I live in Portland, Oregon and recently received a notice in the mail for a telephone hearing. It is for a modification of child support. When you file for a modification of child support and the other party claims to make less than the bare minimum amount being requested (40 hours per week based on a minimum wage of $8.50 an hour or $1,477 a month), what are some of the stories or supporting evidence that an administrative law judge might entertain to arrive at a final decision?

My spouse and I are in the midst of marriage counseling. We are both making an effort but my gut is telling me that unless my husband becomes a completely different person, things are not going to work out. I own my own business and money is practically nothing right now, but I'm on the verge of some very big breakthroughs that could lead to financial windfall later this year. Financially now - I'm reliant on him, but I'm worried that if I wait to file until I have my own money that I'll end up getting screwed having to split my new earnings with him for spousal support, etc., or whatever would happen in terms of custody with our 2 kids. I'm open to advice, feedback. Thanks.
