legislative issue but plain negligence. If AID recipients are responsible for under utilization of AID then AID givers too could be responsible for lack of monitoring and auditing in a double entry system of accounting. If stakeholder (shareholder) investment were to have been under utilized legitimated questions would have been raised in shareholder meetings.

2. The issues in paragraph 1 above if were left unaddressed could become serious speed breakers and road blocks to the Health & Prosperity goals Bill Gates speaks about. Many charities and foundations set up by visionary "do gooders" often hide under political and legislative reasons not to address the issues in paragraph 1 above. At this moment in time there is only one Bill Gates and the chances of humanity having another Bill Gates in the coming years is very bleak considering the global economic turmoil so what needs to be said has to be said.

3. There is no dispute on the intrinsic merits of increasing AID but only its effective use. Without giving country wide or country specific data I can say that there are charities in certain countries in the West who hoard $120 billion in their charitable foundations some of which could have been collected by showing heart wrenching pictures of poverty, famine, disasters, illiteracy, disease, natural disasters affecting both humans and animals. The humanity expects from Bill Gates to run a charity which is different from all other charities in its reach and healing instead of following the templates of existing charities which were once set up by great humanitarians like Bill Gates himself but in a different decade and age. Institutions do suffer from value erosion like individuals and unless this is dealt with goals will remain as goals either unaccomplished or part accomplished. Eradication of polio and eradication of the depreciation in charity goals therefore assume equal importance. It is conceded the Bill Gates foundation may not be able to indulge in direct political or legislative action where their humanitarian activities in developing countries could be frustrated through such interference or involvement as the case may be. But Bill and Melinda Foundation could not have been banned from funding researches in to such issues. In Kerala, India where I grew up we have saying roughly translated in to English means, "There is no hope for a farmer when even the fence starts eating the crops", "There is no point in filling a leaking pot with water".

4. Bill Gates for me is a philosopher because he knew the intrinsic worth of giving. In Hinduism it is called renunciation. There were Maharajas and emperors in India before Christ like Parikshit, Chandra Gupta and Ashoka who even gave up their Kingdoms to embrace sanyasa or renunciation of all their wealth believing that humanity would follow their path in sorting out human problems. It unfortunately did not happen. Renunciation of these great men became an opportunity for opportunistic men who succeeded them and nothing happened. Humanity was back to square one.

5. I reserve my comments about the Polio Campaign in the USA to another paragraph below

6. It is still a pity that India, Nigeria, Pakistan and Afghanistan have Polio cases. Could it be due to the issues raised in paragraph 1 to 5 above is left to the deliberation of the Bill & Melinda Gates Foundation ("the Foundation")

7. It is wrong to state that people need to be more charitable in an age of charitable excess where no body has a proper figure on the charity lavished on humanity in the past five to six decades involving trillions of dollars more than the founding capital of the Foundation. Yet diseases, poverty, homelessness all come back to haunt us. In the Holy Bible there is the parable of "Widow's Mite" everyone contributed but poverty, disease, homelessness are all still there on our tree screens as if nothing had happened before to sort out these issues. Mahatma Gandhi once said, "Poverty is the Worst Form of Violence" and it is so true even today despite trillions of dollars of over funding of charities. The $720 million short fall for polio eradication projected by the Foundation ought to be seen in this context.

8. It is up to the Foundation to evaluate whether its noble goals of prevention of death and disability due to Polio incidence the four countries are being hampered in any way due to the issues raised in paragraph 1 to 7 above considering the fact that only 1% of the infected develop disability and/or progress to death whilst they can infect others. Eradication of polio is not a quick fix but a sure fix that humanity deserves and the humanity of faceless and voiceless millions are looking up to the Foundation to do something different from the renunciation and charitable empathetic giving that has been going on for centuries. Please also refer to paragraph 4 and 7 above.

9. There cannot be any dispute against the projections of a $50 billion saving from Polio eradication alone but the billion dollar question is what could be the cumulative saving for humanity from solving preventable diseases, deaths, homelessness, joblessness, accidents, negligent health care etc. There are no projections of these eventualities in Bill Gates' letters.

10. The "Resolve and Courage" of leadership in prevention and eradication of Polio referred to in Bill Gates Letter for 2011 is also relevant to the purposes of paragraph 1 to 9 above. The marchers in the "March of Dimes" some 50 years ago in the USA that Bill Gates witnessed had such lofty ideals although they were not as wealthy as Bill Gates or Warren Buffet. In that spirit of "March of Dimes" the citizens of the USA might have donated trillions of dollars in philanthropy to "Save the World/Humanity" and their disadvantaged brethren but it all disappeared in to a vacuum of underperformance and diminishing returns as evidenced by the charity collections going on today. Charity ought to be a stop gap arrangement and not an ad infinitum business venture of charity dependence to save the charities from extinction like the dinosaurs.

11. Humanity and humility as enunciated in Bill Gates' 2011 letter does not mean fatalism even for charitable purposes and the philosophy is the need of the hour. The reduction of Polio spastics of 741 to 41 and 388 to 41 for Nigeria and India whilst being impressive if such a comparative study/auditing is done for the impact of other preventable diseases including those caused through lack of information, awareness, negligence, professional negligence...........then perhaps this world could become a paradise. I know it is naive to think in these lines but you thought in these lines when you dropped out Harvard and presented before the world the "Microsoft"- micro but soft windows for all of us to interact with our brothers and sisters in the wider world. There were days when I wished I were born as your gardener/driver/dustman...............but destiny made me a lawyer with dual qualifications with a heart that can identify with people from my backgrounds.

12. Your points about significant and co-ordinate leadership and resourcefulness I believe could be relevant to paragraphs 1 to 11 above.

13. Your emphasis on empathetic efficiency is the need of the hour and the humanity expects from one of its heroes to deliver the entire hero is spending his own resources for the benefit of the humanity!!! In Kerala, India where I come from even the beggars toss back miniscule alms as it is so insulting to them. I have been a victim of that several times in 2005 when I was with my mother during a vacation from the UK from July to October 2005. I remember watching Bill Gates on NDTV in the company of Narain Murthy of Infosys advising the audience before him besides his global Indian audience, "The World Depends on the USA Getting Certain Things Right" now it is up to Bill Gates to consider whether it is relevant for the humanity to expect certain things for the Bill and Melinda Gates Foundation getting right or are they going to be another Rockefeller and Carnegie Foundations, Oxfams, Green Peaces and millions of other charities who simply trade poverty porn to get donations!!!

I think it is wrong to hide the influence of Sanskrit on English, Latin and other Indo-European languages. Kalidaasa’s Shakunthalam and Goethe’s Sakontala may not be that different after all. The Vedas, Puranas, Itihaasas, Upanishad’s and the Five Books of Moses and the Old Testament and the New Testament may not be that dissimilar either.

From these premises I believe learning Sanskrit is eminently more sensible than learning Latin. Many people blindly believe Greek and Latin alone is responsible for the English etymology. This belief could be due to the fact that in English dictionaries the etymology of most English words is shown as Greek & Latin or French & German. The Sanskrit connection is often ignored or sidelined either due to ignorance, bigotry, intellectual racism or all of them. Some others can't even make the connection between English and the rest of the Indo-European family of languages although it is the largest language family in the world spoken by the largest number of people in Asia and Europe even according to several Encyclopedias.

In a world of ideological divide and academic expediency what is forgotten are the true connections between the Indo-European languages. It is believed that the Silk Road has been in existence for about 4500 years or so connecting Europe with Asia which in a sense laid the foundations of the modern world as we know it.

For some the Silk Road unfortunately was a mere " spice road/curry trade route" involving some spices like cloves, cinnamon, pepper, turmeric or a luxury trade involving silk, sahutosh, pashmina, cashmere, diamonds, pearls, saphron, precious stones etc! Was it also a “Skills Road” as it was in Asia that most of humanity’s first innovations happened? The Silk Road/Silk Route or whatever that infrastructure is called allowed Europe to learn about the religions like Hinduism (the oldest of major religions), Judaism, Budhism, Jainism, Christianity, and Islam which all originated in Asia. Jesus Christ was a rebel Jewish Rabbi born in Asia (Israel/Palestine) and whether he has had blonde hair or not is not the issue the issue is about the assimilation of languages, cultures, philosophies, science between the the two continents.

Please bear in mind how the European colonialists rewrote the history of humanity since the early 1700s to this day using their techonological and economic advantage in the form of printing presses, industrial revolution, typewritters to the computer. Until 1700 AD both India and China together had a global GDP share of 70% which in India's case shrunk to 0.8% by 1991 and China's to less than India's in 1947. Please keep in mind the denigration inflicted on both India and China by the European print and television media using both the so called experts from Europe in tandem with the hired Indian and Chinese experts. The typical Indian and Chinese pictures of 1990s that of the cyclists on Chinese roads or that of the Hindu monks in bathing ghats in Varanasi or that of snake charmers to name a few were all part of a pattern like a pattern of dictatorships and dynastic rulers in the developing world mostly educated in British universities like in the case of the Indira-Nehru dynasty of India, the Bhuttos of Pakistan, the Husseins and Azads of Jordan and Syria. Ever wondered why all the Indian born Booker Prize Winners are all staunch British supporters, Hindu haters and Islamic sympathisers! Ever wondered why Khalid Muhammed Sheik the architect of September 11 terrorist attacks on New York was educated in London School of Economics? Sorry for going on about this context whilst the theme of this blog is about looking at how English borrowed so heavily from Sanksrit. If "Nein" in German is the English equivalent of "No" and Jagnath is good for juggernaut many of the Sanskrit words in this blog do qualify for this etymological study.

I therefore believe that there is more connection between Sanskrit, Latin and English than projected by vested interests and the historians of the victors as Latin is also an Indo-European language. I am not an expert in Latin (my Latin learning confined to mere botanical and zoological names plus legal terms etc). However I believe it is order to give the similarities between English and Sanskrit (Some Sanskrit words are difficult to be spelt in English as the former has 48 letters whilst the latter has only 26. The differences in the pronunciation of “C”, “kicking Ka” “Curly Ka” “J” and “G” in English may be an issue for some. Sanskrit is not a simplistic or simpleton’s alphabet with only vowels and consonants but has vowels and consonants with complex Gutturals, Palatals, Cerebrals, Dentals, Labials, Sibilants and Aspirates. Please also do appreciate that most of the words given in this blog are based on the starting sound of the words represented by the respective Sanskrit and English alphabets. It is believed that to have a normal conversation or writing letters one needs only a five hundred word strong vocabulary assuming grammar, pronunciation etc are properly used. Simply because the modern numerals looks like Arabic numerals there was no need to sever the connection between the Sanskrit numerals and Arabic numerals either as there was no historical or scientific reason to do so except when history and study of languages is subservient to colonial bigotry. I will try to give my best shot to compare English and Sanskrit as below;

THE INDIAN AND WESTERN STAR SIGNS FOR THE NEOPHYTE IN CLASSICAL STUDIES SANS BOUNDARIES OR PREJUDICES

The ecliptic is divided into 73625252 nakshatras, which are variously called lunar houses or asterisms. These reflect the moon's cycle against the fixed stars, 27 days and 7¾ hours, the fractional part being compensated by an intercalary 28th nakshatra. Nakshatra computation appears to have been well known at the time of the Rig Veda (2nd–1st millennium BCE).

The ecliptic is divided into the nakshatras eastwards starting from a reference point which is traditionally a point on the ecliptic directly opposite the star Spica called Chitrā in Sanskrit. (Other slightly different definitions exist.) It is called Meshādi or the "start of Aries"; this is when the equinox — where the ecliptic meets the equator — was in Aries (today it is in Pisces, 28 degrees before Aries starts). The difference between Meshādi and the present equinox is known as ayanāngsha or fraction of ecliptic. Given the 25,800 year cycle for the precession of the equinoxes, the equinox was directly opposite Spica in 285 CE, around the date of the Surya Siddhanta.^[1][2]

The nakshatras with their corresponding regions of sky are given below, following Basham.^[3] As always, there are many versions with minor differences. The names on the right-hand column give roughly the correspondence of the nakshatras to modern names of stars. Note that nakshatras are (in this context) not just single stars but are segments on the ecliptic characterised by one or more stars. Hence there are more than one star mentioned for each nakshatra.

An additional 28th intercalary nakshatra, Abhijit (अभिजित्)(α, ε and ζ Lyrae - Vega - between Uttarasharha and Sravana. Last two (third and fourth) Padas of Uttrashada and first two (first and second) Padas of Sravana are considered to be Abhijit. Unless specifically mentioned it is not included in the list of the 27 constellations.

The nakshatra in which the moon lies at the time of sunrise of a day is the nakshatra for the day's therefore obvious to an intelligent but independent mind that who copied whom in this saga!!! Was it the Aryans who came to India but did not bother to create anything literary of the magnitude of the Indians despite their superiority or the Greeks or the Romans or the Egyptians. The biggest question is who pirated whom to jump the historical and civilisational league tables?

Whilst history including history of languages written by victors may be titillating it creates complacency and complacency self delusion and defeat for the victims of such plagiarized history. This I believe is the philosophy behind the saying, “Pride Goes before a Fall”. The English dictionaries are teaching the children of the English speaking world a wrong etymology to suit their political ideology and are hurting their children in the long run whilst the sycophant historians are profiting and amassing awards, citations and recognition! The proof of the pudding is in the eating as in the spelling competitions done in the USA/UK where the native children are lagging behind the children from the Indian and Chinese families in both the USA and the UK.

If western soldiers are constantly taught that no body conquered Afghanistan and Russia they would grow up as soldiers, commanders and Defense Secretaries to believe it as a gospel truth. Of course Russia was conquered by the Huns, Genghis Khan and Kublai Khan; the Japanese just like the Romans and Greeks conquered “all of the entire known world”. Afghanistan was conquered by at least two Indian emperors Chandragupta Maurya and Ashoka/Asoka besides the Huns and the Khans above. Alexander never conquered India and his so called benevolence of giving India back to the Indians as Lord Macaulay taught the Indians was simply to pump down Indian accomplishments and achievements to pump up British accomplishments through their western counterparts.

As regards the relative wealths of the Greeks with their olives, Egyptian with their cotton, babylons with their almonds, Romans with their grapes the best measurement is their relative trade baskets compared to ancient India. As regards their religions, gods, goddesses the relative religious scriptures they have and worhsips paractised today in these countries would testify the depth of their religions. Hinduism and Judaism withstood the invasions, oppressions, progroms, prosyletisation of the foreigners. What more the scriptures and srutis of the Jews and the Hindus and their temples/synagogues are still venerated by their devotees. What about the Romans, Greeks, Egyptians, Babylonians, Aztecs, Arabs etc? The true test of a religion is its deep rooted existence and not a fad which could have been copied from anywhere. Simply because the IPad is made in China today does not mean that the idea for the IPad originated in China. It may or may not have.

If ancient Indians could take Hinduism up to Sumatra and Malaka and built temples there they could have designed even the Egyptian pyramids. If Indians could have built Anghor Vatt in Cambodia and abandoned it for the French to discover it in the 18th century they could have travelled to Egypt. It is relevant to re-appraise the full impact of the musings of Strabos the Greek geographer who claimed that one ship sailed from India to Greece & Rome via Alexandria in the first century AD. The Romans were losing about 1% of their GDP to the luxury goods from India around that time.

This list of words above however is not an exhaustive list of all Sanskrit words similar to English but only teaser to prod others to investigate further. This sort of literary, religious, civilization, scientific connections between India and Europe could be the reason why some of the best brains in the world like Oppenheimer, Wheeler, Bailey, Voltaire, Mark Twain, Von Schlegel, Elliot, Heisenberg, Schopenhauer from diverse fields such as Physics to Literature and Philosophy eulogized and revered the ancient Indian Heritage. Sir William Jones (the author of the Aryan theory) a British colonial judge like Lord Macaulay (colonial educationalist in India) is definitely not in the league of these great men. My Thoughts on Poverty Porn

I just happened to read an item in the Hindustan Times of 10 March 2011 which reported that the British charity Oxfam is sponsoring a comic book for the Indian children to make them aware of Communalism in India. It left a very bad taste in my mouth. To identify an activity as communal the first thing we need to do is identify what secularism truly is. Not secularism according to any British charity wallahs or their Indian followers but according to the Constitution of India. Hence this blog.

Socialism and Secularism are not defined or explained in the Indian Constitution so who will be the arbiter here to explain socialism and secularism? Oxfam, academics, intellectuals, artists, journalists, politicians, charities, busy bodies, movie stars, writers, Booker prize winners?! None of these entities are competent authorities to define socialism and secularism under the Indian Constitution. If a definition is given for these cardinal constitutional principles like socialism and secularism in the Indian Constitution these career socialists and secularists could become unemployed!!!

As regards Oxfam they ought to be aware that there are about a million or so British charities dealing with all sorts of issues under the planet and collecting money. Several of these British charity wallas are paid high six figures in British pounds and Euros. They collect money from the gullible British people by showing them heart wrenching pictures from the developing countries such as India. It is estimated that the British Charity industry is hoarding about £90 billion and several charities lost money in the stock market crash in the wake of the credit crunch. Imagine the employment potential of the British charities to the UK GDP

The UK Charity wallas stopped the business with China now as China could any day make their pounds and Euros worthless due its $3 trillion dollar currency reserves. China still has around 200 million people living on less than one dollar a day which is roughly half the population of the European Union. Yet the British & European charities are not interested. May be it is because their wiggle room to intimidate the developing world with their GDP figures along with per capita incomes is now very shaky. The truth is that in any accounting systems there should be a double entry. If national GDP figures are relevant the national debt figures are also relevant. In the UK's case the national GDP is around £1.5 trillion and the national debt is around £5 trillion in 2010 which is poised to rocket to £10 trillion by 2015. There is a massive pension black hole in the UK which is about £1trillion. This itself exposes that the percapita net income is minus £75,000 a year. Yet the British Charities are not concerned although charity begins at home!!!!

If Oxfam is interested in legitimate charity they should help the Indian people get back their Black Money stashed away in European tax havens including in the Swiss Banks or help India get back all the looted heritage from Britain including sacred, semi-sacred and secular antiques besides several invaluable diamonds like the Kohinoor, pearls, jewels, precious stones etc stashed away in British Museums, other charitable and educational institutions under the duress of European colonialism of India. They will never do it as their industry is dependent on poverty porn. The Tower of London where the Kohinoor is exhibited is one of the most visited tourist locations in London attracting several millions of tourists. Had the Kohinoor been in India or shared with India on a win win basis India could attract more tourists creating tens of thousands of jobs in India from that one diamond alone.

My elder daughter studies in a private school in the UK. She showed her friends the pictures of our house in Kerala. By all standards our house is only a reasonably good house in the locality. She told me her friends at her private school wondered, " We never thought that there could be such good houses in India". The poverty porn practised by the European charities are also damaging the good will of India as an investment and tourist destination through good will denigration. It is not because of any third rate European charities or human rights organisations that the people of Egypt finally brought about spectacular political change over there. The British charities are also a major cause behind the rise of Islamic fundamentalism in Britain. India has about 140 million Muslims and there are no reported cases of them fighting against the NATO in Afghanistan. Yet hundreds of British Muslims are said to be fighting against British forces in Afghanistan.

The British charity wallahs are the primary cause behind the projection of Palestine as the only place in West Asia lacking democracy and the only victimised lot. Now the Charity Wallahs are exposed for their hypocracy. The same was their tactics with the Kashmiri terrorists. Now they have moved on to the Maoists and Naxals in India. How do you think 40 Nobel Prize winners from 12 European countries write to the Indian Prime Minister for the immediate release of Dr. Binayak Sen a person accused of acting as a conduit for terrorists? I do not know the guilt or lack of guilt of Dr. Sen but I know the Indian Prime Minister if he were to ensure the immediate release of Dr.Sen would be committing contempt of court, breach of his Oath of Office, obstruction of justice as the matter is before the High Court. What do these third rate Nobel Prize winners think? That India is a banana republic?

These British charities often show heart wrenching pictures of the starving, diseased, homeless, and frail besides that of animals from developing countries to collect money from the vulnerable British people. This poverty porn coverage of developing countries has a bearing on their tourist arrivals. It is easy to understand which foreign tourist would want to visit a country blighted by disasters, filth, poverty, beggars, disabled, open drains and the lot whilst only showing off BBC's favourite the Taj Mahal? There are thousands of fabulous temples and palaces all over India some of which make the Buckingham Palace look cluttered. If the travel, aviation and the hospitality industry (the tourism industry) in India were to file a class action in the USA for lost earnings and employment due to the denigration of their country by these British charities could go bankrupt.

Amnesty International a British charity was exposed by the UK Sunday Times as having close connections with some terror suspects in the UK. Amnesty was also exposed by the Sunday Times about the £300,000 plus severance package given to their lady CEO. Imagine how many houses can be built in India or Africa with this £300,000 severance package. It is about Rs.2.4 crores in Indian currency. The annual budget of the Amnesty International is about £21 million which is about Rs 160 crores which should be seen in the context that the Tata's in India are planning to offer affordable housing for the low income families at about £7000 and £10,000 for one and two bedroom flats. So how many flats could have been built with £21 million per annum? About 2100. Most of the British charity money is spent on the wages of the British charity employees, their call centre staff, volunteer's commissions etc. This is why despite years of charity porn the poverty in India or in Africa or in South America is not tamed. Sir Bob Geldoff another charity wallah who wanted to make "poverty history" in 2000/01 did not even pay the proper stamp duty for his palatial home according to the last week's Sunday Times.

Many British charities have Royal Patrons including the British Queen to give a boost to their charity business. Green Peace another British charity knows fully well that half of the UK government owned premises are schools. Yes thousands of British schools. Yet only 12 of them were found to be energy conserving. Yet they do not do any campaign in the UK to address this issue. The biggest cause of pollution anywhere is inefficiency which causes the wastage of non renewables like human and natural resources, time and investment. Yet Green Peace is not interested. Another side effect of poverty porn is that it creates contempt in the impressionable minds of the British children for developing countries. This contempt creates complacency in young British minds. Complacency often leads to defeat in a highly competitive world. This is a side effect of denigrating others. Further more, poverty porn places all the burdens on the government for welfare schemes. Without compelling the British charities to spend their money in Britain David Cameron's "Big Society" may not succeed. So poverty porn is an enemy of both Britain and the developing countries at a macro level.

These British charity wallahs could have brought about a meeting of the British and Indian small and medium scale industries benefiting both our nations creating millions of employment in both our countries. They do not want to do that as they relish their right to patronize Indians and citizens of other developing countries. If the open drains were to disappear how can the British Bragging Corporation's (the BBC) cameras focus on it? There are about a million plus households in dire straits in the UK as all that shines is not gold but made with huge borrowings. Millions of People in the UK are neck deep in debt. Yet these charity wallas have no solutions for them. Two weeks ago the Sunday Times published a feature about the leftist lobby in the British schools and since a Deputy School head spoke against it she is now treated as a pariah and can't even get any school jobs. The Deputy Head in question is said to be planning to set up her own school now. So you can infer why the Oxfam wants to focus on Communalism. The BBC, the British Charity Industry, the British School system are all hot beds of not only leftists ideology and some even treat the terrorists with softie softie kid gloves. The carbon foot print of the British Charity Wallahs through international travel and five star life if it were properly audited and placed in the public domain could shock us all.

Many British charities and institutions even receive donations from dictators like Gaddaffi as was exposed by the Sky news in the UK. The so called world famous London School of Economics (LSE) took or received commitments for a million pounds in donation from Gaddaffi's son. The poor and the suffering around the world in whose names these British charities ply their scavenger business of poverty porn now is left with no option but to say to them in loud and clear voice "NO TO POVERTY PORN PLEASE". It is therefore time we all said "NO TO POVERTY PORN PARASITES"

Background Behind My Piece on Pornography and Poverty Porn

I think I watched my first "Blue Film" (porn) when I was in my late teens or early twenties. By that time things have changed. I changed, my village changed, there was electricity, paved roads, buses and taxis started plying, one by one hutments metamorphosed in to bigger houses, children grew up, got married, children with pink runny nose marks and barefeet either went to the University or worked hard in the farm after dropping out to be rich. Illiterate parents we looked down upon suddenly made their mark, farm hands played poker and made money to buy farms of the losers and continued to play poker to pay their labourers, others went in to nursing and migrated to West Asia, professionals began to emerge from our rustic village, my uncle became a finance minister and we as a family with higher bramnic ideals were left way behind.

Ghosts, lightning, elephants, tigers, leopards, flash floods, snake bites didn't kill me as they all got decimated in a scramble to make money to escape hunger, poverty, deprivation, insults, humiliation. And I reached the law school from a little known lower primary school (LP School) via the Upper Primary School (UP School) landing in a boarding school in the city learning English the hard way under the strict instruction of my second from eldest brother who himself migrated to the city after dropping out of college to pursue a life of business and home study. The rest of the villagers were wiser as they made more money biding their time and hiding their strength like China does now. For some time since 2001 I had the time to meditate on the activities of the charities for the humans and the animals alike. For me it was immoral for charities to hoard billions of pounds they collected from the public.

On Bloomberg I heard today that China is investing $35 billion to improve the railways in Africa so that the African minerals reach China faster without the infrastructure bottlenecks. Which western charity has done such a thing? The western charities had an opportunity to prod their governments to initiate such strong economic joint ventures in Africa but they squandered that opportunity. Now the charities are not in a position to match China's financial muscle. I believe what the roads and electricity did for my little village in Kerala could do the same for Africa. The western charities were clearly on an ego trip in vanity and patronisation. Now they are complaining about China's dominance in Africa. Even now it is not late as China's control of African resources should be regulated in an atmosphere economic checks and balances.

The charities could play a key economically productive role in Africa if they bother to change their mindset. The slums in India alone could be transformed through affordable housing schemes benefitting both the small and medium industries in the west in collaboration with their counterparts in the west. The Tata's are planning to sell affordable 1 and 2 bed flats for the low income families in India for £7000 and £10,000. How many such flats could be built in a win win economic partnership with £1 billion? The British Charity Industry hoards about £90 billion according to a statement by a UK minister on Bloomberg just a couple of weeks ago. It is always better to teach someone to fish than give him a fish as China is doing now.

I Don't Envy the Rich But I Love the Poor More

I don't envy the rich although I used to as a kid. We were not dirt poor. Our family GDP was more than OK for a village in Kerala. The problem was in the per capita income. As a family of 13 (11 children plus father and mother). Although we were one of the leading land owning migrants in and around our village, families with one or two children always had more money to spare. None of the villagers were however in the league of were major land owners called the "Estate Owners" who inherited their riches from the British as a family or as a corporate. They rarely showed their faces in the village, the best interaction migrants like us had with them was via the "Estate Managers".

There was always a Rocking Horse Winner (D H Lawrence) kind of atmosphere at home. So I always considered myself very poor no matter what our neighbours said. We were struggling always as a family of 13 with our unrealistic life style. Going to the hospitals in the city instead of seeing the herbal or homeopathetic practitioner. Always avoiding the far more economical village hospital, staying in ensuite rooms instead of using the general maternity wards, sending children to the university in the cities.

Although we wore some of the best clothes in the school there were a few others who wore better shorts and shirts. I did not envy anyone's shoes though as only a few of the students had flip flops or sandals let alone shoes. We are talking about a school with some 2000 students or thereabouts. Most students had only one or two cotton shorts and shirts. But a few had polyester shorts and shirts which stirred up envy which in turn set off silly fights or taunting or bullying.

Some students even walked bare feet 8 miles to the school. Civilisation was in a stand still in our village like many other migrant villages of mud shacks, dirt roads, good houses which stood out as an "eyesore" in a poverty ridden desert of hutments, no running water, no electricity, no television let alone radios, no toilets, mammoth rains, lightning, summers, monsoons, malaria, snake bites, cobras, vipers, pythons, scorpions, spiders, creepy crawlies, leopards, tigers, bisons wild elephants which raided the villages. Sometimes we heard about people getting killed.

On top of that I also had to fear the Satan, ghosts and all other stuff just like other kids. Once in a while a "Jeep" or a lorry would pass through our village and we could hear the sound from a mile away. The aroma of petrol fumes lingered on. It was all so quiet and pure and we could hear and smell everything. Even the ripened mangoes under the trees we could smell from twenty feet away. The mangoes fell when it was fully ripe. What was not eaten were eaten by the cows or the pigs or the rodents or beasts or whoever fancied it. There were no buyers for mangoes as everyone had mango trees in their farm just like banana palms, pepper vines, tapioca pads etc

I would n't say politics and economics is in my blood but it got in to my blood because my paternal uncle was a lawyer and an aspiring politician. Once in a blue moon his photos and statements appeared in the Malayalam daily. By the age of eleven I fancied imitating his budget speech I listened on our little radio. The radio was treasured by us all more than any IPad can ever dream of. It was a puni little radio with a leather jacket. A radio which ran on two battery cells. When the batteries ran out it sometimes took a week or more to replace. We could even listen to Malayalam programmes broadcasted from Ceylon Radio on short wave.

Despite all my pretensions before strangers deep down I always believed that I was poor as I knew the poverty within our home.

I, Johnson Thomas K (“the Informant”) an Indian citizen resident in the United Kingdom for the past 14 years, a former advocate of the Honourable Supreme Court of India (“the Supreme Court”) and a solicitor of the Supreme Court of England and Wales, an author, a former trustee of the Naz Foundation of India, a conscientious votary for the recovery of the looted Indian Heritage expropriated under the duress of colonial occupation of India submit this representation before the Honourable Prime Minister (“the Prime Minister”)

The Informant has come to know on 09 February 2011 through NDTV (“NDTV”), a reputed news channel based in India that Dr. Binayak Sen (“Dr. Sen”) a champion of human rights for the Maoists has been sentenced to life imprisonment some time ago on the charges of sedition by the Honourable District and Sessions Court (“the District Court”) in Raipur, Chattisgarh.

The report by NDTV has also claimed that Dr. Sen is currently seeking bail through the Honourable High Court of Chattisgarh (“the High Court”) and that he is duly represented by one of the most eminent Constitutional and Criminal lawyers in India, Mr. Ram Jethmalani (“Mr.Jethmalani”) who is also a member of the Raja Sabha. The legality of this representation is in no way reliant on the outcome of the bail application or the hearing in the High Court.

In spite of such best possible legal representation for Dr. Sen the report further stated that observers from the European Union who claim to be neutral observers (“the EU observers”) have been attending the proceedings before the High Court to ensure the proceedings before the High Court protects Dr. Sen’s human rights amongst other things. The EU observers are part of the EU Executive who is deemed to be aware that the Executive in the EU has no observer or supervisory status over the EU judiciary.

The report also referred to the previous hearing before the High Court where the EU observers sought special permission to attend the proceedings which was granted. The Informant has also learned that the Amnesty International a British charity specialising in the advancement of human rights for several internationally banned organisations have declared Dr. Sen as a prisoner of conscience. It is pertinent to mention here that the Sunday Times of the UK has exposed the connection between some functionaries of the Amnesty International and some of the UK terrorism suspects whilst they hold out as mere champions of human rights instead of the human rights of those accused of terrorism. The Informant concedes that Amnesty International has every right to champion the human rights of those accused of terrorism and sedition so long as they do not monopolise the meaning of human rights to mean solely for those accused of terrorism and sedition.

The Informant believes that Maoists are an internationally banned terror organisation under the UN and under the Indian law anyone who assists, facilitates, induces, funds, propagates their ideology of violent overthrow of a democratically elected government through force by being a conduit or courier is an accessory under the Indian law just as under the EU laws including the United Kingdom where the membership in a terror organisation is a serious crime. The failure of the Prime Minister’s government in not challenging the recent Supreme Court judgement which exonerates those who are members of a terrorist organisation ought to be seen in this context. The Indian judiciary has proven beyond any doubt that it is capable of interpreting; protecting and dispensing the human rights of even those convicted of terrorism as Mr. Ajmal Kasab in the Mumbai terrorist attack of 26 November 2008 and the EU observers are deemed to be aware of this. Yet the EU special interest for those accused of Maoist terrorism in India is a matter of concern for several members of the civil society in India which is not the monopoly of a few who tries to advance the human rights of only those accused of serious crimes like terrorism, treason and sedition.

The Informant has also came across an interview by NDTV a month or so ago of Dr. Amartya Sen a Nobel Prize winner in Economics and a University of Cambridge professor who during the course of his interview by Ms. Burkha Dutt an eminent Indian journalist stated that he is a close friend of the Prime Minister and that he believed that Dr.Sen should be released and acquitted. The Informant is concerned whether the Prime Minister is reflecting Dr. Sen’s views instead of his mandated duties. It is relevant to submit here that the Nobel Committee refused to give a Nobel Prize to Mahatma Gandhi at least five times despite him being considered for the prize.

The Informant is alarmed that a group of 40 Nobel Prize winners predominantly from the 12 European Union nations as a united entity cum pressure group (“the Nobel pressure group”) has written to the Prime Minister of India to ensure Dr. Sen’s immediate release as if the Prime Minister ought to influence the proceedings before the High Court.

The Informant as a citizen of India and a lawyer with dual qualifications is alarmed at the silence of the Prime Minister in not explaining to the Nobel pressure group that any influence by him on any judicial proceedings in India would make him liable for contempt of court/obstruction of justice/perversion of the course of justice/discrimination besides in the denigration of the Constitution of India including its Doctrine of Separation of powers and the violation of his Oath of Office as the Prime Minister of India.

The Informant believes that giving any special treatment to one India citizen whether he is Dr.Sen or any other whilst thousands of under trials including those accused of terrorism are languishing in Indian jails for years would set a precedent where EU observers and a group of European Nobel Prize winners acting as a pressure group whether jointly or severally could secure speedy trial and a bail even in serious charges such as sedition beyond the intent and purpose of the concept of equality before law, equal protection of the laws, constitutionalism and the concept of Rule of Law in general without which there is no human rights protection. The EU observers who claim to be from rule of law countries are deemed to be aware of it and if they are not the Prime Minister has a duty to inform them about these issues which are germane to the human rights protection of all citizens of India and not a select few. The Informant believes that the Prime Minister has a duty to defend the Indian judiciary from such organised and concerted attacks by informing the people of India about his refusal to interfere with the judicial process in India as demanded by the pressure group of Nobel Prize winners.

The Informant has also noticed from the NDTV report that the Government of India is planning to file an affidavit on 9February 2011 in the Honourable Supreme Court of India in a matter pertaining to the stashing away of laundered and “Black” money in several tax havens in Europe/EU including in Switzerland by several Indian nationals and even charitable foundations.

The Informant notes that all tax evasions and their fruitage; the so called Black Money (“the Black Money”) is nothing but money laundering and every member nation of the United Nations since the terrorist attacks in New York (“9/11”) is authorised and mandated to take proper steps to monitor, detect, arrest money laundering including through what is called the “Hawala” and as such the Government of India is barred from hiding behind international treaty obligations in not prosecuting such tax evaders in India. It is an accepted fact both under the Contract Act as well as Public International Law that there cannot be a treaty to facilitate an international crime or where the object is to afford privacy, immunity and confidentiality from law enforcement and prosecution through a perverted expansion of the duty of confidentiality. Even if there were such provisions or clauses in an international treaty they are rendered unenforceable under the international provisions against money laundering and the guilty governments are liable to be prosecuted under International Law. Furthermore the object of every valid international treaty is deemed to be lawful similar to the domestic contract laws and no treaty could be entered to subvert the operation of the Constitution of India or any part of it including the role of the Judiciary or the sovereignty of Republic of India exemplified by its tax laws. It appears that the Government of India under the Prime Minister has misled the Supreme Court and the 1.2 billion citizens of India in the Black Money matter pending before the Supreme Court.

The Informant is also concerned that the European Observers have chosen to ignore the proceedings before the Supreme Court in the Black Money matter whilst they are monopolising the human rights of Dr. Sen. The Informant firmly believes that the European Union including their observers currently in India are bound by their obligation to co-operate with every other country in their anti-money laundering commitments and report the money laundering that is taking place through the European Banks in their respective tax havens including the Swiss Banks. It is pertinent to mention here that several EU member nations besides the United Kingdom mandate every professional including lawyers to report money laundering activities of their clients despite their duty of confidentiality to their clients and thus the EU which has waived duty of confidentiality for bankers, lawyers, financial professionals to facilitate the investigation and prosecution of money laundering cannot impose a contrarian standard on India to favour the tax havens which hoard the tax money due to the Government of India which is public property. The government of India is also barred from alienating Indian property such as tax revenue to other sovereign nations to benefit them to the detriment of nearly 500 million aam aadmi of India who survive on less than one dollar a day which the EU observers and their governments have reason to know. The Solicitors Act read with Financial Services and Markets Act in the United Kingdom mandates the overriding of the duty of confidentiality owed by both the banks and the lawyers to their depositors or clients as the case may be to enable the investigation and prosecution of all financial crimes including money laundering. It appears that there cannot be an operational treaty between any two sovereign nations to facilitate money laundering or black money and India is barred from being an accessory to money laundering.

The Informant believes that the Prime Minister ought to inform the EU observers upon their return from the Chattisgarh High Court that all the laundered money from India in their respective jurisdictions ought to be seen in the context of the anti-money laundering obligations in the EU member nations read with the UN resolutions and they have a duty to disclose to the Government of India on the strength of their commitments to the International Community to fight money laundering in the wake of 9/11 as black money and laundered money are a major source of funding for terrorism, subversive anti-national activities, violent over throw of democratic governments, human trafficking, drug trafficking and other serious organised international crimes. According to some estimates the money stashed away in Swiss Banks from across the dictators and the corrupt in Asia, Africa, and Latin America is believed to be around $11 trillion. According to a US think tank India alone might have lost at the least $400 billion. According to the claims by a Swiss Bank whistle blower who passed over a CD to the Wiki-Leaks founder more than from any other country tax evading Indian citizens are the major benefactors of the Swiss banks including UBS, Credit Suisse etc. This was also reported by NDTV a few days ago. The EU banks in the tax havens are the biggest violators of the human rights of the citizens of the developing nations who are victimised by dynastic rulers, dictatorships who harbour the looted national wealth of the developing countries in tax havens. The Prime Minister is duty bound to protect the best national interests of the citizens of India and not that of the tax havens or the tax evaders

The Informant believes that the Prime Minister has a duty to protect the national interest of India he solemnly undertook to protect through his oath of office and inform the EU observers that all the Black Money stashed away in their respective jurisdictions ought to be repatriated back to India as this money belongs to the 1.2 billion citizens of India and is badly needed to implement, protect, advance and improve the human rights of all citizens of India as below;

a) To build and equip more courts across India to ensure speedy trials in India to prevent delayed justice fomenting denied justice and to curtail human rights violations there from.

b) To train, equip and appoint more police officers, lawyers and Judges in India to increase the judge, police, lawyer and population ratio in India to enhance human rights protection across India.

c) To create a police force independent of the Executive in India which was thwarted by the machinations of Lord Macaulay during the British colonial occupation of India and to equip all police stations in India with live video recording of police interrogations in the presence of legal representatives of all accused persons in India and their victims and thereby promote the human rights of all instead of just a privileged few like Dr. Sen who has EU support and Nobel Pressure Group sponsorship.

d) To set up special courts to try serious crimes with international and national ramifications and to train and equip judicial and non judicial staff in all these courts to promote and protect human rights as never before.

e) To set up a niche federal investigative agency dedicated to the investigation, detection of serious economic crimes both domestically and internationally to prevent money laundering, bribes paid by EU companies to secure contracts like the Bofors or the bribes paid by the BAE to Saudi royal family to secure multi billion dollar defence contracts which has been successfully investigated and prosecuted by the US Justice Department. This would prevent Indian citizens from becoming victims of serious economic crimes through the loss of their tax money needed for their education, health care, housing, slum eradication, economic, cultural, religious and democratic rights.

f) To set up a comprehensive Legal Aid fund to protect the interests of all accused persons in India both in courts and police stations who otherwise could be deprived of access to justice which is the most important human right without which all other human rights will flounder. The ordinary citizens of India accused of terrorism or sedition cannot even dream of availing the services of eminent lawyers like Mr. Jethmalani is a fact the Prime Minister ought to consider whilst repudiating the EU and Nobel Prize pressure groups request to ensure the release of Dr. Sen. It is imperative that the Prime Minister’s government should give full legal aid to Dr. Sen so that he has the best defence without the help of any EU agencies or donors especially when they are the beneficiaries of the looted Indian Heritage expropriated under the European colonial occupation of India.

g) To set up a comprehensive witness protection programme across India to prevent witnesses from being influenced in any way whether through intimidation, threats, physical attacks, emotional torture including harassment, inducement or any other means to protect and promote human rights of the witnesses and the accused including those accused of terrorism and sedition.

h) To set up a comprehensive fund for the counselling, training and rehabilitation of all prisoners in India during and after their jail term and to enable them to secure gainful employment and help them become worthy contributors to the society if they so consent. And to modernise all prisons and jails in India to enhance the human rights of all prisoners.

i) To set up institutions in the educational, health, cultural and affordable housing, sanitation and environmental protection sectors and to train, teach, fund and employ professionals including teachers, doctors, nurses, pharmacists, counsellors and other professionals so that the citizens in India enjoy Right to Health as a human right along with right to livelihood, education, economic, cultural and religious rights and their promotion, protection and monitoring in an environment of guaranteed rule of law rights for all without which human rights would only remain on paper as in dynastic and dictator regimes.

j) To protect the environment by providing basic amenities to the people of India through running water, toilet facilities, basic accommodation, implementation of covered drains instead of open drains, refuse collection and recycling facilities, implementation of environmental protection through modernisation of all polluting industries, recycling plants etc. There is very little evidence to suggest that the EU observers and their EU governments could be against comprehensive human rights and environmental protection in India.

The Informant pursuant to paragraph 1 to 15 above believes that no EU observer or EU member nation could be disinterested in the human rights protection accessible by the Indian citizens through the repatriation of the stashed black money which once operationalised could be the largest human rights protection scheme by any government in human history. Dr. Sen or his supporters, friends, if they are not inclined to being a beneficiary of the repatriated black money still would be enjoying the right not to benefit from such repatriation of black money from European tax havens. The opinion of Dr.Ilena Sen that the High Court of Chattisgarh ought to cede observer status to the EU observers because the Chattisgarh government is in receipt of 80 million Euros in AID only reflects a pressure tactics sponsored by the EU observers to create subservience amongst Indian citizens and destroy their right to national sovereignty and dignity where the latter is a human right in its own right.

The Informant having already served a legal notice on the Prime Minister enquiring about the action taken so far by the Government of India to bring back the Indian Heritage looted under the duress of European colonial occupation of India is still awaiting a response. The Informant also brings to the attention of the Prime Minister that several European charities collect money from their gullible EU citizens in the name of the poor, the ailing, the homeless, the illiterate, the tribals and the victims of natural disasters in countries like India on top of their animal and bird charities purported to protect these animals in the developing world. A case in point is that the British charity industry which alone hoarded about £39 billion pounds according to a report by the British Charity Commission in 2008. The Informant believes that there are about a million charities in the UK alone which would show that there could be about a million people employed by the British charity industry alone through poverty porn. The British Charity Industry is often used as cover to swing contracts in favour of domestic companies in Europe and many charities employ chief executives who earn high six figure salaries in Euros and Pounds. The Informant is yet to hear about a charity in Europe orientated for securing compensation for the victims of paedophilia by the Catholic Church in the wake of about $800 million dollar compensation awards in the US courts. This information the Informant does not believe would absolve the Government of India’s culpability for manslaughter in allowing food grains to rot whilst millions of aam aadmies die of hunger and tax havens profit at the expense of millions of hungry and malnourished Indian citizens. Every starvation death is manslaughter/culpable homicide not amounting to murder when caused by the Indian state whilst food grains are rotting in government run warehouses or when food and staples for public distribution are diverted by the corrupt bureaucrats of the civil supplies corporations and ration shop owners due to their commissions or omissions or plain heartless negligence. Causing death in the UK through negligence amounts to manslaughter.

The Informant believes that the Prime Minister in his confabulations with the European Union leaders ought to inform his EU counter parts that India believes in the protection of the human rights of all including those accused of serious crimes such as terrorism and sedition besides their victims and that under the Indian Constitution the human rights of the accused and their victims are equally important to constitute the protection of human rights without any barriers or class or discrimination instead of protecting it only for a class of citizens as the EU observers propose through their observer status. The victims of crimes in India number millions even by a conservative estimate as every incidence of corruption constitutes a serious violation of the right to dignity, right to equality before law, right against discrimination, right against harassment and bullying and right to rule of law where the corrupt government servants across India are the major perpetrators. Had the Supreme Court of India held that the Prime Minister as the de facto head of the government is liable for the break down in Rule of Law and Constitutional Machinery as illustrated by rampant corruption across India he would have been liable to be indicted.

The Informant believes that the Prime Minister ought to disclose to the people of India the names of the 40 Nobel Prize winners and the EU observers so that the people of India can petition them in a democratic way exhorting them to consider the human rights of Indian citizens who are the descendants of the victims of colossal human rights violations during the European colonial rule of India and take appropriate legal action such as the class action law suits brought about by the victims and the descendants of Hitler’s genocide or against the Swiss Banks who even profited from the melting of tooth fillings of Hitler’s genocide against the Jewish people, besides the slave labour and won multi-billion dollar settlements in the United States of America. There are millions of surviving Indian citizens over 63 who could be direct victims of the European colonial occupation of India whose human rights including their right to compensation through class action could also be protected if the EU observers adopt a similar approach they adopted solely for Dr. Sen in exclusivity.

The Informant also believes that the civil society in India being a neighbour of Afghanistan a fellow SAARC member has a right to petition the EU observers and the 40 Nobel Prize winners to write to the President of Afghanistan where bombing by the NATO forces could have resulted in the human rights violations of thousands of Taliban and Al Qaeda operatives besides that of innocent non combatant civilian victims who were mistakenly bombed out of existence. It is pertinent to mention here that several EU nations are also members of NATO and can easily secure observer status in Afghanistan under the protection of the NATO. The civil society in India definitely has an interest in the stand of the 40 Nobel Prize winners as regards the human rights including the religious and democratic rights of the 1.3 billion Chinese and Tibetan people and other human rights as espoused by a fellow Nobel Prize winner His Holiness the Dalai Lama especially because his Holiness is in Dharamshala in India and China is India’s neighbour. These human rights of the Chinese people could not be sidelined for EU companies and governments to get market access in China or in fear of the vast $ 3 trillion Chinese foreign currency reserves which could determine the value of the Euro, the GDP and per capita incomes across Europe as pointed out by a Japanese political thinker who considers it the new Mutually Assured Destruction (MAD)

The Informant apprehends that the people of India will be alarmed to learn that the Prime Minister is complicit in the obstruction of justice pursuant to paragraph one to 20 above making his position untenable if he were not to inform the 40 Nobel Prize winners defending the sanctity of the Judiciary and Judges in India besides the supremacy of the Indian Constitution which is not subject to his doctrine of pleasure.

The Informant wrote to the Prime Minister enquiring about the steps the Government of India has taken to get the Indian Heritage expropriated under the duress of European Colonial rule repatriated back to India as they impinged on the religious, educational, economic and cultural rights of the citizens of India besides the Human Rights flowing from Right to worship as many of these looted ancient Indian artefacts include sacred and semi-sacred jewellery and idols belonging to all religions in India besides secular artefacts. According to Mr.Kuldip Nayyar a former High Commissioner of India to the UK in the wake of the auction of Gandhi’s letters/Tippu Sultan’s sword bulk of the looted Indian Heritage was lying undocumented and un-catalogued in the British Museum stores when he visited that Museum. The Informant suspects that there is a massive laundering of looted Indian Heritage through the western auction houses. Yet the Prime Minister or some of his ministries of culture, archaeology are not even interested and they admitted that they have not made a single correspondence to recover the looted Indian Heritage whilst the Informant spend his own money to engage lawyers to serve legal notices and take legal action. The Informant learned that there are sadly High Court Judges like Justice Mr.Sharma of the High Court of Delhi who believes that his writ petition was like what the “Shiva Sena” demands despite him relying on the opinions of the world’s best brains like Oppenheimer, Voltaire, Wheeler, Einstein, Mark Twain who all eulogised and revered Indian Heritage unlike Indian historians like Ramachandra Guha, Promila Thapar, Macaulay and the Booker Prize winners from India. Justice Mr. Sharma may be like Justice Mr. Dinakaran, Justice Mr. Balakrishnan or several others who ruin the good standing of the Indian judiciary. Macaulay’s contribution of the police being subservient to the Executive to perpetuate British colonialism and keep the Indian citizens in subservience is relevant in context

The Informant firmly believes that the Prime Minister ought to discharge his duties to the 1.2 billion people of India in the matter of the recovery of the tax and the principal from money laundering as well as in the recovery of the looted Indian heritage expropriated under the duress of European colonial occupation of India where such duress vitiates the sanctity of all legal documents the EU claims as a defence against their loot and laundering of the Indian heritage. The proceeds of crime including through money laundering and Black Money stashed away in tax heavens belongs to the Republic of India along with their principal, interest and tax. The failure of the dictatorships and dynastic rulers besides the aggressive prosecution of the corrupt in India would destroy the solvency of the banks in tax havens and they have an interest in keeping India a corrupt country steeped with internal conflicts, dynastic rulers, an opaque bureaucracy, a national constituency of disgruntled population who would resort to violence to protect their banks. The onus is on the Prime Minister to declare before the nation whether he or his party has received any political donations from the front organisations or companies where banks or financial institutions in tax havens have a direct or indirect holding whether or through subsidiaries or charitable foundations.

The Informant firmly believes that there was a serious denigration and subversion of the Constitution of India through the indirect imposition of an extra constitutional authority through the office of the United Progressive Alliance (“the UPA Chairperson”) cum National Advisory Council Chairperson (“the NAC Chairperson) cum National President of the Majority Party in the Lokh Sabha collectively called the Extra Constitutional Authority. It is clear to the Informant that the office of the Prime Minister is subject to the Doctrine of Pleasure of “the Extra Constitutional Authority” who is not a constitutional authority upon whose pleasure his tenure is reliant. The denigration of the Constitutional office of the Prime Minister and his cabinet by making them answerable and accountable to extra constitutional authorities is not with the informed democratic consent of the 1.2 billion Indian citizens but through misinformation and deception to facilitate party political advantages for political dynasties that thrive on sycophancy. It is alarming to state that there are no such extra constitutional authorities of “the UPA Chairperson” over the offices of the President of the United States of America, the Prime Minister of the United Kingdom, the President of France or the German Chancellor or for that matter any other prime minister or president of a robust constitutional democracy. The installation of “the Extra Constitutional Authority” therefore is a betrayal of all the millions of freedom fighters who sacrificed their lives including the Father of the Nation for making India a Constitutional Republic and not merely a democratic nation of dynastic rulers. The onus is on the Prime Minister to pilot constitutional amendment motions/Bills in the Lokh Sabha and get it passed to legitimise the operation of extra constitutional authorities in India instead of doing it through the denigration of the constitution to appease ruling party sycophants.

The hall mark of dictatorships and dynastic rulers across the world is that they are corrupt or complicit in corruption and denigrate constitutional institutions as in Egypt. The reports that Mr. Hosni Mubarak has a fortune of $70 billion stashed away in Switzerland and Britain is alarming and may be it is time the Supreme Court ordered a CBI investigation under the Supreme Court’s own supervision in to the ill- gotten wealth of the dynastic rulers of India both at the Centre and in the states stashed away in European tax havens. It is pertinent to submit here that in no democracies like the USA, the UK, France or Germany the ruling parties’ national president is above the relevant presidents, prime ministers or chancellor as the case may be. When the Forbes Magazine ranked the Extra Constitutional Authority as the 3^rd, 6^th and 9^th most powerful person in the world in 2004, 2007 and 2010 respectively above the Prime Minister, the Chief Justice of the Supreme Court, the Speaker of the Lokh Sabha it was accomplished through the denigration of the Indian Constitution as the informed consent and will of the people of India is not to set up any Extra Constitutional Authority over these three entities.

The Informant believes that every incidence of corruption in India is a serious break down in Rule of Law and Constitutionalism and thus pervasive corruption in India is a clear instance of institutionalised break down of the Constitutional Machinery as a whole. The complicity in corruption through silence, inaction, prevarication are all equally culpable because it is those who are complicit in corruption who afford the corrupt the immunity and a safe haven betraying the informed democratic and constitutional will or informed national best interests of about 1.2 billion citizens of India.

The Informant firmly believes that the silence of the Prime Minister and the Law Minister when the integrity of the courts were challenged by the European Nobel Prize pressure group asking him to ensure the immediate release of Dr. Sen in tandem with the EU observers’ supervisory jurisdiction over the Indian courts is a sad day for India. It is important that the Prime Minister appreciates the High Courts and the Supreme Court do not have spokespersons in an age of media explosion to defend against criticisms. It is important that the Prime Minister ensures the establishment of Judicial and Regulatory Institutional Infrastructure across India so that the citizens of India are protected from the patronisation and grand standing of the EU and European Nobel Prize winners and the Indian busy bodies who support them. As cited earlier the EU member nations are the worst human rights violators in the world due to their genocide of billions of people in Asia, Africa and South America over the past few centuries where only the Jewish victims of genocide have secured compensation. As such the Prime Minister had a duty to defend the Constitutional Institutions of India and the self respecting citizens of India from the EU patronisation, lecturing, neo-colonisation through selective human rights protection, cultural imperialism etc. Protection of National Pride is not a bad thing neither is the protection of constitutional institutions but what is now happening in India is the systematic denigration of constitutional institutions to promote the status of extra constitutional institutions as cited earlier. The denigration of the Constitutional institutions like the CVC, the Election Commission, the Central Information Commission and others like the CBI etc are all matters in the public domain. The orchestrated propaganda by many of the EU funded charities in India against the Judiciary is also an attempt to denigrate the supremacy of the Judiciary before the extra constitutional dynastic rulers and their votaries and the Prime Minister ought to disclose the names of the Nobel Prize winners and the EU observers for the purposes of paragraph 1 to 25 above. The government’s duty is not to run commercial enterprises like Air India or Insurance Companies or Banks and sustain losses as a pretext not to fund institutions of governance and sabotage governance which is its fundamental duty.

The Prime Minister instead of being proactive in the areas mentioned in paragraphs above is denigrating the existing constitutional institutions such as the CVC, the Election Commission, the Central Information Commission and other institutions like the CBI, the Enforcement Directorate etc through the appointment of individuals with questionable integrity. It is unfortunate that instead of admitting his own failures through inaction, prevarication, silence , delay etc in combating issues of governance the Prime Minister chose to blame the Judiciary for being proactive.

The Informant has come across extremely serious allegations about the integrity of the Extra Constitutional Authority (the UPA cum NAC Chairperson) and some even relate to forgery involving her birth certificate, holding of both Indian and Italian citizenships, holding of Swiss Bank accounts, having questionable antecedents and associations even with the ISI/KGB/LTTE and Maoist organisations besides others. The Informant appeals to the Prime Minister to confirm to the citizens of India that this is not the case instead of rubbishing such extremely serious allegations. It is pertinent to submit here that the Extra Constitutional Authority and her family are given all immunity from investigation under the guise of their right to privacy/human rights/right to reputation and such other fictitious grounds. If subjecting oneself to investigation and judicial proceedings would breach right to privacy in India then all people arrested or investigated in India are deprived of their so called privacy. There is no right to privacy to prevent investigation in any transparent, robust, constitutional democracy anywhere in the world is a matter worth considering. When the former President of the United States Mr. Bill Clinton was investigated for perjury/obstruction of justice in the infamous Paula Jones case there was no Central Information Commissioner or Election Commissioners or High Court or Federal Judges in the USA obstructing the course of justice there. Any person who lies to the police or any other investigating agency or to the court or to any statutory body could be tried for obstructing the course of justice/perverting the course of justice/perjury/evidence tampering/forgery as the case may be is a fact that the Prime Minister ought to appreciate. It appears that the charges investigated against Dr. Sen is relatively less serious compared to the allegations against the Extra Constitutional Authority. It is a sad day when the Central Information Commissioner and the Punjab & Haryana High Court Judges claimed that revelation of the Extra Constitutional Authority’s religious status given in the Indian census would infringe her privacy. No privacy of President Obama was breached when his religious affiliations including his association with Reverend Jeremiah was discussed thread bare across the American print and television media and the internet. The rulings of the Central Information Commission and the Punjab and Hariyana High Court that the Extra Constitutional Authority’s faith is like a state secret and private when it is even mentioned on Wiki-Pedia as Roman Catholicism is motivated to protect the ruling party’s Hindu Vote bank or thwart inferences against her for her families associations with the religious conversion lobby in India’s tribal belts. There is no outstanding privacy in a matter which is already in the public domain is an accepted fact in all Rule of Law countries. The Informant through this letter appeals to the Prime Minister not to obstruct the course of justice in any manner or form by not disclosing to the relevant investigating agencies in India the contents of paragraph 29 above concerning the Extra Constitutional Authority so that conclusions are arrived at only after proper investigations monitored by the Supreme Court. It goes without saying that the Prime Minister is barred from being an accessory or being complicit in matters concerning the Extra Constitutional Authority as it impinges on the supreme national interest of the Republic of India
It is a pity that some 460 government schemes of the government are named after the ruling dynasty of India besides all major landmarks and institutions according them undue clout, voter recognition and thus electoral, political and dynastic advantage. Even the London Heathrow is not named after the British Queen neither are other Airports or Harbours or Universities, Railway Stations which itself exposes the monarchic and dynastic nature of the government of India and their ruling party to sustain the Extra Constitutional Authority. There are a galaxy of freedom fighters and leaders whose names could be considered to rename these landmarks, institutions and infrastructure projects and government schemes if the government were to follow genuine democratic governance instead of dynastic politics. The ruling dynasty favouring the Kerala Bureaucracy in all key departments is not what true informed federalism in Indian bureaucracy that over 20 million people of Kerala deserve as they too like other Indian citizens want protection from corruption, jobs, homes for the homeless, dignity, human rights, genuine democracy and not crony democracy or dynastic rule. As the democratic leader of the world’s largest democracy the Prime Minister also has a duty to protect the dignity and goodwill of the Indian Republic as foreign investment and tourism inflow is based on goodwill of a nation and its democratic credentials. The denigration of Indian Heritage along with infrastructure bottle necks and the looted Indian Heritage on foreign shores benefiting the tourism of those countries is robbing millions of jobs in the aviation, transport, hospitality sectors. All of Indian heritage in India is in a bad state of disrepair except the Taj Mahal and a few Islamic monuments. Heritage Protection like Human Rights protection is not religion or class specific is a fact the Prime Minister ought to appreciate. When the Prime Minister and the Republic of India are lectured and patronised by any EU observer the Prime Minister is well within his rights to point out the right to compensation of the victims of the European colonial genocide, human rights flowing from the ban on burqa, turbans, the human rights of the Romany gypsies in Europe are descendants of the people of Rajasthan amongst others as the WTO based trade permissions granted to the EU is not a licence to patronise India. Pursuant to paragraph 1 to 30 above the Informant submits the following as his direct appeal to the Prime Minister for his time bound action as a matter of priority as there could not be any priority more important to governance for a democratic government.

Direct Appeal to the Prime Minister for Urgent Action

The onus is on the Prime Minister to consult the state governments where the matters below are exclusively in the state or the concurrent list as he is the leader of the nation. Most of the much needed reforms below could be achieved within a year if there is a political will. The nation would be behind the Prime Minister if investigations he orders results in his unseating or expulsion from the ruling party. However, it is alarming to learn about the Prime Minister’s criticisms about Judicial Activism when it is warranted by the “In-activism” of the Executive of which he is the de facto head. The proactive Judiciary is the only hope for the millions of people in India who are persecuted, harassed and bullied by the bureaucrats through corruption and injustice. From these premises the Informant appeals the Prime Minister to be proactive in the coming Budget Session and implement the following governance, legal, administrative reforms as listed below;

a) The Informant appeals to the Prime Minister to allocate 2% of the GDP for Judicial and Regulatory institutional infrastructure in the coming budget

c) To abolish all British era draconian laws which were orientated to make the Indian citizens to be at the mercy of the Indian bureaucrats who use this as duress to extract bribes.

The Informant undertakes to submit documentary evidence before the Prime Minister upon reasonable notice and is even prepared to testify before any other agency or institution in the interest of promoting Rule of Law and Constitutionalism in India if he is accorded the protection under Witness Protection Schemes and provided legal aid both in India and the United Kingdom.

I Have Been Upset with the Way India is Governed

I have been upset with the way India has been governed for decades. I'm 45 and attained political puberty at the age of 12 when I was elected as a member of the constituency executive of the Janatha party in 1978. It was the first time the independent India had a government other than from the ruling Congress Party of the Indira-Nehru dynasty. My father used to read out to us the atrocities under Indira Gandhi's rule (the Emergency as it is still called in India). Only the Indian Express covered the scale of the atrocities. Forced vasectomies, slum demolitions without compensation, torture in police cells and prisons, imprisonment of opposition leaders. Many died and others disappeared without a trace. Only my father in our village subscribed to the Indian Express. He preferred it over the vernacular daily Manorama although he subscribed to that also. The radio plus two dailies was a major cause of strife in the family. According to my mother my father spent too much money on the radio batteries and the news papers. He never drank or wasted money other than on the poor who borrowed from him. The money he lent was always written off as they seldom got repaid.

My father could speak proper English in our view. He could read Indian Express and translate it in to Malayalam for a start. The torture of George Fernandez and Jai Prakash Narain in prison cells was narrated in detail in the Indian Express. I cried and felt so upset. We all wished the down fall of Indira Gandhi in private. When the elections finally were held we listened on the radio throughout the night for polling up dates. I still remember the joy of hearing, " Shri (Mr.) Raj Narain of the Janatha is leading by thirteen thousand..... votes against his nearest rival Shrimathi (Mrs.) Indira Gandhi of the Congress from the Raebrailly Constituency.......after............votes were counted...........We can now confirm that Shri Raj Narain has defeated his nearest rival Shrimathi Indira Gandhi by margin of fifty six thousand....votes" The joy in the fall from grace of Mrs Indira Gandhi for me was like the joy of a Jewish person in the fall of Hitler.

The news papers normally arrived at about 9 AM the time we set off to school two and half miles away. India still had not adopted the metric system and everyone referred to distances in miles in our village. Some even referred to distances in the Hindu "Metric" system. Girls in the schools wore short skirts and blouses and the concept of panties were still a decade or so away.

My simmering discontent against the governance deficit in India erupted in the form of an open letter to the Prime Minister of India on or around 15 February 2011. I have been in the UK for the past 14 years but only my body is in the UK. I love India first and Britain the second. Some times you criticise the people you love the most the harshest at times not even realising it.

How Do I Begin?

I've tried blogging of and on. Mostly it was a sudden reaction to something I heard about or saw or felt. Some were mere escapisms. I do believe though that a British man's blog is his virtual fortress like his house although I am not British. As such in that fortress there are bedrooms and living rooms. There are also people who live in them. People with blood & flesh who have feelings, fears, passions, anger, frustration, joys of varying shades and intensity.

This blog is cathartic for me. It helps me to tame myself as self conquest for me is the biggest conquest of all. If there are anything in my musings that are hurtful to someone it is not intentional. My musing only represent my feelings and how I feel about stuff. So please forgive me if something appears hurtful to you. I don't pray to protect me from my enemies I pray, "Save me from myself and protect me from my adversaries"

There is also the issue of language barrier. I never learned English emotionally as in a mother tongue. English is only one of the four languages I speak. I have no intention to apologise to anyone for asserting my right to speak only in Indian English. Artificially learned vocabulary and grammar poses issues like "lost in translation". Hopefully one day when I have time I want to edit and refine my blogs. Until then it will be rustic.
