1. I contacted Catrina on January 24, 2024, for service at 1201 Marinaside Crescent, Vancouver (suite 3303) on a RUSH BASIS.(see screenshot of email below)

2. Catrina quoted $90 and said it included (an affidavit of service and up to three attempts). (see screenshot of email below)

3. There was no mention of an Affidavit of Non-Attempt fee in that email chain for the request. (see screenshot of email below)

4. I acknowledge that there is a RUSH SERVICE fee, which Catrina said was $30 in the previous email (see screenshot of email below)

5. Catrina provided notes saying their server attended the address on January 24, 2024, January 26th (Friday) and January 27th (Saturday).

6. On January 30, 2024, I asked for an affidavit of non-service to send to my client as per her instructions, as she was already anxious – It was TIME SENSITIVE.

7. Catrina said she was going to provide the affidavit within two days from the time I requested it. In other words, I should have received the affidavit on Thursday, February 1, 2024. Ideally, I should have received the affidavit on January 27th (the last attempt Catrina made to serve) as per RUSH SERVICE.

8. I received the affidavit from Catrina on February 7, 2024 (after eight calendar days)

9. I never received a complete RUSH SERVICE (which technically includes attempts and affidavits), yet I am being charged $50 for a rush fee, $20 more than the actual rush fee Catrina quoted and what I had paid for as rush fee for invoice # 48366. (see screenshot of email below)

In lieu of the above, I can only pay:

– $90 for service (which includes an affidavit of service and up to three attempts) as per Catrina’s email – (see screenshot of email attached)

– $30 for rush (this is what I acknowledged) as per the previous invoices Catrina sent – even though I didn’t completely get a rush service (the affidavit was sent eight days after.)

– $54.75 for printing

– 2.50 for postage

– $11.62 for GST

I do not acknowledge and I find the following charges unjustifiable

– $20 additional rush fees – I wasn’t informed.

– $35 affidavit of attempted service – I wasn’t informed that there would be a separate fee for non-attempt (there was no mention of it). ALSO, Catrina said in her email that $90 includes the affidavit (see screenshot of email attached.)

I just wished Catrina for Rapid Taggers was transparent (no hidden fees) in their rates to avoid confusion like this.

August 12, 2023: Zara requested service of a Petition for Divorce at 555 Rexdale Blvd, Mississauga, ON. See evidence in our email correspondence

Her email provided no instructions on on the following:

How to serve the document,
Who to serve,
The timeline for service,
Instructions regarding affidavits
Instructions regarding emailing and mailing affidavits.

She only stated: “I need the attached Petition to be served on someone living at 555 Rexdale Blvd, Mississauga, ON, with the attached document. Thanks. “See evidence in our email correspondence.

MOST LAWYER AND CLIENTS USUALLY PROVIDE INSTRUCTIONS AS TO HOW TO EFFECT SERVICE ON THE DEFENDANT OR RESPONDENT.

August 13, 2023: I replied, “I will send an invoice for the same.” She instructed us to hold off on serving the document until you received approval. See evidence in our email correspondence

August 15, 2023: She emailed, giving us the go-ahead to serve the document. See evidence in our email correspondence

August 18, 2023: We sent Zara an invoice for the service. Our policy requires upfront payment due to past issues with clients.

August 21, 2023: Zara emailed inquiring if the document had been served. I asked if the invoice was paid. Zara responded that they typically don’t pay before service and decided to go with another process server. I informed her that I would void the invoice. See evidence in our email correspondence

September 2023: Her office contacted us about the service. We explained that the invoice was voided. However, we were instructed to resend the invoice.

September 29, 2023: We sent the invoice.

October 4, 2023: We received a $180 payment from Daniel Chornopyski Law Corporation by Interac transfer. See evidence of payment

October 5, 2023: We attempted service but faced challenges due to insufficient instructions from Zara regarding how and where to find the respondent. The address we retrieved from the document she sent us is: 555 Rexdale Blvd Mississauga, ON M9W 5L21. This address led to the following entities:

Woodbine Racetrack
Grandstand Casino
Trackside Clubhouse

Huge corporations occupying over 87,000 sq. ft.

After canvassing the address looking for the respondent, we eventually left the document with the receptionist of Woodbine Racetrack who informed us that she was not personally acquainted with the respondent. She also tried to search for the respondent’s name in the system but couldn’t find his name. Nevertheless, she kindly offered to accept the envelope and pass it to the respondent if he works there.

October 10, 2023: I updated Zara on the service attempt. She stated this was not effective service, even though no specific instructions had been provided initially for the appropriate method of service: personal or alternative to personal service (you can verify this from our email correspondence.) < see attachment >

I emailed offering to reattempt service with a proper address or phone number. Zara responded by saying, “he works and lives there and sent me his phone number.”

We issued a second bill for $80 for another attempt but received no payment.

October 24, 2023: She emailed inquiring about the service. We asked about the second invoice payment, which she said was never received.

October 26, 2023: After three attempts and coordination with the respondent, we successfully served the document. The respondent initially refused it, but we effected service upon him personally outside one of the gates (there is a security camera there.)

I updated Zara, and she offered to draft the affidavit.

October 27, 2023: Zara sent a drafted affidavit, which I completed and commissioned the same day.

November 10, 2023: Zara requested updates, but I couldn’t respond due to illness.

November 30, 2023: Zara followed up again. I apologized for the delay and sent a scanned copy of the affidavit of service (see evidence). Same day, I mailed the original to Zara Kadhim, 250 McDermot Ave #412, Winnipeg, MB R3B 0S5.

December 17, 2023: Zara emailed inquiring about the mailed affidavit. We clarified the mailing address we sent it to and offered to recommission and resend it again by registered post to ensure safe delivery..

Zara emailed back saying and I quote, “you don’t need it to be sent by registered mail (that she just need it to arrive.)”

Subsequent emails we received on December 17, 2023, from Zara accused of the following:

Not completing the job
Falsely stating that your firm paid us on August 16, 2023
Ignoring your requests, and disrespected your firm
Alleging that we forgot about the request. Meaning you forgot that your Absence from office: December 8-11, 2023, December 1-11, 2023, August 29, 2023, to September 12, 2023 and cancelling the initial request on August 21 2023 may have contributed to the delay.

Apologies for the miscommunication.

First off, I have been very busy with work and school, and I bet you know how overwhelming it is to juggle both. So nothing unprofessional here. Even the most professionally ethical person has room for mistakes; hence, I give people the benefit of the doubt.

Secondly, to address the issue of refund or resolution.

The only solution here is to provide you with an affidavit of attempted service, which is the standard protocol for unsuccessful service of processes.

As you know, I actually did you a huge favour by lowering the fees. That is not my usual charge for effecting services for pickup documents and same-day service. More so, I used the amount you paid to pay the process server. If I had issued a refund for every unsuccessful service, I would not have had my business up and running – there wouldn’t have been a phone number to call for process serving – the company would have dipped. I believe you know this as well.

Attempts

Jit recounted to you what transpired at each attempt to serve. Everything that happened was beyond our control. How is it now “just” to issue a refund knowing fully well that we attempted service but were unsuccessful?

As Jit recounted for one of the files, you have to follow the instructions i.e., mail it to them.

For the other files, you can use the affidavit of attempted service document to file a motion to serve by substituted service.

This is a very different side of you to receive, Mo, as compared to who I first met in mind and in spirit on the phone that day.

How can you, so apt and intelligent a man as you are, consider your juggling of school and business, and whatever else you might have going on privately at any time, reasonable grounds or excuse for keeping business clientele of yours unnecessarily waiting who are not responsible for what you do privately in your life?

How you can you say there is nothing unprofessional about that?

Not that I care to press such an issue. You spoke with me on the phone that day; and I think I did well at conveying to you the quality of heart, mind and spirit which I possess.

If you were in my place, and I in yours, would you see me as showing you favour by providing you a reduced cost for not completely doing what you paid me for to do?

Where is the great deal in that?

How have you done me a huge favour? We came to terms on service of process. Nothing was ever mentioned of attempted service of process.

Did you provide me aforehand with any disclosure, verbal or otherwise, stating that, In the event of failure to provide affidavit of service, we will provide attempted affidavit of service, and not refund?

Again, who is responsible for your business being up and running?

Where do you source the mind from to determine your business being up and running of greater significance than your business actually serving to provide the people who do business with you with what they required done?

If your business does not serve to the end of satisfying the party with whom you do business, your business should fail, yea, and before the clientele is offended or defrauded.

Those sentiments expressed/shared by you there are more the congenials of fraud than the contractions of good business.

Why I should know this well is beyond me. I do fair business with everyone and anyone I engage with.

It is “just” to offer back part of the funds provided you, yea, along with the attempted affidavits of service, the affidavit of service for the one you mail out and the other four sets of documents which Jit is unable to serve.

For each attempt, $25 can fairly be kept rather than $50, and the other half can be fairly returned to the half served clientele. Love of money is the root of all evil.

I hope you find it within yourself to see the sense which I send to you, look at this situation from the other way around and offer me your help according to what is just fair and right, Mo.

From the very unset from when I spoke to you, I covered the affidavit of attempted service aspects – I usually do so whenever I talk to my clients about process serving – there is no way I wouldn’t have mentioned that to you.

Yes, I did you a favour; you asked if I could give you a rate cheaper than the rate of dial and file, to which I consented.

From the beginning, I felt strongly negative about taking on your file. What you are throwing at me now just confirmed my hunch.

Did I ever mention to you that the service will be on-serve no-charge basis? Who does that in the industry? Absolutely no one.

I will issue you a full refund if you insist on these conditions:

I will refund you with a sad heart and hope that God, in his infinite power, will grant me justice through retribution.
I will pay in 5 installments to mitigate my loss and sustain my business.

If you consent to these conditions, let me know in your reply mail, and I will send you the first part of the installment.

Mo, I rejoice to see that you are a man wise enough to fear the Word of the Lord more than anyone or thing in this world.

Mo, you, with your own mouth when we spoke, said you were willing to offer me the rate that you did for the reason of not wanting to miss out entirely on earning any funds for that day, because you were disposed with meetings and what not that day and had missed many work calls, and not because I asked if you could do the same work for a better rate than dial and file only.

Mo, if you felt “negative” as a result of interacting with me and coming to terms on business arrangements with respect to my Notice of Application, and, likely, as a result of minding unto who the respondent parties are which were transparently made known to you much ahead of the time of Jit and I meeting, nothing being hidden or withkept from you:

do you think it was because you saw a brother in Christ in need in me and because you saw that my cause was just that you endeavoured to move past that “negative” feeling you were made feeling to?

or do you think it was your desire to earn the funds from taking on the case that caused you to move past the warning in your heart as to the insinuated “evil” or otherwise “negative” intent which you may or may not be assuming that I had for some reason?

I can assure you, Mo, that there is no negative or wrongful intention to be revealed in me in the day of judgment to be found with regards to us seeking to work together.

In truth, I have no ill-will toward you and Jit, Mo; and I just wanted my works to make for conditions of peace with the Government of Canada and the Province of Ontario, which we are commanded to do as ministers of Christ Jesus, to be further along than they are now and to let you know that I would have appreciated being told sooner, like on last Friday, which was two days after I met Jit last week, of what the status was with regards to our efforts to work together along the way; which there is also nothing wrong with doing.

I felt a little disheartened because I had to reach out to you and, I felt as though I might not have heard from you or Jit for long time if I had not been the one to reach out like I did; and that made for me to be like What is going on here; to which you have let me know your sentiments, thoughts and feelings toward the same on your end, which we are now getting over or getting past.

All I want, Mo, is peace with you, and also what I required your help with in the first place to be completed as I am required of at the courts to have done.

I am homeless at present, just as the Lord has set forth as righteousness ( saying, Foxes have holes and birds have nests, but the Son of man has no where to lay his head,) and without due performance provided me by the government which occupies the land which I was born upon and much is relying upon this civil proceeding proceeding in a timely manner for me, that I might receive the relief which I am seeking. I make you privy to these aspects of my life that you might better understand me and who I am, and not to gain any special treatment from you, sympathy, pity or mercy that you would otherwise not mind to show.

But if you are not willing to further perform the work of skip tracing or doing whatever it is you are supposed to be the expert in with regards to helping in this situation;

and if you are not willing to humbly do the one mailing to the Lieutenant Governor General, providing the full affidavit of service for that, and providing the other four as attempted service of process affidavits, keeping $150 of the $250 paid you and returning $100 to me (which in no way to me seems unfair or unreasonable;)

and if for whatever reason it might satisfy you only to make me out to be some negative wrong-doer who has only ill intentions for you and your business aspirations and you would rather be restored to as you were before calling me back that day,

then I will accept the full refund and parting of ways with you as you would have us part ways; but I would prefer a clean one-time meeting between me and you to do so, you giving me 250 dollars cash as I gave Jit that morning 250 dollars cash, no parts of it in installments, and we parting ways in peace.

And I will leave you for your business’ sake a five star review for honourability and withal pray our Father for your success and blessing.

But every hour that goes by is the prolonging of my vexation, oppression and suffering in this land before the Lord; and I pray you take heed to that in your considerations of me and of what our business and, or spiritual relations will be carrying on.

I appreciate your word of compassion unto me and kindness.

When will you have $250 cash and the documents I gave Jit to serve ready for me to pick up from the address you have provided me?

I do not have an address and I have not had a bank account for over seven years now; and I have no one else to use their address or bank account by to receive what you would make to be the only terms for our mutual restorations.

Which is why I have honourably conducted myself with you and Jit as I have, performing my part in full unto you and not by installments when asked of me for my part.

And I cannot accept your demand therefore, which is not fair to be set as some almighty governing force between us for what is right to be done, as if what works for you only, and not that which is fair and which works for me as well, is the only way for restoring things between us to be as they were before we met to be done.

The client emailed us on February 27, 2023, asking to serve an inmate at Toronto South Detention Centre. We replied with a quote of $150 + HST.

On February 28, 2023, she emailed us back with the documents to be served. In the same email, she said she would confirm if the defendant had been released from detention so we could serve him at home – see screenshot of our email correspondence below. On February 28, 2023, an invoice was sent to her for the same on – see screenshot below.

On March 2,2023 she sent an email to us saying: the defendant as been released from detention and that we may proceed to serve him at his home address.

As you can see in our email correspondence below and from the invoice above, she didn’t ask for rush service the first time she placed the order, hence, we didn’t include the fee for rush service.

She called and asked for rush service on March 2, 2023, so we sent her an updated invoice, as shown in the screenshot below.

on March 2, 2023, she called the Process Server in charge of serving her document to get a status update for her request. Coincidentally, the process server had just made the first attempt to serve her document at the time she called.

He explained to her on the phone that he rang the bell of the defendant three times, but no one came to answer the door. She asked if he had seen cars on the driveway and the process server said there was a jeep and one other vehicle in the driveway, to which she confirmed that one of the cars belonged to the defendant and the other belonged to the defendant’s daughter. Subsequently, the process server made a second attempt to serve the document within the same hour, but to no avail – no one answered.

The client emailed on March 6, 2023, saying she had just discovered that the defendant hadn’t been released from detention and instructed us to attend a new address to serve the defendant. (see screenshot of our email correspondence below). I replied to her email saying: since this is a new address, we will have to charge her separately, as we only offer up to three attempts at the same address. The logic behind this is to prevent clients from taking advantage of the three-attempts policy. For example, a client pays for service at a Scarborough address and then, later on, decides to change the address to an Oakville address after we have attempted service at the Scarborough address, thus, taking advantage of our three-attempts at one address policy.

However, she agreed to pay the new charges at a different address, so an invoice was sent to her on March 6, 2023. On the same day, the process server attended the new address at the Toronto Detention center, where the defendant was being detained. While the process server was there, the prison officer told him he couldn’t serve the defendant personally as it wasn’t allowed; as such, we dropped off the document with the prison officer and left.

On the same day, the client sent us an offensive email threatening to leave a 1-star review and defaming our company. Before that, she had sent an email saying that she could have sent lots of businesses and left a 5-star review, but because we didn’t accommodate her request to serve the document for free at the new address, she would not recommend us or leave a review (see screenshot of our email correspondence below.)

The client claims that we didn’t complete the job. Please see below commissioned affidavit of service, with details regarding the service of process on the defendant.

As you can see from the above explanation and as evidentiary shown in the screenshots, we did everything we could to serve her documents and acted according to the instructions provided. Despite completing the job, the client is still not satisfied.

False Allegation

The client is spreading false information about a business who thrives to facilitate court proceedings regardless of the risk involve.

Indeed, she is one of those clients many businesses prays to avoid coming across.

Her intent is malicious – deliberately orchestrated to damage our company’s reputation. We are currently seeking legal advice regarding this false information.
