Asbestos work comp claims can be very tricky because most of the symptoms of an injury doesn't show up for fifteen years or more. The injured employee could be long gone from that previous job and should have concerns that the time limit could be expired. An article over at Illinois Work Comp hints on some of these points.

Worker's compensation claims can be difficult even for the normal injuries that usually occur at work. When you throw in an on the job injury that might have occurred twenty years ago and in a building that was owned by a third party or someone other that your employer, the case gets extremely difficult. In cases like these, it's imperative to obtain legal representation as well as Experienced Work Comp Physicians and Doctors.

Slip and Falls are usually considered third party billing accidents unless it occurs on the job. The article at Diocese Looses Workers Compensation Appeal is intriguing for several reasons. The article eventually touches on unemployment benefits in respect to the diocese participation but starts out with a work comp case that involved a diocesan priest of seventy two years that had a slip and fall accident while at work.

The total cost of medical treatment from the local hospital for the priests care was over four hundred thousand dollars. Although the workers comp hearing officer concluded and ruled that the diocese was responsible for one hundred percent of the medical bills, the diocese appealed the ruling and lost but still only paid the hospital one hundred forty two thousand dollars. It's more than concerning that the medical provider was extremely underpaid even though the diocese was self insured and knew the risks. A discussion of a priest trying to get out of paying bills is a brutal topic for another day.

Workman's compensation is a tangled animal as it is and situations like the above priest's is one of the reasons for high work comp insurance benefits. There are many factors involved when considering the multiple facets of the system. It's unfortunate that we don't learn or understand the complications involved with an on the job injury until it happens to us. Moreover, only when one recovers from a worker's compensation injury do they understand the confusing and disturbing process: Even then it still might be too late.

One aspect that is important in third party billing accidents or slip and falls is personal representation. For instance, frequently, the workman's comp insurance carrier will deny requested diagnostics and approve physical therapy. Depending on the unknown injury this physical therapy could actually increase the pain, injury or health problems. These situations and more are among the many reasons that an attorney is more often than than not extremely important to retain to provide the best advice for recovery treatment. Work comp law firms also have a list of proven and experienced Medical Physicians and Specialists that treat for all the different and various injuries that occur on the job. And vice versa, worker's comp medical clinics have a list of worthy attorneys experienced with these types of injuries. Am I wrong or missing something, let me know by commenting below.

"Healthier employees lead to lower premiums". This is the main idea as well as the first sentence located at 5 Steps Companies Should Take Before Launching a Wellness Program. Insurance premiums are important factors for any business due to the high costs and can make or break companies.

As stated, wellness programs that maintain healthy workers can reduce healthcare costs in many areas. Workers that are more healthy are less prone to an on the job injury and if injured, recover from their pain and injury more quickly.

Worker's compensation insurance companies charge businesses outrageous costs for work comp insurance and benefits associated with work related injuries. Workers Comp Physicians and Doctors recommend wellness programs. These programs can focus on out of shape employees, healthier foods and exercise programs which can positively affect absentees and medical costs.

To implement a wellness program, take in consideration a few points. Companies should evaluate costs associated with health trends, asses the ability to implement health programs, educate employees, ability of management support and establish goals. What else should be added, comment below.

The underlying question is "Was the employee receiving compensation during travel?" This resulting evaluation refers to the legal decisions and court's outcomes related to travel injuries at an article over at No Worker's Comp for an Employee Injured on the Way to their Job.

There are many previous cases setting precedent for these types of accidents that involve "Traveling Employees" The post mentions several cases that include resembling remarks concerning identical incidents:

Does the employee's job duties and responsibilities require travel?

Does the employee's job site differ from day to day?

Is it a stretch for the "Coming and Going Rule"?

Does the employee have a fixed place of employment?

The final and most important question that determined the outcome of this case is "Was the employee paid for travel time?" Moving forward, the injured worker will have an even more difficult time finding a Treating Doctor or Work Comp Physician. Not all medical clinics treat for on the job injuries. Additionally, the type of doctor to seek to treat injuries and pain will be directly affected by the outcome of this case. Also, if the employee was receiving medical care from a workman's compensation physician before and during the case, he or she will have to obtain a new treating physician that is accepted by his personal healthcare plan.

The real question remains; was the injured worker receiving medical treatment until the court's judgment was declared and if so, who will be responsible for the medical bills? Will the worker's compensation insurance company file a suit against the injured employee personally for medical reimbursements? What's your thoughts? Comment below!

It's a short article over at Washington Work Comp Overhaul Keeps Business Costs Down. To explain, the post states that due to concerns from businesses the Department of Labor and Industries is proposing a rate hike of 2.5 percent next year to restore depleted reserves but was considering up to 8 percent.

Businesses worked with the lawmakers on many worker's compensation changes including the state's ability to offer decreased settlements to the injured worker to lower payout costs over the long term.

This is absolutely disgusting. The Labor Unions fought against it but lost to the businesses and lawmakers. This is a ripoff to the major party involved; the injured employee. It should be illegal for the state to pay the patient less than they deserve: The state is treating the injured party as if he or she asked to be severely injured at work for their employer and to financially and emotionally compromise the ability to provide for their family.

This is absurd and it proves that the lawmakers in Washington don't care one bit; it's been said before, it seems like the lawmakers in Washington just seem to be "Playing House".

It's hard enough to find Treating Work Comp Physician Specialists without the government adding more burden and increased misfortune on an already injured worker. Shame on you Washington. Leave a comment below if you agree or disagree.

The IRS announced that companies that classified employees as independent contractors to get around worker's compensation insurance premiums will only have to pay a "Small payment to cover past payroll taxes" in a program named the Voluntary Worker Classification Settlement Program. The article over at Are Employers Rolling the Dice goes on further to state that the IRS uses a twenty factor test to determine if an individual is an employee or an independent contractor combined with the different statutes and the Fair Labor Standards Act's provisions complicates the decision.

This distinction is important for many reasons. Employers must pay high work comp insurance premiums to provide benefits to any workers claimed as employees. However, independent contractors are responsible for their own coverage of medical benefits. Also, it's unfortunate that the majority of medical clinics don't accept workers compensation insurance for payment of treatment. In specific situations, the employer chooses the Medical Doctors or Work Comp Physicians to treat for a on the job injury

On the other hand, as the article summarizes, there is a potential danger and risk involved with recourse treatment with this type of admission of guilt to the IRS. Let me know you are alive by commenting below.

Congratulations to Dr. Burdette for over 10 years of providing community health care as well as supporting and giving back to the community. A wonderful story at Community Chiropractic celebrates 10 years in Poway details a retired 20 year Marine gone Doctor has a success story worth reading by anyone and not just those in the industry.

It seems Dr. Burdette treats his community for a multitude of injuries and pain. From car accident injuries and soft tissue massages to sports injuries and ailment treatment for adults as well as children.

While it can be difficult to find a doctor that one can be comfortable with, it is even more laborious to locate medical professionals that can treat for auto accidents and personal injury including slip and falls. The majority of primary care physicians and medical doctors, including family practice, don't treat for these types of accidents due to third party billing. But there are Experience Car Accident Physicians out there.

When it comes to car accidents and such, treating physicians want a guarantee of medical cost reimbursement since the insurance company involved is not the individual's. The physician will request this promise come from the patient's attorney. Since the patient's case might not settle for more than a year, the treating medical professional has to float the medical costs for an extended period of time and hopes the attorney settles for at least more than the medical reimbursement payments so as not to take less in the form of reductions.

For Dr. Burdette to continue to treat for all injuries including car accident patients for more than ten years proves a successful and resilient practice. Whadayathing, let me know below.

There are a multitude of posts on this site that sometimes hits on the same subject. If in a car accident, especially if injured, it's imperative to locate an experienced attorney and a Proven Car Accident Physician or doctor. The article over at Geico's Valuation of a Wrongful Death Case states a few of these facts amid a sad accident.

Unfortunately, a gentleman was rear ended by another motorist with underinsured provisions. The deceased had a policy that was purchased for just such accidents, that's what insurance is for. Most of the time, when injured in an auto accident, the victim's lawyer will represent the injured, communicate with the third party insurance carrier and settle for amounts that are used to pay bills and medical treatment reimbursements.

In this case, the attorney had to deal with their client's own insurance carrier to collect insurance payments for a situation that they were paying premiums for. The article details that the victim's insurance company still plays games with their own clients. A specific type of denial and low ball is offered while the author is amused because through his experience he sees this all the time.

I find it disgusting; absolutely despicable. It just shows, that if injured in a car accident, regardless of fault, it is without a doubt most important to retain a lawyer and obtain a car accident medical professional. Add your thought below if they are not dull.

There is a barrage of coverage concerning the Florida illegal immigrant awarded workman's compensation benefits after an on the job injury at a construction company. The article Lawmakers Blast Illegal's Worker's Compensation Case was one of the best articles covering the details.

In summary, a three judge panel of the 1st District Court of Appeals declared that Luis Aragon, an illegal immigrant, was entitled to work comp benefits after injured at work. The judges contend that "It was only right that the company foot the bill" otherwise it "would have put Aragon's medical bills on the taxpayers, presumably through unreimbursed emergency-room care."

Florida State Representative Ritch Workman disagreed with the decision and stated "The insurance company ought to make the employer pay every dime of that claim." It's merely a misdemeanor to hire an illegal alien in Florida, however, situations and examples such as this workmans comp injury are the reasons for stricter laws. Companies should loose their license to conduct business and should be forced to close operations indefinitely.

To strain the system furthermore, since a lower court judge considered that the illegal immigrant couldn't speak English very well and therefore would have difficulty finding another job, then the judge awarded permanent total disability benefits on a continuing basis. The illegal worker should obtain initial medical treatment and care and then promptly deported for breaking the law.

It's hard enough to find Competent and Experienced Work Comp Physicians and Doctors if injured at work and subjected to the already negative work comp experience to have illegal migrants increasing the work comp insurance premium costs while lowering the value of medical treatment. Agree or disagree, let me know what you are thinking by commenting below.
