New Yorkers Beware of Burn Injuries this July 4

With Independence Day around the corner, personal injury lawyers remind our loyal readers to please avoid dangerous burn injuries and scalds. Fireworks, sparklers, roman candles and cherry bombs can cause serious personal injury, eye injury, loss of vision, skin burns and bodily disfigurement. Firecrackers release projectiles at very high pressure, and send out high temperatures sparks. Ohio University doctors report that sparklers -- often handled by young children -- can reach high temperatures as high as 1,800 Degrees Fahrenheit! Yes, that is One Thousand Eight Hundred degrees. In comparison, water boils already at 212 degrees! This type of heat can burn eyes, hands, chest and anything nearby, say experienced personal injury lawyers. In fact, every year, 12,000 Americans experience firework related injuries and end-up in hospital Emergency Rooms. See this case of a New York infant burnt severely by hot liquid. Please stay clear of this dangerous situation. Instead, sit back, watch and enjoy while trained professionals, with proper safety equipment and measures, put on the show. If personal injury does strike, get in touch with a top attorney right away.

Work Injury :: Mac Computer's High Gloss Screen Poses Danger

Personal injuries can happen anywhere, even while sitting behind a quiet desk. New Yorkers and others must beware. Australian technology researchers recently warned computer users about personal injuries resulting from the Mac's high-gloss, high glare screen displays. Coupled with undesirable overhead lighting or sun rays, the high-gloss Apple monitors compel users to maintain awkward postures for extended periods of time. This can cause neck, eye, back strain, and other computer-related injuries. The findings bear special significance to millions of New York professional who work behind keyboards every day. In some respects, this type of personal injury differs from the typical on-the-job, slip and fall accident, such as, $1,173,000 Settlement: Restaurant Worker Slips & Falls Down Greasy Steps. On the other hand, this type of work injury shares a common thread. Employers are negligent, and provide a dangerous workplace condition for employee. If and when any sort of work-related injury happens, get a hold of a highly-qualified personal injury lawyer who can protect your rights and get you compensation.

Medical Malpractice :: New York Hospital Makes Misdiagnosis, Disfigures Man

Hospitals sometimes make serious negligent mistakes that lead to serious personal injury. We reported on this Kings County New York hospital that led to negligent and wrongful death. See $1.5 Million Result -- Failure To Properly Diagnose & Treat Epileptic Seizures Leads to Death -- Medical Malpractice. According to The Journal News, New York hospitals did it again. Doctors at Nyack New York Hospital told a strong, fit, twenty-eight year old man that he had a rare case of male breast cancer. They said three lab samples confirmed the diagnosis, and recommended a masectomy. The man accepted the medical diagnosis, relayed the difficult news to his family, and underwent the surgery, which left him disfigured. Two weeks later, the NY hospital told the man it was all a mistake. The lab had mixed up the samples with those belonging to someone else. The New York man suffered a variety of personal injuries, including emotional, psychological and physical suffering, including permanent scars, due to the hospital's medical malpractice and misdiagnosis. Just last week, we reported about negligent hospital that dropped and left a needle inside a patient's bladder. This reminds us of the Million Dollar NY injury lawyer story in which New York University Hospital mispositioned a patient's arm. Manhattan's best injury lawyers can affirm that Medical malpractice happens all the time, even at the best hospitals.
Medical Malpractice :: Patient's Worst Fears Come True

Arguably, every patient fears this before undergoing a serious medical procedure. What happens if the performing doctors mess up? Medical malpractice does happen all the time. A doctor's error or omission can cause pain, suffering and wrongful death, say leading NY injury lawyers. For instance, check out this story of a New York Woman Killed By Stomach Stapling. Also see this instance of a NY hospital's failure to diagnose a patient who suffered an epileptic seizure. The patient ultimately died as a result, and his family recovered $1.5 Million in personal injury damages. Now, medical malpractice strikes again. A Texas resident suffered severe bladder disfigurement, mental anguish and pain, when operating surgeons left a dropped needle inside the man's bladder. At first, the doctor allegedly tried locating the dropped needle. Eventually, the doctor gave up and simply closed up the man's body. The man subsequently suffered from a perforated bladder with extreme complications. Medical malpractice can lead to dangerous personal injuries.
Wrongful Death :: Shoppers Trample NY Walmart Worker to Death

We've recounted all kinds of stories about wrongful death, including those involving medical malpractice, childcare negligence, operating rooms, trains and sidewalks. For instance, See $2.9 Million Award - Tree's Limbs Fall and Kill Woman. A day after Thanksgiving 2008, a crowd of 2,000 shoppers ran into Valley Stream New York's Walmart to pound the aisles. The crowd trampled a Queens NY worker to death. Eleven other people received personal injuries in the rush. Full story here. This is neither the first nor job-related injury. We covered the story of a Westchester NY bookstore employee who got injured by a slip and fall, while on the job. Walmart reached an agreement with NY's prosecutors whereby Walmart will pay out $1.9 Million to a variety of youth organizations, and provide summer employment to fifty youngsters in five NY counties. Keep in mind that this settlement only addresses the criminal aspect of the wrongful death. However personal injury lawyers quickly point out that civil suits may follow, despite the dropping of criminal charges. Get ready to hear more about New York's personal injury lawyers suing Walmart for wrongful death compensation.

Baby Drowns in Accidental Wrongful Death

Negligent medical and childcare often lead to personal injuries, accidental death and wrongful death. For instance, we reported on this failure of a NY hospital to diagnose an Epileptic seizure, which led to a $1.5 Million case of wrongful death and medical malpractice. New York's personal injury lawyer fought until the family received fair compensation. More about the NY injury case here. Last week, a Montana childcare provider pleaded guilty to negligent care of a a six-month old baby, which led to the baby's wrongful death. The child's care provider left the baby unattended in sink-top bath seat for four minutes, while changing another child's diaper. The woman returned to find the baby's head submerged underwater, and the baby dead. Details of the tragic story here. Both cases have a common thread. Negligent care takers and medical professional failed to properly preserve other people's lives. Whether its Montana, New York, New Jersey, or anywhere else, negligence and accidental death can strike. If and when it does, contact a personal injury lawyer right away.

Elevator Injuries Strike Again

Any New Yorker knows that elevators are a part of life in the city. There is little alternative when buildings stretch up over 100 stories toward the sky. But speedy climbing elevators also cause personal injuries. According to the U.S. Bureau of Labor Statistics and the Consumer Product Safety Commission, 17,000 Americans get hurt every year due to elevator and escalator injuries (stats). This includes injuries like sudden impacts, whiplash, smoke inhalation and even wrongful death. For example, this 67-year old blind man living in the Bronx, stepped into an elevator, as the doors opened, and subsequently plunged his death. The Bronx story presents a clear case of premises liability and negligent maintenance and repair, as someone was responsible for maintaining the proper functioning of the elevator. Injury attorneys can firmly pursue compensation for such wrongful death. In Boston, thirty students were trapped in an elevator, due to sudden power shortage. So long as elevators continue to work, people will experience elevator injuries. So first, be careful.
90,000 Pedestrian Personal Injuries Every Year

More pedestrian injuries, says the National Highway Traffic Safety Association. According to the NHTSA, an astonishing 90,000 pedestrian injuries occur every year in the United States. This includes pedestrians hurt in hit and runs, bus accidents, bicycle car crashes, truck crashes and sidewalk injuries. For example, see Car Accident: Personal Injury While Waiting at Stop Sign. These numbers would be even higher if one counts other types of pedestrian injuries and wrongful deaths, such as those resulting from dangerous conditions like icy sidewalks or falling tree branches. Want to help make sidewalks and roads safer for pedestrians?
Contingency Models Means Win-Win for Personal Injuries

According to a recent press release a Philadelphia personal injury firm, Contingency models present ideal terms for those injured in an accident or medical malpractice. In a Contingency model, such as that provided by New York Personal Injury, a top-notch, experienced attorney (or in this case, a team of top lawyers) provides legal representation for an injured party. "Because they are not paying by the hour, it doesn't cost any more to retain an experienced law firm with a long record of success," says the Philly firm. The injured party, such as a car accident victim or injured employee, does not pay the attorney anything up front. Instead, the injured person pays only if and when the lawyer successfully recovers compensation on behalf of his/her client. If the lawyer does not recover compensation, then nothing is paid. often the victim, such as someone who experienced workplace injury (read $1,500,000 Settlement -- 90-pound Jackhammer Causes Snap of the Neck) or slip and fall, will directly contact the injury lawyer. At other times, such as instances of wrongful death or medical practice, an injury victim's family turns to the personal injury lawyer on the victim's behalf. In any event, the lawyer fights to win the client's case and create a win-win situation for the injured person.

NY Bus Accident Causes Personal Injury. Court Awards Woman $27.5 Million.

In the past, we wrote about a New York City Transit Authority mini-bus causing personal injuries. See the story of the Bronx woman here, "$1 Million -- Failure to Secure Wheelchair on a Bus, Sends Woman onto Floor." Now, it has happened again. According to this recent NY Times story, New York 's Supreme Court just awarded $27.5 to a New York woman who lost her leg, after a Manhattan Transit Authority (MTA) bus ran it over. As a result of the pedestrian accident, the woman suffered pain and suffering, hospital amputation, multiple surgeries and a lifelong disability. The story also reminds us of a Maryland pedestrian hit while waiting a Stop sign. An interesting twist on the recent NY bus accident story is that despite the large-scale personal injury award, the jury did conclude that the woman was indeed negligent for failing to look before entering the crosswalk. Nevertheless, the court awarded her $27.5 Million. The jury reasoned that the New York Transit bus driver was negligent in failing to avoid the impact. This monetary award underlies the concept that accident victims have great legal rights even if they are to some extent negligent in causing their own personal injuries. If you or a loved one ever get hurt in a car accident -- even if you may feel that you may be in some way at fault -- contact a top new personal injury lawyer right away. Maximize your rights!

Medical Malpractice :: $16.8 Million Awarded to New York Woman Killed By Stomach Stapling

Recall our September story, Thirty-Something Year-Old Female Victims Yield Highest Awards for Wrongful Deaths. Well, this New York story affirms the earlier conclusions. Virginia Beach bloggers remind the public to be careful in pursuing cosmetic surgery, and watch out for the dangers involved in stomach stapling, formally known as Gastric Bypass Surgery. In 2008, a 36-Year old New York woman suffered wrongful death due to her doctor's malpractice. First, the New York surgeon failed to determine that the woman ought not have the surgery, as she was an unsuitable candidate. Secondly, the doctor reduced the woman's stomach down to a holding capacity of two tablespoons. The New Yorker subsequently died of liver failure and malnutrition. Her two surviving sons sued the physician for medical malpractice and wrongful death claims, and were awarded $16.8 Million. The story calls to mind several other features that we have reported. In February, we reported on a Pennsylvania family that sued and won $20 Million in a medical malpractice suit against a Pennsylvania hospital. Earlier, we featured a Kings County New York wrongful death case of medical malpractice involving an epileptic seizure.
Commuter Train Victim Gets $25.5 Million for Brain Injury

The courts in Cook County, Illinois confirmed the findings of the Notational Transportation Safety Board (NTSB). In 2005, a Metra train's human engineer was at fault for failing slow down a Chicago train from 69 to 10 miles per hour. Consequently, the train derailed, causing the wrongful death of two commuters, and injuries over 100 others. Renea Poppel who filed the lawsuit, was among the personal injury victims. Read more about a Brooklyn New York wrongful death suit here. Her injuries included traumatic brain injury and a broken pelvis and neck.
Post-Traumatic Stress Disorder from College Hazing

Unfortunately, it has happened again. And this is not the first time we have written about wild college hazing, alcohol abuse and wrongful death. A Missouri college student was allegedly emotionally and physically abused while pledging for admittance into Signa Alpha Mu, a Tulane fraternity. Several months thereafter, in May 2008, the college student drove at dangerously high speeds, while under the influence of alcohol. He crashed into a 25-year old pedestrian and caused wrongful death. Read about other pedestrian car accidents here. The Missouri college student, now serving a five-year jail sentence, filed suit against the fraternity.
