The Patriot Act in Practice: Sen. Russ Feingold grills DoJ official over use of Patriot Act

Earlier this week, Sen. Russ Feingold (D-WI) questioned Assistant Attorney General David Kris over the use of the special powers given under the Patriot Act to "sneak and peak." Kris confirmed that in 2008 only 3 of 763 cases, where warrantless powers were used, involved suspected terrorists. What is important here, and Feingold made mention, is that the Patriot Act was sold to Congress, and the American people, on the pretext of its use against so-called terrorists. What is illustrated here, and in many other cases since 2001, is that the government has been using the Patriot Act against its own citizens for purposes other than terrorism. What is shocking however, is the number of cases cited by Kris that had nothing to do with terrorism.

Besides the Patriot Act, and often overlooked, is the Authorization for Use of Military Force Act (AUMF). Like the Patriot Act it contained provisions for warrantless behavior (in addition to the use military commissions). Also, the Military Commissions Act (2006) added more fuel to the fire by labeling anyone who is against the US government, non-military, as a possible terrorist. As scholar Elliot Cohen has noted:

According to this Act, an "unlawful enemy combatant" is to be defined as:

"an individual engaged in hostilities against the United States who is not a lawful enemy combatant."
This basically means that if a person is not a soldier in the service of a foreign government, but is nevertheless engaging in "hostilities" against the United States, then this person is an unlawful enemy combatant. Notice that this definition does not require that such a person be an "alien," which accordingly leaves open the possibility that this designation could also be applied to an American citizen.

In Hamdan vs Rumsfeld (2006) the Supreme Court ruled against the use of military commission (which did not give the accused a right to habeas corpus). As a result, the Bush administration, and a compliant Congress, passed the Military Commissions Act. This egregious act gives the government the power to accuse one of terrorism, not actually committing any crime mind you, without ever coming before a court of peers to determine guilt. It is simply guilty before proven innocent.

New Book about WTC 7

David Ray Griffin, pioneer in 9/11 research, has released a new book entitled The Mysterious Collapse of World Trade Center 7: Why the Final Official Report About 9/11 Is Unscientific and False.

Recently, Griffin wrote an overview of the materials covered in this book available here.

World Trade Center Building 7 (WTC 7) is the a key part of the 9/11 story. WTC 7 was 47 stories tall, sharing the sturdy design characteristics of WTC 1 and 2, and collapsed symmetrically to the ground in roughly 6.5 seconds. WTC 7 was not hit by plane and its implosive destruction was considered by FEMA as not understood strictly from fire. (Besides Griffin, researcher Jim Hoffman also provides excellent material on WTC 7 at his website). In addition, WTC 7 housed the New York City Emergency Command Center and other Federal agencies as the CIA and Secret Service. According to FEMA's Building Performance Study: "The specifics of the fires in WTC 7 and how they caused the building to collapse remain unknown at this time... Further research, investigation, and analyses are needed to resolve this issue."

Griffin covers all of these important issues. An often overlooked issue of WTC 7 is the presence of two witnesses that were in the building 15 minutes after the first plane struck the North Tower at 8:46 am. Barry Jennings, was the deputy director of the Emergency Services Department of the New York City Housing Authority, and Michael Hess, was New York City’s corporation counsel (and now business partner of Rudy Guilani), were headed to the Emergency Command Center on the 23rd floor of WTC 7. Griffin discusses the cover-up and out right lies from NIST regarding what they saw. Jennings, who feared for his life, died mysteriously last September - and we still do not know how he died (or any of the circumstances of his death). Hess is still doing business and has changed his testimony here and there to not rock the boat of the government's official conspiracy theory. Jennings and Hess came into a a Command Center, which they expected to be bustling with people, and found it deserted. As Jennings said, it was as though everyone just stopped what they were doing and left. Jennings and Hess then experienced an explosion from the lower part of the building a little after 9am. Both men were trapped in a stairway for hours until they were let out around 11-11:30 (as both men gave interviews in the street closer to 12pm). Upon this rescue, firefighters warned them to not look at the ground they were walking on in the lobby area because it was filled with bodies. The only reason for dead bodies in the lobby is from the prior explosion. And remember, this building was not struck by an airplane, and only barely stuck with some debris from the collapse of the North Tower - which occurred well after the explosion that Hess and Jennings reported.

Griffin leaves no stone unturned. I'm sure this book will only add to the truth movement and help publicize the importance of WTC 7. Check out his overview and support his work.

The Beat of the Resistance

If a soundtrack could be created for the movement of truth, for the survival of liberty, it would have to come from Matthew Bellamy and the British band Muse.

Today Muse released their fifth album The Resistance with interesting tracks as "The United States of Eurasia," "Uprising," "Unnatural Selection," and "MK Ultra." The cover shows a man seeking to see the world from the kaleidoscope of images nearly blocking his view - struggling to find truth in a maze of smoke and mirrors.

I discovered Muse through hearing a track entitled "Take A Bow" from the album Black Holes and Revelations. "Take A Bow" possesses powerful lyrics clearly identifying Tony Blair (former British Prime Minister) and George W. Bush as wizards casting their "hex" over millions and ultimately facing God's judgment for their "crimes against the earth" and needless human sacrifices by war.

The Resistance contains both intriguing lyrics and electrifying sublimity. The first track, Uprising, could be called an anthem for the truth movement (or any movement, seeking the deconstruction of centralized police state governments world-wide). The lyrics are as follows (with grammatical emphasis placed by me here and there):

"Paranoia is in bloom, the PR transmission will resume. They'll try to push drugs that keep us all dumbed down, and hope that we will never see the truth around.

Another promise, another seed, another packaged lie to keep us trapped in greed - And all the green belts wrapped around our minds and the endless red tape to keep the truth confined - So come on!

They will not force us! They will stop degrading us! They will not control us! We will be victorious!

Interchanging mind control, come let the Revolution takes its toll - If could flick the switch and open your third eye, you'd see that we should never be afraid to die - So come on! -

"Uprising" is the foretaste of great tracks as "The United States of Eurasia" where Bellamy sings:

"You and me are the same, we don't know or care who's to blame - But we know that whoever holds the reigns nothing will change, our cause has gone insane - And these wars they can't be won. Does anyone know or care how they began? They just promise to go on and on and on..."

This song speaks of the movement of NATO (at the command of the US and Britain) to surround and break up any unification of Russia with China, eastern Europe and eventually the whole of Europe. Zbignew Brezinski's chessboard geopolitical strategy of breaking up countries, making them divisible, is the target of this track.

"MK Ultra," the tracked named after CIA mind control program of the early 1950s, speaks of a "universe trapped inside a tear," of people desperately seeking freedom and happiness only to find a massive control grid: tagging each and every human on the planet like cattle. The MK Ultra program attempted to bring a person to the breaking point so that he could then be susceptible to total mind control through drugs and psycho therapy via the CIA masters. Muse bemoans this deconstruction of man which seeks to brings us to our knees by pumping an endless stream of images, evoking a variety emotions (especially aggression and sexual deviance), to bring out a neurosis in being: the loss of control and the creation of an ineffectual person led around by ever-changing emotions and desires. "How many lies they create? How long until you break? Your mind's about to fall - They are breaking through," sings Bellamy.

The importance here is that we must fight to take control of our minds or we'll end up being broken, lost and unfulfilled. The artificial environment creates artificial realities in the individual. If we don't wake up and see "the green belts wrapped around our minds" life will be a series of frustrations, confusion, hopelessness, and contradictions. Who benefits? Those that rule the world.

Boogie, Boogie, Boogie

I didn't take long for another installment of the bin Laden "I hate the infidel" saga. According to the our benevolent masters and their media whores, bin Laden passed along 11 minutes of himself ranting; conveniently just in time when US imperial wars are at an all time low in support. Maybe Usama should open a PR firm. Perhaps issuing this alleged bin Laden tape on last Friday would have caused an even greater distrust. It is amazing that any rational person could buy such garbage.

Where does the tape come? The CIA-linked Intel Center. It was the Intel Center who was caught inserting an Al Qaeda logo in one of their tapes at the same time their own logo was inserted. According to Steve Watson, "Intel center is run by Ben Venzke, who is an interesting character. A google search results in the revelation that he used to be the director of intelligence at a company called IDEFENSE, which is a verisign company. IDEFENSE is a web security company that monitors intelligence from the middle east conflicts and focuses on cyber threats among other things." Furthermore, video/audo tapes are sold by Intel Center to the government. Where does the Intel Center get them? From a company called As-Sahab: a company that is Al Qaeda's "production company." I'm sure it is not out of the realm of possibility that they simply manufacture them at times too (from my professional experience, with technology existing today, it is possible to create entire videos of computer generated images (CGI) indistinguishable from the real thing).

In case you don't know who the figures are the photo here, they are Zbignew Brezinski and Usama bin Laden. Best friends forever? Brezinski loves getting others to do his dirty work.

8th Anniversary of 9/11 come and gone

I was quite busy answering questions on 9/11 to curious friends that I neglected my blog. What is there to say about this anniversary? Namely, that the powers that be gear-up each September 11 to sweep the events of 9/11 under the rug of history; effectively burying dissenting voices, the swarming multitudes, on the subject. All the major corporate media outlets repeat and hammer into the ground the government blessed conspiracy theory of 9/11. Dissenters are regularly derided and slandered.

9/11 is now treated as a religious ceremony with all the trimmings of ritual. Obama pays homage to the dead with symbols and carefully crafted words meant to stir emotion, and above all, loyalty to the American wars of 9/11 (while firmly reinforcing the images which created the "official" lie of 9/11). Let us not forget, that the nearly 3,000 that died on 9/11 were just the beginning of the greater number that have died because of 9/11; and will continue to suffer.

The occupation of Iraq and Afghanistan, CIA secret prisons, torture, renditions, rumors of wars, the growing police state, etc., go on and on. The truth of what happened on September 11, 2001 matter a great deal to the lives of posterity and the world.

FEMA videographer goes public about 9/11

Key Eyewitness Inside WTC 7 is Dead at 53

According to a confirmed report by Aaron Dykes of Prison Planet, 9/11 eyewitness Barry Jennings is allegedly dead at 53; however, circumstances of his death and corroborating reports have yet to turn up. Jennings was trapped inside of World Trade Center 7 (WTC 7) before either towers one or two collapsed and was later evacuated by firefighters.

After 9/11 Jennings was threatened by his employer with loss of his pension and job if he continued to communicate with those in the 9/11 truth movement. One of the creators of Loose Change, Dylan Avery, had many conversations with Jennings when shooting film and researching the film Loose Change: Final Cut. Jennings later attempted to recant the part of his testimony that he had been giving for years after 9/11 that he was stepping over dead bodies in the lobby of WTC 7. Jennings told this in private and in video recording with Avery.

Jennings worked for the New York Housing Authority as emergency coordinator in New York inside WTC 7. On the morning of 9/11 Jennings was to work at the command center at the 23rd floor of WTC 7. After some explosions, while trying to leave the building, Jennings and co-worker Hess, became trapped in WTC 7. According to Jason Burmas, creator of the film Fabled Enemies, a BBC reporter claimed Jennings never said anything about explosions and bodies despite being showed film and testimony where he did say such. In addition, Michael Hess, who was trapped with Jennings after explosions in WTC 7 barred their escape, immediately retracted his corroborating eyewitness testimony shortly after the reports of Jennings death. Why? Could it be that Hess is afraid that what happened to Jennings might happen to him if he continued to support Jennings account? The truth is we don't know anything about Jennings' death. The folks at Prison Planet have attempted to find out the details of his death and have been roadblocked. No obituary, no cause, only a confirmation by the Housing Authority that he is dead. Any reason should be treated as suspect if you believe that 9/11 was truly a murderous inside operation. One life matters very little.

What does this mean? It means that Jennings testimony will never be called upon by a grand jury subpoena. If there was ever another 9/11 investigation, an independent one, Jennings indispensable testimony will be lost. What makes Jennings testimony so valuable is that there is a scarcity of witnesses who were inside of WTC 7 before its controlled implosion.

As I find more information, I'll keep you informed. In the mean time please spread this recording of his testimony before.

Environmental Anomalies at the WTC

The fires at Ground Zero (GZ) did not diminish despite the use of millions of gallons of water, a chemical fire suppressant Pyrocool, and rain fall. The pulverized concrete blanketed the area and also failed to suppress the red hot fires from the debris piles. An article by Dr. Steven Jones, Kevin Ryan, and James Gourley, argues that, "such fires are better explained given the presence of chemical energetic materials, which provide their own fuel and oxidant and are not deterred by water, dust, or chemical suppressants." Energetic chemical materials are evidenced, says the article, by: (1) Photographs and witness testimony evidencing molten metal and explosions accompanied by white dust clouds; (2) Extremely high temperatures in the fires at the WTC; (3) Unusual spikes in volatile organic chemical (VOC) emissions, suggesting abrupt, violent fires on specific dates; (4) Unusual species in the environmental monitoring data, also corresponding to specific dates.

The presence of 1,3 Diphenylpropane (DPP) and other materials and characteristics have yet to be explained by the government and EPA.

After reading this article you may never step inside a skyscraper again. Maybe cigarettes should be banned in skyscapers from the possibility (that NIST has made us foolish mortals aware) of small fires causing an entire building's structural integrity to fail followed by a rapid, symmetrical, collapse. Why stop there? Maybe companies that specialize in controlled demolition better scrap incendiaries as the tools of the trade and start random small fires in buildings: they will save a bundle! Cha-ching$$$!

Sofia Shafquat and "9/11 Mysteries"

More Testimony From The Grave

Paul Watson, relentlessly reporting on 9/11 issues, has recently posted an article about Deputy Chief Raymond M. Downey, Commanding Officer of the Special Operations Command (SOC), for the FDNY, and expert on building collapses. Downey apparently commented shortly after the sudden explosive collapse of the South Tower that it was brought down with bombs. Downey died saving the lives of many at the WTC and has joined the cries of the dead seeking justice. Downey did not survive the controlled demolition of the North Tower. He is missed. This information comes from FDNY Chaplain Father John Delendick who asked Downey, after both witnessed the collapse of the South Tower, if it was brought down by jet fuel. According to Delendick, Downey told him that "he thought there were bombs up there because it [the collapse] was too even."Downey was no novice in the study of building collapses. He was viewed by many as an authority on the subject.

Watson remarks, "Downey's testimony is added to the assertions of hundreds of leading academics, scientists, former government and military officials and researchers, who have all questioned the impossible collapse of both the twin towers and WTC 7, and singled out incendiary or explosive devices as the only means by which the structures could have fell in the manner they did." Besides just giving us testimony after the fact, Downey was giving us his professional opinion based on his first hand engagement in the disaster of the WTC. Along with Downey lay the voices of hundreds of dead WTC victims silenced by evil NYC bureaucrats through the courts. See may post from last year entitled "Silencing the Dead."

Boogie-Man Bin Laden

Well, it's that time of year again; the time of changing leaves, cool weather, and more disinformation from our secret government spooks. That's right, it's the sixth anniversary of 9/11.

Last year on the fifth anniversary of 9/11 I commented on the media blitz of disinformation to slander and deride the truth behind 9/11. Last month we witnessed the release of the History Channel's big 9/11 hit piece and now we see the release of yet another so-called Bin Laden confession tape, or an "I'm the boogie man here to scare you in to submission" tape. Thankfully, the folks down at Prison Planet have put out a good article in refutation of such shameful attacks.

CIA Official Sounds Off on 9/11

Retired Central Intelligence Agency (CIA) official Bill Christison has publically (on the Alex Jones Show) remarked that 9/11 was an inside job. Christison served as a National Intelligence Officer and Director of the CIA's Office of Regional and Political Analysis. Christison was formally skeptical about alternative 9/11 theories before researching 9/11. Christison remarked, "The reason that the two towers in New York actually collapsed and fell all the way to the ground was controlled explosions rather than just being hit by two airplanes [1]."

The Fifth Anniversary of 9/11, Propaganda, and Dr. Steven Jones

As we come closer to the fifth anniversary of the September 11th tragedy, media outlets are gearing up for coverage. Like vultures, the media grabs hold of the story, devours it, and then moves on until a better story comes along. The media acts in cycles and shows antipathy as it coldly reports what it deems as news. 9/11 coverage has increased steadily over the past couple of months and now we see its climax. Once September 11th comes and goes the story will fade away to more profitable topics.

One of the more notable pieces to appear surrounds the strange release of another so-called Bin Laden tape. While the average American may not seem interested in this it is important because it aims at discrediting the 9/11 truth movement and solidifying the US-backed story. On Drudge Report the headline reads, "Al-Jazeera Airs Pre-9/11 Bin Laden Tape." First off, the tape is alleged to be "pre-9/11." How do we know this? Well, we don't. We simply trust Al-Jazeera: who cannot confirm anything. In fact, they don't even tell us where the tape came from. Are we supposed to believe that it's just an amazing coincidence that a tape featuring Bin Laden, with alleged 9/11 criminals, simply shows up days before 9/11/06? Well, I suppose if the majority of Americans can believe that WTC buildings 1, 2 and 7 all fell due to planes (the last not being hit by a plane)they will believe anything.

However, no one is concerned over questions of legitimate evidence. Only the official conspiracy theory matters. Among the excessive coverage of ABC's "Road to 9/11," Drudge Report threw in a headline on Thursday regarding BYU professor Dr. Steven Jones. Jones has apparently been censored, or is in the process of being so, by BYU for his opinions on 9/11. He has been forced to take a paid leave conveniently as we approach the anniversary of 9/11. This is more significant than it appears. Jones is a major figure-head in the 9/11 truth movement. Publicly censoring him at this time, i.e. violating his freedom of speech rights, is a psychological jab that tells the public that alternative theories of 9/11 are unacademic, not accepted by society, and merit punishment. Jones could have been forced on paid leave anytime. He is not doing anything different now than he was doing a year ago. The only difference is that BYU has suddenly decided to punish and humiliate Jones and the truth movement. I would not be surprised if we don't once again here Bill O'Reilly, or others like him, rehashing their call for the removal of Kevin Barrett from teaching alternative 9/11 theories at the University of Wisconsin. Two things are important for US government at this time: reinforce the official conspiracy theory and discredit alternatives. The National Institute of Standards and Technology (NIST) and the State Department have both tried to do this during the past couple of weeks by issuing so-called refutations (if it can be called that). Jim Hoffman of 911 Research has carefully analyzed these documents and has shown how each is a redressing of the official conspiracy theory.

To further solidify the government-backed conspiracy theory, President Bush will be giving an address to the nation on 9/11 at 9:00 pm. The purposes of this address should be obvious: self-promotion, GOP promotion, a reminder of the so-called "war on terror," and most importantly, reinforcement of the official conspiracy theory.

There will definitely be more attempts, subtle or obvious, to discredit the 9/11 truth movement. World Net Daily has told us that only anti-Semites believe in alternatives theories to 9/11. GOPUSA has echoed this same. Of course, GOPUSA is much more comfortable blaming democrats than anyone else. As 9/11 comes closer there will be more hit pieces varied in their criticisms. Once 9/11 passes so too will media coverage, at least for awhile.

The folks at Infowars.com point out some interesting remarks Bush made about conspiracies. Apparently, if you happen to believe in any so-called "conspiracy theories" you may be a terrorist.

I have been away for awhile due to problems with my internet service. I will return with more in-depth articles very soon.

New Photos of the Smoking Gun: Building 7

On Infowars.com new photos of WTC building 7 and 5 (among other photos) show startling images. These photos support the argument that the destruction of the WTC was accomplished by controlled demolition. Building 7 was not hit by a plane and was further away than building 5, yet it fell (on its footprint) at free fall speed to the ground. Additionally, WTC building 5 was a raging inferno and some how held up, while 7 had only small fires. In case my readers are unaware, Larry Silverstein (leaseholder of the WTC) actually admitted that building 7 was "pulled" (a term used to denote controlled demolition). Though there were buildings closer to Towers 1 and 2, it was WTC building 7 that fell. Interesting isn't it? Perhaps the reason that buildings sitting closer to the Towers didn't fall was because Silverstein didn't own those buildings. Check out this excellent article about the ownership of the WTC and the huge profits that Silverstein received from their destruction.

I am working on putting together an article on building 7 to appear very soon. Until then, read the fine articles written by Scholars for 9/11 Truth and the ones I have added to my "download" section. I am sorry to say (to strictly visual learners), but if you want to understand what happened on 9/11 then you have to read.

World Net Daily, at it again.

Last week I posted a piece about World Net Daily's (WND) hit piece in their September issue of "Whistle Blower." In addition to this hit piece, on August 16th WND published a shameful hit piece by Jonathon Moseley ridiculing the truth movement. Among many assertions, Moseley claimed that Dr. Steven Jones advocated violence on C-SPAN in June. He also called Dr. James Fetzer (of Scholars for 9/11 Truth) an anti-Semite while using fuzzy logic and straw-man arguments in vain to debunk alternate theories on 9/11. In fact, Moseley called those who didn't support the official government-sponsored 9/11 story as simply Bush bashers (the title of his article). Once again, another misunderstanding about the argument put forward by the truth movement. The truth movement is not about politics, but about truth and exposing cover-up (lies). Until conservatives as Moseley can realize that fact there will be only anger and contempt for those who don't fall in line with the official government story. WND, a conservative website, only fuels greater political division by publishing terrible articles as these, and (as a result) ends up blinding people from the truth. Fortunately, Alex Jones and Dr. James Fetzer raised flags over this article and WND issued a retraction.

Moseley was brave enough to appear on Jones' radio show with Fetzer (though I can't say it turned out well for him) [listen here]. Be sure to listen when Moseley denies that Operation Northwoods exists (check out my download section to view this document).

Silencing the Dead: 911 phone calls

Yesterday, media outlets published many headlines saying things as "NYC releases New 9/11 Tapes". CBS even posted tapes for your listening pleasure [click here to view]. This so-called release of 9/11 tapes is misleading. In fact, there has yet to be full disclosure by NYC as to what was going on in the WTC through 911 calls, dispatcher calls, and interviews of firefighters . The latter has been somewhat disclosed after the August 12, 2005 ruling of the Court of Appeals (the film "Loose Change" uses some of these interviews and dispatcher calls with firefighters.Click here to view source material). The New York Times has posted the oral histories, or interviews, of firefighters on their website. If you click on any of the recently alleged disclosed 911 tapes you will hear a series of intermittent beeps. Those beeps are to block the words of the victims in the WTC. And as you listen you will realize that in fact nothing has been released. It's all a lie, a half-truth. Why mislead? Because it is important for those supporting the official conspiracy theory (the government) that the public believes the government is fully disclosing 9/11 evidence and it has nothing to hide. For example, MSNBC does not mention anything about the obvious edits till page two. They spend more time discussing the tapes as though there is material to discuss. Listening to these edited tapes is like listening to a one-sided conversation. Why the edits? Why did these tapes take about four years to be disclosed?

Four months after 9/11, Jim Dwyer, a New York Times journalist, requested disclosure of 911 calls, dispatcher calls, and oral histories (audio and written) from EMT and firefighters. FDNY denied his request. In a 2005 article the New York Times said that they "sought copies under the freedom of information law in early 2002, but Mayor Michael R. Bloomberg's administration refused, leading to litigation." In 2004, the case went through the NY Supreme Court and then to an Appellate Division where both decided in favor of FDNY and New York City (ruling for partial disclosure). FDNY argued that the Freedom of Information Law (FOIL) was limited by certain exceptions in Police Law. Both courts agreed and allowed material to be edited or blocked. The families that sued could have full disclosure of 911 calls, but other 911 calls were not disclosed out of an alleged privacy exception the court dreamed up to conceal the tapes. The case was then appealed to the District Court of Appeals in Matter of New York Times Co. v City of N.Y. Fire Dept., 3 AD3d 340. They affirmed the lower courts decisions and added that the interviews should be disclosed (because they were public records).

What is interesting is that the Court of Appeals, Judge Smith writing for the majority, argued that 911 calls were not public records (while calling the interviews public). Perhaps I should say that they avoided that issue altogether. Smith ended up siding with the FDNY by allowing the privacy exception in the Public Officers Law § 89. What is fascinating is that Smith failed to see that 911 calls are public records. When you make a 911 call you are being recorded by a public entity and it is generally acknowledged by the caller that what they say goes into the public record. Courts have upheld full disclosure of 911 calls as public records. Private phone calls, on the other hand, cannot be recorded because it invades a private conversation between individuals. In addition to the public issue, Smith assumed the side of families (because there weren't any in the case) who wouldn't want disclosure and ignored the families of the WTC tragedy that had only shown support for full disclosure. Smith ignored this fact and advocated for those families not in the legal suit (who voiced no opinion). Also, he expanded the idea of privacy rights by extending it to dead people. Specifically, he allowed relatives of dead people to hold, as a kind of trust, the privacy rights of the deceased. In that way their rights essentially never go away because someone can always claim the deceased's privacy right. Again, Smith fails to do several things: (1) he ignores the historical, and public significance of 9/11; (2) he goes against precedent and placed 911 calls in a protected realm of privacy; and (3) he ignores the families demanding full disclosure and personally advocates for families seeking non-disclosure. Smith presumptuously said, "The grieving family of such a caller—or the caller, if he or she survived—might reasonably be deeply offended at the idea that these words could be heard on television or read in the New York Times." Smith seems to know more about wishes of the families of the victims than they do. Again, this is a clear bias against the plaintiffs (specifically the families in the suit with the Times) and a gross deference to outside parties (not involved in the case). The dissent in Matter of New York Times Co. v City of N.Y. Fire Dept., (3 AD3d 340) by Judge Rosenblatt analyzes these problems better than I can:

"I disagree with the majority only with respect to the 911 calls. The Freedom of Information Law (FOIL) requires more disclosure. The public is well aware of the function of the 911 system and the sort of information it is designed to relay. Ordinarily, there is no reasonable expectation of privacy in a call to 911, and the full contents are generally subject to disclosure under FOIL.

Here, because of the unique nature of the attack, the Court has ordered disclosure of words spoken by the operators, while deleting the words of the callers. There is, of course, a need to balance the competing public and private interests. On the side of full disclosure lies thepublics interest in a complete and coherent account of what happened on September 11, 2001. FOIL's goal of making information public is inhibited when only half the conversation is divulged. The value of a response is compromised when the words that prompt the response are deleted. In some instances, the thrust of an incomplete communication can be inferred or constructed; in others it will be incoherent or even misleading...

Notably, the City has not provided any affidavits from survivors or victims' family members suggesting that disclosure of 911 tapes, or any other material sought, would violate their privacy. The record contains only the opposite: affidavits from nine intervenors, family members who want full disclosure. [1]."

After the Appellate Division of New York ruled to affirm the NY Supreme Court's decision, "family members complained that New York City officials cited the privacy of victims' families as a reason to keep the records sealed. Monica Gabrielle, who lost her husband in the World Trade Center and wants the documents released, called that "ludicrous and outrageous. I have not gotten one call to ask if I want the information released," she said." The questions are inevitably raised in our minds: What is all the fuss? What is the FDNY hiding? Why spend a so much in legal fees and three years to block tapes about an event we are supposed to know all about? Even President Bush, shortly after 9/11, told the American people that we didn't need an investigation [2001 CBS article]. If that is the case then why the secrecy?

The 2005 case shows poor legal reasoning and willful ignorance of precedent. Judge Smith never cites any precedent for allowing editing of 911 calls. However, Judge Rosenblatt does. Check out this powerful footnote in his dissent:

"Other courts considering the availability of 911 calls under FOIL have uniformly required their disclosure, and the majority appears to be in agreement in the ordinary case ( see maj op at 6). In Cincinnati Enquirer v Hamilton County (75 Ohio St3d 374, 377-378 [1996]), the Ohio Supreme Court held that there was no expectation of privacy in a 911 call and, accordingly, ordered the release of 911 tapes under that state's version of FOIL. It further held that the tapes became public records at the moment they were made and that their content was irrelevant ( see id. at 378). In accord are Meredith Corp. v City of Flint (256 Mich App 703, 708-709 [2003]); Asbury Park Press v Lakewood Township Police Dept. (354 NJ Super 146, 161 [Ocean County 2002]); Brazas v Ramsey (291 Ill App3d 104, 106-107 [2d Dist 1987], app denied, 174 Ill.2d 555 [1987])."

The chief legal question is whether the interests of the public for full disclosure under FOIL (designed for the public good) outweigh other interests: as those of victims, FDNY, and law enforcement agencies. It is clear that the events of 9/11 have an enormous public interest, and interest for the world and history. Though victim's families have voiced a desire for disclosure the Court turns a deaf ear. "'To this day, I have no information whatsoever about what happened to my son,' Sally Regenhard, whose son was a firefighter, told reporters. 'We need to know the truth [2]." I'm afraid the those in control won't allow that Sally.

World Net Daily joins CBS, ABC and Popular Mechanics in 9/11 brainwashing

September is approaching and the lies regarding 9/11 are coming into full swing. The neo-conservative website World Net Daily (WND) joins the 9/11 propaganda matrix in their September issue of Whistle Blower. It is interesting that the media has become so afraid of something they deride as merely a "conspiracy theory" that they feel the need to devote so much time to shamefully debunk it. Conservatives are under the impression that to question 9/11 is to be anti-American or pals with DNC chair Howard Dean. WND certainly appears to follow the same reasoning. It is unfortunate that WND cannot think outside the box and their political ideology. 9/11 is not a political issue, it is a matter of truth. Though I have not read this issue of Whistle Blower, WND gives an overview about the magazine's contents. From that it is safe to say that WND is merely parroting Popular Mechanics (PM), as though they were the Bible, in their critique. In addition, PM has released a book dedicated to debunking so-called 9/11 myths. A representative of PM also appeared on Bill O'Reilly's "The Factor" deriding the 9/11 truth movement as a myth. Finally, ABC (click here) and CBS (click here) plan to air programs designed to brainwash the masses with the official story to suppress the 9/11 truth movement.
CBS has aired something like this before, while ABC is airing for the first time a six-hour series. These are mainstream channels, widely viewable for non-cable subscribers, which will result in further entrenchment of the government's official lie regarding 9/11.
