Refixation of the salary during the pendency of the case in the Honorable High Court, Calcutta

Sir,

At the outset I am to inform you that re-fixing the salary of the officers without informing them sufficiently in advance and without getting their signature on the service book, during the pendency of the case in the Honorable High Court, Calcutta, is nothing but your utter contempt to the Court of law and to your colleagues

The result of your exercise is that, it has created an impression that you are totally unilateral and partial and do not like to follow the administrative manual or the practices in the CBWE.

All that you have done is erroneous; Juniors are getting more pay than the seniors.
Officers who joined the Board and were promoted on the same date are getting different pay,with a difference in their pay ranging from Rs. 1000 to 7000 and those who were promoted two years after the seniors are getting more pay than the Senior officers. It appears totally ridiculous, and even an outsider or a layman may fail to find justification.

The officers fail to understand how some of the officers in the 14th batch are getting equal pay with the officers from the 13th batch.

There is huge difference in the Salary of the officers who were drawing the same salary till November 2012. All these are highly irregular and objectionable.

I am afraid that, your undemocratic, unilateral and arbitrary decisions create a havoc in the organization, displeasing every employee, resulting in the total loss of morale of the employees; which ultimately is likely to lead to the collapse of our prestigious organization.

Immediate steps have to be taken to restore the salary which everyone was drawing all these years. Your action is also against the assurance given by the Honorable Chairman at Delhi when our delegates had discussion with him.

If you do not correct this mistake immediately, we will be constrained to approach the court of law and you, on account of your unilateral, hasty and arbitrary decisions will be responsible for the costs, and all other consequences.

Approval of tour programme

LEGAL STAND

The Hon'ble CAT Kolkata bench in its decision has ordered to implement the sanant mehta committee recommendations for revising the pay scales of the Director and on that base the pay scales of the Officers of the board were also enhanced.
But as as the present Director is perusing to file a WP 85/2010 before the Hon,ble High court Kolkata challenging the CAT judgement.
Forgetting that "the pay scale of the Director is the base for the enhancement in the pay scales of the Officers", so if the officers pay goes down, it means the Director pay will also be reduced automatically.

Court doesnot have any relation of association registered or recognized. Even 5 persons can put a petition in the name of A to e. Are you not benefited by the petition then why ask this question after 2 years. When you got higher salary have you asked whether the case own by association or A. Bhattacharya and P. Mondal. We people need to know which question to be asked on blog or not. More over this is a public forum. Ans- How much amount was paid for court case why not published the annual accounts of CBWE EOA. what is the reason ? How much amount was paid to Advocate from Association

Chowdhury…for the petitioners Mr. Somnath Bose Mr. Pratip Chatterjee …for the respondents Re: CAN 8670 of 2011 & CAN 5891 of 2011 These two applications for addition of parties have been filed by two sets of applicants. The applicants are the retired employees of the petitioners. Most of them were in service, when the Original Application no. 566 of 2007 was filed, however, in course of time they retired. The applicants have prayed that they want to be added as parties to support the order and to resist the application made by the petitioners/employer. The respondents, who were the petitioners before the Tribunal, are conspicuously absent, despite repeated notice being given to them. Mr. Somnath Bose, learned Counsel appearing for the Union of India, the petitioners abovenamed while opposing the applications, contends that in case the Union of India is successful in having the order of the Tribunal set aside, the applicants would not be entitled to the benefit of the said order. In any event, they were not parties before the Tribunal. Hence, they could not be added as parties to this proceeding. We have considered the rival contentions. It is not in dispute that the applicants were the employees of the petitioners. It is also not in dispute that they already retired from service and might be getting benefit of the order of the Tribunal, if sustained. As per para -I last three lines of the court Order, dated 26/09/2011 as quoted " The respondents, who were the petitioners before the Tribunal, are conspicuously absent, despite repeated notice being given to them" From the above sentence our cadre friends easily conclude that, the present respondent & the petitioner at Tribunal are CBWEOA/Representatives of CBWEOA are not attending the Hon,ble Court despite of repeated notices. If, the present people who are dealing with case will show such type of step motherly approach towards Retd. employee, then it is very unfortunate to initiate a united legal fight. Its a appeal to every one to ask the persons dealing with the case with clarification & real stands of the CBWEOA, because one day every cadre will retired.

In DOPTt OM dated 31/3/1992 on the period of training spent before taking over charge of the post is counted as on duty and for drawal of increment. . So in our Case we are entitled for Increment from the Month when we Joined our Training at IIWE i.e. May 2004 for 21st Batch and December for 19th batch E.O. But in many Cases Wrong fixation is Done by CBWE HO Nagpur From the Date of Joining of E.O. at Regional Directorates

Wrong Pay Fixation By Head Office,Nagpur "The Office Memorandum as issued by the Department of Expenditure, Ministry of Finance, Governing of India dated 30th August, 2008 for the implementation of the Sixth Pay Commission recommendations has inter alia appended the pay fixation fitment tables and the related instructions. For the pre-revised pay scale of Rs. 8000-275-13500, the fitment tables have made two distinctions with two different pay bands as follows: i. PB2 with revised pay band + grade pay of Rs. 9300 to34800 with a grade pay of Rs. 5400 and; ii. PB3 with revised ay band + grade pay of Rs. 15600 to 39100 with a grade pay of Rs. 5400 As per the stated fitment table, the latter scale (PB3 as at ii above) is apparently applicable to personnel on direct Group A Entry only.( CAT Judgment is Implemented Notionally w.e.f. 1.1.1996 , So the 19th ,20th and 21st Barches of Education Officers have Enters As Group A Officers level in the CBWE) The Head Office has mentioned pay Band 3 (15600-39100)+ GP 5400 But in Pay fixation Format sent by them and Using wrong Fitment Table of . PB2 with revised pay band + grade pay of Rs. 9300 to34800 with a grade pay of Rs. 5400

LATEST DEVELOPMENT

1. The Ministry has issued a show cause notice to the director, asking how the AD (ministerial post) was transferred from HQ without permission.

2. The HQ has reduced the pay scale of one ZD, but now the Ministry itself fixed his pay in 14000 scale and send it to HQ. This is very good step and may be quoted for future references. This also shows that Ministry has already accepted the 8000 scale and there are only rumors that ministry is going to degrade the scale and few people are making it an issue.

3. The pensioners has taken stay from court and now HQ is re-fixing the pensions

4. Mr D R Prashar has gone on retirement prepratory leave & will only join in last week of Feb 2012.

5. Now the miscellaneous bills in programmes need to be signed by RD and also the dignatery present (non sense)

6. All the TA & Medical bills will be directly credited into individual a/c (if get cleared) and that too without informing the concerned person seeking his acceptance.

Financial scam at HQ

A new a/c was opened at IDBI Bank nagpur ?, you know why:-

1. All the salaries will be directly credited in the personal a/c of the officials.
2. In the plan and mgnrega prog, the EOs need to collect the bank a/c of the
participants, guest speakers and RVs and HQ will directly credit their honorariums
into their a/c and the EO need not have to pay them on the spot( the idea is in
pipeline).
3. The TA bills, Medical bills and other allowances will also be credited directly
to the officials personal a/c.
4. The non plan exp of the offices will also be credited from this bank a/c.
5. The whole MGNREGA fund has already transferred to this new a/c.

Now IDBI has to do all this transactions and money transfers ( approx more than 10 lacs per annum )

So What?

This will give a huge transaction charges to IDBI bank OR IDBI will keep this whole amount with it without claiming transaction charges but will not give any interest.
The benefeciery has to bear the transaction charges or CBWE.
The benefeciery will loose the bank interest or CBWE.
During the transfer time IDBI will enjoy the whole fund,it would be bigger if the benefeciery a/c is at remote place or with a non core banking branch.

WHO WILL BE BENEFITTED - CBWE (NO), MOLE (NO), BENEFECIERY (NO), only IDBI. Then why we have chosen this option? to favour a private Bank. Sources said, its an under table deal.

IT IS MISAPPROPRIATION OF PUBLIC FUND AND MUST BE TREATED A FINANCIAL SCAM.

New threats

All the salaries will now be credited by HQ, there are very evident chances of illegal deductions, without notifying and consent of Staff and Officers.

The bunching of the pay of the officers is forfeited and there would be an average recovery of around 2-3 lacks, again without consent and notification (illegal).

The pensions has been reduced superseding the court orders ( illegal again).

The officers are forced to travel without settling their TA DA (illegal).

The TA advances are accumulating as the outstanding amount against the officers.

The officials medical bills are lying pending idle.

The higher ups are claiming their TA.DA and other allowances, whereas other are deprived of the same.

The power of RD has continuously being reduced ( his DDO power is taken back without any consent of MOLE or GB( it is against our Administrative manual and RR).

The staff at HQ are forced to work on holidays

The EOs are overburdened and now they are forced to conduct block & district level MGNREGA programme ( all the bills to be settled at HQ, making it complicated)

SO WE DON'T RAISE OUR VOICES AGAINST THESE ILLEGAL AND UNJUST ACTIVITIES, THE OUTSIDERS WILL CONTINUE TO HARASS US, WE HAVE WITNESSED IT EARLIER AND NOW ALSO FACING THE SAME.

High time to unite

This time if don't get united STAFF & OFFICERS, our Board is going into drain. The Staff association has taken very strong stand and we must apprecaite them. Likewise, the Officer association must also come forward and raise the voice.
If both the associations work together leaving our self interest aside, we can counter every challenge and take CBWE to new heights.
The Pensions are reduced, people are not saying anything, we must remember, one day we all will retire. So don't wait for others take initiatives and come forward.

The Central Board for Workers Education under the Ministry of Labour & Employment is providing financial assistance for bringing awareness among the workers of organised and unorganised sector in the country. The Board through its Grants-in-Aid Scheme extends financial assistance to eligible Trade Union Organizations and Institutions to conduct workers Education Programmes. During the last three years the financial assistance given by the board various to trade Unions/Institutions is as under:

Moreover, the Government has appointed M/s Educational Consultants India Ltd. (Ed. CIL), a Government of India Enterprises of the Ministry of Human Resources Development to assess the impact of the programmes being implemented by the Central Board for Workers Education in 2008. Ed. CIL in its report has appreciated the work of Central Board for Workers Education and recommended for its expansion at all levels.

The Central Board for Workers Education (CBWE) is an autonomous body under the Ministry of Labour & Employment, Government of India. It is registered under the Societies Registration Act, 1860. Started in 1958, the Workers Education Scheme in India has been playing a very significant role in our national development; creating an enlightened and disciplined work force and bringing about desirable behavioral changes in our workforce in the organized, unorganized and rural sectors. It gets grants-in-aid from the Ministry of Labour & Employment to operate its activities. The Scheme of Workers Education aims at achieving the objectives of creating and increasing awareness and educating the workforce for their effective participation in the socio-economic development of the country. To achieve these objectives, various training programmes are conducted by the Board for the workers of formal and informal sectors at national, regional and unit levels through a network of 50 Regional and 09 Sub-Regional Directorates spread all over the country and an apex Training Institute viz. Indian Institute of Workers Education (IIWE) at Mumbai.

AG is not auditing in HO only. It is auditing all the centres. 90% centres not have any major objections so far finnancial irregularity is concern. So who is spreading the message that AG has huge objections regarding financial discipline. If also theres objections thats at HO level so why to drag all documents to HO and create a mess of it. More or less delegation of power is the norm of present days governance of UPA government and Madam Sonia Gandhi not Centralising power with vindiction. There must be conducive environment for work, If people will be engaged in these petty works of ditance cerificate and all rubbish stuffs, then when will they work. Ministry must play a role in it. Every circular must be supported with Govt orders. Lets see how long this circus continued. Friends when i was with you , you always considered me as enemy but I am always your well wisher few people from your cadre who run association posed me as villian to earn money.
