Driving With a Suspended License

When you are convicted of driving under the influence or driving while intoxicated (DUI/DWI), one of the many penalties that a state may issue is a license suspension. Typically, for your first DUI conviction, you will have your license suspended for no longer than six months. For subsequent convictions, you may be stripped of your driver's license for a year or more.

Most people rely on an automobile as their primary means of transportation. A suspended license can limit a person's mobility and make it difficult to commute to work or visit family and friends. While this may seem like an unreasonable hardship, it is better to make other driving arrangements, such as taking the bus or carpooling, than to risk being pulled over without a valid license. If you are caught driving with a suspended license from a DUI/DWI, you risk being penalized even further.

Suspended License Violation Penalties

Each state has its own penalties for drivers who are caught without a valid license, but most states will extend the period of the suspension and slap the offender with a hefty fine. Under Rhode Island law, penalties for driving on a suspended license are as follows:

First offense: 3 months additional suspension + $500 fine + at least 10 days in jail
Second offense: 6 months additional suspension + $500 fine + 6 months to 1 year in jail
Third offense: Felony charge + 1 year additional suspension + $1000 fine + at least 1 year in jail

Coping with Your License Suspension

Clearly, suspended license violations are taken seriously and can add months to your original penalty, not to mention the additional hefty fines. It is best to not risk being caught without a valid license. If you have been convicted of a DUI and penalized with a license suspension, consider using one of the many other modes of transportation available to you. If you are traveling within a couple of miles, try walking or biking to your destination, or look up a convenient bus route. You may find that you are able to save hundreds and even thousands of dollars that otherwise would be spent on gas.

First Time Driving: Ashley

Any way you look at it, we have another Ashley today. Today we have hysterical laughing, loud voices, and a general feeling of a long progress ahead.

Pass With No Presence

Apparently, some people can't pass their driving test themselves. They sent someone else to do that, Gagan Singh. Singh, an illegal overstayer in Britain, is accused for impersonating over 150 written and practical driving tests.

Singh, as it seems, was paid good money for these tests. With about £400 per test and even more for the harder tests, he was able to collect £9000 in one month. Not bad at all.

Unfortunately for all people who used his services, their licenses are now revoked. They will now have to take the test themselves.

Today I want to talk about something that really irritates me and teach you a valuable rule along the way. This is one of the most important driving rules of all time.

The two car rule says this: if one car passes you from the right, you may be driving too slowly. If two cars pass you from the right, change lanes, you're delaying traffic. Simple and elegant rule.

Too many people don't know about this rule, and this causes them to drive slowly on the left lane, which is the fast lane. With some more traffic IQ the would have realized that choosing the right lane is not a shame, it's the right thing to do.

A Warrant for Your Blood

Last week, the St. Clair County in Illinois went a bit far in their war against drunk drivers. From November 25 to November 29, judges could issue warrants for your blood or breath test.

The idea is good: if someone refuses to take a breath test, a judge can force you to do so. The state's attorney can obtain such a warrant and force a suspect to give blood.

As nice as this sounds, to me it goes a little too much into people's privacy. I know it's about protecting the public, but the public should also be safe from needle warrants and intrusive tests without permission.

How strong is your car? How did you test it? I have the perfect test for that: drive a car full of passengers.

Earlier this week I went out with friends, and the car was full. The car's behavior was changed immediately. Suddenly I had to press harder on the gas, take turns slower (remember the centrifugal force?), and generally adapt to a totally new driving style.

Usually I drive alone or with one more passenger, so the car accelerates easily and quickly. When it's full, it takes more time.

Ontario Keeps on Striking

Remember the Ontario driving examiner's strike? It has been going on for three months now, and it's still going on. However, Serco, the company that handles driving tests in Ontario, said they are giving driving tests to special groups.

What are those groups? People who need the license for a living (commercial vehicle drivers) and people with out-of-province licenses. Everyone else will have to keep waiting.

Last week the union which includes driving examiners said "no" to an offer from Serco. Looks like the Ontario people will have to wait for a long time.

What Happens to Your Driver's License If You're Arrested For DUI in California

Initial Procedures. If you are arrested for DUI (or drunk driving) in California, you should have been given a choice of a chemical test of your breath or blood. If you take a breath test and the results are .08% blood-alcohol or higher, your driver's license will be taken by the officer and you will be given a Notice of Suspension. This pink document operates both to formally advise you of the immediate suspension and as a temporary permit to drive (unrestricted) for thirty days. If you give a blood rather than breath sample in a California DUI case, the results will probably not be available for a few days; the suspension begins but will be conditional upon later results being over .08%. If you should refuse to take a chemical test, your license will still be confiscated but the period of suspension will be substantially longer.

Out-of-State Drivers. If you are an out-of-state driver, the police in California cannot confiscate your license, as it is the property of another state government. You will receive the same Notice of Suspension, but this serves only to suspend your driving privilege within the state of California; your license remains valid outside of the state. You should be aware, however, that your state's motor vehicle department will probably suspend your license upon being notified by the California DMV of the DUI license suspension.

Administrative Penalties. A first drunk driving offense carries a suspension of 4 months. You should be aware, however, that this can be reduced to 1 month followed by work-restriction of 5 months if you file proof of insurance (the SR-22 form) and proof of enrollment in a state-approved DUI school. If you refused to take a chemical test, the suspension is for 1 year - and no work restriction is permitted. If this is a second offense within 10 years, the suspension is for one year, two if for a refusal - and again, no work restriction will be granted.

Challenging the Suspension. You have a right to contest the suspension (called an Administrative License Suspension, or ALS). This is completely separate and apart from the criminal proceedings. It is strongly recommended that an ALS hearing be requested: There is a good chance of having the suspension thrown out. In any event, the worst thing that can happen is that you will receive the same suspension as if you had not requested a hearing
