Private Commercial Mortgage Lenders Thrive Amid Credit Crunch - Where To Turn For Financing Today

The Liquidity Crisis Has Paralyzed Institutional Commercial Mortgage Lenders

We are in the middle of the most challenging credit environment in a generation, and crisis is not too strong a word to describe the situation we find ourselves in. American business runs on borrowed money, as-does America’s multi trillion dollar commercial real estate industry. Without the free flow of capital the system breaks down.

Institutional lenders are just not lending. Thousands of great projects that would have been fought over just two years ago are being rejected out-of-hand by banks and by Wall Street. The problem is liquidity. Conventional lenders can’t sell their loans into the secondary mortgage market anymore, so they are opting to hold on to their cash until things improve. And who can blame them? There is no money to be made writing a 6% mortgage and then holding it for decades. A thriving market in mortgage paper is imperative; institutions absolutely must have the ability to sell and borrow against the loans they write.

The Mortgage Derivatives Market Has Broken Down

Specifically, it’s the “collateralized mortgage obligation” or “CMO” market that has broken down. CMOs are simply publicly traded bonds that are backed by packages of mortgages that Wall Street investment banks have bundled and turned into marketable securities. They trade in several different incarnations such-as “CDO” (collateralized debt obligations), CCMO (collateralized commercial mortgage obligations) and “MBS” (mortgage backed securities) but, whatever the acronym they’re all the same thing; mortgage derivatives.

Because many of these bonds are backed by a variety of mortgage types, including the dreaded “sub-prime” residential mortgage, and because no one really has a handle how bad the sub-prime crises will get or if it will spread, investors are cool towards mortgages now-a-days. Or, put another way, nobody’s buying CMOs anymore. Lenders are not confident that they can sell the loans they write, so they don’t write them. Likewise, investors are not buying mortgages because they aren’t sure they could turn them back into cash if they needed to. The cycle is vicious and devastating to our economy.

A Massive Funding Gap Has Been Created

The result is what I call “the funding gap”. Loans that fall into the funding gap are quality commercial mortgages that should be funded but, due to the turmoil in the credit markets, have been rejected. There are tons of great deals on the sidelines today, deals with top-notch sponsorship and plenty of equity. With the big banks largely out of the lending business, private mortgage lenders have stepped in to fill the funding gap.

Private Lenders Are Playing a Vital Role

Private lenders, once referred to as “hard money” lenders, are privately held companies that engage in commercial mortgage lending for their own benefit. Privately funded commercial mortgages are, generally underwritten on the basis of equity and are typically not credit driven. Interest rates and points on private loans are significantly higher than those charged by banks and other large institutional money centers. Private mortgage lenders can make decisions quickly and fund loans in a matter of a-few weeks, rather than the several months it takes to close a conventional deal.

Many private commercial lenders are, what’s-known-as, portfolio lenders, meaning they hold the mortgages they issue in their own company portfolios. Others do sell their loans, but generally not to investment banks that turn them into bonds. By-and-large, private, hard money lenders are not concerned with the goings-on in the CMO market. Private lenders charge more than double what their institutional counterparts’ charge, so it can be very profitable for them to write a loan, collect the interest during the loan’s term and then get their principle back at maturity. They issue mortgages at low LTVs (loan-to-value ratios) so the risk inherent in holding mortgage paper is mitigated. Because private mortgage firms are not at the mercy of the secondary market, the liquidity crisis that has paralyzed banks, Wall Street and other traditional lenders has had little negative impact on them. In-fact, private commercial mortgage lending is thriving.

Once considered lenders of last resort, private, hard money, firms are now mainstream business and are, indeed, the fastest growing segment of commercial real estate finance. With bank lending volume severely curtailed, thousands of excellent loans are in danger of going un-funded. Commercial real estate property owners, investors and developers are becoming more and more frustrated and are turning to private funding sources in record numbers. Private lenders are making deals and closing loans based on the merits of the deal not the condition of the credit markets. Even large developers and project sponsors who would not have dreamed of turning to a hard money lender just 18 months ago, are now lining up for privately funded loans.

“Hard Money” Can be Well Worth the Cost

Hard money commercial mortgage loans funded by private entities are more expensive than conventional loans on an absolute basis but, because there is no institutional bureaucracy and lending decisions are based on a simple LTV formula, private lenders are much faster and more efficient. If a deal makes sense, a private lender can close and fund it in 10 business days or less. Many real estate investors have come to realize that, even as high as the rates are, hard money is a-lot less expensive than losing the deal completely.

Finally, does the home have carpets? If so, people have been walking over them. Developers know anticipate this and tend to put in cheap carpet that looks nice, but won’t last. Get it changed out for something better.

The barrier methods of birth control work by preventing the sperm from reaching the egg. The idea of inserting something into the vagina to prevent pregnancy is not new. Such devices were called pessaries and they were used by the ancient Egyptians.

Pessaries were mentioned as early as 1850 B.C. in the Petri Papyrus. The formula then was a mixture of crocodile dung and honey which was placed in the vagina prior to intercourse.

“Interestingly, this mixture not only acted as a barrier to sperm, but had some broad spermicidal effects. If a convenient crocodile wasn’t available, elephant dung could be used,” said Dr. Niels Lauersen, a diplomate of the American Board of Obstetrics and Gynecology and Steven Whitney in “It’s Your Body: A Woman’s Guide to Gynecology.”

Various formulas of pessaries were used throughout the world. Elephant dung and honey was the preferred combina¬tion in India and Africa. In Persia during the 10th century, pessaries were made of mixed rock salt and an oily material.

The most popular pessary, however, was invented by Walter Rendell, a London chemist who lived in the late 1800s. Seeing how many people suffered from the burden of having too many children, Rendell developed a pessary containing quinine which he distributed freely to customers at his pharmacy.

“The results of this new pessary exceeded his expecta¬tions. Requests were logged so rapidly that the pessary was marketed commercially in 1886. By the turn of the century, the product was a best seller throughout the world. In fact, until the 20th century, quinine was the only recognized spermicide which could be used with complete safety,” Lauersen and Whitney added.

With the popularity of pessaries, new formulas were developed using less irritating substances. Today’s barrier methods of contraception include the diaphragm, vaginal sponge, condom and cervical cap. These are often used together with chemical barriers such as creams, jellies, foams and suppositories. Let’s examine them one by one.

DIAPHRAGM AND CERVICAL CAP

The diaphragm is a molded rubber cap which blocks sperm as it covers the cervix and the back of the vagina. It must be inserted for each act of intercourse and left on for six to eight hours afterward.

A smaller version of the diaphragm is the cervical cap which covers only the cervix but works the same way. Unlike the diaphragm, however, this device must be fitted by a physician. Women may find it difficult to do the same because the cap must be inserted deep within the vagina.

I know something about you. I may not know you personally but I still know something about you. That something is this: YOU were born with the seeds of greatness and created by the Creator of the universe to be a champion. If you choose to tap into your greatness, then you will live an extraordinary life. We may not all be famous. We may not all be financially rich. But we all have greatness to make a difference in this world. Dr. Martin Luther King, Jr., said, “If a man is called to be a street sweeper, he should sweep streets even as Michelangelo painted, or Beethoven composed music, or Shakespeare wrote poetry. He should sweep streets so well that all the hosts of heaven and earth will pause to say, here lived a great street sweeper who did his job well.”

History tells us a wonderful story about the greatness of individuals. It goes something like this. The year was 1815. The date was March first. This was the day that all of Europe will remember. It was as if all their nightmares were coming true. On that day, a small British ship sailed very quietly to dock on the French Riviera. A man stepped off the boat with a fire in his eyes. The man looked as if he were on a mission. All of Europe shivered at the thought of the return of this man. The nightmare was back. His name was Napoleon.

Napoleon had been exiled to the island of Elba, which is off the coast of Italy. During this period in his life, Napoleon didn’t want to live and he attempted suicide. He carried a pouch around his neck that contained poison. He swallowed the poison but he did not die. He suffered cramps and convulsions and then he recovered.

Napoleon spent less than a year on Elba. He knew that the Allies had many differences and couldn’t solve them at the Congress of Vienna. Napoleon hoped to exploit this weakness to regain what he thought was his right to power. After his recovery from the poison, Napoleon escaped from his British captors and stole one of their ships. Now he had just stepped off this stolen ship to begin his revenge on a frightened Europe.

The Allies immediately put their differences aside and joined forces to confront the tyrant. One of the men Europe looked to defend them against Napoleon was the Duke of Wellington. Wellington was a British hero determined to stop Napoleon. Wellington commanded the combined forces of Great Britain, Prussia, Belgium, and The Netherlands. A line was drawn in the sand and a battle was fought. That battle was to become one of the greatest military victories in all of history. The battle was called “The Battle of Waterloo.”

Before the battle, Wellington was in Brussels preparing for his standoff with Napoleon. Accompanying the Duke was a member of the British Parliament named Thomas Creevey. As they were walking through Brussels Park they noticed a lonely British redcoat staring at a statue. Wellington grabbed Creevey by the arm and said, “There, look at him! It all depends on that article whether we do business or not. Give me enough of them and I am sure of victory.”

On June 18, 1815, the line was drawn in the sand. Wellington had with him 67,661 men and 150 artillery guns. Napoleon had 71,947 men and 246 artillery guns. Because of heavy rain the night before, Napoleon chose to wait till close to noon to attack. This decision may have cost him the victory. The battle began at 11:25 in the morning and would last until 10:00 that evening. Napoleon pummeled the front of Wellington’s line. Wellington’s troops fought earnestly. Finally, all hope for victory was put on the British infantry. These solitary redcoats put together made an impressive stand. These boys stood their ground. They would not give up. They believed in their leaders. They believed in their cause. They began to believe in themselves. They did have greatness within them. The line in the sand stood and finally Marshal Gebhard von Blucher came and reinforced Wellington with his Prussian troops. Napoleon was forced from the battlefield licking his wounds. This battle finally closed the book on Napoleon’s quest to rule Europe. Europe was safe again.
