Discharge of the Homeless: Is It Patient Dumping? Critical Compliance and Regulatory Issues

Because many homeless people often lack a safe place to live and the resources to take care of themselves, they often come to hospitals again and again for the same or similar medical treatment. When a hospital doesn’t properly plan a homeless patient’s discharge and post-admission placement, and cannot help that person to avoid being re-admitted needlessly in the future, then the hospital can face accusations of so-called “patient dumping.”

In this podcast, Henry Fader, partner and head of Pepper Hamilton’s Health Care Practice Group, discusses this issue and asserts that hospitals need to be aware that the care and treatment of medically or mentally ill homeless people requires not only careful attention to their medical needs, but to their discharge needs as well.

What Every CFO Needs to Know About the Changes to the HSR Act Premerger Notification and Report Form

Recently Pepper Hamilton hosted a breakfast breakout session in conjunction with the CFO Alliance. The topic of the breakfast was “What Every CFO Needs to Know About the Changes to the HSR Act Premerger Notification and Report Form.”

In late 2010, the Federal Trade Commission (FTC) issued a Notice of Proposed Rulemaking regarding a number of long-anticipated changes to the HSR Act Premerger Notification and Report Form.

Some of these changes will require companies to provide new or additional information and documents that could prove to be burdensome and expensive. The new rules will also require companies to be more cautious when drafting internal documents, even those unrelated to transactions, as these documents will now be captured by some of the new HSR requirements. The final rules will likely take effect in Q3 or Q4 of 2011.

In this session Barbara Sicalides, a Pepper partner and incoming Chair of the American Bar Association, Business Law Section's Antitrust Committee, discussed this fast-changing environment and the important steps companies should take to prepare for the new requirements, minimize risks and maximize opportunities for efficiently navigating the premerger review process.

Basel III's Liquidity Coverage Ratio ("LCR") was created to promote short term liquidity resilience for banks over a hypothetical 30 day severe stress scenario. The following podcast with Pepper attorneys Tim McTaggart and Ahmad Hajj focuses on the current Basel III LCR proposal, provides an analysis of the Basel III regulatory weightings for certain products that are anticipated to leave a bank in the LCR's severe stress scenario as well as the specifics of what types of assets qualify as sufficient liquid assets to cover for the flight of such products. In May of 2011, we recorded a podcast with Pepper attorney John Brenner, a partner in the Health Effects Litigation Practice Group, to discuss a possible U.S. Supreme Court ruling in Mensing v. Pliva, which could pave the way for pharmaceutical companies to be liable to people who haven’t taken drugs that the pharmaceutical companies have effectively withdrawn from the market. Recently, the U.S. Supreme Court ruled on Mensing v. Pliva, and we've recorded a new podcast with John to discuss the ruling.
