Ofcom awards eight new community radio licences

Ofcom has today announced the award of eight new community radio licences (PDF, 346.5 KB) in England and Scotland. The new stations will serve communities in Coventry, Leeds, Reading and Waterlooville in England; and Glasgow and Peterhead in Scotland. No application was lodged by any Peterborough based group or organisation.

Community radio services are provided on a not-for-profit basis, focusing on the delivery of specific social benefits to a particular area or community of interest.

More than 250 community radio stations are currently on air.
The eight new community radio licences have been awarded to:

2tr (Two Towns Radio) (Basingstoke Broadcasting Company Limited)

Contact name: Matthew Perry-Vaughan
2tr will be a community radio service for Reading with a particular focus on listeners under-40.

Buchan Radio (Buchan Community Radio CIC)

Contact name: John Cropley

Buchan Radio will broadcast to communities in Peterhead and the surrounding areas.

East Leeds FM (Heads Together Productions Limited)

Revival FM (Revival FM (Glasgow) Limited)

The licences are awarded for a five-year period. A statement setting out the main determining factors for the award of the licences above (PDF, 346.5 KB) can be found on the Ofcom website.

In addition to the licence awards, Ofcom considered two further applications, but decided not to award a licence to the following:

2. Seven further applications were rejected due to there being no suitable FM frequency available:

Radio India (Radio India Limited), Metropolitan Borough of Dudley;
Regen FM (Regen Media Group Limited), Tottenham and Haringey, London.

3. In addition, one application has been rejected due to the proposed transmission proposals not being suitable to achieve the applicant’s required coverage area:

RMT 24-hour strike action on Northern Rail and Greater Anglia in disputes over guards and safety on Wednesday 9th May

RAIL UNION RMT confirmed further industrial action in separate disputes over rail safety and the axing of guards on both Arriva Rail North and Greater Anglia, the strike goes ahead as planned.

RMT members on both franchises are on strike for 24 hours on Wednesday 9th May.

RMT General Secretary, Mick Cash said: “Yet again the intransigence of private rail companies operating in England over the key issue of the guard guarantee means that we have no option but to go ahead with further strike action in the separate disputes on Arriva Rail North and Greater Anglia. We are drawing attention to the ludicrous situation that means we are able to reach agreements in Wales and Scotland on the guard guarantee but not on a raft of key franchises in England. If it’s good enough for Wales and Scotland to put rail safety first then it should be good enough for the rest of Britain.

“We have long detected the dead hand of the Government interfering to stop us reaching negotiated settlements in the current disputes and it’s about time Chris Grayling stopped playing politics with passenger safety and started taking the issue seriously.

Peterborough elections wash up ...Just fancy that

Just fancy that ....

Sadly the traditional Stanground community is now geographically split between three very different wards, following the ridiculous Boundary Commission carve up.

Still the voters have spoken, well a small minority who were able to vote. Many voted by staying at home, and not using a postal vote either. Sad when you consider all the effort our ancestors went to give us each the right to vote. But equally it is their right to abstain.

By the time the next full election comes around another 6,000 plus households will be added on the Cardea high density estate.

There is still some hope for a late correction as a by-election could be called sometime soon - perhaps even sooner - judging by the physical state of some of the councillors who ventured out...

You would be forgiven for thinking the Conservatives did quite well at the Peterborough local government elections but you'd be totally wrong. No less than TEN conservative party candidates lost including councillor Gavin Elsey seeking re-election, all were therefore not elected.

Something that one jingoistic 'janitor' and former failed loft installer, with a variety of CV's; - depending on the audience, might like to properly consider before his chubby knuckles, next hit the vapid keyboard. Turnips all round...

RMT rail union strike action goes ahead on Greater Anglia tomorrow in fight over rail safety and the role of the guard

RMT has confirmed some twenty four hours of industrial strike action on Greater Anglia Railway [GAR] tomorrow, Saturday 5th May. Its part of a long running dispute over rail safety and the role of the guard.

RMT General Secretary Mick Cash said: "Despite strenuous efforts by RMT Representatives to reach a negotiated settlement to this dispute, the vital safety role of the guard is still under threat. The extension of Driver Only Operations [DOO] remains a serious risk.‎ Nothing that the company [GAR] has put forward in recent talks resolves this fundamental issue.

"RMT Represntatives across GAR have made it clear that the fight for a safe and accessible railway for all continues, and that the RMT members remain 'rock solid and united' in securing that objective.

" As a result the union’s National Executive Committee has had no option but to instruct our Greater Anglia Conductor and Senior Conductor members to take a further 24 hours of industrial action this Saturday.

"Once again, I would like to congratulate our members for their continuous show of strength and solidarity throughout this long dispute which is solely about putting rail safety before private profit.

"‎The union also thanks the travelling public for their support and understanding throughout our campaign to put safety and access to services for everyone using our railways right at the top of the agenda.

On a shockingly low turnout of 27.8% Stanground South the geographically strange creation following the outcome of the Boundary Commission has returned the newly appointed deputy police and crime commissioner and former long-term Northern Ireland RUC officer Conservative Ray Bisby as its councillor for the next five years.

Clearly Mr Bisby will now have to physically venture out of the old Cardea footprint and immediately set up regular councillor surgeries for casework right across the new greatly expanded and culturally and religiously diverse Stanground South ward.

However questions remain to be answered over an earlier police panel result directly involving Mr Bisby which is the subject of an official complaint. The official response so far is unsatisfactory and with the document offered, only added to the suspicion, that the result is qustionable. More as we get it.

Consultation: Local TV licensing – provisional decision not to advertise or re-advertise certain local TV licences

The document sets out Ofcom’s provisional decision not to advertise or re-advertise licences in 13 specific areas, or their substitutes, identified for the roll-out of local TV services but where no licence has been awarded to date.

If following consultation, the decision is upheld, there will be no possibility of a local television station for Peterborough. Which in any case was not included in the original list.

China CK Group owned UK Power Networks puts major squeeze on Peterboroughs Charters Barge restaurant and iconic pub.

STOP PRESS: UK Power Networks, the UK subsidiary of the Chinese CK Group (owned by the 81-year-old billionaire Chairman Li Ka-shing who is due to retire this month, and we all wish him a long and happy retirement. Hopefully as a final retirement gesture, Li will personally intercede to resolve the matter, and might even have an Oakhams Ale named after him. Who knows?)

The firm has asked the PBROTRIB to publish the following statement, which we are more than happy to do, and have also discreetly offered the landowner a possible solution:

"As the landowner [UK Power Networks], we were happy to allow public parking for many years. Unfortunately the parking grew to a level which meant that access to our electricity substation was blocked at times, and damage was also caused to a fence. As a result we introduced the security barrier though we still allow public parking on part of the site, as well as access for local businesses, who we have consulted."

Dozens of empty parking places used by Charters for over 20 years suddenly put behind a locked barrier at the behest of Chinese owned CK Holdings subsidiary UK Power Networks.

The CK Group subsidiary UK Power Networks is seemingly trying to put a much loved and valued upmarket Peterborough Thai restaurant and an iconic Oakhams pub 'Charters' out of business? Why?

Meet Ian Smyth, Director of UK Power Networks Services ..... Ian joined UK Power Networks in August 2016, to lead the Chinese firms commercial division called UK Power Networks Services.

Prior to joining UK Power Networks Services he was Managing Director at Navigant, a Partner with LCP and a consultant with Ernst & Young.

Ian has a BA(Hons) and an MSc in philosophy, psychology, statistics and artificial intelligence.....

Charters Pub plus the East Thai Restaurant opened in 1991 and all housed onboard an original iconic 1907 Dutch coal barge, the largest in the UK.

The barge is 616 tonnes, built just a few years after RMS Titanic was launched and employing a like single row hot rivet process.

The Leendert - R built in 1907 and has worked ever since, ironically the cargo included coal for power stations, it sailed all over European canals and rivers, then heroically sailed over from the Netherlands, by Oakhams Brewery, then sunk to negotiate under Town Bridge, re-floated and rebuilt.

Its moored on the River Nene, but why is the Chinese CK Group trying to put Charters out of business?

...but they don't use the spaces...is it just a device to close down Charters??

UK Power Networks are slapping 'cease and desist' notices on any Charters customers car that dares park on the empty spaces alongside CHARTERS, indeed its so bad that staff working late shifts, and on modest wages, cannot even park their own cars without the heavy hand of the CK Group Chinese owned power company subsidiary choking the very commercial life out of one of Peterboroughs essential public realm attractions, threatening a number of local jobs and effectively putting Charters off limits to anyone even with a mild disability and reliant on motor transport.

Charters Bar and East Thai Restaurant now effectively denied access - by a Chinese firm CK Group - to many disabled customers or those of limited mobility who rely on motorised transport and cannot negotiate a steep metal stairway from the bridge above

Not a WORD from Peterborough councillors or any practical help for an iconic successful home grown business.

The new stations will serve communities in Bristol, Maldon, and Newcastle and Gateshead, in England; Belfast in Northern Ireland; as well as Cumbernauld, and Musselburgh, Tranent and Wallyford in Scotland.

There was no application in this round from any Peterborough based group.

Ofcom has published a Call for Evidence as part of its review of the guidance provided to public service broadcasters to help ensure they meet their regional production and programming obligations consistently. To help support and strengthen the creative economies in the nations and regions, Ofcom requires the BBC, Channel 3 services, Channel 4 and Channel 5 to meet expenditure and programme hours quotas for productions made outside of the M25, for UK-wide broadcast.

BBC One and Two, and Channel 3 services must also meet quotas to provide regional programmes that are of particular interest to people living in the area where the service is broadcast. Ofcom guidance explicitly defines the criteria that a production or programme must meet for it to be categorised as ‘regional’ and for it to count towards the quotas.

This call for evidence represents the first stage of an Ofcom review. Building on the stakeholder engagement sessions held last autumn, Ofcom is seeking data and further information from broadcasters, production companies and other interested parties on the health of the production sector in the nations and regions, and how effectively the current guidance supports the delivery of regional productions and programming in practice. Responses must be submitted by 10 May 2018.

These views will help inform a formal consultation, planned for later this year, on any changes Ofcom may propose to regional production and programming guidance.

PETERBOROUGH MISSES OUT ON £100MILLION FILM & TV STUDIOS ENTERTAINMENT COMPLEX

The Peterborough organisation charged with bringing in new business to the City, following the sudden and so far unexplained departure of Mr Harrison, is under the exceptionally well remunerated PCC Corporate Director Simon Machem - it is he of the Bourges Boulevard dead trees (replacements not doing too well either) and never ending roadworks saga - but he appears to have lost out again, in fact he never even fully responded to an earlier request to bring parts of London-based Channel4TV headquarters staff to Peterborough. Still we lead Dagenham in the number of Pizza outlets and formulaic near identical High Street 'restaurant' chains!

This latest lapse by the Conservative controlled council, many Conservatives - a few hardworking but the rest seemingly along for the generous allowances, they know who they are - will be offering themselves up for re-election as Councillors this May.

On the basis that Mr Machem as a council director acts on policy from the ruling political party, this must act as a wake up call. Clearly there are substantial new inward bound multi-million pound investment packages to be had, investment in terms of hard cash that creates substantial new jobs and positively raises the profile making this City an attractive proposition rather than the current conservative negative campaign posted on lampposts bemoaning the fact that a Conservative Westminster Government has cut funding to this City.

We don't for example see Barking & Dagenham Council sitting on their hands. They actively went out and searched for investment and clearly if run down Dagenham can do it, Why cannot Peterborough on the East Coast Main Line do the same? If anyone has attempted to get to Dagenham by road or rail, it is a nightmare, but they still have pulled this one off!

Major film and TV studios and entertainment complex confirmed for East London

Pacifica Ventures-MCC won the contract after Barking and Dagenham Council invited expressions of interest to build a bespoke complex near the Londoneast-UK business park towards the end of last year. The council’s urban regeneration company, Be First, was charged with finding suitable partners. Pinewood was thought to be one of the early front runners after it put forward a bid.

Pat Hayes, managing director of Be First, said: “I would like to thank all the bidders for the excellent quality of their submissions. Our team rigorously assessed each, but a clear winner emerged. Subject to detailed negotiations and exchange of contracts with Pacifica Ventures-MCC, we expect construction of the media and TV complex to get underway in 2019.”

The proposed Dagenham film and TV studios have been given the green light, with £100m set aside to create a studios and entertainment complex covering 22-acres, including 12 sound stages, a major events centre, VR and 3D attractions and retail and dining outlets.

It will be built and operated by US-based Pacifica Ventures in partnership with Media Content Capital (MCC). Pacifica Ventures has previously designed, developed and built large-scale film studios including the Albuquerque Studios in New Mexico and the Sun Center Studios outside Philadelphia, Pennsylvania, and has consulted on studio projects around the world.

Media Content Capital (MCC) is a private equity investment fund focussed on investments into media, internet and entertainment companies.

“The complex will be an exciting new visitor destination that will create thousands of quality jobs and educational opportunities in a huge range of disciplines.”

UPDATE:

Since writing the original story, some disturbing but important developments have been uncovered. Julian Bray for the PBROTRIB, armed with a clutch of letters sent out by the Partnership, knocked on the closed and locked door of the Stanground Dental Clinic on Wednesday afternoon.

We have agreed to protect the identity of the person who reluctantly agreed to talk to us, as clearly the individual afraid of repercussions and was visually shaking during our interview. The stark fact is The My Dentist Stanground clinic cannot find dentists willing to work in Stanground. Simply few dentists want to work at Stanground, as the unnamed employee explained:

"The majority of the patients we see here are so rude to the staff, only a few are polite and reasonable. I feel very sorry for those patients, as they, through no fault of their own are left without a professional NHS dental service.

"We have covered the glass door panel with paper, as we have had a few people banging on the door and shouting. They are clearly very angry, and for this reason we cannot get dentists to work here on a regular basis.

"I don't know why these people are angry but that is the situation. It will quickly get much worse, as several new very high density housing developments in South Stanground and Park Farm are opening, but these new residents, sadly won't find NHS dentists willing to work in this area.

"I'm not certain if we will remain here, or if I will continue to have a job in a few weeks. So if you know any dentists willing to work in Stanground, then please ask them to get in touch and quickly.

"We didn't send out the letters, it was the partnership in Manchester who own this and several other dental clinics in Peterborough. They simply cannot get dentists to work here and for that reason we cannot honour the appointments made.

"I cannot comment on the continuing fees paid to the partnership by the NHS on behalf of NHS patients registered at this clinic, but clearly as the letter suggests, patients are being steered towards registering at our other clinics, or face being put on a waiting list for an appointment at some distant future date, I am dreadfully sorry but as you can see there is nothing I can do. The community has to deal with this cultural issue, clearly this has not been a happy place for dentists and staff alike. All very sad as a great deal of investment was made by the owners when they took on this clinic."

Our original story:

Before you cast your vote for the local authority elections in May and return the existing moribund coterie of Stanground conservative councillors 'jobs and allowances for life' brigade, you might like to seriously look more carefully at the Conservatives somewhat shabby self-serving record for South Stanground, Cardea, Park Farm and Fletton.

New high density housing estates springing up and the long established NHS Dental patients at the Stanground Dental Clinic, Peterborough Road, Stanground, having their appointments repeatedly cancelled, some patients being shown the door and told register elsewhere; helpfully included in the cancellation letter is a list of practices 'of those who are taking on patients'

The letter just states 'due to the current circumstances,' but fails to expand on this. However the NHS revenues continue to be banked by the Manchester partnership we can assume?

The noise from the existing South Stanground councillors has been deafening! Not a whimper, although one of the bunch a former loft installer ( but for some reason, this is missing from his official CV) and electrician is amazingly the current chair of planning!

Consider the sorry state of this Stanground Dental Clinic, now owned by the Manchester based partnership of two partners namely Stephen Williams and Clifford Davies trading as 1A Group Dental Practice Partnership, they also control dental practices in St Ives- two in fact, Huntingdon, Millfield, Peterborough, two in Lincoln Road, JK Dental in Werrington (children only)

They are currently sending out 1,000's of undated letters REF:CO1A and a second version Ref: CO3A telling long established dental patients that their mainly NHS dental appointments are again deferred or cancelled.

Regular readers of this blog will cast their minds back to a time (November 2011) a few years ago when we fought tooth and nail to keep the dental clinic as the next door co-op funeral parlour, and the Stanground Surgery both had eyes on the building and car park to facilitate their expansion plans. It was a long, loud and sometimes bloody fight, we suddenly had conservative councillors actually stung in to doing something. Clearly it didn't last that long and the Stanground Dentist was sold on.

Bear in mind that although dental appointments are being cancelled the Manchester based partnership still reaps considerable revenues from your NHS. Clearly if they can offload their NHS patients, then more private dental work can be taken on with the enhanced profits being remitted back to the Manchester based partnership. Cushty!

RMT secures renewed mandates for action in ballots on Greater Anglia and South Western Railway enforced by the Conservatives anti-union laws.

RAIL UNION RMT has confirmed today that it has secured overwhelming votes to continue with action in the rail safety disputes on Greater Anglia and South Western Railway after being forced to renew the mandates with both employers under the terms of the new wave of Tory anti-union laws.

On Greater Anglia the strike vote was over 80% yes on a turn-out of over 80% and on South Western Railway the turn-out was 63% with a yes vote of 73%.

RMT General Secretary Mick Cash said: “RMT has been forced under the latest wave of Tory anti-union laws to re-ballot in the rail safety disputes on both Greater Anglia and South Western Railway under the six month rule and once again our members at both companies have stood united and solid and have renewed the mandate to carry on the fight to put public safety before private profit.

“Both Greater Anglia and South Western Railway have opted to play for time over the past six months rather than acting responsibly and getting round the table with the union to work out a solution to these separate disputes that puts safety and the guard guarantee centre stage. That is the package we have successfully negotiated in both Wales and Scotland and it defies belief that we are being denied the same positive outcome on these English franchises.

“Now that the staff have spoken the ball is in the court of both Greater Anglia and South Western Railway and we expect a swift and positive response to the union’s call for genuine and meaningful talks to commence immediately.”

FALSE TELEPHONE PREFERENCE SERVICE CALLS COULD EMPTY YOUR BANK ACCOUNT...

NFIB Alert - False Telephone Preference Service Calls

False claims of Telephone Preference Service:

Fraudsters are cold-calling victims, falsely stating that they are calling from one of the well-known UK telecommunication service providers.

They call victims claiming to provide a ‘Telephone Preference Service’ - an enhanced call-barring service, which includes barring international call centres.

The fraudsters ask victims to confirm/provide their bank account details, informing them that there is a one-off charge for the service.

Victims instead see monthly debits deducted from their accounts, which they have not authorised.

The fraudsters often target elderly victims.

In all instances, direct debits are set up without following proper procedure.

The victim is not sent written confirmation of the direct debit instruction, which is supposed to be sent within three days.

On occasions when victims attempted to call back, the telephone number provided by the fraudster was either unable to be reached or the victim’s direct debit cancellation request was refused.

During 2017, there were 493 Action Fraud Reports relating to this fraud.

Protect yourself:

There is only one Telephone Preference Service (TPS). The TPS is the only official UK 'do-not-call' register for opting out of live telesales calls. It is FREE to sign-up to the register.
TPS never charge for registration. You can register for this service at http://www.tpsonline.org.uk.
You will receive postal confirmation of genuine direct debits. If you notice unauthorised payments leaving your account, you should contact your bank promptly.
Always be wary of providing personal information, or confirming that personal information the caller already claims to hold is correct.
Always be certain that you know who you talking to. If in doubt hang up immediately.

Cambridge professors call on Vice Chancellor to follow Oxford’s about-turn in pensions row

A call by 100 senior academics at Cambridge on the University’s Vice-Chancellor, Steven Toope, to reverse the institution’s position in the pensions strike - which has hit over 60 campuses across the country - will be made public today.

Professors from both the sciences and humanities will join forces to demand that Cambridge follows Oxford’s lead and breaks with the hard-line position of Universities UK in the dispute.

The academics will gather with striking colleagues and students outside Great St Mary’s Church in Cambridge, opposite the University’s Senate House at 12.30 today (Wednsday March 7).

The collective letter calls on Toope to back the call made this week by the President and Provost of Imperial College for an independent expert review of UUK’s analysis of USS’s position and to commit Cambridge to supporting the retention of a Defined Benefit element in the USS pension scheme, reversing the position taken by the University in September 2017.

Professor John Arnold, one of the co-organisers of the letter said:

“I’m delighted by the news this morning that Oxford’s Vice-Chancellor has called for a reversal of her institution’s position regarding the pension. As her letter to her staff makes clear, this change was recognition of the strength of feeling voiced by colleagues in Oxford. A number of professors and others have collectively been calling privately upon our Vice Chancellor to do the same. Today we make that call very public, and have every hope that he will recognise the similar strength of feeling – and substantive critique of UUK’s position - here in Cambridge.”

“The threat to the pension scheme is hugely important not only for those working now in academia, but for the future of higher education in this country. Cambridge, like Oxford, has a role to play nationally in this debate, and a large number of professorial staff feel very strongly that UUK is not representing the sector or its interests. Today a number of us speak out, from the humanities and sciences.”

Dr Anne Alexander, Cambridge University UCU industrial action committee added:

“Steven Toope has to recognise that the tide is turning against the University’s disastrous support for UUK’s plans to cut staff pensions. Our union branch membership has doubled since January, we have had hundreds of staff out picketing daily and hundreds of students joining us at rallies and marches. We welcome this call by senior academics and urge others to follow their lead in demanding a reversal of a divisive and destructive policy.”

150 small-scale DAB multiplexes radio services given extended trial period until 31st March 2020.

The way we were ...

Ofcom has written to 10 small-scale DAB triallists to propose further extending their Ofcom granted trial licences until 31 March 2020.

By extending the trial period, around 150 radio services will continue to be available to listeners in the test areas. (Peterborough is not included although invited to participate) The trial extension will also allow Ofcom to continue gathering useful information to help inform a new, formal framework for licensing small-scale DAB multiplexes across the UK, which is currently in development.

Ofcom expects that interested parties, including the current trial licensees as well as those not taking part, will have the opportunity to apply for such licences under the new framework in 2019.

Just so we all understand what is going on inside the Town Hall, we were amused to see the job specification for a mid level manager (salary 30k) in a new role that does not in our view exactly help the good citizens of this fine City, but adds yet another layer of needless jobsworth activity to the PCC 'back office.'

The job specification clearly written by a computer system somewhere a million miles away from the City of Peterborough and its unique and diverse population.

We've reproduced it below together with a few helpful suggestions to aid any intending candidate. Here goes:

The City Services and Communications team have an exciting opportunity for an Internal
Communications & Employee Engagement Manager. This role will help support organisational
and cultural change and includes taking a lead role in a project which will see the council move
to its new offices this summer.

Main duties

? Develop, implement and manage delivery of the employee engagement strategy, ensuring that employees feel informed, involved and able to shape the future of the council, and aligning with the council’s vision, priorities and objectives, and any related
strategies.

Do not tell anyone what a right old Horlicks the whole move to so called Fletton Quays is turning out to be and don't let on how much it is all really costing.

? Champion employee engagement and communications, promoting its value and
benefits, ensuring that best practices are both known and followed.

Keep staff noticeboard up to date

? Contribute to the ongoing development and enhancement of our internal
communications channels using feedback and exploring new innovation tools (including
digital, video, social media technologies and free online design tools).

Waste as much time as you like on these as very few will click onn their tablets to see them but it'll look good on your CV for your next job.

? Advise senior management, line managers and make strategic recommendations on
employee engagement/internal communications to help build leadership expertise and
VNF Nov2015 positive organisation culture. Provide regular updates on internal communications
activity to managers.

Snitching is to be encouraged...if done discreetly

? Identify the training that will enable managers to engage effectively with employees by specifying the skills and behaviours required, devising ways for managers to assess their training needs, producing training specifications and plans, commissioning and
managing providers, managing and delivering training where required. Work with L&D to implement this.

Group away days, in top hotels .. and lots of courses on diverse but worthy subjects

? Gather insight and evaluate all activity to ensure impactful communications that support behaviour change and continuous improvement, including benchmarking, employee feedback surveys and focus groups; publish reports on its impact, benefits and

Not enough car park spaces so better learn to ride a push-bike.

? Manage the internal communications business support and direct project groups, such as the staff panel.

A kinda moan of the week, pat on the back, endless minutes taken that no one will have time to read.

? Seek opportunities to become more commercially focused and support the team and organisation in achievement of this.

Work out who is going to pay an enhanced commercial rent for the surplus office space the council has committed to.

? Support the wider Communications teams by offering, as required, internal communications and staff engagement advice.

Tell them how to communicate by not using email and how to use a telephone, rather than snapchat.Key Skills

'No DSS' and discrimination

The BBC ran a new report today on a case in Birmingham. The headline - "Landlords who say 'no DSS' breaking equality laws" - was, as we shall see, somewhat misleading, but the report did indeed cover a discrimination claim against a letting agency who had refused to consider a woman and single mother as an applicant for tenancies in the Kings Heath area of Birmingham because part of the prospective rent would be paid by housing benefit.

Ms Keogh brought a claim against the agents, Nicholas George, claiming indirect sex discrimination, on the basis that women were more likely to work part time and have recourse to housing benefit, such that a blanket ban on 'DSS' (aka housing benefit/LHA claimants) affected women disproportionately.

We have wondered here, on and off and across comments, about the possibility of discrimination claims on such a 'no DSS' policy, particularly in regard to disability discrimination. If anything, the recent Supreme Court judgment on indirect discrimination by a provision, criterion or practice (PCP) in Essop and others (Appellants) v Home Office (UK Border Agency) (Respondent) Naeem (Appellant) v Secretary of State for Justice (Respondent) (2017) UKSC 27 might have made such a claim more straightforward to bring.

However, despite the first version of the BBC article asserting that 'the principle has been settled' (the article has since been changed), this claim was settled before judgment, with the letting agents paying £2,000 compensation.

So while an interesting development, this is not a precedent.

While claims of indirect discrimination in such a blanket ban may be well founded and are clearly arguable, there remains the possibility of a defence under s.19(2)(d) Equality Act 2010, that the practice is "a proportionate means of achieving a legitimate aim". Unless or until that defence is tested in court, the issue will remain unclear.

That said, this is a clear demonstration that something that a number of people have been discussing as a hypothetical possibility for some time is indeed a viable potential claim. And it is a reminder (if one were needed after Fergus Wilson met the EHRC) to landlords and agents that any simple 'blanket letting policy' actually needs to be considered very carefully.

(It is also worth mentioning that the Bar Pro Bono Unit arranged for some pro bono advice and representation by Robert Brown of Arden Chambers. These things are important.)

Incidentally, isn't it interesting how 'no DSS' has lingered on. I think it says something about the average age of landlords (the DSS ceased to exist in 2001), but it also suggests something about resistance to change...

CASH STRAPPED PETERBOROUGH CITY COUNCIL PUNTS ANOTHER £2.5MILLION INTO FLETTON QUAYS AS THE POSH SACK MANAGER GRANT MCCANN

Oh dear, we hear that Fletton Quays next-door neighbour, has just announced the departure of Peterborough United Manager Grant McCann. Genuinely sorry to see him go, perhaps Barry Fry should roll up his trouser legs and get his knees dirty? But equally all is not well on the Fletton Quays front either...

For a Conservative controlled Council that's claiming its strapped for cash and in the process of increasing residential housing council tax to near its permitted maximum, its Leader publicly holding out the begging bowl to engage with a seemingly disinterested Westminster parliamentary party, on top of that a May local authority election looming...

You'd think some eyebrows may be raised as the misnamed Fletton Quays development has now swallowed a further £2.6 million of public funds (err debt..) that is on top of the £15 million of public funds (err debt..) already advanced...to build an on-spec Hotel!

The original concept which spurred the release of the first tranche of £15million council debt (sorry investment) was the daft notion that an East German GDR style residential accommodation block and offices plus an east facing (*sunless) beach strip was the ideal destination for intrepid holidaymakers.... And if you are looking for the social/affordable housing part of this development, we've been told by someone close to planning (but yet to positively confirm it|) that you'll not find it at Fletton Quays but have to take bus ride to Dogsthorpe Quays... [if you have information on this let us know...]

The word is the Council is also buying new ICT equipment, anyone in the ICT game will tell you lease the kit, as it soon goes out of date, leasing/renting is clearly an option; it can be handed back at the end of the lease. Just look at the City Mayors newish top of the range Jag!

Still no real guarantee of any profit on the adventure so far, but sadly few seem to realise mountains of extra debt being stored up for the next generation.

The original idea was to save money by moving staff and officers out of the Town Hall and Bayard Place and effectively hot desk so there would be fewer desks than staff in the new building.

Now we hear the Council is keen to be a commercial property landlord and set to rent out part of its new building! Madness...

This is despite the fact that Peterborough centre is stuffed full of modern empty office blocks, some now being converted into short stay temporary dwellings for the homeless.

Centrally located offices now effectively lost to the commercial marketplace which could have been marketed to new businesses, seeking to set up in a revamped Peterborough City centre.

Clearly if the need for the extra £2.5million 'bung' was noted at the outset, then Fletton Quays might not have been started by this particular developer but offered to a more established group with deeper pockets, or at least able to fund the entire project, without its own corporate begging bowl being rattled before the council.

The council does seem to have rushed this one through, and is now only realising that effectively the residential concept seems to be facing the wrong way.

Sunshine* only enters into the tightly packed apartments when the property is south facing. To achieve that the residential block needs to face the railway! It clearly does not...

Its also noted that the 'photoshopped' glossy brochure has effectively removed the 'Grain Barge' Chinese floating restaurant from the airbrushed vista... and we also hear on the grapevine that the site for UK largest outdoor beer festival is in danger as the Embankment is being coveted as a campus for the so called Peterborough University.

Still all is not lost, the Peterborough Beer Festival could always be moved onto the car park site near town bridge or under cover into the some of the soon to be vacated retail warehouses.. Toys'R'Us for example, is near the top of the list.. Then there is always the East of England Showground to consider?

As reported by the Peterborough City Council:

Recommend that Council approves additional capital investment of £2,636,025 (including a contingency of £500,000), to ensure council office buildings, including Sand Martin House, are able to meet the new and emerging needs of the council and provide opportunities for other organisations to lease parts of the office building to provide the council with additional income streams. It also facilitates the conversion and refurbishments of Bayard Place reception to provide an improved customer experience.

Reasons for the decision:

The Council had agreed to consolidate back office functions to Fletton Quays. Agreeing the additional capital investment would facilitate a landmark regeneration site, provided the Council with much-need flexibility in its office portfolio, aligned to its current programmes for flexible working, and was financially beneficial over the long-term.

Have the residents of 'CARDEA' noticed that the carved concrete and brick plinth sign proclaiming CARDEA has suddenly vanished and that now they are just plain old South Stanground? Councillors will say CARDEA was just the developers name in order to offload the housing units in all too narrow streets, still awaiting adoption sometime in the distant future, by the local authority.

Well you may consider the current Conservative coterie of local councillors in your South Stanground Ward on Peterborough City council - no Labour councillors seem to represent South Stanground at the moment but this could change after May - have made a right old mess of things, and seemingly spent all the cash, slashed services, but could you do any better?

You don't need to be sponsored by any political party or find a cash deposit. There is NO deposit to lose! Just have a stout pair of shoes, a programme of ideas in mind, a few thousand leaflets (Vistaprint are dead cheap!) and be prepared to tackle a lot of doorsteps and in the process bang on a few door knockers and talk to your voters... It really is open to all.

Certainly, the main political parties will be putting up candidates, or as we know them 'the usual suspects' and some existing councillors will 'promise the earth' to hang onto their seats, and secure your vote. You may not then hear from them for a few years but amazingly as it gets close to the elections, they suddenly get very busy, potholes get mended and verges/ hedges cut and even call up local radio stations and appear on regional television.... expect the pre-election comics to come cascading through your letter box anytime soon...

But that is it, it is YOUR vote. Please guard it well and use it wisely. Don't let anyone however well meaning fill in your postal vote form for you! Peterborough has experienced a number of election fraudsters in the past .

Question both candidates and councillors on their track records, sadly some have just trousered the (very generous) , substantial cash allowances and left it to others to do the work. Others have worked exceptionally hard, and its not too difficult to figure it out.

This is your chance to unseat them or join them.... Best of Luck, and as usual the PBROTRIB is right with you, but back to business...

Prospective Local Authority election candidates looking to stand in this year's local and parish elections are invited to attend a briefing session in the Council Chamber at the Peterborough Town Hall on Monday 12 March 2018 at 6.30pm.

Peterborough City Council's Chief Executive Gillian Beasley, who is also the council's Returning Officer, will be holding a briefing session for all prospective candidates and their agents to discuss election processes.

An overview will also be given on the nomination process and election timetable, postal voting procedures, the counting process and electoral integrity issues.

PETERBOROUGH BOGUS POLICE OFFICER (IPO) BEING HUNTED IN BANK CARD CASH SCAM

Police Officers investigating a series of fraud incidents have released images of a car they believe to be involved. In the past few weeks there have been three incidents in Peterborough of bogus police officers asking people for money.

The suspect who collected the money

is described as Asian, around 6’ to 6’6”,

with brown hair.

In one incident, a man pretending to be a police officer called the victim and told them they were investigating criminal activity on the victim’s bank card, which was linked to an inside job at NatWest Bank. The victim was asked to withdraw £5,000 and hand it over to a police officer, who would collect it from him with a code word.

The victim asked to see identification from the police officer, but was told it was an undercover operation and the officer would not be able to identify himself.

The victim felt this was suspicious so refused to hand over the money, but he was told he would be ‘arrested under section 84 for refusing to cooperate with a police enquiry.’

The bogus officer arrived in a hatchback car, believed to be on fake plates, and the victim handed over the £5,000 in cash.

Detective Constable Louise Mann said: “Your bank and the police will never ask you to withdraw cash, reveal your PIN number or passwords or purchase high value goods that they will then collect from your home.

“If you believe you have been a victim of fraud you should contact Action Fraud any time of the day or night using their online fraud reporting app. or by calling 0300 123 2040.”

Peterborough Burglary Update and beware of Courier Fraud

21 February Aster Drive, Werrington CF0100300218
Offenders smashed a rear window and stole electrical items and jewellery. At 2.30pm neighbours saw two males near the property aged in their 20s, dressed in grey and black.

A small black car was also seen in the area around the same time, possibly a Vauxhall Vectra.

20-21 February, Station Rd, Thorney: CF0099980218

A rear door was forced at this property and a quantity of large electrical items taken.

A blue hatchback vehicle, possibly a Peugeot was seen at around 2.30-3.00pm nearby.

20 February Cromwell Rd, Millfield: CF 0098360218

Householder heard a noise at the address around 7.30pm then looked out of the window.

A person was seen in the garden, it was later discovered that a Gents Carrera cycle had been stolen from the unlocked conservatory.

17-18 February, Little Close, Eye: CF0093240218

Attempt burglary. A noise was heard at around 11.40pm but the householder did not discover the damage to a door frame until the next morning. No entry was gained and nothing was stolen.

17 February, Skye Close, Orton Northgate CF0092930218

Rear door smashed, motorcycle keys taken along with alcohol. Garage was also entered. Occurred between 1.45 and 11.15pm, believed part of a mini-series on the same night in the area.

17 February, Kelburn Rd, Orton Northgate CF0092680218

Offenders entered through a rear garden and smashed rear window to gain entry. Car keys to one of the family vehicles taken, the vehicle was driven away, later found nearby.

It is thought that offenders may have been interested in the homeowners more expensive vehicle.

At around 8.35pm that some 5 people were seen in the area, 3 on bikes, 2 on foot, travelling towards Dunblane Avenue. We do not know if these people are related to the crime.

At 8.20pm homeowner heard a loud noise and went to investigate. He saw 3 males run from the property and found a rear window smashed.

No entry was gained but it is possible these males were looking to steal and expensive car that was on the driveway at the time.

12 February, Broadway CF0083200218

Offenders forced a ground floor window causing damage but appear to have fled when house alarm sounded. Alarm was activated at around 3.30pm.

12 February, Prince's St CF0082910218

Householder returned home at 3.15pm and disturbed a male attempting to gain entry into the property. The male left the scene on a cycle, he is described as white and wearing a black tracksuit. Nothing was stolen.

10th-12th February, Constantine Drive, Stanground CF0081700218

A new home still under construction had all of the white goods removed. Due to the size of these goods it is likely that there would been at least two people and a vehicle involved.

Courier Fraud cases in the City

We have had 4 cases of 'Courier' Fraud reported to us since 17th January and would urge all readers to warn their elderly friends, family and neighbours of these offences.

What is it? When you are called by someone claiming to be from your bank or the Police and they advise you that your bank card has been used elsewhere in the country and that someone has been arrested.

They then arrange for a courier to pick up your card to take it away for evidence etc. In reality, the card is collected by the fraudsters to withdraw money from your
account.

In the recent cases a male advised he was DC Harry Pritchard from Holborn Police in London and this person advised, in all cases, that the persons bank card had been cloned and that they believed that a bank employee was responsible.

There are many variations of this fraud -

you are contacted and told there is a corrupt member of staff within your bank and the Police need your help to identify them
you may be asked to withdraw a large sum of money with the purpose of the money being marked by the Police or the bank and then used to identify the corrupt person. On handing the cash over, it is taken by the fraudsters.
you are informed your bank account has been taken over and you need to transfer all the funds in to a 'safe account' set up by the caller. This account is operated by the fraudsters who then steal the funds.

Protect yourself. Your bank or the Police will NEVER send a courier to your home.
Your bank and the Police will NEVER collect your bank card or ask for your PIN.

If you receive one of these calls END IT IMMEDIATELY.

Report this to POLICE immediately via 101. If you think you have been a victim of this

fraud and have handed over any details to the fraudster, call your bank and cancel your cards immediately and call us.

Courier fraud is becoming more prevalent and sophisticated and it is normally the elderly that are targeted. Please raise awareness of this type of fraud.
