How long does it take to start?

It is to your advantage to file for your benefits as soon as you become disabled however you must prove your disability will last at least 12 months. You do not however need to wait until you have been disabled for 12 months before you apply.

Date of Onset:

Your "date of onset" is considered the first day you are unable to work because of your disability. The date of onset may or may not be the same as the date you were diagnosed. Applicants typically use the date they last worked as the date of onset.

What is the difference between Social Security disability and SSI disability?

The Social Security Administration is responsible for two major programs that provide benefits based on disability: Social Security Disability Insurance (SSDI), which is based on prior work under Social Security, and Supplemental Security Income (SSI). Under SSI, payments are made on the basis of financial need.

Social Security Disability Insurance (SSDI) is financed with Social Security taxes paid by workers, employers, and self-employed persons. To be eligible for Social Security Disability Insurance, the worker must earn sufficient credits based on taxable work to be "insured" for Social Security purposes. Disability benefits are payable to blind or disabled workers, widow(er)s, or adults disabled since childhood, who are otherwise eligible. The amount of the monthly disability benefit is based on the Social Security earnings record of the insured worker.

Supplemental Security Income (SSI) is a program financed through general revenues. SSDI benefits amounts are determined by a formula that takes into account your earnings record. The formula allows for yearly increases in the individual benefits in order to reflect adjustments in the cost of living. The amount of your benefits will be based on your average earnings for all of the years you have been working, not just your most recent salary.

For SSI and SSDI and for Disabled Widow's and Widower's Benefits, the benefits cannot begin until five months have passed after the person becomes disabled. In addition, benefits will not be retro-actively paid for more than one year prior to the date of the claim."

For a Disabled Adult Child, there is no five-month waiting period before benefits begin, but benefits cannot be paid retroactively for more than six months prior to the date of the claim.

SSI benefits cannot be paid prior to the start of the month following the date of the claim.

Denial

Reconsideration

Types of Social Security Benefits

A small number of Social Security disability claims are approved at the initial level.

What types of Social Security Disability benefits are there?

Social Security Disability Insurance Benefits are the most important type of Social Security benefits. They may be awarded to individuals who have worked fulltime in recent years (five out of the last 10 years in most cases) who are now disabled.
Disabled Widow's and Widower's Benefits are paid to individuals who are at least 50 and become disabled within 7 years after the death of their husband or wife. The late husband or wife must have worked enough under Social Security to be insured.
Child's Disability Benefits are a type of SSI program. It provides financial support to children age 17 or younger that are disabled. Social Security uses different rules for determining disability in a child's claim than in an adult's claim. To be found disabled, the child must have a physical or mental condition that causes marked and severe functional limitations. As with SSI claims, to be eligible for Child's Disability Benefits the parent's household income must not exceed a certain maximum level.
Disabled Adult Child Benefits must be paid to a child age 18 or older who became disabled before age 22 and to a full-time elementary or secondary student under age 19. If the parent is alive, he or she must be entitled to retirement or disability benefits. If deceased, the parent must have worked long enough under Social Security for survivor's benefits to be paid on the record.
Supplemental Social Security Income benefits are paid to individuals who are poor and who are disabled. It does not matter to SSI whether an individual has worked in the past. SSI child's disability benefits are a variety of SSI benefits paid to children under the age of 18 who are disabled.

Disability may be a familiar enough concept to many people, but rarely do we think of the possibility of becoming disabled ourselves until we become ill or experience an accident. Surprisingly though, the chances of becoming disabled are probably far greater than you imagine. Studies show that someone who has worked 20 years has a 3-in-10 chance of becoming disabled before reaching retirement age.

Each year, you should receive a benefits estimate from the Social Security Administration which summarizes the years you have worked, how much money you have paid into the system, and your estimated monthly disability benefit.

If you are a widow (er) or divorced and have not remarried, you may qualify for disability benefits under your spouse's Social Security account. When the spouse is deceased, you must make a claim within 7 years of the spouse's death.

You may qualify for a percentage of your parent's benefits if you are currently a disabled adult child at least 19 years of age and can prove your disability began before your 22nd birthday (and your disability continues). Note: You must still be disabled.

If you are granted Social Security Disability benefits, you will be entitled to receive Medicare benefits two years from your disability onset date. If you are impoverished and unable to obtain medical treatment during any interim period, you may qualify for Medicaid benefits until your Medicare becomes effective.

Your condition must prevent you from consistently performing basic work-related activities.
Your medical problem must either be on their list of qualifying medical conditions, or it must be determined to be equivalent in severity to a listed condition.

NOTE: If you meet these first three requirements, you are considered disabled by Social Security. If you only meet the first two requirements, but do not meet the third, then you may still qualify as disabled if you also meet the fourth and fifth requirements.

Your condition must prevent you from consistently performing the work you did previously.
You are found to be unable to adjust to other work.

You must also have worked long enough, and recently enough.

What this basically means is that you need to have earned a minimum amount of money (as little as $3880 per year) over enough years throughout your life, as well as over the 10-year period that leads up to your disability.

If You Have An Auto Accident

What should you do if you?re involved in an automobile accident in New York State?

Stop

In New York State, if you are involved in a vehicle accident causing injury to person or property, you are required to stop and give your name, address, and show your driver?s license and insurance identification card to the person who is injured or whose property is damaged, or to a police officer. If such information isn?t available at the scene of the accident, it must be given to the nearest police station or judicial officer as soon as possible.

Injured Persons Receive First Consideration

If possible, have someone call a doctor or an ambulance at once. If you don?t know the local area, a telephone operator will locate help for you. Remember, in getting aid, it is necessary to fix your location as precisely as possible, so that help can reach you without delay. Meanwhile, make the injured party as comfortable as possible. You normally should not move an injured person. Keep the person warm with blankets or coats. If there is any bleeding, stop it by applying direct pressure with a clean cloth. Do not give an unconscious person anything by mouth.

Protect the Scene

Make every effort to prevent further accidents. You may be liable for damages to approaching vehicles unless they are properly warned. Vehicles should not be left in a position of danger on a highway if they can be moved, nor should passengers remain in such a vehicle. If the highway is obstructed at night, have someone with a flashlight warn approaching motorists. Set out flares and reflectors if they are available.

Call Traffic Officials

Request the presence of a police officer or highway official and give briefly the basic facts. The official report may help you later if any liability claim is made.

Trade Facts With Other Drivers

Obtain the names and addresses of all other drivers involved, along with the names and addresses of other passengers. Also note the ownership, license number, year and make of all cars involved in the accident. If possible, obtain the names of the insurance companies and the policy numbers covering the other autos in the accident. By law, an insurance policy information card must be carried in every vehicle licensed in New York State. These cards can be your source for such information.

Get the Names and Addresses of as Many Witnesses As Possible

Witnesses will be a tremendous help to you in any subsequent court action if there is any question of liability involved. Get the names, addresses and telephone numbers of as many witnesses as possible. If they refuse to identify themselves, jot down the license numbers of their automobiles. Do not discuss the accident with the witnesses. Do not give their names to anyone but the police, your attorney or your insurance company. Remember to get the name and badge number of any police officials who appear on the scene.

Write Down the Details of the Accident

Make a note of the details of the accident, including date and time, road conditions, weather conditions and speed of all other cars involved. It is also a good idea to draw a diagram of the accident showing the position and direction of the cars just prior to and after the accident.

Report the Accident to the Commissioner of Motor Vehicles and to Your Insurance Company

The law requires that the operator of a vehicle involved in an accident in New York State in which a person is killed or injured ? or one in which damage to the property of any person, including himself, exceeds $1,000 ? must file a written report with the Commissioner of Motor Vehicles within 10 days. If the operator is unable to make such a report, another participant must make it within the prescribed period. Remember to keep copies of all correspondence and reports for your records. The law further provides that if an operator or participant is unable to make this report, the owner of the vehicle must do so within 10 days after learning of the accident. Failure to comply with the law is a misdemeanor and could be grounds for suspension or revocation of the operator?s driving license, or certificate of registration for the vehicle. Your local police station or insurance agent will help prepare the necessary forms.

Failure to comply with the law is a misdemeanor.

Remember to call your insurance company representative immediately after the accident. Don?t forget to send written notice to your insurance company as soon as possible. The notice should include the time, place and circumstances of the accident. Also, make sure your report contains the names of all injured persons (including passengers, pedestrians, and drivers), and the names of all available witnesses. If you fail to notify your insurance company of the accident in writing within a reasonable time, this could be grounds for the company?s denying any obligation to protect your interests in the event a claim is made against you.

Claims Made Against You

Refer all persons making claims against you to your insurance company. Make no payments, or promises to pay, to any claimant. Immediately send your insurance company all legal papers served on you. If the coverage you have purchased is not adequate to cover the claims made against you, consult your lawyer at once. Remember, you may have insurance coverage under more than one policy.

Claims Made by You

If you are injured, see a doctor as soon as possible. Potentially serious and costly injuries may seem trivial at first. Where accidents occur within New York State, automobile insurance policies include provisions for payments to operators and passengers of automobiles, and to pedestrians for medical expenses, lost wages, and other expenses, regardless of fault. If you have any questions about your right to sue for either personal injury or property damage, consult your attorney.

No-Fault Insurance Benefits in New York State

Under New York State?s compulsory no-fault automobile insurance law, persons injured in a motor vehicle accident are eligible to receive up to $50,000 in benefits provided they were not intoxicated, drugged or engaged in other specified criminal or anti-social behavior.
The no-fault benefits include:
? All necessary medical and rehabilitation expenses.

? Lost earnings up to $2,000 a month for up to three years from the date of the accident. There is a 20% reduction of actual lost earnings.

? Up to $25 a day for a year for other reasonable and necessary expenses incurred because of the accident, such as the cost of hiring a housekeeper to perform the household services usually performed by the injured person.

These benefits are payable regardless of who was to blame for the accident.

Some policies may contain additional benefits, but each policy must be examined to determine what its benefits are.

The Right to Sue

Under no-fault, you, as an accident victim retain the right to sue a negligent operator and owner of a covered vehicle for personal injury losses in certain cases:
? For your medical expenses and other economic losses when they exceed $50,000.

? For "pain and suffering" if you suffer an injury which results in significant disfigurement, a fracture, or other kinds of significant injury as defined under the no-fault law.

? For injury resulting in death.

? When the injured person or the person at fault does not have insurance complying with New York State minimum provisions.

New York State requires a minimum of $25,000/$50,000 personal liability coverage, $10,000 property damage and $50,000 in the event of a wrongful death; in addition to the no-fault coverage.

If an owner or operator is uninsured, you should consult your attorney immediately.

Property Damage

Claims for damages to your vehicle still will be covered by your own collision or comprehensive insurance policy, if you have one. As in the past, if another motorist is at fault in an accident, you retain the right to sue the person for property damage. New York requires a minimum $5,000 property damage coverage. Epstein’s visit is part of the John William Pope Lecture Series through the Clemson Institute for the Study of Capitalism in the College of Business and Behavioral Science.

Epstein is the James Parker Hall Distinguished Service Professor at the University of Chicago Law School and is director of the university’s law and economics program. He is the author of more than a dozen books, including “Takings,” “Principles for a Free Society: Reconciling Individual Liberty with the Common Good” and “Overdose: How Excessive Government Regulation Stifles Pharmaceutical Innovation.” He has published hundreds of articles on antitrust law, property rights, intellectual property, medical ethics, eminent domain, tort law, contracts, legal theory and constitutional history.

The Clemson Institute for the Study of Capitalism was founded in 2006 with a grant from the BB&T Charitable Foundation. His most recent book, The Rule of Lawyers, was hailed in leading publications including Forbes ("truly gripping" and "brilliant"),Walter Olson in Sept. 2006 The American Lawyer, and Barron's (a "marvelous combination of irony, insight and outrage"). The Excuse Factory, his 1997 book on litigation in the workplace, was met with accolades in the London Times ("riveting") and the A.B.A. Journal ("wittily scathing"). His widely discussed first book, The Litigation Explosion, was cited by Justice Sandra Day O'Connor in a major Supreme Court case. On the web, he founded and continues to run Overlawyered.com, widely cited as the oldest blog on law as well as one of the most popular, as well as the Manhattan Institute's PointOfLaw.com.The Washington Post has dubbed Olson an "intellectual guru of tort reform".

A longtime senior fellow at the Manhattan Institute, the think tank in New York City, Mr. Olson has been a columnist for Great Britain's Times Online as well as Reason. His writing appears regularly in such publications as the Wall Street Journal, the New York Times, and the New York Post. He has appeared numerous times before Congress and advised many public officials. His approximately 400 broadcast appearances include all the major networks, CNN, Fox News, PBS, NPR, and "Oprah". He is at work on a book about the influence of the law schools.

1. Rob La Gatta: You’re credited as starting one of the oldest – if not the oldest – law blog on the web. What made you think starting a legal blog was a good move at a time when nobody else was doing so?

Walter Olson: I'm a writer, and the desire to write came first, before much thought as to who the audience would be. It started more or less as notes to myself, on topics I figured I might write about later. Also, while Overlawyered is a blog about law, its early readers were more policy types and journalists than lawyers.

2. Rob La Gatta: In many ways, blogs have indirectly created a new system of checks and balances, where people and businesses are held much more accountable simply because their moves are constantly being documented on the web. Do you believe blogs have the power to contribute to the “reform of the American civil justice system” that you say we need?

Walter Olson: The fact is, despite the obvious dangers in it, that blogs are great at shaming. No one wants to have the top page of Google hits on one's name be from having committed some ethical howler or taken some ridiculous position in a case.

If you haven't given up on the idea of self-policing by professionals (and I haven't) there is real hope that legal blogging will focus peer pressure and scrutiny on the underside of law practice in a way that the prospect of bar discipline often fails to do. This isn't just law, by the way – read the medical blogs and you'll see plenty of frank talk about the ethical dilemmas and temptations that doctors face. It's quite an education, actually.

3. Rob La Gatta: I notice that you’ve popped up in a wide range of print and television media outlets. Do you believe your blogging work has helped enhance your overall professional reputation?

Walter Olson: Sure. Reporters and their editors inevitably spend time on blogs, as do talk-show bookers. How could they not? They use Google constantly, and Google leads them to sites like mine. Most working reporters are also starved to see intelligent reactions to stories they've done. As a book author, I was already a media source, but it's not uncommon for reporters making their first call to say they feel they "know me already". It's blogging that does that.

4. Rob La Gatta: What is your take on the future of the legal blogosphere…will it continue to gather steam? Do you think that eventually, lawyers will need blogs to stay competitive?

Walter Olson: It continues to change and expand at an incredible pace; new bloggers can still make a name for themselves in months, even weeks. I would say that certain types of lawyers – in particular those who want to become well known with the press or among other lawyers, but are not already handling front-page cases – really should consider blogging if the aptitude is there.

5. Rob La Gatta: Since you’ve been blogging for quite some time, you’re probably one of the most well-suited individuals to answer this question: if you were to meet a lawyer just starting his or her first blog, what is the one most important bit of advice you’d offer them, and why?

Walter Olson: Find a niche (or two or three) that you'll never tire of writing about – very few of the good niches are taken. Then write short, pace yourself, and leave them wanting more.

New York Personal Injury Lawyer - A Day to Declare Independence

On July 2nd, 1776, the Continental Congress voted for Independence. We celebrate, however, on the 4th when the Declaration was signed. I discussed this last year in: United States of America Declares Its Independence (Jury Trials Are One Reason)

But it's worth repeating this year on the heels this week of the WSJ op-ed by high profile law professor Richard A. Epstein, who proclaimed that the right to a jury trial was a mere "procedural feature," among other ludicrous claims.

And so it's worth repeating that not only is the mere "procedural feature" enshrined in the Bill of Rights, but it's also in the Declaration of Independence.

In the long bill of particulars of reasons we took up arms against the crown is this:

For transporting us beyond Seas to be tried for pretended offences:

For abolishing the free System of English Laws in a neighbouring Province, establishing therein an Arbitrary government, and enlarging its Boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule into these Colonies

For taking away our Charters, abolishing our most valuable Laws and altering fundamentally the Forms of our Governments:

For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever.

He has abdicated Government here, by declaring us out of his Protection and waging War against us.

He has plundered our seas, ravaged our coasts, burnt our towns, and destroyed the lives of our people.

He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation, and tyranny, already begun with circumstances of Cruelty & Perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation.

He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands.

He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers, the merciless Indian Savages whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions.

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.

Nor have We been wanting in attentions to our British brethren. We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here. We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which would inevitably interrupt our connections and correspondence. They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends.

We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies, solemnly publish and declare, That these united Colonies are, and of Right ought to be Free and Independent States, that they are Absolved from all Allegiance to the British Crown, and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved; and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do. -- And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes, and our sacred Honor.
